AWARD PROFESSIONAL SERVICES AGREEMENTS FOR BUILDING PLAN REVIEW AND

firms will allow the Building Department to assign work based on project needs, consultant expertise, and availability, thereby improving operational flexibility and maintaining efficient permit processing timelines.
The proposed agreements are for a one-year term beginning July 1, 2026, and ending June 30, 2027. Combined expenditures under the agreements will not exceed $300,000 and will be administered collectively, allowing staff to utilize any of the consultants as needed without exceeding the approved budget authority.
FISCAL IMPACT
No additional budget action is required. The proposed FY 2026-27 Building Department operating budget includes $300,000 in professional services funding for plan review and inspection support. Costs associated with these services will be recovered through building permit and application fees, resulting in no net fiscal impact to the City.
CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the approval of a professional services agreement for building plan review and inspection services and therefore, it is the creation of a governmental funding mechanism or other fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

CORNERSTONE 19
Cornerstone provides comprehensive Building and Safety Support Services with efficient, reliable, and code-compliant solutions. Services include permitting, plan review, field inspections, and code enforcement, all delivered with a focus on accuracy, consistency, and customer service. By combining technical expertise with a clear understanding of regulatory requirements, we help streamline development processes, ensure public safety, and maintain compliance with applicable building codes, zoning regulations, and local ordinances while serving as a seamless extension of the jurisdiction’s building department.
Plan Review
The plan review process serves as an essential quality control step to confirm that proposed building projects adhere to all relevant codes, regulations, and safety standards before construction begins. During this stage, building and safety specialists carefully evaluate architectural, structural, mechanical, electrical, plumbing, and energy plans to ensure design compliance with state and local requirements. The review includes checking for proper occupancy use, fire and life safety measures, accessibility provisions, and structural soundness. When issues or inconsistencies are identified, detailed comments are issued to help applicants make the necessary revisions. Once all corrections are resolved and the plans meet code requirements, approval is granted—allowing the project to move forward to the permit stage with confidence and compliance.
Structural
Licensed engineers and qualified plan examiners evaluate structural drawings and calculations to verify that the proposed design can safely support anticipated loads, resist seismic and wind forces, and maintain structural integrity throughout the building’s lifespan. The review process includes checking materials, foundation systems, framing, lateral force-resisting systems, and connections to confirm code compliance and design accuracy.
Architectural
Our team will evaluate building design documents to ensure compliance for life safety, accessibility, occupancy, and overall building functionality. Additionally, we examine the building layout, exits and egress, fire-rated assemblies, accessibility features, and energy efficiency requirements. The goal is to verify that the proposed design provides safe, functional, and code-compliant spaces for occupants. This review also helps identify potential design conflicts early in the process, facilitating timely corrections, reducing project delays, and supporting the successful approval and construction of the project.
Plumbing | Mechanical | Electrical
Plan review services for plumbing, mechanical, and electrical (PME) systems are performed with a thorough, codedriven approach to ensure full compliance with all applicable local, state, and national regulations. Each review evaluates system design, load calculations, equipment specifications, energy efficiency requirements, and in coordination with architectural and structural plans to identify potential conflicts early in the process. By emphasizing accuracy, constructability, and life-safety considerations, we help streamline the permitting process, reduce revisions, and support efficient project delivery while ensuring that all PME systems are safe, reliable, and designed to perform as intended. Accessibility
Cornerstone’s team of CASp-certified professionals brings extensive expertise in both state and federal accessibility laws, ensuring full compliance with the California Building Code and ADA standards. Our experienced architects and plans examiners offer specialized plan review, evaluation, and consultation services designed to help municipalities and building departments enhance accessibility and meet regulatory requirements. We tailor our services to each client’s goals and collaborate closely to resolve plan review and inspection matters efficiently, resulting in a smoother approval process and successful project delivery.
Fire Life Safety
Our fire plan check services involve a comprehensive review of fire protection and life-safety systems to verify compliance with applicable fire codes, building codes, and local amendments. This includes evaluating fire sprinkler and alarm systems, fire-resistive construction, means of egress, occupant loads, fire access, and emergency systems to ensure coordinated and effective fire protection throughout the project. By identifying deficiencies and coordination issues early, we help expedite approvals, minimize revisions, and ensure that fire protection measures are properly integrated to safeguard occupants, property, and first responders.
