Fire Department to notify all affected property owners by mail of the intended weed abatement action. Staff is also requesting Council set a public hearing on April 30, 2025, for property owners to provide objections to the proposed removal of weeds. This hearing date will also be included on the notice to property owners. Under this program, the City’s contractor will only undertake weed abatement activities if the property owner fails to do so before the contractor.
Environmental Considerations
This item is not a project that is subject to CEQA, because it is not an activity that may cause either a direct or reasonably foreseeable indirect physical change in the environment. (Pub. Resources Code, § 21065; CEQA Guidelines § 15060(c), § 15378(a).)

Strategic Plan Integration
This program assists the City in its efforts to reduce local climate vulnerability. By minimizing the fuel load in West Sacramento, this program will subsequently reduce the number of fires and smoke that pollute the atmosphere.
Alternatives
The City may choose not to actively pursue a weed abatement program; however, it is more than probable that there will be an increase in the intensity of vegetation fires as the fuel becomes drier during the summer months.
This added fuel load within the city is a threat to life and property. By reducing the size of the combustible vegetation, the risk and intensity of fires are significantly reduced.
Coordination and Review
This report was produced by the Fire Department.
Budget/Cost Impact
100% of the private party weed abatement costs (historically under $30,000) are reimbursed by property owners, which also includes a 20% administrative fee.

OBJECTIVE
The purpose of this report is to comply with current AB 481 regulations, which require that law enforcement agencies obtain approval from the applicable governing body for the funding, acquisition, collaboration or other use of “military equipment” as defined by Section 7070(c).
RECOMMENDED ACTION
Staff respectfully recommends the City Council:
1. Receive the Police Department military equipment use policy and annual report; and
2. Affirm renewal of Ordinance 22-16.
BACKGROUND
Assembly Bill 481 (AB 481), codified at Government Code (GC) Sections 7070 through 7075 (“AB 481”), requires a law enforcement agency to obtain approval from the applicable governing body prior to taking any action related to funding, acquisition, collaboration, or other use of “military equipment”, as that term is defined by Section 7070(c).
The West Sacramento Police Department (WSPD) currently has equipment defined in AB 481 and codified in GC Sections 7070 through 7075 as “military equipment” in its reserves. Throughout history, up to and including the present, WSPD has found it necessary from time to time, to use this equipment in order to protect the public health, safety, and general welfare, as well as that of WSPD officers, in the most efficient and communityconscious manner.
Specifically, the military equipment is used when WSPD officers face gunfire for prolonged incidents. Such ballistic equipment allows more opportunities to de-escalate the situation by, for instance, equipping tactical teams to resolve life threatening conditions in the safest way possible for all involved, including the community, the suspect, victims, bystanders and officers. Although some of the weaponry and other devices may be used infrequently, their availability expands the choices of non-lethal or less-lethal options for the large variety of dynamic and dangerous encounters faced in our city and profession. Limiting those choices without careful analysis could lead to decreasing options of relevant, contemporary interventions that can allow for deescalation, decrease the severity of violence and reduce harm overall.
To comply with AB 481, the Police Chief shall obtain City Council approval by way of an ordinance adopting a Military Equipment Use Policy (Policy) as defined in Section 7070(d), that delineates the authorized military equipment and its purpose and use, and associated fiscal impact, legal and procedural rules, and requisite training. Additionally, the Policy is to include mechanisms to ensure compliance with the Policy, the procedures by which members of the public may register complaints or concerns, and how WSPD will ensure that each complaint, concern or question receives a timely response.
AB 481 allows the governing body to approve the funding, acquisition and use of military equipment within its jurisdiction, only if it determines that the military equipment meets specified standards outlined in GC 7071 as follows:
1. The military equipment as defined by California Government Code section 7070(c) identified in the Policy is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.
2. The Policy will safeguard the public’s welfare, safety, civil rights, and civil liberties. 601
AB 481 Military Equipment Use
April 9, 2025
3. The current military equipment identified in the Policy and the purchasing of any future military equipment on the list of approved military equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.
