BACKGROUND:
During the December 6, 2022 City Council meeting, Mayor Castellanos requested that staff provide a report on the feasibility of an increase to the City Council's and Commissioners’ pay and benefits.
At the September 19, 2023 City Council meeting, members of the City Council expressed the desire to increase the City Council salary in order to encourage more members of the community to serve on the City Council, noting that it is not financially feasible for many members of the community to serve at the current salary.
At the same meeting, the City Council directed the following:
1. Increase Council compensation to the maximum allowed per statute and provide Council benefits and car allowance.
2. Increase Council reimbursement allowance to $5,000.
Increase Commissioner compensation as follows:
Increase Planning Commissioner compensation to $100/meeting.
Increase Human Resources Commissioner compensation to $75/meeting.
Increase Community and Senior Services Commissioner compensation to $75/meeting.
Provide financial analysis of establishing Audit Committee compensation of $75/meeting, excluding elected officials.
3. Council reimbursement allowances were modified by the City Council on November 7, 2023.
DISCUSSION:
City Council Compensation
California Government Code section 36516(a)(2) establishes the maximum amount of City Council salaries based on city population. The amounts set forth in Section 36516(a)(2) have not been adjusted since 1984.
In June 2023, the Governor signed SB 329, which amends California Government Code section 36516, effective January 1, 2024, to increase the maximum salaries set forth in Section 36516 to adjust for inflation since 1984. The author of the bill stated that city council members have one of the hardest jobs in California government, dealing with a wide range of issues, often with very little financial compensation. The author also stated that low levels of pay make it much harder for council members to balance their careers and personal obligations with the calling to serve their community. The author further stated that raising the pay will make it easier for members of marginalized communities to serve, and that increasing compensation is an important step in achieving city councils that are reflective of their communities.
California Government Code section 36516(a)(4) allows for increases in council member salaries in an amount not to exceed 5% for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance to increase the salary is enacted.
Since it has been 33 years since the last adjustment, the maximum increase allowed, per Section 36516(a)(4), is $1,262, which increases Council's monthly compensation to $2,027/month or $24,327/year. The estimated fiscal impact to the General Fund would be approximately $80,000 annually.
It is important to note that the increase to the City Council salaries would not take effect until after the results are certified for the next City Council election, which is November 2024.

City Commissioners
The proposed resolution increases the monthly stipend for serving on City commissions to the following:
Planning Commissioners: Increase stipend from $75.00 to $100.00 per meeting attended.
Community and Senior Services Commissioners and Human Resources Commissioners: Increase stipend from $50.00 to $75.00 for each meeting attended.
Audit Committee
Council also directed that staff bring back an analysis regarding the cost of providing stipends to Audit Committee Members. Pursuant to the Audit Committee Rules and Regulations, as reflected in Resolution No. 2021-33, Members of the Audit Committee "shall serve without compensation". If the Council wishes to provide a stipend to Members of the Audit Committee, Resolution No. 2021-33 would need to be revised to reflect the payment of such stipend. Staff would also prepare a separate resolution establishing the stipend for Members of the Audit Committee. If Council wishes to establish a stipend of $75.00 per meeting, similar to City Commissioners, the estimated fiscal impact is approximately $1,500 per year.

On November 7, 2023, City Council approved a budget amendment for Council Allowances, bringing the net change in fund balance to $156,081 for FY2023-24.
Based on the revenue and expenditure assumptions in the City’s Long-Range Financial Forecast: FYE 2024-2028, the General Fund is anticipated to have positive revenue over expenditures for the forecasted period. This positive excess is modest in FYE 2025 (slightly over $1 million) but is anticipated to increase in the outer years to over $5 million in FYE 2028. Additionally, reserves are anticipated to increase over the upcoming years from 26% in FYE 2022 to 36% in FYE 2028.