Methodology
The plan review process involves evaluation of construction documents to ensure compliance with applicable building codes and local ordinances. Submitted plans are reviewed by qualified professionals across multiple disciplines—such as structural, architectural, mechanical, electrical, plumbing, and fire/life safety— to verify code compliance, design coordination, and constructability.
Comments and corrections are prepared and returned to the applicant for revision, with follow-up reviews conducted as needed.
This collaborative and structured process helps identify potential issues early, promotes safe and code-compliant construction, and supports an efficient and transparent permitting process.
Electronic Review
Electronic plan review is provided using digital platforms that allow for timely review, markup, and tracking of documents. This process enables reviewers to provide clear, detailed comments, facilitate quicker revisions, and maintain accurate records. Electronic plan review enhances coordination among jurisdictions, applicants, and design teams by improving accessibility and transparency, reducing turnaround times, and supporting a streamlined, environmentally responsible review process while maintaining the same level of technical rigor and code compliance as traditional reviews.
Correction Lists
Our team will prepare clear, thorough correction lists that identify code deficiencies, coordination issues, and required revisions in an organized and easy-to-understand format. Each correction is supported by applicable code references and concise explanations to assist applicants and design teams in efficiently addressing comments. Our well-structured and consistent correction lists help reduce repeat submittals, promote timely approvals, and support a transparent and collaborative review process that maintains a high standard of code compliance and public safety.
Project Management Portal
We utilize a cloud-based project management system that allows applicants, design teams, and jurisdiction staff to track the status of plan reviews in real time. This system provides secure, centralized access to project documents, review comments, and approval progress, enabling all stakeholders to monitor updates, revisions, and
CORNERSTONE 21
pending actions efficiently. By offering transparency and easy communication through the platform, we streamline coordination, reduce misunderstandings, and support timely decision-making, ensuring that plan reviews and related processes are managed smoothly and effectively from submission to approval.
Turnaround Times
We will provide a predictable and timely turnaround for plan reviews, recognizing that prompt feedback is critical to keeping projects on schedule. Clear review timelines based on project complexity, scope, and jurisdiction requirements provide efficient and thorough evaluations in order to minimize delays. Cornerstone’s combination of experienced staff, standardized review procedures, and effective communication will ensure that plan review comments are delivered within the agreed-upon timeframes.
Transportation of Plans
Reliable pick-up and delivery services for plans and construction documents to and from the jurisdiction, ensuring that all materials are handled securely and arrive on time. Our team coordinates closely with the jurisdiction and project applicants to schedule pickups and deliveries that align with project timelines, minimizing delays in the plan review and permitting process.
Meetings | Communication
We place a strong emphasis on collaboration and maintain a high level of availability to meet with jurisdictions, project applicants, and design teams throughout all phases of a project. Our staff is willing to participate in in-person or virtual meetings to discuss project requirements, clarify code interpretations, and resolve plan review or inspection-related issues in a timely and cooperative manner. An open communication and a solutionoriented approach results in mutual understanding, reduce delays, and support efficient project delivery while ensuring full compliance with applicable codes and regulations.
Permit Issuance
Permit issuance is an essential step in the City’s development process, serving as the official authorization for construction, renovation, or occupancy to begin. Before a permit is granted, plans are reviewed to ensure compliance with building codes, zoning ordinances, and safety regulations, protecting both the community and future occupants.
The issuance of permits helps cities manage orderly growth, safeguard infrastructure, and uphold standards for structural integrity, fire safety, and environmental responsibility. By requiring permits, municipalities create accountability for builders and property owners while providing a transparent record of development activity that benefits public safety and community planning efforts.

Building Inspection
Building inspection is the one of the final steps in the process of permit issuance that ensures structures are safe, compliant with codes, and built according to approved plans. During an inspection, qualified inspectors carefully examine construction work at various stages—such as foundation, framing, electrical, plumbing, and final completion—to verify that materials, workmanship, and design meet local building and safety regulations. Inspections help identify potential hazards, prevent costly mistakes, and ensure the long-term integrity of a building. By serving as a safeguard for property owners, occupants, and the community, building inspections play a vital role in protecting public health, safety, and welfare while promoting confidence in the construction process.