4. Prior military equipment use complied with the use policy that was in effect at the time.
On April 20, 2022, Police Department Staff presented for first reading Ordinance 22-16 and on May 18, 2022, subsequent to Staff’s presentation of a second reading, Ordinance 22-16 was adopted, approving Police Department Military Equipment Use Policy 709 and the use, acquisition, collaboration and seeking of funding for military equipment. (See Attachments 2 and 3) The adoption of Ordinance 22-16 was based upon determinations consistent with the required standards for approval as outlined in GC7071. (See attachment 4).
In December of 2023 and March of 2024, public hearings were conducted and the continuance of Ordinance 22- 16 was approved. The associated Policy 709 and the Annual Military Equipment Use Report were received by Council per regulations. The Police Department is currently seeking to again comply with GC 7071, which requires the governing body at a regular Council meeting to annually review Ordinance 22-16 and vote on whether to renew the Ordinance.
ANALYSIS
Pursuant to GC 7072, a law enforcement agency that receives approval for a military equipment use policy shall submit to the governing body annually a “military equipment use report” for each type of military equipment approved by the governing body to include:
1. A summary of how the military equipment was used and the purpose of its use.
2. A summary of any complaints or concerns received concerning the military equipment.
3. The results of any internal audits, any information about violations of the military equipment use policy, and any actions taken in response.
4. The total annual cost for each type of military equipment, including acquisition, personnel, training, transportation, maintenance, storage, upgrade and other ongoing costs, and from what source funds will be provided for the military equipment in the calendar year following submission of the annual military equipment report.
5. The quantity possessed for each type of military equipment.
6. If the law enforcement agency intends to acquire additional military equipment in the next year, the quantity sought for each type of military equipment.
The governing body shall determine, based on the annual military equipment use report, whether each type of military equipment identified in the report has complied with the standards for approval. If the governing body determines that a type of military equipment identified in the annual military equipment use report has not complied with the standards for approval, the governing body shall either disapprove renewal of the authorization for that type of military equipment or require modifications to the military equipment use policy in a manner that will resolve the lack of compliance. The Police Department’s annual Military Equipment Use Report to Council is included as Attachment 1 of this report.
Within 30 days of submitting and publicly releasing an annual military equipment report, WSPD is required to hold at least one well-publicized and conveniently located community engagement meeting, at which the general public may discuss and ask questions regarding the annual military equipment report and WSPD’s funding, acquisition or use of military equipment. On March 1, 2025, the Police Department held an open house for the public to view the Department’s military equipment. Annual Military Equipment Use Report 2024
On September 30, 2021, Assembly Bill 481 was signed into law. It requires law enforcement agencies to obtain approval for the use of certain items defined as “military equipment” from the applicable governing body (City Council), by adoption of a military equipment use policy. The West Sacramento Police Department is required to seek City Council approval of its Military Equipment Use Policy at a regular open meeting prior to taking certain actions relating to the funding, acquisition, and use of military equipment.
Assembly Bill 481 allows the governing body to approve the funding, acquisition, and use of military equipment within its jurisdiction, only if it determines that the military equipment meets specified standards. The Military Equipment Use Policy is subject to City Council review to determine whether the standards set forth in Assembly Bill 481 have been met, based upon an Annual Military Equipment Use Report.
Finally, Assembly Bill 481 requires publication of the Military Equipment Use Policy and the Annual Military Equipment Use Report on the Department’s website. (Assembly Bill 481) California Government Code section 7072 states the following:
(a) A law enforcement agency that receives approval for a military equipment use policy pursuant to Section 7071 shall submit to the governing body an annual military equipment report for each type of military equipment approved by the governing body within one year of approval, and annually thereafter for as long as the military equipment is available for use. The law enforcement agency shall also make each annual military equipment report required by this section publicly available on its internet website for as long as the military equipment is available for use. The annual military equipment report shall, at a minimum, include the following information for the immediately preceding calendar year for each type of military equipment:
(1) A summary of how the military equipment was used and the purpose of its use. (2) A summary of any complaints or concerns received concerning the military equipment. (3) The results of any internal audits, any information about violations of the military equipment use policy, and any actions taken in response.
