Subject: Wildomar Cottages Affordable Housing Project – Staff Review Comments (PA 23-0025):
A proposal by Affirmed Housing to construct a 130-unit multi-family affordable housing project on a 8.98-acre site located at 32650 Mesa Drive (APN: 365-180-004).
Dear Ms. Martinez,
The City of Wildomar has completed its review of your formal SB 35 development application package and fee payment submitted to the City and processed on February 16, 2023 for the project referenced above.
In accordance the criteria of Government Code Section 65913.4 and Article IV of the state Department of Housing and Community Development (HCD) SB 35 Guidelines, and the City of Wildomar SB 35 checklist (Attach A), the City has determined that the proposed 130-unit affordable housing project (known as Wildomar Cottages) meets all the criteria for an SB 35 streamlined ministerial approval process.
Under SB 35, the City has until August 16, 2023 (180 days from formal submittal) to complete the design review and public oversight meeting permitted by subsection (d) of Government Code section 65913.4 and approve this ministerial project. The City is committed to processing this application in an expeditious manner as we do on all our development projects.
The submitted development plans and technical studies were distributed to each city department for review in accordance with all applicable objective criteria outlined in the Wildomar Municipal Code. Based on this review, the City has the following staff review comments that will require revisions to the development plans. Each comment must be addressed, and revisions made to the development plans and technical studies as noted in each section below and the attachment herein.
Planning Department Comments:
The following comments have been prepared based on staff’s review of the proposed application and development plans, including design comments that were not addressed during the SB 330 Pre-Application staff review comment letter. These comments are intended to address staff concerns with the proposed development plans and offer recommendations/changes to improve the quality of the project design and minimize possible impacts to the surrounding residential community of Windsong Valley and North Ranch.
Site Plan/Architectural Design:
1. It is the city’s understanding based on the project description provided that the project will include 128 affordable units and 2 manager units (130 units total). The project will include 13 residential buildings with 36, 2-bedroom units; 63, 3-befroom units; and 31, 4-bedroom units. There is proposed three (3) “amenity buildings” are also included as follows: 1) a centrally located Community Building with community room, 2) property manager offices, and 3) multi-function room, residential kitchen and storage. Additional site amenities include a resident pool with BBQ area as well as two pavilion areas with a play area (one at the north and one at south end of the property). Please confirm this is description is accurate.

Wildomar Cottages Affordable Housing Project (PA 23-0025) Staff Review Comment Letter #1
March 20, 2023
2. The project description did not include a breakdown of the unit count and floor plan count similar to that described on the project development plans so please revise the project description narrative to include this information. I also did not see the affordability breakdown by units in either the project description narrative or development plans. Please provide this information so we can compare with the city’s 2021/2029 Housing Element.
3. Please be aware that any modification to the project after it is approved may be considered in compliance with Government Code section 65913.4(g).
4. Please change to the date on Page 1 of the development plans to February 16, 2023 as this is date the formal application and fee payment were made. The plans show February 6, 2023.
5. Provide the Plot Plan No. 23-0025 on all the development plan sheets and grading plan sheets within the title box or somewhere easily readable.
Density Bonus/Waivers/Concessions:
6. According to the SB 35 application, Affirmed Housing is requesting a density bonus of 80% in accordance with Government Code Section 65915. Given the General Plan land use designation for the 8.98-acre site is Medium High Density Residential (MHDR) which allows for a density range of 5- 8 dwelling units per acre. Given the site size the density bonus request is to add an additional 58 units bringing the total to 130 units (128 affordable).
7. According to the SB 35 application, Affirmed Housing is requesting an deviation from the City’s parking standards outlined in Section 17.188 of the WMC which based on the project description requires 337 parking spaces. Per Government Code Section 65915, the Applicant is requesting a reduction in the required parking spaces to provide only 242 spaces. While staff does not support a deviation from this parking standard as it could impact surrounding streets and neighborhoods, state law allows this parking waiver, and the City cannot deny this request.
