oid "The City of Gracious Living"
DATE: January 12,2026
TO: MAYOR AND CITY COUNCIL
FROM: MICHAEL BLAY,CITY MANAGER
PREPARED BY:DAMIEN R.ARRULA,ASSISTANT CITY MANAGER

JESSICA ESCOTO,RECREATION&COMMUNITY SERVICES MANAGER

MEGHAN MEADE,RECREATION&COMMUNITY SERVICES SUPERVISOR

ANDREW MCCULLOUGH,POLICE SERGEANT
SUBJECT: CONSIDER ADOPTING A RESOLUTION AMENDING THE 2025 MASTER FEE

SCHEDULE
RECOMMENDED ACTION:

It is recommended that the City Council adopt a Resolution amending the 2025 Master Fee Schedule to adjust certain fees within the Police Department and the Recreation&Community Services Division to cover the cost of services.

GOAL STATEMENT
The proposed action supports the City's goal of providing fiscal stewardship for the City of Upland.

BACKGROUND
On May 23, 2022,the City Council approved Resolution No. 6658 adopting the Master Fee Schedule and directing the City Manager to return to Council within the next five years with a comprehensive Cost Allocation Plan and User Fee Study update. In the interim years,City Council authorized the City Manager to adjust Citywide user fees based on the January year-to-year increases in the local Consumer Price Index.

On August 14,2023,the City Council approved Resolution No. 6742 adopting a Master Fee Schedule.

On April 14,2025,the City Council approved Resolution No.6825 adopting a Master Fee Schedule.

On October 13,2025,the City Council approved Resolution No. 6851 adopting a Master Fee Schedule.

The City's "Master Fee Schedule" combines listings of City fees into a single document. Periodic publication of a revised Master Fee Schedule is recommended to: 1)maintain appropriate recovery ratios of service costs; 2) add or delete fees for service; and/or 3)incorporate pre-existing fees and charges that have not previously been included in the published Fee Schedule.

California law permits local government agencies to recover the full cost of providing user-related services from those who receive the benefit of the service.User fee-related services are those services where the customer is identifiable, the service is measurable, and the service can be withheld for non-payment. Full cost is defined as including both direct and indirect costs(overhead)of the service.

The objective of establishing a user fee is to recover all or part of the cost of providing a requested service from those who benefit directly, so as to limit or avoid subsidizing the service through use of General Fund revenue. However, recovery of full cost is not always feasible, or advisable. In some cases, the City Council may decide to reduce costs rather than increase fees and/or continue some level of General Fund subsidy. Further, cities may not set user fees at higher than the cost of providing the service.

ISSUES AND ANALYSIS
Following the approval of the 2025 Master Fee Schedule, staff has identified several revisions and additions necessary to update the existing schedule.

Recreation&Community Services Division Fees
Recommended fee adjustments are specifically related to athletic facility usage. These adjustments ensure consistency with current policies, operational needs, and facility conditions. The proposed changes include the following:

Page 1328 of 1374 ends

• Sports Field Group Categories: Update the Sports Field Usage and Sports Field Light Usage categories to align with the City Council-approved Athletic Facilities Policy and Procedures. • Premier Field Usage Fee:Adjust the fee from$150 to$100.The condition of Memorial North is not currently at"premier field"standards;fees will be re-evaluated once the field meets the premier level. • Cabrillo Park Soccer Complex Fees: Standardize the rates for Groups 1A, 1B,and 2A to$5 per field for both north and south fields(previously$2.75 for north and$5 for south). • Maintenance Fee: Covers the cost of materials required to repair and maintain athletic fields. • Maintenance Worker Fee: Covers staff time dedicated to field repair and maintenance. • Park Monitor Fee(if necessary): Covers staff time for field monitoring when required. • Key Deposit:Increased to discourage key sharing among user groups. • Damage Deposit:Covers potential facility damage. The full deposit is refundable if the facility is returned in its original condition.
• Cancellation Fee: Assessed to cover administrative costs incurred when groups cancel reservations with insufficient notice, preventing the City from rebooking the field. • Vandalism Fee: Covers materials and staff time required to address vandalism attributable to user groups. • Park Monitor Fee — Special Event Permits: Covers staff time for monitoring large-scale private or public events in parks.
• Park Monitor Fee —Picnic Reservations: Helps to subsidize the cost of staff to monitor parks throughout weekends for customer service or maintenance needs.

