OBJECTIVE
The purpose of this report is to provide the City Council with the treasurer’s quarterly report on the City’s investment portfolio for the quarter ending June 30, 2024 as outlined by the Government Code 53646(b) (1).

RECOMMENDED ACTION
Staff respectfully recommends that the City Council receive and file the Treasurer’s Quarterly Financial Report on the City’s investment portfolio for the period ending June 30, 2024.

BACKGROUND
All local agencies are required to file regular financial reports with their legislative body on the status of their investment portfolio. One of the roles of the Finance Department is to manage investments of the City to ensure that cash flow needs are met while maximizing the investment portfolio.

The funds invested in the City’s treasury are made up of pooled cash from all Funds in the City’s General Ledger, including funds held in Trust for other agencies (i.e., the Yolo-Sacramento Port District and West Sacramento Flood Control Agency (WSAFCA) JPA). City staff structure investment maturities in such a way to optimize return while ensuring enough liquid funds are available to meet the operating and capital needs of the City and agencies for which the City acts as Treasurer. The pooled cash also includes impact fee revenues collected from developers and set aside until sufficient funds are available to implement the capital projects for which they were collected, and reserve funds for budget stabilization to ensure fiscal stability of the City and its various services to the community.

It should be noted that the majority of the funds held in the City’s treasury are legally restricted and may only be used for the purposes for which they are collected. Moreover, the funds may only be invested in investments permitted by California Government Code 53600 (Code) et. al, and the City’s investment policy.

Under section 53646(b)(1) of the Government Code, the City Treasurer may prepare and transmit a quarterly financial report to the City Council on the City’s investment portfolio. This report includes:

1. The type of investment, issuer, date of maturity, and par and dollar amount invested on all securities, investments and funds held by the City;

2. A current market value as of the date of the report;

3. A stated compliance of the portfolio to the statement of the City’s adopted investment policy, or manner in which the portfolio is not in compliance; and

4. A statement denoting the ability of the local agency to meet its pool’s expenditure requirements for the next six months, or provide an explanation as to why sufficient money shall or may not be available. Once a year, the statement of investment policy is included in the report.

This quarterly report is produced in a format designed to provide stakeholders a broad profile of the City’s Investment Portfolio. While staff are only transmitting portions of the report with key investment results, a full report with additional detail is available upon request. 548

ANALYSIS
This quarterly financial report summarizes the status of pooled treasury investments as of June 30, 2024. For the quarter-end, the City’s treasury investments comprised investments with a book value of $351,234,900, and a market value of $348,320,705. These figures do not include accrued interest of $792,660, which represents interest income the City has earned but not yet received. The Book Value represents the carrying value of the securities and is based on what the City paid for the security, net of amortization of premiums or accretion of discounts to date, whereas Market Value is a constantly changing amount based on how the securities markets value our portfolio. Market values fluctuate with changes in interest rates, and price has an inverse relationship to interest rates.

The City continues to maintain sufficient liquidity to meet its expenditure requirements for the next six months.

Local Agency Investment Fund (LAIF), which is the California State Treasurer’s investment pool, and California Asset Management Program (CAMP), a local government investment pool, comprised the City’s most liquid funds, and totaled 26.2% of the investment portfolio. These funds are available to the City within one day.

Additionally, the City held $63.7 million in its operating bank account, which fluctuates depending on cash needs to meet City obligations. Those funds not held in the short-duration investment pools or cash are invested in a diversified portfolio of securities as allowed by code and the City’s investment policy. The portfolio’s duration, sector allocation, and maturity structure are actively managed throughout the quarter. In total, the City’s consolidated investments maintain an average maturity of 405 days.

The City’s portfolio is designed to provide safety and liquidity and continues to meet its goals. City staff and the City’s investment adviser continue to focus on any market dynamics that pose risks to the portfolio.

The City’s portfolio of securities (excluding cash, LAIF, and CAMP) maintains its duration in line with its performance-measuring benchmark. Duration is a risk measure indicating the portfolio’s fair value sensitivity to changes in interest rates. As of June 30, 2024, portfolio duration was 2.58 years, which is 103% of its duration target, as measured by the portfolio’s risk and performance-measuring benchmark (which had a duration of 2.51 years). The portfolio continues to maintain strong diversification in sectors, issuers, and maturities.

