INSTRUCTION FOR SUBMITTING INSURANCE CERTIFICATES AND ENDORSEMENT FORMS Certificates of Insurance
The sample accord form on the following page is provided to facilitate your preparation and submission of certificates of insurance. You may use this or any industry form that shows coverage as broad as that shown on the attached sample. Please note the certificate holder address must be as shown on the attached sample accord form with the contract number and insurance exhibit identification information completed.
Improperly addressed certificates may delay the contract start-up date because the City's practice is to return unidentifiable insurance certificates to the insured for clarification as to the contract number. Cancellation provisions must be endorsed to the policy. Modifying the certificate does not change coverage or obligate the carrier to provide notice of cancellation.
Endorsement Forms
Original endorsements are required for commercial general liability and business automobile liability insurance policies and must be attached to the applicable certificate of insurance. City preference is that the Consultant/insurer use the endorsement forms which are attached. Substitute forms will be accepted, however, as long as they include provisions comparable to the sample accord form.

SUBJECT: CONSIDER AMENDMENT NO. 1 TO THE PROFESSIONAL SERVICES AGREEMENT
WITH LDM ASSOCIATES TO SUPPORT AND IMPLEMENT FEDERAL AND STATE-
FUNDED PROGRAMS
RECOMMENDED ACTION:
It is recommended that the City Council approve Amendment No.1 to the Professional Services Agreement with LDM Associates for administering a variety of federal and state-funded programs in an amount not-to-exceed$240,000 for a one-year term ending on July 27,2027;and authorize the City Manager to execute the amendment.
GOAL STATEMENT
The proposed action supports the City's goal of providing adequate housing, a suitable living environment and expanded economic opportunities principally for low-and moderate-income persons.
BACKGROUND
The Housing Division administers a variety of federally and state-funded programs, including Community Development Block Grant (CDBG), HOME, CalHome, Permanent Local Housing Allocation (PLHA), First-Time Homebuyer,Housing Rehabilitation,Emergency Repair, and affordable housing compliance programs.
These programs are subject to extensive federal and state regulations, including environmental review requirements, labor standards compliance, fair housing requirements, income certification review and compliance, grant reporting, monitoring, auditing, and construction management. Failure to comply with these requirements may result in audit findings, repayment of grant funds, loss of funding opportunities,or other regulatory actions.
LDM Associates provides technical assistance and specialized program administration services for City staff. Their expertise has contributed to the successful rehabilitation of single family and multiple family affordable housing units, emergency repairs,first-time homebuyer assistance, small business assistance in the Downtown while supporting the City's compliance with federal and state requirements.
Assembly Bill (AB) 339 (effective January 1, 2026)requires local public agencies to provide recognized employee organizations with at least 45 days'written notice prior to issuing an RFP,RFQ,or renewing or extending a contract for services that are currently performed by represented employees.
ISSUES AND ANALYSIS
The proposed extension of the agreement with LDM establishes a one-year contract with a not-to-exceed amount of $240,000.A detailed scope of work to be performed is contained within Exhibit A of the attached agreement.
Continued use of LDM Associates is necessary to ensure uninterrupted program administration, maintain compliance with funding requirements, and protect the City's housing, community, and small business assistance funding resources. These programs require expertise in federal grant regulations, environmental compliance, loan underwriting, construction management, labor standards, grant reporting systems, and regulatory monitoring. The knowledge and technical skills necessary to perform these functions are outside the normal scope of work assigned to City staff positions.
City staff retains responsibility for policy development, program oversight and decision-making, budget administration, funding recommendations, customer service, and final approval authority. LDM functions as a technical consultant and implementation resource. LDM's knowledge of City programs and regulatory requirements provides significant value in reducing compliance risks and protecting federal and state funding resources.
The scope of work associated with this contract falls within duties performed by classifications represented by the UMMEA bargaining unit and is therefore subject to the requirements of AB 339.The City provided notice to UMMEA regarding the proposed contract and requested consideration of waiving the full statutory 45-day notice period to avoid minimal interruption in services currently being provided.
Following discussions between City and UMMEA representatives, UMMEA agreed to waive the remainder of the 45-day notice period and support continuation of the contracted services for a period of one year.
ENVIRONMENTAL DETERMINATION
In accordance with Section 15378 of the California Environmental Quality Act(CEQA)and Section 24 CFR 58.34(a) of the National Environmental Protection Act(NEPA),the hiring of professional services to assist in the planning and administration of federally assisted projects is determined not to be a project under CEQA and are the administrative activities of the City that will not result in a potentially significant physical impact on the environment.
FISCAL IMPACTS
The total cost for the one-year term is$240,000.There are available funds in the following accounts:
• Housing Programs—Account No.2012931-5252: $171,916 • CDBG Emergency Rehabilitation Program(ERP)—Account No.2092338-5252-23827: $32,270 • CDBG Commercial Rehabilitation Program(CRP)—Account No.2092337-5252-23727: $16,907 • CDBG Business Assistance and Attraction Program(BAAP)—Account No.2092336-5252-23627: $18,907