Police Department Fees
The City of Upland currently does not bill separately for a false 211-silent alarm or a panic alarm. These types of false alarms are generalized under all false burglary alarms. The Upland Police Department will typically utilize more resources when responding to a robbery or panic alarm verses a burglary alarm. These resources can include but are not limited to additional police officers, drone usage,K9 response, and the time to coordinate a plan for a potential violent encounter.
• An analysis was conducted from 11/17/24—11/17/25 on panic alarms within the City of Upland.During that period, there were(96)calls for service labeled"Panic Alarms."Out of those(96)calls for service,only(2) of those were valid Panic Alarms.
• An analysis was conducted from 11/17/24 — 11/17/25 on Silent 211(robbery) alarms within the City of Upland.During that period, there were(86)calls for service labeled"211-silent."Out of those silent robbery alarms,all(86)were found to be false.
• These types of alarms are typically dispatched with a minimum of(2) officers and sometimes additional officers depending on the circumstances. The average time it takes the Upland Police Department to close out one of these types of alarms is 12 minutes.
• In this time frame, that is a total of(182) calls for service. If a minimum of(2) officers responded at 12 minutes each call, that is a total of 4,368 minutes(73 hours)of officers'time.

The proposed fee for responding to these types of alarms will in theory minimize the amount of calls for service, which would lower response times for valid priority calls for service. The Upland Police Department will create a new disposition code within our system to separate the billing types.

Public Hearing Notification
In accordance with Government Code Section 66018,notice of the meeting to discuss potential increases in fees was sent at least 14 days in advance to all interested parties who had filed a written request for notice of the meeting on new or increased fees for service charges and a notice of public hearing was published once a week for two consecutive weeks at least 14 days prior to the hearing.

Next Steps
These fees will be effective as of January 13,2026.

ENVIRONMENTAL DETERMINATION
The proposed action is not subject to the California Environmental Quality Act(CEQA). Section 15378 of the CEQA Guidelines defines a project subject to CEQA. The proposed action is not included within the definition of a"project" and thus is exempt.

Page 1329 of 1374 ends

FISCAL IMPACTS
The changes to the fees are intended to more accurately recover the cost of providing the service, and therefore, any revenue will have a budget-balancing effect.

DARREN CHAN,MANAGEMENT ANALYST
SUBJECT: 2025 LEGISLATIVE UPDATE AND CONSIDERATION OF A RESOLUTION UPDATING

THE CITY'S LEGISLATIVE PLATFORM
RECOMMENDED ACTION:

It is recommended that the City Council receive and file the Legislative Update and adopt a Resolution approving a Legislative Platform and rescinding Resolution No.6612.

GOAL STATEMENT
The proposed action supports the City's goal of providing responsible and transparent governance for the City of Upland.

BACKGROUND
Annually, the California State Legislature and the U.S. Congress pass legislation that directly impacts the City of Upland and other local governments. For the purpose of efficiently pursuing legislative action that reflects the City's interests, and in accordance with its goals and objectives, the City of Upland adopted a formal Legislative Platform on September 13,2021,by Resolution 6612.

The 2025 California Legislative Session concluded on September 13, 2025, after an active and amendment-heavy final week. The session produced significant new laws affecting the City's operations, public transparency, housing production, environmental review, climate and energy policy, labor requirements, water management, and regional planning.

Several recently introduced bills directly impact the City's land use authority, public meeting procedures, and public safety enforcement. These measures conflicted with the City's Legislative Platform, which generally opposes unfunded state mandates. Despite the City's advocacy efforts, a number of these bills were enacted and signed into law by Governor Newsom.

A review of the City's legislative platform, conducted as part of its ongoing legislative advocacy efforts, indicates that updates are needed to ensure alignment with the City's current legislative priorities and to maintain relevance within the evolving State and Federal legislative landscape.