Economic Outlook
Recent economic data suggests positive but slower growth this year fueled by consumer spending. While the consumer has been resilient, declining savings rates, growing credit card debt, higher delinquencies, and a moderating labor market pose potential headwinds to future economic growth. Inflationary trends are subsiding, but core levels remain above the Fed’s target. The labor market is showing signs of cooling, reflecting an improved balance between supply and demand for workers. Given the cumulative effects of restrictive monetary policy and tighter financial conditions, it is expected the economy will gradually soften and the Fed will begin lowering interest rates at upcoming meetings with pace and magnitude determined by the incoming data.

As expected at the July meeting, the Federal Open Market Committee voted unanimously to leave the federal funds rate unchanged at a target range of 5.25-5.50%. Although this was the eighth straight meeting, they left the overnight rate unchanged, they noted that risks to achieving their employment and inflation goals are moving “into better balance”. In addition, the FOMC adjusted their evaluation of the labor market pointing out that job gains have moderated. The market is now pricing in more aggressive easing in the coming months.

Discussion of Performance
Long Term Investment Portfolio
The following is a summary of the City’s holdings by investment type, including each sector’s yield to maturity.

Yield to maturity measures the interest income the City is expected to earn for the coming 12 months, assuming nothing in the portfolio changes. As of June 30, 2024, the weighted average yield to maturity of the City’s consolidated investments was 3.3%:

The interest income component of the return continues to be robust (the investment portfolio of securities is expected to earn (purchase yield) was also 3.3% for the next year (up from 3.0% last quarter; when LAIF, CAMP and cash are included the expected earnings are 3.3%). The City’s reinvestment yield (market yield) has been hovering in the 4.9% range. Fair value (the other component of total return) also increased as a result of falling market rates, which caused the City’s portfolio to appreciate in value. The portfolio grew by 4.73% for the past 12 months. The City measures the growth of the portfolio against a total return benchmark with a similar risk profile as the City’s portfolio (InterContinental Exchange Bank of America 1-5 Year Treasury & Agency Index). The benchmark’s return for the same period was 4.18%. Please see below for a summary of the total return.

Short Term Investment Portfolio
Staff continued to maintain a liquidity portfolio comprising money previously held in LAIF, which was providing yields less than 4.6% for new money, to be managed as a separate liquidity portfolio, apart from the City’s main portfolio. The maturities in this portfolio go no longer than six months. The yield on this component of the City’s investments averages 5.3% and is valued at approximately $60.8 million. Staff continues to work closely with the City’s investment adviser to diversify the portfolio in order to improve safety, liquidity, and return. In the current quarter, staff will continue to evaluate liquidity needs and, where possible, continue the investment in longer-duration securities. The total return (percentage growth) for this portfolio for the 100 days it has been in existence was 1.19%, which is an annual equivalent of 4.41%.

The City utilizes pump stations to help transport potable water to its citizens and to maintain water pressure through the system.

Recognizing the need to begin scheduled replacement of the VFD’s, a CIP was proposed and approved by Council beginning with the fiscal year 2023/24 budget cycle.

Staff has conducted a review of the variable frequency drives at all water pump stations throughout the City and has created a priority list for replacement. An Invitation to Bid was released on March 6, 2024 for the first six drive replacements.

ANALYSIS
After reviewing available funds, staff created an Invitation to Bid (24-052-ITB) and released it on August 23, 2024. Proposals were due for review by September 27, 2024. A total of nine bids were received, with all of them being accepted. This bid specified three separate VFD configurations, which would allow staff to replace the maximum number of units based on cost per unit, rather than specifying a specific number of units.

Integrated Power System has proved to be lowest responsible bidder and staff accepted this bid.

