31 PERFORMANCE BOND

KNOW ALL PERSONS BY THESE PRESENTS:

THAT WHEREAS, ___________________________ (hereinafter referred to as “City”) has awarded to ____________________, (hereinafter referred to as the “Contractor”) _______________________ an agreement for ________________________________ (hereinafter referred to as the “Project”).

WHEREAS, the work to be performed by the Contractor is more particularly set forth in the Contract Documents for the Project dated ________________, (hereinafter referred to as “Contract Documents”), the terms and conditions of which are expressly incorporated herein by reference; and
WHEREAS, the Contractor is required by said Contract Documents to perform the terms thereof and to furnish a bond for the faithful performance of said Contract Documents.

NOW, THEREFORE, we, _______________, the undersigned Contractor and _____________________________________________ as Surety, a corporation organized and duly authorized to transact business under the laws of the State of California, are held and firmly bound unto the City in the sum of ___________________________ DOLLARS, ($____________), said sum being not less than one hundred percent (100%) of the total amount of the Contract, for which amount well and truly to be made, we bind ourselves, our heirs, executors and administrators, successors and assigns, jointly and severally, firmly by these presents.

THE CONDITION OF THIS OBLIGATION IS SUCH, that, if the Contractor, his or its heirs, executors, administrators, successors or assigns, shall in all things stand to and abide by, and well and truly keep and perform the covenants, conditions and agreements in the Contract Documents and any alteration thereof made as therein provided, on its part, to be kept and performed at the time and in the manner therein specified, and in all respects according to their intent and meaning; and shall faithfully fulfill all obligations including the one-year guarantee of all materials and workmanship; and shall indemnify and save harmless the City, its officers and agents, as stipulated in said Contract Documents, then this obligation shall become null and void; otherwise it shall be and remain in full force and effect.

As a part of the obligation secured hereby and in addition to the face amount specified therefore, there shall be included costs and reasonable expenses and fees including reasonable attorney’s fees, incurred by City in enforcing such obligation.

As a condition precedent to the satisfactory completion of the Contract Documents, unless otherwise provided for in the Contract Documents, the above obligation shall hold good for a period of one (1) year after the acceptance of the work by City, during which

32 time if Contractor shall fail to make full, complete, and satisfactory repair and replacements and totally protect the City from loss or damage resulting from or caused by defective materials or faulty workmanship. The obligations of Surety hereunder shall continue so long as any obligation of Contractor remains. Nothing herein shall limit the City’s rights or the Contractor or Surety’s obligations under the Contract, law or equity, including, but not limited to, California Code of Civil Procedure section 337.15.

Whenever Contractor shall be, and is declared by the City to be, in default under the Contract Documents, the Surety shall remedy the default pursuant to the Contract Documents, or shall promptly, at the City’s option:
(1) Take over and complete the Project in accordance with all terms and conditions in the Contract Documents; or
(2) Obtain a bid or bids for completing the Project in accordance with all terms and conditions in the Contract Documents and upon determination by Surety of the lowest responsive and responsible bidder, arrange for a Contract between such bidder, the Surety and the City, and make available as work progresses sufficient funds to pay the cost of completion of the Project, less the balance of the contract price, including other costs and damages for which Surety may be liable. The term “balance of the contract price” as used in this paragraph shall mean the total amount payable to Contractor by the City under the Contract and any modification thereto, less any amount previously paid by the City to the Contractor and any other set offs pursuant to the Contract Documents.
(3) Permit the City to complete the Project in any manner consistent with California law and make available as work progresses sufficient funds to pay the cost of completion of the Project, less the balance of the contract price, including other costs and damages for which Surety may be liable.

The term “balance of the contract price” as used in this paragraph shall mean the total amount payable to Contractor by the City under the Contract and any modification thereto, less any amount previously paid by the City to the Contractor and any other set offs pursuant to the Contract Documents.

