SUBJECT: EMERGENCY REPAIR WORK FOR 26 W. 15TH STREET TRANSFER STATION UPDATE RECOMMENDED ACTION:

It is recommended that the City Council receive and file the status update related to the KSM Electric,Inc. contract for emergency repair work at the 26 W. 15th Street Transfer Station.

GOAL STATEMENT
The proposed action supports the City's goal of maintaining critical public works and utilities support facilities in good operable conditions in order to provide safe and reliable water service to the community.

BACKGROUND
On February 9,2026,the City Council adopted Resolution No. 6866 declaring an emergency condition and approved the emergency repair work at the 26 W. 15th Street Transfer Station. This included approval to execute a contract with KSM Electric,Inc. The emergency action was necessary to address facility conditions requiring immediate repair to maintain safe and reliable operations. Per the City's Purchasing Policy, emergency purchases require a recurring update during City Council agendas until such time as the work is completed.

The work generally includes electrical system repairs, replacement of damaged or failing electrical components, troubleshooting and restoration of power and control systems, and associated work necessary to restore the facility to safe and operational condition.Following Council authorization, staff completed contract execution and advanced the project into implementation, including conducting a pre-construction meeting with KSM Electric, Inc. and its subcontractors and issuing the Notice to Proceed effective April 2,2026.

ISSUES AND ANALYSIS
KSM's permit submittals remain under review, and coordination is ongoing to address comments and facilitate permit issuance. City staff continue to review the contractor's material submittals as they are received to support upcoming construction activities. The proposed change order for the required traffic control measures is currently under review and is anticipated to be presented to City Council at an upcoming meeting. Construction activities are expected to resume in the coming weeks following delivery of the soft-start panel and receipt of the necessary permit approvals.

ENVIRONMENTAL DETERMINATION
This action is not a project subject to CEQA and is exempt under Section 15378(b)(5)of the CEQA Guidelines as an organizational or administrative activity of government that will not result in direct or indirect physical changes in the environment.

FISCAL IMPACTS
There is no fiscal impact associated with this action.

SUBJECT: FISCAL YEAR 2026/2027 UTILITIES BLANKET PURCHASE ORDERS RECOMMENDED ACTION:

It is recommended that the City Council approve blanket purchase orders for Fiscal Year 2026/27 with various vendors for the Public Works Utilities Division.

GOAL STATEMENT
The proposed action adopts the City's goal to maintain asset protection and management that ensures the infrastructure is effectively renewed, replaced, and maintained.

BACKGROUND
In accordance with Chapter 2.48 of the Upland Municipal Code (UMC), purchasing and contracting of supplies, equipment, vehicles, maintenance, public works projects and professional services, over $50,000 are subject to a formal purchasing procedure and are awarded by the City Council.

In the event the City Manager determines that it is necessary to omit any phase of the selection process, the City Manager shall notify the City Council or finance of such action. A written statement of the City Manager's determination shall be retained in the project file. (UMC 2.48.080)

ISSUES AND ANALYSIS
It remains imperative that the Public Works Department have the ability to effectively purchase hardware, supplies, tools, materials, and other equipment and supplies from vendors on a regular basis.Blanket Purchase Orders("BPOs") provide efficient control of recurring purchases and facilitate the acquisition of small-dollar items($10,000 or less per item) needed for daily operations that are otherwise uneconomical to store or procure through formal bidding processes.

Section 4 of the City's Purchasing Policy provides that purchases of equipment, materials, supplies,or services from any one vendor exceeding$50,000 during the same fiscal year must be approved by the City Council. Additionally, Section 8.4 requires City Council approval of any change order that results in a purchase order exceeding $50,000.

The BPOs and related change orders identified in this report will result in total purchases from the applicable vendors exceeding the City Manager's $50,000 purchasing authority. Therefore, staff is requesting that the City Council approve the identified BPOs and change orders to ensure citywide operational efficiency and continuity.

