Agenda Staff Report # 1.12
Meeting Date: June 14, 2023
SUBJECT: Joint Park Use License Agreement with The Farm Property Owners Association
SUBMITTED BY: Daniel Torres
PREPARED BY: Daniel Torres
ACTION:
Authorize the City Manager to sign the License Agreement SUMMARY:
The City has reached out to residential HOA communities to presented Tier IV events in HOA and POA managed parks.
BACKGROUND:
The City had developed, expanded, and partnered to present Community and Special Events with the objective to foster unity among residents, an alternative location that would promote physical and mental health, and allow for in-person interactions with City Council members and staff personnel. The City had been successful to engage residents by conducting Tier IV events such as Astronomy Night, Movie in the Park, and Popsicles in the Park which attract 50 – 150 attendees. Events held at Windsong Park, located in the Windsong housing tract are highly participated and extremely successful for City representatives to interact and establish a positive rapport within the residential community.
DISCUSSION:
To expand on this success, the City had reached out to multiple residential communities inquiring if they were interested in a partnership that will generate synergy between the City of Wildomar and the residential neighborhood. As part of the objective in conducting these events, the City will go to the resident rather than having the resident drive to another neighboring location. This would enable the residents to enjoy a walk to their HOA/POA managed park and immediately participate in a community event. The City personnel reached out to communities that have the infrastructure to hold an event, communities that are located on the east side of the 15 freeway, and communities that are at least a mile away from Marna O’Brien. Presenting Tier IV events to these potential locations and city owned parks would 267
assist in controlling the capacities per event.
Understanding that these communities have infrastructure that is owned and maintained by the HOA/POA and that the City will be utilizing them presented a level of risk. The City’s legal counsel and risk management provider developed a Joint Park Use License Agreement as a key component to present these events successfully and cautiously. The Use License state terms, procedures, insurance, and mutual indemnity. The HOA/POA will determine the licensed premises. The HOA/POA board and City would determine a reasonable term of year(s) of the use of the licensed premises. The City will provide the HOA/POA Manager: 10 business days’ notice prior to conducting an event, notice of cancellations, entry/exit of premises, and any injuries or damages during the event. Both parties agreed upon mutual indemnification from any losses, and or damages.
Staff had contacted The Farm Property Owners Association’s manager to present the possibility of conducting tier IV events within their community. The board was receptive and provided positive feedback. The City provided the board the Joint Park Use License for review and approval. Advertisement for events at the licensed premises will be handled internally by the The Farm.
FISCAL IMPACT:
Expensed related to these events would range from $900.00 - $1,500.00 which include onsite EMT, Environmental Health Permit, and the cost of the activity provided.

SUBJECT: Levy and Collection of Special Taxes within Community Facilities District No. 2022-1 (Services) for Fiscal Year 2023- 24 SUBMITTED BY: Jason Farag
PREPARED BY: Jason Farag
ACTION:
Adopt a Resolution entitled:
RESOLUTION NO. 2023 - _____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WILDOMAR, CALIFORNIA,
ORDERING THE LEVY AND COLLECTION OF SPECIAL TAXES WITHIN COMMUNITY FACILITIES DISTRICT NO. 2022-1 (SERVICES) FOR FISCAL YEAR 2023-24 SUMMARY:
Annually, the City determines the amount of the special tax for CFD 2022-1 (Services) that should be charged to cover service expenses consistent with the rate and method of apportionment approved by the City Council at the time the CFD was formed.
BACKGROUND:
The State legislature enacted the Mello-Roos Act in 1982 to assist public agencies in financing certain public improvements by creating Community Facilities Districts (CFDs) and either issuing tax exempt securities that are repaid by annual levy of special taxes within the CFD, or to provide for the financing of on-going public services through a special tax levied on parcels within the CFD.
In 2022, the City established CFD No. 2022-1. Three special taxes (Special Tax A, Special Tax B, and Special Tax C) are levied on properties within the CFD to fund the maintenance of certain improvements and to fund public safety services. The improvements maintained by the CFD that are funded by Special Tax A include items such as landscaping, streetlighting, street maintenance, drainage, parks and trail, and graffiti abatement. Also, Special Tax B of the CFD 299
finances certain public safety services to meet the increased demands new development places on police and fire protection services for all residential developments. In addition, Special Tax C is a Contingent Tax only if the POA is unable to maintain the contingent services. The three tax rates are proposed to escalate each year. Special Tax A will escalate at the greater of Consumer Price Index (CPI) or 2%, not to exceed 6%. Special Tax B will escalate at the greater of Consumer Price Index (CPI) or 5%, not to exceed 6%. Special Tax C (Contingent) will escalate at the greater of Consumer Price Index (CPI) or 2%, not to exceed 6%.
DISCUSSION:
Annually, the City Council determines the amount of the special tax for CFD 2022-1 (Services) that should be charged to cover service expenses within the district zones consistent with the rate and method of apportionment approved by the City Council at the time the CFD was formed.
Exhibit A to the attached Resolution includes the preliminary levy rolls for CFD 2022-1 for FY 2023-24.
FISCAL IMPACT:
Community Facilities District No. 2022-1 (Services) will generate a maximum special tax of $88,747.39 in Special Tax A and $99,141.00 in Special Tax B for Fiscal Year 2023-24.
Expenses for the Fiscal Year 2023-24 for Zone(s) Original - 2 cannot be estimated at this time because not all certificates of occupancy and acceptance of the facilities have not occurred at this time. Contract amendment(s) to city maintenance contractor(s) will be presented to City Council and the CFD 2022-1 (Services) amounts will be encumbered at the time the services are deemed and rendered.

