PUBLIC WORKS DEPARTMENT
DATE: OCTOBER 6, 2026
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: JAMIE LAI, P.E. DIRECTOR OF PUBLIC WORKS AND CITY ENGINEER PREPARED BY: COLIN TSUI, P.E. ASSOCIATE CIVIL ENGINEER
SUBJECT: APPROVE AGREEMENTS WITH WRIGHT CONSTRUCTION
ENGINEERING CORP. AND NV5 FOR THE YORBA LINDA BLVD AT

MOUNTAIN VIEW AVE STORM DRAIN REPLACEMENT PROJECT

RECOMMENDATION

1. Approve the plans and specifications for the Yorba Linda Boulevard at Mountain View Avenue Storm Drain Replacement Project.

2. Approve a construction agreement with Wright Construction Engineering Corp. for $546,222, plus a 15% contingency of $81,933.

3. Approve a professional services agreement with NV5, Inc. for construction management, inspection, and materials testing services for $94,857, plus a 15% contingency of $14,229.

4. Appropriate $487,500 in the Capital Projects Fund for the Storm Drain Replacement Project.

5. Transfer $737,500 from the Master Plan of Drainage Fund to the Capital Projects Fund.

6. Approve an intrafund loan agreement within the Master Plan of Drainage Fund from Watersheds 4, 5, and 6 to Watershed 1.

SUMMARY
The project will replace a deteriorated 48-inch corrugated metal storm drain beneath Yorba Linda Boulevard at Mountain View Avenue with a new reinforced concrete pipe.

DISCUSSION
Recent inspections show the pipe has deteriorated to the point that it requires full replacement with a new 48-inch reinforced concrete pipe rather than the liner as originally envisioned.

Page 97 of 344 ends

S T O R M D R A I N R E P L A C E M E N T P R O J E C T A G R E E M E N T S P a g e | 2
Public Works conducted a competitive bidding process for the project and received six bids (Attachment 4). Wright Construction Engineering Corp. submitted the lowest responsive and responsible bid at $546,222.

Public Works also requested proposals from the City’s on-call consultants for construction management, inspection, and materials testing services and received nine proposals. NV5, Inc. is recommended for these services at $94,857, plus a 15% contingency of $14,229.

FISCAL IMPACT
The project can be paid for from the Master Plan of Drainage Fund. There are 10 drainage watershed zones within the Fund, and this project is in Watershed 1. Although the Fund has sufficient resources, the City must account for project costs within the watershed where the project is located.

Watersheds 4, 5, and 6 have sufficient funds to lend Watershed 1 the $737,500 required to complete the project without impacting projects in those other watersheds. Watershed 4 projects are low-priority and do not require immediate funding. Watersheds 5 and 6 currently have no priority projects.

A 30-year loan with an annual interest rate of 3% between the watersheds is recommended to preserve General Funds that would otherwise pay for the project. Fees from future development in Watershed 1 will repay the loan as they become available. At approximately $14,000 per acre, slightly more than 200 acres of land in Watershed 1 will need to develop to repay this recommended loan and another authorized last year for the Black Golf Strom Drain project. That level of development is not currently anticipated in Watershed 1 and if it does not occur in the next 30 years, the City Council will need to modify the loan terms or repay it with General Funds. If the City Council does not authorize the intra-watershed loan, General Funds accumulated in the Special Reserve Fund will be required to complete the project.

The City Council previously appropriated $250,000 in the Special Reserve Fund for the project before its scope expanded. Funding the project through the Master Plan of Drainage Fund will allow $250,000 to be returned to the Special Reserve Fund.

ALTERNATIVES
Do not approve the recommendations and provide alternative direction.