Annual BPO requests are typically presented to the City Council in June. For Fiscal Year 2026-27,Public Works staff required additional time to review the requested dollar amounts and compare anticipated purchasing needs with prior- year expenditures to ensure the proposed amounts were appropriate. Staff has completed this review and is now presenting the applicable BPOs and change orders for City Council approval.

Section 6 of the City's Purchasing Policy identifies certain purchases that are not readily adaptable to the informal or formal bidding process and are therefore exempt from competitive purchasing requirements. These exemptions include purchases from"General Supply Stores."The following vendors meet the requirements of a General Supply Store, and staff is requesting approval of the applicable annual purchase orders and change orders for these vendors. • Holliday Rock Company,Inc(Holliday Rock):Holliday Rock supplies construction materials such as rock, sand, gravel, asphalt, and concrete and their main office and quarry are located at 1499 N.Benson Ave,which

Due to their location and on-hand inventory, Holliday Rock has a substantial advantage in delivery, convenience, and responsiveness to the City of Upland and as a result, Public Works can get material at all times of day and/or night as well as during emergencies (i.e.rainstorm).In addition, since Holliday Rock is a local vendor and has an Operating Covenant Agreement with the City, the City receives local sales tax revenues for all purchases from Holliday Rock. • Hubbell Lenoir City,Inc (Hubbell)Offers underground, utility boxes, lids and vaults that ensure safe and efficient management of utility services for both residential and commercial applications that pertain to city of Upland specifications.

The applicable Sole Source & Exemption Forms are included as attachments to this report.
• Badger Meter,Inc(Badger Meter):The City has standardized on Badger Meters for water meters to collect consumption data for water billing purposes. DATE: September 14,2026
TO: MAYOR AND CITY COUNCIL
FROM: MICHAEL BLAY,CITY MANAGER
PREPARED BY:STEPHEN PARKER,CPA,ASSISTANT CITY MANAGER

STACI SULLIVAN,DEPUTY FINANCE DIRECTOR
SUBJECT: CONSIDER APPROVAL OF A RESOLUTION ADOPTING THE MASTER FEE SCHEDULE RECOMMENDED ACTION:

It is recommended that the City Council approve a Resolution adopting the Master Fee Schedule and amending citywide fees to cover the cost of services; and authorize the City Manager to adjust citywide user fees based on the January year-to-year increases in the local Consumer Price Index.

GOAL STATEMENT
The proposed action supports the City's goal of providing fiscal stewardship for the City of Upland.

BACKGROUND
On May 23, 2022,the City Council approved Resolution No. 6658 adopting the Master Fee Schedule and directing the City Manager to return to Council within the next five years with a comprehensive Cost Allocation Plan and User Fee Study update. In the interim years,City Council authorized the City Manager to adjust Citywide user fees based on the January year-to-year increases in the local Consumer Price Index.

On August 14,2023,the City Council approved Resolution No. 6742 adopting a Master Fee Schedule.

On April 28, 2025,the City Council approved Resolution No. 6825 adopting a Master Fee Schedule and authorized the City Manager to adjust citywide user fees based on the January year-to-year increases in the local Consumer Price Index(CPI).

ISSUES AND ANALYSIS
The City's "Master Fee Schedule" combines listings of City fees into a single document. Periodic publication of a revised Master Fee Schedule is recommended to: 1)maintain appropriate recovery ratios of service costs; 2) add or delete fees for service; and/or 3)incorporate pre-existing fees and charges that have not previously been included in the published Fee Schedule.

California law permits local government agencies to recover the full cost of providing user-related services from those who receive the benefit of the service.User fee-related services are those services where the customer is identifiable, the service is measurable, and the service can be withheld for non-payment. Full cost is defined as including both direct and indirect costs(overhead)of the service.

