Mission Statement
To promote a quality of life making Tulare the most desirable community in which to live, learn, play, work, worship and prosper.

Regular City Council meetings are held on the first and third Tuesdays of the month in the Council Chamber located in the Tulare Public Library at 491 North M Street, Tulare, subject to cancellation.

Additional meetings of the City Council may be called as needed.

Members of the public may attend meetings in person or access the meeting live via YouTube. For those that wish to provide public comment while not physically in attendance, you may call (559) 366-1849 during Public Comment. Please note that there will be approximately a 20-second delay in broadcast for viewers. When calling in, mute the device used for viewing the meeting.

Members of the public may address the City Council on matters within the jurisdiction of the City of Tulare.

A person desiring to address the City Council is encouraged to complete a public comment card and provide to the city clerk prior to the start of the meeting. Comments are limited to three minutes per speaker unless extended by the Council. Depending upon the extent of the agenda and number of persons desiring to speak on an issue, the mayor may, at the beginning of the item, limit the time for individual comments. When invited by the mayor to speak, please approach the lectern and begin your comments by stating your name and city of residence.

12.3 Letter of Support for Assembly Bill 259 (Rubio).

Recommended Action: Approve a letter of support for Assembly Bill 259 which would eliminate the sunset on provisions added to the Brown Act by AB 2449. [D. Smith] Summary: In 2022, the Legislature passed Assembly Bill (AB) 2449 (Rubio). This bill provided local agencies with alternative Brown Act meeting procedures in the event that a board member is absent due to “just cause” or “emergency circumstances” and allows the so-affected members to participate in the meeting remotely, usually via teleconference. AB 259 eliminates the sunset on provisions added to the Brown Act by AB 2449, which state that the meeting procedures established by the bill expire at the end of 2025. By removing the sunset, AB 259 provides flexibility for individual board members of local agencies to attend remotely thus providing the public with essential services. Furthermore, AB 259 preserves the continuity of government operations while maintaining public transparency and accessibility.

12.4 Measure R Citizens’ Oversight Committee Appointment.

Summary: On November 7, 2006, the voters of Tulare County approved Measure R, imposing a ½ cent sales tax for transportation within the incorporated and unincorporated area of Tulare County for the next 30 days. The transportation measure will generate slightly more than $652 million over 30 years to Tulare County’s transportation needs.

In accordance with the Measure R Expenditure Plan (“Plan”), a Citizens' Oversight Committee (“Committee”) consisting of 16 members designed to reflect the diversity of the County of Tulare was established to provide input on implementation of the Plan, to advise the Authority Board if and when the plan needs to be augmented, and to ensure that the funds are being spent in accordance with the Plan. The Committee is also responsible for informing the public and ensuring that the Transportation Measure expenditures are made in accordance with the Plan and in the best interest of the residents of the county. The Committee meets quarterly and reviews the prior transactions of Measure R and discusses the upcoming projects. They have received multiple presentations on the usage of Measure R Funds from member agencies. The Committee has scrutinized multiple projects and showed a great interest in making sure Measure R Funds are used to their maximum capacity.

This committee consists of one member appointed by each city and the County (nine total); one representative from a major private sector Tulare County employee (nominated by the Tulare County Economic Development Corporation); one representative from the building industry (nominated by the Tulare County Building Industry Association); one representative from the agriculture industry (nominated by the Tulare County Farm Bureau); one representative from the Hispanic community (nominated by the Tulare Kings Hispanic Chamber of Commerce); one representative from an advocacy group representing bicyclists and pedestrians and/or transit; one member who is a professional in the field of audit, finance, and/or budgeting with a minimum of five years in a relevant and senior decision-making position in the public or private sector; and one representative from an environmental group.

Members of the Committee serve two-year terms beginning July 1 and ending June 30. No member may serve more than eight years.

On September 20, 2021, Craig Vejvoda was appointed to serve as the City of Tulare’s representative on the Committee to fill a vacancy for the term ending June 30, 2022. Mr. Vejvoda has served in this capacity since and has expressed his desire to continue to serve in this capacity.

12.5 Designating Portions of a City-owned Lot as Public Street Right-of-Way.

Summary: The City owns property located at the northeast corner of Morrison Street and Seminole Avenue. This property was acquired as part of the final subdivision map for KCOK Ranch 2B. It was intended to be dedicated to the City as right-of-way for the future extension of Seminole Avenue on the final subdivision map, however, it was incorrectly designated as an out lot and included as part of the future park lot for the KCOK subdivision.

In order to correctly establish the full-width street right-of-way for Seminole Avenue, that portion of the City-owned property on the north side of Seminole Avenue that was inadvertently included in the future park lot needs to be designated as public street right-of-way and incorporated into the City street system.

Alternative Action: 1) Approve with changes - Would have minimal impact on the development; 2) Deny - Denial of the dedication of street right-of-way on Seminole Avenue could result in parts of the roadway not being designated as public right-of-way. This may lead to potential complications with the installation of public utilities by our franchise utility partners, including SCE, SoCal Gas, Comcast, and AT&T; or 3) Table - Tabling of the street right-of-way dedication could mean delays in the installation of public utilities by our franchise utility partners, including SCE, SoCal Gas, Comcast, and AT&T.

12.6 Grant of Easement to SCE on Morrison Street and Seminole Avenue.

Recommended Action: Authorize the City Manager to execute a Grant of Easement and Certificate of Conveyance to Southern California Edison Company (SCE) for installation and maintenance of SCE utilities located within Lot B, D, and E of the KCOK subdivision, subject only to minor conforming and clarifying changes acceptable to the City Attorney and City Manager. [M. Miller]
Summary: As part of the subdivision improvements for Phases 5 & 9 of the KCOK subdivision, the developer was required to underground SCE electrical lines along the subdivision’s Morrison Street and Seminole Avenue frontages. The undergrounding of electrical lines requires certain structures, such as enclosures, vaults, manholes, etc., to be placed at ground level. SCE is proposing to locate these structures and conduit within Lot B of the KCOK 2B subdivision, and Lots D and E of the KCOK 5 & 9 subdivision. These lots are located along the west side of Morrison Street and the north side of Seminole Avenue and were deeded to the City as part of the Landscape and Lighting Maintenance District established for the KCOK subdivision.

Landscape lots that are not also designated as street right-of-way are not included in the City’s existing franchise agreements with SCE, and a separate easement is required for SCE to construct, maintain, and repair utilities located within these lots. The conveyance of easements to SCE is normal practice when development is required to underground SCE infrastructure and portions of that infrastructure are located outside of the City street right-of-way.

A copy of the grant of easement to SCE and certificate of conveyance are attached to this transmittal. Also attached for reference is an exhibit showing the locations of the requested easements on Lot B, D, and E.

Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.

Legal Review: The submittal from SCE follows their standard format and has been accepted in prior SCE easement dedication requests made to the City.

Alternative Action: 1) Approve with changes - Changes made to the easement would require a new submittal from the applicant and review by staff. Changes would be brought to a later Council meeting for acceptance of Grant of Easement and Certificate of Conveyance; 2) Deny - Denial of the easement request would not allow SCE to construct, maintain and repair utilities located in these lots; or 3) Table - Tabling the SCE easement request would delay SCE’s ability Agenda Packet for February 18, 2025 Page 9

to proceed with the undergrounding of their utilities and would impact the Developer’s ability to complete Morrison Street & Seminole Avenue frontage improvements in a timely manner.