Public Works Department
City of Yorba Linda

Yorba Linda, CA 92886
Subject: Construction Management, Inspection and Materials Testing Services on the Yorba Linda Boulevard and Mountain View Avenue Storm Drain Replacement Project Dear Public Works Department,
NV5, Inc. is excited to have the opportunity to provide Construction Management, Inspection and Materials Testing Services to the City of Yorba Linda (City) for the subject project. Our team has the technical knowledge and experience to assure your project is completed in a timely and costeffective manner. We have prepared this proposal to demonstrate how our team is best suited to deliver the requested services.

PROJECT UNDERSTANDING
We understand the City is seeking a consulting firm to provide Construction Management, Inspection and Materials Testing Services for the above project. Based on a review of the email RFP (dated 9/1/26) and Project Scope Exhibit, we understand the scope of work to include the removal and replacement of an existing 48” CMP Storm Drain running southwest across Yorba Linda Boulevard, just west of Mountain View Avenue and the entrance to the Nixon Library.

Specifically, improvements may include:

1. PCC Parkway/Median/ Improvements:
a. Sidewalks
b. Stamped Paving
c. Curb and Gutter
d. Landscape Restoration

2. Street Improvements:
a. AC Pavement Construction
b. AC Pavement Resurfacing
c. Utility Adjustments
d. Traffic Signage and Striping

3. Drainage Improvements:
a. 48” RCP
b. PCC Junction Structures
c. PCC Inlets and Collars
Yorba Linda Boulevard is an arterial roadway with 2 lanes of traffic in each direction. The roadway is separated by a raised, landscaped median. The Nixon Library fronts the northern side of Yorba Linda while residential development fronts the southern side.

PROJECT-SPECIFIC ISSUES
Based on a preliminary site visit as well as our experience working on projects of similar scope, we have identified the following general issues that our team will be cognizant of during construction:

Shoring
Removal and replacement of the existing Storm Drain will require deep excavation and shoring. We will work closely with the contractor, the engineering design team, as well as the geotechnical engineer to assure the engineering shoring plans are submitted, reviewed and approved in a timely manner, and the approved shoring system is properly installed and maintained during construction.

Once work is completed, we will work with the contractor to assure the trench is properly backfilled and restored.

Pipe Installation
Given that Reinforced Concrete Pipe (RCP) typically comes in relatively short sections (typically 8’ segments), sagging may be an issue. Our inspectors have extensive experience in the installation of RCP and will assure the bottom of the trench is graded to final design grades and transitions are graded smooth. We will also assure the pipe is installed plumb to design grades, either via laser target or plumb bob. These measures will help avoid any sagging. Finally, our inspectors will assure the proper installation of gaskets at tie-ins and connections.

Temporary By-Pass/Hi-Line System
The Project Scope Exhibit is silent on the installation and maintenance of a temporary by-pass/hi-line to keep a working storm drain system in service during construction. We recommend this be considered for inclusion in the scope of work. Our team has had extensive experience in designing and implementing similar systems in the past and is familiar with potential issues that could arise.

We will assure appropriate contingency measures such as provisions for stand-by Vactor trucks and continuous monitoring are included in the proposed system.

Utility Conflicts
A review of the Project Scope Exhibit shows potential conflicts with existing utility lines, specifically:

1. 8” VCP sewer

2. 16” ACP domestic water
While the plans show acceptable lateral clearance, there is always a concern for conflict, especially with the 8” sewer, where we have just over 1’ of clearance. Should a conflict arise, our team will

Page 152 of 344 ends

September 22, 2026

Page 3 ends

work closely with the contractor and the engineering design team to develop the most cost-effective and cost-efficient solution. Our construction management and inspection team has extensive experience in resolving conflicts of this nature, and working in concert with our in-house engineering design team, have devised both creative and practical solutions. Finally, during construction we will assure the existing sewer and water mains are properly supported and protected in place.

