Proposal – Cost Allocation Plan & Citywide Fee Study
Revenue & Cost Specialists, LLC (RCS) appreciates the opportunity to respond with this proposal to develop a Cost Allocation Plan and Citywide Fee Study. We have been providing fee studies and other costing services since 1980, making us the first and foremost expert in costing services for California. RCS’ skill set will generate maximum accountability for the City of Shafter. We have a history of delivering quality reports with defensible data that can be acted on and adopted.

Our processes are straightforward, analytical and require minimal staff time. In the end, we strive to ensure that the City of Shafter will be able to confidently stand behind the information and recommendations in the Report. As former city staff ourselves, we understand how Shafter operates, what you want, and that your time is precious.

Based in Fullerton, we can provide timely support to City staff for years to come. The terms of this proposal will be honored for 90 calendar days from the date of submittal. Please contact Eric at (714) 992-9027 or [email protected] with any questions.

Sincerely,
ERIC S. JOHNSON
President

SHAFTER PROJECT TEAM
While all RCS principals have worked independently on projects, Eric Johnson will be the project manager involved with the City of Shafter, and Chu Thai will provide off-site analysis and support.

RCS assigns two principals for several reasons. Often, both principals will attend the public hearing because two are better than one at convincing the policy makers. Two principals allow us to discuss high-level issues for each project. Most important to RCS, we want our principals to build long-term relationships with all our clients.

RCS may assign additional specialists to the project to help maintain the proposed schedule and ensure the quality of the product. For the sake of continuity, only RCS principals will interact with City staff, as our specialization and expertise will allow staff to focus on other City functions. We thoroughly understand and will be involved in every phase of the fee study, advising City staff when necessary.

RCS resumes for the project team are included in this proposal on the following pages.

FIRM’S EXPERIENCE AND REFERENCES

RCS HISTORY
Revenue & Cost Specialists, LLC (Taxpayer ID No.
330787781) was founded in 1980 by two former City
Managers and a Finance Director who, after the passage of Propositions 13 and 4, discovered that user fees were a legal option to recover lost municipal revenues. Four decades later, RCS continues its focus on cost allocation and fee calculation services.

After the passage of AB 1600 in 1988, our company added impact fee calculation services to help municipalities finance public facility expansion. In those early years, RCS principals published articles and presented at conferences, helping California municipal employees understand how fees work. Our early work is the foundation of how fees and cost allocation plans are calculated today.

In 2000, RCS created Government Software Systems to develop robust costing software that serves fee calculation needs better than spreadsheets. Our company has provided additional services to municipalities that include long-range financial planning, accounting procedures and utility rate studies.

RCS continues to thrive through repeat business, referrals and references. As a small business, RCS takes only a handful of new clients each year, allowing us to spend substantial time with them. In 2024, RCS celebrates its 44th year in business and is looking forward to another 40 plus years of partnering with municipalities.

QUALIFICATIONS
RCS’ principals make up the Limited Liability Company, which has been financially stable since the company started. Combined, RCS principals have over 100 years of experience in cost allocation plans and fee studies and served over 250 municipalities. We have provided these services for a wide array of public agencies, from the smallest special district to larger and more complex cities and counties. Though based in Orange County, we engage in projects throughout the State of California.

RCS principals specialize in:
 User Fee Studies
 Cost Allocation Plans
 Development Impact Fee Studies
 Special Financial Management Studies and Reports

Page 162 of 216 ends

Proposal for Cost Allocation Plan and Citywide Fee Study Page | 9
These specializations allow RCS to focus on every aspect of municipal fees and be the best of what we do. We are confident in our project time estimates and do not respond to RFPs when the project workload exceeds our capacity. We have suggested new fees that are not common practice throughout the state and have challenged and removed municipal fees that were not defensible. We have assisted municipalities in streamlining their fee-based processes.

All RCS principals have prior city experience, serving as analysts, managers or directors. We are all knowledgeable in fund accounting, department structures and municipal services. We stay current on pending financial and legal issues that challenge municipalities. All principals are comfortable speaking with city staff at all levels, drafting reports and resolutions, and presenting them to the public, stakeholders and City Council members.

Eric Johnson, President, has streamlined and perfected the process of CAP and User Fee Study engagements. With over 30 years and hundreds of studies completed, Eric has created a superior process that demands little staff time while obtaining maximum results. Eric quickly understands complex city services and how to calculate fees for them. He relates well with elected officials because he responds with candor and brevity. If you speak to any of Eric’s prior or current clients, they will tell you how easy the process was.

Chu Thai, Partner, joined RCS after 22 years of municipal experience. As a budget manager and finance director, Chu has successfully coordinated user fee increases, impact fee increases, utility rate increases and tax ballot measures. His experience helps clients avoid the unseen perils that jeopardize municipal projects. After project completion, Chu leaves behind well-documented reports and spreadsheets for City staff. The focus of his career has been to improve cities’ financial stability and implement operational effectiveness and efficiencies in local government.

Scott Thorpe, Senior Vice President, joined RCS in 1985. Before that, he spent 13 years at the cities of Chula Vista, Covina, Anaheim and Brea, serving in various roles within the city manager’s offices. Scott performed user fee studies for several years, transitioning to development impact fees when AB 1600 went into effect. He has written articles laying out the fundamentals of impact fees, and his work has generated tens of millions in fee revenues for cities.

Rick Kermer, Partner, was one of the founders of RCS. Rick used his CPA and audit experience to build cost allocation and user fee spreadsheets and software that passes rigorous analysis and reporting accounting standards. Rick’s work is the foundation of all the fee study work offered today. He is now semi-retired, taking only a handful of projects each year.

METHODOLOGY/PROJECT UNDERSTANDING
The City of Shafter wants to identify the full costs of all operational services that are either currently charged a fee or could be charged a fee.

RCS will first update the City’s Cost Allocation Plan
(CAP), which is necessary in calculating the fully
burdened hourly rates for employees and is an
effective way to distribute the overhead costs to other funds, departments, and the end-user services. Our
Cost Allocation Plan is powerful in capturing the
maximum overhead charges to enterprise funds. If
excluded from this Citywide Fee Study, RCS will use
the City’s prior Cost Allocation Plan.

Next, RCS will perform the fee study, reviewing the
staff time and program costs involved with each
service and calculating the full cost of services for each fee.

