Agenda Staff Report # 1.9

Meeting Date: September 11, 2024
SUBJECT:

Vacation of an Existing 30-foot Road Easement Lot C located in the Faith Bible Church Project Site (Project No. 19-0179) SUBMITTED BY:

Jason Farag, Public Works Director
PREPARED BY:

Ninette Eva, Associate Engineer

ACTION:

Adopt a Resolution entitled:

RESOLUTION NO. 2024 -______

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WILDOMAR, CALIFORNIA, SUMMARILY VACATING A 30-FOOT ROAD EASEMENT (LOT “C”) LOCATED IN THE

FAITH BIBLE PROJECT SITE, INCLUDING A RESERVATION OF A PUBLIC UTILITY

EASEMENT
SUMMARY:

The City will vacate an existing 30-foot road easement, running from the intersection of Glazebrook Road and Depasqualle Road to the north property line of the Faith Bible Church Project (Project), as part of a condition of approval for the Project. A public utility easement will be reserved for any existing utilities operating in the area.

BACKGROUND:

Faith Bible Church (Project) is an approved project to establish a 27,489 square-foot church that includes a 16,486 children’s ministry building and an 18,024 square-foot gymnasium north of the intersection of Glazebrook Rd. and Depasqualle Rd. Construction of the Project has been on-going. The developer has completed on-site and off-site improvements and is now seeking occupancy of a temporary structure while they continue construction of their permanent structure. An aerial image of the Project site and the surrounding area is provided in Attachment A.

DISCUSSION:

The primary entrance to the Faith Bible Church property and the permanent church structure are located within a previously dedicated road easement known as Lot "C" of Parcel Map 9789. Lot "C" is a 30-foot road easement running from the intersection of Glazebrook Rd. and Depasqualle Rd. to the Project's north property line. Lot "C" provided a north-south right-of- way connection between Glazebrook Rd. and the area to the north. As part of the Project, the developer has dedicated new right-of-way to the City along the Project's western boundary to provide a future north-south connection between Glazebrook Rd. and Bayless Rd. Lot "C" is now excess right-of-way that is no longer needed by the City for public access and can be vacated.
246

Elsinore Valley Municipal Water District (EVMWD) has an existing water line located in the 30- foot road easement that is being vacated. A reservation of a public utility easement is included in the resolution to allow EVMWD to continue to operate the utilities they own in this area.

California Streets and Highways Code (SHC), Division 9, Part 3, Chapter 4 (Summary Vacation) Section 8334 (a) allows the City’s legislative body to summarily vacate an excess Right-of-Way of a street or highway not required for street or highway purposes. Therefore, staff recommends that the City Council adopt a Resolution to vacate the right-of-way and to also reserve a public utility easement over the vacated right-of-way.

FISCAL IMPACT:

There are no fiscal impacts to the City from the vacation itself. All costs related to processing are covered by developer deposits/fees.

Meeting Date: September 11, 2024
SUBJECT:

First Amendment to Agreement for Services between the City of Wildomar, California, and Gods Fan Club, Dba Project T.O.U.C.H.

SUBMITTED BY:

Raul Berroteran, Code Enforcement Manager
PREPARED BY:

Raul Berroteran, Code Enforcement Manager

ACTION:

Authorize the City Manager to execute Amendment #1 (Attachment A) of the Professional Services Agreement between the City of Wildomar and God's Fan Club, dba Project T.O.U.C.H., to be extended indefinitely.

BACKGROUND:

The City and Project Touch entered into a six-month agreement on March 13, 2024, with the option to extend to a month-to-month agreement for shelter services. The City Council approved the agreement. It states that the service provider will offer emergency shelter services effectively to address and reduce the homeless population within the City of Wildomar.

On behalf of the city, Project Touch will provide emergency shelter services to address and reduce the homeless population within the City of Wildomar. The Service Provider will coordinate efforts with the City of Wildomar and The Riverside County Sheriff’s Department, the City’s contracted street outreach Provider, and other stakeholders. The prime goal is to continue to provide emergency sheltering services in the City of Wildomar to engage with persons experiencing unsheltered homelessness with the ultimate goal of moving individuals and families into housing sustainability.

DISCUSSION:

The proposed amendment outlines the key areas of cooperation between the City of Wildomar and God’s Fan Club, also known as Project T.O.U.C.H., to provide shelter for the homeless. Addressing homelessness includes establishing joint outreach teams, sharing information, and taking a unified approach to providing shelter and services for individuals experiencing homelessness. The collaborative efforts outlined in the MOU are intended to maximize the impact of Homeless Outreach Services and promote a unified front against homelessness in our communities. It's crucial to extend our MOU agreement with Project T.O.U.C.H. so that the city can continue to provide outreach services.

