OBJECTIVE
The purpose of this report is to introduce Ordinance 24-17, amending Chapters 9.28 and 12.12 of the Municipal Code and repealing and readopting Title 10 of the Municipal Code, to allow for improved planning, design, regulation and enforcement of traffic and parking activities.

RECOMMENDED ACTION
Staff respectfully recommends that the City Council:
1) Waive the first reading and read by title and number only Ordinance 24-17, amending Chapters 9.28 and

12.12 of the Municipal Code and repealing and readopting Title 10 of the Municipal Code related to traffic and parking; and
2) Inform the audience that the second reading and adoption of Ordinance 24-17, is tentatively scheduled for December 4, 2024.

BACKGROUND
Several sections of the Municipal Code have not been updated for many years and either contain outdated information or limit the City’s ability to effectively manage the planning, design, management and enforcement of traffic and parking activities in the City. Chapter 9.28 (Aggressive Solicitation) of the Municipal Code was last updated in 1996 by Ordinance 96-17. Minor updates are needed to this section to support special event traffic control and parking. Similarly, Chapter 12.12 (Parks and Community Service Facilities) was last updated in 1989 by Ordinance 89-12. Minor updates, including provisions for motorized vehicles in parks and updated violation penalties are necessary to encourage and enforce safety in park spaces.

Additionally, Title 10 was adopted shortly following the incorporation of the City in 1987. In 1988, the City Council established a Traffic Committee to serve as a regular forum for coordination and oversight of traffic engineering, safety and enforcement concerns within the City. Membership in the Traffic Committee was defined to include the Chief of Police, the Fire Chief, and the Director of Public Works or their designees. The purpose of the Traffic Committee was to provide close coordination between these departments and positions during the infancy of the City, to supplement staff expertise, and provide ongoing coordination between key departmental staff relating to transportation safety, operations and public transportation concerns. Further, the Traffic Committee was to serve as the primary channel for public comments, complaints, and suggestions related to transportation safety, education, enforcement, and engineering concerns.

Since then, significant changes to staffing, department organization and commissions have occurred. The Transportation, Mobility, and Infrastructure (TMI) Commission is now the major forum for serving as a conduit for public comments, complaints, and suggestions. The City government structure has changed and the establishment of new departments such as Economic Development and Housing, Capital Projects, and a standalone Public Works Operations & Maintenance Department which has shifted traffic engineering and parking functions to different departments. To address this, an internal Traffic and Parking Technical Coordination Group was formed to foster ongoing coordination and communication related to traffic and parking issues within the City and includes representatives from the Capital Projects Department, Community Development Department, Economic Development and Housing Department, Police Department, Fire Department, Public Works Operations & Maintenance Department, and other departments as appropriate. This group has been meeting on a monthly basis since 2018 and began identifying updates needed to Title 10. 429
Municipal Code and Book of Fees Updates - Parking

Page 2 ends

Updates to Title 10 were so significant that staff is recommending a repeal and readoption of Title 10 rather than an amendment, to bring it up to date with current practices, definitions, etc. and to reflect staffing, department and other organizational changes that have occurred over the years.

Parking Fee Update
On April 19, 2017, the City Council adopted uncodified ordinance 17-4 to establish off-street public parking facility and parking meter rates as authorized by the West Sacramento Municipal Code Section 10.26.060 and California Vehicle Code Section 22508. Additionally, on January 19, 2006, the City Council adopted Resolution 06-5 approving parking violation fines which have undergone minor periodic updates in subsequent years.

Based on parking demand increases, off-street and parking meter rate increases in neighboring jurisdictions and opportunities to modify special event parking rates to mirror rates charged by Sutter Health Park for the River Cats and Oakland A’s games, staff proposes to amend parking rates to better manage parking space use and align with regional market rates, including fines for new violations.

