City Council Agenda Report
Agenda Item No. 10.a.
DATE: October 6, 2026
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Rene Salas, City Manager
SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION NO.
26-070, APPROVING A WEEKLY FOOD TRUCK FESTIVAL IN
PARTNERSHIP WITH WANDERLUST EVENTS
SUMMARY: The City Council will discuss and consider entering a potential partnership with Wanderlust Events to host a weekly Food Truck Festival at the South El Monte City Hall parking lot. The proposed event is designed as a recurring, family-friendly gathering that highlights a diverse selection of food trucks, encourages community engagement, and supports small businesses. Staff worked with the vendor to develop a Memorandum of Understanding (MOU) outlining responsibilities, operational provisions, and service expectations. Staff recommends approval of the proposed partnership and adoption of the accompanying MOU.
RECOMMENDED ACTION: Staff recommends that the City Council:
1. Adopt Resolution No. 26-070, approving a partnership with Wanderlust events for a weekly food truck festival;
2. Review and approve the proposed MOU with Wanderlust Events to host a weekly Food Truck Festival; and
3. Authorize the City Manager to finalize and execute all necessary documents to implement the event.
FISCAL/FINANCIAL IMPACT:
DISCUSSION: Wanderlust Events contacted the City of South El Monte with interest in hosting a recurring food truck festival at City Hall. Their team focuses on delivering high-energy, family-friendly community events, and has successfully managed similar festivals across multiple cities, including Palm Springs, Temecula, Lake Elsinore, Murrieta, and out-of-state locations.
On June 23, 2026, City staff met with Wanderlust representatives to review the concept and explore the potential activation of City Hall parking facilities as the festival site.
Following this meeting, materials including a presentation deck and preliminary site map were provided for review.
Separately, on July 14, 2026, staff presented the Community Services Commission with a proposed event report detailing the food truck festival concept. Community Services Commissioners approved the proposed food truck festival and recommended moving forward with proposing the idea to City Council. Council consideration is now directed toward a weekly format, though baseline elements of the event remain consistent.
Based on the vendor’s presentation deck and prior discussion, the proposed weekly event would include:
• Location: South El Monte City Hall parking lot, selected for visibility, walkability, and access for residents.
• Frequency: Weekly (every Friday), pending Council direction. • Event Hours: 6:00 PM - 10:00 PM, aligning with peak evening attendance. • Food Trucks: Over 20 trucks per event, featuring varied cuisines and fully licensed/insured operations.
• Environment: Outdoor, pedestrian-oriented layout with clear wayfinding and a curated selection of vendors.
The vendor’s presentation highlights goals in creating an inviting, family-friendly atmosphere that encourages residents to gather and socialize while exploring diverse food offerings.
Based on similar deployments in other communities and the vendor’s presentation:
• Economic Activity: Increased foot traffic may support local businesses, restaurants, and shops.
• Community Engagement: The event provides a recurring gathering opportunity for families and residents.
• Visibility & Tourism: Regular programming may promote South El Monte as an active and vibrant community destination.
• Support for Small Businesses: Food truck operators benefit from dedicated event infrastructure and marketing.
Several operational components will require additional coordination:
Parking and Traffic Management
Use of the City Hall parking lot will require coordination for temporary closures, vehicle traffic, and designated areas for food truck setup. Staff will work with Wanderlust to determine appropriate traffic control measures that ensure safe access for guests and preserve emergency access routes.
Public Works & Sanitation
Wanderlust will provide third-party trash bins for onsite waste collection during the event.
Their staff will conduct scheduled trash checks and disposal throughout operating hours.
Additionally, Wanderlust staff will clean and restock City Hall restrooms, reducing the demand on City custodial services.
Security & Safety
The vendor has stated that they will provide event security. Staff will continue to coordinate with Sheriff's Department to identify whether additional City oversight or standby support may be required depending on expected attendance and layout.
Event Programming
Wanderlust clarified that there will be no entertainment component included. Their model focuses solely on food truck participation and creating an open, family-friendly gathering space. Staff will evaluate whether the absence of entertainment impacts traffic flow, crowd expectations, and the overall event design.
Permits & Regulatory Compliance
The vendor will work with the City and LA County departments to ensure compliance with public event regulations, food handling requirements, and safety standards. This includes ensuring all participating food truck operators remain fully licensed and insured.
Marketing & Outreach
Wanderlust will coordinate event promotion through social media, printed materials, and collaborations with local influencers. Staff will evaluate opportunities for cross-promotion through City channels.
To formalize the partnership, staff has drafted a Memorandum of Understanding (MOU) that defines the operational and service commitments of both parties. Adoption of the MOU will allow the event series to proceed under clear expectations and collaborative management.

City Council Agenda Report
Agenda Item No. 10.c.
