FROM: Steven D. Jones, Community Development Director
DATE: September 2, 2025
SUBJECT: Initiating Potential Annexation Proceedings for 78.48 Acres Along Cherry Valley Boulevard Within Unincorporated Riverside County Into the City of Beaumont
Description: Consider a resolution required by the Riverside County Local Agency Formation Commission (LAFCO) to apply for a City -led annexation of a 78.48 -acre area to expand Beaumont's jurisdictional boundaries.
Background and Analysis:
City staff has been directed to pursue a City -lead annexation encompassing approximately 78.48 acres across nine (9) parcels (Table 1), which are currently developed with a truck repair facility alongside largely undeveloped land. A resolution is required by LAFCO to formally submit the annexation application. The annexation would allow for consistent land use regulation, improved municipal services, and integration into the City's long-term planning and infrastructure strategies.
The site is situated along Cherry Valley Boulevard, a two-lane east —west roadway identified in the City of Beaumont's (City) General Plan Circulation Element as a Major Highway. Major highways function as primary travel corridors, providing regional mobility and accommodating high traffic volumes.
Much of the site remains unimproved and is covered with native grasses, weeds, trees, and other vegetation. South of Cherry Valley Boulevard, the site consists primarily of vacant land, except for the Bonafide Truck and Equipment Repair facility on the western portion of the property, fallow agricultural land, and a static billboard and wireless communication facility located adjacent to the Interstate 10 (I-10) Freeway. To the north, the project area borders the City of Calimesa, unincorporated Riverside County, and newly constructed warehouse facilities in the Industrial Park Zone. The Sunny Cal Specific Plan lies to the east within the City of Beaumont.

Annexation Overview
Under the California Government Code and the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000, annexation proposals must include preparation of a Plan of Services and environmental review prior to consideration by LAFCO.
Annexation of the proposed area would:
• Advance the City's General Plan policies supporting logical, contiguous growth. • Enhance service delivery efficiency and provide access to City utilities and infrastructure.
• Extend City oversight for planning, zoning, and development standards, ensuring orderly and compatible land uses.
• Create opportunities for commercial, residential, or mixed -use development, strengthening the City's economic base and assessed property valuation.
If initiation is authorized, the City will prepare a Plan of Services and conduct environmental review under the California Environmental Quality Act (CEQA) to ensure transparency and compliance. No fiscal impact analysis is required for annexations under 100 acres.
General Plan Conformity:
The Beaumont General Plan encourages annexations that improve quality of life, promote a sense of place, strengthen fiscal stability, and balance growth with environmental protection and neighborhood revitalization. Annexation of this site would help implement gateway features at the I-10/Cherry Valley Boulevard interchange and aligns with Policy LUCD13, which requires that annexation should only occur when full urban services are available or adequately funded.
Zoning Compliance:
Pre -zoning designations, once approved, will become effective upon annexation, ensuring consistency with the General Plan and preventing incompatible development.
Subsequent General Plan review and tools such as specific plans, overlay zones, development agreements, and environmental review will guide cohesive land use planning and implementation.
Public Communications and Community Outreach:
Public hearings will be noticed in the Press Enterprise, and direct mail notifications will be sent to affected property owners to provide information and invite input regarding the annexation proposal.
Fiscal Impact:
The cost to prepare this report is approximately $450.
Initial annexation activity costs include consultant fees for preparation of a Plan of Services and environmental review, estimated at $60,000-$130,000 (if a full environmental impact report is required), to be funded from the General Fund, which is not in the current FY budget. Potential long-term fiscal benefits include expanded property tax revenues, sales tax potential, and development -related fees.
Recommended Action:
Waive the full reading and adopt by title only "A Resolution of the City Council of the City of Beaumont, California, Initiating Proceedings to Annex 78.48 Acres of Unincorporated Riverside County to the City of Beaumont and Directing Preparation of a Plan of Services And Environmental Review";
Authorize staff to prepare Requests for Proposals to retain consultants for the required Plan of Services, fiscal impact analysis, and CEQA review; and Direct staff to submit the annexation proposal to Riverside LAFCO upon completion of the required studies.

