City Council Agenda Report
Agenda Item No. 9.a.

DATE: July 1, 2025
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Gerardo Marquez, Interim Director of Community Development SUBJECT: CONTINUED FROM THE JUNE 3, 2025, REGULAR CITY

COUNCIL MEETING - UPDATE ON CANNABIS BUFFER

ZONE MAPS
SUMMARY: Cannabis Buffer Zone Alternatives
RECOMMENDED ACTION: Staff recommends the City Council review the provided maps and provide staff direction to maintain the current or modify the buffer zone and eligible zones for retail commercial cannabis operations within the South El Monte Municipal Code.

FISCAL/FINANCIAL IMPACT: No Anticipated Fiscal Impact
DISCUSSION:

On November 8, 2022, the voters of South El Monte approved Measure CM, which led to the adoption of Ordinance No. 1260. This ordinance added Chapter 5.26 to Title 5 of the South El Monte Municipal Code to allow for the permitting and regulation of retail commercial cannabis operation within the city, allowing for the future issuance of a maximum of three retailer commercial cannabis operation permits. On September 26, 2023 City Council adopted Ordinance No. 1268, amending Chapter 5.26 to Title 5 of the South El Monte Municipal Code.

Currently, the City of South El Monte only allows for cannabis retail as a permitted use within the C (Commercial) and C-M (Commercial Manufacturing) zones, including any overlay zone districts covering the C or C-M zones. Additionally, the South El Monte Municipal Code currently includes a buffer requirement that cannabis retailers be located at least 1,000 feet from the following:
• Other Cannabis Retail Operations
• Alcohol or Drug Treatment Facility
• Day Care Centers
• Religious Institutions
• Schools

Page 293 of 315 ends

• Youth Centers
• City Jurisdictional Boundary
• Residential Zoned Properties
• Parks
At the March 18th City Council Meeting, staff was directed to provide different variations of the Cannabis Retailer Buffer map showing alternative buffer distances as well as the inclusion of Manufacturing zoned lots.

The attached maps display the lots that would be eligible for cannabis retailer uses if the City amends its permitted zoning for cannabis retailers to add Manufacturing under the current 1,000 buffer requirement, and potential reduced buffers of 900, 800, 700, and 600 feet. The pink lots represent the Commercial-Manufacturing zoned lots and the blue parcels represent the Manufacturing zoned lots. The table below shows the amount of parcels that could be available in each zone for each alternative. 1,000 ft.

Only cannabis retailers issued a valid city commercial cannabis operation permit, among other approvals, are allowed to operate in the City. The City has not yet issued any city commercial cannabis operation permits. The City is currently working with a consultant who will assist in evaluating future cannabis applicants to ensure that the most suitable operator is chosen to do business within the City of South El Monte.

City Council Agenda Report
Agenda Item No. 9.c.

DATE: July 1, 2025
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Masami Higa, Director of Finance, Iyob Tessema, Director of Human Resources & Risk Management
SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION NO.
25-063, AMENDING AND STREAMLINING THE PROVISIONS

FOR MEDICAL OPT OUT AND ADMINISTRATION LEAVE
SUMMARY: Approval of Resolution No. 25-063, amending and streamlining the provisions for Medical Opt-Out and Administrative Leave.

RECOMMENDED ACTION: Staff recommends City Council adopt Resolution No. 25- 063, amending and streamlining the provisions for Medical Opt-out and Administrative Leave.

FISCAL/FINANCIAL IMPACT: The fiscal impact for medical opt-out would depend on the number of employees who decide to waive their City health insurance coverage each year. The option for medical opt-out would take place each fall during Open Enrollment and would take effect January 1st of each calendar year.

For fiscal year 2025-2026, there would only be a 6-month savings based on the number of employees who opt-out of medical insurance, but for future fiscal years, a full 12- months savings would be achieved.

There is no fiscal impact for administrative leave.

DISCUSSION:

Medical Opt-Out
The City looked at surrounding cities to see what medical opt-out (if any) is provided to their employees. We found that half of the surrounding cities offer their employees 50% to 80% of the health premium for opting out of medical coverage.

Page 308 of 315 ends

Also, staff reached out to all eight cities, and five cities provide similar medical opt-out benefits to City Council members, but two do not, where one did not respond.

The City is requesting to change the medical opt-out benefit for employees to 65% of health premium. The intent is to share premium savings between the employer and employee, which would result in a mutual benefit. Below are the current Kaiser Permanente monthly rates, along with an example of what the Medical Opt-Out would look like for employees and the City savings.

