Council Agenda Report – December 10, 2024 Page 1 of 3
City of South Lake Tahoe
Report to City Council
Meeting Date: December 10, 2024
Title: Change of Excess Workers' Compensation Insurance Coverage from Local Agency Workers’ Compensation Excess (LAWCX) to California Intergovernmental Risk Authority (CIRA) Location: Citywide
Responsible Staff Member: Becky Penado, Risk Manager – 530-542-6064 Background:
The City of South Lake Tahoe has been self-insured for workers’ compensation since March 1993, and is currently self-insured up to $500,000 for each claim. Any claim over $500,000 is paid by the City’s excess reserve insurance carrier, the Local Agency Workers’ Compensation Excess Joint Powers Authority (LAWCX).
The City has been with LAWCX since 1993 for excess workers’ compensation insurance. Initially, LAWCX covered claims above $250,000. In 2006, the City raised its self-insured retention (SIR) to $500,000 due to dramatically rising premium costs.
For the 2025/26 program year, LAWCX is projecting a minimum 4% premium increase for all members, and this amount is likely to increase due to funding needs that were identified at the last LAWCX board meeting on November 5, 2024. The City’s 2024/25 premium with LAWCX was $243,799.
Issue and Discussion:
In July 2024, the City’s liability insurance pool, the California Intergovernmental Risk Authority (CIRA), provided a quote for joining the CIRA workers’ compensation program. CIRA has Safety National and Gray Insurance for excess workers’ compensation coverage, which has significantly lower costs and has not seen any rate increases for the past three years.
City staff worked with CIRA to prepare an analysis, comparing costs of switching from LAWCX to CIRA while maintaining a $500K SIR, and also analyzed if the City’s SIR should be lowered from $500K to $350K based on the City’s loss history. Over the last 5 years, the City has had very few claims that exceed $350K and only one claim that exceeds $500K by $1,500.
The below table compares the total amount spent under LAWCX (or would have spent if at $350K SIR) on workers’ compensation claims before hitting our SIR each fiscal year for the past 3 years. Then, combining the claims costs within the City’s SIR with the premium each year, the Total Cost of Risk (TCOR) was calculated, which is the total amount that the workers’ 857
Council Agenda Report – December 10, 2024 Page 2 of 3
compensation program costs the City each year (note: the total costs incurred for each claim are included in the year the injury occurred, even if treatment/lost time/etc. occurred in a future year).
The table also shows that if the City moves from LAWCX to CIRA and maintains a $500K SIR, the City will save an average of about $60,000 per year on workers’ compensation total program costs. It also shows there is no cost benefit to lowering the SIR to $350K with CIRA, since lowering the SIR results in a premium increase of $108,701.
In addition to program cost savings, other advantages of switching the excess workers’ compensation program to CIRA are that CIRA staff will be able to provide more support with developing our safety and workers’ compensation program, including site visits evaluating our 858
Council Agenda Report – December 10, 2024 Page 3 of 3
program with recommendations on how to improve and grant money that can be used on safety related equipment, trainings, and improvements.
Financial Implications:
The minimum expected annual savings of switching excess workers’ compensation insurance pools is $60,000 for the FY25/26 fiscal year with anticipated similar annual savings for the indefinite future. Premium costs for the City’s workers’ compensation program are funded each year through the Workers’ Comp Insurance account 602-1220-44010.
Environmental Considerations:
This action is not a “project” subject to review under the California Environmental Quality Act (CEQA) under CEQA Guidelines section 15378(b)(5) (organizational or administrative activities that will not result in direct or indirect physical changes in the environment).
Policy Implications:
This action would not affect the employees in any way and would allow CIRA to offer the City more assistance with developing and improving its city-wide safety program and strategies to further lower total workers’ compensation program costs. 859

Background
2 • City has been self-insured for WC
since 1993.
• Self-insured up to $500K for each
claim.
• When a claim exceeds $500K,
City’s excess reserve insurance
carrier begins paying for all claim
costs.
• Currently with Local Agency

Changing Excess WC Insurance Pools
3 • Table to right compares total amount spent
under LAWCX (or would have spent if at
$350K SIR) on WC claims before hitting
our SIR each fiscal year for the past 3
years.
• Then, combining the claims costs within
the City’s $500K SIR with the premium
each year, the Total Cost of Risk was
calculated, which is the total amount that
the WC program costs the City each year.
• The analysis shows that if the City moves
from LAWCX to CIRA and maintains a