Additionally, in response to complaints received by residents about the need to better manage the use and enforcement of activities at the Broderick Boat Ramp, staff also proposes to add off-street paid parking and boat launching fees at the Broderick Boat Ramp Facility to help assist with the ongoing management of the property.

The updated language in the Book of Fees also grants the City Manager the authority to make fee adjustments up to 20% of the published fee schedules adopted under Resolution 24-114. This authority allows the City to respond promptly to emerging budgetary or operational needs. Any further fee adjustments beyond this initial increase would require reauthorization by the Council.

ANALYSIS
Municipal Code Update
Attachment 1 includes Ordinance 24-17 which considers the proposed updated Municipal Code sections. A redline version of all proposed changes to Chapters 9.28 and 12.12 of the Municipal Code, as well as Title 10 is included as Attachment 2. Proposed edits are needed to bring the Municipal Code up to date with current practices, definitions, etc., and to improve management and enforcement of traffic and parking activities in the City. The following provides a summary of the proposed revisions.  Chapter 9.28 (Aggressive Solicitation) – One minor addition is proposed for this Chapter which includes provisions for persons authorized by the city manager or designee to collect fees from an operator of a motor vehicle that is in traffic on a public street for the purposes of supporting special events and specifically, events at Sutter Health Park.
 Chapter 12.12 (Parks and Community Service Facilities) – Proposed changes include updating references to reflect the current Parks and Recreation Department name (formerly Parks and Community Services Department), as well as the Parks, Recreation and Intergenerational Services Commission name and amending language to clarify that off-street parking included as a part of park and/or special use facility site that is owned or maintained by the City is subject to the same permitting and enforcement parameters as other municipal off-street parking lots, as well as the California Vehicle Code. These proposed changes allow the City to better manage and enforce parking activities located on park sites, as well as special use facilities such as the Broderick Boat Ramp and Southport Levee Trail Trailhead. Additionally, new sections were added for motorized vehicles on trails and in parks and violations.  Title 10 (Parking and Traffic) – The repeal and adoption of Title 10, includes comprehensive changes that reflect the following:
- Updated department names throughout.
- Updated staff positions and titles throughout, including the addition of a new Parking Manager position and a description of the position powers and duties.
- Updated language related to traffic control and parking enforcement. - Updated speed limits based on recently-completed speed surveys, as implemented by actions previously taken by the City Council.
- Updated violations and penalties associated with violations of the code. 430

- New chapter that includes on-street parking provisions, including designation of no-parking zones, permits for loading or unloading, requirements to prevent site distance obstruction, temporary parking restrictions, time limit parking zones, parking space markings, removal of parked vehicles and immobilization of vehicles, freight and passenger loading zones, time limits, designation of bus, taxicab and rideshare zones, disabled parking, parking meter installation and pay-by-space machines and crosswalk requirements.
- New chapter that includes off-street parking provisions, including parking private and commercial vehicles on private residential property, prohibiting maintaining, dismantling and repairing vehicles on City property prohibited, municipal parking facility rates and rates to be posted at parking facilities, impairing operation of mechanical gates controlling municipal parking facilities and other related provisions. - New chapter on valet parking to include required permits, terms associated with permits, revocation/nonissuance of permits and administrative penalties. - Updates to preferential permit parking, including language for modification or deleting preferential permit parking areas, as well as posting, exemption and penalty provisions.