ISSUES AND ANALYSIS
Although many bills passed in 2025, the ones most likely to affect the City are related to Brown Act modifications that create new requirements for public meetings, state mandates that override local authority over planning and housing development in the area surrounding the Metrolink station, and the State's response to federal immigration enforcement efforts. Additionally, several other bills have indirect impacts on the City's interests.

Brown Act Requirements and Local Transparency
• New requirements for remote public participation and agenda translation. • Increased administrative and technology demands for meeting management. • Expanded language access obligations for cities with qualifying demographic thresholds.

SB 707 is one of the most impactful bills for cities statewide. It modernizes the Brown Act by requiring certain legislative bodies to provide two-way telephonic or audio-visual participation for all meetings. Although advisory boards and commissions are generally exempt from mandatory remote access, any remote participation by decision- making members without posting a public location triggers the requirement. The bill also requires agenda translation

Page 1341 of 1374 ends

into languages spoken by at least 20% of local residents who speak English"less than well,"up to three languages, and mandates designated spaces where members of the public may post their own translated agendas. These requirements substantially expand the administrative complexity of preparing and hosting public meetings, potentially increasing staff time, translation needs, and technology investments for the City.

Land Use,Development,and Transit-Oriented Housing
• SB 79 establishes statewide zoning requirements near major transit. • Clean-up legislation addresses warehouse siting and truck-route requirements.

SB 79 introduces a new statewide framework for transit-oriented development(TOD),requiring significant increases in allowable height and density near major transit stops in qualifying urban transit areas.Because the Upland Metrolink Station would classify as a Tier 2 station under the Bill, this would put limits on local discretionary review and mandate streamlined zoning and development standards in the area around the station, including Historic Downtown Upland and the surrounding community. Additional land-use bills include AB 735 and SB 415,which clarify implementation of warehouse siting requirements and circulate-element updates under AB 98. These revised timelines and clarifications will be important should the City consider logistics-related land uses in the future.

Public Safety and Immigration Response
• Increased regulation of immigration enforcement on school campuses. • Mandates on local law enforcement agencies to increase officer identification and transparency.

In response to increased Immigration and Customs Enforcement(ICE)activity in California, several bills were passed to curtail enforcement activity specifically related to school campuses. For example,AB 49 requires agents to present a valid judicial warrant before being allowed access and SB 98 requires schools to notify parents and guardians when immigration enforcement is present on campus. The most contentious bill is SB 627 which prohibits state and federal law enforcement officers from wearing facial coverings while on duty. However, the broad language of the bill may impact the operational safety and efficiency of on-duty officers and create administrative burdens on already overburdened agencies.

Budget,Fiscal Policy,and Funding Opportunities
• The State faced a$12 billion deficit but preserved many grant programs. • Over $3.2 billion in Proposition 4 bond funds were appropriated for statewide climate, water, parks, and wildfire programs.
• Long-term revenue uncertainty may affect future program funding levels.

California's fiscal challenges influenced nearly every policy area in 2025.Despite a sizable deficit, the State avoided deep cuts by relying on one-time solutions, including reserve withdrawals and cost shifts. Trailer bills passed in the session's final days implemented Proposition 4 funding, appropriating more than$3.2 billion to statewide priorities such as safe drinking water, wildfire resilience, coastal protection, biodiversity, extreme heat mitigation, parks, and clean air programs. These appropriations may translate into future competitive grant opportunities for the city's park improvement, water infrastructure, and climate adaptation projects. However, the budget's dependence on temporary fixes underscores continued revenue instability, meaning future expansions or new programs may be limited.

Housing,Homelessness,and CEQA Reform
• CEQA clean-up provisions clarify timelines, site definitions, and review processes. • HHAP Round 7 preparation begins, offering future funding for homelessness programs. • Homeless service ordinances face new limits under SB 634.

Housing and homelessness were major themes in 2025, with SB 158 providing important clarifications to earlier CEQA streamlining legislation. The bill adjusts deadlines tied to tribal consultation, refines defmitions for natural and protected lands, and modifies rules for Builder's Remedy and ministerial housing approvals. These changes influence how local agencies, including Upland, evaluate infill projects and manage environmental review obligations. SB 158 also directs preparation for Round 7 of the Homeless Housing, Assistance, and Prevention (HHAP) program, with funds anticipated in September 2026. Additionally, SB 634 prohibits cities from enforcing ordinances preventing individuals or organizations from providing services to homeless persons, requiring adjustments to local enforcement and engagement strategies.