12.7 Cartmill Avenue Irrevocable Offer of Dedication Partial Acceptance.

This map created eight parcels south of Cartmill Avenue between the Akers Street alignment (also known as Gem Street) and Retherford Street. An Irrevocable Offer of Dedication (IOD) in favor of the City of Tulare was provided along the Cartmill Avenue frontage of Parcels 1 and 2 on the map.

On February 5, 2013, City Council accepted a portion of the irrevocable offer for Parcel 1 through Resolution No. 13-06 to facilitate improvements associated with the Cartmill Avenue interchange project. An additional portion of the IOD for Parcel 1 was accepted by the City Council on November 5, 2025, under Resolution No. 2024-61 for the installation of Southern California Edison utilities related to the Cartmill Commons commercial improvement project.

During construction, the contractor for Cartmill Commons discovered an unmarked AT&T line that would obstruct the placement of the SCE line within the right-of-way acquired under Resolution No. 2024-61. To accommodate the installation of Southern California Edison utilities, it is necessary to accept an additional 3 feet from the IOD across Parcel 1.

A copy Parcel Map No. 5020, Resolution No. 13-06, Resolution 2024-61, proposed IOD resolution acceptance, and the certificate of acceptance are attached to this transmittal.

Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.

Legal Review: The City Attorney will review the proposed resolution prior to its recordation.

Alternative Action: 1) Approve with changes - Staff would work to implement any changes directed by Council. Minor changes would have minimal impact on construction cost and schedule; 2) Deny - Denial of the requested Irrevocable Offer acceptance would require SCE to come up with an alternate means of serving property at the southwest corner of Cartmill Avenue and Akers Street, resulting in significant impacts to construction cost and schedule; or 3) Table - Tabling the item to accept a portion of the Irrevocable Offer could have a significant impact on construction cost and schedule.

12.8 Preliminary Oversize Agreement Leland Avenue Lift Station Abandonment.

Recommended Action: Authorize the City Manager to execute a preliminary oversize construction reimbursement agreement with Summit Homebuilders, Inc., a California Corporation, for construction costs associated with the Villas at Sierra Ranch residential development that are eligible for reimbursement in accordance with Chapter 8.64 of the Municipal Code, subject only to minor conforming and clarifying changes acceptable to the City Attorney and City Manager. Summary: As part of the Villas at Sierra Ranch residential development located on the southeast corner of Corvina Avenue and Retherford Street, the developer of the project was required to abandon an existing sewer lift station located on Leland Avenue west of Hillman Street, and to extend a sewer main from the location of abandonment to the intersection of Leland Avenue and Hillman Street.

At the request of Great Valley Builders, Inc., City Council approved a Preliminary Oversize Agreement for this work on November 1, 2022. Great Valley Builders, Inc. never executed the agreement or completed the lift station abandonment improvements. Since that time, Summit Homebuilders, Inc. (Developer) has acquired the project and desires to move forward with completing the Leland Avenue sewer improvements. The Leland Avenue sewer improvements are required to serve regional needs beyond what is required for just this development. Costs associated with the supplemental size and capacity are eligible for oversized construction reimbursement in accordance with Chapter 8.64 of the Municipal Code.

The attached preliminary oversize construction reimbursement agreement for the Leland Avenue sewer improvements identifies work to be completed by the Developer at the City’s request for the benefit of the City’s overall sewer system. The preliminary oversize construction reimbursement agreement identifies work that is reimbursable under the City’s oversize reimbursement policy and specifies that the City will reimburse the developer for their eligible expenditures within 45 days of a Notice of Completion being filed for the work, provided that all documentation necessary to verify the eligibility of reimbursable costs has been submitted to and approved by the City Engineer.

A copy of the preliminary oversize construction reimbursement agreement is attached to this transmittal.

Alternative Action: 1) Approve with changes - Approving this item with minor changes would likely have no impact on the proposed development; 2) Deny - Denial of the preliminary oversized construction reimbursement agreement would be contrary to the policies set forth in Chapter 8.64 of the Municipal Code; or 3) Table - Tabling the oversized reimbursement agreement could delay the completion of the Villas at Sierra Ranch residential subdivision.

12.9 Final Design Phase of CIP Project PK0039 – Alpine Property Improvements.

Recommended Action: Approve the project scope and budget for the Final Design phase of Capital Improvement Program Project PK0039 - Alpine Property Improvements; authorize the City Manager to sign a professional services contract with Lane Engineers, Inc. of Tulare, CA in an amount not to exceed $49,900 for final design and construction support services; and authorize the City Manager or designee to approve contract change orders in an amount not to exceed 10% ($4,990) of the contract award amount. Miller] Summary: Authorize the City Manager to complete and execute the documents necessary to purchase a portion of APN 172-040-034 located on the north side of Bardsley Avenue in the amount of $12,000 as property for public right-of-way required by CIP Project EN0078 – Bardsley Sidewalk Improvements, subject only to minor conforming and clarifying changes acceptable to the City Attorney and City Manager. Summary: As part of the Cambridge Homes subdivision located north of Bardsley Avenue and east of Mooney Boulevard, 6-acres of property at the southeast corner of Alpine Avenue and Nelder Grove Street was dedicated to the City of Tulare for park/open space purposes.

However, the scope of future improvements or means by which they would be completed was never determined. As such, the property has remained undeveloped since the time of its dedication.

On December 19, 2023, Council authorized the City Manager to execute a lease agreement with the Tulare City School District for the subject property. In accordance with the terms of that lease agreement, the parties agreed upon the following:
• The City will lease the Alpine Property to the District for $1 a year for 99 years. • The Lessee will develop, construct, interconnect, operate, maintain, repair, and upgrade outdoor recreational facilities and ingress, egress, and other access to the property 24 hours per day, 365 days per year.
• Within four years, the Lessee will either convert the land to turf or construct a multipurpose facility such as sports fields, sports courts, community center, but will not construct a facility for dedicated educational space.
• The property may be fenced, but the property will be made available for public use during non-school hours, weekends as well as summer, winter, and spring breaks. • Within two years, the City will install curb and gutter to the property. In addition, the owner shall retain a 55-foot-long by 22-foot-wide roadway access easement connecting to the north gate of the water tank located near the southeast corner of the subject property for turnaround space for vehicles to maintain the water tank.

Staff requested a proposal from Lane Engineers, Inc. of Tulare, California for design and construction support services for the frontage improvements that the City is responsible for under the terms of the lease agreement. Lane Engineers, Inc. is one of the consultants approved by City Council on December 15, 2020 to provide on-call engineering services, and responded with a Proposal to complete the requested scope of services for a fee of $49,900.

The proposed cost is in line with industry standards and falls within the amount budgeted for this work on this project.

Fiscal Impact & Funding Source(s): Sufficient funding from Fund 601 - Other General Fund CIP was programmed in the City’s Capital Improvement Program for Fiscal Years 2023/2024 thru 2027/2028 to cover both the proposed fee of $49,900, and the requested 10% contingency.

Legal Review: The proposed professional services contract between the City and Lane Engineers, Inc. will be reviewed and approved as to form by the City Attorney.