DATE: October 6, 2026
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Gerardo Marquez, Director of Community Development & Public Works
SUBJECT: AN INTERIM URGENCY ORDINANCE OF THE CITY OF
SOUTH EL MONTE IMPOSING A TEMPORARY
MORATORIUM ON THE ESTABLISHMENT, APPROVAL, AND
EXPANSION OF SUBSTANCE USE DISORDER TREATMENT
FACILITIES WITHIN CITY LIMITS PURSUANT TO
GOVERNMENT CODE SECTION 65858
SUMMARY: The proposed interim Urgency Ordinance would establish a new temporary, citywide moratorium on the establishment, approval, and expansion of substance use disorder treatment facilities. Staff has conducted additional research regarding applicable State and federal, and initiated coordination with public safety agencies and other relevant service providers. This review has identified additional land use and regulatory considerations requiring further evaluation before the City determines whether amendments to its zoning regulations and objective development standards are necessary.
RECOMMENDED ACTION: Staff recommends City Council:
1. Determine that the adoption of this Urgency Ordinance is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15061(b)(3); and,
2. Introduce by title only, and waive further reading of Urgency Ordinance No. 1298- U, imposing a 45-day moratorium on the establishment, approval, and expansion of Substance Use Disorder Treatment Facilities within City limits, subject to the terms and exemptions contained in the Ordinance.
FISCAL/FINANCIAL IMPACT: No fiscal impact.
DISCUSSION: California has enacted a series of laws intended to expand access to behavioral health and substance use disorder treatment services and to accelerate the development of treatment facilities. Staff's additional review has identified land use
considerations under Health and Safety Code section 50675.1.5, including provisions that may allow qualifying uses involving inpatient, outpatient, or residential services in zones where multifamily residential, office, retail, or parking uses are principally permitted. These provisions may implicate the City's Multifamily Residential (R-3), Commercial Residential (C-R), Commercial (C), and, in certain circumstances, Commercial Manufacturing (C-M). The legislation also facilitates the reuse or redevelopment of existing residential and commercial structures, creating potential land use considerations beyond development of vacant sites.
The City is evaluating whether its existing objective development standards adequately address the operational characteristics of these uses, including potential traffic, circulation, parking, public safety, and service demands. Staff is also coordinating with public safety agencies and other relevant service providers to better understand existing conditions and service-call patterns and to determine whether the introduction or expansion of these uses could affect existing demands, particularly in established C and R-3 areas.
The City requires additional time to complete this review, determine the extent of its local regulatory authority, and evaluate whether amendments to its General Plan, Municipal Code, zoning regulations, or objective development standards are necessary and consistent with applicable State law. Without a temporary moratorium, applications could be submitted or processed under the City's existing regulatory framework before that review is completed. Based on the information developed through the City's ongoing review, the City Council finds that allowing such applications to proceed during this period presents a current and immediate threat to the public health, safety, and welfare.
Government Code section 65858 authorizes the City Council to adopt an interim urgency ordinance prohibiting uses that may conflict with contemplated land use regulations that the City is studying or considering. The proposed 45-day moratorium will provide the City with a limited period to complete its focused review and determine whether permanent regulations or objective development standards are necessary and legally permissible.
If adopted, the proposed interim Ordinance will establish a 45-day citywide moratorium on the establishment, approval, and expansion of new Substance Use Disorder Treatment Facilities, subject to the exemptions and other terms set forth in the Ordinance.
In order to protect public safety, health, and welfare, the City may adopt an urgent measure, an interim ordinance to protect the public health, safety, and welfare by prohibiting any uses that may conflict with the contemplated land use regulations that the City is considering, studying, or intends to study within a reasonable time. Such an interim ordinance requires a four-fifths vote of the City Council for adoption. An interim ordinance is only effective for an initial period of 45 days. Prior to its expiration, the City Council may, after a public hearing, extend the interim ordinance. The interim moratorium will provide the City with a limited period to evaluate the evolving State regulatory framework, examine how other jurisdictions classify and regulate Substance Use Disorder Treatment Facilities, and determine whether amendments to the City's land use regulations and development standards are necessary and legally permissible. As detailed in the Ordinance's findings, the moratorium is intended as a temporary and proactive planning measure to allow the City to establish an appropriate regulatory framework for these uses, consistent with State law and, to the maximum extent permitted by law, address potential impacts to surrounding properties and the public health, safety, and general welfare.
If adopted, the proposed interim Ordinance will prohibit the establishment, approval, and expansion of Substance Use Disorder Treatment facilities.
ENVIRONMENTAL REVIEW ANALYSIS/DETERMINATION
The Interim Urgency Ordinance is exempt from the California Environmental Quality Act (CEQA) (Pub. Res. Code § 21000 et seq.) pursuant to CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.) Section 15061(b)(3) because the action does not approve any construction or development. Therefore, it can be seen with certainty that the proposed action would not create any environmental impacts, and no additional action under CEQA is required.