Environmental Considerations
The purchase and installation of five Variable Frequency Drives project is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines 15301 (Class 1). Class 1 consists of operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. 573

CITY COUNCIL AGENDA REPORT
MEETING DATE: November 20, 2024 ITEM # 15
SUBJECT:

CONSIDERATION OF AWARD OF A CONTRACT WITH RENTOKIL NORTH AMERICA, INC. DBA TARGET SPECIALTY PRODUCTS FOR CHEMICALS, PESTICIDES,

OBJECTIVE
The purpose of this report is to provide the City Council with sufficient information to consider for approval a professional services contract with Target Specialty Products for chemicals, pesticides, fertilizers, and associated training for City Departments.

RECOMMENDED ACTION
Staff respectfully recommends that the City Council:
1) Find that the contract with Target Specialty Products for chemicals, pesticides, fertilizers, and associated training for City Departments is exempt from environmental review under California Environmental Quality Act Title 14, Chapter 3, Article 19 pursuant to the Section 15301, Class 1 Categorical Exemption; 2) Award a contract for chemicals, pesticides, fertilizers, and associated training for City Departments to Rentokil North America, Inc. dba Target Specialty Products; 3) Authorize the City Manager or his designee to execute the contract and make non-substantive changes or modifications to the Contract for Services with approval from the City Attorney; 4) Authorize the City Manager or his designee to execute amendments or change orders up to 10% of the contract amount; and
5) Authorize the City Manager or his designee to execute amendments to extend the term of the contract.

BACKGROUND
The City uses a variety of specific materials related to weed abatement and the maintenance of parks. In addition, the City requires qualified vendors to provide annual staff training to comply with certifications, as-needed consultation to address abatement issues, and provide compliance documentation to the Yolo Agriculture Department as required.

ANALYSIS
In August 2024 the Public Works Operations & Maintenance issued a Request for Proposals (24-047-RFP) for the purchase of chemicals, fertilizers, and pesticides to be used in parks and as part of the weed abatement program as well as to provide training to remail compliant with County, State, and Federal regulations. Only one bid was received, and it was found to be responsive.

Environmental Considerations
This action falls under a Class 1 (Existing Facilities) Categorical Exemption according to the California Environmental Quality Act (CEQA). Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination (Existing Facilities, Section 15310, CEQA Guidelines).

Commission Recommendation
Not applicable.

Strategic Plan Integration
Awarding a contract for chemicals, pesticides, fertilizers, and associated training aligns with the City’s Strategic Principle of Core Services and Infrastructure.

Alternatives
The City Council may decide to:

Based on history with the vendor, staff recommends alternative 1 as the best way to achieve the City’s required maintenance needs.

Coordination and Review
The Request for Proposals was coordinated with the Parks and Recreation Department. Additionally, coordination with the Finance Department was in place for contract review.

Budget/Cost Impact
The cost for pesticides, chemicals, and fertilizers is budgeted within the Parks and Recreation Funds (101), Road Fund (201), CFD’s (269), L&L Districts (213) and Storm Maintenance (215) Funds as approved by Council in the biennial budget. The approved budget is sufficient to fund the anticipated costs for pesticides, fertilizers, and chemicals for the remainder of fiscal year 2024/25 and any needed changes will be included in the upcoming biennial budget.

CITY COUNCIL AGENDA REPORT
MEETING DATE: November 20, 2024 ITEM # 16
SUBJECT:

CONSIDERATION OF RESOLUTION 24-111 SETTING THE TIME AND DATE FOR THE 2025/26 REGULAR MEETINGS OF THE CITY COUNCIL
INITIATED OR REQUESTED BY: REPORT COORDINATED OR PREPARED BY:
[ ] Council [X] Staff
[ ] Other

City Manager’s Office
ATTACHMENT [X] Yes [ ] No [ ] Information [ ] Direction [X] Action

OBJECTIVE
The objective of this report is to seek Council approval of the City Council meetings scheduled for February 1, 2025 through January 31, 2026.

RECOMMENDED ACTION
It is respectfully recommended that the City Council adopt Resolution 24-111 setting the time and date for City Council meetings commencing February 1, 2025 through January 31, 2026.

BACKGROUND
The City Council generally meets on the first and third Wednesdays of the month. In the fall of each year, the Council reviews the meeting calendar with consideration given to holidays and other regular Council obligations.