Alternative Action: 1) Approve with changes - Proposed changes to the scope of work, conditions impacting the consultant’s proposal, or changes to the proposed contract would require staff to negotiate with the consultant; 2) Deny - Not approving the contract or project scope and budget would halt progress towards the construction of the improvements that the City is obligated to undertake in accordance with the terms of its lease agreement with the Tulare City School District; or 3) Table - A delay in the City approving the proposed contract or project scope and budget could result in the need to re-negotiate the proposal submitted by the consultant, which could result in an increase to their proposed fees.

12.10 Purchase of Real Property for Street Right-of-Way.

Recommended Action: Authorize the City Manager to complete and execute the documents necessary to purchase a portion of APN 172-040-034 located on the north side of Bardsley Avenue in the amount of $12,000 as property for public right-of-way required by CIP Project EN0078 – Bardsley Sidewalk Improvements, subject only to minor conforming and clarifying changes acceptable to the City Attorney and City Manager. [M. Miller] Summary: Capital Improvement Project EN0078 is a traffic safety project to install missing sidewalk along the north side of Bardsley Avenue in the vicinity of the Mission Oak High School campus. This stretch of Bardsley Avenue serves as a primary route for school-age pedestrians walking to the high school. In areas where there is no sidewalk, pedestrians are required to walk along the dirt roadway shoulder. Numerous citizen complaints have been received regarding this situation, especially during winter months when the roadway becomes muddy. In such situations, pedestrians frequently opt to walk on the roadway in close proximity to vehicular traffic.

CIP Project EN0078 was included and approved as a part of the City’s 2023-2028 CIP.

Subsequently, Council gave direction to staff to commence the right-of-way acquisition phases for the project. A contract was awarded to Paragon Group for right-of-way acquisition services.

Paragon Group completed appraisals and has been working on the City’s behalf to obtain the required right-of-way at fair market value for two (2) parcels. The subject parcel is the first owner to have accepted an offer from the City and signed a Purchase and Sale Agreement (attached).

The subject parcel is located on the north side of Bardsley Avenue, east of Morrison Street. The property owner, David Avila, has been working with the City’s consultant team throughout the design, appraisal and acquisition process, and has agreed to sell the required property for the amount of $12,000 in accordance with the terms previously authorized by City Council. This property acquisition encompasses 0.0157 acres. The property has minor improvements on the portion being acquired. The land is valued at $6,840, and the value associated with existing improvements affected by the acquisition (cost to cure) was determined to be $4,800. The subsequent acquisition offer was rounded to $12,000.

Fiscal Impact & Funding Source(s): Project EN0078 – Bardsley Sidewalk Improvements was programmed in the City’s Capital Improvement Program for fiscal years 2023/2024 thru 2027/2028. The identified funding source for the project is Gas Tax Revenues (Fund 022).

Legal Review: The City Attorney will review purchase document as necessary to ensure that it conforms to standard requirements.

Alternative Action: 1) Approve with changes - Approving the proposed property acquisition with changes or additional conditions could require the City to renegotiate the acquisition of said land, which may delay the project construction start date; 2) Deny - Denying the subject property acquisition would prevent the City from installing curb, gutter, and sidewalk along the north side of Bardsley Avenue; or 3) Table - Tabling the proposed property acquisition could delay the project’s construction start date.

12.11 Conditional Final Map Acceptance – Fulton Estates Phase 1B.

Recommended Action: Conditionally approve the final map and subdivision improvement agreement for Phase 1B of the Fulton Estates subdivision for recordation, and accept all easements and dedications offered to the City subject to receipt of the signed final map, all fees, and other required items prior to April 19, 2025. Summary: Planning Commission Resolution No. 5435, which was adopted on October 24, 2022, approved the tentative subdivision map for the Fulton Estates subdivision. This subdivision is situated on the southwest corner of Tulare Avenue (State Route137) and Oakmore Street and comprises approximately 39 acres with a total of 185 single-family lots at full buildout. The development of the subdivision is being completed in phases. Phase 1B of the Fulton Estates subdivision will consist of 49 single-family residential lots.

To streamline the final map approval process, the Subdivider is seeking conditional approval and acceptance from Council. This is subject to the receipt of the signed map, all fees, and other necessary items within 60 days. Such requests for conditional approval have been routinely accommodated.

Fiscal Impact & Funding Source(s): There is no fiscal impact associated with this action.

Legal Review: The final map will be reviewed for compliance with applicable legal requirements prior to recordation.

Alternative Action: 1) Approve with changes - Changes would result in delay to the project schedule; 2) Deny - Construction of the proposed single-family residential construction project would not be permitted; or 3) Table - The delay resulting from tabling this item could adversely impact the Developer’s construction schedule.

12.12 Resolution with Tulare Police Management Group.

Recommended Action: Adopt a resolution approving salary and benefits for the Tulare Police Management Group (TPMG) subject to minor clarifying and conforming changes as approved by the City Attorney. [S. Oneal; M. Zamora]
Summary: The City has reached an agreement with TPMG and staff is presenting a resolution outlining all special compensation benefits for this group. Pursuant to CalPERS regulations, agreements for special compensation benefits must be self-containing and may not refer to other bargaining unit agreements. In previous agreements, reference was made to the TPOU bargaining agreement for some special compensation benefits. This resolution will 1) confirm existing special compensation benefits 2) make language clarification; and 3) add the newly agreed upon items. The newly agreed upon items are highlighted below:

Salary
Increases to members of the TPMG shall be as follows (with full retroactivity for base pay and overtime accruals):

Four percent (4.0%) increase retroactive to the pay period beginning on July 13, 2024.

Four percent (4.0%) increase effective with the first full pay period in July 2025.

Four percent (4.0%) increase effective with the first full pay period in July 2026.

Post Certificate Pay
Intermediate POST increased to 2.5%
Advanced POST increased to 5.0%
Supervisory POST added at 7.5%
Management POST added at 10.0%
Certificate pay would not compound, and officers are limited to highest percentage of certificate achieved.

Education Incentive Pay
Education pay remains at 5.0%.

Service Pay
In addition to the current steps, increase to 3.5% at 15 years, and add 4.0% at 20 years of service. Previous law enforcement service to be counted and definitions added for clarification.

Bilingual Pay
This pay was increased from 2.5% to 3.0%.

Uniform Allowance
Increase to $1,300 annually.

Specialty Assignment Pay
SWAT/Hazard pay of 2.5% in addition to the current annual incentive of $1,200.

Fiscal Impact & Funding Source(s): An additional appropriation will be necessary to fund this year’s salary increases that were more than what was originally anticipated in the adopted budget. The increases for later years will be included in future budgets.

12.13 Salary Schedule Amendment.

Summary: This fiscal year, the City has been conducting negotiations with various bargaining units and groups. The City and Tulare Police Management Group (TPMG) have reached an agreement that includes a salary increase of four percent (4.0%) effective July 13, 2024.

This proposed salary schedule reflects the updated salaries for these positions.

12.14 Purchase of One Ford F-350 Truck.

Recommended Action: Award the purchase of one new/unused 2025 Ford F-350 truck to National Auto Fleet Group, of Watsonville, CA using Sourcewell Contract No. 091521-NAF in the amount of $71,759.50, which includes all fees, tax, and shipping. [T. Whitfield] Summary: The City is a member of Sourcewell, which is a national public service agency that provides for cooperative purchasing for government agencies. Through the Sourcewell Contract No. 091521-NAF, staff is requesting authorization to purchase one new/unused 2025 Ford F350 4WD crew cab truck from National Auto Fleet Group, of Watsonville, CA in the amount of $71,759.50.

