Report to City Council
Meeting Date: February 10, 2026
Title: Adoption of Artificial Intelligence (AI) Policy and Guidelines Location: Citywide
Responsible Staff Members: Gabriel Raab, Senior IT Analyst Background: Artificial Intelligence (AI) technologies are increasingly being used across both the public and private sectors to support decision-making, automate routine tasks, analyze data, and improve service delivery. Within local government, AI tools have the potential to enhance operational efficiency, improve customer service, and support data-driven decisions that benefit the community.
At the same time the rapid adoption of AI presents new risks and challenges, particularly when AI systems involve the use of personal, confidential, or sensitive information. Without clear standards and oversight, AI use may raise concerns related to privacy, data security, bias and discrimination, transparency, accountability, and compliance with applicable federal and state laws. These risks are especially significant in the public sector, where trust, fairness, and responsible stewardship of public resources are critical.
The City of South Lake Tahoe (the City) currently does not have a formal policy governing the use of AI technologies. As AI tools become more accessible and widely used by staff and contractors, there is a growing need to establish clear guidelines to ensure AI is used responsibly, ethically and in a manner consistent with the City’s values, legal obligations, and commitment to public trust.
This proposed policy establishes a comprehensive framework for the appropriate use of AI within the City. It is intended to promote innovation while safeguarding privacy, ensuring fairness, maintaining transparency, and preserving human oversight and accountability in government operations.
Issue and Discussion: AI systems that process personal or confidential data without proper safeguards can create significant risks, including violations of privacy laws, bias and discrimination, pose security and compliance risks, loss of accountability, and the spread of misinformation. The absence of clear standards for AI use may also result in inconsistent practices across departments.
Adopting an AI use policy helps mitigate these risks by establishing clear expectations, controls, and oversight mechanisms for the use of AI technologies. As the AI use is growing in both the public and private sectors, the need for a policy governing its use within local government has become increasingly important to ensure responsible implementation and public confidence.
The proposed policy covers ethical principles and rules for AI use by all City staff and elected 26 Council Agenda Report- February 10, 2026 Page 2 of 2 officials. It includes provisions related to training, prohibited uses cases, disclosure requirements, data handling and security, monitoring and reporting, and compliance and enforcement. This policy was developed using resources from other public sector agencies, industry best practices, and input from senior City staff.
Staff Recommendation: Pass a Motion approving the adoption of the proposed Artificial Intelligence (AI) policy governing the use of AI technologies by the City of South Lake Tahoe staff and elected officials.
Financial Implications: Adoption of the proposed policy will not result in any direct fiscal impact to the City.
Environmental Considerations: The proposed action is not a “project” subject to review under the California Environmental Quality Act (CEQA) under CEQA Guidelines section 15378(b)(5) (organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment).
Policy Implications: This AI policy adoption addresses Priority 2, Efficient Government, action item 2.8, Evaluate appropriate systems and tools for processes and communications that are cyber safe (i.e. website, AI framework, scheduling system, etc.). 27 Resolution 2026-XXX February 10, 2026 Page 1 of 1

28 City of SLT AI Policy and Guidelines 1 February 2026 City of South Lake Tahoe
Artificial Intelligence (AI) Policy and Guidelines
1. Purpose
This policy outlines the guidelines for the responsible and ethical use of artificial intelligence (AI) technologies in the City of South Lake Tahoe (the City). It aims to ensure that AI is used to enhance services, improve e)iciency, and benefit the community while maintaining compliance with federal and state law and respecting privacy, fairness, and transparency.
2. Scope
This policy applies to all employees and volunteers, who use AI technologies in any capacity within the City government, whether or not the work is produced using City equipment or resources.
3. Ethical Use of AI
• Transparency: Employees must ensure that AI systems are used in a transparent manner.
Decisions made by AI should be explainable and understandable to both the public and internal stakeholders.
• Accountability: All AI systems and their outcomes should be monitored regularly.