Resolution 24-111 sets a regular Council meeting schedule for 2025/26 which takes into consideration holidays and other scheduling conflicts. This schedule will reduce the need to cancel and/or schedule special meetings.

ANALYSIS
Resolution 24-111 keeps, as much as possible, with the designated first and third Wednesdays of each month with the following exceptions:
 Pursuant to Resolution 23-76 the Council is currently scheduled to meet on January 15, 2025, and staff is recommending not scheduling a meeting on February 5 (first Wednesday) but scheduling a meeting on February 19 (third Wednesday) to allow for scheduling two consecutive meeting days in February, to be determined at a later date, for the annual Council strategic planning session.  Due to the Washington Unified School District Spring Break schedule April 14-21 staff is proposing to schedule a meeting on April 9 (second Wednesday) and April 30 (fifth Wednesday) and not schedule meetings on April 2 (first Wednesday) or April 16 (third Wednesday). If necessary, a special meeting could easily be scheduled to accommodate any date sensitive items.  Due to the Metro Chamber Annual Cap-to-Cap event (which Council attends) scheduled for May 3-7, 2025, staff is recommending not scheduling a meeting on May 7.  Staff is recommending not scheduling a meeting on July 2 due to the July 4 holiday.  Staff is recommending not scheduling a meeting on September 3 due to the Labor Day holiday.  Due to the holiday season, staff recommends meeting once in December on the 3rd and not scheduling meetings on December 17 or January 7, to allow for a holiday break until January 21, 2026. The meeting on December 3 will also accommodate the planned Executive Team Retreat schedule.

SUBJECT:

PUBLIC HEARING, SECOND READING AND CONSIDERATION OF ADOPTION OF ORDINANCE 24-15 REGARDING PROPOSED AMENDMENT TO MUNICIPAL CODE TITLE 17 (ZONING) FOR HOUSING ELEMENT IMPLEMENTATION
INITIATED OR REQUESTED BY: REPORT COORDINATED OR PREPARED BY:

Elijah Ortega, Associate Planner

[ ] Commission [X] Staff
[ ] Other
ATTACHMENT [X] Yes [ ] No [ ] Information [ ] Direction [X] Action

OBJECTIVE
The purpose of this item is to request the Council’s consideration of an amendment to Municipal Code Title 17 (Zoning) to achieve compliance with Government Code § 65583.2 and Housing Element Program HE-PR-1.14 regarding by-right approval of projects with at least 20 percent affordable units.

RECOMMENDED ACTION
Staff respectfully recommends that the Council:

1. Conduct the Public Hearing;

2. Find that the amendment to Municipal Code Title 17 (Zoning) to achieve compliance with Government Code §65583.2 and Housing Element Program HE-PR-1.14 is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to the Class 5 Categorical Exemption under §15601(b)(3) (common-sense exemption) and §15305 (minor alterations in land use limitations in an area with an average slope less than 20%) and find that the exemptions represent the independent judgment of the City; and

3. Waive second reading and adopt Ordinance 24-15 amending Title 17 (Zoning) of the Municipal Code regarding: Chapter 17.09 – Housing Element Carry-over Sites.

BACKGROUND
Pursuant to California State Government Code § 65580 the City maintains an adopted, certified Housing Element of the General Plan that establishes goals, policies, and programs governing residential development within the City. The Housing Element is updated every eight years to ensure the document is current and responds to changes in the market and State law. The City’s current Housing Element was adopted in 2021 and covers the eight-year period from 2021 to 2029.

In 2017, AB1397 amended Section 65583.2 of the California State Government Code regarding Housing Element Sites Inventories. Housing Element Sites Inventories identify those parcels reasonably available for residential development within the required eight-year planning period (see Attachment 2, Housing Element Sites Inventory). Specifically, AB1397 requires that cities provide for by-right processing of projects with ≥ 20 percent affordable units proposed on low- and very-low income carry-over sites. By-right processing means that the project shall be a permitted use not subject to a conditional use permit, planned development permit, or other discretionary local government review. In practice, this means that projects meeting the above criteria would proceed straight to building permit plan review. Carry-over sites refer to those sites that were previously identified in two or more consecutive Housing Element cycles (see Attachment 3, Carry-over Sites).