FISCAL IMPACT:

Services are provided as needed, with a monthly maximum of $10,485. The total impact of the agreement, including extensions over Fiscal Year 2024-25, will be $125,820 and has already been 253
accounted for in the FY2024-25 Amended Budget. Therefore, no additional appropriations are needed.

Agenda Staff Report # 1.11

Meeting Date: September 11, 2024
SUBJECT:

Consideration of annual reporting of completed State
mandated fire and life safety inspections by the City of Wildomar in compliance with SB 1205 for Fiscal Year 2023- 2024
SUBMITTED BY:

David Young, Supervising Fire Marshal

ACTION:

Adopt a Resolution entitled:

RESOLUTION NO. 2024- ____

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WILDOMAR, CALIFORNIA,

ACKNOWLEDGING RECEIPT OF A REPORT MADE BY THE FIRE CHIEF OF THE

RIVERSIDE COUNTY FIRE DEPARTMENT REGARDING THE INSPECTION OF CERTAIN

OCCUPANCIES REQUIRING ANNUAL INSPECTIONS IN SUCH OCCUPANCIES PURSUANT TO SECTIONS 13145, 13146, and 17921 OF THE CALIFORNIA HEALTH AND

SAFETY CODE
BACKGROUND:

On September 27, 2018, Senate Bill 1205 became effective, and added a new section to the California Health and Safety Code that affects every fire department or fire district in the State.

Existing state law required every fire department or district providing fire protection services to inspect every building used as a public or private school annually. This same annual inspection requirement is applicable to hotels, motels, lodging houses, and apartment houses.

This bill also requires every fire department or district to annually report to its administering authority their compliance with the annual inspection requirements of the California Health and Safety Code. The bill also requires the administering authority to formally acknowledge receipt of the compliance report in a resolution or a similar formal document.

DISCUSSION:

The responsibility for conducting the required inspections falls to the Fire Division as directed by the Deputy or Supervising Fire Marshal. In conducting these inspections, Fire Division staff evaluate compliance with such items as fire sprinkler and fire alarm maintenance, safe exiting, fire extinguisher maintenance, conducting fire drills, and safe storage of combustibles.

In review of all completed inspections, the Supervising Fire Marshal has determined that all required inspections have been completed for Fiscal Year 2023-2024. Adoption of the recommended resolution and transmittal to the appropriate State Agency will meet the City’s obligation under SB 1205.

FISCAL IMPACT:

There is no fiscal impact related to this action and all costs of the inspection processes are included in 289
There is no fiscal impact related to this action and all costs of the inspection processes are included in the adopted fees.

ENVIRONMENTAL DISCUSSION:

The proposed resolution is exempt from the California Environmental Quality Act (Cal. Publ.

Res. Code §§21000 et seq. “CEQA”) and the State CEQA Guidelines (14. Cal. SUBJECT:

Services Agreement for Human Resources Information
System, Electronic Forms, and Performance Evaluation
Software with NeoGov, Inc.

SUBMITTED BY:

Emily Wolf
PREPARED BY:

Emily Wolf

ACTION:

Authorize the City Manager to enter into an Agreement with NeoGov, Inc. by way of Order Form and Agreement for human resources information systems (HRIS) software, electronic forms, and performance evaluation software.

SUMMARY:

This item enters into an agreement for human resources information systems (HRIS) software, electronic forms, and performance evaluation software.

BACKGROUND:

NeoGov, Inc. provides a suite of human resources software programs developed specifically for the public sector and is currently used by over 6,000 public agencies. In January 2024, City Council approved the implementation of NeoGov’s employment application tracking software to provide better access to candidates and an efficient communication and tracking process for recruitments. In addition, the software provided a platform to house classification descriptions. The implementation of this software provided efficient and effective recruitment processes, leading to eight newly hired staff members.

Another of NeoGov’s software programs is a Human Resource Information System (HRIS).

The HRIS is a cloud-based central hub for employee records, salary, and workforce data.

Designed specifically for the public sector, NeoGov’s HRIS automates approval workflows, streamlines HR processes, and easily manages and tracks human resources data while achieving compliance. The software program retains employee demographics required for Equal Employment Opportunity (EEO) reporting, quickly identifying vacancies, maintaining an employee roster, and more. The HRIS also seamlessly incorporates software to provide fully configurable e-Forms.