Code Enforcement
A code enforcement officer is responsible for ensuring that properties and activities within a community comply with local codes, ordinances, and regulations. Their duties include responding to complaints, conducting field inspections, and identifying violations related to building safety, zoning, property maintenance, signage, and other municipal standards. They issue notices of violation, prepare reports, and may coordinate with other departments or legal entities to resolve issues and pursue enforcement actions when necessary. In addition to enforcing regulations, code enforcement officers often educate property owners and the public about compliance requirements, working collaboratively to achieve voluntary corrections whenever possible. Through these responsibilities, they play a key role in protecting public health and safety, enhancing neighborhood appearance, and supporting the overall quality of life in the community.

CITY OF SHAFTER
CITY COUNCIL REPORT
MEETING DATE: June 2, 2026
DEPARTMENT: Michael James, Assistant City Manager
SUBJECT: POLICE DEPARTMENT OFFICE AND TECHNOLOGY SPACE
IMPROVEMENTS
RECOMMENDATION
Council find that the project is exempt from the California Environmental Quality Act; approve the establishment of a new capital improvement project in the amount of $100,000 for office and technology space improvements at the Police Department building located at 201 Central Valley Highway; authorize the use of salary savings from unfilled Police Department positions to fund the project; and authorize Staff to solicit, receive, and award proposals consistent with the City’s bidding and procurement policies.
BACKGROUND
Staff has identified a need to establish a new capital improvement project in the amount of $100,000 for office and technology space improvements at the Police Department building located at 201 Central Valley Highway.
The proposed office space improvements consist of converting an area previously used as an employee gym into two offices to accommodate lieutenant personnel. The project is intended to improve operational efficiency and provide additional administrative workspace within the existing facility footprint. The office space improvements have been designed by a professional architect and are ready for bidding.
The proposed technology improvements include replacing the HVAC systems serving the network server room. The existing HVAC equipment has experienced repeated failures and is unable to consistently maintain the critical temperature requirements necessary for reliable operation of the Department’s network and technology infrastructure. Replacing outdated HVAC systems is intended to protect critical equipment, improve system reliability, and maintain the continuity of Police Department operations.
With Council authorization of the project funding, Staff would utilize informal bid procurement procedures consistent with the City’s purchasing policies to complete the proposed improvements. Due to ongoing operational concerns with the server room HVAC system, the HVAC portion of the work would likely be awarded to the City’s contracted HVAC vendor, which currently performs routine maintenance and
POLICE DEPARTMENT OFFICE AND TECHNOLOGY SPACE IMPROVEMENTS - 2 -
emergency repair services for City facilities. To expedite completion of the improvements, the Council may also authorize staff to solicit, receive, and award proposals in accordance with the City’s bidding and procurement policies.
FISCAL IMPACT
The proposed project would establish a new capital improvement project in the amount of $100,000 for office and technology space improvements at the Police Department building located at 201 Central Valley Highway. Funding for the project is proposed to be provided through salary savings generated from currently unfilled positions within the Police Department.
CEQA ANALYSIS
The proposed project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15301 (Existing Facilities) and 15302 (Replacement or Reconstruction) of the CEQA Guidelines because it consists of repair, minor alteration, and operations of public structures and facilities involving negligible or no expansion of existing or former use as well as the placement and reconstruction of existing structures and facilities where the new structures will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.

1. Open the public hearing, receive public testimony, close the public hearing and consider adoption of Resolution No. 3083, which establishes a schedule of proposed user fees and charges to take effect sixty (60) days following the date of the public hearing.
2. Find and determine that this action has been reviewed per the authority and criteria contained in the California Environmental Quality Act (CEQA). The City has determined that this Resolution is not subject to CEQA pursuant to Sections 15060(c)(2), 15060(c)(3), and 15061(b)(3) of the State CEQA Guidelines, because it will not result in a direct or reasonably foreseeable indirect physical change to the environment as there is no possibility that the action would result in a significant environmental impact, and because it does not constitute a “project” as defined in Section 15378 of the State CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3.
BACKGROUND
At its January 21, 2025 meeting, the City Council authorized staff to award a professional services agreement to Revenue & Cost Specialists, LLC to prepare a cost of services study (the “Study”) for various regulatory activities, programs, and services provided by the City. The primary intent of the Study was to recommend a new set of user and regulatory fees for the City’s various regulatory activities, programs, and services.
