Hi Jessica,
Thanks for the reply. As I said in my email I am not pursuing a public records request at this time... I am just researching for information about private wells. When I asked Patrick about it he referred me to you and I am not sure why since planning seems to be involved in the application process and he has knowledge of other private wells in AG. A public records request involves more resources and effort than is necessary in my opinion. I have also found the council agenda/minutes which does have information regarding wells and I am able to use this for now.

Thanks,
Mike

Mike,

Thank you for reaching out. From what I read, you are requesting documentation of all private wells in the City as well as the applications and permits for those wells. Is that correct?

If so, this email can serve as a public records request and we will process accordingly.

However, if you just have questions about private wells that don’t require staff to research specific records, we can connect you with Engineering and/or Public Works staff.

Please confirm and we will go from there.

Thank you,

Hi Jessica,

I was given your name by Patrick Holub regarding information about existing private wells in the City.

Patrick mentioned that I would likely need to file a request for public records. I want to be clear this is not a public records request at this time.

I am looking for information regarding the number and location of existing private wells in the City and the applications and permits associated with these wells.

I don't want to cause unnecessary work for City staff and I thought it would be more efficient to just have a discussion with someone that has knowledge of this information.

Mike, is there anything in particular that you are looking for? We can provide you information on the locations of other wells if that is what you want. In my experience over the past 8 years working here, there are not many domestic wells being requested in the City. Furthermore, I am not aware of another domestic well that was approved as anything other than a replacement well. If you can let me know what information you’re seeking, we can provide what we have.

Richard, thanks for the call just now regarding the well application. During review of the staff report, I was asked to see if you could provide more information on the cost related to the installation of the well. If you can provide that information, I think that should be sufficient for the Council to make a well-informed decision. A format similar to the cost estimate from your contractor would be great.

Reach out with any questions. Thank you.

I won't have any problem getting that to you by ear;ly next week. Please remind me, is there anything else but the cost estimate that we need to provide the City at this time?

7 Hi, Richard. That is a good question. If we were to recommend that the Council denies the request, that would likely involve a discussion with our City Manager. I don't think that is going to be likely once you present the numbers, but we can meet and discuss before that point so that no one is surprised.

I'm hoping you can provide an update to the well permit application that was filed for the Harris property on Equestrian and Noyes. I had been in touch with Patrick who was preparing the staff report for our pending council presentation (we were originally targeting the 3/28 meeting) but have run into delays in getting guidance from City staff on the matter. After reaching out again yesterday I received an automated email response saying Patirck would be out of the office until 5/1.

The applicant is looking for some insight into when the staff report will be complete and available for our review as well as what staff's recommendations will be in regards to supporting the proposed well or not. We had originally met with Shane and Patrick on Feb 16th to discuss the project and have promptly provided additional information as requests from Patrick have come through.

Any info you could provide on this matter would be greatly appreciated.

After several discussions with our staff, we do not feel that it is in the best interest of the City to allow a domestic well at this location. At this point, we will be writing a staff report recommending that the City Council deny the request. Alternatively, if you do not wish to go through the process with the Council, you have the option of withdrawing your application. The permit number I was given is PPR23-000001

Please let me know what else we need to provide at this time to process this permit request.

Good morning, Richard. After several discussions with our staff, we do not feel that it is in the best interest of the City to allow a domestic well at this location. At this point, we will be writing a staff report recommending that the City Council deny the request. I’ve asked our City Clerk to advise a meeting date where that discussion could be held and I will provide that information to you once I receive it.

Alternatively, if you do not wish to go through the process with the Council, you have the option of withdrawing your application. If you choose to go this route, you would be eligible for a refund of your permit fees. If you request a refund after any hearing is scheduled, you would not be eligible to receive a refund.

Please let me know what you prefer. I’m happy to have another discussion if you have questions. Thanks,

Good Morning Andrew,

Thank you

2 Good morning, Richard.

I'm hoping you can provide an update to the well permit application that was filed for the Harris property on Equestrian and Noyes. I had been in touch with Patrick who was preparing the staff report for our pending council presentation (we were originally targeting the 3/28 meeting) but have run into delays in getting guidance from

Page 1586 of 1799 ends

3 City staff on the matter.

Thank you

Hi Patrick,

This is disappointing news. I don't think the property owner is interested in an application refund at this point, but we would like to see the staff report once it's available along with any other information the city used to come to this determination?
Thanks for your help

Thank you

Richard, thanks for the call just now regarding the well application. During review of the staff report, I was asked to see if you could provide more information on the cost related to the installation of the well. If you can provide that information, I think that should be sufficient for the Council to make a well-informed decision. A format similar to the cost estimate from your contractor would be great.