Performance evaluations are critical to employee development. NeoGov’s employee evaluation software, Perform, automates annual employee evaluations, helping to ensure timely evaluations and assistance setting goals for the next year. Perform analyzes individual employee, team, or departmental data to identify skill gaps across the agency and optimize employee development based on common themes.
294

DISCUSSION:

The current HRIS and performance evaluation processes consist of paper files, spreadsheets, and multiple databases housing different sources of information. Implementation of the NeoGov HRIS provides continuity of information that is readily available to authorized users to ensure human resources information is maintained and in compliance with local, state and federal laws.

Currently, the human resources division relies heavily on paper forms for various internal and external processes such as employment offer letters, onboarding checklists, policy acknowledgements, employee requests, and more. E-Forms would allow employees to submit, track, and manage forms online, as well as provide a workflow process for when supervisory review is required. E-Forms electronically stores all documents the employee has completed throughout their employee lifecycle, working cohesively as a central repository.

Supervisors benefit from the Perform module with its ability to organize notes throughout the year to document performance and refer back during performance reviews, schedule periodic check-ins to provide feedback and track goal progress, and implement performance improvement plans (PIPs), when necessary. The Perform module provides reminders for evaluations due dates, an approval workflow process, and electronic recordkeeping and reporting to help identify areas of opportunity.

The City’s human resources processes will be streamlined with automated workflows and integrated notifications to ensure target dates are met. The NeoGov platform provides a fully unified system to capture the entire employee lifecycle starting from the candidate application.

Utilizing the HRIS, e-Forms, and Perform modules will ensure compliance, increase efficiency, and grow along with the City, bringing modernization to the human resources division and City staff as we continue to strive to be an employer of choice.

PUBLIC HEARING
Agenda Staff Report # 2.1

Meeting Date: September 11, 2024
SUBJECT:

Consideration of Resolution of Necessity for Condemnation of a Portion of Vacant Property Identified by Assessor Parcel Number 362-250-025 for the Clinton Keith Road Widening
Project (CIP 025-1)
SUBMITTED BY:

Jason Farag, Public Works Director
PREPARED BY:

Thomas D Jex, City Attorney

ACTION:

1. Conduct a hearing on the proposed Resolution 2024-__ of the City of Wildomar finding and determining that the public interest, convenience, and necessity require the acquisition of certain property for public purposes; and

2. Review the evidence presented, including this staff report and public comments, and close the hearing; and

3. Find that on January 13, 2010, in accordance with the California Environmental Quality Act (CEQA) and State CEQA Guidelines §15070, the City Council adopted Resolution 2010-02 certifying a Mitigated Negative Declaration or the Clinton Keith Road Widening Project, and that no additional CEQA findings are required for the Project; and

4. Adopt a Resolution entitled:

RESOLUTION 2024 - _____

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WILDOMAR FINDING AND

DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY

REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC PURPOSES SUMMARY:

To complete the construction associated with the Clinton Keith Road Widening Project (CIP 025-1) ("Project"), certain easements are required from adjacent property owners. This item considers a Resolution of Necessity for Condemnation of easements over a portion Vacant Property that are needed to allow for the construction of the Project.

BACKGROUND:

The Clinton Keith Road Widening Project involves the widening and improvement of Clinton Keith Road between Hidden Springs Rd. and Copper Craft Dr., to provide six lanes and bike lanes through the segment. The project also involves the construction of certain retaining walls, the extension of existing culverts, traffic signal modifications, and other ancillary improvements. The Project is intended to improve traffic flow in the area and enhance the safety of the roadway.
300

On January 13, 2010, in accordance with the California Environmental Quality Act (CEQA) and State CEQA Guidelines §15070, the City Council adopted Resolution 2010-02 certifying a Mitigated Negative Declaration or the Project, and that no additional CEQA findings are required for the Project.

DISCUSSION:

In order to complete the construction of the Project, the City must acquire a portion of the vacant parcel identified by assessor parcel number 362-250-025 (“Larger Parcel”). The Larger Parcel is zoned IP (Industrial Park) and is owned by Malak Hanna and Joseph Zakhary (“Owners”).

For the purpose of the Project, the City is seeking to acquire two easements over the Larger Parcel: (1) permanent slope easement containing 2,490 square feet, (2) a 24-month temporary construction easement (TCE) containing 2,837 square feet (collectively the “Easements”). The Easements are more particularly described and depicted in the proposed Resolution attached hereto.