TO GOVERNMENT CODE SECTION 65858
WHEREAS, the City of South El Monte (“City”) is a general law city, incorporated under the laws of the State of California; and
WHEREAS, pursuant to Article XI, section 7 of the California Constitution, the City may enact and enforce laws and regulations within its boundaries which promote the public health, morals, safety, or general welfare of the community, and are not in conflict with general laws; and WHEREAS, California Government Code Section 65858 authorizes the City Council to adopt, as an urgency measure, an interim ordinance to protect the public health, safety, and welfare by prohibiting land uses that may conflict with contemplated land use regulations that the City is studying or considering or intends to study within a reasonable time, provided that such urgency ordinance is passed by a four-fifths vote of the City Council; and WHEREAS, the City Council previously adopted an urgency ordinance pursuant to Government Code Section 65858 establishing a temporary moratorium on the establishment, approval, and expansion of new Substance Use Disorder Treatment Facilities to allow the City time to further evaluate existing land use regulations and whether additional or amended regulations are necessary to protect the public health, safety, and welfare; and WHEREAS, following the adoption of the initial urgency ordinance, City staff undertook additional research and outreach concerning the regulation and treatment of Substance Use Disorder Treatment Facilities and similar uses, including review of approaches taken by surrounding jurisdictions and review of applicable federal and State laws and regulations that may supersede, preempt, or otherwise limit the City’s local land use authority; and WHEREAS, the City’s review of applicable State legislation has identified additional land use considerations that were not fully addressed in the City’s regulatory framework and that warrant further consideration before the City establishes permanent regulations governing these uses; and
WHEREAS, State legislation contemplates qualifying uses that may include facilities providing inpatient services, outpatient treatment services, residential services, or combinations of these operational characteristics resulting in uses that may combine residential, medical, treatment, and other operational characteristics that are not comprehensively addressed by the City’s existing zoning classifications and development standards; and
WHEREAS, the City's existing definition of “Clinic, dental or medical” expressly excludes inpatient care, and the City's zoning regulations do not comprehensively address facilities combining residential, medical, and treatment-related services; accordingly, the City requires additional time to determine how the operational characteristics of qualifying uses should be addressed within the City's existing land use framework; and WHEREAS, Health and Safety Code section 50675.1.5(a)(1)(A) provides that certain qualifying uses may be located in zones where multifamily residential use, office, retail, or parking is principally permitted use, which may implicate the City’s Multifamily Residential (R-3), Commercial Residential (C-R), Commercial (C), and under certain circumstances Commercial Manufacturing (C-M) zoning district; and
WHEREAS, Health and Safety Code section 50678.1.5(a)(1)(D) further establishes a limitation applicable to certain C-M properties where more than one-third of the square footage is dedicated to industrial use, requiring the City to further evaluate the application of State law to the City’s existing zoning districts and property conditions; and WHEREAS, the potential establishment, conversion, or redevelopment of existing properties for these uses before the City completes its review could result in the introduction of operational characteristics that are not adequately addressed by the City’s existing objective development standards, including standards relating to intensity of use, parking traffic and circulation, neighborhood compatibility, public safety, and demand for municipal and other public services; and
WHEREAS, of particular concern are established Commercial (C) zoning areas, where development is concentrated and where existing conditions and public safety and service demands warrant further evaluation. These areas are substantially served by Peck Road and Durfee Avenue, which function as major arterial corridors and in portions of the City provide primary access to surrounding single-family residential neighborhoods; and WHEREAS, the potential establishment or expansion of Substance Use Disorder Treatment facilities within R-3 zoning districts also warrants further evaluation because such facilities may combine residential, medical, treatment, and other operational characteristics within areas primarily served by local streets and residential and industrial collector streets; and WHEREAS, the City is currently engaging with its public safety agencies and other relevant service providers to better assess existing conditions, service-call patterns, and the level and nature of public safety and other service demands within areas that may be affected by the potential establishment or expansion of these uses; and WHEREAS, the City's review has further identified a need to determine whether the existing Municipal Code provides sufficiently tailored objective development standards addressing the intensity, circulation, parking, public safety, service demands, and other operational
characteristics that may accompany qualifying uses subject to the State's ministerial review framework; and
WHEREAS, because Health and Safety Code section 50675.1.5 contemplates ministerial review based upon objective development standards, the City requires additional time to evaluate whether its existing standards are sufficiently specific and comprehensive to regulate qualifying uses in a manner consistent with applicable State law while protecting the public health, safety, and welfare; and
WHEREAS, the City Council therefore finds that additional time is necessary to complete its focused review and determine whether amendments to the General Plan, Municipal Code, zoning regulations, development standards, or permitting procedures are necessary or appropriate; and
WHEREAS, based on the information developed during the City's review following adoption of the initial urgency ordinance, the City Council finds that the potential establishment, conversion, redevelopment, or expansion of qualifying uses before completion of the City's review presents a current and immediate threat to the public health, safety, and welfare because the City's existing regulatory framework may not adequately address the operational characteristics and potential traffic, circulation, parking, public safety, and service-demand implications of such uses in established residential and commercial areas; and
WHEREAS, without a temporary moratorium, applications for the establishment, conversion, or expansion of affected uses could be submitted or processed under the City’s existing regulatory framework before the City completes its evaluation of applicable State law and determines whether additional or amended objective standards are necessary; and WHEREAS, to preserve the public peace, health, safety, and welfare during the period in which the City conducts this study and determines whether the amendments to its General Plan, Municipal Code, zoning regulations, objective development standards, or permitting procedures are warranted and consistent with applicable State Law the City Council desires to adopt a temporary, citywide moratorium on the establishment, approval, and expansion of new Substance Use Disorder Treatment Facilities within the City pursuant to Government Code Section 65858.