The services for which a City imposes user fees typically derive from an individual person or entity’s action, request, or behavior. Therefore, except in cases where there is a substantial public benefit generated by a City’s involvement in the individual action, user fees for service are designed to provide that the individual bears the cost incurred by the City to provide that service. When a user fee targets “full cost recovery,” the individual is bearing the entirety of the cost. When a user fee targets less than full cost recovery, another City revenue source – the General Fund – subsidizes the individualized activity. User fees are charged at less than full cost recovery when there

is a strong public policy interest in subsidizing the activity due to broad communitybased benefits from the activity, or when necessary to keep a user fee in line with pricing predominant in the region. The user fees proposed as a result of the Study reflect these principles of pricing.
The proposed user fees are designed to comply with applicable federal, state and local laws including that the proposed user fees are not a tax as defined by Article XIII C of the California Constitution, that the proposed user fees are no more than that necessary to cover the reasonable cost of the activities and services addressed by the user fees, and that the manner by which costs are allocated to a payor bear a reasonable and fair relationship to the payor’s burdens on, or benefits received from, the activities and services provided by the City.
Ongoing review and adjustment of user fees provides multiple benefits, including keeping pace with general cost inflation; avoiding user fee spikes that are more likely to occur when municipalities leave user fees unchanged for a lengthy period of time; providing user fee payors, City staff, and policymakers with a pattern of consistency that provides information for reliable forecasting and decision-making purposes; helping meet applicant service level expectations by collecting user fees sufficient to properly fund the desired level of service; and promoting generational equity among user fee payors by avoiding long-term stagnation of user fees followed by significant fee increases.
The Study examined various fee categories including Development Services; Public Safety Services; Rental and Enterprise Services; and Administrative Services. The Study excluded Development Impact Fees; Taxes and Assessments; Franchise Fees; and Utility Rates and Services Charges, as these are subject to different approval procedures or are not subject to the same cost of service limitations.
The City anticipates that it will comprehensively examine user fees every five years. In the years between studies, staff has proposed an annual inflationary adjustment to the user fees based on the annual change in the Consumer Price Index (CPI). It is proposed that user fees shall be adjusted annually effective July 1, 2026 and each July 1 thereafter, and that the City Manager, or designee, may administratively adjust the user fees based on the percentage increase in the CPI for Bakersfield-Delano, California, as published by the U.S. Bureau of Labor Statistics. If the CPI does not change or decreases in any given year, no change shall be made to the user fee schedule. In no event shall the user fees be increased annually to exceed the costs of providing the services. This authorization shall remain effective until revoked by the City Council or until new user fees are adopted.
The City Council will conduct a duly noticed public hearing to receive public testimony regarding the proposed user fees and charges prior to consideration of adoption of the Resolution establishing the updated fee schedule.
FISCAL IMPACT
UPDATES TO USER AND REGULATORY FEES FOR VARIOUS CITY REGULATORY ACTIVITIES,
PROGRAMS, AND SERVICES
- 3 -
The anticipated fiscal impact of the proposed changes to the user fees is approximately $882,950 annually in additional General Fund revenue. It is important to note that while adjusting the user fees will provide a positive fiscal impact in the form of additional revenue, that revenue is not designed to fund new services because the City is prohibited from collecting fees that exceed the reasonable estimated costs of providing the service sought by the applicant. Rather, the anticipated revenue increase is intended to more equitably fund the cost of providing the services, thereby reducing or eliminating General Fund subsidy, except where user fees are intentionally established at rates lower than the estimated costs due to a broad-based community benefit.
CEQA ANALYSIS
This action has been reviewed per the authority and criteria contained in the California Environmental Quality Act (CEQA), the State and local CEQA Guidelines, and the City’s environmental regulations. The City, acting as the lead agency, determined that the Resolution is not subject to CEQA pursuant to Sections 15060(c)(2), 15060(c)(3), and 15061(b)(3) of the State CEQA Guidelines, because it will not result in a direct or reasonably foreseeable indirect physical change to the environment as there is no possibility that the action would result in a significant environmental impact, and because it does not constitute a “project” as defined in Section 15378 of the State CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3.