Reach out with any questions. Thank you.

Cc: Patrick Holub; Mike Harris; [email protected] Subject: Harris Property Well Application - Summary
Hello Brian,
Thanks for taking the time to discuss the City's concerns regarding the well application for the property owner by Mike Harris. Obviously, we were disappointed to hear that the City's position on the matter would not be supportive of the application submitted, especially considering that our original communications with Andrew and Patrick suggested that this would not be a contested issue. To recap I have provided a chronological account of email correspondence between City staff and our team below:

Prior to Mike purchasing the property we reached out to City staff to relay his desired development goals.

Oct 12 2021 - Andrew Perez: "My research revealed that the Noyes Road properties could be developed with one single-family residence on each parcel for a total of two units without a discretionary permit." Andrew goes on to say that "portions of these parcels are considered environmentally sensitive due to steep slopes, rare vegetation, wetland or riparian habitat, etc." The City is now suggesting that it is both "practical and feasible" to trench a water line through a potentially environmentally sensitive area in-lieu of a well that would avoid these areas all together at significantly less cost.

Andrew’s input was a critical component in Mr. Harris’s decision to ultimately purchase the property.

Sep 30, 2022 - Filipponi & Thompson Drilling Inc submitted a water well application to San Luis Obispo County.

Oct 17, 2022 - Carrie Zuur-Lopez (of San Luis Obispo County Health Agency) provided Shane Taylor with the well permit application for review and comment. Carrie specifically asked Shane to "provide any supporting documentation/evidence of prohibition or restrictions." Oct 18, 2022 - Shane emailed Carrie that (from the City Code) "the City Council is required to review and approve the application. No such action has occurred concerning this parcel." The City Code actually says, "the application and recommendations of the (county) health officer for a new well shall be submitted to the council." Carrie did provide Shane with the application and asked for review and comments.

Oct 19, 2022 - Emily Willeford (of Filipponi & Thompson Drilling Inc) emailed Mike indicating that Shane told her that water is available to the property, and included the contents of the Shane Taylor email.

Nov 30, 2022 - Mike emailed Andrew asking who should be contacted regarding a water well permit.

Dec 5, 2022 - Mike emailed Bill Robeson requesting assistance in processing a well application.

Page 1635 of 1799 ends

2 Dec 13, 2022 - Andrew emailed Richard with information on how to apply for a review of the water well application.

Jan 26, 2023 - A minor use permit application, for the well, was submitted to the City.

Feb 7, 2023 - Patrick confirms receipt of the application and mentions that Shane will be looped in on the review.

Patrick suggests a meeting with Shane to discuss the possibility of connecting to the water tank above the property which was held on 2/16/2023
Feb 23, 2023 - Patrick suggests that approval is likely due to high construction costs of running the line to the water tank and mentions that denial would "likely include discussions with the City manager." Mar 9, 2023 - Patrick asks for a "feasibility calculation" be provided addressing construction costs of the water line installation, and also mentions that his staff report was "95% prepared" and just needed the cost estimate to support his recommendation to approve the well.

Mar 20, 2023 - A cost estimate was provided by Nash Construction. It's worth noting that details regarding how the connection would be made at the water tank were not discussed in detail with Shane and therefore these costs were not included in the estimate.

Mar 20, 2023 - Patrick mentions that he has sent the staff report for "Final round of review" and that we would be on the CC agenda for 3/28.

Mar 21, 2023 - Patrick requests a cost estimate for the construction of the well so that council can "make a well-informed decision". The applicant already had this estimate on-hand and it was provided to Patrick later that day.

Mar 29, 2023 – Patrick notified Mike that "I’m still waiting on more information from our City Manager regarding this item. I haven’t had a chance to speak with her to see if she has any particular concerns, though, so I don’t think a meeting would be very productive at this time." Mar 29, 2023 - Patrick emailed Mike that "I don’t necessarily think there are any concerns specific to your proposal. We’ve been discussing our Utility Manager’s general opinion that a connection to the City’s system would be preferred, is feasible and is practical."
Mar 29, 2023 - Mike emailed Patrick "If the opinion has already been formed that the connection is feasible and practical I would expect that the City could share specifics on how the connection would be made and the costs involved for the City and myself." To date, the City has provided no cost information regarding the total cost to connect to the City water supply as envisioned by the City.