CITY COUNCIL COMPENSATION
WHEREAS, California Government Code section 36516(a)(1) provides that the City Council may enact an ordinance setting the salary for each member of the City Council, the amount of which is based on the population of the City; and WHEREAS, California Government Code section 36516(a)(4) provides that the City Council’s salaries may be increased by up to five percent (5%) per calendar year from the operative date of the last adjustment; and
WHEREAS, on November 13, 1989, the City Council adopted Ordinance No. 1830, establishing a monthly salary of $765.00 for each City Council Member, effective July 1, 1990; and
WHEREAS, the time, commitment, and expense of serving on the City Council have increased, but the salaries for City Council Members have not been adjusted since 1990; and
WHEREAS, increasing the monthly salary as authorized by California Government Code section 36516 may help attract members of the public from different income levels to run for City Council by providing sufficient income for their service to help ensure they can serve the public while supporting their families; and WHEREAS, the City Council desires to adjust City Council salaries as authorized by California Government Code section 36516; and
WHEREAS, in accordance with California Government Code section 36516.5, the adjusted salaries will not take effect until one or more Council Members begins a new term of office following the November 2024 election; and WHEREAS, all legal prerequisites prior to the adoption of this Ordinance have occurred.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. Amendment to Section 2-23 of the West Covina Municipal Code.
Section 2-23 (Salary) of Division 1 (Generally) of Article II (City Council) of Chapter 2 (Administration) of the West Covina Municipal Code is hereby amended to read as follows:
Sec. 2-23. - Salary.
Each member of the city council shall receive a salary in the sum of two thousand twenty seven dollars ($2,027.00) per month in accordance with California Government Code section 36516. The salary is payable at the same time and in the same manner as the salaries are paid to other officers and employees of the city.
SECTION 2. Effective Date of Salary Adjustment. Pursuant to California Government Code section 35616.5, the increased salary set forth in Section 1 of this Ordinance shall go into effect and become payable for all City Council Members when one or more members of the City Council becomes eligible for a salary increase by virtue of the Council Member beginning a new term of office following the November 5, 2024 general municipal election.
SECTION 3. Environmental Compliance. The City Council hereby finds that it can be seen with certainty that there is no possibility the adoption and implementation of this Ordinance will have a significant effect on the environment. The Ordinance is therefore exempt from the environmental review requirements of the California Environmental Quality Act pursuant to Section 15061(b)(3) (Common Sense Exemption) of Title 14 of the California Code of Regulations.
SECTION 4. Severability. If any section, subsection, sentence, clause, phrase, or portionof this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of West Covina hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
SECTION 5. Effective Date. This Ordinance shall take effect thirty (30) days after its final passage.
SECTION 6. Certification. The City Clerk shall certify to the passage and adoption ofthis Ordinance and shall cause the same to be published or posted in the manner required by law.

The City Council of the City of West Covina hereby finds and declares as follows:
WHEREAS, on September 4, 2007, the City Council adopted Resolution No. 2007-66, establishing that the City Council shall be afforded all benefits provided to City Department Heads that are deemed appropriate by the California Government Code; and
WHEREAS, on July 3, 2018, the West Covina City Council adopted Resolution No. 2018-94, which identified the schedule of benefits for current City Council Members and reduced the benefits provided to the City Council; and WHEREAS, the City Council desires to update the schedule of benefits for consistency with the benefits provided prior to the adoption of Resolution No. 2018-94, which benefits are no greater than those provided to City Department Heads.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Resolution No. 2018-94 is hereby repealed.

Schedule of Benefits for Council Members
Effective following certification of results of the November 5, 2024 Election
1. Auto Allowance: The City shall provide each City Council Member an automobile allowance of three hundred dollars ($300.00) per month in lieu of reimbursing actual vehicle expenses after such expenses are incurred.
2. Deferred Compensation: The City shall contribute for each Department Head three hundred dollars ($300.00) per month to a deferred compensation plan.
Council Members may utilize the funds as follows:
a. Council Members may apply the City’s contribution to a deferred compensation plan from a list of plans provided by the City. b. Council Members may apply the City’s contribution as they determine to medical, dental, or life insurance premiums.
c. Council Members may take cash in lieu of depositing funds in a deferred compensation plan.