The objective of establishing a user fee is to recover all or part of the cost of providing a requested service from those who benefit directly, so as to limit or avoid subsidizing the service through use of General Fund revenue. However, recovery of full cost is not always feasible,or advisable. In some cases, the City Council may decide to reduce costs rather than increase fees and/or continue some level of General Fund subsidy. Further, cities may not set user fees at higher than the cost of providing the service.

Recommended Updates
In April 2025,the City Council approved an annual Master Fee Schedule adjustment based on the CPI change in index on a January-to-January basis. The CPI change for the period January 2025-to-January 2026 in the San Bernardino- Riverside-Ontario region is 3.2%.

Page 122 of 166 ends

The following updates are also recommended:

Administrative Services
The fee for the release of public records on a flash drive is no longer necessary as the new public records request software allows City staff to upload large electronic files for release at no charge to the public.

Recreation
The proposed revisions to the Master Fee Schedule support the updated Facility Reservation Policy while maintaining its original intent of providing a fair, consistent, and equitable process for the reservation and use of City facilities. As community demand for facility reservations continues to grow, these updates are intended to improve clarity, enhance administrative efficiency, and better align the fee schedule with current operational practices.

The proposed changes include adding user group numbers to align with the policy definitions, establishing a user group classification for nonprofit organizations, and adding an Extended Reservation Flat Fee of $100 and a Reservation Extension Fee of$65 for each additional 15-minute increment to discourage use beyond the reserved rental period. The revisions also establish a$100 cleaning fee to recover costs associated with excessive cleanup and reorganize portions of the Recreation Master Fee Schedule to improve organization and usability. • Extended Reservation Flat Fee of$100 -Rate is designed to deter reservation groups from going over their allocated reservation time. When this occurs, staffing the extended time can become difficult as it is last minute in notification and we have a limited amount of time to find a replacement. • Reservation Extension Fee of$65 for each additional 15-minute increment-Rate is the fully burdened rate for a full-time coordinator on call per 15-minute increment. Fully burdened rate is$260.94 per hour/4 (15- minute increments)=$65.24;rounded down to$65.
• Cleaning Fee of$100 to recover costs associated with excessive cleanup -Fully burdened rate for custodial staff is $91.21 per hour; rounded up to $100 as work varies between an hour to an hour and 15 minutes depending on the extent of the required cleanup.

Public Works-Operations
The electric vehicle(EV)charging station rates have not been updated since May 11,2020.Based on increased electric costs and a survey of surrounding cities, the per kilowatt(kWH)rate is increasing by$0.05 for both the Level 2 and super charging stations.

Currently,Public Works will replace a tree or trim trees at a property owner's request. The work is completed by the City's contractor, and the costs are fully covered by the property owner. This fee has now been added to the Master Fee Schedule for transparency purposes.

Public Works-Sewer
The Inland Empire Utilities Agency (IEUA) pass-through fees for regional sewer capacity-new construction/improvement have been updated from the fee amount to "actual pass-through fee". This adjustment allows the City to pass-through the actual costs as charged by IEUA which vary depending on the number of fixtures.

The Public Works—Utilities Division is currently conducting a comprehensive fee study which will be presented to the City Council at a later date.

In accordance with Government Code Section 66016(a), notice of the meeting to discuss potential increases in fees was sent at least 14 days in advance to all interested parties who had filed a written request for notice of the meeting on new or increased fees for service charges. Additionally, the notice of public hearing was posted on the City's website and published 14 days and 7 days prior to the public hearing.

If approved, the proposed fees would go into effect as of October 1,2026.

ENVIRONMENTAL DETERMINATION
The proposed action is not subject to the California Environmental Quality Act(CEQA). Section 15378 of the CEQA Guidelines defines a project subject to CEQA. The proposed action is not included within the definition of a"project" and thus is exempt.

Page 123 of 166 ends

FISCAL IMPACTS
The changes to the fees are intended to more accurately recover the cost of providing the service, and therefore, any revenue will have a budget-balancing effect.

ALTERNATIVES
Provide alternative direction to staff.