NOW THEREFORE, the City Council of South El Monte does find, determine, declare and ordain as follows:
SECTION 1. The recitals set forth above are true and correct and are hereby incorporated by reference in full herein.
SECTION 2. The City of South El Monte has a significant interest in protecting the public health, safety, or welfare of its residents while it evaluates the information developed during the City’s prior review and considers whether additional regulations are necessary to address the establishment, approval, and expansion of new Substance Use Disorder Treatment Facilities.
SECTION 3. Pursuant to Government Code Section 65858, a temporary citywide moratorium is hereby established for a period forty-five (45) days from the effective date of this Ordinance on the establishment, approval, or expansion of any new Substance Use Disorder Treatment Facility.
SECTION 4. No applicant shall submit or obtain, and no applicant shall be entitled to receive from the City, any permit, license, or other land use entitlement, in any zone, or any parcel, or at any place, public or private, within the City for the establishment, operation, or expansion of a new Substance Use Disorder Treatment Facility during the effective period of this Ordinance.
A. This moratorium shall not impact, any person who lawfully holds an existing permit, license, and/or land use entitlement for an existing and lawfully operating a Substance Use Disorder Treatment Facility in the City of South El Monte as of the effective date of this ordinance, so long as the operator is in full compliance with all City and State requirements, inclusive of State laws, and the South El Monte Municipal Code.
SECTION 5. Pursuant to the California Environmental Quality Act (“CEQA”) (Pub. Res.
Code § 21000 et seq.) and CEQA Guidelines (Cal. Code Regs., tit. 14, 15000 et seq.), there is no possibility that the adoption of this Ordinance and establishment of a moratorium hereby, may have a significant effect on the environment, because the moratorium will maintain the current environmental conditions arising from the current land use regulatory structure and is therefore exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3).
SECTION 6. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions might subsequently be declared invalid or unconstitutional.
SECTION 7. This Ordinance shall expire, and the moratorium established shall terminate, 45 days after the date of adoption, unless extended by the City Council, at a regularly noticed public hearing, pursuant to California Government Code Section 65858.
SECTION 8. The Mayor shall sign, and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause this Ordinance to be published or posted as required by law, which shall take full force and effect immediately upon its adoption by a four-fifths vote of the City Council.

SUBJECT: AN INTERIM URGENCY ORDINANCE OF THE CITY OF
SOUTH EL MONTE IMPOSING A TEMPORARY
MORATORIUM PROHIBITING APPROVAL AND
ACCEPTANCE OF NEW DATA CENTER LAND USE
APPLICATIONS PURSUANT TO GOVERNMENT CODE
SECTION 65858
SUMMARY: The proposed interim urgency ordinance would establish a temporary fortyfive (45) day moratorium on the approval and acceptance of land use applications for Data Center facilities while the City evaluates appropriate land use classifications and development standards. The moratorium would provide time for the City to address potential compatibility, security, noise, and public health and safety concerns.
RECOMMENDED ACTION: Staff recommends the City Council:
1. Determine that Urgency Ordinance No. 1299-U is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061 (b)(3) (Common Sense Exemption); and
2. Introduce by title only, and waive further reading of, Urgency Ordinance No. 1299- U, imposing a 45-day moratorium prohibiting approval and acceptance of new Data Center land use applications.
FISCAL/FINANCIAL IMPACT: No Anticipated Fiscal Impact
DISCUSSION: Communities throughout the state and country have experienced detrimental effects of Data Center land uses, including but not limited to intensive energy and water use, noise, crime and security issues, air quality, water and noise pollution, aesthetic impacts; and other related effects on property values and quality of life to surrounding neighborhoods.