TO: City Council
FROM: Steven D. Jones, Community Development Director
DATE: September 2, 2025
SUBJECT: Discuss a Potential Municipal Code Amendment to Streamline the Current Food Truck Review and Approval Process
Description: Discussion of current regulatory approach to food trucks to assess whether a code amendment or policy changes are warranted to improve efficiency, support entrepreneurship, and align with modern mobile vending trends.
Background and Analysis:
The City of Beaumont currently identifies and regulates food trucks as mobile food vendors through a combination of local zoning, permitting, and health regulations in coordination with Riverside County. On April 5, 2022, the City Council adopted Ordinance No. 1147 to update food truck permit language within the Beaumont Municipal Code (BMC) to align with state law. Ordinance No. 1147 became effective on May 5, 2022, and added BMC Chapter 5.72 (Food Trucks) to promote public health, safety, and welfare while providing an opportunity for a variety of innovative and unconventional business activities.
In recent years, food trucks have become increasingly popular as a flexible and affordable food option and opportunity for community engagement and incubator business with potential growth.
Current Status:
• Zoning and Land Use Restrictions.
o Food trucks permits are regulated to ensure no interference with the performance of public safety officers or pedestrian or vehicular traffic, ensure safe food handling with sanitary conditions, and ensure reasonable access for the sharing, maintenance, and use of the public right-of-way. • Permit Processing.
o Food truck vendors must obtain a business license after having obtained a Riverside County health permit, and in some cases, a temporary or special event permit or a plot plan to regularly operate on private property.
Otherwise, they are allowed to operate on the public sidewalk as long as they do not block pedestrian or vehicular access.
Operational standards.
o Hours of operation can be 24 hours but are limited to no more than 4 hours at one location; waste disposal or commissary affiliation, signage, and utility are regulated, but current codes and enforcement processes may lack clarity.
Key issues identified include:
1. Frequency of health department inspections;
2. Designated vending zones;
3. 4 -hour allowance to serve from a single location, including facing the adjacent sidewalk;
4. Unclear process for food truck permittees to follow;
5. Impacts on brick -and -mortar businesses.
The business license renewal process for recurring vendors, private property hosting permit approval processing, and events on City property or City -sponsored events could also be clarified for concise guidelines and streamlined permit processing. Stakeholders have expressed interest in a more predictable and business -friendly approach.
Potential Council Considerations:
Business -Friendly Customer Service Pamphlets
To support improved customer service and streamline the food truck permitting process, staff propose updated materials, including a revised food truck permit application and an informational brochure. These reworked resources would provide a clear, concise summary of the steps required to obtain a food truck permit in the City of Beaumont, including zoning requirements, health and safety standards, and applicable fees. By simplifying the application and offering accessible guidance in a user-friendly format, these updates aim to reduce processing time, improve compliance, and enhance transparency for both new and returning vendors.
Clarity on Impact to Wastewater
Food trucks proposing to operate on private property must show they are part of a commissary or restaurant where grease interceptors have been approved. Part of the reason for recent delays in the permitting process is that some food truck operators did not show such an association and identified maintaining their trucks from a home location. This caused the Wastewater Department to require additional proof of proper grease disposal, which delayed their permit process. If the Code and policies are
amended to "require" truck storage and maintenance from an associated restaurant and/or approved commissary, the approval process would move much faster.
Quarterly Inspections
Quarterly inspections are required due to potential food truck maintenance issues that arise. However, requiring quarterly food truck permit license inspections, while other business licenses are only subject to annual renewals, has several important operational, administrative, and policy implications. To address business community concerns of perceived inequity and unfair treatment, a public health or safety need for justification in requiring quarterly license inspections could be incorporated into the proposed brochure. The additional time and cost associated with more frequent inspections could deter small or new vendors from entering the market, especially if they only operate part-time or seasonally. It may be appropriate to consider tiered inspection models for food trucks that have been shown to be out of compliance with regulatory provisions or have been reported to be the source of food -borne illnesses by Riverside County. The administrative costs and budgetary implications of quarterly inspections mean a significant demand for Planning, Code Enforcement/Community Enhancement, and Fire Services staff.