CEQA:Not a Project.

SUBJECT: CONSIDERATION OF AN ORDINANCE ADDING CHAPTER 9.50 TO THE MUNICIPAL

CODE REGULATING THE SALE OF FLAVORED TOBACCO, NITROUS OXIDE, AND

KRATOM PRODUCTS
RECOMMENDED ACTION:

It is recommended that the City Council hold first reading by title only, waive further reading and introduce an ordinance adding Chapter 9.50 (Flavored Tobacco; Nitrous Oxide; Kratom Products) to Title 9 (Public Peace And Welfare)of the Upland Municipal Code, regulating the sale of flavored tobacco, nitrous oxide, and kratom products within the City.

GOAL STATEMENT
The proposed action supports the City's goal of protecting public health, improving community safety, reducing youth access to harmful substances, and promoting responsible retail business practices.

BACKGROUND
The City of Upland has long recognized the importance of protecting the health and safety of its residents through reasonable local regulations. Although state and federal laws regulate the sale of tobacco and other controlled substances, recent trends have demonstrated that flavored tobacco products, recreational nitrous oxide products, and highly concentrated kratom products remain widely available through retail establishments and continue to present significant public health concerns.

ISSUES AND ANALYSIS
While California has enacted legislation regulating tobacco products and restricting youth access, local governments maintain authority to adopt more restrictive regulations that further protect their communities. The proposed ordinance establishes local regulations that provide additional safeguards against products that have demonstrated negative impacts on public health.

Flavored Tobacco
Flavored tobacco products continue to be disproportionately used by minors and young adults due to flavors that mask the harshness of tobacco and nicotine.National and state public health agencies have consistently identified flavored products as one of the primary drivers of youth tobacco initiation. Although California prohibits the sale of flavored tobacco products under certain circumstances, local enforcement mechanisms remain an important component of ensuring retailer compliance and protecting the community.

The proposed ordinance prohibits the sale, display for sale, and possession with intent to sell flavored tobacco products and tobacco flavor enhancers within the City. These provisions provide clear standards for retailers while reducing the availability of products that are designed to appeal to younger consumers.

Nitrous Oxide
Nitrous oxide serves many legitimate commercial purposes, including medical treatment, dentistry, food preparation, automotive performance, and industrial manufacturing. However, recent years have seen a dramatic increase in recreational misuse through products marketed specifically for inhalation.

Retail sales of flavored nitrous oxide canisters, colorful packaging, and products marketed under names such as "Galaxy Gas"have contributed to increased misuse among young adults and minors.Recreational inhalation of nitrous

Page 153 of 166 ends

oxide can result in oxygen deprivation, neurological damage, spinal cord injury, vitamin B 12 deficiency, paralysis, permanent disability, and death.

Although California law prohibits certain conduct involving nitrous oxide, enforcement remains difficult when retailers continue selling products intended for recreational misuse. The proposed ordinance prohibits retail sales of nitrous oxide while preserving exemptions for legitimate medical, dental, pharmaceutical, automotive, wholesale, culinary, and other lawful uses.

Kratom Products
Kratom products have become increasingly common in smoke shops, convenience stores, and other retail establishments despite limited regulatory oversight. Scientific literature and public health agencies have expressed growing concern regarding products containing elevated concentrations of 7-hydroxymitragynine (7-OH), a compound significantly more potent than naturally occurring mitragynine(primary psychoactive alkaloid found in the leaves of Mitragyna speciosa).

Higher concentrations of 7-OH have been associated with increased risks of addiction, overdose, respiratory depression, and other adverse health effects.Additionally, certain kratom products are packaged and marketed in ways that appeal to minors. The proposed ordinance establishes reasonable regulations by prohibiting the sale of kratom products to persons under 21 years of age, prohibiting products containing excessive concentrations of 7-OH, prohibiting products designed to appeal to children, and prohibiting products adulterated with synthetic or semi- synthetic kratom alkaloids.