8. As allowed under SB 35 provisions, the proposed density bonus, and parking incentive is allowed to be presented to the City Council at a public meeting in conjunction with the “public oversight” meeting permitted by SB 35. Staff has not yet determined a date for this meeting, but the City Council will serve as the “oversight body” for this project. We are asking that you be prepared to make a formal presentation to our City Council and community as part of this public oversight meeting, so City Council and the community have a good understating of the proposed project and the reasoning behind the proposed density bonus and concessions being requested.
Public Works/Engineering Department:
The Public Works department has completed its review of the development plans and technical studies.
Please refer to the comment memorandum and redline plans noted in Attachment A. Please make the requested changes to the plans and studies with your 2nd submittal. If you have any questions, please contact Emily Stadnik, Land Development Manager at (951) 265-6583, or via email at [email protected].

While staff does not support a deviation from this parking standard as it could impact surrounding streets and neighborhoods, state law allows this parking waiver, and the City cannot deny this request.
Response: This is correct, no response required.
8. As allowed under SB 35 provisions, the proposed density bonus, and parking incentive is allowed to be presented to the City Council at a public meeting in conjunction with the “public oversight” meeting permitted by SB 35. UACTIONS REQUESTED
Wildomar Family Housing, L.P. (“the Applicant”) requests the following approvals to allow for the construction of new 100% affordable housing project consisting of 13 residential buildings with 130 residential units with approximately 140,138 square feet of gross floor area (the “Project”). The Project is proposed under the provisions of Government Code Sec. 65650 et seq. The Project also requests a density bonus of 80% per Government Code Sec. 65915.e.3.
1) Pursuant to Government Code Section 65913.4 (Senate Bill 35) a. Project is a Streamlined Infill Project that satisfies all of the objective zoning standards set forth in Government Code Section 65913.4(a) and is therefore subject to the Streamlined Ministerial Approval Process;
2) Authorizing Code Section: Pursuant to Government Code Section 65913.4 a. Action Requested, Narrative: Ministerial review of the State Density Bonus/Affordable Housing Incentives Program pursuant to CA Government Code Sec. 65915 and SB-35 (CA Government Code Section 65913.4) for a Housing Development Project totaling 130 dwelling units, reserving 128 units for Low Income Household occupancy for a period of 55 years (the two additional units are Managers units).
b. Pursuant to California Government Code Section 65915 (State Density Bonus) i. Incentive: The Applicant is requesting a reduction in the required parking spaces.
Note: This project was designed under existing laws at the time which have since been updated as of January 1, 2023. AB 2334 in particular extends incentives for 100% affordable housing projects that are within ½ mile of a Major Transit Stop as defined by State Law. The Project Site is not located within ½ mile of a Major Transit Stop and therefore was not previously eligible for additional incentives. Under AB 2334, those incentives now apply to projects located in Very Low Vehicle Travel Areas within designated Counties. The Project Site is located in Riverside County which is a designated county and also appears to be in a low Vehicle Miles Traveled (VMT) area. This would qualify the Project Site for the following automatic incentives:
1. No maximum controls on density
2. 33 ft. (3 stories) increase in height
3. No minimum parking requirement
4. Four additional waivers of development standards

Attachment A: Actions Requested, Project Description, and Evidence of Compliance with Objective Standards February 14, 2023 2 of 6 Prepared by: Irvine & Associates, Inc.
UPROJECT DESCRIPTION
The Applicant proposes to construct an approximately 140,138 gross square foot building area containing 128 affordable units with 2 manager’s units within 13 residential structures. Vehicle parking would be consistent with the City of Wildomar Municipal Code (WMC) Section 17.188.030 and the Applicant will request parking incentive to provide 242 spaces in lieu of the 337 required spaces provided as surface parking. Vehicle access (ingress/egress) would be provided from one entrance/exit along Mesa Boulevard, at the front property line. Three Amenity buildings are included - a centrally located Community Building with community room, property manager offices, multi-function room, residential kitchen and storage. Additional site amenities include a resident pool with BBQ area as well as two pavilion areas with a play area, one at the north and one at south end of the property.