FOR VARIOUS CITY REGULATORY ACTIVITIES, PROGRAMS, AND SERVICES
SET FORTH IN A COMPREHENSIVE USER FEE SCHEDULE
WHEREAS, the City of Shafter (the “City”) imposes certain user and regulatory fees established by the City Council; and
WHEREAS, the City recently retained the services of an independent rate consultant to conduct a Cost of Services Study (the “Study”), which is on file with the Office of the City Clerk and incorporated herein by this reference, analyzing the costs of providing various City regulatory activities, programs, and services (collectively, the “Services”); and WHEREAS, the Study, examined fee-related Services provided by the City, the costs reasonably borne by the City in providing the Services, the beneficiaries of those Services, and the revenues produced by those paying fees and charges for such Services; and WHEREAS, the City Council finds that providing these Services is of direct benefit to applicants both separate and apart from the general benefit to the public and therefore, in the interests of fairness to the general public, the City desires to better recover the costs of providing these Services from applicants who have sought or require them by revising its schedule of user fees; and
WHEREAS, based upon the results of the Study, the existing user fees no longer adequately reflect the City’s costs of providing the Services; and WHEREAS, the Study provides adequate evidence to conclude that the revised user fees do not exceed the reasonable estimated costs to provide the Services for which the user fees are charged; and

Section 5. Annual CPI Adjustments. The City Council authorizes annually, effective July 1, 2026 and each July 1 thereafter, that the City Manager, or City Manager designee, may administratively adjust the user fees, without additional City Council action or approval, based on the percentage increase from the prior year annual Consumer Price Index – All Urban Consumers for Bakersfield-Delano, California (“CPI”), calculated by the 12-month change as of April each year as published by the U.S. Bureau of Labor Statistics, or a similar index if the CPI is no longer published or is otherwise not available. CITY OF SHAFTER
CITY COUNCIL REPORT
MEETING DATE: June 2, 2026
DEPARTMENT: Alan Cazares, Associate Planner
SUBJECT: AMENDMENT TO THE CONDITIONS OF APPROVAL FOR
TENTATIVE TRACT MAP NO. 7461
RECOMMENDATION
Council find the action is exempt from the California Environmental Quality Act; conduct a public hearing; and adopt Resolution No. 3084, a resolution of the City Council of the City of Shafter, finding the action has already complied with the California Environmental Quality Act, and approving an amendment to the conditions of approval for Tentative Tract Map No. 7461 located at the northwest corner of the intersection of 7th Standard Road and the future Lake Road within the Mission Lakes Specific Plan area.
BACKGROUND
Tentative Tract Map (TTM) No. 7461 was approved by the Shafter City Council on January 07, 2025, pursuant to Resolution No. 3005, to subdivide 82.53 gross acres into 281 single family residential lots, 1 public park, 1 sump lot, and 6 public landscape lot (including a Nature Trail). Now the applicant has submitted a request to change the compliance timing triggers for several conditions and make other minor revisions that will eliminate redundancy and provide clarity. Most of the conditions being revised are related to the completion of the 2.69-acre public park within the development, shown as Lot A in the approved Tentative Map. The park in the tract falls within the jurisdiction of North of the River Recreation & Parks District (NOR) and is required to be dedicated/deeded to NOR. Therefore, NOR was given an opportunity to review the subdivision design and provide conditions of approval related to the development of the proposed park sites. The conditions relevant to NOR are shown in Exhibit B of Resolution No, 3005 as conditions of approval #18 and #159 through 165.
The applicant has requested that the timing for compliance with NOR requirements be changed to afford more time for the Condition to be completed while allowing the owner to continue to develop the tract. It’s important to note that the proposed revisions will not absolve Lennar Homes of complying with any of the conditions but rather they provide additional time to obtain compliance. Lennar Homes will still be fully responsible for developing the park site and surrounding public improvements at their own expense.
Several conditions require completion prior to the recordation of a final map for 7461.
However, Lennar is about ready to record a final map, and the process to satisfy the
AMENDMENT TO THE CONDITIONS OF APPROVAL FOR TENTATIVE TRACT MAP NO. 7461 - 2 -
NOR requests is taking more time than previously anticipated. Lennar’s request is to defer these items.
All the amendments can be found in Exhibit A of Exhibit 1 in strikethrough / underlineformat. If the Planning Commission and City Council approve, the tracked changes will be accepted on the master Word document. The affected conditions of approval are the existing #18, 26, 35, 156, 157, 159, 160, 162, and 163. A summary of the change to each condition is listed below.