3. Medical, Dental, & Vision Insurance Option:
The City’s contributions for Medical, Dental, and Vision Insurance shall be provided as set forth below for all Council Members.
Medical Insurance:
a. Employee Only (Single): A Council Member who selects an Employee Only medical plan will receive a City contribution in an amount that when added to the PEMCHA statutory minimum amount equals the monthly Los Angeles Region Kaiser Employee Only medical premium or $600, whichever is greater.
b. Employee Plus One (Two-Party): A Council Member who selects an Employee Plus One medical plan will receive a City contribution in an amount that when added to the PEMCHA statutory minimum amount equals the monthly Los Angeles Region Kaiser Employee Plus One medical premium.
c. Employee Plus Two or More (Family): A Council Member who selects an Employee Plus Two or More medical plan will receive a City contribution in an amount that when added to the PEMCHA statutory minimum amount equals the monthly Los Angeles Region Kaiser Family medical premium.
Dental Insurance:
In addition to the provision for medical insurance, the cafeteria amount shall also include up to $62.23 monthly for dental insurance for the Council Member and eligible dependents. If the dental insurance plan selected by the Council Member is less than $62.23, the cafeteria amount shall be the cost of the dental insurance plan selected. If the dental insurance plan selected by the Council Member is equal to or more than $62.23 per month, the cafeteria amount shall be $62.23.
Vision Insurance:
In addition to the provisions for medical and dental insurance, the cafeteria amount shall also include the employee only monthly cost for vision insurance.
Council Members may enroll eligible dependents in the plan at the Council Member’s cost.
4. Retiree Dental: City Council Members that retire directly from City employment shall be allowed to participate in the City’s employee dental insurance program based on employee monthly premium rates. The City shall not contribute to the monthly premium.
5. Term Life Policy: The City shall provide all City Council Members a term life insurance policy in the amount of $100,000 while serving on the City Council, with an additional Accidental Death & Dismemberment (AD&D) policy of $100,000 if injured in the line of duty.
6. Section 125 Plan: The City has established a program consistent with Section 125 of the IRS Code, which enables Council Members to voluntarily use pre-tax earnings for medical, dental, and dependent care expenses. It is understood that participation in the plan is voluntary and the City will not be obligated to contribute to pay any City Council Member costs for those who participate in the plan.
7. Retirement: City Council Members elected after January 1, 2013 shall participate in the 2.0% at age 62 PERS retirement benefit plan, with their final compensation based upon the average of their highest annual compensation earned over a three (3) year period. New Council Members will be required to pay the appropriate share of their pension costs and other provisions, as required by the Public Employees’ Pension Reform Act of 2013. Such contributions shall be made on a pre-tax basis. Council Members are vested after five (5) years of full-time service credit.

REPRESENT CITIES WITHOUT PRESCRIPTIVE WATER PUMPING RIGHTS ON THE BOARD
OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY
BACKGROUND:
The State Legislature established the San Gabriel Basin Water Quality Authority (WQA) to develop, finance, and implement groundwater treatment programs in the San Gabriel Basin. The WQA is empowered by the State to address the problem of the migration of contaminated groundwater within the San Gabriel Basin and, in particular, the migration of contaminated water through the Whittier Narrows into the Central Basin.
The WQA also operates the only groundwater cleanup projects in the San Gabriel Valley that are actively intercepting contaminated groundwater flowing toward the Whittier narrows. The WQA is under the direction and leadership of a seven (7) member board. The board is comprised of one member from each of the three overlying municipal water districts, one from a city with prescriptive water pumping rights, and one from a city without prescriptive water pumping rights, and two members representing water producers in the San Gabriel Basin. West Covina is designated as a city without prescriptive water pumping rights.
