City Council Agenda Report
Agenda Item No. 10.d.

DATE: May 6, 2025
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Masami Higa, Director of Finance
SUBJECT: INTRODUCTION, CONSIDERATION AND APPROVAL OF
FIRST READING OF ORDINANCE NO. 1283, REPEALING
CHAPTERS 3.20 THROUGH 3.36 UNDER TITLE 3 OF THE

SOUTH EL MONTE MUNICIPAL CODE
SUMMARY: On October 8, 2024, Staff held a Finance Workshop to seek direction from City Council regarding Title 3, Revenue and Finance, of the South El Monte Municipal Code. Staff is bringing back this item for City Council’s consideration and approval to repeal Chapters 3.20 through 3.36 under Title 3 of the South El Monte Municipal Code.

RECOMMENDED ACTION: Staff recommends City Council:

1. Receive a brief presentation from City staff and pose questions to City staff; and

2. Approve the first reading of Ordinance No. 1283, repealing Chapters 3.20 through

3.36 of the South El Monte Municipal Code.

FISCAL/FINANCIAL IMPACT: There is no fiscal impact associated with this item.

DISCUSSION: On October 8, 2024, Staff held a Finance Workshop to seek direction from City Council regarding Title 3, Revenue and Finance, of the South El Monte Municipal Code. During the Workshop, Staff presented and expressed its desire to update two Chapters under Title 3 regarding purchasing, and to repeal five Chapters regarding Funds. Staff now seeks City Council’s consideration and approval of Ordinance No. 1283 to repeal the five Chapters regarding Funds.

The Governmental Accounting Standards Board (GASB) sets the accounting standards and guidance for U.S. state, local and tribal governments. GASB Statement No. 34, issued in June 1999, sets the standards for local governments in preparing financial statements. Governmental funds are defined under paragraphs 64 of GASB Statement No. 34, referencing the National Council on Governmental Accounting (NCGA). In March 1979, NCGA issued Statement No. 2, Grant, Entitlement, and Shared Revenue Accounting by State and Local Governments. Paragraph 7 of NCGA Statement No. 2

Page 357 of 383 ends

states, “Grants, entitlements, or shared revenues received for purposes normally financed through the General Fund may be accounted for or within that fund provided that applicable legal requirements can be appropriately satisfied; and use of Special Revenue Funds is not required unless they are legally mandated.” Chapters 3.20 through 3.36 of the South El Monte Municipal Code established five funds as follows:

1. Chapter 3.20 Special Gas Tax Street Improvement Fund (1958)

2. Chapter 3.24 Recreation Revolving Fund – Special Excursions (1983)

3. Chapter 3.28 Refund Account (1983)

4. Chapter 3.32 Farmers Market Food Stamp Impressed Fund (1985)

5. Chapter 3.36 Air Quality Improvement Trust Fund (1991) Currently, the City has about thirty-five (35) funds. Some of these funds were legally mandated, and others were created to segregate certain activities from the General Fund to improve the City’s overall accountability and transparency.

The City continues to maintain the Special Gas Tax Street Improvement Fund (Ch. 3.20) and the Air Quality Improvement Trust Fund (Ch. 3.36), which are legally mandated.

However, the other three funds have not existed for many years.

Because cities are required to use Special Revenue Funds to account for grants, entitlements, or shared revenues from other governments, which are restricted contractually, or by law, to be used for a special purpose, Staff finds that Chapters 3.20 through 3.36 of the South El Monte Municipal Code are outdated and no longer necessary. Staff therefore recommend City Council adopt Ordinance No. 1283 to repeal Chapters 3.20 through 3.36 of the South El Monte Municipal Code.

DATE: May 6, 2025
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Gerardo Marquez, Interim Director of Community Development SUBJECT: UPDATE ON CANNABIS BUFFER ZONE MAPS
SUMMARY: Cannabis Buffer Zone Alternatives
RECOMMENDED ACTION: Staff recommends the City Council review the provided maps and provide staff direction to maintain the current or modify the buffer zone and eligible zones within the South El Monte Municipal Code.

FISCAL/FINANCIAL IMPACT: No Anticipated Fiscal Impact
DISCUSSION: At the March 18th City Council Meeting, staff was directed to provide different variations of the Cannabis Buffer map showing alternative buffer distances as well as the inclusion of Manufacturing zoned lots. Currently, the City of South El Monte only allows for one medical/adult-use cannabis retail operator within the C (Commercial) and C-M (Commercial Manufacturing) zones. Additionally, there is currently a 1,000 foot buffer requirement from sensitive uses within the South El Monte Municipal Code. These sensitive uses are defined as:
• Other Cannabis Operations
• Alcohol or Drug Treatment Facility
• Day Care Centers
• Religious Institutions
• Schools
• Youth Centers
• City Jurisdictional Boundary
• Residential Zoned Properties
• Parks
The attached maps display the lots that would be eligible for cannabis uses. The pink lots represent the Commercial-Manufacturing zoned lots and the blue parcels represent the Manufacturing zoned lots. The table below shows the amount of parcels that each zone

provide for each of the buffer maps.

City Council Agenda Report
Agenda Item No. 10.f.