The proposed truck is an expansion unit for the Graffiti Division within the Office of Safety, Compliance and Facilities. The proposed truck will be utilized for graffiti abatement and to tow heavy equipment for encampment clean-ups. The truck will be equipped with a generator, paint sprayers, pressure washer and hose reels.

The Sourcewell purchasing contract is available to agencies nationwide and is therefore very competitive and very limited. In looking for vehicles, the Fleet Superintendent was made aware that there were vehicles available for immediate purchase. After going through the list and working with the Office of Safety, Compliance and Facilities staff, it was determined that this truck met the needs of the department and due to time constraints, the City Manager approved the issuance of the purchase order to secure the truck.

Fiscal Impact & Funding Source(s): Funding for the purchase of the vehicle will come from the Fleet Replacement Funds for the Graffiti Division (Fund 604). The FY 24/25 appropriated budget for the truck is $75,000 and the cost for new truck is $71,759.50. The remaining funds will be used to equip the truck.

Alternative Action: 1) Approve with changes; 2) Deny; or 3) Table. If not approved, the truck will be cancelled and the division will continue to use existing equipment until a new vehicle can be purchased.

Recommended Action: Approve the selection of NHA Advisors, LLC (“NHA”) to provide municipal advisory services and authorize the City Manager to execute a professional services agreement with NHA for the period of February 19, 2025, through December 31, 2027, with two additional one-year options. Summary: Professional municipal advisory services are beneficial for reviewing the City’s longrange financing needs and developing alternative strategies for meeting those needs, analyzing and interpreting legislation for economic or financial opportunities or impacts for/to the City, analyzing and interpreting complex business plans and financial proposals made to the City, and issuing debt.

Request for Proposals Process:

The City issued a request for proposals (“RfP”) for municipal advisory services on January 8, 2025. The RfP was posted on the City’s, California Purchasing Group’s (BidNet Direct’s) and sent directly to several municipal advisory firms. Responses to the RfP were due by 4:00 pm on January 24, 2025.

The City received three proposals in response to the RfP. The firms submitting proposals, listed in alphabetical order, are:

KNN Public Finance, LLC;
Kosmont Transactions Services, Inc. dba Kosmont Financial Services; NHA Advisors, LLC;
PFM Financial Advisors LLC.

A selection panel reviewed the proposals, and all the responding firms were invited to deliver presentations and be interviewed by the panel on February 7, 2025. The selection panel included the following members:

Melanie Gaboardi, Assistant Director of Finance;
Jason Bowling, Chief Technology Officer;
Michael Miller, Director of Engineering.

To rank the firms and provide a recommendation to the City Council, the interview panel considered:
• demonstrated understanding of the work/services required; • relevant experience with California municipal governments; • commitment of key members of the firm to the City;
• proposed investment management and investment advisory methodology; and • approach to municipal advisory services; and
• cost of services.

After reviewing and considering each proposal, NHA was selected for the engagement.

13.1 Measure R Program Supplement to Cooperative Agreement for the International AgriCenter Way Extension Project.

Summary: On May 22, 2007, the City of Tulare entered into a Cooperative Agreement with the Tulare County Association of Governments (“TCAG”) to receive Measure R funding for certain transportation projects. The City now wishes to execute a Program Supplement to the Cooperative Agreement for the International Agri-Center Way Extension Project (the “Project”).

The Project will construct a four-lane extension of International Agri-Center Way from its “T” intersection with Laspina Street to Turner Drive, a distance of 1.12 miles. The Project will also include 12-foot-wide travel lanes and 4-foot-wide shoulders on both sides of the street extension.

The Project will install water distribution and sewer collection facilities along the extension of International Agri-Center Way to accommodate future development. The Project will also relocate utilities as necessary.

The Project has the potential to construct a traffic signal at the intersection of International AgriCenter Way and Laspina Street, contingent upon the availability of sufficient project funding at the time of construction award.

The total cost of the Project is not to exceed $5,000,000. The City will provide the Project with an advance of no more than $5,000,000 from the City of Tulare Local Measure R funds at zero percent interest. The City will be repaid the advanced funds beginning in fiscal year 2026-2027 and continuing for the following two to four fiscal years. The City may repay some or all of the advanced funds in a lump sum payment from available revenues.

Fiscal Impact & Funding Source(s): The Project will be funded by the TCAG, and the City will be repaid the advanced funds beginning in fiscal year 2026-2027. The City anticipates no adverse fiscal impact.

City Attorney Mario U. Zamora advised that for items 3.2 and 3.3, Council considered a contract to hire outside legal counsel for those two lawsuits. It was moved by Councilmember Mederos, seconded by Councilmember Sigala, and unanimously carried to retain Downey Brand out of Sacramento and authorize the City Manager to sign an agreement. Mr. Zamora also advised there was no reportable action in regard to item 3.1.

13.5 Purchase of 2025 Ford Police Interceptors.

Recommended Action: Award the purchase of 11 new/unused 2025 Ford Police Interceptor Utility (K8A) AWD vehicles to National Auto Fleet Group of Watsonville, CA using Sourcewell Contract No. 091521-NAF in the amount of $597,061.85. [T. Whitfield]

14.1 Farmland Mitigation Ordinance Revisions.

Recommended Action: Adopt Zone Amendment No. 757 approving revisions to the City of Tulare’s Farmland Mitigation Ordinance (Chapter 10.222 of the City of Tulare Municipal Code).

Presented By: Community Development Director Mario Anaya Public Comment: The public hearing was opened at 7:49 p.m. Darlene Mata addressed the Council expressing support for the proposed ordinance. City Manager Marc Mondell advised a letter of support was received from the Building Industry Association in regard to the proposed ordinance. The public hearing was closed at 7:51 p.m.

Council Action: Councilmember Sigala inquired about the property on the southwest corner of Pratt and Bardsley in regard to whether it was being protected or not at which he was advised that was not City-owned property where this ordinance only includes Cityowned property. Mr. Sigala also expressed concern over decision-making being moved from Council to staff. Councilmember Mederos and Mayor Isherwood shared that concern.

Mr. Mederos also expressed concern that projects 20 acres or less would be exempt from the in-lieu fee as indicated in the proposed ordinance as well as the recommended price per acre. Mr. Mederos would like a better understand on how this program would be administered. Mayor Isherwood expressed concern over legal review and inquired whether the proposed ordinance in full is compliant from the City Attorney’s Office perspective. City Attorney Mario U. Zamora did confirm it was reviewed and approved by the City Attorney’s Office. Following discussion, it was moved by Councilmember Mederos, seconded by Vice Mayor Harrell, and unanimously carried to close the public comment portion of the public hearing and continued the remainder of the public hearing to March 4. It was the consensus of Council to direct staff to provide the additional information requested as discussed prior to March 4.

15.2 Temporary Encampment Facility Operational Plan and Related Costs.

Recommended Action: Approve a new twelve-month operational plan and budget for the Temporary Encampment Facility; and authorize the City Manager and/or his designee(s) to establish the necessary contracts and/or grant agreements to fulfill the operational plan and related budget expectations where feasible.