Page 1342 of 1374 ends

Energy, Climate,and Air Quality
• A major climate and energy package passed at the end of session. • New statewide Cap-and-Invest(previously Cap-and-Trade)structure prioritizes program emphasis on long- term revenue for housing, clean water, and climate projects. • Expanded air monitoring and environmental justice programs may affect local and regional planning.

Several impactful policies emerged in the final days of the session. The six-bill energy package includes SB 237, SB 352, SB 254,AB 825,AB 1207, and SB 840. Together, these laws address fuel price stability, climate investments, wildfire mitigation, environmental justice, and electric grid reliability. SB 352's expansion of community air monitoring and creation of a Bureau of Environmental Justice is particularly relevant in inland communities like Upland, where air quality concerns are often tied to goods movement and regional transportation. The Cap-and-Invest reauthorization(AB 1207 and SB 840) guarantees continued funding for programs such as Affordable Housing and Sustainable Communities, transit operations, wildfire resilience, clean water, and air protection.

Water,Environmental Compliance,and Utility Protection
• Expanded legal uses for recycled water.
• Strengthened statewide water planning and long-term supply analysis. • New PFAS prohibitions and enhanced enforcement tools against water theft.

Water supply reliability and environmental health remain ongoing state priorities. SB 31 expands the allowable uses of recycled water in non-potable settings, potentially supporting future parks and landscape irrigation strategies in Upland. SB 72 strengthens the California Water Plan by requiring broader stakeholder engagement and the development of interim and long-term statewide water supply targets. SB 682 establishes future prohibitions on products containing PFAS, which will impact City procurement practices. Finally, SB 394 provides stronger enforcement mechanisms against water theft, including unauthorized hydrant use, which may be an issue important to cities managing drought conditions, hydrant safety, and utility revenue protection.

Labor and Public Employment
• New pre-notification requirements for contracting out certain services. • Expanded transparency and collaboration expectations between cities and employee organizations.

Labor reforms continue to affect municipal contracting. AB 339 requires cities to provide recognized employee organizations with at least 30 days' written notice before issuing an RFP, RFQ, or contract extension for work that overlaps with represented employee classifications. The notice must include the proposed contract's duration, scope of work, costs, and the draft solicitation or equivalent details. This law will require earlier project planning and more coordination with labor groups before procuring services in areas such as maintenance, cleaning, or specialized operations.

Revenue and Taxation
• Clean-energy tax credit conformity affects long-term energy project financing. • New statewide tax measure may appear on the 2026 ballot.

SB 302 aligns certain state tax provisions with federal clean energy credit treatment, potentially affecting financing for municipal or regional renewable energy projects. Ongoing efforts to reintroduce a statewide Taxpayer Protection Act may eventually restrict the ability of cities to adopt or extend local tax measures, making this an area to monitor closely.

Legislative Platform Update
In light of recent legislative changes,an updated Legislative Platform is included in the attached Resolution. Changes from the original 2021 Legislative Platform are as follows.

General changes include:
• The platform was enhanced aesthetically by adding the City Seal, inclusion of brand-consistent fonts and colors, and enhanced numbering and section formatting for ease of readability • The opening purpose was rewritten to align with the City's adopted Mission Statement • Position statements were altered to include more definitive Support/Oppose statement Deletions from the 2021 Legislative Platform include:
• #46—Support of legislation allowing discretionary review on school district planning

Page 1343 of 1374 ends

• #64—Opposition to NPFA standard 1710 mandates on fire crew staffing Additions in the 2025 Legislative Platform include:
• 2.1 —General statement of support for City to pursue new funding sources • 2.2—Support for changes to Bradley Burns for more equitable distribution of e-commerce sales tax • 5.4—Statement of support for local and regional efforts to address homelessness • 11.7-11.9—Support general legislation regarding PFAS/PFOA • 15.1—General statement of support for legislation and funding that promotes law enforcement services • 15.3—Statement of support for local authority to address and mitigate challenges related to homelessness • 15.11—Oppose legislation that removes or diminishes local authority over law enforcement • 16.3—Support funding for disaster preparedness including development of an EOC • 17.4—Support funding for water, wastewater and stormwater infrastructure