DATE: May 6, 2025
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Danilo Batson, Interim Director of Public Works SUBJECT: RESIDENTIAL PARKING PERMIT PROGRAM
SUMMARY: Currently, several surrounding cities, including the City of South El Monte, have what is either referred to as “residential parking permit” or “preferential parking permit” program. The City’s Municipal Code Chapter 10.13 – Residential Parking Permit Program describes the City’s program in detail on how to establish and maintain said parking program.

RECOMMENDED ACTION: Receive presentation and direct staff as appropriate.

FISCAL/FINANCIAL IMPACT: There is no fiscal impact with this action.

DISCUSSION: On April 15, 2025, staff was directed to bring an item by the City Council regarding a residential parking permit. Currently, several surrounding cities, including the City of South El Monte, have either a “residential parking permit” or a “preferential parking permit” program, under which residents can request via a petition, signed by 2/3 of the residents on a street, a request to establish a “parking permit district” on their street. The petition needs to be completed on a city-approved petition form. The petition must be reviewed by staff and then submitted to the City Council for consideration.

The City’s Municipal Code Section 10.13 – Residential Parking Permit Program details the process and implementation of a parking permit district in South El Monte (See Attachment A). Once the City Council establishes a parking district, eligible residents are given two (2) free parking permits, with the third (3rd) and fourth (4th) permits for a fee of $25 per vehicle permit (See Attachment B – Application to Obtain Residential Parking Permits). The number of permits issued to one residence is determined by the number of residents residing in that property, as well as the parking conditions within each district, and it is set forth in the resolution establishing each specific district. Surrounding cities have a similar fee, ranging from no cost (City of Whittier, but limited to 3 permits per residence) to $34 per each permit (City of Long Beach). Guest parking permits are also available and issued to residents in a parking district.

Parking permits must be renewed once every two (2) years from the date of issuance

Page 366 of 383 ends

and must be displayed on the vehicle in order to avoid a citation. Currently, Lorin Avenue, north of Klingerman Street to the end of the cul-de-sac, has an established residential permit parking district, as set forth in Resolution No. 18-05. (See Attachment C – Resolution No. 18-05).

Title 10. Vehicles and Traffic
Chapter 10.13. RESIDENTIAL PARKING PERMIT PROGRAM
§ 10.13.010. Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
"Guest" means any person visiting or intending to visit, for any purpose, either a resident or merchant located in a residential parking district. "Merchant" means a person who, as proprietor, operates a commercial business involved in the retailing of goods or services within a residential parking district. "Permit" means a permit issued to an individual to park in a residential parking district in the city. "Residence" means a house, apartment, condominium, mobile home or other type of dwelling, in conformance with the city's zoning ordinance and related zoning maps, having an address assigned consistent with the house numbering maps maintained by the city. An apartment having numbers or letters assigned in addition to the street address shall be deemed to be a residence. "Resident" means a person who lives in a residence located in a residential parking district. "Residential parking district" or "district" means certain public streets or portions thereof, including residences and businesses adjacent thereto, designated by the resolution establishing the district, wherein vehicles displaying a valid permit applicable to that district shall be exempt from parking restrictions established pursuant to this chapter. (Ord. 1220 §1, 2018)
§ 10.13.020. Establishment of districts.

The city council may by resolution, upon first convening a public hearing and providing notice to property owners of record and/or lawful lessees of properties within three hundred feet of the proposed residential parking district, designate a public street or streets, or portions thereof, together with residences and/or businesses adjacent thereto, as a residential parking district.

A proposal to create a residential parking district may be brought to the city council by staff, or at the city council's discretion, or upon receipt of a petition signed by no less than two-thirds of all property owners of record and/or lawful lessees of properties comprising all developed frontage of the public street or streets proposed for designation. Any person signing such a petition may be required to provide satisfactory evidence that he or she satisfies the requirements of this section. The city council retains discretion to approve or disapprove petitions to create residential parking districts. When districts are formed by resolution, the resolution should identify various district parameters including but not limited to permit expiration dates, hourly parking limitations, eligibility criteria for permittees, and the number of permits to be issued. RE: Invitation to Present at the Unity in the Community Event & Facility Use waiver
We would like to thank you for the opportunity to discuss our vision to bring resources to the City of South El Monte. I am the new pastor at South El Monte Community Outreach (SEMCO) where we conduct homeless outreach services throughout the community. We are collaborating with Union Station Homeless Services (USHS) and other faith based organizations (FBO) to bring an array of services including governmental agencies, Nonprofit Organizations (NPO), and Community Based Organizations (CBO) to the community. These resources are intended to assist individuals and families who are on the verge of being homeless or living on the streets.

Our coalition of faith leaders are from various parts of South el Monte, El Monte, and neighboring communities. We would like to invite Mayor Olmos and City Councilmembers to the Unity in the Community event scheduled for either Saturday, July 19 or Saturday, July 26, 2025.

We are also requesting the facility fees to be waived as we are serving the South El Monte community with homeless resource services. As mentioned, the event will include CBOs, NPOs, and County agencies to provide one-on-one support to those in need during the Resource Fair.

The event will also include worship bands, evangelism, and food vendors.

We anticipate approximately 200 people joining us on the day of the event. We also anticipate having security guards to provide safety and security. The coalition of faith leaders will also be in attendance engaging individuals and families about the services they provide in the South El Monte and neighboring communities. We look forward to fellowshiping with the community while sharing the truths we confess.