Council Action: Councilmember Sigala expressed that he understands the need for the services provided in Table 3 but is concerned over the shortfall in funds which would be covered by the General Fund and Measure Y which has not yet been obligated.

Councilmember Mederos expressed concern over funding and being able to sustain services. Mr. Mederos stated he would not be able to support additional services at this time. Councilmember Sayre provided rationale for the request for additional services in regard to security. It was moved by Councilmember Mederos and seconded by Councilmember Sayre to approve Plan C with the inclusion of services provided in Table

3. Prior to the Council voting on the motion, Mayor Isherwood expressed concern over sources and uses when making adjustments to provided services as that information was not provided. Mr. Isherwood also expressed the need for City staff to look into more cost effective ways to provide services as well as the need for a transition plan from the encampment to the homeless shelter. Following continued discussion, Councilmember Mederos withdrew his motion and Councilmember Sayre withdrew the second to the motion. It was the consensus of Council to have staff come back with a table of funding for objectives and sources of funds.

15.3 City of Tulare Budget Policies & Practices Amendment.

Recommended Action: Adopt a resolution approving the proposed amendment to the City of Tulare Budget Policies & Practices “Long-Term Financial Planning” section, which includes: 1) consolidating the General Fund Reserve Account policy and General Fund Contingency Reserve into a single reserve; 2) setting a target range for the consolidated reserve of between seventeen and thirty-three percent of a single fiscal year’s budgeted General Fund operating expenditures; 3) establishing a replenishment schedule for the Reserve for if it falls below its minimum target level; and 4) designating $15.3 million of current General Fund unassigned fund balance, which is equal to approximately twentyfive percent of fiscal year 2025 General Fund operating expenditures, as the General Fund Contingency Reserve, to classify it as committed fund balance as defined by the Governmental Accounting Standards Board in its Statement Number 54 (GASB 54).

SUMMARY
In 2022, the Legislature passed Assembly Bill (AB) 2449 (Rubio). This bill provided local agencies with alternative Brown Act meeting procedures in the event that a board member is absent due to “just cause” or “emergency circumstances” and allows the so-affected members to participate in the meeting remotely, usually via teleconference. AB 259 eliminates the sunset on provisions added to the Brown Act by AB 2449, which state that the meeting procedures established by the bill expire at the end of 2025.

By removing the sunset, AB 259 provides flexibility for individual board members of local agencies to attend remotely thus providing the public with essential services. Furthermore, AB 259 preserves the continuity of government operations while maintaining public transparency and accessibility.

Dear Assembly Member Rubio,
On behalf of the City of Tulare, I write in support of Assembly Bill 259, which would eliminate the sunset on provisions added to the Brown Act by AB 2449 (Rubio). AB 2449 provided additional flexibility by amending the Brown Act to provide alternative meeting procedures, notably teleconferencing, to be observed in the absence of a board or council member.

AB 259 ensures the continuity of government operations while maintaining public transparency and accessibility. As technology continues to evolve, providing a balanced approach to local governance through modern teleconferencing procedures is critical. By codifying the provisions in AB 2449, officials will have the ability to fulfill their duties without compromising public engagement.

In the City of Tulare, we have experienced firsthand the delays in decision-making that can happen when officials are unable to physically attend council meetings. If the sunset clause goes into effect, officials who are unable to participate in person due to illness or family emergencies will be left with no option to participate in meetings which can lead to delays in decision-making.

AB 259 promotes transparency and better governance by ensuring councilmembers are not restricted in their ability to participate in meetings.

For these reasons, the City of Tulare supports AB 259.

Agenda Title: Measure R Citizens’ Oversight Committee Appointment

RECOMMENDED ACTION
Appoint Craig Vejvoda to serve as the City of Tulare representative on the Tulare County Association of Governments (TCAG) Measure R Citizens’ Oversight Committee for a term beginning July 1, 2024 through June 30, 2026.

SUMMARY
On November 7, 2006, the voters of Tulare County approved Measure R, imposing a ½ cent sales tax for transportation within the incorporated and unincorporated area of Tulare County for the next 30 days.

The transportation measure will generate slightly more than $652 million over 30 years to Tulare County’s transportation needs.

The Committee is also responsible for informing the public and ensuring that the Transportation Measure expenditures are made in accordance with the Plan and in the best interest of the residents of the county.

The Committee meets quarterly and reviews the prior transactions of Measure R and discusses the upcoming projects. They have received multiple presentations on the usage of Measure R Funds from member agencies. The Committee has scrutinized multiple projects and showed a great interest in making sure Measure R Funds are used to their maximum capacity.

Members of the Committee serve two-year terms beginning July 1 and ending June 30. No member may serve more than eight years.

SUMMARY
The City owns property located at the northeast corner of Morrison Street and Seminole Avenue. This property was acquired as part of the final subdivision map for KCOK Ranch 2B. It was intended to be dedicated to the City as right-of-way for the future extension of Seminole Avenue on the final subdivision map, however, it was incorrectly designated as an out lot and included as part of the future park lot for the KCOK subdivision.

In order to correctly establish the full-width street right-of-way for Seminole Avenue, that portion of the City-owned property on the north side of Seminole Avenue that was inadvertently included in the future park lot needs to be designated as public street right-of-way and incorporated into the City street system.

Agenda Title: Grant of Easement to SCE on Morrison Street and Seminole Avenue

RECOMMENDED ACTION
Authorize the City Manager to execute a Grant of Easement and Certificate of Conveyance to Southern California Edison Company (SCE) for installation and maintenance of SCE utilities located within Lot B, D, and E of the KCOK subdivision, subject only to minor conforming and clarifying changes acceptable to the City Attorney and City Manager.

SUMMARY
As part of the subdivision improvements for Phases 5 & 9 of the KCOK subdivision, the developer was required to underground SCE electrical lines along the subdivision’s Morrison Street and Seminole Avenue frontages. The undergrounding of electrical lines requires certain structures, such as enclosures, vaults, manholes, etc., to be placed at ground level. SCE is proposing to locate these structures and conduit within Lot B of the KCOK 2B subdivision, and Lots D and E of the KCOK 5 & 9 subdivision. These lots are located along the west side of Morrison Street and the north side of Seminole Avenue and were deeded to the City as part of the Landscape and Lighting Maintenance District established for the KCOK subdivision. Landscape lots that are not also designated as street right-of-way are not included in the City’s existing franchise agreements with SCE, and a separate easement is required for SCE to construct, maintain, and repair utilities located within these lots. The conveyance of easements to SCE is normal practice when development is required to underground SCE infrastructure and portions of that infrastructure are located outside of the City street right-of-way.

A copy of the grant of easement to SCE and certificate of conveyance are attached to this transmittal.

Also attached for reference is an exhibit showing the locations of the requested easements on Lot B, D, and E.

LEGAL REVIEW
The submittal from SCE follows their standard format and has been accepted in prior SCE easement dedication requests made to the City.