Apr 3, 2023 - Patrick emailed Mike "I am not aware of another domestic well that was approved as anything other than a replacement well." The City has approved new water wells, a report on January 12, 2021 recommended to the City Council the approval of a new well to service 580 Easy Street for domestic supply.

There was no existing well to be replaced at 580 Easy Street according to the report.

Apr 3, 2023 - Patrick emailed Mike and Richard that "We have a meeting scheduled tomorrow to meet with our Public Works staff."
Apr 17, 2023 - Richard emailed Patrick asking for the status of the application. He received an automated email response saying Patrick would be out of the office until 5/1.

Page 1636 of 1799 ends

3 Apr 18, 2023 - Richard emailed Andrew asking for the status of the application.

May 1, 2023 - After receiving all requested information from the applicant Patrick sent an email stating "After several discussions with our staff, we do not feel that it is in the best interest of the City to allow a domestic well at this location. At this point, we will be writing a staff report recommending that the City Council deny the request."
May 10, 2023 - Call with Brian and Patrick to discuss City's position.

On this call I heard two initial concerns articulated:
1) Precedent - Going back to 2017 there seems to have been only 6 applications presented to council regarding well requests, and all were approved. It is also my understanding that 3 of the applications were for "well replacement", 2 were for new wells, and 1 was for a temporary well on the current applicant's property. If anything, it seems that precedent has already been set in our favor. In addition, this seems to be a "one of a kind" property within the City limits in terms of its size and current zoning and therefore it is unlikely that approving this application would put the City in the position of having to approve similar requests. The size of the property and development goals of the applicant require connection lengths that are not likely to be found elsewhere within the city limits.
2) Feasible and Practical - The definition of feasibility: possible to do easily or conveniently. The applicant has provided costs for both connecting to the water tank and drilling the well. These estimates show that the City water line would cost significantly more than drilling the well. Based on this definition I think that suggesting a construction method that requires trenching a utility line through land that is, as Andrew stated in his email on 10/21/21 "environmentally sensitive due to steep slopes, rare vegetation" does not qualify as feasible. We understand that it is possible but do not believe it is feasible or practical as defined and applied by the City in past well applications.

As our call continued two additional concerns were expressed:
 Utilities Department: Shane, with utilities, "doesn't like the idea" of approving the well. Land Use: City Planning Department had envisioned the property being subdivided and further developed. As I mentioned on our call, the current property owner has no plans for subdividing the property and instead intends on building a primary residence for his family to enjoy. With current zoning and land use, it is clear that developing the property as a single-family residence with no subdivision or lot split would be the most straightforward path to a project approval as it would not require any land-use amendments or discretionary permitting. This messaging was then expanded upon when you mentioned that the "City had envisioned future development" for the property. The fact remains that the current property owner does not intend on subdividing the property and would be acting within the development guidelines articulated in both the current zoning and land-use elements.

As I prepare to continue to advocate for the applicant, I would like to continue to engage with City staff in good faith to alleviate the concerns expressed to date. In an attempt to achieve this, I propose that staff consider revising the staff report to be in support of the well application with the condition the property owner must remove or abandon the well as a condition of any future project that would subdivide the property. Language to this effect was written into the previous report that supported the temporary well which was approved by council on this property and is a reasonable condition to place on the approval of the current application.

We wish to continue working with City staff on coming to a reasonable arrangement that would both allow for the well to be constructed and relieve City staff of any concerns regarding bigger development projects that might be presented for the property in the future.

Subject: Update on policy meeting and costs
Hi Brian,
I wanted to see if I could get an update on the policy meeting you referred to in our meeting on June 15th. Do you have any feedback from that policy meeting?
If policy allows you to move forward with evaluating the feasibility of connecting to the city water system I wanted to see if you had a chance to determine the total cost (to me) for connecting to the city water system. We would also like additional details on the proposed means of connecting to the city water.

Please let me know at your earliest convenience.

Thanks,
Mike

Subject: Re: Hello
Hi Kate,
I am following up on my email that I sent to you on March 23. The reason I sent the email to you was that I believe you are the City Council member that was elected in the district where my property is located.

You may remember that I introduced myself to you after the City Council meeting that was held on March 28.