ENVIRONMENTAL DETERMINATION

PURPOSE
The City of Upland recognizes the importance of proactive legislative engagement to protect and advance the interests of its residents and businesses. The City's Legislative Platform (Platform) outlines the City's guiding policy principles and positions, aligning them with the City's mission statement and goals. The Platform serves as a strategic framework guiding the City's federal, state, and local advocacy efforts. Once adopted by the City Council, the Platform provides clear direction to the City Council, City Manager, and staff on key policy issues, enabling legislative and regulatory matters to be addressed in a timely and efficient manner.

The objective of the Platform is to adopt official city positions on clearly stated legislative issues to streamline the legislative approval process by eliminating repetitive concurrence and direction from the City Council on previously approved issues. The Legislative Platform is developed and maintained using the goals and objectives of the City Council, a review of legislative priorities from the League of California Cities, input from City Council and staff, research of current law and pending legislation, and discussions with the City's legislative advocates.Where Federal and state legislation are consistent with the Platform or the City's past legislative positions, City staff shall be authorized to prepare position letters with the authorization of the City Manager.

GUIDING PRINCIPLES
I. PRESERVE LOCAL CONTROL
Preserve and protect the City's powers, duties, and prerogatives to enact local legislation and policy direction concerning local affairs and oppose legislation that preempts local authority. Local agencies should preserve authority and accountability for revenues raised and services provided.

II. PROMOTE FISCAL STABILITY
Support measures that promote fiscal stability, predictability, financial independence, and preserve the City's revenue base and maximum local control over local government budgeting. Oppose measures that shift local funds to the County, State or Federal Governments and/or make cities more dependent on the County, State or Federal Governments for financial stability, such as unfunded mandates or mandated costs with no guarantee of local reimbursement or offsetting benefits.

III. SUPPORT FUNDING OPPORTUNITIES
Support opportunities that allow the City to compete for its fair share of regional, state, and federal funding. Support funding for programs with combined benefits to air quality, water quality, affordable housing, infrastructure (including multi-modal transportation systems), public safety and public health.

IV. ENHANCE QUALITY OF LIFE THROUGH ADEQUATE PUBLIC SAFETY Reform recently enacted criminal justice laws -enacted by both statute and initiative - that have eroded public safety protections of Upland residents. Protect existing city authority to deliver local emergency services.

POLICY STATEMENTS
The following legislative positions and policy statements generally reflect priorities of the City on a regular and long-term basis and align with the City's mission of delivering superior services that meet community needs with transparency and integrity.

oid "The City of Gracious Living"
DATE: January 12,2026
TO: MAYOR AND CITY COUNCIL
FROM: MICHAEL BLAY,CITY MANAGER
PREPARED BY:ROBERT D.DALQUEST,DEVELOPMENT SERVICES DIRECTOR SUBJECT: URGENCY ORDINANCE AMENDING SECTION 17.22.060(E) OF THE UPLAND

MUNICIPAL CODE RELATING TO CAR WASH FACILITIES AND FINDING THE ACTION

TO BE EXEMPT FROM CEQA
RECOMMENDED ACTION:

It is recommended that the City Council read the title of the ordinance, waive further reading, and adopt an Urgency Ordinance regarding the establishment and regulation of car washes, pursuant to Government Code section 36934 and 36937,declaring the urgency thereof, and making a determination of exemption under the California Environmental Quality Act.

GOAL STATEMENT
The proposed action supports the City's goal to periodically consider changes to the City's Zoning Code as issues arise or State legislation mandates amendments.

BACKGROUND
On May 28, 2024, the City Council expressed concerns with the overconcentration of car washes and their noise, traffic, and other harmful impacts. At that meeting, the City Council directed staff to study the issue and return to the City Council with some options for their consideration, including a possible moratorium or changes to the City's zoning code regulations for car washes.