Book of Fees Updates
Off-Street Parking Rates – Staff is proposing several parking rate adjustments to better manage parking space use and to align with regional market rates. Off-street rates have not changed since 2017. Modest increases are proposed to better mirror private sector and nearby public parking garage rates in downtown Sacramento, and also include a 15% passthrough fee to facilitate an online prepaid parking reservation system starting next year. New fees are also proposed for the Broderick Boat Ramp to improve public access and mirror similar facilities in the region. Monthly permit holders will be notified by email and provided a minimum 30-day advance notice of fee changes. Proposed fee updates to the Book of Fees are included in Attachment 3 as summarized below:
 5
th & Bridge Lot:
- Hourly Rate: Increased to match first hour of on-street parking rate. - Monthly Rate: Proposed $20 per month increase in 2025 and an additional $20 per month increase in 2026 to reflect pricing currently offered at nearby private and City of Sacramento public parking facilities, which range between $100-$150/month.
 7
th & Tower Bridge Gateway Lot:
- Monthly Rate: Proposed changes include offering one Monthly Rate and eliminating Reserved Parking rates, as they have never been offered or used. - Special Event Rate: Add this rate to match the 5th & Bridge Lot event rate due to its close proximity to Sutter Health Park and to reduce event parking impact on nearby businesses and residents.  Ziggurat Garage 28 City Spaces:
- Monthly Rate: Proposed changes include offering one Monthly Rate, eliminating Reserved and Nights & Weekends parking rates, as they have never been offered or used.  Ziggurat Garage Main Garage City Access Times:
- Daily Maximum: Adjusted rate to better match the Garage’s non-public rates during business hours. - Special Event Rate: Provides more flexibility to increase rates to mirror those charged at Sutter Health Park, which are anticipated to fluctuate, depending on the games. - Monthly Parking: Adjusted rate to better match the Garage’s non-public rates during business hours.  All City-Owned or Managed Parking Facilities:
- Parking Reservation Technology Fee: This fee is to accommodate the cost to the City to implement a new online parking reservation system which allows residents and visitors to make prepaid parking reservations.
 Broderick Boat Ramp:
- Vehicle Only: Daily Flat Rate Max: This rate aligns with regional market rates. - Vehicle with Trailer: Daily Flat Rate Max: This rate aligns with regional market rates. - Vehicle with Trailer: Annual Pass rates for both West Sacramento residents and non-residents: These rates align with regional market rates.

Page 4 ends

On-Street Rates – On-Street Rates have not been updated since 2019. Proposed rate updates include modest increases, while remaining competitive with surrounding jurisdictions.  Meter Rate: On-street parking meter rates will be adjusted by $0.25/hour for Tier 1, $0.50/hour for Tier 2, and $0.75/hour for Tier 3. This will align with regional market rates, promote turnover and increase short-term availability, while directing longer-term parking to off-street facilities.  Monthly Parking Zone Rate: Clarify that this rate is based on monthly rate at the 5th & Bridge Lot.  Daily On-Street Parking Use Fee: Expand fee to non-metered spaces.  Parking Meter Removal and Installation: New fees to accommodate the removal and/or installation of parking meters due to construction projects, as needed. The City contracts with Sacramento for parking meter services and the proposed fees reflect their actual costs to provide this service.

Parking Violation Fines
In addition to the proposed off-street and on-street parking fee updates, parking citation fees for various on-street violations have been updated to reflect changes in the municipal code, deter safety hazards, and align with neighboring jurisdictions.

Next Steps
Based on Council feedback, staff will prepare the proposed updates to the Municipal Code Chapters 9.28 and

12.12, and Title 10, as well as the Book of Fees updates for consideration at the December 4, 2024, Council meeting. Proposed updates to the Book of Fees, once adopted, will go into effect in early 2025.

Environmental Considerations
This action is not a project that is subject to CEQA because it is not an activity that may cause either a direct or reasonably foreseeable indirect physical change in the environment. (Pub. Resources Code, § 21065; CEQA Guidelines §§ 15060(c), 15378(a).)
Commission Recommendation
This item is scheduled to be presented and to the TMI Commission at their November 18, 2024, meeting.