Project Location and Zoning
Project Site, as seen on Google Maps
The Project Site is located at 32650 Mesa Drive, within the City of Wildomar and is comprised of one tax parcel (APN: 365-180-004) and one lot (Lot: 04) (“Project Site”). The Project Site is zoned RR (Rural Residential) and maintains a General Plan Land Use designation of Medium High Density Residential. The subject property is also located in Council District 1. Attachment A: Actions Requested, Project Description, and Evidence of Compliance with Objective Standards February 14, 2023 3 of 6 Prepared by: Irvine & Associates, Inc.
Lot Area
The Project Site maintains a lot area of approximately 8.98 acres. The City of Wildomar Municipal Code (WMC) Section 17.16.020 requires a minimum lot size of one-half acre with an average width average width of 80 feet.
U
Floor Area/ Height
The Project Site is subject to the requirements of the City of Wildomar Municipal Code Section 17.16.020.
This code section does not provide a limitation on Floor Area but does restrict height to not exceed 50 feet.
Government Code Section 65915 provides that housing projects comprised of one hundred percent lower income units (exclusive of a manager’s unit or units) shall receive additional height increase of 33 feet or 3 additional stories if they are located within ½ mile of a major transit stop or located in a low VMT area within a designated County. The Project Site is located in Riverside County which is a designated County and is located in a low VMT area. Regardless, the maximum proposed height is 45 feet for the community building with most of the residential buildings achieving a maximum height of 36 feet. U Density
The Project Site maintains a Lot Area of approximately 8.891 acres and a zoning designation of RR, which does not have a maximum Density. The General Plan Designation of Medium High Density Residential which permits a density of 5-8 dwelling units per acre. Therefore, a base density of 72 residential units is permitted on the Project Site (rounded up consistent with State Density Bonus Law). The Applicant proposes to provide 130 affordable housing units (including two manager’s units) and is located in a low VMT area within a designated County. Accordingly, pursuant to California Government Code Section 65915, the Project does not any maximum controls on density. Nevertheless, the requested increase in density is equivalent to 80% which is consistent with CA Government Code Section 65915 for Projects that do not meet this threshold for relief from density controls.
Setbacks
Pursuant to WMC section 17.10.020, the Project is required to maintain a front yard setback of not less than 20 feet and a side yard setback of 10 feet.
Open Space
The Applicant would be required to provide 52,000 square feet (400 SF per dwelling unit) of open space pursuant to Wildomar Multifamily Design Standards F.4.1. As currently designed, the Applicant would provide 133,690 square feet of Open space within amenities such as a centrally located 3,705 square-foot community building (with community room), property manager offices, multi-function recreation room, community kitchen and storage.

Parking
Pursuant to Wildomar Municipal Code 17.188, the Applicant will be required to provide 337 spaces for the mix of units that consist of two-, three- and four-bedroom units. However, the Applicant is requesting a parking incentive to reduce the required parking and provide 242 spaces in lieu of the 337 spaces. 972

I. DENSITY BONUS/AFFORDABLE HOUSING INCENTIVES COMPLIANCE FINDINGS
1. That the Pursuant to Government Code Section 65915, the local agency shall approve a density bonus and requested incentive(s) unless the director finds that:
a. The incentives are not required to provide for affordable housing costs as defined in California Health and Safety Code Section 50052. 5 or Section 50053 for rents for the affordable units.
There is not substantial evidence to make a finding that the requested incentives do not result in identifiable and actual cost reduction to provide for affordable housing costs per State Law. The California Health & Safety Code Sections 50052.5 and 50053 define formulas for calculating affordable housing costs for Very Low, Low, and ModerateIncome households. Section 50052.5 addresses owner-occupied housing and Section 50053 addresses rental households. Affordable housing costs are a calculation of residential rent or ownership pricing not to exceed 25 percent gross income based on area median income thresholds dependent on affordability levels.
