City Council Agenda Report
Agenda Item No. 9.b.

DATE: June 27, 2023
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Masami Higa, Finance Director
SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION NO.
23-67, APPROVING PARKING LICENSE AGREEMENT WITH
COUNTY OF LOS ANGELES AT 1415 AND 1441 SANTA

ANITA AVENUE
SUMMARY: Consideration and approval of a license agreement for leasing parking spaces to the County of Los Angeles (County).

RECOMMENDED ACTION: Staff recommends City Council:

1. Adopt Resolution No. 23-67, approving a license agreement for leasing parking spaces to the County; and

2. Authorize the Mayor to execute the agreement.

FISCAL/FINANCIAL IMPACT: For the 41 parking spaces the City will be renting to the County, the City's General Fund will receive revenues as follows:

Year Monthly Base Rent Monthly per Space Annual Base Rent 1 $ 974.57 $ 23.77 $ 11,694.84
2 $ 998.93 $ 24.36 $ 11,987.21
3 $ 1,023.91 $ 24.97 $ 12,286.89
4 $ 1,049.51 $ 25.60 $ 12,594.06
5 $ 1,075.74 $ 26.24 $ 12,908.92
6 $ 1,102.64 $ 26.89 $ 13,231.64
DISCUSSION: The City of South El Monte (City) initially entered into a 25-year lease agreement for parking spaces with the County on June 30, 1970. On July 6, 2005, the City entered into a lease agreement for 31 parking spaces with the County for 3 years, with the County having 3 options to renew the term of the lease for a period of 3 years each, and an option to lease additional spaces up to 28 additional spaces. On July 6, 2008, the County exercised its 1st option, and on July 6, 2011, the County exercised its 2nd option, and as of July 6, 2012, the County occupied 41 spaces. On July 6, 2014, the County exercised its 3rd option, paying $19.54 per parking space for a monthly rent of

Page 259 of 297 ends

$801.14 as identified in the agreement.

The July 6, 2005 agreement technically expired on July 5, 2017, or 12 years later, but the County has continued to pay the City $801.14 per month for the 41 spaces to this day, or 6 years after the agreement expired.

On November 1, 2022, staff reached out to the County to renew the parking space agreement, as well as the Public Safety Center lease agreement which has also expired. Staff and County continues to work on the Public Center lease.

On April 28, 2023, the County provided a draft of a license agreement for parking spaces for City's review. The County updated the agreement from a lease to a license agreement, as the majority of the County parking agreements are currently adopted as a license agreement. The City reviewed the terms and conditions provided by the County to be acceptable.

According to the current City Council approved Facility Reservation and Regulations and Fee Schedule, community partners and non-profit organizations are permitted a fee waiver request which solely covers the facility rental fee.