Traffic Control
Proposed improvements will most likely necessitate temporary lane closures and implementation of all necessary traffic control measures along Yorba Linda Boulevard. We will assure lane closures are properly implemented. Taper lengths and advance warning signage for lane closures are especially critical on arterial roadways such as Yorba Linda Boulevard. Our inspectors have a razor-sharp knowledge and understanding of the latest WATCH manual and CA MUTCD requirements, and they are experienced in reviewing traffic control set-ups to verify if they meet established standards. We will also work closely with the contractor to modify or adjust the proposed traffic control set-ups to assure it is coordinated with the planned work sequence.

It is anticipated the trench shall be plated and traffic lanes are to be re-opened at the end of each workday. We will work with contractor to assure plates are properly installed, with temporary AC paving.

Public Relations/Advanced Notification
We will work closely with the contractor as well as City staff to provide sufficient advanced notification to both the Nixon Library and residential communities. We will assure the formatting and language of the notification is reviewed and approved by the City and it is issued in a timely manner.

Our inspector will also assure verbal follow-ups are made prior to and during construction to minimize complaints. All of our inspectors are adept at responding to public complaints and concerns.

While not anticipated, should there be any kind of potential impact to access points of the Nixon Library, we will work with the contractor, along with City staff and to notify and work with Library staff to minimize any impacts.

RESOLUTION NO.

A RESOLUTION OF THE PLANNING COMMISSION OF THE

CITY OF YORBA LINDA APPROVING TENTATIVE TRACT
MAP 19468 – SHEA HOMES, WITH CONDITIONS
WHEREAS, an application for Tentative Tract Map 19468 was made by Shea Homes, 15261 Laguna Canyon Road, Suite 100, Irvine, California, 92618, to consolidate and subdivide a 19.6-acre site into 82 single-family lots and develop 82 detached, twostory, market-rate homes. The project includes two ungated access points on Bastanchury Road and the removal of an existing driveway on the north side of the Plumosa Drive and Bastanchury Road intersection. The request also includes reduced front, side, and rear setbacks for certain lots within the development for the properties addressed as 18101, 18141, 18203, and 18231 Bastanchury Road, located north of Bastanchury Road and west of Plumosa Drive within the PD-26 (West Bastanchury Planned Development) zone, APN: 323-181-04,-05,-06,-07, and, WHEREAS, Tentative Tract Map 19468 is being considered in conjunction with Conditional Use Permit 2025-64, Variance 2026-02, and Design Review 2025-19; and, WHEREAS, notice of public hearing before the Planning Commission of the City of Yorba Linda concerning Tentative Tract Map 19468 was given in accordance with applicable law; and,
WHEREAS, on July 8, 2026, a public hearing pertaining to Tentative Tract Map 19468 was held by the Traffic Commission who recommended approval of the project; and WHEREAS, on August 26, 2026, a public hearing pertaining to Tentative Tract Map 19468 was held by the Planning Commission; and,
WHEREAS, city staff prepared a written report on this matter, a copy of which was provided to the applicant in accordance with Government Code Section 66452.3; and, WHEREAS, after consideration of the staff report and all of the information, testimony, and evidence presented at the public hearing, the Yorba Linda Planning Commission does hereby find that with incorporation of those conditions attached hereto as Exhibit "A" and all mitigation measures described in the previously certified Program EIR and Addendum (State Clearinghouse No. 2022040574) of the California Environmental Quality Act (CEQA) for the Yorba Linda 2021-2029 Housing Element and Implementation Programs prepared in support of the Housing Element:
(1) The proposed map will be consistent with the City's General Plan in that it is compatible with the objectives, policies, general land uses and programs specified in the General Plan, and will be consistent with all other aspects of the General Plan.
(2) The proposed map will be consistent with the current zoning on the property.