Parking: The Applicant proposes 242 parking spaces in lieu of the 337 parking spaces required per Wildomar Municipal Code 17.188.030. The request to reduce the required parking spaces allows the development to be built in a design to accommodate the additional density bonus units. The development is not a single building but thirteen individual residential structures that will house 128 affordable housing units with 2 manager’s units. In order to maximize the Project Site for the residential units and also the community amenities, the applicant is requesting the reduction in the required parking.
The requested incentives allow the developer to expand the buildings so the additional and affordable units can be constructed, provide for design efficiencies, and allow the overall space dedicated to residential uses to be increased. These incentives support the applicant’s decision to set aside the specified number of dwelling units for Very Low and Low-Income Households for 55 years.
b. The Incentive will have specific adverse impact upon public health and safety or the physical environment, or on any real property that is listed in the California Register of Historical Resources and for which there is no feasible method to satisfactorily mitigate or avoid the specific adverse Impact without rendering the development unaffordable to Very Low, Low and Moderate Income households.
Inconsistency with the zoning ordinance or the general plan land use designation shall not constitute a specific, adverse impact upon the public health or safety. 973
32650 Mesa Drive, Wildomar, CA, 92530
Attachment A: Actions Requested, Project Description, and Evidence of Compliance with Objective Standards February 14, 2023 6 of 6 Prepared by: Irvine & Associates, Inc.
There is no substantial evidence in the record that the proposed incentive(s) will have a specific adverse impact. A "specific adverse impact" is defined as, "a significant, quantifiable, direct and unavoidable impact, based on objective, identified written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete" As required by Government Code Section 65916, the project meets the eligibility criterion that is required for density bonus projects.
Therefore, there is no substantial evidence that the proposed incentive(s) will have a specific adverse impact on public health and safety.
c. The incentive(s) are contrary to state or federal law.
There is no evidence that the proposed incentives are contrary to state or federal law. 974

SB 35 HOUSING SUMMARY BULLETIN

City of Wildomar Page 1 January 2021
WHAT ARE THE ALLOWANCES UNDER THE
HOUSING ACCOUNTABILITY AND
AFFORDABILITY ACT (SB 35)
City of Wildomar – Planning Department
California Senate Bill 35 (SB 35), the Housing
Accountability and Affordability Act, was signed by
Governor Jerry Brown on September 29, 2017 and
became effective January 1, 2018. This Information
Bulletin outlines the streamlined ministerial permit
processing allowances provided under this act.
I. BACKGROUND
Under state housing law, the State Department of
Housing and Community Development (HCD)
assigns each jurisdiction housing production goals
for different income categories; this is referred to as the Regional Housing Needs Allocation (RHNA)
goals.
Every year cities and counties are required to report
to HCD their housing production (by income
category) according to the number of building permits
issued within the jurisdiction. If HCD finds that a
jurisdiction’s RHNA goals are not being satisfied, SB
35 requires cities and counties to streamline the
review and approval process of certain affordable
housing projects.
II. STREAMLINED MINISTERIAL APPROVAL
SB 35 requires cities and counties to streamline
review and approval of eligible affordable housing
projects by providing a ministerial approval process,
exempting such projects from environmental review
under the California Environmental Quality Act
(“CEQA”).
This process does not allow public hearings; only
design review or public oversight is allowed, which
must be objective and strictly focused on assessing
compliance with criteria required for streamlined
projects as well as objective design review of the
project.
Depending upon the number of housing units
proposed in the project, the City has a short
timeframe to review the application to determine if it
is eligible for processing under SB 35. If it is
determined that the project is eligible, SB 35
specifies the timeframes within which the City has to
make a final decision on the application. These
timeframes are discussed in more in this bulletin.
III. ELIGIBILITY CRITERIA
Development projects are eligible for the streamlined,
ministerial approval process under SB 35 if they meet
all of the following criteria:
• Minimum Affordable Units:
At least 50 percent of the total proposed units must
be restricted for low or very low income housing for
a period of no less than 55 years.
• Urban Infill:
The subject property must be located in an urban
area (services readily available), with 75% of the
site's perimeter already developed.