Before proceeding with an eminent domain action, the City must make an offer to purchase to the property owner, which offer must be transmitted in writing, based upon an appraisal. On May 29, 2024, City Staff tendered an offer to the Owner in the amount of $14,200 for the Easements (“Offer”) (Attachment A). The Offer was based on an appraisal prepared by a licensed appraiser. City Staff and the City’s Right of Way agents have attempted in earnest to negotiate a purchase of the Easements, and although negotiations are ongoing and will continue, the acquisition of the Easements has not been consummated. The City requires possession and use of the Easements before work on the Larger Parcel can commence and there are no assurances that an agreement between the parties will be reached in order to meet the Project’s construction schedule; therefore, a Resolution of Necessity is being requested.

Pursuant to California Government Code Sections 7267.2, 37350.5, and 40404, and California Code of Civil Procedure Section 1230.010 et seq., 1240.410 and 1240.020, and Section 19, Article I of the California Constitution, and other authorities, the City is authorized to acquire the aforementioned Easements by eminent domain, provided certain procedural steps are followed.

It is now necessary that an action in eminent domain be commenced to acquire the Easements referenced above. Prior to the filing of the action, the City must hold a hearing on the proposed Resolution of Necessity (attached) and provide the Owner an opportunity to be heard. In addition, the hearing must be duly noticed. Attached is a copy of the Notice of Hearing, which was issued on June 24, 2024, in accordance with the applicable statutes (Attachment B).

After conducting the public hearing, if the Council finds that the public necessity so requires, City should adopt the attached Resolution of Necessity, authorizing condemnation proceedings for the purpose of acquiring the Easements.

The findings which need to be made are as set forth in the Resolution of Necessity.

Specifically, the Council must find:
301
1 .

That the public interest and necessity require the acquisition of the proposed Project. As proposed, the Project will serve public purposes, as discussed above; 2 .

That the Project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury. City evaluated different Project design options to identify any overall Project cost and real estate impacts in an effort to ensure the least private injury. It was determined that Project in its currently proposed iteration will be most compatible with the greatest public good and the least private injury. 3 .

That the Easements are necessary for the proposed Project. A slope easement is necessary for proper drainage along the roadway. In addition, a temporary construction easement is needed in order to construct the Project improvements within the Easements and Project area.
4 .

That City made the offer to purchase as required by section 7267.2 of the California Government Code. The Statutory Offer to Purchase was tendered to the owner of the Property on May 29, 2024.
5 .

That the necessary notice of hearing to consider the adoption of the Resolution of Necessity has been given, as required by Code of Civil Procedure section 1245.235. As evidenced by Attachment B, this notice was issued on August 23, 2024. 6 .

That City has complied with CEQA for the Project.
7 .

The Easements are necessary for the purpose specified in Section 1240.350 of the Code of Civil Procedure, and as such the taking is authorized by Section 1240.350 of the Code of Civil Procedure. This project is in compliance with Section 1240.350 in that the proposed road widening and storm drains along Clinton Keith Road in the City, is a public need and is for the greater good of the public’s interest and balances the various hardships of all parties affected by this taking.

Questions relating to value are not relevant to this proceeding. However, that does not mean that negotiations for the acquisition of the Easements are at an end. If City adopts the Resolution of Necessity, after the hearing, negotiations for the acquisition of the Easements may continue.

The proposed Resolution of Necessity must be adopted by a two-thirds majority vote.

FISCAL IMPACT:

Funds are available for the acquisition of this Property and are included in the City’s FY 2024- 25 budget. Legal costs related to the eminent domain proceedings are unknown at this time and are dependent upon whether or not an agreement can be reached with the property owner. Legal costs will be paid for from the approved Project budget. Staff will track the related costs and bring forward a budget amendment if additional budget is needed for this process.

The  City  of  Wildomar  (City),  as  part  of  the  Clinton  Keith  Road  Widening  Project  (Project),  is  considering  acquiring  a permanent  easement  over  a  portion  of  the  subject  property  in  which  we  believe  you  are  the  owner,  along  with  a temporary easement interest. The City obtained a preliminary title report that lists Malak Ghobrial Hanna, a married man and his sole and separate property, as to an undivided 50% interest and Joseph Zakhary, a married man and his sole and separate property, as to an undivided 50% interest, as tenants in common to be the vested owner of the above‐ mentioned property. The permanent easement is described in the legal description and depicted on the plat map within the attached Permanent Slope Easement Deed, and the Temporary Construction Easement is described and depicted in the attached Temporary Construction Easement Deed, herein collectively referred to as the” Easements.” This offer is contingent upon presentation of conclusive evidence of title. If more than one person has an interest in the Easements that the City is seeking to acquire, all parties with such interest must accept this offer.

