STAFF REPORT
TO: City Council
FROM: Community Development Director
FOR MEETING: Jun 14 2022
SUBJECT: Abandoned Shopping Carts - Future Agenda Item Request.

RECOMMENDATION:

The City Council provide direction to Staff on policy or regulatory actions to reduce the number of abandoned shopping carts and send down to the Planning Commission for policy development.

ORDER OF PROCEDURE:

Request Staff Report (Community Development Director
Presenting)
Council Questions of Staff
Request Public Comment
Council Discussion
Provide Direction
ATTACHMENTS:
• Shopping Cart Presentation
BACKGROUND:

Abandoned shopping carts have become a nuisance throughout the City as they are removed from store premises and often left on the side of the road or in vacant lots. They are unsightly and can be a hazard depending on where abandoned. There are several approaches to mitigating this problem ranging from warning signage to locking mechanisms to cart retrieval services.

Require Warning Signage
While signage is not a big deterrent for the theft of shopping carts, it does provide notice to the thief that they can incur fines for removing shopping carts from premises. Signage also lays the foundation for future prosecution if necessary.

Citations and Fines
Citations and fines can be approached two ways. Citing and fining the store owner and/or citing and fining the thief if caught in the act by Code Enforcement. The standard Code Enforcement fines for a nuisance violation consist of a warning, $100 for the first offense, $250 for the second offense, and $500 for the third offense.

Coin Deposit Systems
While more often used on the east coast and in Europe, these systems can deter cart removal by requiring the shopper to deposit a coin (typically a quarter) or a token to unlock a cart. The coin or token is returned once the cart is returned to its holding area. The down side is that the customer must have a coin or token to use the cart.

Wheel Locking Devices
These systems, typically magnetic or electronic, will lock the wheels of the cart and limit the ability to move it in two instances: 1) at the store entrance if the cart contains unpaid items when the cart is exiting or 2) at the site Page 543 of 545 perimeter to prevent the cart from leaving the site. This requirement could be added as a condition of approval by the Planning Commission at the approval of the store site plan. While it does not impact existing stores or those that have been entitled, fines could be used to apply pressure to install these systems to existing stores.

Cart Retrieval Service
This alternative contracts with a private service to periodically retrieve shopping carts. The service then usually bills the store owner for the retrieval or the City who in turn bills the store owner.

What other comparable cities are doing:

Jurisdiction Enforcement Approach
Apple Valley Administered by Code Enforcement. Contracts with RMS corporation for retrieval.

Cathedral City Contracts with California Shopping Cart Retrieval Corporation (CSCRC) for retrieval.

Generally, the CSCRC works with various major retailers for this service.

Desert Hot Springs
Administered by Code Enforcement. Fines are issued to the owner of the carts with escalating amounts, depending on number of instances. Retailers are required to retrieve their own carts.

Palm Springs Administered by Code Enforcement. Contracts with RMS corporation for retrieval. City reserves the right to impound abandoned carts.

Yucca Valley
Administered by Code Enforcement. Retailers are required to retrieve their own carts.

City will fine owners of carts, and add it to the cost of the annual business license renewal.

ENVIRONMENTAL:

Not applicable.

ALTERNATIVES:

The City Council could suggest or request more alternatives to Staff.

FISCAL IMPACT:

None.