• Minimum Units:
At least two residential units must be proposed.
• Designated Residential Use:
The City’s current general plan and zoning
designation must allow residential or residential
mixed-use with at least two-thirds of the proposed
development square footage designated for
residential use.
• Location:
The development cannot be located on property
within any of the following areas:
o Very or very high fire hazard severity zone
o Delineated earthquake fault zone
o Habitat for protected species or wetlands
o Under a conservation easement
o Flood plain/floodway
o Hazardous waste site
o Farmland (prime/statewide significance)
• Demolition of Existing Residential Units:
Development cannot demolish any existing
housing units that meet one of the following:
o Occupied by tenants in the last 10 years;
o Subject to any form of rent or price control; or,
o Subject to a local law that restricts rents to
levels affordable to persons and families of
moderate, low, or very low incomes.
983
City of Wildomar Page 2 January 2021
• Historic Buildings:
Development cannot demolish a historic structure
that is currently listed on a national, state, or local historic register at the time of application submittal. • Consistent with Objective Planning Standards:
Must meet all objective general plan, zoning and
design review standards in effect at the time the
application is submitted, with the exception of
Density Bonus (see Section VIII).
Note: SB 35 defines objective standards as those
standards that involve no personal or subjective
judgment by a public official and are uniformly
verifiable by reference to an external and uniform
benchmark or criterion available and knowable by
both the development applicant or proponent and the
public official prior to submittal.
• Prevailing Wages:
All construction workers employed in the execution
of the development must be paid at least the general
prevailing rate of per diem wages for the type of work
and geographic area. Public work projects as
defined in Government Code Section
65913.4(a)(8)(A), are exempt.
• Skilled and Trained Workforce Provisions:
A skilled and trained workforce, as defined in
Government Code Section 65913.4(a)(8)(B)iii, must
complete the development if the project consists of
75 or more units that are not 100 percent subsidized
affordable housing.
• Subdivisions:
Does not involve a subdivision, unless the
development either:
o Receives a low-income housing tax credit and is
subject to the requirement that prevailing wages
be paid; or,
o Subject to requirements to pay prevailing wages
and use a skilled/trained workforce.
• Parking:
The project must provide at least one parking space
per unit; however, no parking may be required under
the following:
o The project is located within:
one half mile of a public transit stop;
Architecturally or historically significant
historic district; or,
one block of a car-share station; or,
o On-street parking permits are required, but not
offered to the development occupants.
IV. APPROVAL TIMELINE
Projects that elect to take advantage of this process
must submit an application specifically requesting SB
35 processing. The City must determine whether the
project is eligible for streamlining within 60 days of
application submittal for projects with 150 or fewer
units, and 90 days for projects with more than 150
units.
Thereafter, project design review and consideration of
any information requested of the applicant for
ministerial review must be completed with a final
approval in 90 days from project application submittal
for projects with 150 or fewer units and 180 days from
project submittal for projects with more than 150 units.
V. PUBLIC HEARING REQUIREMENTS
SB 35 projects are ministerial, which do not require
public hearings. SB 35 allows “design review or public
oversight” to occur if a city so chooses. This process
may be conducted by the Planning Commission or
equivalent board or commission responsible for
review and approval of development projects, or the
City Council.
Design review or public oversight must be objective
and strictly focused on assessing compliance with
criteria required for streamlined projects, as well as
any reasonable objective design standards that were
in effect before the application was submitted. This
process may not in any way “inhibit, chill, or preclude the ministerial approval” allowed by SB 35.
VI. ENVIRONMENTAL/IMPACT REVIEW
SB 35 projects are considered ministerial and
therefore not subject to CEQA. As such, the city
cannot require applicants to prepare any studies that
would be required under CEQA (i.e., traffic, air quality, noise).
The City can only require an applicant to abide by
objective planning standards that were in effect at the time the SB 35 application was submitted. If an
objective planning standard requires certain studies
to be performed and there are objective standards to
address the preparation and results of those studies,
then the applicant would be required to prepare and
implement those requirements.