The proposed fee structure will recover these costs in the most equitable and efficient way possible. The user fees will represent how operations are conducted in the City, and may involve flat fees, deposits, valuation-based fees, step-increase fees, or a combination of these.

The eventual fee recommendations included in the final report and master fee resolution will be defensible, easy to understand, and be supported by City staff.

The most important part of our work is performed through a series of focused meetings with staff. Scheduled meetings commit staff to the timeline and ensure that our study draws from the most knowledgeable person on the subject matter. A series of meetings also gives City staff time to digest and reflect on the information generated. RCS uses only company principals with more than 20-plus years of experience to conduct these meetings, which makes the process quicker and the results more accurate. Our process provides the City with well-documented and defensible service costs that will be used to develop fees that comply with Propositions 4, 218 and 26.

We also identify 100% of the staff time on 100% of the services they provide. This gives City staff a complete perspective on their time allocations instead of merely looking at time allocations for individual services in a vacuum. These methods will ensure that City staff feels confident about the data and, therefore, confident in supporting the results in public hearings.

The other key result of identifying 100% of City services is that we are identifying not only the cost of fee services, but of community-supported services, such as public safety, street and park maintenance services. This allows us to have a real discussion with real numbers with the City Council about tax subsidy policy. Since we are identifying the full costs of fee services, we are also identifying the current subsidy of general tax dollars for these services.

Therefore, we can show the City Council how much fee services are subsidized at the expense

Page 164 of 216 ends

Proposal for Cost Allocation Plan and Citywide Fee Study Page | 11
of community-supported services. Does the City want to continue to use precious tax dollars to support, for instance, a bathroom remodel and permitting inspection that only benefits a particular property owner or use those tax dollars on things that can only be supported by tax dollars, like police patrol and park maintenance? They will now have that information to be able to make that conscious choice.

Changing the discussion from fee increases to tax subsidy policy along with RCS’ experience in successfully presenting the results of similar studies to City Councils ensures that the City will be able to meet its policy objectives.

RCS will provide the City of Shafter with the requested printed and electronic copies of the final versions of the Cost of Services Study and Cost Allocation Plan, including related schedules and cost documentation in a format that can be edited and updated by City staff to accommodate desired changes.

In the past five years, there have been no previous failures or refusals to complete a contract.

RCS makes it a point to follow through on tasks and establish clear lines of communication.

By maintaining open communication and being flexible with any challenges that come up, RCS aims to display our dedication to completing every contract we take.

Project Kick-Off
Task 1: Prepare City Data
RCS will review and prepare necessary files for the project. This includes obtaining and reviewing prior user fee reports and fee schedules, line-item budget details, salary schedules, MOUs and fringe benefit details.

Task 2: Kick-off Meeting
RCS will conduct a Citywide meeting, explaining the operational methodology of the study and the role of staff. We will review any possible issues that may arise as well as answer any questions from staff about the process. This meeting is crucial for the process as we want to ensure that everyone understands the various steps in the process and what is expected of them.

Cost Allocation Plan
Task 1: Identify Central Services and Allocate Staff Time RCS will meet with various departments to identify and review central services and allocate staff time and costs for those services. Examples of central services include payroll, risk management, and facility maintenance. City staff time involved in the meetings would be approximately 1-2 hours per central service department.

Page 165 of 216 ends

Proposal for Cost Allocation Plan and Citywide Fee Study Page | 12
Task 2: Develop Allocation Factors
RCS will meet with City staff to develop the allocation factors for each central service identified in the above task. These factors will form the basis for determining fully burdened hourly rates and allocating central service costs. This meeting will be concurrent with the time allocation meeting. Though City staff involvement in data gathering is a function of the availability of the required information, RCS will develop allocation factors that are easily reproducible from year to year but still equitably allocate central service costs. RCS will calculate allocations to the functional centers and review the results with the managers of the various central service departments.

City staff time to review the results of the allocations will be less than 1 hour per department.

Task 3: Prepare and Review Draft Cost Allocation Plan with City RCS will prepare a Draft Report with allocations to end user departments using our 20-step allocation model. RCS will review this Draft Report with the City’s management, making any necessary adjustments to ensure that costs are allocated properly.

Task 4: Prepare Final Cost Allocation Plan
RCS will then prepare a Final Report with allocations to end user departments. These results will be used for the general overhead component of the Fee Study and can also be used to determine the amounts for transfers to the General Fund for support provided to other funds. RCS will provide the City’s requested number of printed copies, as well as a PDF file of the Overhead Cost Allocation Study. RSC will also provide a computer-based model for adjusting these fees and charges for the City’s current and future needs, providing an electronic copy of the final study that can be edited and updated as needed. RCS will consult with City Staff as necessary to defend the cost allocation plan in the event of audits or other challenges.

User Fee Study
Task 1: Review the Service List with Staff
RCS will review the service list through meetings with City staff. We will also work with Departmental staff to determine any changes to the fee calculation methods. The end result, whichever method is used, will be a fee structure that best fits the City going forward. While this list will change during the course of the Study as it is refined, it will be the initial basis from where we start. City staff time for this review will be approximately 1 hour per department.

Page 166 of 216 ends

Proposal for Cost Allocation Plan and Citywide Fee Study Page | 13
Task 2: Staff Time/Contract Cost Allocations
RCS will interview personnel providing end-user services to ensure that costs from all functional areas directly involved with a service are included in the cost of that service. This component will form the bulk of the time spent by staff. There will be two to four meetings with supervisory level staff in each functional area to create and verify the amount of time spent by staff on the services identified in the task above.

We do not ask City staff to do our job by filling out forms detailing how they spend their time. This interactive process, and the fact that we allocate 100% of all departmental staff, ensures that the information being generated is valid and reliable.

Total time commitment per department varies from 2-20 hours, through a series of working meetings.

Task 3: Develop Fully Burdened Hourly Rates
RCS will develop a fully burdened hourly rate for each City employee, including salaries and benefits, miscellaneous operating services and supply costs, citywide overhead and departmental overhead.

Task 4: Prepare Draft Report
RCS will prepare a Draft Report that identifies the total costs for each service, along with current fees, and makes fee recommendations for each service presented as well potential new fees for services the City provides but does not charge for. Service costs will be compared with existing recovery levels. RCS will review this report with the departments so that each will have input on the fees presented in the Final Report.