Oil Burners
An "oil burner" is a glass smoking device that allows users to inhale vaporized oils or other concentrates. These devices are typically made from glass and consist of a long, thin tube ending in a hollow, spherical bulb. The bulb has a small hole on the top used for placing material inside and allowing airflow to enter, and when heated from below, the user inhales the said vapors. This device is commonly referred to as a methamphetamine pipe.

Oil burners are frequently sold at tobacco establishments and single handedly contribute to the continued use of methamphetamine in our community by providing the very device to smoke it.It shall be a violation of this proposed ordinance for any tobacco retailer or any of the tobacco retailer's agents or employees to sell, offer for sale, give away in conjunction with a sale,to display for sale,or to possess with intent to sell or offer for sale, any oil burners.

Enforcement
The ordinance establishes misdemeanor and civil enforcement provisions consistent with other provisions of the Upland Municipal Code.Violations may be addressed through criminal prosecution, administrative enforcement, civil penalties, nuisance abatement, injunctions, and business license actions where appropriate.

The ordinance is intended to encourage voluntary compliance through retailer education while providing effective enforcement mechanisms when necessary.

Adoption of the proposed ordinance represents a proactive public health measure designed to reduce youth access to harmful products, improve community safety, and provide clear regulatory standards for retailers operating within the City of Upland.Additionally,it provides law enforcement with additional enforcement tools to reduce the availability of products that are commonly associated with youth initiation, substance abuse, and criminal activity.

ENVIRONMENTAL DETERMINATION
The proposed action is not subject to the California Environmental Quality Act(CEQA). Section 15378 of the CEQA Guidelines defines a project subject to CEQA.The proposed action is not included within the definition of a"project" and thus is exempt.

FISCAL IMPACTS
The proposed ordinance is not anticipated to have a significant impact on the City's General Fund. Implementation and enforcement responsibilities will be performed by existing City staff as part of normal code enforcement and law enforcement operations.

Although limited enforcement costs may be incurred, these costs are expected to be absorbed within existing departmental budgets. Any revenue generated through citations or administrative enforcement actions is expected to be minimal and is not the purpose of the ordinance.

BURNERS, NITROUS OXIDE, AND KRATOM PRODUCTS

WITHIN THE CITY
WHEREAS, the City of Upland, California ("City") is a municipal corporation, duly organized under the California Constitution and laws of the State of California; and WHEREAS, pursuant to Article XI, section 7 of the California Constitution, the City may adopt ordinances not in conflict with general laws designed to promote public convenience and general prosperity, which include public health, welfare, and safety; and
WHEREAS, under federal and state law, the City may regulate tobacco sales, and tobacco retailers' failure to comply with all tobacco control laws threatens the City's mission to preserve the public health, safety, and welfare of its residents; and WHEREAS, according to the World Health Organization, there are over eight million tobacco-related deaths per year, making tobacco use one of the biggest worldwide public health threats;2 and
WHEREAS, the California Legislature has recognized the danger of tobacco use and has made reducing youth access to tobacco products a high priority, declaring that "[Woking is the single most important source of preventable disease and premature death in California";3 and
WHEREAS, Health and Safety Code section 104559.5, as amended by Senate Bill 793 ("SB 793") in 2020, prohibits the sale of flavored tobacco products, and permits local agencies to adopt and implement local ordinances that impose greater restrictions on the access to tobacco products; and
WHEREAS, nitrous oxide is an odorless, colorless chemical that can be inhaled for legitimate medical, dental, industrial, and culinary purposes, but it is also subject to recreational misuse and abuse, in part because it is easy to purchase from retail vendors and is relatively inexpensive; and