The WQA is asking each city to cast their vote for one of the nominees designated in Attachment No. 1 to serve as a board member for a four-year term that will represent cities without prescriptive water pumping rights. The election for this position is to be held on December 20, 2023. The position is currently filled by rights. The election for this position is to be held on December 20, 2023. DISCUSSION:
The nomination period for the election of the WQA board member and alternate representing cities without prescriptive water pumping rights was closed on October 19, 2023. As a result of the nomination period, a list of qualified nominees was compiled and provided to cities without prescriptive water pumping rights. Margaret Clark, Mayor Pro Tem of the City of Rosemead, and Valerie Munoz, Mayor Pro Tem of the City of La Puente, have both been nominated for this position (Attachment No. 1).
Each city has one vote for each of 10,000 residents or majority thereof, as determined by the 2020 U.S.
Census data. The City of West Covina has a total of 11 votes to cast and must cast all votes for only one candidate by resolution of City Council. Votes cannot be split. The resolution of City Council casting its votes must be submitted no later than December 19, 2023, at 12:00 p.m., or votes may not be counted. THE BOARD OF THE SAN GABRIEL BASIN WATER
QUALITY AUTHORITY
The City Council of the City of West Covina hereby finds and declares as follows:
WHEREAS, on September 22, 1992, Senate Bill 1679 was signed into law by Governor Brown authorizing the creation of the San Gabriel Basin Water Quality Authority; and
WHEREAS, the Board of the San Gabriel Basin Water Quality Authority is composed of seven members, with three appointed members from each of the three municipal water districts, one elected city council person from cities in the San Gabriel Basin with prescriptive water pumping rights, one elected city council person from cities in the San Gabriel Basin without prescriptive water pumping rights, and two appointed members representing water producers; and
WHEREAS, the City of West Covina is one of the cities in the San Gabriel Basin without prescriptive water pumping rights; and
WHEREAS, the City of West Covina is entitled to eleven (11) votes; and WHEREAS, the City of West Covina may cast its votes for a representative by resolution and delivered to the San Gabriel Basin Water Quality Authority no later than December 19, 2023 at 12:00 PM.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of West Covina casts its full votes for Councilmember ____________ as the representative for cities in the San Gabriel Basin without prescriptive pumping rights.
SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall enter the same in the book of original resolutions and it shall become effective immediately.

The City of West Covina provides street sweeping services for cleaning approximately 463 curb miles of its streets through a contract with a third-party vendor, Nationwide Environmental Services ("Nationwide"). Street sweeping is a public service that cleans our community, focuses on trash and debris, and assists with the compliance of water and air quality regulations.
At the November 7, 2023 City Council meeting, City staff provided a presentation to the City Council regarding its evaluation of the City’s street sweeping program and the City’s options. Following staff’s presentation and discussion by Council, Council continued the item to a future date to enable Nationwide to be present to answer questions from the Council.
DISCUSSION:
The staff report and attachments from the November 7, 2023 City Council meeting are included as Attachment No. 1 to this report. As outlined in the November 7, 2023 staff report, staff has determined that in order to enhance and improve the City’s street sweeping program, the City has two options:
1. Implementation of a complete street sweeping parking restriction and enforcement; and/or
2. Increasing frequency of street sweeping operation from bi-weekly to weekly.
Staff is requesting that the City Council provide direction.

Street sweeping is a public service that cleans our community, focuses on trash and debris, and assists with the compliance of water and air quality regulations.
The City’s current street sweeping routes were last adjusted in 2015 and are shown in Attachment No.
1. Street sweeping hours in the residential neighborhoods are generally between 7AM and 3PM. The majority of the City’s arterial streets (with the exception of portions in the “West Covina Downtown “listed below) are swept during the early morning hours, typically between 5AM and 7AM.
Moreover, the designated streets in “West Covina Downtown" are swept twice a week on Mondays and Fridays between 3:30 AM and 7:00 AM.
Except for the streets in West Covina’s Downtown area, all other streets are currently on a bi-weekly (twice a month) service as shown in Attachment 1. The City originally contracted for weekly (four times a month) service and has adjusted the frequency of street sweeping over the term of the contract. The last adjustment was in 2015 to change the weekly schedule to bi-weekly service.