• Condition #18: changes compliance deadline from prior to final map recording to prior to receiving 60% occupancy
• Condition #26: removes the requirement to receive approval from City of Bakersfield on the final map, since their signature may be omitted pursuant to SMA section 66436
• Condition #35: updated to comply with Senate Bill 937 regarding when development and impact fees are required to be paid
• Condition #156: removed requirement to record covenant regarding proximity of certain lots to existing plugged wells, since a general note is already shown on the title sheet of the final map which addresses the same issue. • Condition #157: updated language for clarity
• Condition #159: changes compliance deadline from prior to final map recording to prior to receiving 60% occupancy
• Condition #160: changes compliance deadline from prior to final map recording to prior to receiving 60% occupancy
• Condition #162: instead of requiring a covenant to be recorded prior to final map recording, a disclosure notice will be shown on the face of the final map which will address the same issue
• Condition #163: condition removed due to redundancy – already covered in another condition
Pursuant to Title 16 Section 4.80.C, modification of a tentative map after approval or conditional approval shall not extend the time limits imposed by the Shafter Subdivision Ordinance. The tentative map approval for tract 7461 is still set to expire on January 07, 2027.
At the May 12th Planning Commission regular meeting, a public hearing for this item was held by the Commission. The Commissioners unanimously voted in favor of adopting Resolution No. 26-485 to recommend approval to the City Council of the amendment to the Conditions of Approval for 7461.
FINDINGS:
1. All required public notices have been given. Hearing notices regarding the proposed project were mailed to property owners within 300 feet of the project area, and published in a local newspaper of general circulation at least 10 days prior to the hearing.
AMENDMENT TO THE CONDITIONS OF APPROVAL FOR TENTATIVE TRACT MAP NO. 7461 - 3 -
2. The City Council finds that the requested amendment of conditions is consistent with the goals, policies, and objectives of the Shafter General Plan and Mission Lakes Specific Plan and is consistent with the applicable development policies and standards of the City.
3. The City Council finds the requested amendment of conditions would not impair the integrity and character of the Shafter General Plan or Mission Lakes Specific Plan.
4. The City Council finds that the requested amendment of conditions does not alter the subdivision design or improvements, so the design and improvements are consistent with the General Plan and the Mission Lakes Specific Plan.
5. The City Council finds that the requested amendment of conditions does not impair the ability of the subdivision design to provide, to the extent feasible, future passive or natural heating or cooling opportunities within the subdivision.
6. The City Council finds that the requested amendment of conditions does not alter the site. The site remains physically suitable for the proposed type and density of development.
7. The City Council finds that the requested amendment of conditions is not likely to cause substantial environmental damage or substantially injure fish or wildlife or their habitat.
8. The City Council finds that the requested amendment of conditions is not likely to adversely affect public health, safety, or general welfare. The development remains compatible with surrounding properties and will not create any public nuisance.
9. The City Council finds that the requested amendment of conditions will not conflict with easements acquired by the public at large, for access through or use of property within Tract 7461.
10. The City Council finds the requested amendment of conditions does not affect the discharge of waste from the proposed subdivision into the existing sewer system and will not result in a violation of existing requirements prescribed by the Regional Water Quality Control Board.
11. The City Council finds that the requested amendment of conditions will not result in any change to water, sanitation, public utilities and services. Adequate provisions of urban services remain, to ensure public health and safety.
12. The City Council finds that the City of Shafter certified a Program Environmental Impact Report for the 2005 General Plan Update and related actions (SCH No. 2004101029) including the Mission Lakes Specific Plan (Resolution No. 05- 1738) and that no additional CEQA analysis or documentation is required to amend the conditions of Tentative Tract Map No. 7461.
FISCAL IMPACT
There is no fiscal impact because of the proposed action.
CEQA ANALYSIS
The project is exempt from the California Environmental Quality Act, i.e., exempt from the requirements of Division 13 (commencing with Section 21000) of the Public Resources Code, pursuant to California Government Code 65457. The project is within
AMENDMENT TO THE CONDITIONS OF APPROVAL FOR TENTATIVE TRACT MAP NO. 7461 - 4 -
the scope of the Program Environmental Impact Report (EIR) that was certified for the Mission Lakes Specific Plan in 2005 (SCH No. 2004101029) pursuant to Resolution No. 05-1738. The certified Program EIR adequately describes the activity of the residential development to be governed by this Tentative Tract Map No. 7461 Amendment of Conditions and is consistent with the Mission Lakes Specific Plan and approved alteration thereof.