Data Center land uses often necessitate unique and/or abnormally large utility
infrastructure connections to electrical, water, and sewage systems; where existing infrastructure is unable to support such land use nor load intensity of demand.
The South El Monte Municipal Code (“SEMMC”) does not, at present, adequately regulate Data Center land uses, including location, size and scope, and other development standards in its Zoning Ordinance. Data Centers are currently undefined in the SEMMC.
An interim ordinance is only effective for an initial period of 45 days. Prior to its expiration, the City Council may, after a duly noticed public hearing, extend the interim ordinance for up to 10 months and 15 days.
While the moratorium enacted under interim urgency ordinance is in effect, the City could pursue the process to enact permanent regulations, which requires introduction of a zoning code amendment, a duly noticed hearing by the Planning Commission, and duly noticed public hearing of the City Council.
ENVIRONMENTAL REVIEW ANALYSIS/DETERMINATION:
Pursuant to the California Environmental Quality Act (“CEQA”) (Pub. Res. Code § 21000 et seq.) under the common sense exemption set forth in California Code of Regulations, Title 14, § 15061(b)(3) (“CEQA Guidelines”), projects that do not result in direct, or reasonably foreseeable indirect, physical changes in the environment are not subject to CEQA review. The adoption of this Interim Urgency Ordinance would prohibit the approval and acceptance of new Data Center land use applications; thus, it can be seen with certainty that prohibiting the approval and acceptance of new Data Center land use applications would not cause a direct or indirect impact on the environment.

SECTION 65858
WHEREAS, California Constitution Article XI, Section 7, enables the City of South El Monte (the "City") to enact local planning and land use regulations; and WHEREAS, the authority to adopt and enforce zoning regulations is an exercise of the City's police power to protect the public health, safety, and welfare; and WHEREAS, California Government Code Section 65858 authorizes the City Council to adopt an interim urgency ordinance for the immediate preservation of the public health, safety, or welfare, and to prohibit a land use that is in conflict with a contemplated general plan, specific plan, or zoning proposal that the City Council, Planning Commission, or Community Development Department is considering or studying, or intends to study within a reasonable time; and
WHEREAS, a "Data Center" is defined herein in Section 2, below. Data Centers provide the hardware for large scale software systems, traditional computational demands with accompanying cloud storage, and generative artificial intelligence; and WHEREAS, communities throughout the state and country have experienced detrimental effects of Data Center land uses, including but not limited to intensive energy and water use, noise, crime and security issues, air quality, water and noise pollution, aesthetic impacts; and other related effects on property values and quality of life to surrounding neighborhoods; and WHEREAS, Data Center land uses often necessitate unique utility infrastructure connections to electrical, water, and sewage systems; where existing infrastructure is unable to support such land use nor load intensity of demand; and WHEREAS, Data Centers are undefined in the City of South El Monte Municipal Code ("SEMMC") and present a novel use in the City. The City does not, at present, adequately regulate Data Center land uses, including location, size and scope, and other development standards in its Zoning Ordinance; and
WHEREAS, it is in the City's best interest to promote orderly growth and balance the development of Data Centers with respect to economics, compatibility with other uses, and aesthetics; and
WHEREAS, the City requires time to study the relevant issues and explore appropriate regulations concerning the establishment, placement, and possible operational conditions of Data Center land uses; and
WHEREAS, the City Council desires to direct Staff of the Community Development Department to conduct such analysis and to report their findings to both the Planning Commission and City Council within a reasonable time.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SOUTH EL MONTE, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Recitals. The above recitals are true and correct and incorporated herein by reference.
SECTION 2. Definitions.
A. For the purpose of this Interim Urgency Ordinance, the term "Data Center" shall mean a facility or structure whose sole or primary function is to house servers, systems, equipment, appliances, and other related components for digital data storage, processing, and related operations (whether with connections to the public internet or closed enterprise networks for large scale software systems), including but not limited to generative artificial intelligence, cryptocurrency mining, cloud computing, server hosting, and/or other high-intensity computing uses. A Data Center may also include backup power generators, water cooling and storage facilities, air handlers, utility substations, fire suppression systems, physical security systems and other infrastructure to support operations. The term "Data Center" shall not include:
1. City action; and
2. Data processing facilities whose use is secondary or ancillary to another expressly permitted use, located on less than one acre of land.
SECTION 3. Moratorium.
A. The City Council declares a moratorium on the acceptance and approval of any application for the establishment of a new Data Center, and the issuance of any permit, business license, business occupancy permit, or certificate of occupancy for the purpose of establishing a new Data Center or expanding an existing Data Center.