(4) The total annual cost for each type of military equipment, including acquisition, personnel, training, transportation, maintenance, storage, upgrade, and other ongoing costs, and from what source funds will be provided for the military equipment in the calendar year following submission of the annual military equipment report.
(5) The quantity possessed for each type of military equipment. 604
(6) If the law enforcement agency intends to acquire additional military equipment in the next year, the quantity sought for each type of military equipment. (b) Within 30 days of submitting and publicly releasing an annual military equipment report pursuant to this section, the law enforcement agency shall hold at least one well publicized and conveniently located community engagement meeting, at which the general public may discuss and ask questions regarding the annual military equipment report and the law enforcement agency’s funding, acquisition, or use of military equipment.
In addition to maintaining the highest levels of public safety, the West Sacramento Police Department is committed to transparency, public trust, community partnerships, and compliance with the law. CITY COUNCIL AGENDA REPORT
MEETING DATE: April 9, 2025 ITEM # 13
SUBJECT:
CONSIDERATION OF AN AMENDMENT TO THE CONTRACT FOR FEDERAL
GOVERNMENT RELATIONS AND ADVOCACY SERVICES TO HOLLAND & KNIGHT LLP INITIATED OR REQUESTED BY: REPORT COORDINATED OR PREPARED BY:
[ ] Council [ X ] Staff
[ ] Other
Doug Drozd, Deputy City Manager
City Manager’s Office
ATTACHMENT [ X ] Yes [ ] No [ ] Information [ ] Direction [ X ] Action
OBJECTIVE
The objective of this item is to seek City Council approval of an amendment to the contract for federal government relations and advocacy services to Holland & Knight LLP (Holland & Knight).
RECOMMENDED ACTION
Staff respectfully recommends that the City Council:
1. Approve the contract amendment with Holland & Knight to continue Federal Government Relations and Advocacy Services; and
2. Delegate Authority to the City Manager or his designee to execute an amendment to extend the term of the contract for two (2) years and increase compensation by $414,000; and
3. Authorize the City Manager or his designee to execute non-substantive changes and modifications, with approval from the City Attorney; and
4. Authorize the City Manager or his designee to execute amendments to extend the term of the contract or increase the total contract NTE up to the Council approved budget.
BACKGROUND
The federal government has a large and generally increasing impact on City operations through policy, administration, and the many funding opportunities it provides. Marshaling those federal resources and advocating for City priorities requires close cooperation and coordination with the City’s representatives in Congress, the entire California Congressional delegation, key committees, and dozens of federal agencies.
Historically, the City has utilized the services of a federal lobbyist to work with Council and staff to establish working relationships with elected officials and staff, navigate the federal landscape, secure vital resources, and implement a legislative strategy to advance City priorities, including but not limited to:
the West Sacramento Flood Control Project;
the Downtown Riverfront Streetcar/Light Rail Extension; the Sacramento River Bridge Program;
Housing and Homelessness;
Public Safety;
Broadband Access; and,
Port of West Sacramento (Port) operations and maintenance.
Since 2007 the City, West Sacramento Area Flood Control Agency (WSAFCA), and Port have been represented in Washington by Holland & Knight. The firm was originally chosen through a competitive selection process in 2007 and was selected again in 2012 when the City issued a second request for proposals (RFP) for federal advocacy services. The 2012 contract was due to expire in December 2021, so staff again released an RFP, conducted a competitive solicitation process, and selected Holland & Knight, executing a new contract with a three-year term and options for three additional one-year contract extensions on November 17, 2021. However, due to a clerical error, the 2021 contract did not authorize staff to expend the additional budget needed to cover the three one-year extensions. In November 2024, staff amended the contract as authorized by Council to extend it one year to November 17, 2025, but only subsequently realized the error in the initial contract has resulted in a situation where the cost of the full year of the contract cannot be paid out under the existing authorized funds.
ANALYSIS
To rectify this problem, the proposed contract amendment, included as Attachment 1, stipulates that Holland & Knight will continue to provide federal government relations and advocacy services to the City on an on-call basis for a three-year term running from November 17, 2024 to November 17, 2027. Base compensation is set at 641
Contract Amendment for Federal Government Relations and Advocacy Services April 9, 2025
$12,500 per month, a $1,000 per month increase to the original contract compensation. The contract contains a clause allowing either party to terminate the agreement for any reason with thirty (30) days' written notice.