City of South Lake Tahoe
Report to City Council
Meeting Date: December 10, 2024
Title: Professional Services Agreement with Workbench for the Preapproved Accessory Dwelling Unit (ADU) Plans
Location: City-wide
Responsible Staff Member: Jessica Wackenhut Lomeli, Housing Manager Background: The City’s adopted Housing Element provides the policy and program direction for the City’s housing activities, which the City’s Strategic Plan further prioritizes. The Housing Element is comprised of two primary sections. The first part, a Background Report, contains the analysis that is used to inform the Policy Document.
The Policy Document is the second part which outlines the policies and programs to be implemented by the City.
Effectively addressing the housing crisis involves hitting the right balance between numerous policies and programs and allocating resources to implement them effectively. Infill housing, including accessory dwelling units (ADUs), is a crucial element in the City’s plan to provide a diverse housing supply. The state and city have responded to the housing crisis by passing new laws and ordinances to encourage the construction of ADUs. City staff created an Accessory Dwelling Unit Guidebook in July 2023 that provides a how-to guide to designing ADUs, resources, and incentives.
On March 12th, 2024 the City Council directed staff to develop a Request for Proposal (RFP) to procure a consultant to develop Preapproved Accessory Dwelling Unit (ADU) plans.
Issue and Discussion: A Request for Proposals (RFP) was released on June 14th, 2024 with proposals due on July 19th, 2024. Four proposals were received from consulting firms: Design Path Studio, JKAE, WHA, and Workbench. A selection panel comprised of Jessica Wackenhut Lomeli, Housing Manager; Andrew Black, Financial Services Supervisor; and John Hitchcock, Planning Manager, reviewed and scored the submittals on the following criteria totaling 100 points:
Cover Letter - 5 points
Executive Summary - 10 points
Company History, Background and Experience - 20 points Scope of Work/Implementation - 35 points
Project Budget – 25 points
Description of Recent Projects/References – 5 points
868
City Council Report December 10, 2024 2 of 3
Scores of the four panelists were averaged and the review scoring was as follows:
Design Path Studio – 90 points
JKAE – 90 points
WHA – 87.6 points
Workbench – 91 points
After the review process, it was determined that Workbench would be the best firm to assist the City to develop Preapproved Accessory Dwelling Unit plans. The Scope of Work includes plan check ready construction plans for three different detached ADUs to include: a Studio ADU, 1 Bedroom ADU, 2 Bedroom ADU, and a detached garage design with an above garage ADU based on one of the three aforementioned designs.
Workbench staff are familiar with developing preapproved ADU plans with local jurisdictions. The proposal from Workbench includes the scope of work, project schedule, and optional tasks to be included in the scope of work. The recommended scope of work and project schedule is included as part of the draft Professional Services Agreement (PSA) (Attachment 1).
On March 12th, staff anticipated the use of $140,000 in funds from the Community Development Block Grant (CDBG) Program Income Fund 255. However, the California Department of Housing and Community Development (HCD) denied the use of funds for ADUs due to the HCD changing the eligible uses since City staff originally requested the funds. Staff identified the use of Permanent Local Housing Allocation (PLHA) Formula funds to be used since $223,018 does not yet have a designated use.
It is recommended that City Council pass a Motion authorizing the Mayor to execute a Professional Service Agreement with Workbench, in an amount not to exceed $125,000, for the development of Preapproved Accessory Dwelling Unit plans.
Financial Implications: On March 12th, City Council directed to establish a potential Preapproved ADU design program. It is anticipated that additional financial resources, including staff time, would be required. The anticipated $140,000 in funds were available from Community Development Block Grant (CDBG) Program Income Fund 255 but the proposed use for Preapproved ADUs was rejected. Staff identified the use of Permanent Local Housing Allocation (PLHA) Formula funds to be used since $223,018 does not yet have a designated use. To use PLHA formula funds, staff submitted another amendment to HCD for the additional eligible activities, and the PLHA funds have been received and appropriated in the budget. The proposed Professional Services Agreement contains a not to exceed amount of $125,000 to allow for flexibility in the scope of work.
Environmental Considerations: The recommendation in this report is not a project under CEQA, because it does not involve any commitment to a specific project which may result in a potentially significant physical impact on the environment, as 869
City Council Report December 10, 2024 3 of 3
contemplated by Title 14, California Code of Regulations, Sections 15378(b)(2) and 15378(b)(4) and is, therefore, not subject to CEQA pursuant to CEQA Guidelines Section 15060(c)(3).
Policy Implications: The following adopted policies and programs are applicable to this discussion:
City General Plan Housing Element
Policy 2-3. The City shall encourage a range of housing options so that people who work in South Lake Tahoe can choose to live in the city.
Policy 2-5. The City shall recognize that it will become difficult to attract employees if they cannot afford to purchase or rent housing in South Lake Tahoe. The City shall encourage and support programs and activities that create a robust local economy that provides residents with good paying employment and the means to purchase and/or rent housing in the City.
Program 2-8. Mitigation of TRPA Regulations – Accessory Dwelling Units and Junior Accessory Dwelling Units.
