The City of Watsonville’s Assistant Public Works & Utilities Director, Murray Fontes as City Engineer of Work for Gonzales Street Alleyway Landscaping and Lighting Assessment District No. PK-94-1, City of Watsonville, Santa Cruz County, California, makes this report as directed by the City Council pursuant to Section 22500 of the Streets and Highways Code (Landscaping and Lighting Act of l972).

PART D: A statement of the method by which the undersigned has determined the amount proposed be assessed against each parcel.

PART E: An assessment of the estimated cost of the improvement on each benefited parcel of land within the assessment district for the 2025/2026 fiscal year. The assessment numbers are the assessor’s parcel numbers as shown on the last equalized assessment roll for taxes, or as known to the Clerk.

PART F: A schedule setting forth the estimated total cost of improvements to be paid in installments including the number of installments, fiscal years which installments are to be collected, and the maximum amount of the annual installment in any year, if any.

The proposed assessments will be used exclusively to finance the maintenance and operation costs for the alleyway. Assessments are not proposed to be increased over the amount levied in the previous year.

5 PART C

ESTIMATE OF COST

1. Annual Maintenance Costs
a. Plant care, mowing and cleaning
3 hours per month @ $12.00 per hour x 12 months $ 432.00 b. Alleyway maintenance $ 168.00
Total Estimated Annual Maintenance Costs $ 600.00

2. Incidental Expense (by City) 0.00
Estimated Total Annual Cost 2025/2026 FY $ 600.00
PART D

METHOD OF ASSESSMENT
There are 18 parcels within the block surrounded by High Street, Gonzales Street, Brennan Street, Freedom Boulevard and Sudden Street. Seventeen of these parcels will benefit from the maintenance and upkeep of the alleyway within this block. The 18th parcel, the alleyway, was dedicated to public use and does not benefit.

The benefits to be derived include but are not limited to additional parking, access to garages, open space uses security, and the improvement of the appearance of the adjacent land along back yard property lines.

In the opinion of the Engineer, each of the 17 parcels within the block will share these benefits equally with the exception of Parcel Number 016-143-10 that does not “tack” along the alleyway. Therefore, 16 parcels were assessed an equal unit of assessment and Parcel 016-143-10 was assessed 0.75 unit due to the lack of backyard “frontage”.

The amount of a unit of assessment for annual maintenance was calculated by dividing the total estimated annual maintenance cost by the total number of units (16.75).

1 CITY COUNCIL AGENDA REPORT
MEETING DATE: Monday, April 21, 2025
TO: CITY COUNCIL
RECOMMENDED BY: ADMINISTRATIVE SERVICES DIRECTOR DURAN
APPROVED BY: TAMARA VIDES, CITY MANAGER
SUBJECT: RESOLUTIONS AUTHORIZING FIRST AMENDMENT TO THE JOINT

POWERS AGREEMENT FOR THE WATSONVILLE PUBLIC FINANCING

AUTHORITY
RECOMMENDATION:

Adopt Resolutions of the City Council, sitting as the legislative body of the Industrial Development Authority of the City of Watsonville and the City of Watsonville, authorizing the first amendment to the joint exercise of powers agreement for the Watsonville Public Finance Authority.

BACKGROUND
The City of Watsonville entered into a joint powers authority, (“Watsonville Public Financing Authority or “PFA””) on October 24, 2017 (Resolution No. 1-17 (ID), for future long-term financings between the City and the Industrial Development of the City of Watsonville (the “IDA”); the members of the City Council are the members of the PFA’s board of directors governed by the City Council.

The statutory purpose of the IDA is to increase opportunities for useful employment or otherwise contribute to economic development. Articles 1 and 2, Chapter 5, Division 7, Title 1 of the California Government Code (Section 6500 et seq.) permits two or more agencies, by agreement, to exercise jointly powers common to the contracting parties. Such agreement was entered into to facilitate the financing and/or refinancing of certain public programs, projects and public improvements.

The subject matter at hand is to amend the JPA Agreement pursuant to a First Amendment to the Joint Exercise of Powers Agreement (the “First Amendment”) to proceed with issuing a 2025 Lease Revenue Bond.

Page 195 of 204 ends

2 DISCUSSION:

Prior to the issuance of the lease revenue bonds, the City and the PFA would enter into a site lease pursuant to which the City would lease certain real property and improvements owned by the City to the PFA for a nominal payment. Concurrently, the City and the PFA would enter into a property lease, under which PFA would lease the Leased property back to the City in exchange for rental payments by the City (and payable from the City’s general fund) to the PFA. The rental payments by the City under property lease would be pledged by the PFA as security for the payment of debt service on the PFA’s lease revenue bonds. Lease revenue bonds have some advantages in that they don’t require voter approval and are a fairly quick financing project.

Staff is currently working on the issuance of a lease revenue bond to partially fund the Ramsay Renaissance Project and other Capital Improvement Projects. Approving this amendment will help facilitate the issuance of a lease revenue bond, which is a critical step in securing funding for the planned capital improvements. The action ensures the necessary legal and financial framework is in place to move forward with the investment in vital infrastructure projects.

STRATEGIC PLAN:

This resolution supports the strategic plan by laying the ground framework for a future financing possibility to fund capital needs without reliance on General Fund Reserves.

Infrastructure & Environment
Fiscal Health
FINANCIAL IMPACT:

Adopting the resolution and executing the amendment to the joint powers agreement has no fiscal impact.

ALTERNATIVE ACTION:

Reject the resolution and remove the Lease Revenue Bond financing as an option to fund the City’s Capital needs.

2 (b) Section 1.03(d) of the JPA Agreement is hereby amended to read in its entirety as follows:

The time and place for holding Board meetings shall be established and may be changed at any time by resolution of the Board. Initially, the Board shall conduct regular meetings on the same date, at the same time, and at the same location as the regular meetings of the City Council; provided that the first regular meeting of the Board shall occur on October 17, 2017. Such regular meetings may occur either during or after the regular meetings of the City Council but may not commence earlier than the starting time for the regular meetings of the City Council. If the Secretary does not post an agenda for a regular meeting pursuant to Section 54954.2 of the California Government Code, then such failure to post shall be deemed to be a determination by the Chair that no items require discussion and, therefore, that the regular meeting has been cancelled, except as otherwise provided in Section 54954.2 of the California Government Code. The City and the Industrial Development Authority each hereby declares that it would have entered into this Amendment and each and every other section, paragraph, sentence, clause or phrase hereof irrespective of the fact that any one or more sections, paragraphs, sentences, clauses or phrases of this Amendment may be held illegal, invalid or unenforceable.

Section 5. Execution in Counterparts. This Amendment may be executed in several counterparts, each of which shall be deemed an original and all of which shall constitute but one and the same instrument.