Holland & Knight’s current duties include but are not limited to:
Working with the City Council, City Manager, and other key City staff to identify and establish federal legislative and policy goals, objectives, opportunities, and priorities. Advocating for the City’s positions on key issues to the White House, federal agencies, and the U.S.
Congress and fostering a positive relationship with those entities. Maintaining the productive relationship the City holds with its representatives in the House and Senate. Identifying and monitoring legislation and regulatory processes that may impact the City. Providing legislative and regulatory lobbying on behalf of the City. Engaging key officials and stakeholders to support the City’s efforts to secure permits, grants, incentives, and favorable laws and regulations.
Pursuing greater public funding for the City, including identifying grant opportunities and assisting with grant applications that support key City priorities.
Coordinating meetings with Members of Congress (House and Senate) and their staffs as well as agency/department leaders to provide the City the opportunity to meet face-to-face with key decisionmakers on pertinent City issues. Advising on the City’s participation in and relationship with the U.S. Conference of Mayors and National League of Cities as well as other relevant advocacy groups. Facilitating the establishment of relations between the Mayor/Councilmembers/City staff and federal government officials, including Chairs of key committees and other important decisionmakers. Assisting with communications and messaging on City priorities. Providing regular updates on the political landscape in Washington, D.C. to give context and identify opportunities and potential issues.
Drafting legislation, amendments, and other language, as necessary. Providing oral and/or written briefing reports for the City Council and City Manager on key issues and legislative/administrative activities.
Providing the City with a deep roster of policy area experts who can be called on to provide guidance in relevant fields.
Coordinating and cooperating with other organizations, municipalities, and firms having similar legislative objectives as the City.
Environmental Considerations
Awarding this contract is not considered a project under the California Environmental Quality Act (CEQA), per Public Resources Code Section 21065.

Strategic Plan Integration
Effective federal advocacy has the potential to advance several items in the Council’s Strategic Plan Policy Agenda by making beneficial federal policy changes and securing federal funding. 642
Contract Amendment for Federal Government Relations and Advocacy Services April 9, 2025
Alternatives
The City Council's primary alternatives are summarized below:
1. Approve the amendment to the agreement with Holland & Knight to provide federal government relations and advocacy services in substantially the form included with this report as Attachment 1 and authorize the City Manager or his designee to execute the amendment.
2. Approve the amendment to the agreement with Holland & Knight subject to Council-directed revisions;
3. Decline to approve the amendment to the agreement with Holland & Knight and direct staff to conduct a new procurement process for federal government relations and advocacy services; or
4. Decline to approve the amendment to the agreement with Holland & Knight and direct staff not to conduct a new procurement process for federal government relations and advocacy services Staff is prepared to implement Alternatives 1 and 2. Staff does not recommend Alternative 3, as the prior competitive bidding process revealed no firms with greater qualifications, proven ability, or strategic approach to achieving the City’s federal advocacy goals. Moreover, the current contract will soon run out of funds which, if not addressed, will cause the City to terminate the existing contract and conduct a new procurement for these services, leaving the City without representation at the federal level. Staff does not recommend Alternative 4, as it is vital to maintain professional representation in Washington, D.C. in order to advance the City’s goals and objectives.
Coordination and Review
This procurement and recommendation were coordinated with the Finance Department.
Budget/Cost Impact
The compensation proposed for this contract is structured as a monthly retainer of $12,500 ($150,000/year), split between City (50%), WSAFCA (40%), and the Port (10%) with the City portion totaling $6,250 ($75,000/year).
The appropriations are included in the budgets adopted by City Council, Port Commission, and the WSAFCA Board for the 2024/25 fiscal year.

PUBLIC HEARING AND CONSIDERATION OF FIRST READING OF ORDINANCE 24-9 REGARDING AMENDMENTS TO TITLE 17 (ZONING) OF THE MUNICIPAL CODE TO

OBJECTIVE
This item is a public hearing regarding proposed amendments to Title 17 (Zoning) of the Municipal Code to accommodate Tiny Homes on Wheels (THoWs) as legal dwellings.