984
City of Wildomar Page 3 January 2021
VII. APPROVAL EXPIRATION
The expiration dates for projects approved under SB
35 are as follows:
• Projects will not expire where 50% of the units
are affordable to households making below
80% of the area median income (below
moderate income levels).
• Projects that do not include housing noted in
the bullet above automatically expire after three
years.
• Projects shall remain valid for three years and
shall remain in effect as long as vertical
construction has begun and is in progress. A
one-year extension to the original three year
period may be granted if making progress
toward construction.
VIII. SB 35 AND DENSITY BONUS
SB 35 projects can utilize all of the benefits offered
under the State Density Bonus Law, which includes
density bonus and the granting of concessions,
incentives and waivers of development standards to
housing developments.

CITY OF WILDOMAR
CC - REGULAR MEETING
GENERAL BUSINESS
Agenda Staff Report # 3.4
Meeting Date: May 10, 2023
SUBJECT: Consideration of Sponsorship, Advertising, and Website Linking Policy
SUBMITTED BY: Thomas D Jex
PREPARED BY: Thomas D Jex
ACTION:
Staff recommends that the City Council repeal the current Website Linking Policy adopted in May of 2014 and adopt the new Sponsorship, Advertising, and Website Link Policy.
SUMMARY:
In May of 2014, the City Council adopted a Website Linking Policy. The purpose of this policy was to outline when and how an external link may be placed on the City’s website to provide non-political, non-religious, factual information about the City of Wildomar, including services and resources available in the City and surrounding community. The City is seeking to expand on this initial policy, to accommodate sponsorships of City events and advertising on City property.
DISCUSSION:
Community sponsorships and advertisements can be an effective means of informing the community of available services and upcoming events and building community partnerships.
Advertisers and sponsors will provide an opportunity to develop partnerships with entities and individuals that share the City’s commitment to providing high quality public services and potentially enhance the delivery of City services. The proposed policy is intended to provide guidance on the following:
- Sponsorship of City events;
995
- Advertisements to be displayed on City property, including, but not limited to, designated space on or within City buildings or facilities, and banners hung across City streets; and
- Advertisements and website linking on the City’s webpage.
The intent of this policy is to provide the City maximum control to choose the individuals and entities who may seek to sponsor or advertise with the City, and maximum control over the content of those sponsorships and advertisements, without running afoul the First Amendment.
Eligible sponsors and advertisers will include (but not be limited to):
1. Governmental or public educational institutions;
2. Nonprofit organizations that perform services for the welfare of the Wildomar community;
3. Organizations that are providing services to or partnering with the City to meet the City’s strategic or operational goals;
4. Professional associations affiliated with local government;
5. Private or public utilities that service City residents or businesses; and
6. Commercial or non-profits that have a distinct project-specific relationship with the City.
Nothing in the proposed policy requires the City to accept an advertisement, sponsorship, or website link from any individual or entity. Further, nothing in this policy converts City property or events organized by the City into public forums of general speech and/or public expression.
The City will retain maximum control over its website and public spaces.
FISCAL IMPACT:
None.

POLICY May 2023
I. PURPOSE

3. Containing religious messages or advocating or promoting religious beliefs;

Violating any of the City’s equal opportunity policies; and, Nothing in this policy shall be interpreted as requiring the City to accept an advertisement or sponsorship from any individual or entity, even if that individual or entity satisfies the above listed criteria. Nothing in this policy or the associated procedures is intended to convert City property or events organized by the City into public forums of general speech and/or public expression, except as provided by law. To the extent any City property, event, website, project, or program is designed for a specific purpose or public message, such event, website, project, or program shall remain a non-public forum subject to the City’s exclusive use and control.
III. SPONSORSHIP OF A CITY EVENT
In order to introduce and raise awareness concerning organizations that share the City’s vision and goals, and/or to promote events within the community, the City may choose to accept sponsors for City events. Organizations that choose to sponsor a City event may provide some form of consideration to the City for the City event, including, but not limited to financial assistance, food and beverages, the use of a facility or room, or some other good or service that benefits the City and/or City event attendees. The sponsor may request that its name be listed on notices issued by the City regarding the event.