City staff time would be approximately 1-2 hours per department for those departments that have fee services.

Task 5: Prepare Final Report
Based on staff input, RCS will prepare a Final Report, which will have recommendations for new fees, subsidy percentages and revenue projections from those fees. The Report will include text and summary tables that will clearly explain the results and the context. All recommended fees will comply with Propositions 4, 218, 26 and any other applicable laws. RCS will provide the requested number of copies and a Microsoft Word and PDF file of the Final Report. Any Master Fee Schedule revisions will also be made available in Word, Excel and/or PDF formats.

RCS will provide a computer-based model for adjusting these fees and charges for the City’s current and future needs, providing an electronic copy of the final study that can be edited and updated as the need arises and allowing for the requirements referred to in the City’s RFP. RCS will consult with staff as needed to defend the fee study in the event of audits or other challenges.

Page 167 of 216 ends

Proposal for Cost Allocation Plan and Citywide Fee Study Page | 14
Task 6: Present Report to the City Council
RCS will assist City staff, the City Council and any Committee in the review and adoption of revised service fees and subsidy percentages, at up to three public meetings. RCS will assist City staff in the implementation of the revised service fees.

PROJECT TIMELINE
RCS is available to begin work immediately with the proposed schedule outlined below. This schedule, of course, will require the cooperative participation of City staff.

ONSITE MEETINGSAND VIDEO CONFERENCING MEETINGS
RCS will utilize our Zoom account, or any video conferencing platform of the City’s choosing, to facilitate all working meetings. Our experience has determined that the use of video conferencing is more flexible in scheduling meetings, permitting City staff to quickly access reports and files on their computers, and allowing everyone to view and discuss the same documents at the same time. Department meetings will be 30 minutes to two hours each.

We would be on-site to present the report at all City Council meetings.

CLIENT INPUT
RCS will make every effort to advise, seek input from and, in general, explain the work as it is being performed. For a project to be completed successfully, we depend on dedicated and engaged staff participation. Most of the staff participation is to attend working meetings with RCS. There will be no “homework” to be completed and returned to us.

The City should also designate a Project Coordinator for the fee study who will:
1) Identify key City staff and coordinate the kick-off meeting(s) 2) Assist in obtaining requested information
3) Coordinate the review of draft reports, and
4) Provide project direction if needed

Master Lease Terms & Conditions

1. This Master Lease Agreement shall apply to any Order between Williams Scotsman, Inc. and/or any affiliate ("Lessor") and City of Shafter ("Lessee") for any Equipment as defined below ("Agreement"). This Agreement and any Order governs Lessee's use of Lessor's Equipment. By (1) signing this Agreement, (2) executing an Order that references this Agreement, (3) taking delivery of the Equipment, or (4) other commercially acceptable methods of acceptance, Lessee agrees to the terms of this Agreement.

2. Definitions
a. "Delivery Date" shall be defined as the date the Equipment was physically delivered. Within 48 hours of delivery, Lessee shall inspect the Equipment and notify Lessor in writing of any defects. Lessee must contact Lessor to relocate any Equipment and obtain Lessor's written consent prior to doing so. Lessee shall pay Lessor's relocation rates if the Equipment is moved without Lessor's written consent. Lessee acknowledges that delivery of Equipment may be in parts and not all at once.
b. "Equipment" means products leased from Lessor, which include Storage Containers, Refrigerated Storage Containers, Ground Level Offices ("GLO"), Modular Equipment, FLEX offices, Blast Resistant products, ancillary products and essentials, Additional Rental Equipment, and any additional products or services available for Lease from Lessor at the time of an Order. Any Lease for Equipment such as an Over the Road Trailer, Temporary Structure or other Equipment may be subject to an Addendum or Equipment specific terms and conditions. Lessee agrees Equipment shall not be used for residential occupancy.
c. "Lease" is defined as any Order for the Lease of Equipment by Lessee from Lessor. d. "Lessee" means in the case of an individual accepting this Agreement on his or her own behalf, such individual, or in the case of an individual accepting this Agreement on behalf of a company or other legal entity, the company or other legal entity for which such individual is accepting this Agreement, and affiliates of that company or entity (for so long as they remain affiliates), which have entered into an Order. e. "Order" means a WillScot document or online Order forming an individual Lease, specifying the Equipment to be provided hereunder that is entered into between Lessee and Lessor or any of their affiliates, including any addenda and supplements thereto. By entering into an Order hereunder, the Lessee or it's affiliate agree to be bound by the terms of this Agreement as if it were an original party hereto.

3. Lessee is responsible for all site conditions, use permits, and applicable Fees, and maintains sole responsibility for site selection, which shall be a flat, firm and open space, and prepared prior to Equipment Delivery as set forth in the Site Suitability Addendum, incorporated herein by reference.

4. If delivery of the Equipment is delayed through no fault of Lessor for a period of more than thirty (30) days from the confirmation date set forth in the Order, Lessee shall pay Lessor a storage fee equal to 50% of the Total Lease Charges for each thirty (30) day period of delay, or portion thereof, until the Equipment is delivered, in addition to any other Lease payments, charges and Fees due. Any such storage fees shall not affect commencement of the Minimum Lease Term.

5. Lessee is responsible to inspect and maintain the Equipment in good condition. Lessee shall use the Equipment in accordance with and be responsible for all maintenance as set forth in the Williams Scotsman Service Guide and/or any instructions contained in or on the Equipment.

6. Lessee shall maintain commercially reasonable insurance limits covering the Equipment's replacement cost. Lessee may obtain insurance for their contents at their discretion or can elect to participate in an optional third-party Contents Insurance Program provided through Lessor for a fee.

Optional coverage programs offered to Lessee include General Liability, Loss Damage Waiver and Content Insurance. Details can be found at https:// www.willscot.com/the-essentials/insurance-and-waivers-package.

7. Lessee shall provide no less than 15 days prior notice to schedule a pick-up date, and no less than thirty (30) days prior notice for any multi-floor Modular Equipment. Lessor shall not prorate any fraction of a Billing Cycle. Upon return, Lessee agrees to pay for all reasonable charges for cleaning, repair, and any damage beyond ordinary wear and tear. Lessee may have the option to pick-up and/or return certain Equipment, which shall be subject to signing an appropriate addendum.

