Any unspent funds from the conceptual design will be used towards the construction of the Teri G. Muse Family Service Center.

Congressional Earmark Allocation Gilbert Cisneros $3,150,000 Total $4,021,075

BACKGROUND:

At their October 6, 2021, City Council meeting, City Council directed staff to add the Family Service Center to the preliminary ARPA list to construct a new facility. The proposed site is located at a City-owned parking lot on Laurens Avenue adjacent to Morgan Park.

At their January 19, 2022, City Council meeting, staff recommended that City Council define the scope of work for the project, provide direction and authorize funding for the development of an initial conceptual design, environmental review, and an amendment to the Downtown Specific Plan, if needed. After Council discussion, the City Council directed staff to develop conceptual design options for a Family Service Center at the Morgan Street and Laurens Avenue parking lot a parking structure.

At their August 3, 2022, City Council meeting, staff recommended that City Council define the scope of work for the project, provide direction and authorize funding for the development of an initial conceptual design. City Council directed staff to incorporate the staff’s input for best practices for a new conceptual design. The Teri G.

Muse Family Service Center has a long history of providing residents of the City with a centralized facility where non-profit, social, health and educational service providers can offer residents low-cost or no-cost programs, information, and/or services to overcome daily challenges, achieve educational goals, and improve quality of life. Clients may access resources in person or via hybrid models. The current high need for social services across the community has demonstrated a need to expand the facility requirements to ensure adequate space is available to meet the needs of the highly requested services. The existing facility is 5,150 square feet, which includes an executive boardroom, six (6) offices, kitchen, community pantry, meeting room and small assembly hall. Developing a concept plan will assist in furthering discussion.

At their December 4, 2024, City Council Meeting, City Council awarded an agreement to SVA Architects, Inc. to develop a conceptual design for the Teri G. Muse Family Service Center. The scope of work outlined in the RFP includes the development of two (2) preliminary conceptual alternatives: a 12,000-square foot one-story option and a 24,000-square foot two-story option. SVA Architects is responsible for delivering final conceptual design for both alternatives, including color site plans, detailed floor plans, and building elevations. These conceptual plans are intended to reflect input from facility users, ensuring that the design is both functional and responsive to the needs of the community.

To support this process, staff organized a series of collaborative meetings with nonprofit partners and facility users to present the alternative floor plan layouts. These sessions facilitated open dialogue, enabling stakeholders to provide meaningful feedback that was carefully incorporated into the final conceptual plans. Additionally, staff conducted site visits to other comparable facilities to observe best practices in design, operational efficiency, and layout, ensuring that the proposed improvements align with proven strategies for functional and

user-friendly family service centers.

DISCUSSION:

At their September 17, 2025, City Council meeting, staff presented conceptual plans for the proposed Family Service Center for City Council review and feedback. The conceptual plan proposes demolishing the existing facility and relocating the new building toward the front of the lot to enhance visibility and accessibility. The expansion plans are designed to fully comply with the Americans with Disabilities Act (ADA), support a thoughtful interior flow to maximize usability, and preserve the Spanish-style architectural character consistent with surrounding city facilities.

Key features of the conceptual designs include a lobby, two (2) waiting areas (one specifically for families), restrooms, intake offices, control points, food pantry, clothing closet, executive boardrooms, celebration hall, kitchenette, storage rooms, and a outdoor terrace. Collectively, these features create a comprehensive and cohesive vision that balances functional improvements with architectural integrity, enhanced visibility, and accessibility.

During the City Council discussion, Councilmembers expressed interest in evaluating an additional design alternative that would incorporate an outdoor venue balcony into the second-floor layout. In response to Council direction, SVA Architects, Inc. revised the conceptual plans to include an additional alternative identified as “Conceptual Option C,” which incorporates the requested outdoor balcony feature. The balcony design also includes mitigated features intended to reduce sound transmission and minimize potential noise impacts. The revised conceptual design options are now presented for City Council consideration and direction.

Staff recommend that the City Council review the conceptual design alternatives identified as Options A through C, select a preferred design option, and approve the final conceptual plans for the Family Service Center project.

ALTERNATIVES:

The alternative is not to approve the conceptual designs and provide alternative direction.

CEQA REVIEW:

ITEM NO: 12.