WHEREAS, the recreational misuse and abuse of nitrous oxide can cause permanent vitamin deficiencies in the blood, and can cause long-term neurological effects, including paralysis and death; and
WHEREAS, although California Penal Code sections 381b and 381c(b) make it a misdemeanor to possess nitrous oxide for intoxication and to furnish nitrous oxide to persons under 18 years of age, sellers who know or should know that their customers intend to misuse nitrous oxide continue to sell the substance using a "don't ask, don't tell" approach, often in quantities too small for legitimate medical, industrial, or culinary use, and in colorful, flavored canisters with names such as "Galaxy Gas"; and WHEREAS, kratom (Mitragyna speciosa) is a tropical tree native to Southeast Asia, and its leaves are often consumed in powdered or extract form for their stimulant and sedative effects; and
WHEREAS, the active compounds in kratom include mitragynine and 7- hydroxymitragynine ("7-OH"), and although present in smaller amounts, 7-OH is more potent and is largely responsible for kratom's stronger pain-relieving, sedative, and euphoric effects; and
WHEREAS, research has shown that 7-OH binds more strongly to opioid receptors in the brain, and may be more potent than morphine in relieving pain,4 prompting scientific research and health advisories to raise concerns that kratom products, especially those with higher concentrations of 7-OH, increase the risk of addiction, overdose, and adverse physical and psychological effects, including nausea, vomiting, and potential psychosis5 ; and
WHEREAS, a number of local governments across California and the United States have taken efforts to regulate or ban kratom products, particularly those with higher concentrations of 7-OH, in order to protect public health and safety; and WHEREAS, the City desires to regulate the sale of flavored tobacco, nitrous oxide, and kratom products in order to preserve and protect public health and to prevent the unlawful sale of these products.

D. Any person violating the provisions of this Chapter shall also be liable for civil penalties of not less than two hundred fifty dollars ($250) and not exceeding one thousand dollars ($1,000) for each day the violation continues.

E. A violation of this Chapter shall additionally be grounds for a revocation of a business license, if applicable, pursuant to Section 5.04.280 of this Code.

F. Causing, permitting, aiding, abetting, or concealing a violation of any provision of this Chapter shall also constitute a violation of this Chapter.

G. Violations of this Chapter are hereby declared to be public nuisances. § 9.50.080 Revocation of tobacco retailer license.

A. Revocation of License for Violation. In addition to any other penalty authorized by law, a tobacco retailer license shall be revoked if the licensee, or any of the licensee's officers, agents or employees, has violated any of the provisions, requirements, conditions, or prohibitions of this Chapter or any conditions of the license itself, according to the procedures set forth in Section 5.04.280 of this Code.

B. Appeal of Revocation. Notwithstanding anything in this Code to the contrary, a decision of the Department to revoke a tobacco retailer license is appealable to the city manager or designee and must be filed with the city clerk within ten (10) days of the date of mailing of the Department's notification of revocation. Failure to properly and timely file such an appeal shall constitute a waiver of the right to appeal and a failure to exhaust administrative remedies. If such an appeal is made, it shall not stay enforcement of the appealed action except upon written request to, and decision in writing by, the city manager or designee that a stay would not be adverse to public safety, health or welfare. Any determination(s) by the city manager or designee shall be the final decision of the City.

Notwithstanding anything in this Code to the contrary, the decision of the city manager or designee is not appealable to the City Council.

C. Revocation of License Wrongly Issued. A tobacco retailer's license shall be revoked if the Department finds that one or more of the bases for denial of a license under Section 5.04.280 existed at the time application was made or at any time before the license was issued. Such a revocation shall be without prejudice to the filing of a new license application. The initial revocation shall follow the procedures set forth in Section 5.04.280. The decision may be appealed according to the procedures and consequences of subsection B of this section.

Section. 3 CEQA. The Mayor and City Council finds this Ordinance is not subject to the California Environmental Quality Act ("CEQA") in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.

Section 4. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance, or any part thereof, is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared unconstitutional. If for any reason any portion of this Ordinance is found to be invalid by a court of competent jurisdiction, the balance of this Ordinance shall not be affected.