As I think I mentioned when we talked, I bought the property because my dream is to move my family and my business to Arroyo Grande. My great grandfather and great grandmother were pioneers in Arroyo Grande before it was even a city. They are buried in the St. Patrick cemetery on W Branch St. My grandfather (my mom's father lived in Arroyo Grande (in the Village) from the age of 10 until about 30. He worked as a butcher at the Arroyo Grande Meat Company for the Wilkenson family. He met my grandmother (who was born in Nipomo) at a dance in Pismo Beach around 1920. Most of my relatives moved out of the area in the 1920s/1930s. I went to Cal Poly and met my wife there and my three kids also went to Cal Poly so we have strong connections to Arroyo Grande and the area and we have always wanted to relocate at some point.

At that time of the March 28 meeting I was under the impression that my well application was moving through the process with the City. Unfortunately, about that time, things seemed to change at the City with respect to my application. I still do not understand why the City changed their position or the current status of my application and this has been very frustrating. I am at a loss of how to proceed so I am going to send an email to the City Council members requesting help. I would have preferred to just move through the process with the City but that has simply not worked.

I was told directly in a meeting that the City did not want to present my well application to the City Council if their recommendation was to not approve. I believe, as a result, that the staff report and scheduling with the City Council have been delayed unnecessarily. I was offered a refund if I would retract my well application but I am not interested because it is neither feasible nor practical to connect to the City water system.

I am not really sure how this will be resolved but I would appreciate any feedback or help that you or the City Council can provide.

Thanks,
Mike Harris

I was wondering if you might have some time to meet next week, possibly at the property. I currently live in Granite Bay (which is outside Sacramento) but I will be in the central coast next week.

Subject: A request for assistance
My name is Mike Harris and I am a property owner in the City. My property (three parcels) is the 55 acres at the corner of Noyes Road and Equestrian Way. I am writing to you today regarding a water well application (PPR23-000001) that was submitted to the City on January 26, 2023. I engaged the services of civil engineer Richard Burde of SLO Civil Design and geologist Timothy Cleath of Cleath-Harris Geologists to help me with this project. The parcel related to this application is parcel number 007-781-055.

My understanding was that after the application was submitted City staff would write a staff report that would make a recommendation to the City Council to either approve or not approve my well application. It has been approximately 6 months since the permit/application was submitted to the City yet no staff report has been provided and it has not been scheduled for any City Council meeting.

The City has not provided any reasonable justification for the delay and lack of progress on my application. I have travelled to Arroyo Grande from my current residence in Granite Bay on three occasions based on the expectation that my application would be on the City Council meeting agenda. I have also had to spend thousands of dollars (in application and consulting fees along with travel expenses) trying to get the City staff to do their job. I have made a good faith effort to work with the City on this matter. I am asking you for your assistance.

The City has been aware of the well application with the County since October 17, 2022. Carrie Zuur-Lopez (from SLO County Health Agency) emailed Shane Taylor and included the well permit application for the City's review. On October 18, 2022 Shane Taylor sent a reply to Carrie Zuur-Lopez indicating that the City Council is required to review and approve the application. Shane Taylor cc'd Andrew Perez, Bill Robeson, and Brian Pedrotti on that email.

On March 9, 2023 Patrick Holub communicated to Richard Burde that his staff report was "95% prepared" and just needed the cost estimate to support his recommendation to approve the well. We provided Patrick with all cost information requested in a very timely manner. The City has never provided us with any cost information on a feasible and practical connection to the City water system.

Shane Taylor presented an alternative to drilling the well with an idea that would have me connect to the city's water system at the tank above my property. This would be a highly unconventional way to provide service to a private property for several reasons and would also add significant construction obstacles as the water line would need to be trenched through established oak groves and rock outcropping visible from the surface.

On March 20 Patrick Holub indicated that he had sent the staff report for the "final round of review" and that we would be on the City Council agenda for March 28.

During the time period from March 20 to May 1 communications from the City went dark and when we eventually heard back from Patrick we were surprised and disappointed to learn that he had been instructed to change the staff report from a "Recommendation to Approve" to "Recommendation to Not Approve" position .

Page 1644 of 1799 ends

2 Something had changed but the City was not transparent as to what had changed despite numerous requests from myself or Richard Burde.