B. The moratorium shall be effective for the period set forth in this Interim Urgency Ordinance and extensions thereof, or until such earlier time that the City Council amends the City of South El Monte Zoning Ordinance to address the concerns described in this Interim Urgency Ordinance.
SECTION 4. Urgency Findings. This Interim Urgency Ordinance is adopted as an urgency measure pursuant to Government Code Section 65858 and is for the immediate preservation of the public health, safety, and welfare. This Interim Urgency Ordinance is deemed necessary based upon the recitals herein and for the following reasons:
A. In light of the foregoing Recitals, the City Council finds that the establishment or expansion of Data Centers within the City presents a current and immediate threat to public health, safety and welfare, and the approval of permits, licenses, or any other applicable entitlement required by the zoning ordinance would result in that threat to public health, safety, or welfare.
B. Diesel generators plus heating, ventilation, and air conditioning (HVAC) systems within Data Centers can create a constant hum that can be audible to neighboring residents and wildlife. Data Centers generate noise levels that may exceed 90 decibels. Noise levels above 85 decibels are harmful to hearing.
C. It is the intent of the City Council to consider zoning regulations that, for example, expressly define a Data Center, and regulate the placement and operational conditions of Data Centers in the City.
D. Amending the Zoning Ordinance requires study, public hearings, and both Planning Commission and City Council review.
E. This Interim Urgency Ordinance will afford Staff and the Planning Commission a reasonable amount of time to study the matter.
F. In light of these findings and all evidence in the record, including, but not limited to the staff report accompanying this Interim Urgency Ordinance, the City Council finds that this moratorium is justified in accordance with Government Code Section 65858.
SECTION 5. Hardship Exemption.
A. The City Council has the authority but no obligation to grant exemptions from the provisions of this Interim Urgency Ordinance where it finds that strict adherence to the moratorium would result in extreme hardship to either: (i) the business owner proposing a Data Center or expansion of an existing Data Center; or (ii) the relevant property owner. The City Council may consider any factor relevant to this determination. A finding that the moratorium deprives the owner of all economically viable use of the property shall constitute extreme hardship.
B. Written requests for hardship exemptions shall be filed with the Planning Division and shall state the grounds for the exemption and provide supporting documentation. The City Council is not required to consider the request any sooner than two weeks after it was filed. The City Council shall approve, approve with conditions, or deny the request by resolution.
SECTION 6. CEQA. This Interim Urgency Ordinance is exempt from the California Environmental Quality Act ("CEQA") based on the following:
A. Pursuant to the California Environmental Quality Act ("CEQA") (Pub. Res. Code § 21000 et seq.) and CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.), there is no possibility that the adoption of this Interim Urgency Ordinance and continuance of a moratorium, hereby, may have a significant effect on the environment, because the moratorium will maintain the current environmental conditions arising from the current land use regulatory structure and is therefore exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3).
SECTION 7. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Interim Urgency Ordinance, or any part thereof is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Interim Urgency Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or
more section, subsection, subdivision, paragraph, sentence, clause or phrase would be subsequently declared invalid or unconstitutional.
SECTION 8. Effective Date. Pursuant to Government Code Section 36937, this Interim Urgency Ordinance shall become effective immediately upon adoption if adopted by at least four-fifths vote of the City Council and shall be in effect for 45 days from the date of adoption unless extended as provided by Government Code Section 65858.
PASSED, APPROVED, AND ADOPTED on this 6th day of October 2026.

SUBJECT: AN INTERIM URGENCY ORDINANCE OF THE CITY OF
SOUTH EL MONTE IMPOSING A TEMPORARY
MORATORIUM PROHIBITING APPROVAL AND
ACCEPTANCE OF NEW BATTERY ENERGY STORAGE
SYSTEM LAND USE APPLICATIONS PURSUANT TO
GOVERNMENT CODE SECTION 65858
SUMMARY: The proposed interim urgency ordinance would establish a temporary fortyfive (45) day moratorium on the approval and acceptance of land use applications for Battery Energy Storage System facilities while the City evaluates appropriate land use classifications and development standards. The moratorium would provide time for the City to address compatibility, security, and public health and safety concerns, including without limitation, potential fire and explosion hazards, hazardous material releases, and specialized emergency response.
RECOMMENDED ACTION: Staff recommends City Council:
1. Determine that Urgency Ordinance No. 1300-U is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061 (b)(3) (Common Sense Exemption); and,
2. Introduce by title only, and waive further reading of, Urgency Ordinance No. 1300- U, imposing a 45-day moratorium prohibiting approval and acceptance of new Battery Energy Storage System land use applications.
FISCAL/FINANCIAL IMPACT: No fiscal impact.