The business license revocation process is reserved for persistent safety or nuisance issues not promptly addressed to reduce complaints and violations. Annual or semi- annual inspections may help ensure compliance with health, fire, zoning, and operational requirements in a way that is balanced with administrative feasibility and based on risk factors associated with food truck vendor type.
City Parks and Special Events
Food trucks have become an integral component of City events and have contributed significantly to their overall success. Attachment B is a list of events organized by the Beaumont Community Services Department (aka, Parks and Recreation) that currently include food truck participation. The list identifies event locations and indicates which events were reviewed by the Development Review Committee (DRC) for discussion or approval.
In addition to City -sponsored events, an increase in food truck activity at sports league practices and games using City parks, regional parks within the city, and other public areas has been observed. Organizations such as the American Youth Soccer Organization (AYSO), Junior All American Football (JAAF), and local rugby clubs have begun inviting food trucks to set up during their activities to include practice times, regular games, and special event tournaments, typically setting up in parking lots.
Community and resident needs for local food options are being served, however, this could potentially become a safety issue if regulation and enforcement are not imposed.
The leagues are also leveraging the use of food trucks as a fundraising tool, with a portion of sales being donated back to the organization. This approach also helps prevent the misuse of snack bars and other City infrastructure areas like canopies, which are not equipped to handle full-scale food preparation. Recently, snack bar operations were shut down by the Community Services Department after the use of fryers and grills to serve restaurant -style meals — beyond the intended use of the facilities and a potential safety hazard — was observed.
The filing/obtaining of special event permits is requested for larger tournaments or unique events. However, what remains unclear is how to handle food truck operations during routine, day-to-day practices and games since food trucks are currently prohibited from staging on public property (e.g., City parks) and publicly owned land.
Staff are supportive of the presence of food trucks during these smaller -scale activities, as they enhance the overall park experience with clear guidelines and policies for their use in these situations, but language is needed in the Municipal Code to clarify dos and don'ts.
Potential language could be included in the Municipal Code to reduce the number of required inspections, allow greater operational flexibility during City -sponsored and other events, and streamline permitting. Specifically, the proposed code amendments would reduce the required quarterly inspections for permitted food trucks from a recurring basis to a single, consolidated annual inspection, aligning with the business license renewal process. The amendments would also authorize mobile food vendors to operate at and stage events that are approved or sponsored by the City, recognizing the value of food trucks as contributors to successful community programming. Additionally, the draft language would remove restrictive or duplicative provisions that may unintentionally discourage small business participation, including unnecessary documentation requirements or limitations that overlap with state or county public health authorities. Collectively, these revisions aim to ease the City's approach to mobile vending while supporting safe, accessible, and economically viable food service operations in Beaumont.
City Council direction is sought on whether to pursue changes to BMC Chapter 5.72 (Food Trucks) and associated policies, including the quarterly inspection schedule and its application by vendor type and risk profile, and provisions for potential, limited food truck staging during approved rented/scheduled times on public property.
Food Truck Sales from the Public Right-of-way (i.e., sidewalk) Food truck operators are not considered sidewalk vendors. Yet, the current City Code allows them to serve adjacent to the sidewalk. Historically, food truck vendors had set routes within private property and were allowed to stay at a location for approximately 1 to 2 hours. These locations were typically businesses that wanted convenience for their
workers, such as industrial warehouses and office parks with limited food options.
Under an agreement with the property owners, food truck operators would have a set route for the day that would guarantee them a steady flow of income from known customers. This has changed over time. Food truck operators are now operating within the public right-of-way, depending on code allowances from different jurisdictions.

Fiscal Impact:
The cost to prepare this staff report was approximately $450.
If directed to draft a Code amendment, staff and legal review costs would be incurred for introduction and public consideration/publishing. The required inspections, however, would continue to be covered under existing fees and deposits for special event permits, which cover costs for staff time.