On May 1, 2023 Patrick Holub notified us "After several discussions with our staff, we do not feel that it is in the best interest of the City to allow a domestic well at this location. At this point, we will be writing a staff report recommending that the City Council deny the request." On June 15th Richard Burde and I met at the City offices with Patrick Holub and Brian Pedrotti. I asked specifically what was meant by "best interest of the City" and received no coherent response. I was told that the city was concerned about precedent. (It should be noted that precedent has no effect on whether connecting to the City water system is or is not feasible and practical.) I mentioned that precedent was not an element or part of the City Municipal Code related to water well approvals. When connection obstacles related to Shane's idea were expressed to Brain and Patrick during this meeting it was clear from their reaction that they had not considered the extra costs and impacts Shane's proposed connection would add. This left us with the feeling that City staff was prepared to write the staff report "Not to Recommend Approval" based on the "feasible and practical" argument without considering many of the primary reasons we feel a well should be approved.

I asked, more than once, at this meeting if Brian or Partick had any cost information relating to the cost of connecting to the city water system. Neither Brian or Patrick were aware of the cost of connecting (or how the actual connection would be made) to the city water system. I expressed that it is unreasonable for the City to conclude that it is feasible and practical to connect to the city water system without any information on the cost which I would be required to pay for the connection. I was told by Brian that the City would have a meeting to determine if City "policy" precludes me from having a well on my property. This was the first time I had heard that a City "policy" would be a factor. I was also told that Patrick or Brian would follow up and provide me with the cost information for my potential connection to the City water system.

On June 27, 2023 I sent an email to Brian Pedrotti and Patrick Holub asking for a status update on their "policy" meeting and for the cost information for my proposed connection to the City water system.

As of July 21, 2023 I have received no reply from either Brian Pedrotti or Patrick Holub. This is unacceptable and the lack of accountability and responsibility has gone on too long. As a property owner and taxpayer of the City I would expect, at a minimum, a courtesy reply indicating that my request was received. I have repeatedly either received no response or an unreasonably slow response from the City. The City is not living up to its Organizational Values.

We have made significant effort to engage in a discussion regarding the lack of feasibility and practicality of connecting to the City water system. Staff reports for previous well applications that have been presented to City Council have had the following comments related to "feasible and practical":
 (Easy Street - 2021) The neighborhood that includes the subject parcel also includes several other properties off of Easy Street and nearby Printz Road that use domestic wells for water supply. If utilities were to be extended to serve the property, it would likely be from La Canada and would be available to serve all the properties in the neighborhood. The City does not have any plans to extend water utility infrastructure to or near the property and service from the City’s water system is considered neither practical nor feasible at this time. The nearest existing water main is approximately 1000’ from the property and connection to this main would require significant infrastructure improvements and for the City to obtain numerous easements.  (Printz Road - 2018) The neighborhood that includes the subject parcel also includes several other properties off of Printz Road and Easy Street that use domestic wells for water supply. If utilities were to be extended to serve the property, it would likely be from La Canada and serve all the properties in the neighborhood. The City does not have any plans to extend water utility infrastructure to or near

3 the property and service from the City’s water system is considered neither practical nor feasible at this time.
 (East Cherry Ave - 2017) The City currently serves the property with potable water for domestic and fire protection purposes. The property is connected to the City’s water main on East Cherry Avenue. The City currently does not provide irrigation water to any agriculturally zoned parcels within the City limits. A separate connection to the City’s water system would be required to irrigate the 7-acre parcel. A properly sized meter connection would be a substantial cost to the applicant. The City’s current water supply analysis does not account for this connection in that the City does not serve agricultural lands with potable water for irrigation purposes.  (Flora Road - 2015) The City currently does not serve agricultural lands with potable water for irrigation purposes. The property is connected to the City's water system for domestic use; however, a separate connection to the City water system would be required to irrigate the 9 acres of farmland. A properly sized meter would be a substantial cost to the applicant. For these reasons, it is not practical to supply agricultural water from the City's water system.

Images of the Parcel
The parcel in question is adjacent to Noyes Road which can be seen along the left side of the image. The City is proposing that we trench from an area near Noyes Road up the steep slope through rocks and protected oak trees to the water tank which is shown at the top-middle of the image.

The red highlighted areas have over 30% slope (from the SLO County GIS). There is no access to the City water tank area without traversing these significantly sloped areas.

Page 1646 of 1799 ends

4 Reasonable access to the City water system requires trenching of over 2,000 feet. Access to City water system via water tank area (2,068 ft)
Access to City water system via Equestrian Way (2,340 ft)

Good morning Mike,
Thank you for letting us know about your frustrations with this item, and I apologize for our part in the delays associated with getting this processed. Although I would characterize some of our past discussions differently, I agree that we can move forward to reach a conclusion and get it scheduled for a hearing. As I recall from our last meeting, the next step was to schedule a meeting onsite with you and staff from CDD and Public Works to more fully understand the physical constraints of the site and for you to show your concerns with connection feasibility. I will coordinate with Public Works today and pull some dates together to send to you and your team. Please feel free to contact me if you have any questions.