8. LESSOR MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF

MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE AND LESSEE AGREES THAT IT HAS SOLELY DETERMINED THAT THE EQUIPMENT ARE SUITABLE FOR LESSEE'S INTENDED USE. LESSEE LEASES THE EQUIPMENT "AS IS, WITH ALL FAULTS."

9. Each Party agrees to defend, indemnify, and hold the other harmless for any third-party claim arising from the alleged conduct of the other Party under this Agreement. Neither Party shall be liable to the other Party for any special, punitive, exemplary, indirect or consequential damages, losses or damages for lost revenues or profits whether foreseeable or not, arising out of, or in connection with this Agreement.

10. This Agreement shall supersede and replace all prior documents and agreements between the Parties.

11. Lessee shall be solely liable for any and all applicable sales and use, lease or rental, excise, gross receipts, transaction privilege, value-added, goods and services, or similar transactional tax, levy duty or assessment imposed by a taxing authority ("Taxes"). Lessee shall pay or shall reimburse Lessor for any Taxes related to the Equipment.

12. Lessee's failure to make timely payments, filing of bankruptcy, abandonment of the Equipment or other failure to comply with this Agreement is a default, allowing Lessor to immediately terminate this Agreement, at which time Lessor has the right to pick-up and remove the Equipment upon reasonable notice or as required by law.

13. Lessee shall be solely liable for any and all applicable pass-through charges for costs associated with the Equipment including, but not limited to, ad valorem, real property, and ownership tax/personal property taxes, licensing and titling Fees, and any other expenses and/or third-party Fees associated with the Equipment ("Fees").

14. Except as otherwise stated herein, Lessor may amend the terms and conditions of this Agreement and such amended terms shall be effective thirty (30) days after notice is provided to Lessee. If Lessee does not object in writing to such amended terms before their effective date, such terms shall be deemed accepted. Lessee may not amend or assign this Agreement unless agreed to in writing by Lessor. Lessee may not sublet Equipment subject to this Agreement unless agreed to in writing by Lessor.

15. Lessee acknowledges this is a True Lease, and that ownership and title of any Equipment remains with Lessor, and Lessee has no right to ownership or to transfer or sell the Equipment.

16. In the event of any dispute over this Agreement, the Parties agree to waive a trial by jury and that venue shall be in the County or Parish where the Equipment was originally delivered.

17. To the extent permitted by applicable law, Lessee irrevocably and unconditionally authorizes Lessor to charge all amounts due under this Agreement to any credit card provided by Lessee.

Lease Agreement - Terms and Conditions
Rev. Mar 24

1. Lease
The transaction is a lease and not a sale. LESSEE does not acquire through this Lease or by payment of rental amounts, any right, title or interest in leased equipment, or any right to purchase such leased equipment. LESSEE acknowledges that the leased equipment is personal property and shall not, at any time, constitute real property, an improvement thereon or a fixture.

2. Rental Period
The rental period shall commence upon the date of delivery of the equipment by LESSOR to the LESSEE and continue until the termination date set forth in each Rental Order, or as earlier terminated as provided herein.

3. Determination of Rental Charges; Leased Equipment
LESSEE shall pay rent, on a monthly basis, in the amounts set forth in the Rental Order issued by LESSOR reflecting the negotiated rental rate and describing the leased equipment.

4. Payment
Payments are due on the first of each month in the amount described in each Rental Order and shall be deemed late if not paid by the 10th of each month, at which time a finance charge of 1% per month will be assessed until paid. Invoices issued by LESSOR are solely for LESSEE’s convenience and payment is due regardless of timely delivery of any invoice.

5. Access, Site Conditions, Utility Service
LESSEE shall provide free and clear access for delivery and return of leased equipment by standard mobile transport vehicles. LESSEE shall provide site that is dry, compacted with minimum 1,500 PSF, and level ground on no more than six-inch slope from one end to the other for safe installation and removal of the leased equipment. Site selection is the sole responsibility of LESSEE and LESSOR shall have no liability for determining the adequacy of any site. Furthermore, LESSOR solely reserves the right, for any reason, to refuse to release delivery and/or provide removal at any site it deems inadequate for use, installation and/or removal. LESSEE shall be responsible for obtaining any permits required to install, remove and operate the equipment. LESSEE shall provide at LESSEE’s expense site improvements, adequate electrical power, water and other utility services with proper connection to leased equipment and handicap accessibility to the building. LESSEE shall provide at LESSEE’s expense the disconnection of electrical power, water and other utility services prior to LESSOR’s pick up of the leased equipment.

6. Other Fees, Expenses and Taxes
In addition to the rental payments provided for herein, LESSEE shall pay all expenses, fees, charges, and fuel surcharges incurred in connection with the leased equipment during its delivery, use and return. Additional charges include, but are not limited to, the following instances: (1) where travel permits and/or pilots are required for delivery/return; (2) where the delivery site is not a level, compacted and accessible site; (3) where tie downs are required. The number of seismic tie-downs is estimated with assumptions to site surface and seismic zone. If engineering is requested, then the quantities will be adjusted to the engineered plans. If the tie down option is not taken, LESSEE assumes liability; (4) where alternate steps are needed (temporary steps furnished but steps may not meet all local codes); (5) where state/federal prevailing wages are required (unless quoted otherwise); (6) where axles, tires and tow bars need to be removed; (7) where extra trip charges are needed if LESSEE stops work in progress; (8) where grade for ramping is different than 30” to 36” from door threshold to ramp entrance; (9) where LESSEE delays the delivery of the equipment greater than 30 days from proposed delivery date. If LESSOR is unable to deliver the leased equipment due to LESSEE's site delays, a storage fee will begin thirty (30) days after the predetermined delivery date. LESSEE agrees to pay a pro-rated monthly storage fee at a rate of $1.00 per square foot of each floor until LESSEE is able to take delivery. If space is unavailable, LESSEE must either transport to an alternative site or LESSOR will do so unilaterally and pass the expense to LESSEE. If the leased equipment remains undeliverable after four months, the contracted rental rate will commence at that time; (10) where lease is cancelled prior to delivery of equipment and LESSOR has made modifications to the building or performed scope of work items. LESSEE also agrees to pay any fines, servicing costs, sales taxes, use taxes, personal or real property taxes and other use taxes, and all assessments and other governmental charges whatsoever payable on LESSEE’s use, possession, rental, shipment, transportation, delivery or operation thereof. If a lease is terminated early, the remaining contractual balance shall be immediately due and payable, unless waived by LESSOR in its sole discretion.