Recommended Action:
Direct staff to prepare an ordinance amending BMC Chapter 5.72 (Food Trucks) to streamline, clarify, and ensure reduced impacts from food truck operators.

Staff Report
TO: City Council
FROM: Thaxton Van Belle, Director of Water Reclamation
Kenyon Potter, Principal Engineer
DATE: September 2, 2025
SUBJECT: Public Works Agreements for the Construction of Wastewater Treatment Plant Improvement Project — Capital Improvement Project (CIP) WW24-01 Description: Award a Public Works Agreement for Civil Work (Bid Package 1) to Innovative Construction Solutions in the amount of $3,383,857 and Landscape Work (Bid Package 2) to Southern California Landscape in the amount of $598,905.
Background and Analysis:
After the construction of the Wastewater Treatment Plant Expansion and Salt Mitigation project was completed, several additional site improvements were identified to enhance operational efficiency, stabilize the site, and upgrade areas that were not part of the original construction scope. These improvements include, but are not limited to, a Vactor dump station, parking lot, landscaping with dust and erosion control, replacement membrane pumps, entry gates, drainage work, and non -potable water system improvements.
On June 24, 2023, Council authorized the award of a design contract with Webb and Associates for improvements to the WWTP, including a dump station, parking lot, vehicular gates and landscaping.
On January 16, 2024, staff provided an update on the WWTP Site Improvements project, including the entry monument and landscaping. Three conceptual plans with varying levels of landscape were presented, and staff received feedback from the City Council.
On May 7, 2024, Council approved an amendment to the PSA with Webb Associates to design non -potable water system improvements to ensure the reliability of process water and delivery of recycled water to the proposed landscaping, as well as a secondary access road to the WWTP from Veile Avenue. Subsequently, final plans and specifications were prepared for these improvements. During the design, staff identified other plant deficiencies and have addressed these in the final plans. The project was
divided into separate bid packages comprising of civil work and landscape work. The scope in bid packages 1 and 2 are coordinated and intended to be constructed as a single project.
On November 13, 2024, Bid Package 1 was advertised for pre -qualification of contractors, and on December 20, 2024, it was advertised for bids.
On February 4, 2025, three (3) bids from pre -qualified contractors were received and publicly opened, but the bid cost substantially exceeded the project budget at the time.
Subsequently, the City Council rejected all bids on March 18, 2025, and approved staff to prepare revised bidding documents addressing a bid bust and incorporating value engineering, and to re -advertise for new bids in accordance with the established bidding procedure.
Civil Work (Bid Package 1)
On June 6, 2025, the City rebid Bid Package 1, and on July 22, 2025, the City received four (4) bids.
The following is a summary of the received bids, excluding the additive alternates:
1. Innovative Construction Solutions
2. R2Build
3. SCW Contracting Corporation
4. Metro Builders
$3,357,857
$3,734,288
$3,661,243
$4,004,236
Innovative Construction Solutions is the apparent lowest responsive and responsible bidder. No bid challenges were received.
Additives
The lowest responsive bidder was determined based on the base bid as explicitly stated in the bid advertisement. The City also included bid additives as part of the bid advertisement. An additive bid item is a separate component of a project that can be added to the base bid depending on available funds. It allows the City to expand the scope of work without committing before knowing the base bid amount.
Therefore, City staff is recommending including the bid upon additives to the contract. • Additive — Blower Room pipe bracing and evaporative cooler $26,000.
The proposed total contract amount, including base bid and additives, is $3,383,857
Landscape Work (Bid Package 2)
On July 15, 2025, the City issued Bid Package 2, and on August 14, 2025, the City received four (4) bids.
The following is a summary of the received bids, excluding the additive alternates:
1. Southern California Landscape $523,325
2. Superb Engineering $537,712
3. Mariposa Landscapes $571,978
4. Marina Landscape $764,167
Southern California Landscape, Inc. is the apparent lowest responsive and responsible bidder. No bid challenges were received. The landscape bid package includes a demonstration garden as well as embankment protection, dust control, and a building monument made of rammed earth.