Employees are responsible for reviewing and interpreting AI outputs before making decisions or producing work products based solely on AI. • Fairness: AI should be used in ways that avoid bias and ensure equal treatment of all individuals, irrespective of race, gender, age, or other protected characteristics. It is the responsibility of City sta) to ensure that all outputs from AI models follow these fairness guidelines
• Privacy Protection: Any use of AI that processes personal data must comply with local data protection laws (e.g., Public Records Act (PRA), California Consumer Privacy Act (CCPA)). AI systems must not violate the privacy of citizens or employees, and confidential data must be handled securely.
• Non-discrimination: AI systems must not discriminate against individuals or groups. All models must be designed and tested to ensure they operate fairly for everyone.
4. Guidelines for AI Usage
• The only approved AI platform to be used for day-to-day tasks is GovAI. If another approved AI is to be used, budget from your department must be allocated to assign a license and it must be approved by your department head.
• Non-GovAI AI Approval Process: Any new AI technology or tool being introduced to the City must go through the City’s Information Technology division approval process, including 29 City of SLT AI Policy and Guidelines 2 February 2026 risk assessments, policy compliance and an evaluation of potential impacts on employees and citizens.
• Training: Employees must receive adequate training on how to use AI tools responsibly and ethically. Ongoing education about AI ethics and best practices will be provided as part of regular IT security training.
• Use Cases: AI may be used for administrative tasks, data analysis, enhancing service delivery, public engagement, creative design, and improving or automating internal operations.
• Prohibited Use Cases: AI should not be used in situations that could lead to harm, loss of trust, or unfair outcomes for the public or employees.
o Critical decision making in legal, law enforcement or financial matters or in the handling of confidential or sensitive data.
o Creation of deepfakes or misleading media.
o Concealment the use of AI tools during conversations or public engagement—such as transcription or translation tool is also prohibited. • Limitations: AI systems should not replace human decision-making, especially in critical areas such as legal, law enforcement financial, or sensitive matters. AI can be used as a support tool but should not be the sole basis for decisions. • All AI-generated content must be reviewed for accuracy, tone, bias, and context before the content may be published for the City. If a reliable source cannot be found to verify factual information generated using AI, that information cannot be used for City purposes. • Rules of AI Use.
o Do
Complete training relating to the use of GovAI or other approved AI platforms, as well as cybersecurity training related to the use of AI tools. Work with the City’s IT team and experiment thoroughly with various use cases before using GovAI or other approved AI tools in the delivery of programs or services.
Thoroughly review and fact check all AI-generated content (e.g. text, code, images, etc.) You are responsible for what you create with generative AI tools and where its outputs are used.
Disclose when and how generative AI was used in your output. For example:
“The header image was created using the AI tool GovAI.” “This abstract was created using GovAI (or other approved AI tool).” “FYI, I used GovAI (or other approved AI tool) to revise this email.” 30 City of SLT AI Policy and Guidelines 3 February 2026 Provide this policy to all contractors and third-party service providers as part of the service or goods procurement process.
o Do Not
Enter into any AI platform (e.g. GovAI or other approved AI tool) any confidential data. This information can be viewed by the companies that make the tools and, in some cases, other members of the public or City sta). Once entered, this information becomes part of the public record. The handling and disclosure of confidential data or sensitive information is already governed by several City policies, including but not limited to:
Sections within the CSLT Written Information Security Policy (WISP).
Specifically, Data Classification & Handling (DCH), Data Classification & Handling Guidelines (Appendix A), Information Sharing (DCH-8), Publicly Accessible Content (DCH-9) and Cryptographic Protections (CRY).
Publish AI output (whether text, image, or code) without full knowledge, review, and disclosure.
Ask AI tools to find facts or make decisions without expert human review. Generate images, audio, or video that could be mistaken for real people, for example:
Making a fake photo or recording of a specific South Lake Tahoe o)icial or member of the public (“deepfake”) – even with disclosure.
Creation and/or use of “deepfake” images, video, or audio for City work or on City resources or equipment, is strictly prohibited Generating a fake image or recording which purports to be a public o)icial or member of the public, even if not a specific one. Generating fake “respondents” or made-up profiles for surveys or other research.