7. Delivery and Return of Leased Equipment
LESSOR shall not be liable to LESSEE for any failure or delay in delivering the leased equipment. By taking delivery thereof, LESSEE acknowledges that the leased equipment is in good working condition, free of any physical defect or damage, and is fit for the purpose for which it is leased. Further, the leased equipment shall remain at the delivery site until the termination of the lease, at which time LESSOR shall pick up the leased equipment. The leased equipment shall not be moved without LESSOR’s prior written consent. Two weeks’ notice is required prior to equipment return date. Rent is required to be paid until the leased equipment is picked up. Delivery and return costs will be quoted at time of rental. However, return costs are to be at the prevailing rate at termination of lease, thus they are subject to change depending on special circumstances such as fuel costs and delivery routes.

8. Eligible Use, Assignment, and Subletting
LESSEE shall use or permit the use of the leased equipment only for lawful purposes and operate in compliance with all laws. LESSEE shall use the interior of the equipment only for typical office, storage or restroom purposes and shall not in any scenario use the interior of the equipment for agriculture purposes. If the leased equipment is used by LESSEE or by any party in association with unlawful or ineligible purposes prior to it being returned to LESSOR, this shall result in an immediate DEFAULT of the lease. LESSEE agrees to reimburse LESSOR upon demand for any and all damages and incidental costs LESSOR incurs, including, but not limited to, time and cost expenses associated with participating in governmental administrative or law enforcement processes, attorney fees, and remedial costs. LESSEE shall not assign, transfer, sublet, or in any way assign its rights hereunder, and shall not pledge, permit to be liened, mortgaged, or otherwise encumber its rights or interests hereunder. All third-party claims of possession, interest or ownership by or through LESSEE as stated herein, shall be deemed invalid. LESSOR may assign its rights hereunder without notice to, or consent from, LESSEE.

9. Non-Liability of LESSOR and Indemnification
Unless caused solely by LESSOR’s gross negligence or willful misconduct, LESSOR shall not be liable to LESSEE for any third party claims, actions, suits or proceedings of any kind and nature whatsoever, including any damages, liabilities, penalties, costs, expenses and reasonable consultant and legal fees based on, arising out of, connected with or resulting from the leased equipment or by the use, maintenance, operation, handling or storage thereof, for the loss of LESSEE’s business or damages whatsoever or howsoever caused or for LESSEE’s obligations under this Lease (hereinafter “Claim(s)”), including, without limitation, Claims relating to ownership, use, possession or disposal of the leased equipment, Claims arising in contract or tort (including negligence, strict liability or otherwise), Claims arising out of latent defects of the leased equipment (regardless of whether the same are discoverable by LESSOR or LESSEE), Claims arising out of or relating to the violation of applicable law, including environmental law, or the existence or release of hazardous materials at the site where the leased equipment is located, or Claims arising out of any trademark, patent or copyright infringement, but excluding (a) any Claims that accrue in respect of circumstances that occur after LESSOR has taken possession of the leased equipment after termination of this Lease, provided that such Claims do not relate to LESSEE’s use, possession or operation of the leased equipment, or (b) any Claims that result from the gross negligence or willful misconduct of LESSOR. If any Claim is made against LESSEE or LESSOR, the party receiving notice of such Claim shall promptly notify the other, as set forth in Section 11, but the failure of such person receiving notice to notify the other shall not relieve LESSEE of any obligation hereunder. LESSEE shall indemnify, defend and hold harmless LESSOR, its employees and agents from any and all losses, damages, claims, demands, or liability of any kind whatsoever, including legal expenses and attorney’s fees arising from the use, condition or operation of the leased equipment.

10. Insurance Requirements
LESSEE, at its sole cost and expense, will obtain and keep in force, from the delivery date until the removal of the equipment, the following policies:
(a) Blanket Commercial General Liability Insurance providing coverage on ISO form CG 00 01 or a substitute providing equivalent coverage, and subject to policy limitations or exclusions reasonably acceptable to LESSOR, in the amount of not less than $1,000,000 per occurrence, naming LESSOR as additional insured and endorsed to state that it shall be primary and non-contributory insurance as respects to LESSOR’s insurance. All insurance held by LESSOR shall be excess, secondary and non-contributory as respects to LESSEE’s insurance. i. If LESSOR does not receive the general liability certificate prior to delivery, then the LESSEE will pay a monthly non-insurance penalty fee for each month that the LESSEE fails to provide the required certificate of insurance. Such fees shall be calculated by LESSOR at its then prevailing rate(s) and will not be refunded in arrears. LESSOR is not an insurance company and the fee is not an insurance policy. (b) Commercial property Insurance, providing coverage under ISO Cp 10 30, Causes of Loss-Special Form or the equivalent, and subject to policy limitations or exclusions reasonably acceptable to LESSOR, for an amount no less than 100% of the replacement cost of the leased equipment as established by LESSOR, with

If LESSOR does not receive the property insurance certificate as required prior to delivery or if the LESSEE selects the property Damage Waiver, then the LESSEE will automatically be enrolled in the property Damage Waiver program (program). LESSOR is not an insurance company and the program is not an insurance policy. The program only covers damage caused by fire, theft, vandalism and malicious mischief. The LESSEE is responsible for the first $2,000 in damages, per unit/per loss occurrence. The program only covers the unit itself, and LESSEE is responsible for insuring the contents. The program does not cover property damage caused by any of the following: (a) acts of God (earthquake, seismic activity, high winds, hurricane, tornado, flood), (b) acts of terrorism, (c) building contents, (d) damages caused by LESSEE or its employees, (e) collision damage from vehicles and other equipment, (f) collision damage while being transported or moved, or (g) abuse or neglect by LESSEE. The responsibility for property damage due to these perils is on the LESSEE. either party can cancel the program with ten (10) days prior written notice. If the program is canceled, the LESSEE must provide property insurance as required under section 10(b). All program fees must be paid in order for this option to be valid. If the LESSEE fails to pay their rent or the program fees, the program will be terminated automatically. Fees will not be refunded in arrears. Claims must be reported to LESSOR by fax or email within 48 hours of their occurrence.