STAFF REPORT

TO: Honorable Mayor and Members of the City Council
FROM: Manuel Carrillo Jr, Chief Executive Officer
Okina Dor, Director of Community Development
Christian L. Bettenhausen, City Attorney
PREPARED BY: City Attorneys' Office
DATE: June 3, 2026

SUBJECT: Proposed Establishment of 45-Day Moratorium on the Approval, Establishment, or Operation of Battery Energy Storage Systems Facilities (Urgency Ordinance No. 1526)

SUMMARY:

The proposed moratorium ordinance is recommended as a means of temporarily halting the approval, establishment, and operation of Battery Energy Storage Systems (“BESS”) facilities within all zoning districts in the City for an initial period of 45 days to allow City staff to analyze and develop potential regulations for BESS facilities under the Baldwin Park Municipal Code, Zoning Code and General Plan. The purpose of this interim ordinance is to preserve and promote the public health, safety, and welfare while City staff analyzes and prepares new or revised regulatory proposals to govern BESS facilities, including providing the City Council with options and recommendations regarding possible regulations.

RECOMMENDED ACTION:

It is recommended that the City Council waive the reading and adopt by title only by four-fifths vote the urgency moratorium Ordinance No. 1526 entitled: “INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF

THE CITY OF BALDWIN PARK ESTABLISHING A MORATORIUM ON THE APPROVAL,

ESTABLISHMENT, OR OPERATION OF BATTERY ENERGY STORAGE SYSTEMS FACILITIES TO

CONSIDER ADOPTING REGULATIONS FOR BATTERY ENERGY STORAGE SYSTEM FACILITIES PURSUANT TO GOVERNMENT CODE SECTION 65858.”

FISCAL IMPACT:

There is no fiscal impact associated with this item.

BACKGROUND:

Article XI, Section 7 of the California Constitution and Government Code Section 65858 allow cities to adopt temporary moratoria on an urgency basis to prohibit any uses that may conflict with contemplated or pending changes to the general plan, specific plan, or zoning proposals. As described further below, the item is presented as an urgency matter because the approval, establishment, and operation of new BESS facilities would create a current and immediate threat to the health, safety, and welfare of the City and its residents.

DISCUSSION:

Due to increasing demand for renewable electricity to meet the State’s clean energy goals, there has been a growing demand for BESS facilities across the state. Publicly available materials have documented concerns associated with BESS facilities, specifically the unique fire and explosion hazard due to their use of lithium-ion batteries and related equipment. Such batteries may present increased fire or explosion hazards under certain

Page 283 of 325 ends
Page 2 ends

conditions, including thermal runaway events, impacts, punctures, mechanical damage, overcharging, overheating, and short circuits. Fires involving lithium-ion batteries are often difficult to contain or extinguish and may result in the release of hazardous gases or emissions.

However, the Baldwin Park Municipal Code, Zoning Code, and General Plan do not currently establish regulations or development standards for BESS facilities. The absence of such regulations poses a variety of potential known and unknown adverse impacts, including, but not limited to, increased strain on the City’s firefighting and emergency response resources due to the specialized training and equipment required to respond to lithium-ion battery incidents, impacts associated with the proper cleanup and disposal of such batteries following fires, and potential nuisances such as noise impacts associated with continuously-operating cooling and ventilation equipment.

Therefore, City staff is currently studying and analyzing various options for proposing amendments to the City’s existing regulations that are uniform in application, clear, and efficient in administration. While staff conducts its evaluations, the approval, establishment, and operation of BESS facilities under the City’s existing regulations, which do not provide specific regulations or development standards for BESS facilities, would defeat the purpose of the Staff’s ongoing efforts to study and adopt new regulations and development standards for such facilities. For these reasons, the proposed moratorium is recommended to place a temporary hold on the approval, establishment, or operation of BESS facilities within the City.

Adoption of an urgency measure must be approved by a four-fifths vote of the City Council and would become effective upon adoption. The urgency measure proposes an interim ordinance which is effective for 45 days and can later be extended by the City Council for up to an additional 22 months and 15 days. The proposed interim ordinance would establish a moratorium on the approval, establishment, and new operation of BESS facilities within the City. This moratorium would not impact any BESS facility that is already expressly or conditionally permitted in the City and that was lawfully established and operating before the effective date of this Ordinance.

The purpose of the interim ordinance is to preserve and promote public health, safety, and welfare during the time that City staff analyzes and prepares new or revised regulatory proposals to govern BESS facilities within the City.

ALTERNATIVES:

None.