Effective street sweeping involves posting of street sweeping parking prohibition signage and parking enforcement. Currently, not all City streets are posted for street sweeping parking restrictions. In fact, only about 7% of City’s streets are posted. Furthermore, the City has not allocated resources for the purpose of parking enforcement during the designated street sweeping hours. Parking enforcement is a critical component to ensure the street sweepers can complete their job.
The City of West Covina consistently strives to provide the most efficient and effective services to its residents. This requires comprehensive analysis of service delivery models to ensure that an optimal level of service is achieved. As such, the City has conducted a full analysis of its street sweeping program.
ATTACHMENT NO. 1
DISCUSSION:
A comprehensive report detailing the City’s current street sweeping program, outlining steps to review the City’s current street sweeping program, and evaluating alternative service delivery models was presented to the City Council at its meeting of April 18, 2023.
The report recommended a comprehensive review of the City’s street sweeping program and evaluation of potential adjustments to the current service delivery model in order to enhance and improve the overall street sweeping operation. The report also highlighted the need for reviewing current sweeping frequency, routes and schedules, existing street sweeping related parking restrictions, and impacts of parked vehicles during designated street sweeping hours.
At the same City Council meeting, the potential for adjusting routes and schedules to enhance service delivery, consideration of enhancing the current bi-weekly street sweeping services to a weekly program including implementation of a comprehensive parking enforcement program to ensure effectiveness of a new and robust street sweeping program were discussed. After deliberation, the City Council directed staff to conduct a series of community meetings to discuss the City’s street sweeping program with West Covina residents and garner their input regarding frequency of service, parking enforcement and other relevant issues by conducting surveys. Additionally, the City Council asked staff to work with the current service provider to evaluate new routes and schedules to ensure providing an optimum level of service, particularly in the areas of high-density developments (multi-family residential, condominium and apartments). Furthermore, the City Council directed staff to bring back a report for its review outlining the results of the community meetings, public surveys, and the revised street sweeping routes and schedules.
Over the course of the last months, four (4) community meetings were held on June 12, 2023, June 17, 2023, June 26, 2023 and October 19, 2023. At each meeting, staff presented to the members of public the City’s current street sweeping program, some of the challenges which hinder implementation of an efficient program, particularly as related to lack of a comprehensive street sweeping parking prohibition and enforcement; as well as potential opportunities for providing a more effective street sweeping program. At each meeting, residents were provided the opportunity to provide comments and ask questions. At the October 19, 2023 meeting, staff shared the revised routes for weekly street sweeping and obtained feedback from residents. Additionally, surveys were conducted to gather residents’ input.
Based on the input received from the residents and the result of the surveys, a comprehensive review of the current bi-weekly street sweeping program, field observation of current conditions with regards to the negative impact of parked vehicles during designated street sweeping hours, it is concluded that in order to enhance and improve the program, there are two options available:
1. Implementation of a complete street sweeping parking restriction and enforcement; and/or
2. Increasing frequency of street sweeping operation from bi-weekly to weekly.
Option 1: Implementation of a complete street sweeping parking restriction and enforcement Implementation of a successful parking restriction and enforcement program requires revisions to the City’s Municipal Code, installation of street sweeping signs throughout the City (currently only 7% of City streets are posted) and allocation of resources including code enforcement officers and equipment. It is estimated that the cost of installing street sweeping signs will be about $600,000.
Moreover, the cost of a dedicated parking enforcement program will be $470,000 on an annual basis. This includes 7 vehicles, 12 part-time positions, and equipment. Staff anticipates revenue would be generated from parking citations. However, this would not fully offset the cost. It should be noted that the long-term cost of maintaining street sweeping signs has not been included.
In addition, the City will need to amend necessary provisions of the West Covina Municipal Code, including, but not limited to, Chapters 1 (General Provisions) and 22 (Traffic Regulations) to reflect street sweeping regulations and the City's ability to enforce them.