Conceal use of AI use during interaction with colleagues or the public, such as tools that may be listening and transcribing the conversation or tools that provide simultaneous translation.
5. Data Handling and Security
• Data Integrity: All AI models should be trained using accurate, complete, and current data.
The quality of input data directly impacts the performance and fairness of AI outcomes. • Security: AI systems must comply with the City’s security standards. Employees must ensure that AI systems are protected against unauthorized access, cyber threats, and data breaches.
• Data Minimization: AI should only use the data necessary to perform its tasks. Employees should avoid the use of excessive or irrelevant data in AI processes. 31 City of SLT AI Policy and Guidelines 4 February 2026
6. Monitoring and Reporting
• Continuous Monitoring: AI systems must be regularly reviewed to ensure they are operating as intended, without unintended negative consequences. While IT sta) will continuously monitor the use of AI systems, it is ultimately the responsibility of each employee to ensure that AI is being used in accordance with this policy. • Incident Reporting: If any issues arise related to AI use—such as a malfunction, biased outcomes, or privacy concerns—employees are required to report these immediately to the IT Department and their department head.
• Feedback Mechanism: Employees are encouraged to provide feedback on their use of approved AI tools to refine and improve their use and capabilities. • The IT Department will maintain a list of all approved AI tools and their approved application or use.
7. Compliance and Enforcement
• Legal Compliance: All AI systems must comply with relevant laws, regulations, and industry standards, including data protection laws, anti-discrimination laws, and local governance policies.
• This is an emerging area of law with frequent changes. Examples of relevant laws are:
California Penal Code section 13663, which requires any law enforcement agency using AI to assist with generating o)icial reports to adopt a policy with certain requirements and requires certain retention of records, auditing, and certain disclosures.
2 Cal. Code Regs. section 11008 et seq., which places certain limitations on the use of AI in the job application screening process to protect against discrimination.
• The City Attorney’s O)ice is responsible for advising of any legal issues or risks associated with AI systems usage.
• The City Attorney’s O)ice will ensure appropriate contractual safeguards are in place to manage third-party use of data and to restrict the use of input in AI training data sets. If the input of protected information is necessary for the proper use of the AI system, an information-exchange agreement in compliance with applicable rules and standards (e.g., Criminal Justice Information System (CJIS) requirements) should be used to outline the roles, responsibilities, and data ownership between the City and third-party vendor.
• Enforcement: Any employee found violating the guidelines outlined in this policy may face disciplinary action, which may include training, reassignment, or termination, depending on the severity of the violation.
32 City of SLT AI Policy and Guidelines 5 February 2026 • City employees are responsible for following this policy and its updates, as well as the WISP, and shall check compliance with these documents as needed.
8. Conclusion
AI can benefit The City by improving e)iciency and enhancing services. However, its use must be grounded in ethical principles to ensure it benefits the public while minimizing risks. All employees must commit to responsible AI usage to maintain trust, transparency, and fairness.
9. Glossary
Artificial Intelligence (AI): “Artificial intelligence” or “AI” is a machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments. Artificial intelligence systems use machine and humanbased inputs to perceive real and virtual environments; abstract such perceptions into models through analysis in an automated manner; and use model inference to formulate options for information or action. AI encompasses a range of technologies, including machine learning, natural language processing, and robotics.
GovAI: An AI assistant designed specifically for government sta). It provides features for knowledge inquiry, creative generation, task automation, and brainstorming, all while ensuring data privacy and compliance with government standards. Authorization to Accept Funds from STPUD Turf Rebate Program
BACKGROUND
A. The City of South Lake Tahoe is subject to California AB 1572, which prohibits including the use of potable water to irrigate nonfunctional turf by January 1, 2027. Parks & Recreation staff have begun turf reduction and landscape improvement projects at Ski Run Blvd. and at Park Avenue and Pine Blvd.
B. Staff will continue to make additional turf reduction and landscape improvement projects citywide to comply with California AB 1572 in the following areas through 2027: Linear Park, Wildwood, Lake Tahoe Blvd 56 Acres side, and “Y” landscaped areas.