On December 23, 2025, an application was submitted for an Administrative Use Permit to establish a Quick Quack car wash at the site of the Old Tequila Hoppers Bar & Grill on Mountain Avenue. This property has been on the market for about a year, and staff had fielded questions initially from a consulting firm hired by a potential buyer to perform due diligence for a car wash on the site. Subsequent to this inquiry, there was no further communication until a few weeks ago when staff was contacted that an application for a car wash was being prepared to file with the City.

No Preliminary Review was submitted for this project. This site is approximately 1,054 linear feet from the Mountain View Car Wash which is currently being completely remodeled and is located on the west side of Mountain Avenue, just north of the Pacific Electric Trail. This would result in a third car wash along the Mountain Avenue Corridor.

ISSUES AND ANALYSIS
Presently, there are 13 approved and 12 constructed car washes in the City, which include: seven (7) that are standalone, full-service facilities; four(4) that are attached to a gas station/convenience store; and two (2) that are older self-serve facilities which are coin or token operated and located in older commercial centers. Attached is a list of the car washes in the City, their addresses, and their start dates(See Exhibit B).

Overconcentration in specific areas has become an issue as car washes in the City are located on several major commercial areas. For example, along a three-mile stretch of Foothill Boulevard, between Dewey Way and Hospital Parkway, there are seven (7) car washes. On Mountain Avenue, in a one-half(1/2) mile corridor between Arrow Highway and the Pacific Electric Trail crossing, there are two(2)existing car washes("Mountain Avenue Corridor).

On 20th Street, north of the 210 Freeway along a 1,200 foot distance between Campus Avenue and the terminus of 20th Street, there are three(3)existing car washes(See Exhibit C).

Car washes are permitted with an Administrative Use Permit(AUP)in all the Mixed-Use zoning districts and all the Commercial and Office zoning districts. Section 17.22.060(E) of the Zoning Code provides only five development standards for car washes which address only a few design and operational issues. There is no minimum distance separation between other car washes in this section.

Page 1364 of 1374 ends

Thus, there is an urgent necessity for the City to establish comprehensive development standards for new car washes to prevent further overconcentration of this use along the City's prime commercial arterials. The proliferation of car washes throughout the City are an immediate threat to public health, safety or welfare. Car washes are often noisy because they require the use of large-scale, industrial vacuuming systems, and blowers, and cause an increase in vehicular traffic which impacts compatibility of surrounding commercial uses. These impacts can be particularly acute when car washes are located near residential uses and when multiple car washes are concentrated in a small area.

Car washes do not generate any sales tax revenue to the City, as this is a service use and sales tax is not collected, except for the small retail items and soft drinks that are typically sold. In addition, car washes do not employ more than a few people due to the self-service nature of the use.

The Urgency Ordinance amends Section 17.22.060(E) of the Zoning Code and establishes a mandatory minimum distance of one-half(1/2)mile,or 2,640 linear feet, from another car wash facility of any type in the City. The Urgency Ordinance will enable staff time to study this land use and establish more comprehensive development standards and determine from a Citywide perspective which locations or areas are most appropriate for this use and avoid developing car washes on prime commercial sites which are meant to be developed to contribute to the City's tax base and generate employment.

The Urgency Ordinance will require a Four-Fifths vote of the City Council. If the Council adopts the Urgency Ordinance, staff will follow up with a regular ordinance that will contain more comprehensive development standards for car washes. The City Attorney has reviewed the Urgency Ordinance and recommends approval as to form and content.

ENVIRONMENTAL DETERMINATION
Staff is recommending that it can be seen with certainty that there is no possibility that the adoption of this Urgency Ordinance, and the zoning provisions established hereby, may have a significant effect on the environment, because the Urgency Ordinance will impose greater limitations on development in the City, and will thereby serve to eliminate potentially significant adverse environmental impacts. It is therefore not subject to the California Environmental Quality Act review pursuant to Title 14,Chapter 3, Section 15061(b)(3)of the California Code of Regulations.

FISCAL IMPACTS
There is no fiscal impact associated with this action.