Strategic Plan Integration
Approving the proposed amendments to Municipal Code Chapters 9.28 and 12.12 and repealing and adopting Title 10 supports the Council’s 2017 Strategic Plan goal of Urban Parking by establishing parking facilities and associated planning, design, management and revenue generating activities. Additionally, paid parking and the ability to enforce on- and off-street parking activities implements the General Plan 2035 Goal M-7.1 Parking which states that the “City shall develop and manage a comprehensive on- and off-street parking system that reflects the true cost of private vehicle use, supports the use of alternative transportation, and employs best available technologies” and Goal M-7.13 Pricing which states “The City shall use parking pricing and performance parking to discourage congestion.”
Alternatives
The Council’s primary alternatives are summarized below:

1. Propose additional modifications to the Municipal Code and fee schedule and direct staff to return at a future date with additional information and/or a modified Ordinance and fee schedule; or

2. Decline action at this time.

Alternatives 1 and 2 are not recommended as these revisions to the Municipal Code are necessary and long overdue in order to have the Municipal Code reflect current operations and to support improved ongoing enforcement of on- and off-street parking throughout the City.

Coordination and Review
This report was prepared jointly by the Economic Development and Housing Department and Capital Projects Department in coordination with the Community Development Department, Police Department, Finance Department, and the City Attorney.

Budget/Cost Impact
There are no specific budget or cost impacts associated with the recommended actions. Costs associated with installation of new parking signage or meters will be offset by parking revenue generated from paid on- and off432 Municipal Code and Book of Fees Updates - Parking

10.40.010 Purpose—Authority.

The purpose of this chapter is to establish a process for the designation and signing of truck terminal access routes as provided by state law, and to promote the general health, safety and welfare of the public. This chapter is adopted pursuant to Vehicle Code Section 35401.5(d) and the city’s general police power. The city council finds that this chapter is necessary in consideration of public safety on, and preservation of, highways under the city’s jurisdiction. 459

10.40.020 Definitions.

The following definitions apply to this chapter, and if any word or phrase used in this chapter is not defined in this section, it shall have the meaning set forth in the California Vehicle Code or, if not defined in the Vehicle Code, the meaning attributed to it in ordinary usage. “Terminal” means any facility at which freight is consolidated to be shipped or where full load consignments may be offloaded or at which freeway trucks are regularly maintained, stored or manufactured.
“Freeway truck” means a truck tractor and semitrailer combination, or truck tractor, semitrailer and trailer combination with a length as regulated and allowed by the Federal Surface Transportation Assistance Act of 1982, Public Law 97-424, 96 Stat. 2097, 49 U.S.C. Section 2311 et seq., and as addressed by California Vehicle Code Section 35401.5. “Caltrans” means the Department of Transportation of the state of California, or its successor agency.
“Federally designated highway system” means those highways within the National System of Interstate and Defense Highways and those portions of federal-aid primary highways and federalaid urban system highways that have been qualified by the United States Secretary of Transportation for such uses.

10.40.030 Application—Requirements generally.

Any interested person requiring access for a freeway truck or trucks from the federally designated highway system along highways under the city’s jurisdiction to a terminal or terminals shall submit the following to the director of community development: a letter request and such further information as may be required by the city manager.

10.40.040 Application—city action.

Upon receipt of the letter request, the city traffic administrator will cause an investigation to be made to ascertain whether or not the proposed terminal facility meets the requirements for a terminal, as defined. Upon his or her approval of the terminal facility, he or she will then determine the capability of the route requested and alternate routes, whether requested or not.

Determination of route capability will include a review of adequate turning radius and lane widths of ramps, intersections, streets and highways, general traffic conditions such as sight distance, speed and traffic volumes, and other considerations as deemed relevant by the director of public works. The city will also need to consider coordination and terminal access route approval with the California Department of Transportation (Caltrans). The city will acknowledge receipt of the request and identify the time frame for response. The city and Caltrans shall act on request with ninety (90) days of receipt. Based on these considerations, the director of community development will then approve or disapprove a terminal access route. Follow-up questions from the traffic administrator regarding the letter request and applicant’s response to follow-up questions may extend the approval or disapproval response timeline.