Medical Opt-out would be paid to employees twice a month via payroll with the following provisions:
o Medical Opt-Out is not reported to CalPERS as earnings. o Medical Opt-Out is taxable.
o Employee electing to cancel City health insurance coverage for themselves and all eligible family members must provide proof of coverage yearly during open enrollment.
o Employee must not be receiving Medicare or MediCal.
o Employee will need to sign a document stating his/her desire to waive their City health insurance coverage on a yearly basis only if the following apply:
• The unit employee had coverage through another (non-City) benefit plan prior to open enrollment (e.g. spouse’s coverage through another employer) and must waive any liability to the City for their decisions to cease coverage under the City’s health insurance plan.
o Employees and their dependents will only be eligible to reinstate their health coverage during open enrollment periods or upon loss of other coverage as permitted by CalPERS under Special Enrollment Periods for a qualifying event within a 60-day period of such an event.
o Medical opt-outs will take place each fall during Open Enrollment and will be effective from January 1st to December 31st of each year.

Page 309 of 315 ends

Administrative Leave
In comparing the City of South El Monte’s benefits to surrounding cities, staff also noticed that South El Monte’s Administrative Leave hours were in general lower than surrounding cities.

Staff is recommending and seeking City Council consideration and approval to update South El Monte’s Administrative Leave hours from 40 hours to 80 hours to be in line with surrounding cities.

1. A Review of City Reserves and its Purpose

2. South El Monte Public Safety Officers Less Expensive than Contract Public Safety Officers

3. Special City Council Meetings
SUMMARY:
1) A Review of City Reserves and Its Purpose
Since the inception of the modern U.S. economy, the daily, monthly, and even yearly economic indices and indicators typically go up and down. However, over the long run, these economic indices have risen and increased steadily over time. In 2021, after the passage of the Measure ES and a forecasted growing and flourishing economy, the 5- year South El Monte economic forecast predicted an increasing surplus. In 2025, the 5- year South El Monte economic forecast is predicting an increasing deficit due to economic uncertainty created by the current national administration. This deficit is due to an expected decrease in sales-tax revenue at the current spending mode. The city can mitigate the effects of a forecasted deficit by reducing spending and matching it to its expenditures. This plan will clearly reduce city services by neither providing them, or by not having personnel to fulfill them. Or the city can use its reserves in order to maintain and preserve city services, until the economy improves, which historically is bound to do.

The city reserves should be used during economic uncertainty. If not now, then when? When should the city reserves be used?
2) South El Monte Public Safety Officers Less Expensive than Contract Public Safety Officers
Two (2) Full-time and two (2) Part-time Contract Public Safety Officers will cost $258,773.

Two (2) Full-time and two (2) Part-time South El Monte Public Safety Officers will cost

Page 313 of 315 ends

$234,237 (figure includes benefits).

The difference between the two costs is $24,536 and an increased cost for Contract Public Safety Officers…which means…eliminating the SEM PSO team and contracting PSOs will add to and increase the forecasted city deficit.

Further savings can also be deduced. If the two (2) SEM FT PSO take the Medical Optout of 65%, the savings to the city is $21,926…reducing the cost of the 4-man SEM PSO team down to $212,310.

And a difference of $46,463 more for Contract PSOs.

Keep in mind they are a revenue generating department. In FY2024…they generated $157,022 and are expected to generate more in FY2025.

Using the FY2024 revenue ($157,022) as an estimate, the cost of the 4-man SEM PSO team is reduced to $77,215 without medical opt-out, and reduced to $55,288 with medical opt-out.

Eliminating the South El Monte Public Safety Officers is not cost-effective, and should remain in the FY2025-2026 budget.
3) Special City Council Meetings
On Thursday, December 12, 2024, Councilmembers Hector Delgado, Larry Rodriguez, and Rudy Bojorquez called for a special city council meeting to be held on Monday, December 16, 2024. The special meeting was for closed session agenda items: city attorney performance review, city attorney dismissal/release, and appointment of a city attorney.

On Tuesday, June 24, 2025, Mayor Pro Tem Hector Delgado, and Councilmembers Larry Rodriguez and Rudy Bojorquez again called for a special city council meeting to be held on the next day, Thursday, June 26, 2025. This time, the special meeting was called for approval of the FY2025-2026 Budget.

Several questions come to mind. What are the criteria for having a special city council meeting? How are the topics (agenda items) for the special meetings picked or decided on? What is the procedural process for requesting and granting a special meeting? Does the public have access to the details of how the special meeting was requested and how the agenda items were picked? Should the city council set up criteria for holding special city council meetings?