Implementation costs for parking restriction and enforcement: $1,070,000, $600,000 one-time and $470,000 annually
Option 2: Increasing frequency of street sweeping operation from bi-monthly to weekly As related to the second option, changing the frequency of street sweeping from bi-weekly to weekly service, as directed by the City Council, over the course of the last few months, staff has worked closely with the City’s street sweeping contractor, Nationwide Environmental Services, to iron out details of a weekly schedule and new routes. Results of this effort outlining the new routes and street sweeping schedules are attached (Attachment 2). Nationwide Environmental Services has proposed to provide weekly street sweeping services to the City of West Covina at a cost of $1,382,080 per year. This cost includes purchase of additional sweeping machines, fuel, staff and incidentals to accommodate a weekly schedule. The current cost for providing bi-weekly service is $691,040. It should be emphasized that the positive impact and a higher level of service by increasing the frequency of street sweeping service could only be realized if it is augmented by implementation of a comprehensive parking restriction and enforcement program as described above.

RESOLUTION NO. 2023-93 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, MAKING THE REQUIRED CERTIFICATIONS AND APPROVING THE
APPOINTMENT OF ANNETTE CARLOS AS A PART-TIME RETIRED ANNUITANT POLICE
RECORDS SPECIALIST II IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTIONS 7522.56 AND 21224
BACKGROUND:
The Records Bureau of the West Covina Police Department is the primary public safety contact for other criminal justice agencies that coordinate with Police, and also for residents needing in-person assistance at the Police Station. West Covina Police Department Records staff are directly responsible for the timely production of records to meet local, state, and federal laws and mandates, as well as meeting the Police records needs of the public-these are critical public safety duties.
The West Covina Police Department Records Division is currently experiencing a staffing shortage with five vacancies. The Department has been actively recruiting to fill these vacancies; however, staff does not anticipate being able to fill these positions with properly trained staff for months. These vacancies will make it extremely difficult for our existing Records Personnel to keep up with workload demands of the Records Division and to stay in compliance with state and federal requirements. This shortage of personnel will also make training of newly hired personnel to fill current vacancies extremely challenging while managing the workload of day-to-day records functions.
Ms. Annette Carlos, Records Specialist II, retirement from the City and with CalPERS will be effective December 4, 2023, and is one of the five Records vacancies. Due to the workload demands and staffing needed to train newly hired records staff, Ms. Carlos has graciously offered to help the Department by returning to work as a part-time Retired Annuitant. Ms. Carlos is the most tenured Records staff member the Department has, and her experience will be a crucial part of helping to ensure our newly hired personnel are properly trained and that the standards in Records continue to be met. As a Retired Annuitant employee, Ms. Carlos would provide records services, mentor and train Records Specialist II’s as they move into new roles, and help train newly hired Records staff to ensure the future integrity of the as they move into new roles, and help train newly hired Records staff to ensure the future integrity of the Records Division.
Staff is seeking City Council certification that the nature of Ms. Carlos' employment and the appointment is necessary to fill a critically needed position in accordance with California Government Code section 7522.56.
DISCUSSION:
Pursuant to Section 7522.56(b) of the California Government Code, "[a] retired person shall not serve, be employed by, or be employed through a contract directly by, a public employer in the same public retirement system from which the retiree receives the benefit without reinstatement from retirement, except as permitted by this section." Section 7522.56(c) of the California Government Code provides the following exception: "[a] person who retires from a public employer may serve without reinstatement from retirement or loss or interruption of benefits provided by the retirement system upon appointment by the appointing power of a public employer either during an emergency to prevent stoppage of public business or because the retired person has skills needed to perform work of limited duration." Pursuant to Section 7522.56(f)(1) of the California Government Code, "A retired person shall not be eligible to be employed pursuant to this section for a period of 180 days following the date of retirement unless...[t]he employer certifies the nature of the employment and that the appointment is necessary to fill a critically needed position before 180 days have passed and the appointment has been approved by the governing body of the employer in a public meeting. The appointment may not be placed on a consent calendar."