10.40.050 Fees and costs.

A. Upon the approval of the terminal designation and route by the director of community development, the applicant shall deposit with the city sufficient funds as estimated by the city traffic administrator to pay for the purchase and installation of terminal trailblazer signs. Trailblazer signs will be required at every decision point in the city on route to the terminal. Upon completion of the installation of the signs, the actual cost shall be computed and any difference between the actual and the estimated cost shall be billed or refunded to the applicant, whichever the case may be. No terminal or route may be used until such signs as may be required are in place.

B. Notwithstanding subsection A of this section, a fee will not be charged if the applicant is a terminal operator.

Ordinance 24-17

Page 28 ends

4861-9635-2999.3 007203.038

10.40.060 Retrofitting.

A. If all feasible routes to a requested terminal are found unsatisfactory by the director of community development, the applicant may request retrofitting of the deficiencies. All costs of engineering, construction and inspection will be the responsibility of the applicant. Except when the retrofitting of deficiencies is within the jurisdiction of Caltrans, the actual construction will be done by the city or by a contractor acceptable to the city.

B. When the work is to be done by the city, the applicant shall deposit with the city the estimated cost of retrofitting. Adjustments between the estimated and actual costs shall be made after completion of the work and any difference between the actual and the estimated cost shall be billed or refunded to the applicant, whichever the case may be.

C. If at any time within five years from the date of completion of the retrofitting by the applicant, should any other applicant seek terminal access route approval which would use the route upon which such retrofitting was accomplished, any such applicant’s fee may include that applicant’s proportionate share of the retrofitting, as determined by the city traffic administrator, which fee shall be disbursed by the city to the applicant who paid for the retrofitting as well as to any other applicant who contributed to the cost of retrofitting.

10.40.070 Revocation or Changes of route.

The director of community development may amend or revoke any approved terminal or terminal access route if the terminal or route becomes an unreasonable traffic hazard for vehicular or pedestrian traffic. A traffic hazard includes the inability of freeway trucks to negotiate the route or such vehicles causing unsafe driving conditions for other vehicular traffic or pedestrians.

10.40.080 Appeal process.

If the director of community development denies terminal designation or route feasibility or revokes a previously approved terminal or route, the applicant or terminal owner, within fifteen days following the date of receipt of the decision, may appeal the decision to the city council in writing in accordance with the procedure set forth in Chapter 1.08. The appeal shall state specifically whether there was an error or abuse of discretion by the director of community development or whether his or her decision is not supported by the evidence in the record. Within five days of receiving notification that the appeal has been filed, the city traffic administrator shall transmit to the city clerk the terminal application, the sketches of the revoked route and all other data filed therewith, the written decision, and all other relevant documentation. The city council will then reconsider the decision and either affirm or reverse it. The city council’s decision shall be final.

10.40.090 Enforcement.

Any violation of this ordinance shall be prosecuted in accordance with the provisions of Division 17 of the California Vehicle Code and other applicable law.

10.40.100 Routes designated.

The director of community development designates the following roadway segments as terminal access routes in accordance with Vehicle Code Section 35401.5(d).

Chapter 10.44 PREFERENTIAL PERMIT PARKING

10.44.010 Purpose and authority.

The purpose of this chapter is to reduce the adverse effects caused in certain areas of the city by motor vehicle congestion, particularly the long-term parking of motor vehicles on the streets of such areas by nonresidents. As more specifically set forth in Section 10.44.020, such parking by nonresidents threatens the health, safety and welfare of the residents and commerce in the city.

In order to protect such residents and promote commercial well-being in affected areas, it is necessary to enact the preferential permit parking system established by this chapter.

The city council enacts the ordinance codified in this chapter in accordance with the authority granted by Article XI, Section 7 of the California Constitution, and pursuant to Vehicle Code Section 22507 which authorizes cities to designate certain streets for preferential parking.