RECOMMENDED ACTION
Staff respectfully recommends that the City Council:
1. Conduct the public hearing regarding the proposed amendments to Title 17 (Zoning) of the Municipal Code to facilitate tiny homes on wheels as legal dwellings; and
2. Find that, pursuant to Section 15305 of the CEQA Guidelines, amendments are categorically exempt from the California Environmental Quality Act pursuant to Title 14, Article 19 of the California Code of Regulations. The project is considered exempt from CEQA pursuant to Section 15305 (a) Minor Alteration to Land Use Limitations because the project consists of adding a new allowable residential housing type which is considered a minor land use change; and
3. Conduct the first reading of Ordinance 24-9, by title and number only, detailing amendments to Title 17 (Zoning) of the Municipal Code to accommodate tiny homes on wheels as legal dwellings.
BACKGROUND
Tiny homes are those that are typically under 399 square feet and are intended to be minimally impactful on the environment. Tiny homes typically range in size depending on the local jurisdictional requirements, may be placed and used on a variety of sites, ranging from the backyards of existing homes to isolated rural settings. A tiny home built on a permanent foundation is currently allowed under Title 17 of the West Sacramento Municipal Code, if it complies with all requirements pertaining to residential construction, such as utility connections and life safety requirements. From a zoning standpoint the mere size of the home is not relevant if it is proposed on a residential parcel. The City already has several “micro-unit” apartments, with floorplans as small as 250-300 square feet.
A variant of tiny homes are those built on a chassis with wheels that can be towed from one location to another.
Tiny homes on a chassis and wheels (THoWs) are legally considered vehicles regulated by the Department of Motor Vehicles (DMV). THoWs are currently allowed in mobile home parks pursuant to State law that are regulated by HCD (see Figure 1 below). This means that they are not subject to building codes and do not count as housing units toward the City’s housing production goals in the Housing Element of the General Plan, according to HCD. THoWs meet the City’s current definition of a trailer, which is defined as “a vehicle with or without motor power, which is designed or used for hauling materials or vehicles, or for human habitation, office, or storage including camper, recreational vehicle, travel trailer, and mobile home, but not including mobile homes on a permanent foundation.”
646
Figure 1 THoW examples
Trailers are excluded from the definition of a dwelling unit, which is “one or more rooms designed, occupied, or intended for occupancy as separate living quarters, with full cooking, sleeping, and bathroom facilities for the exclusive use of a single household. Excludes tents, cabins, boats, trailers, dormitories, labor camps, hotels, and motels.” This means that a THoW is not considered a legal dwelling unit under the Zoning Code when proposed outside of a RV park, campground, mobile home park, etc. Other communities, such as Santa Cruz County, Placer County, and the City of Oakland, have passed ordinances to accommodate THoWs with varying requirements. THoWs would still be legally classified as vehicles and thus not subject to building codes but would be subject to other land development-related sections of the City’s Municipal Code such as setbacks from property lines, front yard paving, etc. It’s unclear if THoWs would count toward the City’s housing obligations as provided for in the Housing Element of the General Plan.
On November 15, 2023, staff conducted a public workshop with the City Council to get further direction on proposed amendments to Title 17 (Zoning) of the Municipal Code on THoW as legal dwellings. Staff provided a presentation, and public comment was taken as part of the workshop.
The item was previously continued at the August 15, 2024, Planning Commission Public Hearing. On October 17, 2024, the Planning Commission conducted a public hearing. After the public hearing, the Planning Commission voted to approve the item via a 3-2 vote. Since this is an ordinance, this item does require two readings with the City Council.