Surety expressly agrees that the City may reject any contractor or subcontractor which may be proposed by Surety in fulfillment of its obligations in the event of default by the Contractor.

Surety shall not utilize Contractor in completing the Project nor shall Surety accept a bid from Contractor for completion of the Project if the CITY, when declaring the Contractor in default, notifies Surety of the City’s objection to Contractor’s further participation in the completion of the Project.

CIP WW-09 Beaumont Mesa Lift Station
Force Main Addendum No. 1- June 30, 2023

Addendum No. 1
Request for Clarifications (RFC) Questions

1. Do you have an Engineer’s Estimate for this project? City of Beaumont Response: The City does not provide engineer's estimates during bidding.

2. What is the engineer’s estimate for this project?
City of Beaumont Response: The City does not provide engineer's estimates during bidding.

3. Do you have an Engineer’s Estimate for the Beaumont Mesa Lift Station Force Main project that bids on 07/11/23?
City of Beaumont Response: The City does not provide engineer's estimates during bidding.

4. Item 32 Caltrans coordination will almost certainly require an encroachment permit, even just to have a road work ahead sign on the offramp would require one and we can’t know the permit costs until after submitting the application and traffic plan which will have to be engineered and after that they will calculate the costs of the permit. This item can't be accurately or fairly bid and should be changed to a preset allowance item or omitted entirely and the responsibility of cost placed on the city of Beaumont.

City of Beaumont Response: See Special Conditions SC-07 for the work and costs related to Caltrans permit and coordination.

5. Section GC07 section f states that the contractor has to bear the costs of review of substitutions of "or equal" items. Wouldn't that review process already take place during the submittal process and therefore warrant no extra charge to the contractor? City of Beaumont Response: Correct, there will be no extra charges or additional compensation for submittal reviews.

6. Section GC29 - Will all of these items be required? A field office with heating/AC fax machine, phone line, etc.

City of Beaumont Response: No Field Office is required, see Special Condition SC-19.

7. Section GC46 section c states "paid no later than sixty (35) Days.." Is it 60 days or 35 days? City of Beaumont Response: Payment shall be per the general conditions.

8. Section SC-12 Calls for piping, appurtenances, etc. removals and testing and flushing and all costs are supposed to be included but we don’t know what the existing lines condition is or the joints and if it will even withstand a hydrostatic test. Also you mention dechlorination.

Are there chlorination and Bac-T's required then? How can we bid all these unknowns accurately and fairly?
City of Beaumont Response: For bidding purposes, Contractor shall assume that the existing pipeline can be pressure tested as described in Appendix G of the specifications. De-chlorination is necessary due to the chlorine residual from the water source. Additional chlorination and Bac-T of the lines is not required.

Force Main Addendum No. 1- June 30, 2023

9. The run along Western Knolls gets close to the fence line. Do you anticipate removing portions of the fence along the freeway edge on Western Knolls?
City of Beaumont Response: The contractor should use shoring and other available methods in order to avoid having to remove and replace portions of the fence.

10. Plan sheet 3 of 18 calls out for a 2" Air Valve per detail on sheet 15. There are no details for a 2" Air Valve on sheet 15. Please Advise.

City of Beaumont Response: 2" Air Valve shall be provided with a cover per Detail 1 on Sheet 18, connection to force main shall be a 2-in saddle outlet with a corp stop and DI Pipe.

11. Section GC29 of the General Conditions specifies a field office trailer and amenities for the inspectors. Q1) Is there a site location earmarked for the trailer that currently has power? Q2) Will the inspectors trailer require an additional portable sanitary facility? City of Beaumont Response: No Field Office is required, see Special Condition SC-19.

For those RFCs that fall in the latter category, Owner will provide an estimate (time and money) to Contractor as an initial response to RFC. Con- tractor may then elect to have Owner proceed with evaluating Contractor's RFC (with estimated value deducted from Contractor's Contract with Owner), or elect to withdraw Contractor's RFC.