In response to AB1397, Housing Element Program HE-PR-1.14 was included and adopted in the City’s 2021 Housing Element. HE-PR-1.14 commits the City to amending Municipal Code Title 17 (Zoning) to achieve compliance with AB1397. The City is required to complete this implementation measure to maintain compliance with State Housing Element law.

On October 16, 2024, the City received a Corrective Action Letter (Attachment 6) from the State Department of Housing and Community Development (HCD). This letter reinforces the requirement for the City to implement its commitment to the State-certified Housing Element, including Housing Element Program HE-PR-1.14. City staff have responded to HCD, stating that the required code amendments necessary to fully implement HE-PR-1.14 619
are scheduled for consideration by the City Council. At the October 3, 2024 Planning Commission meeting, the commission unanimously recommended that the Council adopt the proposed zoning code amendments. The Council subsequently unanimously approved, after a 5-0 vote, first reading of Ordinance 24-15 at the November 6, 2024 meeting. Should the Council vote to adopt Ordinance 24-15, the changes would become effective on December 20, 2024.

ANALYSIS
The Housing Element Sites Inventory identifies vacant residential and mixed-use-zoned properties to accommodate the City’s Housing Needs Allocation (RHNA) across all income levels. Sites identified to accommodate low- and very-low income units are concentrated within the City’s highest density zoning districts.

Projects affordable to low- and very-low income households require higher densities and greater numbers of units to achieve financial feasibility and to benefit from economies of scale. Frequently, projects containing lowand very-low income units seek to maximize development capacity by constructing residential-only projects with high densities. The intent of AB1397 is to facilitate the development of housing on appropriately zoned properties in a jurisdiction’s sites inventory by removing the regulatory barrier of discretionary permits.

Residential-only projects are currently permitted by-right in all residential zones (RE; RRA; R-1; R-2; R-2.5; R3) and in the WF zone. In the remaining Mixed-Use zones (CBD; C; MU-NC; MU-C) residential-only projects require approval of a Conditional Use Permit, and mixed-use projects are permitted by right if the street frontage is at least 50% non-residential or live-work (see Attachment 4, Zoning Map). The proposed amendment would remove the Conditional Use Permit requirement for residential-only projects in the City’s Mixed-Use zones if the project is proposed on a low- or very-low income carry-over site and ≥ 20 percent of the project’s total units are affordable to lower income households.

Staff’s proposed changes to the Municipal Code are summarized below. Bold/underline text reflects proposed additions to the existing code, while language proposed for deletion is noted in strikeout text. A summary of the proposed change is also noted for each item.

Specific Limitations:
(1) Permitted on upper stories in a mixed-use development/ Ground floor residential and residential-only development is allowed subject to Conditional Use Permit approval.
(2) Permitted on upper stories in a mixed-use development. (3) Permitted on upper stories and in the rear of the site where nonresidential space with a minimum depth of 45 feet is provided along the majority street frontage. Street fronting residential (more than 50%) and residential-only development is allowed subject to Conditional Use Permit approval. Live/work units along the ground floor may be counted towards the commercial requirement.
(4) Only as accessory to a Fueling Station.

Housing Element Carry-Over Sites: Residential-only development is allowed by-right and does not require Conditional Use Permit approval if the project is located on a low- or very-low income Housing Element carry-over site and ≥ 20 percent of the project’s total units are affordable to lower income households. Carry-over site means the site has been included in two or more consecutive Housing Element sites inventories. 620
Summary: This amendment is proposed to implement Housing Element Program HE-PR-1.14 regarding by-right approval of projects with ≥ 20 percent affordable units on identified low- and very-low income carry-over sites.

The amendment would remove the Conditional Use Permit requirement for residential-only projects in the City’s mixed-use zones, if the project meets the above criteria.

Environmental Considerations
This action falls under the Class 5 Categorical Exemption according to Section 15305 of the California Environmental Quality Act (CEQA) Guidelines. Class 5 consists of minor alterations in land use limitations in areas with an average slope of less than 20% which do not result in any changes in land use or density (Minor Alterations in Land Use Limitations, Section 15305, CEQA Guidelines). This action also falls under the “common sense” exemption according to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines. The common-sense exemption applies to projects that do not involve any physical changes with potential to create an adverse effect on the environment (Review for Exemption, Section 15061, CEQA Guidelines).