C. South Tahoe Public Utility District (STPUD) is offering a rebate program to commercial customers on a first come, first served basis of $1.50 per square foot up to $5000 for nonresidential properties to replace turf with water-efficient landscaping.
D. The Turf Replacement Incentive Rebate Program supports water conservation by replacing lawns with Tahoe friendly native and adaptive vegetation that supports soil conservation, water quality, defensible space, and wildlife habitat.
E. Requirements of the rebate application include the following: a committment to maintain the turf conversion for a minimum of 5 years, or else the entire or partial rebate amount must be refunded to the District; participation in an irrigation efficiency evaluation for remaining turf areas when applicable; at completion, converted areas must contain 15% living plant cover at 5-year plant maturity.
F. Staff are seeking approval to accept the STPUD Turf Buyback rebate in the amount of $15,000 for turf reduction and landscape improvement projects at Ski Run Blvd. and at Park Avenue and Pine Blvd. and deposit funds into the Park’s Rebates revenue account 100- 04170-36275.

Agenda Item #:6
Agenda Item: Donation Acceptance from Kiwanis Club of Lake Tahoe for New Recreation & Aquatics Center Scoreboards
Executive Summary: The City is constructing a new Multigenerational Recreation and Aquatics Center (Rec Center) which is scheduled to be completed in early 2026. The South Tahoe Parks Foundation (Foundation) is working closely with the City to solicit charitable contributions to assist with the furnishings, equipment and scholarship access to the new Rec Center. These donations will be remitted to the City pursuant to the City's Donation, Sponsorship and Naming Rights Policy, dated September 2022 (Policy). At the August 13, 2024 City Council meeting, Council approved a Naming Rights Agreement between the City and Foundation. This agreement provides opportunities for individuals and entities to make donations in exchange for sponsorship for certain facilities at the Rec Center. The two scoreboards in the gym were identified in the agreement at $25,000 apiece. Kiwanis Club of Lake Tahoe submitted an application to make a donation in exchange for the scoreboards to include the name and logo of "Kiwanis of Lake Tahoe" and "In Memory of Bob Baunhauser." Kiwanis has made an initial donation of $20,000 to the South Tahoe Parks Foundation in 2025 and an additional $30,000 donation in 2026. The sponsorship of the scoreboards began upon executing of the agreement on April 22, 2025, and extends for the lifetime of the scoreboards. City Council is being asked to pass a Resolution accepting the second donation and funds transfer of $30,000 from Kiwanis of Lake Tahoe in exchange for sponsorship of scoreboards in the gym for new Rec Center.
Requested Action / Suggested Motions: Pass a Resolution: 1) accepting donation per the executed Donation Agreement with Kiwanis of Lake Tahoe in exchange for the Kiwanis name and logo “Kiwanis of Lake Tahoe" and "In Memory of Bob Baunhauser” on two scoreboards in the gym for new Multigenerational Recreation & Aquatics Center; and 2) amending FY2025 budget and appropriating $30,000 from the South Tahoe Parks Foundation to Account #301-70023 New Recreation Center Furniture, Fixtures and Equipment (FF&E).

Report to City Council
Meeting Date: February 10, 2026
Title: Donation Acceptance and Funds Transfer from Kiwanis Club of Lake Tahoe for New Recreation & Aquatics Center Scoreboards.
Location: New Recreation & Aquatics Center
Responsible Staff Member: John Stark, Director of Parks & Recreation Background: The City is constructing a new Recreation and Aquatics Center (“Rec Center”) which is scheduled to be completed in early 2026. The South Tahoe Parks Foundation (Foundation) is working closely with the City to solicit charitable contributions to assist with the furnishings, equipment and scholarship access to the new Rec Center. These donations will be remitted to the City pursuant to the City’s Donation, Sponsorship and Naming Rights Policy, dated September 2022 (“Policy”). At the August 13, 2024, City Council meeting, Council approved a Naming Rights Agreement between the City and Foundation. This agreement provides opportunities for individuals and entities to make donations in exchange for sponsorship for certain facilities at the Rec Center.