LESSEE shall be liable for all deductible portions of all required insurance. LESSEE will deliver certificates evidencing all such insurance to LESSOR prior to delivery of the equipment, provided, however, that LESSOR shall be under no duty either to ascertain the existence of or to examine such insurance policies or to advise LESSEE in the event such insurance coverage shall not comply with the requirements hereof. each insurer shall agree by endorsement to the policy or policies issued by it or by an independent instrument furnished to LESSOR, that it will give LESSOR at least ten (10) days’ prior written notice of cancellation of the policy for nonpayment of premiums and at least thirty (30) days’ prior written notice for alteration or cancellation due to any other reason or for non-renewal of the policy. If the insurers are unable to or unwilling to provide such notice, LESSEE shall provide such notice. All required insurance shall be maintained with insurance companies rated A- X or better by AM Best (or an equivalent rating by another nationally recognized insurance rating agency of similar standing) or with other insurance companies satisfactory to LESSOR.

11. Accidents or Claims
LESSEE shall within 24 hours after any property damage or casualty event involving the leased equipment notify LESSOR by telephone, and within 48 hours notify LESSOR in writing. Said report shall state the time, place, and nature of the event, the damage sustained, the names and addresses of persons involved, persons injured and witnesses, and any other information relating to said event and it shall promptly forward to LESSOR all correspondence, notices or documents received in connection with any claim or demand relating to the leased equipment or its operation, and shall aid in the investigation and defense of all such claims and demands.

Nothing herein shall be deemed to modify the provisions of the paragraph herein in which LESSEE holds LESSOR harmless and indemnifies LESSOR against all these matters, and LESSOR shall have no responsibility to take any action whatsoever in the event of such casualty.

12. Maintenance and Damage
LESSEE shall at LESSEE’s own expense, and at all times, keep the equipment in good and efficient working order, condition and repair and shall maintain thereon such identification of ownership as LESSOR may require. LESSOR will maintain and make any repairs required from normal use to the roof, doors, windows, light fixtures, heating, ventilating and air conditioning systems (HVAC), except that LESSEE shall replace HVAC filters, light bulbs and ballasts as required and pay for any damage caused by the LESSEE. LESSEE shall bear the risk of damage, theft or destruction of the leased equipment from every cause, except as outlined in paragraph 10(b) (i), if selected and shall make all replacements, repairs or substitution of parts of equipment thereon at its expense, all of which shall constitute LESSEE’s obligatory maintenance of the leased equipment. If LESSEE does not adequately maintain the equipment or adequately repair any damage for which LESSEE is responsible, LESSOR shall have the option to perform the maintenance or repair at LESSEE’s expense. LESSEE shall at its expense provide adequate janitorial service to keep the leased equipment in good condition, fair wear and tear excepted. On termination of this lease, the leased equipment shall be returned to LESSOR in the same condition as when delivered, fair wear and tear excepted. In the event that the leased equipment is completely destroyed beyond repair, LESSEE shall continue to pay rent to LESSOR, until the LESSOR is made whole through receipt of full payment for the replacement cost of the leased equipment.

13. Inspection by LESSOR
LESSOR may inspect the leased equipment at any reasonable time and may provide a notice of non-responsibility or preservation of LESSOR’s interest.

14. Default
An event of default will have occurred if LESSEE: (a) does not pay rent when due, or otherwise fails to perform as required under this Lease or under any other agreement with LESSOR, (b) becomes insolvent, assigns its assets for the benefit of creditors, or enters (voluntary or involuntarily) into a bankruptcy or receivership proceeding, (c) shall suffer an adverse material change in its financial or business condition from the date hereof and as a result LESSOR deems itself insecure or (d) uses the equipment in an ineligible way, such as use of the interior of the equipment for agriculture purposes, which is prohibited.

15. Remedies
Upon the occurrence of an event of default, LESSOR may, in its sole discretion, (a) do one or more or the following with respect to all or part of the leased equipment, concurrently or separately: (i) demand the return of the leased equipment, (ii) enter upon LESSEE’s premises and without any court order or other process of law, repossess and remove all or part of the leased equipment, or render the leased equipment unusable without removal, either with or without notice to LESSEE and with or without terminating this Lease, and LESSEE hereby waives any trespass or other right of action for damages by reason of such entry, removal, or disabling of the leased equipment, (iii) proceed by appropriate court action or actions either at law or in equity to enforce performance by LESSEE of the applicable covenants of the Lease, (b) demand and recover judgment for the remaining balance of all rent due through the remaining term of the lease, and recover all other amounts due hereunder and any other damages caused by such default, and (c) exercise any other remedies available under the Uniform Commercial Code or any other law. All of LESSOR’s rights and remedies hereunder and at law and in equity shall be cumulative; any waiver of such rights or remedies must be in writing, and a waiver of LESSOR’s rights or remedies on one occasion shall not constitute a waiver of any other existing or future right or remedy. Should LESSOR be required to take possession of the leased equipment, LESSEE agrees to pay the cost of repossession, storing, shipping, and repairing the leased equipment.

16. LESSEE’s Possession on Termination
If LESSEE retains possession of the leased equipment beyond the Rental Order term expiration date without proper written renewal notice, LESSOR shall have the option of (a) deeming this Lease renewed as a month to month tenancy per LESSOR’s standard rental rates at such time, as determined by LESSOR in its sole discretion, or (b) repossessing its leased equipment and other property at any time without notice.

17. Attorney’s Fees, Collection Fees, Interest
If LESSEE defaults on this Lease, LESSOR shall be entitled to recover from LESSEE all items of damages, costs and expenses, including court costs, reasonable attorney’s fees and repossession fees, incurred by LESSOR to enforce its rights and remedies hereunder, whether suit is filed or not, and including all attorneys’ fees and costs incurred in any bankruptcy proceeding. LESSOR shall also be entitled to interest on delinquent invoices at the rate of 1.0% per month or the maximum rate permitted by law until such invoice is paid in full.

18. Miscellaneous; Consent to Jurisdiction; Jury Waiver This Lease shall be construed and interpreted under the laws of the state in which the equipment is located. LESSEE consents to the jurisdiction of state and federal courts located in the state of Washington for the determination of all disputes arising under this Lease. All signed copies shall constitute duplicate originals.

