Dear City of St. Helena Council Members,
I would like very much to attend the meeting this evening to thank you in person for your support of our fall playwright festival, PlayFest. For the past four years with your help, we have been able to produce 36 new works of today's emerging playwrights. We have been able to cast sixty- four roles for community actors with stipends, and entertain 1,200 local audience members. More importantly the actors, playwrights, directors, and audience have engaged in talkbacks after each play providing a space for us to hear one another's viewpoints on issues facing us in these unsettled times.
Thank you for your support.

Agenda Report to the City Council
Agenda Section: NEW BUSINESS
Department: Public Works
DATE: April 22, 2025
FROM: Eric Janzen, Assistant Public Works Director
SUBJECT: Consideration and possible approval of Resolution granting 1130 Paulson Ct. an exemption from the
independent utility connection requirement for a proposed ADU
RECOMMENDED
ACTION:
Adopt Resolution granting 1130 Paulson Ct. exemption
from SHMC Section 17.22.030(G)(2)(c) to Construct one
(1) ADU.
PREVIOUS COUNCIL
ACTION:
None.
STATEMENT OF THE
PURPOSE:
Consideration and possible approval of Resolution
granting the owner of 1130 Paulson Ct. an exemption from SHMC Section 17.22.030(G)(2)(c) to construct one (1)
ADU without installing separate water and sewer utility connections.
FINANCIAL IMPACT: None.
BACKGROUND:
The owner of 1130 Paulson Ct. wishes to construct a new accessory dwelling unit (ADU).
St. Helena Municipal Code (SHMC) Section 17.22.030(G)(2)(c) requires that an accessory dwelling unit (ADU) be equipped with separate water and sewer utility connections. The owner of 1130 Paulson Ct. has submitted a building permit application to construct an ADU but seeks exemption from SHMC Section 17.22.030(G)(2)(c). The ADU does not qualify for exemption under the provisions described in the municipal code and Staff cannot independently grant a waiver of this requirement. The property owner seeks Council approval for an exception to this requirement.
The property owner has expressed a willingness to provide a public benefit by recording an affordable housing covenant on the parcel where the ADU will be located requiring that the ADU be rented to a low income household.
DISCUSSION:
Due to the limited availability of affordable housing options within the City, the Public Works Department is willing to support this request for exemption to SHMC Section
17.22.030(G)(2)(c). If approved by Council, the ADU will be allowed to connect to the Agenda Item #13.3.
existing water and sewer utilities currently serving the existing residence. The water utility will be connected in accordance with the City Standards for a water meter manifold and include a separate meter to serve the ADU.
The Community Development Director and the City Attorney have drafted an Accessory Dwelling Unit (ADU) Inclusionary Housing Covenant to which the property owner has agreed and executed. A copy of the Accessory Dwelling Unit (ADU) Inclusionary Housing Covenant is attached to this Staff Report as Attachment B. The property owner now seeks Council approval granting the exemption to SHMC Section
17.22.030(G)(2)(c) prior to recording the Accessory Dwelling Unit (ADU) Inclusionary Housing Covenant.
Once recorded, the Accessory Dwelling Unit (ADU) Inclusionary Housing Covenant will bind the parcel to an Affordability Restriction for lower income household as defined California Health and Safety Code section 50079, and an Affordable Rent not to exceed the product of thirty percent times sixty percent of the area median income for Napa County adjusted for a family size appropriate for the unit as defined in California Health and Safety Code section 50052.5(h).
The Accessory Dwelling Unit (ADU) Inclusionary Housing Covenant will also ensure that the ADU will not be sold separately or otherwise conveyed separately from the primary residence.
The Accessory Dwelling Unit (ADU) Inclusionary Housing Covenant will run with the land and bind future owners to these provisions for the period(s) specified in Accessory Dwelling Unit (ADU) Inclusionary Housing Covenant.