ANALYSIS
Based on feedback and direction from the public workshop on November 15, 2023, it was City Council’s recommendation to allow THoWs as both primary dwelling units and Accessory Dwelling Units (ADUs) on residential lots. Since tiny homes as ADUs are already sufficiently addressed, staff has focused on how existing regulations might be revised to accommodate THoWs as primary dwelling units. The critical issues for THoWs revolve around how to address basic health and public safety considerations; sewage connections/disposal, electric power/natural gas provision, and potable water. Impact fees would still be assessed contingent on the type of dwelling unit that is applied for. The City would still require typical development standards such as connections to City utilities, an improved building pad, paved parking, and would adopt similar design standards for traditional single-family homes and ADUs. The proposed amended regulations would be found in section
17.08.020 of the Municipal Code (see below):

E. Tiny Homes on Wheels. Tiny Homes on Wheels (THoW) may be deployed as a primary dwelling unit or as an Accessory Dwelling Unit (ADU). THoWs used as primary dwelling units are subject to the site development standards in the underlying zoning district. THoWs used as ADUs are subject to those standards contained within 17.30.040 (Accessory Dwelling Units). All THoWs regardless of primary or accessory status are also subject to:
1. Public Utilities. THoWs shall be connected to the City water and sewer systems or on an approved well and/or septic system where City services are not available.
2. Administrative Approval. A proposed THoW must receive administrative approval from the Community Development Department prior to being transported to the project site. Fees for said approval shall be per the adopted fee schedule contained within the Book of Fees and applied proportionally.
3. Maximum Floor Area. The maximum square footage of habitable floor space for a THoW shall be 399 square feet including loft areas (if any).
4. Address. THoWs shall obtain a separate address with issuance of an electrical permit.
5. Qualifying Features. THoWs shall include a bathroom, kitchen, and a sleeping area.
6. Certification. THoWs shall comply with standards set forth in California Health and Safety Code 18027.3 (i.e., ANSI 119.5 and NFPA 1192). A THoW shall be certified by a recognized national certification body as complying with these standards and a certified label shall be placed on the tiny homes on wheels to demonstrate compliance.
7. One Story. THoWs are limited to one story. Lofts up to 48” in height do not constitute a second story.
8. Screened Undercarriage. A THoW’s undercarriage, including wheels, axles, tongue, and hitch, shall be concealed from view from adjacent grade level streets and adjacent residentially zoned properties.
9. Egress. THoWs shall have a minimum of two means of egress, one of which shall be the main entrance 648
and one of which shall be in each sleeping area (may be a window with appropriate dimensions to allow for emergency access).
10. Appearance & Design. THoW shall resemble conventional residential structure rather than a recreational vehicle. This shall be done by incorporating design features and materials typically used for houses (e.g., siding, roofing, pitched roofs, eaves, residential windows, etc.). THoWs shall be mounted on a wheeled trailer chassis and designed and built to look like a conventional residential structure, using conventional building materials, and is thus architecturally distinct from traditional mobile homes and recreational vehicles. See example below:
11. Living Area Extensions. The roof and all exterior walls shall not be fixed with slide-outs, tip-outs, or other forms of mechanically articulating room area extensions.
12. Energy. THoWs shall incorporate an electrical subpanel and connect to the power grid. Building permits will be required.
13. Mechanical Equipment. All mechanical equipment shall be incorporated into the structure other than solar energy panels or collectors.
14. Tie Down. A THoW shall be tied down with anchors or otherwise stabilized as designed by the manufacturer.
15. Porches and Decks. Structures such as porches, decks, sheds, and gazebos shall be designed to detach from the tiny homes on wheels. Uncovered porches or decks less than thirty (30) inches in height and less than two hundred (200) square feet do not require building permits. Permanent roofed structures and other accessory structures shall meet the requirements of Section 17.22.020.
16. Wind Loads. A THoW shall be constructed to withstand minimum wind loads for the proposed parking location.
17. Parking Pad. The wheels shall be skirted or removed and shall sit with leveling or support jacks on a paved durable surface designed in accordance with Title 17 (Zoning) of the WSMC.
18. Parking. THoWs shall not require additional parking when proposed as an ADU.
19. Pedestrian Access. An all-weather surface pedestrian path from the street frontage to the main entrance of the tiny homes on wheels shall be provided.