RECOMMENDED ACTION
Adopt a resolution accepting a portion of the Irrevocable Offer to Dedicate (IOD) real property along the south side of Cartmill Avenue east of Akers Street (also known as Gem Street) that was offered to the City of Tulare across Parcel 1 of Parcel Map No. 5020 filed on December 31, 2010, in Book 51 of Parcel Maps at Page 26 in the Office of the Tulare County Recorder; direct the City Clerk to cause a certified copy of the resolution accepting the IOD to be recorded in the Office of the Tulare County Recorder; and authorize the City Manager or his designee to sign a Certificate of Acceptance for the same.

SUMMARY
Parcel Map No. 5020 was filed by property owners Robert W. Wagner, Successor Trustee of Sub Trust A of the Lanting Family Trust, and Rutherford Investment Properties, LLC. This map created eight parcels south of Cartmill Avenue between the Akers Street alignment (also known as Gem Street) and Retherford Street. An Irrevocable Offer of Dedication (IOD) in favor of the City of Tulare was provided along the Cartmill Avenue frontage of Parcels 1 and 2 on the map.

An additional portion of the IOD for Parcel 1 was accepted by the City Council on November 5, 2025, under Resolution No. 2024-61 for the installation of Southern California Edison utilities related to the Cartmill Commons commercial improvement project.

To accommodate the installation of Southern California Edison utilities, it is necessary to accept an additional 3 feet from the IOD across Parcel 1.

A copy Parcel Map No. 5020, Resolution No. 13-06, Resolution 2024-61, proposed IOD resolution acceptance, and the certificate of acceptance are attached to this transmittal.

FISCAL IMPACT & FUNDING SOURCE(S)
There is no additional fiscal impact associated with this action.

LEGAL REVIEW
The City Attorney will review the proposed resolution prior to its recordation.

ALTERNATIVE ACTION

1. Approve with changes. Staff would work to implement any changes directed by Council. Minor changes would have minimal impact on construction cost and schedule.

2. Deny. Denial of the requested Irrevocable Offer acceptance would require SCE to come up with an alternate means of serving property at the southwest corner of Cartmill Avenue and Akers Street, resulting in significant impacts to construction cost and schedule.

3. Table. Tabling the item to accept a portion of the Irrevocable Offer could have a significant impact on construction cost and schedule.

RECOMMENDED ACTION
Authorize the City Manager to execute a preliminary oversize construction reimbursement agreement with Summit Homebuilders, Inc., a California Corporation, for construction costs associated with the Villas at Sierra Ranch residential development that are eligible for reimbursement in accordance with Chapter

8.64 of the Municipal Code, subject only to minor conforming and clarifying changes acceptable to the City Attorney and City Manager.

SUMMARY
As part of the Villas at Sierra Ranch residential development located on the southeast corner of Corvina Avenue and Retherford Street, the developer of the project was required to abandon an existing sewer lift station located on Leland Avenue west of Hillman Street, and to extend a sewer main from the location of abandonment to the intersection of Leland Avenue and Hillman Street.

A copy of the preliminary oversize construction reimbursement agreement is attached to this transmittal.

Agenda Title: Final Design Phase of CIP Project PK0039 – Alpine Property Improvements

RECOMMENDED ACTION
Approve the project scope and budget for the Final Design phase of Capital Improvement Program Project PK0039 - Alpine Property Improvements; authorize the City Manager to sign a professional services contract with Lane Engineers, Inc. of Tulare, CA in an amount not to exceed $49,900 for final design and construction support services; and authorize the City Manager or designee to approve contract change orders in an amount not to exceed 10% ($4,990) of the contract award amount.

SUMMARY
As part of the Cambridge Homes subdivision located north of Bardsley Avenue and east of Mooney Boulevard, 6-acres of property at the southeast corner of Alpine Avenue and Nelder Grove Street was dedicated to the City of Tulare for park/open space purposes. However, the scope of future improvements or means by which they would be completed was never determined. As such, the property has remained undeveloped since the time of its dedication.

On December 19, 2023, Council authorized the City Manager to execute a lease agreement with the Tulare City School District for the subject property. In accordance with the terms of that lease agreement, the parties agreed upon the following:
• The City will lease the Alpine Property to the District for $1 a year for 99 years. • The Lessee will develop, construct, interconnect, operate, maintain, repair, and upgrade outdoor recreational facilities and ingress, egress, and other access to the property 24 hours per day, 365 days per year.
• Within four years, the Lessee will either convert the land to turf or construct a multipurpose facility such as sports fields, sports courts, community center, but will not construct a facility for dedicated educational space.
• The property may be fenced, but the property will be made available for public use during nonschool hours, weekends as well as summer, winter, and spring breaks. • Within two years, the City will install curb and gutter to the property. In addition, the owner shall retain a 55-foot-long by 22-foot-wide roadway access easement connecting to the north gate of the water tank located near the southeast corner of the subject property for turnaround space for vehicles to maintain the water tank.

Sufficient funding from Fund 601 - Other General Fund CIP was programmed in the City’s Capital Improvement Program for Fiscal Years 2023/2024 thru 2027/2028 to cover both the proposed fee of $49,900, and the requested 10% contingency.

LEGAL REVIEW
The proposed professional services contract between the City and Lane Engineers, Inc. will be reviewed and approved as to form by the City Attorney.

ALTERNATIVE ACTION

1. Approve with changes – Proposed changes to the scope of work, conditions impacting the consultant’s proposal, or changes to the proposed contract would require staff to negotiate with the consultant.

2. Deny – Not approving the contract or project scope and budget would halt progress towards the construction of the improvements that the City is obligated to undertake in accordance with the terms of its lease agreement with the Tulare City School District.

3. Table – A delay in the City approving the proposed contract or project scope and budget could result in the need to re-negotiate the proposal submitted by the consultant, which could result in an increase to their proposed fees.

Agenda Title: Purchase of Real Property for Street Right-of-Way

RECOMMENDED ACTION
Authorize the City Manager to complete and execute the documents necessary to purchase a portion of APN 172-040-034 located on the north side of Bardsley Avenue in the amount of $12,000 as property for public right-of-way required by CIP Project EN0078 – Bardsley Sidewalk Improvements, subject only to minor conforming and clarifying changes acceptable to the City Attorney and City Manager.

SUMMARY
Capital Improvement Project EN0078 is a traffic safety project to install missing sidewalk along the north side of Bardsley Avenue in the vicinity of the Mission Oak High School campus. This stretch of Bardsley Avenue serves as a primary route for school-age pedestrians walking to the high school. In areas where there is no sidewalk, pedestrians are required to walk along the dirt roadway shoulder. Numerous citizen complaints have been received regarding this situation, especially during winter months when the roadway becomes muddy. In such situations, pedestrians frequently opt to walk on the roadway in close proximity to vehicular traffic.

CIP Project EN0078 was included and approved as a part of the City’s 2023-2028 CIP. Subsequently, Council gave direction to staff to commence the right-of-way acquisition phases for the project. A contract was awarded to Paragon Group for right-of-way acquisition services. Paragon Group completed appraisals and has been working on the City’s behalf to obtain the required right-of-way at fair market value for two (2) parcels. The subject parcel is the first owner to have accepted an offer from the City and signed a Purchase and Sale Agreement (attached).

0.0157 acres. The property has minor improvements on the portion being acquired. The land is valued at $6,840, and the value associated with existing improvements affected by the acquisition (cost to cure) was determined to be $4,800. The subsequent acquisition offer was rounded to $12,000.