Additives
The lowest responsive bidder was determined based on the base bid as explicitly stated in the bid advertisement. The City also included bid additives as part of the bid advertisement. City staff is recommending including Additives 1 and 2 to the contract. • Additive 1 — Streetscape package $41,020.
• Additive 2 — East Planting Bed package $34,560.
The proposed total contract amount, including base bid and additives, is $598,905.
Fiscal Impact:
The cost to prepare this staff report is estimated to be $500.
The total of all proposed contract work is $3,982,762, and the total of all contingencies is $398,276, for a project total of $4,381,038.
Construction cost for the Project will be paid from the WWTP Improvements Project (CIP WW24-01). The following is a summary of the Project budget and funding:

CITY OF BEAUMONT
PUBLIC WORKS AGREEMENT
This PUBLIC WORKS AGREEMENT ("Agreement") is made and effective August 20, 2025, by and between the City of Beaumont, a municipal corporation ("CITY"), and Innovative Construction Solutions, ("CONTRACTOR"), a California Corporation. In consideration of the mutual covenants and conditions set forth herein, the parties agree as follows:
SCOPE OF WORK
The CONTRACTOR shall perform within the time set forth in Article 2 of this Agreement and shall furnish all labor, materials, equipment, tools, utility services, and transportation and perform and complete all work required in connection with the CIP WW24-01 WWTP Improvements - Bid Package 1 (hereinafter "Project").
CONTRACTOR's Bid, dated July 22, 2025, is attached hereto as Exhibit B and incorporated herein by this reference. The Scope of Work for the Project is set forth in the Invitation. In the event that any terms of the Bid are different from the Invitation for Bids, the Invitation for Bids shall control. Any additional terms in the Bid that purport to bind the City to any additional terms not contained in this Agreement and related attachments shall not be binding on the City.
By entering into this Agreement, CONTRACTOR acknowledges that there may be other contractors on the site whose work will be coordinated with that of its own. CONTRACTOR expressly warrants and agrees that it will cooperate with other contractors and will do nothing to delay, hinder, or interfere with the work of other separate contractors, the CITY, the Construction Manager, the Engineer, or utilities. CONTRACTOR also expressly agrees that, in the event its work is hindered, delayed, interfered with, or otherwise affected by a separate contractor, its sole remedy will be a direct action against the separate contractor. To the extent allowed by law, the CONTRACTOR will have no remedy, and hereby expressly waives any remedy against the CITY, the Construction Manager (if any), and the Engineer on account of delay, hindrance, interference, or other events.
II. TIME FOR PROJECT COMPLETION
All of CONTRACTOR's work on the Project shall be completed within durations established for the individual activities. All work shall commence ten (10) calendar days after receiving a written Notice of Award from the CITY or Construction Manager, if a Construction Manager is employed by CITY on the Project. CONTRACTOR shall refer to the invitations for bids, and Project Plans and Specifications, all of which, as set forth below, are incorporated herein by reference, for contractual obligations regarding individual activity durations.
C25-113
III. THE CONTRACT SUM
The CITY shall pay to the CONTRACTOR for the performance of this Agreement, subject to any additions and deductions provided in the Project documents, the sum of Three Million, Three Hundred Eighty -Three Thousand, Eight Hundred Fifty -Six and 92/100 dollars ($3,383,856.92).
IV. PROGRESS PAYMENTS
Based upon Applications for Payment submitted to the Engineer by the CONTRACTOR and Certificates for Payment issued by the Engineer, the CITY shall make progress payments on account of the Contract Sum to the CONTRACTOR as provided in the General Conditions, which are fully incorporated into this Agreement by this reference.
This Agreement is subject to the provisions of Article 1.7 (commencing at Section 20104.50) of Division 2, Part 3 of the Public Contract Code regarding prompt payment of contractors by local governments. Article 1.7 mandates certain procedures for the payment of undisputed and properly submitted payment requests within 30 days after receipt, for the review of payment requests, for notice to Contractor of improper payment requests, and provides for the payment of interest on progress payment requests which are not timely made in accordance with that Article. This Agreement hereby incorporates the provisions of Article 1.7 as though fully set forth herein.