The sponsor may request to post an advertisement or acknowledgement of the sponsorship at the City event, or make a brief presentation during the event concerning the sponsor’s organization, the sponsor’s services within the community, or concerning an upcoming event within the community being organized by the sponsor.
Sponsors shall be selected by the Mayor or City Manager and shall satisfy the eligibility criteria set forth herein. If the sponsor requests to make a brief presentation at the event, not less than ten (10) days prior to the event, the sponsor shall provide the Mayor or City Manager with a copy of the talking points for the sponsor’s presentation at the event. The Mayor or City Manager shall have an opportunity to approve and provide input on the sponsor’s presentation talking points. Nothing herein shall be interpreted as requiring the City to permit a sponsor to make a presentation at any City event.
The City of Wildomar reserves the right to:
1. Discontinue the sponsorship program at any time;
2. Cancel a specific sponsorship at any time prior to the City event;
3. Revise this policy without prior notice when to do so is deemed to be in the best interests of the City of Wildomar.

2. Flyers placed within or on other City buildings or facilities, as designated by the City Manager; and
3. City owned LED signs
4. Banners across City streets.
No advertisement shall be placed in any of the above locations without authorization from the City Manager. The City reserves the right to request reimbursement from individuals or entities that seek to advertise on City property for any costs incurred by the City related to the posting, placement, or maintenance of such advertisements.
As to the placement of a banner across a City street, the City Manager, in his or her sole and complete discretion, may determine which City street to authorize the placement of such a banner. The City reserves the right to require an advertiser to enter into a use agreement, as approved by the City Attorney, that includes terms and provisions related to the placement of such a banner, provides for the reimbursement of costs to the City, and requires the advertiser to indemnify the City, prior to the placement of any banner across a City street.
Removal of Content
The City of Wildomar reserves the right to:
1. Remove any advertisement that does not comply with the City's policy;
2. Discontinue the use of any designated space for advertisements; and
3. Revise this policy without prior notice when to do so is deemed to be in the best interests of the City of Wildomar.
V. ADVERTISEMENTS AND WEBSITE LINKING ON THE CITY’S WEBPAGE The City of Wildomar created its official website as a public service to provide information about City services, officials and attractions. The website is a supplement to, and not a replacement for, information available from City offices. The City reserves the right to determine what information will and will not be placed on the website, including what links to external websites the City will and will not post to the website.
The purpose of the City of Wildomar website is to provide accurate, non-partisan content that will inform City residents, businesses, visitors and other users about City services, operations and projects. Every request to have the City post an external link on the City’s website must undergo review to determine the link’s relevance and appropriateness to the City’s website in the accordance with the eligibility criteria specified in this policy. The City Manager will review the merits of the requested link, keeping in mind the criteria and examples listed herein, to determine whether the link serves the overall purpose of the City’s website. A request will not be denied because of a viewpoint espoused by the external website so long as it meets the criteria herein.
Location and Appearance of Links
The City reserves the right to determine how and where external links will appear on its website.
Removal of Content
The City of Wildomar reserves the right to:
1. Remove any external link if the nature of the organization or business to which the link relates no longer complies with the City's external link policy;
2. Discontinue any and all external links at any time with or without notice at the City’s sole and complete discretion; and
3. Revise this policy without prior notice when to do so is deemed to be in the best interests of the City of Wildomar.
Private Commercial Sites
The City may choose to provide external links to certain private commercial sites that maintain and display information which provide a public or community service, or other information to aid the public, which is not generally available through a governmental agency. Links to such sites may be included within the City website when the City Manager has made a good faith determination that:
1. The City’s independent replication of the information targeted for linkage is infeasible due to financial or other considerations;
2. No non-commercial site provides the information targeted for linkage; and
3. The information targeted for linkage greatly enhances the usefulness of the City website and services it provides.
2 For purposes of this policy, an “external link” is a hyperlink from the City’s website to an external website maintained by another party.