ALTERNATIVES
Provide alternative direction to staff.

CEQA: Determine to be Exempt.

CITY OF UPLAND AMENDING SECTION 17.22.060(E) OF

THE CITY OF UPLAND MUNICIPAL CODE RELATING TO CAR

WASH FACILITIES AND FINDING THE ACTION TO BE

EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT (CEQA) UNDER SECTION 15061(b)(3) OF

THE CEQA GUIDELINES
WHEREAS, the City of Upland, California ("City") is a municipal corporation, duly organized under the constitution and laws of the State of California; and WHEREAS, the City is responsible for adopting and implementing land use regulations within its boundaries. The Upland Municipal Code regulates the entitlement, establishment and operation of car washes within the City; and WHEREAS, the proliferation of car washes throughout the City are an immediate threat to public health, safety or welfare. Car washes are often noisy because they require the use of large-scale, industrial vacuuming systems, and blowers. Car washes also cause an increase in vehicular traffic in surrounding areas.

These impacts can be particularly acute when car washes are located near residential uses and when multiple car washes are concentrated in a small area; and WHEREAS, there are a total of thirteen (13) car washes in the City. More specifically, along a 3-mile stretch of Foothill Boulevard, between Dewey Way and Hospital Parkway, there are seven (7) car washes. On Mountain Avenue, in a one- half (1/2) mile corridor between Arrow Highway and the Pacific Electric Trail crossing, there are two (2) existing car washes ("Mountain Avenue Corridor). On 20th Street, along a 1,200 lineal foot distance between Campus Avenue and the terminus of 20th Street, there are three (3) existing car washes; and
WHEREAS, on May 28, 2024, the City Council expressed concerns with the overconcentration of car washes and their noise, traffic, and other harmful impacts.

At that meeting, the City Council directed staff to study the issue and return to the City Council with some options for their consideration, including a possible moratorium or changes to the City's zoning code regulations for car washes. City staff has been studying the issue and developing new regulations for car washes; and WHEREAS, the City recently received a new application for a car wash facility on Mountain Avenue on a site which is less than 1,000 feet from an existing car wash, and it would be the third car wash along the Mountain Avenue Corridor; and WHEREAS, while the City intends to complete its study of the issues associated with car washes in order to determine from a Citywide perspective which locations are most appropriate for the use, and the types of development standards that should be imposed on their operation to mitigate noise, traffic, and other impacts, the City now needs to act urgently in order to prevent further overconcentration of car washes and their related noise, traffic, and other harmful impacts; and

Urgency Ordinance No.

Page 2 ends

WHEREAS, absent the passage of this Urgency Ordinance, continued approval of entitlements, building permits, or other approvals for new or expanded car washes poses a current and immediate threat to the public health, safety or general welfare.

If this Urgency Ordinance does not become effective immediately, but instead becomes effective thirty (30) days after a second reading, there is a risk that further harm will be done to prevent the orderly development of car washes in the City.

Therefore, there is an urgent necessity for the City to establish amended development standards on the establishment of new car washes and the expansion of existing car washes to take effect immediately. This requirement is intended to provide the City with the ability to stop the overconcentration of car washes exacerbating noise, traffic, and other harmful impacts, and provide the City an opportunity to evaluate and modify its zoning provisions further in order to regulate the appropriate development of car washes in the City; and WHEREAS, due to the foregoing circumstances, the City Council finds and determines that the immediate preservation of the public health, safety, and welfare requires that this Urgency Ordinance be enacted pursuant to Government Code sections 36934 and 36937, and that it take effect immediately upon adoption, and its urgency is hereby declared.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UPLAND DOES ORDAIN AS FOLLOWS:

Section 1. Incorporation. The recitals above are each incorporated by reference and adopted as findings by the City Council.

Section 2. CEQA. The City Council hereby finds that it can be seen with certainty that there is no possibility that the adoption of this Urgency Ordinance, and the zoning provisions established hereby, may have a significant effect on the environment, because the Urgency Ordinance will impose greater limitations on development in the City, and will thereby serve to eliminate potentially significant adverse environmental impacts. It is therefore not subject to the California Environmental Quality Act review pursuant to Title 14, Chapter 3, Section 15061( b)(3) of the California Code of Regulations.