As described above, the proposed action would eliminate the Conditional Use Permit requirement for residentialonly projects in mixed-use zones, under certain circumstances. However, the actual construction of projects would be subject to its own project-level CEQA review, as applicable. The proposed Class 5 Categorical Exemption does not preclude project-level CEQA review for projects proposed on carry-over sites or other sites within the City. A copy of the Notice of Exemption is provided in Attachment 5.

Strategic Plan Integration
This project advances the 2024 Strategic Principle: Housing & Homelessness, provide housing options for everyone and services for the most vulnerable members of society.

Alternatives
The City Council’s primary alternatives are summarized below.

1. Find that the requested changes are not appropriate revisions of the Zoning Code and defer second reading of Ordinance 24-15 at this time.

2. Find that the Class 5 Categorical Exemption and the common-sense exemption are not the appropriate level of environmental review and direct staff to perform additional environmental analysis (specify impacts to be addressed) prior to Council consideration of the request.

3. Continue the item to a future date and request additional information be provided at that time.

While staff believes the analysis presented in this report is correct, staff is prepared to effectuate the alternatives at the Council’s direction.

Coordination and Review
The project was coordinated with staff from the Economic Development & Housing Department.

RE: City of West Sacramento Housing Element Implementation – Corrective Action Letter
Dear David Tilley:

The California Department of Housing and Community Development (HCD) has reviewed the City of West Sacramento’s (City) obligations under the housing element and hereby issues its written findings that the City has failed to implement Program HEPR-1.14 (Amend Zoning Ordinance to Promote By-Right Affordable Housing) to allow by-right processing of sites identified in previous housing elements pursuant to Government Code section 65583.2, subdivision (c).

HCD requests that the City review this correspondence and provide a written response to these findings within 30 days and no later than November 15, 2024. HCD will review and consider the City’s written response before taking any action authorized by Government Code section 65585, subdivisions (i) and (j). As noted below, such action could include revoking HCD’s finding that the City’s housing element is in substantial compliance with Housing Element Law and/or referral to the California Office of the Attorney General.

Housing Element Law
HCD must review any action or failure to act by a City that it determines to be inconsistent with an adopted housing element or section 65583 generally, and it must issue written findings to the City accordingly.
1 HCD must give the City a reasonable
time, no longer than 30 days, to respond to these findings.2 If HCD does not receive a written response from the City within 30 days, or the response does not demonstrate that the program action has been implemented, then HCD will revoke its findings that the City’s housing element substantially complies with Housing Element Law. 3 1 Gov. Code, § 65585, subd. (i)(1)
2 Gov. Code, § 65585, subd. (i)(1)(A)
3 Gov. Code, § 65585, subd. (i)(1)(B)

Additionally, HCD may notify the California Office of the Attorney General when a City takes actions that are inconsistent with an adopted housing element or Government Code sections 65583 and 65915, among other laws.4
Findings
On February 16, 2022, HCD found the City’s housing element in substantial compliance with Housing Element Law. HCD based its compliance finding on, among other things, a commitment to implement housing element Program HE-PR-1.14. This Program committed to allowing by-right processing of sites identified in previous housing elements pursuant to Government Code section 65583.2, subdivision (c) by May 2024.

On August 14, 2024, HCD sent the City a Letter of Inquiry requesting an update on the City’s progress implementing rezone actions in program HE-PR-1.14. The City provided a written response on September 10, 2024, stating that the City was in the process of adopting required rezonings, but did not anticipate taking these rezones to City Council for adoption until early November.

Based upon the City’s September 10, 2024, correspondence, HCD finds that the City has failed to implement this required rezone program action within the statutorily required timeframe.

Next Steps
HCD provides the City until November 15, 2024 to send a written response to these findings. If you have questions, need additional information, or wish to schedule a meeting, please contact me at [email protected] or Fidel Herrera at [email protected].

Sincerely,
Melinda Coy