Page 200 of 344 ends

(3) The design and improvement of the proposed subdivision as designated on the subject Tentative Tract Map will be consistent with the City's General Plan in that it will be compatible with the objectives, policies, general land uses and programs specified in the General Plan, including:
(a) Street alignments, grades and widths;
(b) Drainage and sanitary facilities and utilities, including alignments and grades thereof;
(c) Location and size of all required easements and rights-of-way; (d) Lot size and configuration;
(e) Traffic access;
(f) Grading;
(g) Land to be dedicated for park or recreational purposes; and (h) Such other specific requirements in the plan and configuration of the entire subdivision as may be necessary to insure conformity to or implementation of the General Plan.
(4) The site is physically suitable for the type of development in that the infrastructure and utilities either already serve the site or can be readily expanded to serve the site, and there are no intractable topographical peculiarities associated with the physical character of the property that may prevent the development of single-family residential dwellings as part of a new residential community.
(5) The site is physically suitable for the proposed single-family residential dwellings as part of a new residential community in that the applicant has submitted a conceptual development plan which illustrates that the proposed project may be constructed on the site without adversely affecting the health, safety, or welfare of anyone who will utilize the development or anyone living within the surrounding community.
(6) The design of the subdivision and type of improvements are not likely to cause serious public health problems in that the proposed subdivision, upon approval of requested Variance allowing a reduction in the required setbacks, will comply with all requirements and development standards prescribed within the Yorba Linda General Plan and Zoning Code.

Page 201 of 344 ends

(7) The design of the subdivision and the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision.
(8) The discharge of waste from the proposed subdivision into the existing sewer system will not result in a violation of existing requirements prescribed by the applicable California Regional Quality Control Board.
(9) The design of the subdivision provides, to the extent feasible, for passive or natural heating or cooling opportunities in the subdivision in that each building’s size, shape and design configuration permits the existing orientation of the planned development to take advantage of existing sun and shade opportunities.
(10) When considering the record as a whole, there is no evidence before the City that the proposed project will have the potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. (11) The Planning Commission has considered the effect of the proposed map on the housing needs of the region in which the City is situated and has balanced these needs against the public service needs of its residents and available fiscal and environmental resources, and finds that the proposed map does not detrimentally affect housing in the area, or place an undue burden on public service needs and available fiscal and environmental resources. (12) As this project involves no repeal, amendment, or adoption of all or any part of the land use planning policy documents as specified in Section 18.01.020 of the Yorba Linda Municipal Code, this project is exempt from the provisions of Chapter 18.01 of the Yorba Linda Municipal Code, also known as the “Yorba Linda Right-to-Vote Amendment.”
(13) The remaining sites identified in the Housing Element are adequate to accommodate the City’s share of housing so as to satisfy its regional housing need.

WHEREAS, the project qualifies for a CEQA guideline Section 15183 environmental review and subsequently a consistency analysis was completed by the applicant which determined the proposed project does not involve new significant environmental effects or substantial increases in the severity of the previously identified effects. As a result, the project does trigger the need to prepare supplemental environmental documents as it is consistent with the existing PEIR; and,
NOW, THEREFORE, BE IT RESOLVED that the Yorba Linda Planning Commission does hereby approve Tentative Tract Map 19468, subject to the conditions of approval shown on Exhibit "A" attached to this Resolution and all mitigation measures described in the certified Final Environmental Impact Report for the Yorba Linda 2021-2029 Housing Element and Implementation Programs, and which is by reference incorporated herein.

RESOLUTION NO.

A RESOLUTION OF THE PLANNING COMMISSION OF

THE CITY OF YORBA LINDA APPROVING TENTATIVE
TRACT MAP 19472 – OLSON URBAN HOUSING, LLC,

WITH CONDITIONS
WHEREAS, an application for Tentative Tract Map 19472 was made by Olson Urban Housing, LLC, 3010 Old Ranch Parkway, Suite 100, Seal Beach, California, 90740, to subdivide an approximately 1.62-acre site for condominium purposes to create one numbered lot and 30 residential condominium units at 4742 Plumosa Drive, Assessor's Parcel Number 323-311-03; and,
WHEREAS, the proposed project consists of a gated residential condominium community with 28 detached three-story market-rate dwelling units and two attached two-story dwelling units reserved for very low-income households, together with a private drive, resident parking, walls and gates, landscaping, drainage, utility, and frontage improvements; and,
WHEREAS, the project site is located at the northeast corner of Plumosa Drive and Lemon Drive, is designated for residential development in the General Plan and 2021-2029 Housing Element as Housing Opportunity Site S4-075, and is zoned Residential Multiple-Family 20 (R-M-20) and Affordable Housing Overlay (AHO); and, WHEREAS, the applicant submitted a preliminary application under the Housing Crisis Act of 2019 (Senate Bill 330) and a formal application for Vesting Tentative Tract Map No. 19472 and Design Review 2026-02 on January 29, 2026; and,
WHEREAS, Tentative Tract Map No. 19472 is being considered in conjunction with Design Review 2026-02; and,
WHEREAS, the project provides two dwelling units for sale to very low-income households and therefore qualifies for benefits under State Density Bonus Law, Government Code Section 65915; although the Applicant has elected not to utilize an increase in residential density, the Applicant has requested waivers or reductions of development standards pursuant to Government Code Section 65915, and relief from the Conditional Use Permit requirement of Yorba Linda Municipal Code Section

18.10.100(B) based upon the requirement of the Housing Accountability Act, as more particularly identified in Exhibit “B”, attached hereto and incorporated herein by reference; and,
WHEREAS, notice of a public hearing before the Planning Commission concerning Vesting Tentative Tract Map No. 19472 was given in accordance with applicable law; and,
WHEREAS, on August 26, 2026, the Planning Commission held a public

Page 233 of 344 ends

hearing pertaining to Tentative Tract Map 19472; and,
WHEREAS, city staff prepared a written report on this matter, a copy of which was provided to the applicant in accordance with Government Code Section 66452.3; and,
WHEREAS, after consideration of the staff report and all of the information, testimony, and evidence presented at the public hearing, the Yorba Linda Planning Commission does hereby find that with incorporation of those conditions attached hereto as Exhibit "A" and all mitigation measures described in the previously certified Program EIR and Addendum (State Clearinghouse No. 2022040574) of the California Environmental Quality Act (CEQA for the Yorba Linda 2021-2029 Housing Element and Implementation Programs prepared in support of the Housing Element, which included the subject development site contemplated as part of the Housing Element Implementation Programs:
(1) The proposed map is consistent with the objectives, policies, general land uses, and programs specified in the General Plan and the 2021- 2029 Housing Element. The project will redevelop an identified Housing Element opportunity site with 30 ownership units, including two units reserved for very low-income households, in an urban infill location near commercial services and existing residential development. (2) The proposed map is consistent with the current R-M-20 and Affordable Housing Overlay zoning applicable to the property, as modified by any density bonus incentive, concession, waiver, or reduction of development standards lawfully approved under Government Code Section 65915(c)(2).
(3) The design and improvement of the proposed subdivision, as designated on Vesting Tentative Tract Map No. 19472 and the concurrently considered plans, are consistent with the City's General Plan and the development standards, policies, and programs applicable to the site, including provisions relating to:
(a) Street alignments, grades and widths;
(b) Drainage and sanitary facilities and utilities, including alignments and grades thereof;
(c) Location and size of all required easements and rights-of-way; (d) Lot size and configuration;
(e) Traffic access;
(f) Grading;

Page 234 of 344 ends

(g) Land to be dedicated for park or recreational purposes; and (h) Such other specific requirements in the plan and configuration of the entire subdivision as may be necessary to insure conformity to or implementation of the General Plan.
(4) The site is physically suitable for the type of development proposed. The property is an urban infill site surrounded by developed residential and commercial uses and is served, or can be served, by existing streets, utilities, public services, and emergency response facilities. The proposed grading, retaining walls, storm-drain facilities, and private street are subject to detailed engineering, geotechnical, building, fire, and utility review before construction.
(5) The site is physically suitable for the proposed density of development.