10.44.020 Findings.

The preferential parking system established by this chapter will relieve the adverse effects caused by motor vehicle congestion by:

A. Protecting the ability of residents in certain areas of the city to obtain parking near their residences and ensure access to their residences;
B. Preserving the residential character of such areas and neighborhoods, which character has been compromised due to the presence of commuter vehicles; C. Preserving the value of property in such areas and neighborhoods; D. Protecting the safety of children and other pedestrians in such areas; and E. Promoting traffic safety, peace, good order, comfort, convenience and the general welfare of the inhabitants of the city.

The above findings of the city council support the need for enactment of the ordinance codified in this chapter and is not meant to be an exhaustive list. 462

10.40.030 Application—Requirements generally.

Any interested person requiring access for a freeway truck or trucks from the federally designated highway system along highways under the city’s jurisdiction to a terminal or terminals shall submit the following to the director of community development: an application, on a form as provided by the city letter request, the requisite fee, and such further information as may be required by the city manager.

10.40.040 Application—City action.

Upon receipt of the applicationletter request, the city manager traffic administrator will cause an investigation to be made to ascertain whether or not the proposed terminal facility meets the requirements for a terminal, as defined.

Based on these considerations, the city managerdirector of community development will then approve or disapprove a terminal access route. The city manager’s decision shall be in writing and shall be delivered to the applicant within thirty days from the submission of a complete application packet. Follow-up questions from the traffic administrator regarding the letter request and applicant’s response to follow-up questions may extend the approval or disapproval response timeline.

10.40.050 Fees and costs.

A. At the time of submitting the application, the applicant shall pay a nonrefundable application fee, as established by resolution which may be amended from time to time, 514

B.A. Upon the approval of the terminal designation and route by the city managerdirector of community development, the applicant shall deposit with the city sufficient funds as estimated by the city manager traffic administrator to pay for the purchase and installation of terminal trailblazer signs.

CB. Notwithstanding subsections A and B of this section, a fee will not be charged if the applicant is a terminal operator.

10.40.060 Retrofitting.

A. If all feasible routes to a requested terminal are found unsatisfactory by the city managerdirector of community development, the applicant may request retrofitting of the deficiencies.

C. If at any time within five years from the date of completion of the retrofitting by the applicant, should any other applicant seek terminal access route approval which would use the route upon which such retrofitting was accomplished, any such applicant’s fee may include that applicant’s proportionate share of the retrofitting, as determined by the city manager traffic administrator, which fee shall be disbursed by the city to the applicant who paid for the retrofitting as well as to any other applicant who contributed to the cost of retrofitting.

10.40.070 Revocation or Changes of route.

The city manager director of community development may amend or revoke any approved terminal or terminal access route if the terminal or route becomes an unreasonable traffic hazard for vehicular or pedestrian traffic. A traffic hazard includes the inability of freeway trucks to negotiate the route or such vehicles causing unsafe driving conditions for other vehicular traffic or pedestrians.

10.40.080 Appeal process.

If the city manager director of community development denies terminal designation or route feasibility or revokes a previously approved terminal or route, the applicant or 515
Attachment 2
4861-9635-2999.3 007203.038
terminal owner, within fifteen days following the date of receipt of the decision of the city manager, may appeal the decision to the city council in writing in accordance with the procedure set forth in Chapter 1.08. The appeal shall state specifically whether there was an error or abuse of discretion by the director of public works community development or whether his or her decision is not supported by the evidence in the record. Within five days of receiving notification that the appeal has been filed, the city manager traffic administrator shall transmit to the city clerk the terminal application, the sketches of the revoked route and all other data filed therewith, the written decision, and all other relevant documentation. The city council will then reconsider the manager’s decision and either affirm or reverse it. The city council’s decision shall be final.

A. Protecting the ability of residents in certain areas of the city to obtain parking near their residences and ensure access to their residences; B.
517
Attachment 2
4861-9635-2999.3 007203.038