20. Emergency and Rescue Openings. All THoWs shall have emergency escape and rescue openings sufficient to ensure emergency escape, including a means of escape, if not an exterior passage door, from each sleeping space that provides an opening of sufficient size to permit the unobstructed passage, with its major axis parallel to the plane of the opening and horizontal at all times, of an ellipsoid generated 649 by rotating about the minor axis an ellipse having a major axis of 24 in. (610 mm) and a minor axis of 17 in. (432 mm).
17.51.020 Definitions
Tiny Home on Wheels. A vehicle intended for human habitation as a dwelling unit that is built on a chassis and complies with National Highway Traffic Safety Administration regulations (Federal Motor Vehicle Safety Standards - Title 49 of the Code of Federal Regulations). They must also comply with the National Fire Protection Association 1192 RV Standard as may be amended. Tiny Homes on Wheels are typically less than 399 square feet of floor area.
Trailer. A vehicle with or without motor power, which is designed or used for hauling materials or vehicles, or for human habitation, office, or storage including camper, recreational vehicle, travel trailer, and mobile home, but excluding mobile homes on a permanent foundation and Tiny Homes on Wheels when used as a primary dwelling unit and/or accessory dwelling unit.
Administrative Approval
THoWs shall be required to undergo administrative approval to demonstrate compliance with the standards described in the supplemental regulations, and is subject to applicable fees and charges, and shall be reviewed by the Planning Division and approved by Community Development Director or their designee.
Environmental Considerations
The project is considered exempt from CEQA pursuant to Section §15305 (a) Minor Alteration to Land Use Limitations because the project consists of adding a new allowable residential housing type in zones that already permit residential uses by right. This is considered a minor land use change.
Strategic Plan Integration
This proposed code updates advance the 2023 Policy Agenda strategic principal Housing & Homelessness:
provide housing options for everyone and services for the most vulnerable members of society.
Alternatives
The City Council’s primary alternatives to the recommended action are summarized below.
1. Conduct the public hearing and recommend denial for reasons provided by the Council.
2. Continue the item to a future date and request additional information be provided at that time.
Alternative 1 is not recommended given Council’s direction. Staff is prepared to effectuate Alternative 2 at the Council’s direction.
Coordination and Review
The project was coordinated with staff from the City Attorney’s Office, Community Development Department, and the Economic Development & Housing Department.
Budget/Cost Impact
There is minimal budget impact associated with the recommended actions. Costs associated with the administrative approval of the Tiny Homes on Wheels will be included in the book of fees.

SUBJECT:
PUBLIC HEARING AND CONSIDERATION OF FIRST READING OF ORDINANCE 25-6 REGARDING AMENDMENTS TO TITLE 17 (ZONING) OF THE MUNICIPAL CODE TO
ENHANCE PUBLIC NOTICING, AWARENESS AND PARTICIPATION IN THE REVIEW OF
LARGE DEVELOPMENT PROJECTS
INITIATED OR REQUESTED BY: REPORT COORDINATED OR PREPARED BY:

ATTACHMENT [X] Yes [ ] No [ ] Information [ ] Direction [X] Action
OBJECTIVE
This item is a public hearing regarding proposed amendments to Chapter 17.35 of the Municipal Code to promote greater public awareness and involvement in the review of large development projects through enhanced noticing, accessibility, and participation procedures.
RECOMMENDED ACTION
Staff respectfully recommends that the City Council:
1. Conduct the public hearing regarding the proposed amendments to Chapter 17.35 of the Municipal Code to establish enhanced procedures for the review of large development projects;
2. Find that the proposed ordinance is exempt from the California Environmental Quality Act (CEQA) under Section 15061(b)(3) of the CEQA Guidelines as there is no possibility the activity may have a significant effect on the environment; and
3. Conduct the first reading of Ordinance 25-6, by title and number only, amending Chapter 17.35 of the Municipal Code to improve the public review process for large development projects.
BACKGROUND
In recent years, West Sacramento has experienced an increase in applications for large-scale private development projects. Due to their size and potential to significantly affect surrounding neighborhoods and the broader community, these projects benefit from heightened transparency and community engagement.
The City’s existing noticing requirements and procedures were not originally designed with these larger, more impactful projects in mind. In response to community input and the desire to foster a more citizen-friendly public input environment, the City has proposed this ordinance to expand notification boundaries, increase transparency around project materials, and strengthen opportunities for residents to provide input earlier and more meaningfully in the process.