THE PARTIES WAIVE ANY RIGHT TO TRIAL BY JURY. The Parties shall endeavor to resolve their disputes by first discussing any such disputes in person and in good faith. If the Parties' direct discussions fail to resolve any and all issues, any controversy or claim arising out of or relating to this Lease, its enforcement or interpretation or because of an alleged breach, default or misrepresentation in connection with any of its provisions, shall be resolved by arbitration pursuant to the Construction Industry Arbitration Rules of the American Arbitration Association.

19. Entire Agreement
This Lease, and any Rental Order issued in connection herewith, contains the entire agreement between the LESSOR and LESSEE and may not be altered, modified, terminated or otherwise changed unless agreed to in writing by LESSOR. This Lease contains the entire understanding of the parties and supersedes any other document from the LESSEE or any other agreement, including verbal, among the parties.

20. Notices
All notices required under the terms and provisions of this Lease shall be in writing and shall become effective three (3) days following mailing if mailed by US certified mail, or upon receipt if given in any other manner, addressed to pacific Mobile Structures at PO Box 1404, Chehalis WA 98532, and to LESSEE set forth on the face page hereof, or at such other address as either party may designate in writing. The payment remittance address is to pacific Mobile Structures at PO Box 24747, Seattle WA 98124.

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: January 21, 2025
DEPARTMENT: Randy Milligan, Police Chief
SUBJECT: POLICE DEPARTMENT WORKSTATIONS PURCHASE

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; approve the expenditure for work-stations per the quotes provided by Stinson's for a total expenditure of $32,456.61.

BACKGROUND
The County of Kern is the recipient of an allocation from the State of California under Assembly Bill Number 33 of 2023- Fentanyl Misuse and Overdose Prevention Task Force, introduced by Assembly Member Jasmeet Bains for awarded agencies to provide various duties relating to Fentanyl Misuse.

The police department presented a project proposal that met the requirements and objectives of Assembly Bill 33 and was awarded seven hundred thousand dollars ($700,000) that will be used for preventing, enforcing, and treating fentanyl misuse.

The police department was given discretion over the allocation and expenditure of the one-time funds provided in the agreement. Under the categorical section of Training and Equipment, the police department provided an estimated allocation of $105,000, including administrative costs essential for the support and operation, which workstation would be needed for the added personnel working the Fentanyl Task Force outside the police department's normal operations.

The police department will need more workstations to support the added personnel working the Fentanyl Task Force assignment. Additionally, with inclusion of new authorized officer positions and police trainees assigned to the field training program, the police department needs to restructure the current workstations to add more workspace.

The police department received two quotes:

One quote for $12,396.61 for four workstations to be purchased with Fentanyl Task Force funds.

A second quote for $20,060.00 for six additional workstations will be purchased with the Department's operating budget 24/25.

Page 187 of 216 ends

POLICE DEPARTMENT WORKSTATIONS PURCHASE
- 2 -
These essential furnishings will meet immediate operational needs, supporting Fentanyl Task Force efforts and current patrol operations. The total quoted cost for ten workstations is $32,456.21.

FISCAL IMPACT
Purchases from the awarded funds will be paid by the State of California under Assembly Bill Number 33 of 2023 – Fentanyl Misuse and Overdose Prevention Task Force with the remaining funds from Public Safety Impact Fees.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is the approval to purchase computer workstations and therefore, it is the creation of a governmental funding mechanism or other fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: January 21, 2025
DEPARTMENT: Randy Milligan, Police Chief
SUBJECT: AT&T EXTENDED MAINTENANCE CONTRACT APPROVAL

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; approve the expenditure for an extended maintenance contract per the quote provided by AT&T for the reimbursable amount of $40,423.96.

BACKGROUND
In 2022, the Police Department contracted with NGA-911 through California Office of Emergency Services (CAL OES) to replace the Call Processing Equipment (9-1-1 Telephone System) in the Public Safety Answering Point (PSAP). NGA-911 has failed to go live with the new equipment, and the department is currently negotiating with CAL OES to switch back to AT&T as our 9-1-1 provider, as other 9-1-1 PSAPS are doing.

The police department still operates with AT&T; however, the VESTA CHE maintenance expired on 9/7/2024. AT&T will continue to cover maintenance. However, the contract must be extended another year to avoid being moved to a Time and Material billed response. CAL OES has agreed to reimburse for the additional year of maintenance.

It is necessary to extend the AT&T contract 1 year in the amount of $40,423.96 to avoid a Time and Material billing response as staff works to secure AT&T as our 9-1-1 provider or await NGA-911 to go live with the new equipment.

FISCAL IMPACT
No additional budget action is required, as the AT&T expense is already included in the communications line item of the current FY 2024/25 operating budget.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is the approval to purchase an extended maintenance contract and therefore, it is the creation of a governmental funding mechanism or other fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: January 21, 2025
DEPARTMENT: Michael James, Public Works Director
SUBJECT: COUNCILMEMBER VOLUNTEERS FOR NORTH SHAFTER

TRANSPORTATION IMPROVEMENTS AND SUSTAINABILITY

PLAN AD HOC ADVISORY COMMITTEE

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(5) of the CEQA Guidelines; authorize two (2) Councilmembers to volunteer to serve on an ad hoc advisory committee for providing input on the development of the North Shafter Transportation Improvements and Sustainability Plan.

BACKGROUND
The communities of North Shafter and North Park were originally developed before being annexed into the City. Upon being annexed in the early 1990s, the City led initiatives to extend municipal water and sewer service to the residents there. However, they still lack safe and reliable transportation amenities like sidewalks, crosswalks, signage, bicycle lanes, and lighting.

In 2023, the City was awarded State funds through the Sustainable Transportation Planning Grant Program for completing the North Shafter Transportation Improvements and Sustainability Plan. The funding for the plan totals $205,000, which includes $181,486 in grant funds and a local match of $23,514. Last year, the Council authorized awarding a professional services contract to a consultant to prepare the plan.

Engaging with the local community and stakeholders is key to developing a successful plan. In its application for the grant funds, the City proposed an ad hoc advisory committee to participate in meetings with the public and the consultant. In addition to providing the public a role in the plan development, the meetings allow select Councilmembers to give input and suggestions. This feedback is critical, particularly in prioritizing future street improvement projects. The committee would only be in place for the grant process and plan development.

Three (3) advisory meetings are anticipated before the plan is finalized and submitted to the full Council for adoption. The plan will later be used in applications for future construction grants upon adoption.