As you are aware, the City had the Easements appraised to determine their fair market value and just compensation. The appraisal was conducted in accordance with commonly accepted standards and included consideration of the highest and best use of the land.  Based on the appraisal, the City offers to purchase a Permanent Slope Easement, free and clear of any  encumbrances,  and  a  Temporary  Construction  Easement  for  Fourteen Thousand Two Hundred Dollars  and No/100, ($14,200) (“Purchase Price”).

The City has made no decision to exercise its power of eminent domain to acquire the Easements and can only do so after it holds a hearing at which all affected property owners have had an opportunity to appear and be heard.

RE: City of Wildomar – Clinton Keith Road Widening Project

NOTICE OF HEARING REGARDING THE INTENTION OF THE CITY COUNCIL OF THE

CITY OF WILDOMAR TO CONSIDER THE ADOPTION OF A RESOLUTION OF NECESSITY TO CONDEMN CERTAIN PROPERTY INTERESTS LOCATED AT ASSESSOR’S PARCEL NUMBER 362-250-025

Dear Property Owner:

This letter is written on behalf of the City of Wildomar (City) to give you notice pursuant to California Code of Civil Procedure Section 1245.235 that the City Council of the City of Wildomar (City Council) will consider the adoption of a Resolution of Necessity (Resolution) to condemn a portion of your real property at its regular meeting on September 11, 2024, at 6:00 p.m. at 23873 Clinton Keith Road, Suite 201, Wildomar, CA 92595.

The property which will be the subject of consideration is located in the City of Wildomar, APNs 362-250-025.

The Project for which this acquisition will be considered is the Clinton Keith Road Widening Project (Project).

If the City adopts a Resolution, the City will commence an eminent domain proceeding in Riverside County Superior Court to acquire the property.

In determining whether to adopt the Resolution, the City Council will consider whether the following three conditions referred to in Code of Civil Procedure section 1240.030 are established:

1. The public interest and necessity require the Project.

2. The Project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury.

3. The property sought to be acquired is necessary for the Project.

The City Council will also consider whether the offer required by Government Code Section 7267.2 has been made to the owner of record.

You have the right to appear and be heard by City Council on the three matters referred to in section 1240.030 as set forth above. Should you wish to appear and be heard on these matters, you must file a written request to appear and be heard within fifteen (15) days of this Notice.

321

If you contend that any of the three conditions listed above have not been met, your written request to appear should indicate such condition(s). By designating which of the conditions form the basis of your challenge and explaining why you believe they have not been met, this will enable the City to authorize a full and expeditious review of the Project’s effect on your property. The City will conduct the review on behalf of the City Council and ask for your participation. Based on this review, the City will then prepare a report to be presented to the City Council at the meeting at which you intend to appear.

Your written request to appear must actually be on file with the City Clerk within 15 days of the date of this notice. The failure to file a written request to appear and be heard with the City Clerk this date, will result in the waiver of your right to appear and be heard by the City Council on the matters referred to in section 1240.030 as set forth above.

All requests to appear must be sent for filling to:

City Clerk - City of Wildomar
23873 Clinton Keith Road, Suite 110
Wildomar, CA 92595

For your convenience, if you are unable to personally appear or choose to submit written objections in place of a personal appearance, the City Council will consider any written objections so long as they are filed within the 15-day period set forth above. All written objections filed with the City Council within the 15-day period will become part of the official record of the meeting at which the Council hears the Resolution. We recommend that if you intend to appear, or if you intend to submit written objections in place of an appearance, you deliver your correspondence or mail it by Certified Mail, Return Receipt Requested to confirm that your response was received by the City Clerk with the 15-day period.

Please note that questions regarding the amount of compensation to be paid or the value of the property to be acquired are not part of this proceeding and the City Council will not consider such in determining whether a Resolution should be adopted. All issues related to the compensation to be awarded for the acquisition of your property will be resolved in the eminent domain court proceeding. If you elect not to appear and be heard, you will still have the right to claim greater compensation in the court proceeding.

The City is moving forward at this time due to the requirements of the Project schedule. However, the City will continue negotiations regarding compensation, and remains hopeful that a settlement can be reached. Enclosed herewith is a copy of the Offer to Acquire provided to you dated May 29, 2024, which includes details regarding the portion of your property that may be acquired, and the offer to purchase issued by the City. If you have any questions, please feel free to contact Jeremy Miller, Interwest Consulting Group, at (949)299- 5309 or email at [email protected].

Sincerely,

Jason Farag, P.E.