CEQA REVIEW:

The Ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment), Section 15060(c)(3) (the activity is not a project as defined in Section 15378), Section 15061(b)(3) (it will not have a significant impact on the environment) and Section 15308 (actions by regulatory agencies for the protection of the environment) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because the subject ordinance has no potential for resulting in any significant physical change to the environment, either directly or indirectly.

WHEREAS, the City Council desires to temporarily prohibit all new BESS facilities within the City of Baldwin Park; and

WHEREAS, this urgency Ordinance is adopted pursuant to the requirements of section 65858 of the Government Code.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. FINDINGS, DECLARATION OF URGENCY. The Recitals set forth above are hereby adopted as the findings of the City Council in connection with the adoption of this Ordinance and that based on these findings, there is an immediate threat to the public health, safety, and welfare due to the materials contained in BESS facilities. The City Council of Baldwin Park hereby finds and declares that there is a need to enact an interim urgency ordinance establishing a moratorium on the approval, establishment, or operation of BESS facilities within Baldwin Park to protect the public health, safety and welfare and that appropriate regulations are enacted to ensure the same. Based on these findings, the City Council finds and determines that the moratorium imposed by this Ordinance is enacted to protect and preserve the public health, safety and welfare of the residents of the City pending the City’s evaluation, and regulations for BESS facilities that are appropriate and clear in application and efficient in administration. The approval, establishment, or operation of new BESS facilities prior to the adoption of such new regulations would threaten the public health, safety and welfare. The adoption of this Ordinance is necessary for the immediate protection of public health, safety and welfare.

SECTION 2. MORATORIUM. Except as provided in Section 3 of this Ordinance, the City Council hereby declares a moratorium on the approval, establishment, and operation of BESS facilities within all zoning districts in the City. The City shall not approve or issue land use approvals or permits, including but not limited to General Plan, zoning, or Municipal Code amendments or interpretations, development agreements, conditional use permits, variances, tentative subdivision or parcel maps, site plan approvals, design review approvals, and building permits, business licenses, or other applicable entitlements for the establishment or creation of BESS facilities during this moratorium.

The City Council hereby enacts this interim Ordinance by not less than a four-fifths vote, under the authority granted to it by Article XI, Section 7 of the California Constitution and section 65858 of the California Government Code, which allows the City to adopt an interim ordinance prohibiting land uses which may be in conflict with a contemplated general plan, specific plan, or zoning proposal that the City Council, planning commission or the planning department is considering or studying or intends to study within a reasonable time.

SECTION 3. EXEMPTIONS. This moratorium shall not apply to any BESS facility already expressly or conditionally permitted in the City that was lawfully established and operating before the effective date of this Ordinance. This moratorium is only intended to apply to new or pending discretionary approvals, and shall not apply to the issuance of ministerial permits, such as

Page 286 of 325 ends

Urgency Ordinance No. 1526 - BESS
grading, demolition or building permits, for the uses set forth in Section 2 above, provided that such ministerial permits are applied for in connection with an approval (conditional use permit, a subdivision map or land use entitlement) effective prior to the initiation of the moratorium.

SECTION 4. EXISTING PROHIBITIONS NOT AFFECTED. This Ordinance shall operate in tandem with any and all BESS facilities regulations already included in the BPMC to the extent not in conflict with State laws. In the instance a conflict exists between this Ordinance and any existing provision in the BPMC, the more restrictive regulation of BESS facilities shall prevail.

SECTION 5. PENALTIES. Pursuant to Section 10.99 of the BPMC, violation of any provision of this Ordinance shall constitute a misdemeanor and shall be punishable by a fine or imprisonment, or both. Each and every day such violation exists shall constitute a separate and distinct violation of this Ordinance. In addition to the foregoing, any violation of this Ordinance shall constitute a public nuisance and shall be subject to abatement and administrative fines as provided by all applicable provisions of State and local law.

SECTION 6. CEQA. The City Council finds that this Ordinance is not subject to California Environmental Quality Act (CEQA) pursuant to Section 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment), Section 15060(c)(3) (the activity is not a project as defined in Section 15378), Section 15061(b)(3) (it will not have a significant impact on the environment) and Section 15308 (actions by regulatory agencies for the protection of the environment) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because the subject ordinance has no potential for resulting in any significant physical change to the environment, either directly or indirectly.

SECTION 7. SEVERABILITY. If any section, subsection, phrase, or clause of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, phrase or clause thereof irrespective of the fact that any one or more sections, subsections, phrases, or clauses be declared unconstitutional.