The two scoreboards in the gym were identified in the agreement at $25,000 apiece. Kiwanis Club of Lake Tahoe submitted an application to make a donation in exchange for the scoreboards to include the name and logo of “Kiwanis of Lake Tahoe” and “In Memory of Bob Baunhauser.” Kiwanis made an initial donation of $20,000 in 2025 to the South Tahoe Parks Foundation and made a second donation of $30,000 in 2026. The sponsorship of the scoreboards began upon execution of the Donation Agreement with Kiwanis of Lake Tahoe by City Council at the April 22, 2025, meeting and extends for the lifetime of the scoreboards.
Persons and Entities selected for sponsorship shall be recognized on the two scoreboards in the gym. A mockup of the scoreboard is included in the Donation Agreement. For corporate entities, the name used should normally be the shortest name possible, and corporate logos shall not be included. The City will have final approval on all wording of any signage or plaques. Per the agreement, funds will be accepted by the Foundation and transferred to the City.
The Donation Agreement form is included as attachment 3 with a mockup of the scoreboards included.
Issue and Discussion:. Pass a Resolution: 1) approving donation per the executed Donation Agreement with Kiwanis of Lake Tahoe in exchange for the Kiwanis name and logo “Kiwanis of Lake Tahoe" and "In Memory of Bob Baunhauser” on two scoreboards in the gym for new Multigenerational Recreation & Aquatics Center and 2) amending the New Recreation Center Furniture, Fixtures and Equipment (FF&E) project account (301-70023) by increasing revenue line 45 Council Agenda Report- February 10, 2026 Page 2 of 2 item 36280 (Contributions and Donations) and expense item 46140 (Furniture and Fixtures) by $30,000 to reflect the South Tahoe Parks Foundation donation.
Financial Implications: Donations and sponsorship contributions would be accepted by the Foundation and transferred to the City to support furnishings, equipment and scholarship access to the new Rec Center. The New Recreation Center FF&E account was originally funded by the General Fund. As the City receives donations for the planned expenditures, any unspent funding in the account after all purchases are completed will be transferred back to the General Fund.
Environmental Considerations: The proposed action accepting grant funds is not a “project” under the California Environmental Quality Act (CEQA) under CEQA Guidelines section 15378(b)(2) because it is a continuing administrative or maintenance activity such as purchases for supplies and personnel-related actions.
Policy Implications: The approval of the naming rights and acceptance of funds meets Strategic Priority 7 Recreation and Equitable Access, Goal 1: Complete the new recreation and Swim Complex and maintain the current complex in the meantime, Goal 7: Continue to improve access for people of all abilities to all public spaces.

Report to City Council
Meeting Date: February 10, 2026
Title: Purchase of Bobcat Toolcat for Parks and Recreation Department Location: Citywide
Responsible Staff Member: John Stark, Director of Parks and Recreation Background: The Parks and Recreation department has identified the need to purchase a Bobcat Toolcat to add to the fleet for maintenance including snow removal of multi-use paths (MUP), hazardous tree removal, forestry, landscaping and land management on city properties and city rights-of-way. The recommended unit is a Bobcat UW56. This item was presented with the FY 25/26 budget request and was approved by the City Council on August 26, 2025.
Issue and Discussion: The Fleet Division acquired the quote through Sourcewell, a cooperative purchasing solution, see attachment 03. The Financial Implications section below outlines the purchase cost and funding source.
Financial Implications: The proposed Bobcat UW56 will be purchased from Clark Equipment Company dba Bobcat Company, West Fargo, ND for $85,622.05 through a cooperative purchasing agreement under Sourcewell Contract No. #020223- CEC. See Attachment 02. Funding for the purchase of the Bobcat Toolcat will be through Account # 100-04170-46110, Machinery & Equipment, that was allocated with purchase amount in FY 25/26 adopted budget. We are requesting Council approval for the purchase of the Bobcat Toolcat UW56.