AMENDED CONDITIONS OF APPROVAL
TENTATIVE TRACT NO. 7461
GENERAL
1. The owner(s), project proponent(s), and/or applicant(s) (hereinafter referred to as “Developer”), solely at their cost and expense, shall defend, indemnify and hold harmless the City of Shafter (hereinafter referred to as “City”), its agents, legislative bodies, officers and employees regarding any legal or administrative action, claim or proceeding concerning approval of Tentative Tract No. 7461 and/or related actions including, without limitation, actions taken or not taken with respect to the California Environmental Quality Act (hereinafter referred to as “CEQA”); or, at its election and in the alternative, shall relinquish such approval. Developer shall assume the defense of the City in any such legal or administrative action, claim or proceeding with legal counsel paid for in the entirety by Developer, but subject to the City's reasonable approvals. Developer shall also reimburse the City, its agents, legislative bodies, officers and employees for any judgments, amounts paid in settlements, court costs and attorneys' fees which the City, its agents, legislative bodies, officers and employees may be required to pay or otherwise pay because of such action, claim, or proceeding. The City may, at its sole discretion, participate at its own expense in the defense of any such action, claim or proceeding, but such participation shall not relieve Developer’s obligations under these conditions of approval (hereinafter referred to as “Conditions”).
2. The Developer or the Developer’s engineer shall submit a list of all contractors and/or subcontractors performing work on this project to the City Administrative Services Department and such contractors and subcontractors shall obtain valid business licenses to do business and/or work in the City of Shafter.
3. The following disclosure shall be given as part of transfer of properties: “All your real property is near property used for agricultural operations, you may be subject to inconveniences or discomforts arising from such operations on any 24-hour basis. Said discomforts may include, but not be limited to equipment noises, odors from manure or other chemicals, and dust or smoke. The City has determined that the use of real property for agricultural operations is a high priority and favored use to the City and Kern County and will not be considered a nuisance for those inconveniences or discomforts arising from agricultural operations, provided such operations are consistent with accepted customs, standards, and laws.”
4. Until all portions of the tentative tract have been developed, all vacant and undeveloped land, not being actively farmed, shall be maintained in a weed-free and clean manner by the Developer. Should said property not be so maintained, the City shall notify the property owner that the property is to be cleaned within thirty (30) days of receipt of said notice. If the property owner does not comply within the required time frame, City may then clear the land and bill the property owner for expenses incurred.
2 5. Unless a final map is recorded, this tentative tract shall expire twenty-four (24) months from the date of approval by the City Council, unless an extension is granted by the City Council.
Should an extension be requested, Developer, not less than sixty (60) days prior to the expiration date, shall submit to the City, the applicable processing fees and a completed application requesting an extension of the map approval in accordance with the provisions of City Code and the Subdivision Map Act. PLEASE NOTE: This will be the only notice given for the above specific expiration date. The applicant is responsible for initiating an extension request.
6. All construction and development shall be consistent with the City of Shafter Mission Lakes Specific Plan and Tentative Tract No. 7461.
PLANNING
7. Prior to initiating any grading or earthmoving within Tract No. 7461, the Developer shall provide the City of Shafter Planning Department with written confirmation from the San Joaquin Valley Air Pollution Control District (SJVAPCD) that the proposed development follows the requirements of the District’s Rule 9510.
8. The Developer shall be required to permanently maintain all landscaping, except for landscaping included in the Community Facilities District, including the replacement of any trees or shrubs that do not survive.
9. Approved street names are as follows: Artesia Lane, Tidewater Way, Salmon Drive, Trout Lane, Badger Lane, Darwin Drive, Pigeon Drive, Oxbow Way, Fisher Lane, Shoreview Drive, Tadpole Lane, Mallard Landing Lane, Water View Drive, Peninsula Lane, South Lake Drive, Sandridge Lane, Mariner Drive, Angler Drive, Quickwater Lane, Klamath Lane, Rocky River Lane, Yosemite Drive, Mission Lake Boulevard, and Lake Road.