Pursuant to California Government Code section 21224(a), "[a] retired person may serve without reinstatement from retirement or loss or interruption of benefits provided by this system upon appointment by the appointing power of a state agency or public agency employer either during an emergency to prevent stoppage of public business or because the retired person has specialized skills needed in performing work of limited duration."
In this case, Ms. Carlos has the specific skills and knowledge required to perform duties related to the Records Bureau, to support the Police Department’s efforts to provide public safety service in a timely manner, and ensure report processing complies with local, state and federal laws. Ms. Carlos, as our Senior Records Specialist with over 22 years of experience, also possesses a special skill set and a high level of expertise related to producing and processing records in response to time-sensitive court requests and Public Records Act requests. Ms. Carlos also has the skills and the tenure necessary to mentor our newly promoted trainers and help provide training to our future newly hired staff members.
As outlined above, the Police Department Records Division is at critical staffing levels with five vacancies. Although the Department has been actively recruiting to fill these vacancies, staff does not anticipate being able to fill these positions for months. The vacancies combined with Ms. Carlos' retirement creates a critical need to fill the position before 180 days have passed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, MAKING THE REQUIRED
CERTIFICATIONS AND APPROVING THE APPOINTMENT
OF ANNETTE CARLOS AS A PART-TIME RETIRED
ANNUITANT POLICE RECORDS SPECIALIST II IN
ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE
SECTIONS 7522.56 AND 21224
WHEREAS, in compliance with California Government Code section 7522.56, the City Council of the City of West Covina must provide the California Public Employees Retirement System (CalPERS) this certification resolution when hiring a retiree before 180 have passed since his or her retirement date; and
WHEREAS, Annette Carlos (SSN XXX-XX-5024) retired from the City of West Covina in the position of Police Records Specialist II, effective December 4, 2023; and WHEREAS, California Government Code section 7522.56 requires that postretirement employment commence no earlier than 180 days after the retirement date, which is June 2, 2024 without this certification resolution; and WHEREAS, California Government Code section 7522.56 provides that this exception to the 180-day wait period shall not apply if the retiree accepts any retirementrelated incentive; and WHEREAS, the City Council, the City of West Covina and Annette Carlos certify that Annette Carlos has not and will not receive a Golden Handshake or any other retirement-related incentive; and
WHEREAS, the City Council of the City of West Covina hereby approves the appointment of Annette Carlos as an extra help retired annuitant to perform the duties of Police Records Specialist II for the City of West Covina under California Government Code section 21224, effective December 9, 2023; and
WHEREAS, the form of the appointment document between Annette Carlos and the City of West Covina is attached hereto as Exhibit A and has been reviewed and approved by the City Council; and
WHEREAS, no matters, issues, terms or conditions related to this employment and appointment have been or will be placed on the consent calendar; and WHEREAS, the employment shall be limited to 960 hours per fiscal year for all CalPERS employers; and

WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the monthly maximum base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and WHEREAS, the maximum base salary for this position is $4,224 and the hourly equivalent is $24.37, and the minimum base salary for this position is $3,475 and the hourly equivalent is $20.05; and
WHEREAS, the hourly rate paid to Annette Carlos will be $24.37; and WHEREAS, Annette Carlos has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby certifies the nature of the appointment of Annette Carlos as described herein and that this appointment is necessary to fill the critically needed position of Police Records Specialist II for the City of West Covina by December 9, 2023 to perform critically needed records-related functions and other duties as needed.
SECTION 2. The City Council hereby certifies that Annette Carlos has specialized skills needed to perform these duties, and the duties cannot be performed by current staff, as described in more detail in the staff report accompanying this resolution.
SECTION 3. The City Council hereby approves the appointment and authorizes the Acting City Manager to appoint Annette Carlos to provide services to the City of West Covina as a Police Records Specialist II, subject to the following terms: Annette Carlos shall be limited to working no more than 960 hours per fiscal year; the City shall pay Annette Carlos at a rate of $24.37 per hour; and Annette Carlos shall not receive any compensation in addition to this hourly rate.
SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall enter the same in the book of original resolutions and it shall become effective immediately.