BACKGROUND:

The Fiscal Year (FY) 2023-24 budgets for each CFD are comprised of collection for principal and interest payments, construction of future facilities, administrative costs, and/or service costs.
The table in Attachment A shows the annual levy amount needed for each district to cover district obligations for FY 2023-24. The assessment roll for FY 2023-24 is included as Attachment B.

Meeting Date: June 14, 2023
SUBJECT: Seventh Amendment to Design Professional Services Agreement with Parsons Transportation Group for the Bundy Canyon Road Project
SUBMITTED BY: Jason Farag
PREPARED BY: Jason Farag
ACTION:
1. Authorize the City Manager to execute the Seventh Amendment to the Design Professional Services Agreement with Parsons Transportation Group, Inc. for Engineering Services for the Bundy Canyon Road Improvement Project.
2. Appropriate an additional $146,000 in TUMF funding to the Project budget, to accommodate the Seventh Amendment.
SUMMARY:
The City previously entered into a contract with Parsons Transportation Group (Parsons) to provide design and construction engineering support services for the Bundy Canyon Road Improvement Project (Project). In 2022, the City Council approved a proposal from Parsons to provide the City with additional Construction Management and Inspection services to assist with the completion of the construction of Segment 1 of the Project. Parsons has provided these services, as requested, but their costs have exceeded the amended budget due to the extended duration of construction. This new proposal amends the budget to account for the additional time not previously anticipated and also accounts for the remaining time needed to close-out the project.
BACKGROUND:
The City and Parsons entered into a Professional Services Agreement (Agreement) on September 10, 2014 to prepare construction and environmental documents for the Improvement of Bundy Canyon Road from Cherry Street to the eastern City limits (Project).
Previous amendments to the Agreement have been approved by the City Council to provide required additional services necessary to construct Segment 1 of the Project from Cherry 317
Street to 1200 feet east of Oak Canyon Drive, to prepare plan revisions and updates to accommodate an SB 821 Grant to provide sidewalk and bike lanes, and to provide some design and environmental services for Segment 2 of the Project from Oak Canyon Drive to The Farm Road. The original contract amount and subsequent amendments resulted in a total contract amount of $1,376,263.71.
DISCUSSION:
The Construction Management Staff Augmentation proposal and budget included in the Fifth Amendment was based on the assumption that the Segment 1 Project construction would be complete in October 2022, with a few months of project close-out support afterwards. Since the Segment 1 Project construction period extended, with the majority of construction complete in May 2023, there was additional Construction Management time spent on the Segment 1 Project, beyond what was originally approved in the Fifth Amendment. This additional tie was necessary to assist with the oversight and completion of construction. As a result, an amendment is necessary to increase the Construction Management Staff Augmentation budget.
Exhibit 'A' to the Seventh Amendment shows an additional scope cost of $145,526.32 for the Construction Management Staff Augmentation services. This added scope cost brings the contract total to $1,521,790.03. A copy of the Seventh Amendment is included in Attachment A.
Staff recommends that the City Council authorize the City Manager to execute the Seventh Amendment to the Design Professional Services Agreement with Parsons Transportation Group, Inc. for Engineering Services for the Bundy Canyon Road Improvement Project and appropriate an additional $146,000 in TUMF funding to the budget for CIP 026-1.
FISCAL IMPACT:
The additional construction management services associated with the Seventh Amendment are eligible TUMF expenses. Staff is requesting a budget amendment to increase the TUMF funding for CIP 026-1 by $146,000.