10. Only the street names or alternate street names that have been approved on the attached Tentative Tract Map shall be shown on the Final Map(s) for Tract No. 7461. If the Developer wishes to change the street names at any point in time, a street name change request will need to be submitted to the Shafter Planning Department and approved prior to changing or using any proposed street names.
11. If at any point the Developer wishes to phase the map or make any changes to the approved tentative map contents, the Developer shall submit a Substantial Conformance application to the Planning Director for review and approval.
12. Approved access shall be provided for each lot in accordance with City standards.
13. All roof-mounted air conditioning equipment shall be located on the rear portion of the roof ridge line in such a manner as to be screened as much as practical from view from public streets.
14. With the exception of model houses, as provided in Section 3.080, Chapter 3, Title 16 (Subdivision Ordinance) of the Shafter Municipal Code, no building permit shall be issued by the City of Shafter until Tract No. 7461 has been recorded pursuant to the requirements
3 of Title 16 (Subdivision Ordinance) and Title 17 (Zoning Ordinance) of the Shafter Municipal Code.
15. If Condition No. 153 is initiated by the Developer and executed by the City of Shafter, no building permit shall be issued until wet utilities have been installed, an all-weather surface roadway is completed on the subject property, and survey stakes or other form of temporary documentation will be provided for, and approved by the Building and Safety Inspector, to verify building location. Missing stakes or other temporary documentation will result in delays in inspection schedule.
16. The following note shall appear on the final map and all grading and construction plans:
a. If during grading or construction, any plugged, abandoned, or unrecorded oil or gas wells are uncovered or damaged, the California Department of Conservation/Geologic Energy Management Division (CalGEM) shall be contacted to inspect and approve any remediation required.
b. If any abandoned water wells are located within the development or discovered during excavation or grading, the Kern County Public Health Department - Environmental Health Services Program must be contacted to obtain information for the proper permitting and destruction procedures.
c. Building setbacks on lots with existing plugged wells shall satisfy the requirements of the CalGEM. If the recommended setbacks cannot be satisfied, the Developer shall submit, concurrent with the submittal for a building permit for the impacted lot, written confirmation from the CalGEM that the setback provided is acceptable.
17. During grading operations, all activity shall be restricted to periods of low wind to reduce dust emissions. Verification of compliance will be the responsibility of the City of Shafter Building Inspection Division.
18. Prior to construction, the Developer shall submit plans for the public park to be developed on Lot A, approved under Tentative Tract No. 7461. The public park design shall be approved by the City of Shafter in consultation with the North of the River Recreation and Park District. The public park shall be fully constructed, landscaped, and completed, consistent with the Mission Lakes Specific Plan, prior to 60% occupancy recordation of the final map or shall be included as a public improvement in the subdivision improvement agreement. The public park shall be dedicated/deeded to the North of the River Recreation and Park District upon completion and acceptance of all improvements by the City of Shafter.
As an alternative to dedication and transfer of ownership of the public park to the North of the River Recreation and Park District, and subject to authority granted in state law, Developer may request the City consider alternative arrangements for the dedication and transfer of the public park, as authorized by state law, either to the City of Shafter or a combination of the City of Shafter and the North of the River Recreation and Park District.
Such alternative arrangements shall be memorialized in an agreement approved by the City of Shafter and the North of the River Recreation and Park District, prior to acceptance of all
4 improvements by the City of Shafter (except for the issuance of a certificate of occupancy for model homes). Nothing contained herein shall obligate the City or the North of the River Recreation and Park District to accept such alternative dedication and transfer
19. The Developer of Tract No. 7461 shall comply with all SJVAPCD requirements while grading and developing the site. It is the Developer’s responsibility to contact the SJVAPCD to determine with which requirements/rules the Developer must comply.
20. Prior to recordation of Tract Map No. 7461, the Developer shall enter into a development agreement with the City of Shafter, in a form and substance reasonably approved and required by the City, which shall provide for a minimum square footage of residential units within the subdivision, and which shall provide for payment of park fees, traffic fees and/or other fees established by the City.
21. All utilities shall be designed and constructed in such a way as to allow for them to be extended into any future residential development areas.
22. The Natural Trail along the south and east boundaries of the map shall be planted with a combination of evergreen and deciduous trees at a density sufficient to provide a year-round visual buffer. Tree species and spacing shall be approved by the City as part of the approval of the landscape plan for the Natural Trail.
23. The drive approaches on the following lots shall be installed as specified:
