To restore a safe environment for residents, visitors, and City employees at Sam Brannan Park by addressing public safety concerns, improving park conditions, and implementing security measures that support the park's intended recreational use.

Strategic Focus Area:

Page 194 of 297 ends

This project supports the City's Safe Communities strategic focus area by restoring Sam Brannan Park as a safe and welcoming public space through cleanup efforts, security improvements, and coordinated outreach that enhance public safety and quality of life.

Background:

Sam Brannan Park, comprising 8.51 acres, is Yuba City's largest community park. It provides residents of all ages with playgrounds, picnic areas, open green space, restrooms, and recreational amenities that include bocce ball, volleyball, pickle ball courts, and a skate park.

In recent years, the overall condition and public use of Sam Brannan Park have declined. A primary contributing factor is the prolonged presence of individual transients and drug users who occupy the park during the day and evenings. Current conditions have affected the park's safety as well as cleanliness and public perception. This has resulted in families seeking other locations for recreational opportunities.

To address the imminent public safety concerns, the City Council conducted a Special Meeting on August 12, 2026, in which staff recommended the following actions be taken:
• The temporary closure of Sam Brannan Park, located at 812 Gray Avenue, Yuba City, CA, effective September 1, 2026
• The posting of signage regarding park closure.
• Authorize the City Manager to allocate funding up to $265,000 from the Capital Improvement Fund (CIP) to implement a remediation plan that includes the installation of security cameras, decorative fencing with electronic gate access with card locks together with enhanced regulations for park use.
• Implement environmental remediation and public safety restoration to allow for safe and beneficial use of the park by residents.
• The park closure will apply to all members of the public, with limited exceptions, subject to reevaluation every 90 days.
• Prior to initiating enforcement, the City's Homeless Outreach Team, in partnership with local service providers, will conduct intensive outreach, offering services such as sheltering options, mental health resources, substance abuse counseling, and transitional housing placement.

Since the August 12, 2026 meeting, staff have worked diligently to prepare construction documents for a project which would install fencing to secure the park. Through coordination meetings, staff have identified multiple areas in which the addition and/or replacement of fencing could be beneficial at the park. As such a Base Bid Schedule and four Bid Alternate Schedules were created with the following scopes of work:
• Base Bid Schedule: Construction of 8'-tall ornamental steel tubing fencing and gates along the frontage of Sam Brannan Park, and replacement of the existing 5'-tall perimeter chain link fencing and gates at the Sam Brannan storage tank site with 8'-tall ornamental steel tubing fencing and gates.
• Bid Alternate Schedule 1: Removal of existing 6'-tall chain link fencing along the Union Pacific Railroad corridor, and replacement with 8'-tall ornamental steel tubing fencing • Bid Alternate Schedule 2: Installation of 8'-tall ornamental steel tubing fencing along the access road to the Sam Brannan storage tank site
• Bid Alternate Schedule 3: Installation of 6'-tall chain link fencing and gates between the storage tank site and tennis/pickleball courts to create a one-acre dog park with designated small and

Page 195 of 297 ends

large dog areas
• Bid Alternate Schedule 4: Replacement of failing fencing at tennis/pickleball courts with new 10'- tall chain link fencing and wind screen
The Base Bid schedule will provide fencing such that the park can be secured and provide accesscontrolled entry. The inclusion of the four Bid Alternate Schedules in the bid documents provides the City with a flexible menu of options for desired items, while also creating the potential for better pricing through economy of scale.

Based on this criterion, Xeela Engineering, LLC is the low, responsible and responsive bidder. Staff recommend awarding a construction contract to Xeela Engineering, LLC in the total amount of their base bid, $303,000.00.

Contract administration, construction management, and inspection will be performed by Public Works Department staff. Project construction is expected to begin in November 2026, weather permitting, and continue through late December 2026.

Dog Park Amenities:

If council chooses to include Bid Alternate Schedule 3 (Dog Park Fencing) in the construction contract, or to re-bid the items associated with the dog park in the future, there are multiple amenities that can be

purchased and installed by staff as desired. Below is a schedule of costs associated with the dog park amenities:

Fiscal Impact:

The estimated total construction cost for the project is approximately $348,450.00, which consists of the following components:

Construction Contract $303,000.00
Construction Contingency (10%) $30,300.00
City Administration (5%) $15,150.00
Total Project Cost: $348,450.00
Through the August 12, 2026 Council item for Sam Brannan Park, the City Manager or designee were authorized to make budget transfers of up to $265,000 in order to fund remediation and improvements to Sam Brannan Park. Additionally through the design process, security improvements to the Sam Brannan water tank were requested to be constructed under the base bid schedule. As such, fence items related to the Sam Brannan water tank are proposed to be funded by Water funds. To date, Capital Improvement Program (CIP) Account No. 1363 (Sam Brannan CIs Improvements) has not yet received any budget transfers.

These actions will ensure a total available project budget of $428,310.00. The $79,860.00 beyond the fencing project's $348,450.00 cost is being proposed to fund other security improvements at the park including cameras, lighting upgrades, and other improvements.

Staff requests that the Council authorize the Finance Director to transfer $163,310.00 from CIP Account No. 971096-65501 (Water Storage Rehabilitation) to CIP Account No. 971363-65501 (Sam Brannan CIs Improvements).

Environmental:

Staff has performed a preliminary environmental assessment of this project and has determined that it falls within Class 1 Categorical Exemption set forth in CEQA Guidelines Section 15301, as the installation of fencing within existing City facilities is a minor alteration of an existing public facility involving negligible or no expansion. Further, none of the exceptions to Categorical Exemptions set forth in CEQA Guidelines 15300.2 apply to this project.

Page 199 of 297 ends

Alternatives:

1. Instruct staff to include bid alternate schedules with direction on how to fund these additions.

This will increase total project cost.

2. Instruct staff to purchase specific dog park amenities.

3. Instruct staff to re-advertise one or more of the bid alternate schedules.

4. Instruct staff to utilize different funding sources to fund the project.

Recommendation:

Adopt a Resolution which takes the following actions:

A. Adopts a CEQA Class I Categorical Exemption
B. Awards the construction contract to Xeela Engineering LLC of Sacramento, CA, in the amount of their total base bid of $303,000.00
C. Authorizes the City Manager to execute the contract on behalf of the City subject to review and approval as to legal form by the City Attorney, and authorizes a project contingency of $30,300.00 (10%)

CITY OF YUBA CITY

STAFF REPORT
Date: October 6, 2026
To: Honorable Mayor & Members of the City Council;
From: Public Works Department
Presentation By: Joshua Wolffe, Public Works Director
Summary
Subject: Yuba City Lighting and Landscape Maintenance District No. 5, Zone of Benefit K_18 (Brownstone Estates Annexation)
Recommendation:

A. Conduct a Public Hearing
B. Adopt a Resolution confirming and ordering the annexation of parcels associated with the Brownstone Estates Subdivision Map, APNs 62-082- 019, 62-082-020, and 62-082-021, into existing Yuba City Lighting and Landscape Maintenance District No. 5, Zone of Benefit K_18 and establishing a levy of assessments for the annexed territory Fiscal Impact: $464.11 per lot, or $25,061.94 total annually for 54 lots, subject to an annual inflation index adjustment
Purpose:

To fund the ongoing operation, maintenance, and administration of street landscaping materials, irrigation systems, and street lighting.

Strategic Focus Area:

Annexing this development into a Lighting and Landscape Maintenance District (LLMD) addresses the City’s Strategic Focus Areas of maintaining infrastructure in a fiscally responsible manner, as the LLMD will ensure that street landscaping materials, irrigation systems, and street lighting are maintained and in operation through annual assessments.

Background:

The Brownstone Estates Subdivision Map Development at Assessor’s Parcel Numbers (APNs) 62-082- 019, 62-082-020, and 62-082-021 is requesting to be included in a LLMD Zone of Benefit, as required through the Conditions of Approval for the Subdivision Map (Attachment 2). Based on the characteristics of Brownstone Estates Subdivision Map’s improvements, City staff determined the bestfit option for an existing Zone of Benefit annexation is LLMD No. 5, Zone of Benefit K_18.

The existing LLMD No. 5, Zone of Benefit K_18 was established in 2017 for the Valencia Estates

Page 212 of 297 ends

subdivision, with a fee per parcel for the operation and maintenance costs associated with street landscaping materials, irrigation systems, concrete block wall, and street lighting. The fee per parcel for LLMD No. 5, Zone of Benefit K_18 includes an annual inflation factor adjustment using the Consumer Price Index (CPI).

The proposed levy amounts for the Brownstone Estates parcels have been established by City staff through the creation of an Engineer’s Report (Attachment 3). The Engineer’s Report contains a detailed estimate of annual costs to energize and maintain the streetlights, and maintain concrete block walls, street trees, landscaping materials, and irrigation systems within the Zone of Benefit. To determine the assessment for the Brownstone Estates parcels, the original assessment for Zone of Benefit K_18 has been increased to today’s dollars using the CPI.

The City has created and modified several LLMDs to encompass several commercial projects and residential subdivisions over the past few years. The process of annexing into an existing District consists of adopting multiple City Council Resolutions, holding Public Hearings, and observing rights of majority protests.

Analysis:

The Public Notice procedure for parcels requesting annexation into an existing LLMD can be waived and an expedited process can be substituted at the request of the property owners of said parcels. The authorized representatives of the Brownstone Estates Subdivision Map parcels have requested to waive the Public Hearing proceedings (Attachment 4), which has allowed the City to utilize the expedited process to annex the associated parcels into existing LLMD No. 5, Zone of Benefit K_18.

This has eliminated the need for the 45-day notice and Public Hearing for the owner of the parcel requesting annexation.

The expedited process consists of Council adopting a Resolution which initiates proceedings for the annexation of the new territory into the existing Zone of Benefit, orders a levy of assessments for the parcels requesting to be annexed into said Zone of Benefit, and then sets a Public Hearing date for all parcel owners that are currently in the Zone of Benefit. This Resolution was adopted at the September 22, 2026, City Council meeting.

The City published the required 10-day public notice for the Public Hearing in the local newspaper on Saturday, September 26. To complete the annexation, Council must conduct a Public Hearing for the owners of parcels that are currently included in the Zone of Benefit. If the Public Hearing is successful, Council must then adopt a Resolution confirming and ordering the annexation and establishing the levy of assessments.

Fiscal Impact:

Revenue from the assessed parcels is to be used to provide maintenance services and district administrative costs. The Engineer’s Report for the Brownstone Estates annexation to LLMD No. 5, Zone of Benefit K_18 determined the annual assessed amount for the parcels being annexed is $464.11 per lot, per year, or $25,061.94 total annually for 54 lots, and is subject to an annual inflation adjustment using the CPI.

Alternatives:

Do not adopt the following Resolution and fund the operation and maintenance of the streetlights, concrete block wall, landscaping materials, and irrigation systems from alternative sources.

Recommendation:

5 PART B

ESTIMATE OF ANNUAL COST OF MAINTENANCE
Yuba City Lighting and Landscape Maintenance District No. 5 Zone of Benefit K_18
(54 Parcels)
Basis of Calculation
Brownstone Estates TSM 24-04,
Background
The Brownstone Estates Development at Assessor’s Parcel Number (APN) 62-082-019, 62-082-020, and 62-082-021 is requesting to be included into a Zone of Benefit, as required through their conditions of approval for Tentative Subdivision Map (TSM 24-04). Based on the characteristics of Brownstone Estates’ improvements, the best-fit option for an existing Zone of Benefit annexation would be the existing Zone of Benefit K_18.

The existing LLMD No. 5, Zone of Benefit K_18 was established in 2017 for the Valencia Estates subdivision, with a fee per parcel for the operation and maintenance costs associated with street lighting, street trees, landscape medians, landscape strips, and landscape planters with block walls. In addition to the aforementioned improvements, funds from this annexation will also cover costs for maintenance and replacement of barricades and associated chain link fencing, sidewalks, block walls landscaping and other related items between sidewalk and block walls, and other improvements installed as defined by SHC §22525.The fee per parcel for Zone of Benefit K_18 was determined based on annual maintenance costs for the aforementioned items associated with the Valencia Estates Subdivision.

The subject parcels are planned to be split into 54 parcels. In order to determine what the assessment will be for these 54 parcels, the original assessment for Zone of Benefit K_18 will need to be increased to today’s dollars using the Consumer Price Index (CPI).

Analysis
The original estimate for annual maintenance costs in this Zone of Benefit was as follows:

Yuba City Lighting and Landscape Maintenance District No. 5 Zone of Benefit K_18
(39 Lots)
Basis of Calculation
Valencia Estates Dwg. No. 5364-D
Street Lighting – Residential Total
$109./yr x 12 lights = $1,308.00
Street Lighting – Tuly Parkway & Elmer Road Collector/Arterial $119/yr. x 7 lights = $833.00
Current cost: (5 active lights = $595.00)
Interior Street Trees –
$45/tree x 88 trees = $3,960.00

Page 232 of 297 ends

6 Tuly Parkway - Trees, Landscape Strips/Planters, and Medians $.20/ sq. ft. x 18,850 SF = $3,770.00
Elmer Road – Trees, Landscape Strips/Planters
current r/w area between edge of pavement and block wall $0.20/ sq. ft. x 8,750 SF = $1,750.00
Current cost: (Elmer Road not fully constructed = $500.00) Tuly Parkway and Elmer Avenue – Block Wall
$.50/ LF x 1,274 LF = $637.00
Subtotal = $12,258.00
CPI multiplier (1.0) $12,258.00
10% Administration = $1,225.80
Subtotal Assessment = $13,483.80
Per Lot Assessment (39 Lots) = $345.74
The above calculations show the original annual cost for maintenance per parcel ($345.74) for Zone of Benefit K_18. The table below presents the Consumer Price Index (CPI) for each year from January 2017 through January 2026. An annual multiplier was calculated to determine the appropriate increase to the annual assessment for each year was then established.

The Ridge Estates – Unit 1 Subdivision Map Development at Assessor’s Parcel Numbers (APNs) 63- 010-136 and 63-010-136 is requesting to be included in a LLMD Zone of Benefit, as required through the Conditions of Approval for the Subdivision Map. Based on the characteristics of The Ridge Estates – Unit 1 Subdivision Map’s improvements, City staff determined the best-fit option for an existing Zone of Benefit annexation is LLMD No. 5, Zone of Benefit K_18.

The existing LLMD No. 5, Zone of Benefit K_18 was established in 2017 for the Valencia Estates subdivision, with a fee per parcel for the operation and maintenance costs associated with street

Page 241 of 297 ends

landscaping materials, irrigation systems, concrete block wall, and street lighting. The fee per parcel for LLMD No. 5, Zone of Benefit K_18 includes an annual inflation factor adjustment using the Consumer Price Index (CPI).

The proposed levy amounts for The Ridge Estates – Unit 1 parcels have been established by City staff through the creation of an Engineer’s Report (Attachment 2). The Engineer’s Report contains a detailed estimate of annual costs to energize and maintain the streetlights, and maintain concrete block walls, street trees, landscaping materials, and irrigation systems within the Zone of Benefit. To determine the assessment for The Ridge Estates – Unit 1 parcels, the original assessment for Zone of Benefit K_18 has been increased to today’s dollars using the CPI.

The City has created and modified several LLMDs to encompass several commercial projects and residential subdivisions over the past few years. The process of annexing to an existing District consists of adopting multiple City Council Resolutions, holding Public Hearings, and observing rights of majority protests.

Analysis:

The Public Notice procedure for parcels requesting annexation into an existing LLMD can be waived and an expedited process can be substituted at the request of the property owners of said parcels. The authorized representatives of The Ridge Estates – Unit 1 Subdivision Map parcels have requested to waive the Public Hearing proceedings (Attachment 3), which has allowed the City to utilize the expedited process to annex the associated parcels into existing LLMD No. 5, Zone of Benefit K_18.

This has eliminated the need for the 45-day notice and Public Hearing for the owner of the parcel requesting annexation.

The expedited process consists of the City Council adopting a Resolution which initiates proceedings for the annexation of the new territory into the existing Zone of Benefit, orders a levy of assessments for the parcels requesting to be annexed into said Zone of Benefit, and then sets a Public Hearing date for all parcel owners that are currently in the Zone of Benefit.

The Engineer’s Report for The Ridge Estates – Unit 1 annexation to LLMD No. 5, Zone of Benefit K_18 determined the annual assessed amount for the parcels being annexed is $464.11 per lot, per year, or $31,559.48 total annually for 68 lots, and is subject to an annual inflation adjustment using the CPI.

Alternatives:

Do not adopt the following Resolution and fund the operation and maintenance of the streetlights, concrete block wall, landscaping materials, and irrigation systems from alternative sources.

Recommendation:

A. Conduct a Public Hearing

Page 242 of 297 ends

B. Adopt a Resolution confirming and ordering the annexation of parcels associated with The Ridge Estates – Unit 1 Subdivision Map, APNs 63-010-136 and 63-010-137, into existing Yuba City Lighting and Landscape Maintenance District No. 5, Zone of Benefit K_18 and establishing a levy of assessments for the annexed territory

ESTIMATE OF ANNUAL COST OF MAINTENANCE
Yuba City Lighting and Landscape Maintenance District No. 5 Zone of Benefit K_18
(The Ridge Unit 1)
Basis of Calculation
The Ridge Unit 1 TM 25-01,
Background
The Ridge Unit 1 Development at Assessor’s Parcel Number (APN) 063-010-136 and 063-010-137 is requesting to be included into a Zone of Benefit, as required through their conditions of approval for Tentative Subdivision Map (TSM 25-01). Based on the characteristics of The Ridge Unit 1’s improvements, the best-fit option for an existing Zone of Benefit annexation would be the existing Zone of Benefit K_18.

The subject parcels are planned to be split into 68 parcels. In order to determine what the assessment will be for these 68 parcels, the original assessment for Zone of Benefit K_18 will need to be increased to today’s dollars using the Consumer Price Index (CPI).

Analysis
The original estimate for annual maintenance costs in this Zone of Benefit was as follows:

Yuba City Lighting and Landscape Maintenance District No. 5 Zone of Benefit K_18
(39 Lots)
Basis of Calculation
Valencia Estates Dwg. No. 5364-D
Street Lighting – Residential Total
$109./yr x 12 lights = $1,308.00
Street Lighting – Tuly Parkway & Elmer Road Collector/Arterial $119/yr. x 7 lights = $833.00
Current cost: (5 active lights = $595.00)
Interior Street Trees –
$45/tree x 88 trees = $3,960.00

Page 261 of 297 ends

6 Tuly Parkway - Trees, Landscape Strips/Planters, and Medians $.20/ sq. ft. x 18,850 SF = $3,770.00
Elmer Road – Trees, Landscape Strips/Planters
current r/w area between edge of pavement and block wall $0.20/ sq. ft. x 8,750 SF = $1,750.00
Current cost: (Elmer Road not fully constructed = $500.00) Tuly Parkway and Elmer Avenue – Block Wall
$.50/ LF x 1,274 LF = $637.00
Subtotal = $12,258.00

STAFF REPORT
Date: October 6, 2026
To: Honorable Mayor & Members of the City Council;
From: Public Works Department
Presentation By: Joshua Wolffe, Public Works Director
Summary
Subject: Yuba City Lighting and Landscape Maintenance District No. 5, Zone of Benefit K_18 (The Ridge Estates – Unit 2 Annexation)
Recommendation:

A. Conduct a Public Hearing
B. Adopt a Resolution confirming and ordering the annexation of parcels associated with The Ridge Estates – Unit 2 Subdivision Map, APNs 63- 010-136 and 63-010-137, into existing Yuba City Lighting and Landscape Maintenance District No. 5, Zone of Benefit K_18 and establishing a levy of assessments for the annexed territory
Fiscal Impact: $464.11 per lot, or $33,880.33 total annually for 73 lots, subject to an annual inflation index adjustment

Background:

The Ridge Estates – Unit 2 Subdivision Map Development at Assessor’s Parcel Numbers (APNs) 63- 010-136 and 63-010-136 is requesting to be included into a LLMD Zone of Benefit, as required through the Conditions of Approval for the Subdivision Map. Based on the characteristics of The Ridge Estates – Unit 2 Subdivision Map’s improvements, City staff determined the best-fit option for an existing Zone of Benefit annexation is LLMD No. 5, Zone of Benefit K_18.

The existing LLMD No. 5, Zone of Benefit K_18 was established in 2017 for the Valencia Estates

subdivision, with a fee per parcel for the operation and maintenance costs associated with street landscaping materials, irrigation systems, concrete block wall, and street lighting. The fee per parcel for LLMD No. 5, Zone of Benefit K_18 includes an annual inflation factor adjustment using the Consumer Price Index (CPI).

The proposed levy amounts for The Ridge Estates – Unit 2 parcels have been established by City staff through the creation of an Engineer’s Report (Attachment 2). The Engineer’s Report contains a detailed estimate of annual costs to energize and maintain the streetlights, and maintain concrete block walls, street trees, landscaping materials, and irrigation systems within the Zone of Benefit. To determine the assessment for The Ridge Estates – Unit 2 parcels, the original assessment for Zone of Benefit K_18 has been increased to today’s dollars using the CPI.

The authorized representatives of The Ridge Estates – Unit 2 Subdivision Map parcels have requested to waive the Public Hearing proceedings (Attachment 3), which has allowed the City to utilize the expedited process to annex the associated parcels into existing LLMD No.

The Engineer’s Report for The Ridge Estates – Unit 2 annexation to LLMD No. 5, Zone of Benefit K_18 determined the annual assessed amount for the parcels being annexed is $464.11 per lot, per year, or $33,880.33 total annually for 73 lots, and is subject to an annual inflation adjustment using the CPI.

Alternatives:

Do not adopt the following Resolution and fund the operation and maintenance of the streetlights, concrete block wall, landscaping materials, and irrigation systems from alternative sources.

The improvements to be maintained subject to this report include operations and maintenance costs associated with the street lighting, street trees, landscape medians, landscape strips, paseo, and landscape planters with block walls, as described within the original “Engineer’s Report, Yuba City Lighting and Landscape District No. 5, Zone of Benefit K_18, Valencia Estates”. The area requesting annexation into District 5, Zone of Benefit K_18 includes: The Ridge Unit 2 (TSM 25-01), on Assessor’s Parcel Number 063-010-136 and 063-010-137 located south of Spirit Way, north of Imperial Way, and west of El Margarita in Yuba City. 5 PART B

ESTIMATE OF ANNUAL COST OF MAINTENANCE
Yuba City Lighting and Landscape Maintenance District No. 5 Zone of Benefit K_18
(The Ridge Unit 2)
Basis of Calculation
The Ridge Unit 2 TM 25-01,
Background
The Ridge Unit 2 Development at Assessor’s Parcel Number (APN) 063-010-136 and 063-010-137 is requesting to be included into a Zone of Benefit, as required through their conditions of approval for Tentative Subdivision Map (TSM 25-01). Based on the characteristics of The Ridge Unit 2’s improvements, the best-fit option for an existing Zone of Benefit annexation would be the existing Zone of Benefit K_18.

The subject parcels are planned to be split into 73 parcels. In order to determine what the assessment will be for these 73 parcels, the original assessment for Zone of Benefit K_18 will need to be increased to today’s dollars using the Consumer Price Index (CPI).

Analysis
The original estimate for annual maintenance costs in this Zone of Benefit was as follows:

Yuba City Lighting and Landscape Maintenance District No. 5 Zone of Benefit K_18
(39 Lots)
Basis of Calculation
Valencia Estates Dwg. No. 5364-D
Street Lighting – Residential Total
$109./yr x 12 lights = $1,308.00
Street Lighting – Tuly Parkway & Elmer Road Collector/Arterial $119/yr. x 7 lights = $833.00
Current cost: (5 active lights = $595.00)
Interior Street Trees –
$45/tree x 88 trees = $3,960.00

Page 288 of 297 ends

6 Tuly Parkway - Trees, Landscape Strips/Planters, and Medians $.20/ sq. ft. x 18,850 SF = $3,770.00
Elmer Road – Trees, Landscape Strips/Planters
current r/w area between edge of pavement and block wall $0.20/ sq. ft. x 8,750 SF = $1,750.00
Current cost: (Elmer Road not fully constructed = $500.00) Tuly Parkway and Elmer Avenue – Block Wall
$.50/ LF x 1,274 LF = $637.00
Subtotal = $12,258.00