Section 3. Required Findings. The City Council hereby adopts the following findings in support of the adoption of this Urgency Ordinance in accordance with Section 17.48.060 of the Upland Municipal Code:

A. The proposed amendment is consistent with the General Plan and any applicable community or specific plan as provided by Government Code Section 65860.

The Urgency Ordinance will be consistent with the following General Plan Policies:

• Policy LU-1.4 Complete and Balanced Community. Foster new land uses and building types that contribute to City revenues and increase employment while also ensuring the provision of sufficient housing, shopping, civic, cultural, open space, and recreational opportunities. • Policy LU-3.1 Economic Development. Retain and attract land uses that generate revenue to the City, provide employment for residents while balancing other community needs such as housing, parks and open space, and public facilities.
• Policy ES-4.4 New Development, Zoning, and Policy. Consider fiscal and economic sustainability as one of a number of citywide goals when evaluating new development, zoning or public policy.
• FA-1.3 Economic Development. Focus economic development efforts on attracting and retaining desirable commercial uses along Foothill Boulevard.

Facts: There is an urgent necessity for the City to establish amended development standards for new car washes in the City to prevent further overconcentration of this use along the City's prime commercial arterials. Car washes do not generate sales tax revenue to the City nor do they employ more than a few employees due to the self-service nature of the use. The Urgency Ordinance will enable staff to study this land use and establish more comprehensive development standards, and determine from a Citywide perspective which locations are most appropriate for this use and avoid prime commercial sites that will contribute to the City's tax base and overall employment from being developed with car washes. • LU-6.2 Compatibility of Uses. Control the location, concentration and operation of land uses that have potential impacts on surrounding development through effective design principals, adequate buffering, and enforcement of regulatory documents.

Facts: The Urgency Ordinance is intended to prevent the overconcentration of car washes along the City's prime commercial corridors and the impacts associated with this land use relative to substantial noise, traffic, and other harmful impacts in an effort to control the locations for the orderly development of this use and compatibility with surrounding uses.

B. The proposed amendment will not be detrimental to the public interest, health, safety, or welfare of the City.

Facts: The intent of the Urgency Ordinance is to protect the immediate threat to the public health, safety or general welfare from the negative impacts on the

unrestrained overconcentration of car washes along the City's prime commercial arterials. The Urgency Ordinance will enable staff to develop more comprehensive regulations and the appropriate locations Citywide.

C. The proposed amendment is internally consistent with other applicable provisions of the Zoning Ordinance.

Facts: The Urgency Ordinance will result in establishing comprehensive land use regulations for car washes and does not propose to alter any regulations in the Zoning Code or changes in the zoning of car washes that would conflict with the intent and purpose of the commercial and industrial zoning districts in the City.

Section 4. Code Amendment. Section 17.22.060(E) of the Upland Municipal Code is hereby amended and restated to read in its entirety as provided in Exhibit "A," attached hereto and incorporated herein by reference.

Section 5. Effective Date. This Ordinance takes effect immediately upon its adoption.

Section 6. Publication. The City Clerk certifies that this Ordinance was adopted by the City Council at a regular meeting on January 12, 2026.

Section 7. Custodian of Records. The custodian of records for this Ordinance is the City Clerk and the records comprising the administrative record are located at the Development Services Department, 460 N. Euclid Avenue, Upland, CA 91786.

Section 8. Severability. If any provision of this Ordinance or its application to any person or circumstance is held to be invalid by a court of competent jurisdiction, such invalidity has no effect on the other provisions or applications of the Ordinance that can be given effect without the invalid provision or application, and to this extent, the provisions of this Ordinance are severable. The City Council declares that it would have adopted this Ordinance irrespective of the invalidity of any portion thereof.

Section 9. Publication. The City Clerk shall certify to the adoption of this Ordinance and cause it, or a summary of it, to be published in a newspaper of general circulation printed and published within the City of Upland, pursuant to all legal requirements.

PASSED, APPROVED, AND ADOPTED this 12th day of January 2026.