AND SUSTAINABILITY PLAN AD HOC ADVISORY COMMITTEE
- 2 -
Costs to conduct the advisory committee meetings are being funded through the funding committed to the project (CIP Project #ST00022). No budget action is required.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(5) of the CEQA Guidelines because the action is to authorize two Councilmembers to be part of an ad hoc committee and therefore, it is organizational and administrative activity that will not result in direct or indirect physical changes to the environment and not subject to CEQA.

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: January 21, 2025
DEPARTMENT: David Franz, Community Services Director, Michael James, Public Works Director, Giovanni Perez, Economic Development
Coordinator
SUBJECT: CENTRAL AVENUE BUSINESS WALK, PARKING SURVEY, AND

TRAFFIC DATA DISCUSSION

RECOMMENDATION
Discuss possible parking remedies on Central Ave and provide guidance to staff.

BACKGROUND
Staff has been in communication with the downtown businesses on Central Avenue about parking for customers. A forum was hosted by staff at City Hall this past September to discuss the parking issues and suggest possible remedies. Attendance was limited, and staff was compelled to conduct additional outreach to ensure the input received was as comprehensive as possible before the Council considered formal action. The Community Services Director and Public Works Director brought to the council a discussion item on this topic back on November 19, 2024. As a result of this discussion with the Council, staff was directed to look into the following three areas and present possible remedies:

1. Business Walk – Heard from as many businesses as possible on their thoughts on parking downtown

2. Surveys – Completed in-person during the business walk or left a QR code for the business to share their thoughts. Available in both English and Spanish.

3. Traffic Data – Acquired the Annual Average Daily Car Traffic The focus area for this discussion is Central Avenue from Lerdo Hwy to Kern St.

The Business Walk was conducted by the City Manager, Community Services Director, Public Works Director, and Economic Development Coordinator on Thursday, January 9, 2025, in the afternoon.

Business Requests:
• Dedicated Downtown Business Employee Parking
• Enhanced Handicapped Parking
• Diagonal Parking Spaces on Central Avenue from Walker St to Kern St

Page 207 of 216 ends

CENTRAL AVENUE BUSINESS WALK, PARKING SURVEY, AND TRAFFIC DATA DISCUSSION - 2 -
• Public Awareness Campaigns such as encouraging Shafter's Dial-a-Ride Program or shared parking agreements between neighboring businesses • Create wayfinding signage directing to underutilized parking areas • Start a reimbursement program for back lots behind multiple businesses Key findings for Central Ave are shared below:
• Vehicle Traffic: 3,775 AADT
• On-Site Parking: 41% of 42 active businesses to survey have on-site parking available typically in the back of the business with access granted via an alleyway
• Survey Respondents: 52% of 42 businesses shared their thoughts • Parking Concerns: 59% of respondents highlighted parking as a concern. • Support for Parking Limits: 54% did not support parking limits (1-2 hours), with 32% believing a limit could hurt their business.
• Common Thoughts Shared: Over 50% of respondents shared that both employees and customers mainly park anywhere open on the street with preference being the front of the business. Some businesses shared that their on-site parking conditions are not “good” leading them to park in the front or anywhere open on the street.

The survey consisted of 9 questions with the main focus to gather information on parking situations for downtown. The prominent questions fueling the discussion are:
• Is parking an issue for your business?
• Where do employees usually park?
• Where do customers usually park?
• Rate from 1 (Not Very Likely) to 5 (Most Likely) how likely would a parking limit negatively impact your business?
• Are you in favor of introducing a parking limit downtown, even on a short-trial basis?
Vehicle traffic data (Average Annual Daily Traffic, or AADT) provided by Placer.ai shows the following information:
• Central Ave from Lerdo Hwy to Kern St: 3,775 AADT
• Munzer St from California Ave to Pacific Ave: 1,450 AADT • James St from California Ave to Pacific Ave: 2,740 AADT • Kern St from California Ave to Pacific Ave: 830 AADT
A full summary report is attached.

FISCAL IMPACT

Page 208 of 216 ends

CENTRAL AVENUE BUSINESS WALK, PARKING SURVEY, AND TRAFFIC DATA DISCUSSION - 3 -
City resources, including staff time to prepare parking-related surveys and policy action, can be covered by existing operational accounts without budget action by the Council. Should parking restrictions be desired by the Council, budget action may be necessary to ensure there is funding for street signage and striping, which would be requested before any purchases or installation work.

CEQA ANALYSIS
This item does not require discretionary action as it is for informational purposes only.

Therefore, it does not trigger CEQA review.

Business Walk: Central Avenue
Executive Summary
Parking on Central Avenue has been brought to the city as an item to look into and explore solutions. City Council directed staff to conduct: 1) a Business Walk, 2) a Parking Survey, and 3) a Traffic Data Analysis. Recent data and survey feedback from Central Avenue’s different areas highlight the complexity of the issue and reveal some opportunities for collaborative solutions:

Key Insights from the Data:

Central Avenue Overall:
 Vehicle Traffic: 3,775 AADT
 On-Site Parking: 41% of 42 active businesses to survey have on-site parking available typically in the back of the business with access granted via an alleyway  Survey Respondents: 52% of 42 businesses shared their thoughts  Parking Concerns: 59% of respondents highlighted parking as a concern.  Support for Parking Limits: 46% supported parking limits, with 32% believing a limit could hurt their business.
 Common Thoughts Shared: Over 50% of respondents shared that both employees and customers mainly park anywhere open on the street with preference being the front of the business. Some businesses shared that their onsite parking conditions are not “good” leading them to park in the front or anywhere open on the street.

Possible Remedies
Building on these insights, possible strategies to address parking challenges are as follows:
 Dedicated Employee Parking: Establish designed lots for downtown business employees to free up high-demand spaces for customers.
 Enhanced Handicapped Parking: Explore the feasibility and process of increasing handicapped parking. Share with applicable businesses.
 Wayfinding Signage: Direct visitors to underutilized parking areas  Reimbursement Parking Program: Explore the feasibility of starting a reimbursement program for business owners to improve their back lots for downtown employees  Walker St-Kern St: Explore the feasibility of diagonal parking spaces.  Public Awareness Campaigns, such as:
 Encourage Shafter’s Dial-a-Ride program
 Encourage shared parking agreements between neighboring businesses A collaborative approach can address parking concerns while supporting businesses, accessibility, vibrancy, and welcoming nature.