Project EN0078 – Bardsley Sidewalk Improvements was programmed in the City’s Capital Improvement Program for fiscal years 2023/2024 thru 2027/2028. The identified funding source for the project is Gas Tax Revenues (Fund 022).

RECOMMENDED ACTION
Conditionally approve the final map and subdivision improvement agreement for Phase 1B of the Fulton Estates subdivision for recordation, and accept all easements and dedications offered to the City subject to receipt of the signed final map, all fees, and other required items prior to April 19, 2025.

SUMMARY
Planning Commission Resolution No. 5435, which was adopted on October 24, 2022, approved the tentative subdivision map for the Fulton Estates subdivision. This subdivision is situated on the southwest corner of Tulare Avenue (State Route137) and Oakmore Street and comprises approximately 39 acres with a total of 185 single-family lots at full buildout. The development of the subdivision is being completed in phases. Phase 1B of the Fulton Estates subdivision will consist of 49 single-family residential lots.

LEGAL REVIEW

APPROVING TENTATIVE SUBDIVISION MAP 2022-22- FULTON ESTATES WHEREAS, the City of Tulare Planning Commission held a regular meeting on October 24,2022 to consider a request by Quest Equity to subdivide approximately

38.48-acres iuto a 185-lot single family residential subdivision on property located on the southwest corner of Tulare Avenue (SR-137) and Oakmore Street (APN 172-030-010); and
WHEREAS, the City of Tulare Planning Commission determined that the proposed subdivision map is consistent with applicable Tulare General Plan; and, WHEREAS, the City of Tulare Planning Commission determined that the design or improvements of the proposed subdivision are consistent with the Tulare Gener'al Plan; and,
WHEREAS, the City of Tulare Planning Commission determined that the site is physically suitable for the type of development proposed; and, WHEREAS, the City of Tulare Planning Commission determined that the site is physically suitable for the proposed density of the development; and WHEREAS, the City of Tulare Planning Commission determined that the design of the subdivision or the type of improvements are not likely to cause substantial environmental damage or substantial and avoidable injury to fish or wildlife or their habitat; and,

NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Tulare makes the following specific findings based on the evidence presented l. That the proposed location of the Tentative Subdivision Map is consistent with the policies and intent of the General Plan, Zoning Ordinance, and Subdivision Ordinance.

3) Applicant shall be responsible for the payment of California State Board of Equalization fees as required by LAFCO fol all approved annexations. 4) Applicant to comply with all mitigation measures within the Initial Study/Mitigated Negative Declaration prepared for the project, which are hereby incorporated as Conditions of Approval.

If the Owner/Developer fails to file a protest regarding any of the fees, dedication requirernents, reservation requirements, or other exactions contained in this notice, complying with all the reqnirements of Government Code Section 66020, the Owner/Developer will be legally barred frorn later challenging such exactions.

Oversize nstruction
f fne conditions of project approval require the construction of facilities which have been designated as "masterplan facilities" by the City Engineer, and as such the Owner/Developer may be eligible to receive reimbursement for oversized construction costs in accordance with Chapter 8.64 "Oversized Construction Reimbursement" of the Tulare Municipal Code, and the oversized construction reimbursement policies of the Engineering Services Department. Eligibility for any reimbursement of oversized construction costs is subject to the City Engineer''s review and approval of costs prior to installation. Within 90 days following the notice of completion of the project, the Owner/Developer shall file with the City Engineer a financial statement, in the form specified by the City Engineer, stating and supporting the cost of constructing the oversize improvements. If the financial statement is not filed within this time period, the Owner/Developer shall not be eligible for any reimbursements. Oversize payments will be made in accordance with a separate oversize reimbursement agreement to be executed after completion of all subdivision improvements. The Fire Prevention Bureau conveys the following site plan comments for SP 21-117, Fulton Estates:

1. The project must comply with all of the latest applicable codes and standards

2. When any portion of the facility or building to be protected is more than 400 feet from an existing fire hydrant on a fire apparatus access road as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains shall be provided where required by the fire code official.

3. Additional fire hydrants shall be required. Fire hydrant spacing shall be as follows:
a. Residential development, fire hydrants shall be installed at 50O-foot intervals b. Divided Highway, fire hydrants shall be installed at 500-foot alternating intervals.

4. An approved water supply for fire protection shall be made available prior to combustible materials arriving on the site.

5. An approved fire apparatus access roads shall be provided for every facility, building or portion of a building constructed or moved into or within the City of Tulare. it shall extend to within 150 feet of all portions of the facility and all portions on the exterior walls of the first story of the buildings as measured by an approved route around the exterior of the building or facility. Agenda Title: Resolution with Tulare Police Management Group

RECOMMENDED ACTION
Adopt a resolution approving salary and benefits for the Tulare Police Management Group (TPMG) subject to minor clarifying and conforming changes as approved by the City Attorney.

SUMMARY
The City has reached an agreement with TPMG and staff is presenting a resolution outlining all special compensation benefits for this group. Pursuant to CalPERS regulations, agreements for special compensation benefits must be self-containing and may not refer to other bargaining unit agreements.

In previous agreements, reference was made to the TPOU bargaining agreement for some special compensation benefits. This resolution will 1) confirm existing special compensation benefits 2) make language clarification; and 3) add the newly agreed upon items. The newly agreed upon items are highlighted below:

Salary
Increases to members of the TPMG shall be as follows (with full retroactivity for base pay and overtime accruals):

Four percent (4.0%) increase retroactive to the pay period beginning on July 13, 2024.

Four percent (4.0%) increase effective with the first full pay period in July 2025.

Four percent (4.0%) increase effective with the first full pay period in July 2026.

Education Incentive Pay
Education pay remains at 5.0%.

Service Pay
In addition to the current steps, increase to 3.5% at 15 years, and add 4.0% at 20 years of service.

Previous law enforcement service to be counted and definitions added for clarification.

Bilingual Pay
This pay was increased from 2.5% to 3.0%.

Uniform Allowance
Increase to $1,300 annually.

Specialty Assignment Pay
SWAT/Hazard pay of 2.5% in addition to the current annual incentive of $1,200.

FISCAL IMPACT & FUNDING SOURCES
An additional appropriation will be necessary to fund this year’s salary increases that were more than what was originally anticipated in the adopted budget. The increases for later years will be included in future budgets.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TULARE

SETTING SALARY AND BENEFITS FOR THE POLICE MANAGEMENT GROUP WHEREAS, the City of Tulare (“City”) desires to memorialize the benefits and compensation currently provided to the Tulare Police Management Group (“TPMG”); and WHEREAS, the City’s TPMG group consists of the following positions:
• Police Sergeants
• Police Lieutenants
• Police Captains
WHEREAS, the above positions are considered a group because they share similarities in job duties or are otherwise a logical work-related grouping.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tulare, as follows:

Section 1. Purpose and Application. The purpose of this Resolution is to set forth the salary and benefits for the TPMG group. The City Council retains all rights and authority to amend, reduce, or eliminate benefits and additional compensation in its sole and absolute discretion consistent with any contractual obligations.

This Resolution shall be applicable to the following TPMG group employees:
• Police Sergeant
• Police Lieutenant
• Police Captain
Where there is conflict between this Resolution and the City of Tulare Merit System Rules and Regulations, this Resolution shall supersede and take precedence.