DISCUSSION: Battery Energy Storage System (“BESS”) facilities contain large concentrations of batteries and associated electrical equipment that, if damaged, defective, or otherwise compromised, may experience thermal runaway, fire, explosion, or the release of toxic or flammable gases and other hazardous materials. These incidents can present particular challenges for emergency responders because battery
fires may persist for extended periods, require specialized response measures, and create potential off-site impacts. Other municipalities throughout California have responded to concerns regarding BESS by imposing interim urgency moratoria or other regulations imposing substantial separation requirements from residential uses, requiring emergency operations plans, regulating facility access and fire protection, and restricting the location of BESS facilities in areas presenting heightened fire risks.
A recent BESS fire in the City of La Verne illustrates these concerns. On September 22, 2026, a fire believed to have resulted from a lithium-battery explosion occurred at a BESS located at a water treatment facility. The incident resulted in evacuation orders for surrounding residences while emergency personnel worked to contain and monitor the affected battery systems. Although the initial fire was contained, an adjacent BESS was damaged and continued to present a potential hazard, requiring firefighters and technical experts to monitor the site for several days and ultimately remove lithium-ion battery cells before the remaining hazards were considered mitigated and evacuation orders were lifted. This recent incident demonstrates that a BESS emergency may have consequences extending beyond the boundaries of the facility and may require substantial and prolonged emergency response resources.
BESS facilities also necessitate specialized electrical infrastructure to receive, store, and subsequently discharge significant quantities of electricity. Depending on the size and location of a proposed facility, development may require connections to substations or transmission and distribution facilities, transformers, utility lines, interconnection equipment, and upgrades to existing electrical infrastructure.
The South El Monte Municipal Code (“SEMMC”) does not, at present, adequately regulate Battery Energy Storage System land uses, including their siting and interconnection needs, proximity to sensitive uses, emergency access and response requirements, and potential fire and environmental hazards in its Zoning Ordinance.
Battery Energy Storage Systems are currently undefined in the SEMMC. The proposed interim urgency ordinance excludes residential-scale BESS installed, operated, and maintained at a site exclusively for the site’s use, in accordance with per unit and aggregate maximum ratings set by the most recently published California Fire Code.
ENVIRONMENTAL REVIEW ANALYSIS/DETERMINATION
Pursuant to the California Environmental Quality Act (“CEQA”) (Pub. Res. Code § 21000 et seq.) under the common sense exemption set forth in California Code of Regulations, Title 14, § 15061(b)(3) (“CEQA Guidelines”), projects that do not result in direct, or reasonably foreseeable indirect, physical changes in the environment are not subject to CEQA review. The adoption of this Interim Urgency Ordinance would prohibit the approval and acceptance of new Battery Energy Storage System land use applications; thus, it can be seen with certainty that prohibiting the approval, and acceptance of new Battery Energy Storage System land use applications would not cause a direct or indirect impact on the environment.

BESS may pose unique fire hazards because BESS-related fires may burn at extremely high temperatures, persist for extended periods, and require specialized emergency response resources and firefighting strategies; and WHEREAS, Battery Energy Storage System land uses may necessitate substantial electrical utility infrastructure, including substations, transformers, switchyards, transmission or distribution lines, and other interconnection facilities, and may require upgrades to existing electrical infrastructure where such infrastructure lacks sufficient capacity to accommodate the proposed facility; and
WHEREAS, Battery Energy Storage Systems are undefined in the City of South El Monte Municipal Code ("SEMMC") and present a novel use in the City. The City does not, at present, adequately regulate Battery Energy Storage System land uses, including location, size and scope, and other development standards in its Zoning Ordinance; and
WHEREAS, it is in the City's best interest to promote orderly growth and balance the development of Battery Energy Storage Systems with considerations of land use compatibility, public health and safety, emergency response capabilities, environmental impacts, economics, and aesthetics; and
WHEREAS, the City requires time to study the relevant issues and explore appropriate regulations concerning the establishment, placement, design, operation, and emergency response requirements of Battery Energy Storage System land uses, including regulations necessary to address potential fire, explosion, hazardous material release, and other public health and safety risks; and
WHEREAS, the City Council desires to direct Staff of the Community Development Department to conduct such analysis and to report their findings to both the Planning Commission and City Council within a reasonable time.
For the purpose of this Interim Urgency Ordinance, the term "Battery Energy Storage System” shall mean a system consisting of batteries, battery chargers, controls, power conditioning systems, and associated electrical equipment, assembled together and capable of receiving and storing electrical energy for subsequent discharge or use at a future time. For purposes of this Interim Urgency Ordinance, “Battery Energy Storage System” does not include a residential-scale battery energy storage system that is lawfully installed, operated, and maintained at a site exclusively to serve that site’s load, with a maximum stored energy capacity less than or equal to 20 kWh, with a maximum aggregate rating per location in compliance with the restrictions set forth under California Fire Code Section 1207 as may be amended and restated, supplemented or otherwise modified from time to time.