SECTION 8. EFFECTIVE DATE. This Interim Ordinance shall become effective immediately and shall remain in full force and effect for a period of forty-five (45) days from passage, unless extended prior to its expiration by further action of the City Council pursuant to Section 65858 of the Government Code.

SECTION 9. PUBLICATION. The City Clerk shall cause this ordinance to be published and/or posted in accordance with State law and shall certify to the adoption of this ordinance and shall place this ordinance in the original book of ordinances on file in the City Clerk’s Office.

PREPARED BY: Ryan Mulligan, Housing Manager
DATE: June 3, 2026

SUBJECT: To consider the Housing Authority of the City Baldwin Park (HACBP) Public Housing Agency (PHA) 2026-2027 Annual
Plan

SUMMARY:

The purpose of this staff report is for the Housing Authority of the City of Baldwin Park (HACBP) to hold a public hearing and consider:

1. The adoption and approval of the Public Housing Agency (PHA) FY 2026-2027 Annual Plan; and

2. Approval of Resolution No. HA-2026-001, entitled “A Resolution of the Housing Authority of the City of Baldwin Park approving and adopting the Public Housing Annual Agency Plan for FY 2026-2027”, which establishes the adoption of the Plan as required by the U.S. Department of Housing and Urban Development (HUD).

RECOMMENDED ACTION:

It is recommended that the HACBP conduct the public hearing, consider public input, and adopt Resolution No.

FISCAL IMPACT:

The adoption of these plans will have no impact to the City’s General Fund. All funding for these programs are from HUD.

BACKGROUND:

Section 511 of the Quality Housing and Work Responsibility Act (QHWRA) of 1998 established the PHA Five Year and Annual requirements. The Five-Year Plan was adopted April 2, 2025, describes the mission of the agency and the agency’s long-range goals and objectives for achieving its mission. The Annual Plan outlines its approach to managing programs and providing services for the upcoming year, including the PHA and Section 8 Housing Choice Voucher Programs. The Annual Plan also serves as the annual application for grants to support improvements to public housing buildings, known as the Capital Fund Program.

Public Notices:

As required, a public notice was published in the San Gabriel Valley Tribune informing the public that the FY 2026-2027 Annual Plan, including the Statement of Consistency with the Consolidated Plan, proposed Capital Improvements and other required supporting documents were available for public review.

No comments have been received from the public regarding the PHA Plans.

DISCUSSION:

The U.S. Department of Housing and Urban Development (HUD) requires all Public Housing Agencies (PHAs)

Page 301 of 325 ends
Page 2 ends

administering federal housing assistance programs to prepare and submit an Annual Plan each fiscal year in accordance with Section 511 of the Quality Housing and Work Responsibility Act (QHWRA) of 1998. The FY 2026-2027 Annual Plan serves as the Housing Authority of the City of Baldwin Park’s (HACBP) annual update to HUD regarding the administration, operation, and goals of the agency’s housing programs.

The Annual Plan identifies HACBP’s continued commitment to providing safe, decent, and affordable housing opportunities for low-income families, seniors, and persons with disabilities through the administration of the Housing Choice Voucher (HCV) Program and related housing initiatives. The Plan outlines the agency’s operational policies, housing objectives, capital activities, and resident-focused initiatives for the upcoming fiscal year.

Additionally, the Annual Plan includes certifications required by HUD regarding compliance with federal regulations, civil rights requirements, fair housing obligations, and consistency with the City’s Consolidated Plan.

The Plan also incorporates the Capital Fund Program activities and identifies planned improvements and maintenance efforts associated with HACBP owned housing assets.

In accordance with HUD requirements, the draft FY 2026-2027 Annual Plan was made available for public inspection for the required 45-day review period, and a public notice was published in the San Gabriel Valley Tribune notifying the community of the availability of the document and the scheduled public hearing. Staff has not received any public comments during the review period.

Approval of the Annual Plan and adoption of Resolution No. HA-2026-001 will authorize staff to submit the FY 2026-2027 Annual Plan to HUD and continue administering federal housing assistance programs in compliance with HUD requirements.

ALTERNATIVES:

The alternative for this item would be to send it back to staff with a revised HACBP Board direction.

CEQA REVIEW:

The proposal does not qualify as a Project under CEQA; therefore, no review is necessary.

LEGAL REVIEW:

This report does not require legal review for the approval of plans contemplated in this staff report by HACBP.