3 The City has been aware of the well application with the County since October 17, 2022.

Something had changed but the City was not transparent as to what had changed despite numerous requests from myself or Richard Burde.

On May 1, 2023 Patrick Holub notified us "After several discussions with our staff, we do not feel that it is in the best interest of the City to allow a domestic well at this location. At this point, we will be writing a staff report recommending that the City Council deny the request."
On June 15th Richard Burde and I met at the City offices with Patrick Holub and Brian Pedrotti.

As a property owner and taxpayer of the City I would

Page 1658 of 1799 ends

4 expect, at a minimum, a courtesy reply indicating that my request was received.

The City does not have any plans to extend water utility infrastructure to or near the property and service from the City’s water system is considered neither practical nor feasible at this time.

Page 1659 of 1799 ends

5 The red highlighted areas have over 30% slope (from the SLO County GIS). There is no access to the City water tank area without traversing these significantly sloped areas.

Reasonable access to the City water system requires trenching of over 2,000 feet. Access to City water system via water tank area (2,068 ft)

Page 1660 of 1799 ends

6 Access to City water system via Equestrian Way (2,340 ft) I would appreciate any assistance you can provide in getting a copy of the staff report and to have my well application presented to the City Council for consideration.

If you have any questions or if we can provide any additional information please feel free to contact myself or Richard Burde or Tim Cleath (they have been CC'd on this email).

Thank you for your time,

Hello Mr. HarrisI am sorry for your frustration and the delays you have experienced.

It’s clear from your email that the situation is quite complicated in both land use and water arenas. At this time it would be inappropriate for me, an elected official, to step in where multiple agencies are in loved and have not completed their analyses. If there are avoidable delays on our part, you have my apologies.

I have ccd in our City Manager, CD Director Pedrotti, and Patrick Hollingsworth so they can bring us up to speed on where we are in the process.

Hope that helps.

Good morning Brian,
Thank you for your reply. I am certain that the "next step" from our meeting was that you were going to have a meeting to discuss "policy". At our meeting, I specifically stated that there was no need for an on-site visit (which I have offered to city staff as far back as March 29) if the City has a policy which precluded a well on my property. Also, if the City has already made the determination that a connection is feasible and practical (which it has) then there is no reason to have an on-site visit. I also referred to this "policy" meeting in my email to you on June 27 to which I received no reply.

We also discussed that you were going to contact Public Works and provide the cost information for a connection to the City water system. I am sure you recall my disbelief that you determined that a connection to the City water system was feasible and practical even though you had no information regarding the cost of such a connection. The primary factor in considering feasibility and practicality will always be cost. A difficult or complex connection will always be reflected in the cost. We requested the cost information as well as the actual method/design of the connection be provided. No cost information has ever been provided (except cost information that we have provided to you).

We have provided our concerns regarding connection feasibility on many occasions. Each of our concerns were dismissed offhand by Shane Taylor at a meeting between Richard Burde, Tim Cleath, Patrick Holub and Shane that took place on February 16. On October 19, 2022 Shane communicated to Emily Willeford (Filipponi & Thompson Drilling Inc) that city water is available to me. There is no City water accessible via a public right of way to my parcel. The connection being proposed by Shane appears to be through City owned property/infrastructure not located within a public right of way but through private property owned by the City.

It is my understanding that making a connection would require an easement be granted to me so that my meter and water lateral connection be located on the property legally. This subtle but critical component of Shane's recommended connection plan did not seem to be considered prior to making the determination to not recommend approval of my well application. From the outset, there seems to be a bias that has precluded a serious and open determination of feasibility.

You have already communicated that a connection to the City water system on my parcel is feasible and practical and that a well on my property is not in the best interest of the city (email from Patrick on May 1 - "After several discussions with our staff, we do not feel that it is in the best interest of the City to allow a domestic well at this location")
Again, I respectfully request that you provide the cost and design information for the connection that has already been determined feasible and practical. I am also requesting a copy of the staff report that was distributed for "final review" (email from Patrick dated March 20 - "I sent the staff report for a final round of review last week.") These documents should be made available to me without delay.

If a final decision regarding my well application has not been made by City staff, then I continue to be more

2 than willing to have any discussion or meetings that are needed to help facilitate this process.

Mike

Sincerely,