The City of Wildomar hosts its annual Trunk or Treat event during the last week of October. In October 2020, the City held a drive-in laser show and held it regular trunk or treats events during 2021 and 2022. With the Fall Family Fun Fair typically held the week before the City Trunk or Treat event, attendees have seen a duplication of vendors and businesses. Agenda Staff Report # 1.19
Meeting Date: June 14, 2023
SUBJECT: Updates to Position Classification Descriptions, Revising Position Classification Schedule, and Adopting a New Pay Plan
SUBMITTED BY: Heidi Schrader
PREPARED BY: Heidi Schrader
ACTION:
Adopt a Resolution entitled:
RESOLUTION NO. 2023 - ____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WILDOMAR, CALIFORNIA, ADDING TWELVE (12) POSITION CLASSIFICATION DESCRIPTIONS; REVISING FOUR (4) POSTION CLASSIFICATION DESCRIPTIONS; ADOPTING A NEW PAY PLAN; AND REVISING THE POSITION CLASSIFICATION SCHEDULE TO REFLECT THE TWELVE (12)
NEW POSITION CLASSIFICATION DESCRIPTIONS
SUMMARY:
After reviewing the upcoming Biennial Budget staffing requirements and existing position classifications and pay plan placement, the City Manager and Administrative Services Director recommend the following:
Accept and approve the twelve new Position Classification Descriptions presented.
Approve the four (4) revised Position Classification Descriptions Approve the revised Position Classification Schedule
Adopt the new Pay Plan to correct for rounding and add the placement of the new position classifications.
BACKGROUND:
On November 9, 2022 the City Council approved a new Compensation and Classification Study including Position Descriptions and Position Classification Placements, effective February 2023. At the same time, City Council approved a revised Pay Plan with new Pay Grade numbers based on the position groupings. This was to address increasing operational 343
needs and to ensure current and future staff members are assigned in the appropriate classifications. It was anticipated at the time that the list of classifications would be revised as needed, creating a working organizational structure.
As part of the upcoming Fiscal Years 2023-24 and 2024-25 Biennial budget approval process, City staff recommend adding the following position classifications to the City's Position Classifications to account for potential staffing needs commensurate with the City's growth over the next five years:
Assistant City Manager
Deputy City Manager
Assistant to the City Manager
Code Enforcement Supervisor
Engineering Technician I/II
Executive Assistant
Finance Manager
Human Resources and Risk Manager
Human Resources Analyst
Human Resources Technician
Plans Examiner I/II
Senior Engineer
DISCUSSION:
In order to continue refining the City's Organizational Structure, and to account for future growth, City staff recommends adding twelve new Position Classification Descriptions, which are included in this staff report. Adding these positions adopts the classifications for use in the future only. The positions are not authorized to be staffed unless they are adopted with the Schedule of Authorized Positions as a part of the Biennial budget, or as a reclassification or promotion process.
The new Position Classification Descriptions were created utilizing the same process as the original Compensation and Classification Study. The descriptions and position titles were designed to match comparable duties with adjacent cities. Each position was then reviewed to determine how best the position fits within the City's Pay Plan. The pay grade is designed to be competitive, aligning with the median range in the region, based on comparison with other local cities.
Four Position Classification Descriptions, originally adopted on November 9, 2022, are also proposed to be revised. These revisions reflect changes in the reporting structure of the positions as well as a change in duties to add assistance in delivering programs to support individuals experiencing homelessness. The following are the four Position Classifications with proposed revisions:
344
Code Enforcement Manager
Code Enforcement Officer I/II
Code Enforcement Technician
Senior Code Enforcement Officer
The newly revised Pay Plan utilizes the same format adopted on November 9, 2022, with the additional position titles added. In addition, there were minor rounding issues with the prior Pay Plan which were based on a four decimal rounding that is incompatible with non-Excel based payroll processing. This includes the current payroll processing vendor as well as the new Enterprise Resource Planning (ERP) system that staff are proposing to implement. The revised Pay Plan utilizes two decimal rounding and minor mathematical adjustments to correct this issue. No employee will suffer a salary decrease as a result of these changes to the City Pay Plan.
FISCAL IMPACT:
There are no fiscal impacts associated with approving the new Position Classification Descriptions and modification to existing Position Classification Descriptions. Any personnel changes will be submitted to the City Council for approval as a part of the Biennial fiscal budget.
While rounding up the salaries in the Pay Plan does have a slight fiscal impact, such impact is projected to not exceed $3,000 for fiscal year 2023-24.
