MEETING DATE/TIME: 3/6/2024

ITEM NO: 2024-1550

AGENDA SUMMARY REPORT
SUBJECT: Receive the Annual Report Regarding the City's Cannabis-Related Ordinances; and Provide Direction to Staff as Necessary.

DEPARTMENT: Community
Development PREPARED BY: Jesse Davis, Chief Planning Manager PRESENTER: Jesse Davis, Chief Planning Manager
ATTACHMENTS:

1. Cannabis Related Businesses - Ukiah
Summary: City Council will receive a report reviewing existing requirements for cannabis-related businesses, as contained within the Ukiah City Code, and provide direction to Staff, as necessary.

Background: Between 2007 and 2017, the City of Ukiah adopted a number of ordinances and polices pertaining to cannabis, primarily in response to changes in State regulations. On February 15, 2017, the City Council adopted Ordinance No. 1176 to allow for the retail of medical cannabis, and on November 1, 2017, Council adopted an amendment to allow for the retail of adult-use cannabis, through Ordinance No. 1182.

On December 20, 2017, Council adopted Ordinance No. 1185 to regulate personal and commercial cannabis cultivation. Then on January 17, 2018, Council adopted Ordinance No. 1186 to regulate cannabis-related businesses. Subsequently, on June 6, 2018, Council adopted Ordinance No. 1190 amending the use permit application process to establish operational standards for cannabis-related businesses. The most recent regulatory updates regarding cannabis were codified by Ordinance Nos. 1226 and 1230.

On August 3, 2022, Council adopted Ordinance No.1226, which to the extent possible, consolidated cannabis regulations into a single article within Ukiah City Code (§9174.2 & §9174.3); updated terminology, definitions, and permit types to mirror State definitions, and reduced the number of permit renewals required. As a result, instead of requiring the indefinite renewal of use permits, the ordinance amended regulations to require only one (1) renewal after the first year of operation. The ordinance also removed cannabis-specific parking requirements in favor of standardized commercial parking requirements; enabled an administrative withdrawal procedure for all cannabis-related businesses; and allowed for both medical and adult use retail cannabis businesses in the CN (Neighborhood Commercial) zoning district.

Subsequently, in 2023, the City's Cannabis Ad Hoc worked with Staff to develop and adopt an on-site consumption policy for cannabis retailers. On April 5, 2023, the Council adopted Ordinance 1230 to allow for the consumption of cannabis products in designated cannabis consumption areas at permitted cannabis retailers upon approval or modification of their associated use permit.

Discussion: Number & Type of Cannabis Businesses
As conveyed in Attachment 1, there are currently six (6) active cannabis related businesses operating within Ukiah. Five (5) of those businesses include cannabis retail while one (1) is focused on manufacturing, processing and distribution. There are three (3) approved but non-operational businesses for which entitlements have been obtained, but the business is not considered active. Since 2018, five (5) businesses

Page 620 of 627 ends
Page 2 of 2 ends

have withdrawn approved or in-progress applications. Presently, there is one (1) business that maintains a designated cannabis consumption area, and one (1) that is currently under review by the City of Ukiah Planning Commission.

Analysis on Ordinance Effectiveness
Overall, standards within the City's cannabis regulations are functioning as designed by the cannabis ad-hoc committee, Planning Commission, and City Council, and achieving their intended purpose. Discretionary review procedures for both minor and major use permits provide the needed level of review and oversight, and cost recovery procedures are adequate for the amount of work and staff time for the processing of applications. The amendments approved to streamline and clarify cannabis regulations have proven beneficial to staff, especially the ability to administratively withdraw applications and limit the number of required renewals.

Since 2022, Staff has not received any reports or cases of nuisance-related impacts from the Ukiah Police Department, Code Enforcement or adjacent property owners. Throughout the year, Planning Division Staff work closely with other Departments, particularly the Ukiah Police Department, to process background checks and ensure that businesses are abiding by local regulations and their approved discretionary permit.

Recommended Action: Receive report regarding cannabis-related business ordinances and provide additional direction as necessary.

Agenda Item No: 14.c.

MEETING DATE/TIME: 3/6/2024

ITEM NO: 2024-1557

AGENDA SUMMARY REPORT
SUBJECT: Receive Updates on City Council Committee and Ad Hoc Assignments, and, if Necessary, Consider Modifications to Assignments and/or the Creation/Elimination of Ad Hoc(s).

DEPARTMENT: City Clerk PREPARED BY: Kristine Lawler, City Clerk PRESENTER: Mayor Dueñas and Various Councilmembers
ATTACHMENTS:

1. 2024 City Council Special Assignments and Ad Hocs
Summary: City Council members will provide reports and updates on their committee and ad hoc assignments. If necessary, the Council may consider modifications.

Background: City Council members are assigned to a number of committees and ad hoc activities. These assignments are included as Attachment 1.

Discussion: Previously, the City Council discussed having more time allocated to reporting on committee and ad hoc activities. Often, the Council Reports section of the regular agenda is rushed due to impending business (i.e., public hearings), and not enough time is afforded for reports beyond community activities.

In an effort to foster regular updates on committee and ad hoc assignments, this item is being placed on the agenda to provide the City Council members an expanded opportunity to report on assignments and modify assignments as necessary.

Recommended Action: Receive report(s). The Council will consider modifications to committee and ad hoc assignments along with the creation/elimination ad hoc(s).