These changes reflect the City Council’s commitment to accessibility, transparency, and inclusive community engagement. The preparation of the proposed Ordinance was the result of City staff collaborating with long-time resident Kimber B. Goddard. The draft ordinance is consistent with provisions negotiated in the Yarbrough settlement agreement and supports the City’s broader goals of equitable and transparent planning practices.
ANALYSIS
The ordinance would add Section 17.35.075 to the Zoning Code to define a new category of projects called “Large Development Projects” and establish enhanced procedures for public noticing and review. Key provisions include:
Expanded Notification Radius: For required public workshops and hearings, notices will be mailed to all property owners within 1/4 mile of the project boundary. Early and Accessible Engagement: Public workshops will be required prior to Planning Commission or City Council action and held in locations close to the project site. Transparency in Materials: Agenda reports and supporting materials must be posted to the City website at least one week in advance. Staff reports over 200 pages must include a table of contents for clarity. 661
Procedural Enhancements: Hearings will be prioritized earlier on the agenda and will feature longer public comment periods (minimum three minutes per speaker) with provisions for extending the meeting past 11:00 p.m. by vote.
Citywide Application: The ordinance applies to all new applications for large development projects, defined as private development involving over 500 residential units and requiring discretionary approval (as defined) from the Planning Commission or City Council.
These enhancements ensure that the public has more time, notice, and opportunities to participate in decisions that affect the future shape of the City.
Environmental Considerations
The proposed ordinance is exempt from CEQA under Section 15061(b)(3) of the CEQA Guidelines. The project involves process improvements only and does not have the potential for a significant impact on the environment.
Strategic Plan Integration
This ordinance advances the City Council’s strategic principles related to Community Engagement and Smart Growth by fostering transparent governance and improving public participation in significant land use decisions.
Alternatives
The City Council’s primary alternatives to the recommended action are summarized below:
The project was coordinated with staff from the City Attorney’s Office and Community Development Department.
Budget/Cost Impact
There is minimal budget impact associated with the recommended actions. Costs associated with the enhanced notification and staff time will be borne by the applicant.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WEST SACRAMENTO AMENDING CHAPTER 17.35 OF THE CITY OF WEST SACRAMENTO MUNICIPAL CODE TO ADD SECTION 17.35.075 RELATED TO
PROCESSING LARGE DEVELOPMENT PROJECT APPLICATIONS
WHEREAS, the City of West Sacramento is, and shall be known as, a respectful and citizen-friendly public input environment; and
WHEREAS, public participation and involvement shall be fostered and encouraged at all levels of City government; and
WHEREAS, consistent with this citizen-friendly, public input environment of accessibility and transparency, specific and focused efforts shall be made by the Planning Commission and City Council to encourage public participation in the process by which large development projects are reviewed; and
WHEREAS, large development projects have, by nature of their size, the potential for greater impacts on the lives of City residents.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST SACRAMENTO DOES ORDAIN AS FOLLOWS:
Section 1. Purpose and Authority. The purpose of this Ordinance is to amend Chapter 17.35 of the City of West Sacramento Municipal Code to promote greater public awareness of, and participation in, the process for reviewing Large Development Projects. The Ordinance is enacted in accordance with the authority granted to cities by State law.
Section 2. Enactment. Section 17.35.075 is hereby added to the City of West Sacramento Municipal Code, to read as follows:
17.35.075 Enhanced Procedures For Large Development Projects A. Applicability. In recognition of the greater potential for impact on residents of the city posed by Large Development Projects, enhancements to the standard processes by which public input is solicited are appropriate. The following process enhancements shall apply to the review of applications filed after the effective date of this Ordinance for Large Development Projects seeking a Discretionary Approval and, to the extent the processes set forth in this Section 17.35.075 conflict with the processes otherwise required by the West Sacramento Municipal Code (including without limitations set forth in Title 16 and Title 17), these processes shall control. Conversely, all provisions of the Municipal Code not in conflict with this Section shall apply to the processing of Large Development Projects.