SECTION 3. Moratorium.
A. The City Council declares a moratorium on the acceptance and approval of any application for the establishment of a new Battery Energy Storage System, and the issuance of any permit, business license, business occupancy permit, or certificate of occupancy for the purpose of establishing a new Battery Energy Storage System or expanding an existing Battery Energy Storage System.
A. In light of the foregoing Recitals, the City Council finds that the establishment or expansion of Battery Energy Storage Systems within the City presents a current and immediate threat to public health, safety and welfare, and the approval of permits, licenses, or any other applicable entitlement required by the zoning ordinance would result in that threat to public health, safety, or welfare.
B. Battery Energy Storage Systems present unique land use and operational concerns, including risks associated with thermal runaway, fire, explosion, hazardous material releases, emergency response access, and impacts to surrounding properties and environmental resources, which warrant further study and development of appropriate siting, development, and safety standards.
C. It is the intent of the City Council to consider zoning regulations that, for example, expressly define a Battery Energy Storage System, and regulate the placement and operational conditions of Battery Energy Storage Systems in the City.
A. The City Council has the authority but no obligation to grant exemptions from the provisions of this Interim Urgency Ordinance where it finds that strict adherence to the moratorium would result in extreme hardship to either: (i) the business owner proposing a Battery Energy Storage System, or expansion of an existing Battery Energy Storage System; or (ii) the relevant property owner.
14, § 15000 et seq.), there is no possibility that the adoption of this Interim Urgency Ordinance and continuance of a moratorium, hereby, may have a significant effect on the environment, because the moratorium will maintain the current environmental conditions arising from the current land use regulatory structure and
is therefore exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3).
The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase would be subsequently declared invalid or unconstitutional.
SECTION 8. Effective Date. Pursuant to Government Code Section 36937, this Interim Urgency Ordinance shall become effective immediately upon adoption if adopted by at least fourfifths vote of the City Council and shall be in effect for 45 days from the date of adoption unless extended as provided by Government Code Section 65858.
PASSED, APPROVED, AND ADOPTED on this 6th day of October 2026.

Dear City of South El Monte,
My name is Dominique Silveira, and I am the Founder and Program Director of Rize Athletics Youth Cheer, a nonprofit youth cheerleading program committed to providing local children teen and young adults with a safe, positive, and affordable opportunity to grow through sports.
I respectfully ask the City of South El Monte to consider waiving the rental fees for the community center facilities we use for our program. More than 25% of our athletes are South El Monte residents, and approximately 80% of our entire team comes from South El Monte and El Monte. Our program serves local families by creating a supportive environment where young people can build confidence, discipline, teamwork, and leadership skills.
As a nonprofit organization, we work hard to keep participation affordable and accessible for families. Facility rental costs place a significant strain on our limited resources, and a fee waiver would allow us to direct those savings toward the youth we serve. Specifically, the funds could help provide equipment, uniforms, competition opportunities, scholarships, and other program resources that directly benefit local athletes.
Supporting Rize Athletics would also strengthen the broader community by helping ensure that local children have access to structured activities, positive mentorship, and opportunities to develop both on and off the mat. We are committed to being a program that South El Monte can be proud to support and that families can rely on.
We would be deeply grateful for the City’s consideration and partnership. Waiving the facility rental fees would make a meaningful difference in our ability to serve local youth and provide more opportunities for children and families in the community.
Thank you for your time, consideration, and continued support of nonprofit youth programs.
With appreciation,
Dominique Silveira

Update on Decision Regarding City Manager’s Decision to Approve Unscheduled, Unapproved Projects
Discussion/Action: This item is a follow up to an Agenda Item presented on the April 28, 2026 City Council meeting. At that time, it was called upon to present the rationale for re-paving Allgeyer street with money from the contingency budget.
SUMMARY:
RECOMMENDED ACTION:
FISCAL/FINANCIAL IMPACT:
DISCUSSION: The city council approved a construction contract for the FY25-26 Pavement Rehabilitation Project (City Project No. 644) on September 2, 2025. The contract and the Construction Notice, issued on November 24, 2025, identifies those specific streets, including the date and time they were to be repaved. The re-pavement project was scheduled and completed between December 1 thru December 9, 2025.
Allgeyer Street was not on the schedule, however, it was re-paved on December 9, 2025.
The re-pavement of Allgeyer Street was approved by the city manager, and paid for with the construction contingency budget. Since Allgeyer street was not in the scope of the contractual budget or the Construction Notice, how was the decision made to solely repave Allgeyer Street, and not any other streets in dire need of re-paving and in the surrounding area? The re-paving of Allgeyer Street was over $56,000 and paid through a contingency budget of $360,000.