Compensation/Benefit Items:

Compensation
Increases to members of the bargaining unit shall be as follows (with full retroactivity for base pay and overtime accruals).

• There shall be granted a minimum of two (2) hours per 24-hour day at their normal hourly rate for Police Sergeants assigned to the investigation division who are required to be on stand-by at any given time unless prior permission for the police chief or his/her designee.

Call Back/Court Time
• Court “stand-by” compensation shall be compensated at the rate of time and one-half (1 ½) for TPMG group employee’s hourly rate for a minimum of four (4) hours for Police Sergeants.

Comp Time Usage
• Fair week, Farm show, 3rd and 4th of July, Thanksgiving, Christmas and New Year’s Eve are considered blackout days for the purposes of Comp Time usage. • Only one TPMG group employee may use Comp Time per shift, unless approved in advance by the Watch Commander.

Holiday Pay
• TPMG group employees shall receive Holiday Pay for the following holidays:
o January 1 (New Year's Day)
o The third Monday in January (Martin Luther King, Jr. Birthday) o The third Monday in February (President's Day)
o The last Monday in May (Memorial Day)
o July 4 (Independence Day)
o The first Monday in September (Labor Day)
o November 11 (Veterans Day)
o The fourth Thursday in November (Thanksgiving Day)
o The day after Thanksgiving Day
o December 25 (Christmas Day)
TPGM group employees work without regard to holidays and shall receive 10 holidays of 9.6 hours each (equaling ninety-six (96) hours) in lieu of holidays. Each member of the TPGM group shall be paid for holiday hours on the first paycheck in December.

TPGM group leaving municipal service with accrued pay days in lieu of holidays who give at least two weeks of notice of their intention to terminate shall be paid the amount of accrued days in lieu of holidays to the day of termination. Payment for accrued days in lieu of holidays shall be at the employee’s current rate of pay.

POST Certificate Pay
• Employees in the TPMG group shall be entitled to receive POST Certificate pay in the amounts set forth below for obtaining and maintaining the listed POST certificates. The combined maximum amount of POST Certificate pay that any employee shall be eligible is a combined maximum of ten percent (10%) of base pay. The incentive is paid bi-weekly. o Two and a half percent (2.5%) of base pay for; an Intermediate POST Certificate; and
o Five percent (5.0%) of base pay for an Advanced POST Certificate; or o Seven and a half percent (7.5%) of base pay for a Supervisory POST Certificate. o Ten percent (10%) of base pay for Management POST Certificate.

Educational Incentive Pay
Employees in the TPMG group shall be entitled to receive five percent (5%) of base pay as educational incentive pay for an eligible bachelor's degree that enhances the employee’s ability to do their job. Business Management or related field with a minor in Police Science. Educational incentive pay will be paid bi-weekly.

Service Pay
• TPMG group will receive service pay for years of service in a sworn law enforcement positions with the City or another public agency. The service pay increases are cumulative (maximum of 13%) and will be paid bi-weekly.
o Two and a half percent (2.5%) of base salary at five (5) years of service. o Three percent (3.0%) of base salary at ten (10) years of service. o Three and a half percent (3.5%) of base salary at fifteen (15) years of service. o Four percent (4.0%) of base salary at twenty (20) years of service.

Bilingual Pay
• TPMG group shall receive three percent (3.0%) of base salary paid bi-weekly for being both (1) certified as being bilingual in accordance with standards established by the Human Resources Director ensuring that the employee is competent and proficient in the language certified and (2) the employee is routinely and consistently assigned by the City to positions requiring communication language(s) other than English. A re-certification for bilingual shall occur every three (3) years. An employee not passing the re-certification shall not continue to receive the incentive bonus.

Uniform Pay
• TPMG group required to wear uniforms in the performance of their duties shall receive a uniform allowance of one thousand three hundred dollars ($1,300) paid in the first full pay period in July. New employees of the Police department shall receive, upon initial employment, two (2) full sets of uniforms and two summer shirts and foul weather gear.

Any new or reappointed employee whose appointment begins prior to January 1 of any year shall be granted the allotment for uniform maintenance. If appointed or reappointed after January 1, he/she shall be granted uniform allowance the following year. • Additional Uniforms and Uniform Allowance Procedures
Any additional uniforms needed shall be supplied at the employee's expense. The Human Resources Department shall establish such regulations and procedures needed for the administration of the uniform allowance procedure.

SWAT Pay
• TPMG group employees serving on the SWAT unit (team members, team leaders, team commanders, snipers) shall receive $1,200 (annually) plus 2.5% of base pay. The $1,200 incentive will be prorated and paid bi-weekly along with the 2.5% base period incentive. • The SWAT Pay is provided in recognition that SWAT unit members are routinely and consistently exposed to dangerous or hazardous materials or substances or perform hazardous activities to implement health or safety procedures.

Physical Fitness Pay
• Physical Fitness Pay: TPMG group will be compensated for physical fitness time as outlined below:
o TPMG group working a forty (40) hour per week schedule assignment will be compensated up to a maximum of three (3) hours per week (up to a maximum of six (6) hours per 14-day duty period). These employees are required to sign in the Agenda Packet for February 18, 2025 Page 147

police department gym and will be compensated for actual hours of physical fitness time they spend to the maximum as outlined above.

Future Meet and Confer Needs
At anytime prior to six months of the expiration of the current TPOU Memorandum of Understanding, the City and TPMG group agree to meet and confer regarding any changes in benefits to the TPOU that may impact TPMG group.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TULARE
AMENDING THE CITY’S 2024/25 SALARY SCHEDULE
WHEREAS, the City Council adopted Resolution 2024-36 adopting the City’s 2024-25 salary schedule; and
WHEREAS, the City has reached an agreement with Tulare Police Management Group (TPMG), which included a four percent (4.0%) base salary increase effective July 13, 2024; and WHEREAS, the City approved a contract amendment to the City Manager’s contract, which included a four percent (4.0) base salary increase effective October 5, 2024; and WHEREAS, the amendment to the salary schedule will reflect the updated salary increases for the classifications of Police Captain, Police Lieutenant and Police Sergeant.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tulare, as follows:

RECOMMENDED ACTION
Award the purchase of one new/unused 2025 Ford F-350 truck to National Auto Fleet Group, of Watsonville, CA using Sourcewell Contract No. 091521-NAF in the amount of $71,759.50, which includes all fees, tax, and shipping.

SUMMARY
The City is a member of Sourcewell, which is a national public service agency that provides for cooperative purchasing for government agencies. Through the Sourcewell Contract No. 091521-NAF, staff is requesting authorization to purchase one new/unused 2025 Ford F-350 4WD crew cab truck from National Auto Fleet Group, of Watsonville, CA in the amount of $71,759.50.

The proposed truck is an expansion unit for the Graffiti Division within the Office of Safety, Compliance and Facilities. The proposed truck will be utilized for graffiti abatement and to tow heavy equipment for encampment clean-ups. The truck will be equipped with a generator, paint sprayers, pressure washer and hose reels.

FISCAL IMPACT & FUNDING SOURCE(S)
Funding for the purchase of the vehicle will come from the Fleet Replacement Funds for the Graffiti Division (Fund 604). The FY 24/25 appropriated budget for the truck is $75,000 and the cost for new truck is $71,759.50. The remaining funds will be used to equip the truck.