The project proposes approximately 18.6 dwelling units per acre, which does not exceed the base density permitted in the R-M-20 zone. The condominium layout, unit mix, private open space, landscaping, parking, access, and building forms are capable of being accommodated on the site subject to the approved waivers, concessions, and conditions of approval.
(6) The design of the subdivision and type of improvements are not likely to cause serious public health problems. The project has been reviewed by applicable City departments and public agencies, and the conditions of approval require compliance with fire access, drainage, water quality, construction management, sight distance, lighting, parking, noise, hazardous material abatement, and building safety requirements. (7) The design of the subdivision and the type of improvements will not conflict with easements acquired by the public at large for access through or use of property within the proposed subdivision. Existing and proposed easements shall be shown on the final map, and any unresolved easement issues shall be addressed before recordation. (8) The discharge of wastewater from the proposed subdivision into the existing sewer system will not result in a violation of applicable requirements prescribed by the California Regional Water Quality Control Board, subject to approval of sewer plans and service requirements by the City Engineer and the Yorba Linda Water District. (9) The design of the subdivision provides, to the extent feasible, for passive or natural heating or cooling opportunities in the subdivision in that each building’s size, shape and design configuration permits the existing orientation of the planned development to take advantage of existing sun

Page 235 of 344 ends

and shade opportunities.
(10) The project is a housing development project that qualifies for the statutory exemption from the California Environmental Quality Act (CEQA) as a qualifying infill housing development project pursuant to Public Resources Code Section 21080.66, subject to completion and documentation of all statutory requirements, including tribal consultation requirement. The City shall file the required Notice of Exemption following project approval.
(11) When considering the record as a whole, there is no evidence before the City that the proposed project will have the potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. The site is fully urbanized and previously developed. The Phase I and Phase II environmental site assessments identified no recognized environmental conditions requiring additional site investigation, subject to proper abandonment or removal of the existing irrigation well and septic systems and completion of pre-demolition asbestos and leadbased paint surveys. (12) The Planning Commission has considered the effect of the proposed map on the housing needs of the region and has balanced those needs against the public service needs of City residents and available fiscal and environmental resources. The project adds market-rate and very low-income ownership housing on an identified Housing Element site.

Conditions address the site's interface with existing residences, nearby multi-family housing development, major commercial tenants, Mabel M.

Paine Elementary School, public streets, and constrained on-street parking.
(13) As the project does not involves repeal, amendment, or adoption of all or any part of the land use planning policy documents as specified in Section

18.01.020 of the Yorba Linda Municipal Code, this project is exempt from the provisions of Chapter 18.01 of the Yorba Linda Municipal Code, also known as the “Yorba Linda Right-to-Vote Amendment.” (14) Approval of the project will not reduce the City’s capacity to accommodate its remaining share of regional housing needs because the project develops an identified Housing Element site with residential units and does not remove a residential opportunity site from the inventory without replacement. The remaining sites identified in the Housing Element are adequate to accommodate the City’s share of housing so as to satisfy its regional housing need.

Page 236 of 344 ends

(15) The project will reserve two ownership units for very low-income households under an Affordable Housing Agreement and recorded affordability restrictions approved by the City. The affordable units shall be comparable in exterior appearance and access to common facilities and shall be integrated into the development as shown on the approved plans.

NOW, THEREFORE, BE IT RESOLVED that the Yorba Linda Planning Commission does hereby approve Tentative Tract Map 19472, subject to the conditions of approval shown on Exhibit "A" attached to this Resolution and all mitigation measures described in the certified Final Environmental Impact Report for the Yorba Linda 2021-2029 Housing Element and Implementation Programs, and incorporated herein by reference, and subject to concurrent approval of Design Review 2026-02.

PASSED AND ADOPTED at a meeting of the Planning Commission of the City of Yorba Linda on August 26, 2026.