V. INDEMNITY, DEFENSE AND HOLD HARMLESS AGREEMENT
CONTRACTOR shall indemnify, defend with legal counsel approved by CITY, and hold harmless CITY, its officers, officials, employees and volunteers from and against all liability, loss, damage, expense, cost (including without limitation reasonable legal counsel fees, expert fees and all other costs and fees of litigation) of every nature arising out of or in connection with CONTRACTOR's negligence, recklessness or willful misconduct in the performance of work hereunder or its failure to comply with any of its obligations contained in this Agreement, except such loss or damage which is caused by the sole or active negligence or willful misconduct of the CITY. Should conflict of interest principles preclude a single legal counsel from representing both CITY and CONTRACTOR, or should CITY otherwise find CONTRACTOR's legal counsel unacceptable, then CONTRACTOR shall reimburse the CITY its costs of defense, including without limitation reasonable legal counsels fees, expert fees and all other costs and fees of litigation. The CONTRACTOR shall promptly pay any final judgment rendered against the CITY (and its officers, officials, employees and volunteers) with respect to claims determined by a trier of fact to have been the result of the CONTRACTOR's negligent, reckless or wrongful performance. It is expressly understood and agreed that the foregoing provisions
C25-113
are intended to be as broad and inclusive as is permitted by the law of the State of California and will survive termination of this Agreement.
CONTRACTOR obligations under this section apply regardless of whether or not such claim, charge, damage, demand, action, proceeding, loss, stop notice, cost, expense, judgment, civil fine or penalty, or liability was caused in part or contributed to by an Indemnitee. However, without affecting the rights of CITY under any provision of this agreement, CONTRACTOR shall not be required to indemnify and hold harmless CITY for liability attributable to the active negligence of CITY, provided such active negligence is determined by agreement between the parties or by the findings of a court of competent jurisdiction. In instances where CITY is shown to have been actively negligent and where CITY active negligence accounts for only a percentage of the liability involved, the obligation of CONTRACTOR will be for that entire portion or percentage of liability not attributable to the active negligence of CITY.
VI. PREVAILING WAGES
A. Contractor shall comply with all applicable laws and regulations relating to prevailing wages. Wage rates for this Project shall be in accordance with the "General Wage Determination Made By the Director of Industrial Relations Pursuant To California Labor Code, Part 7, Chapter 1, Article 2, Sections 1770, 1773 and 1773.1", for Riverside County. Wage rates shall conform with those posted at Beaumont City Hall and the Project site.
B. The following Labor Code sections are hereby referenced and made a part of this Agreement:
1. Section 1775 - Penalty for Failure to Comply with Prevailing Wage Rates.
2. Section 1777.4 - Apprenticeship Requirements.
3. Section 1777.5 - Apprenticeship Requirements.
4. Section 1813 - Penalty for Failure to Pay Overtime.
5. Sections 1810 and 1811 - Working Hour Restrictions.
6. Section 1775 - Payroll Records.
7. Section 1773.8 - Travel and Subsistence Pay.
VII. RECORD AUDIT
In accordance with Government Code, Section 8546.7, records of both the CITY and the CONTRACTOR shall be subject to examination and audit by the Auditor General for a period of three (3) years after final payment.
VIII. FINAL PAYMENT
C25-113
Final payment, constituting the entire unpaid balance of the Agreement Sum, shall be paid by the CITY to the CONTRACTOR no sooner than thirty-five (35) days after a Notice of Completion has been recorded, unless otherwise stipulated in the Notice of Completion, provided the work has then been completed, the Agreement fully performed, and a final Certificate for Payment has been issued by the Engineer.
IX. CONTRACTOR'S FAILURE TO PROCURE COMPLETION OF PROJECT In the event CONTRACTOR fails to furnish tools, equipment, or labor in the necessary quantity or quality, or fails to prosecute the work or any part thereof contemplated by this Agreement in a diligent and workmanlike manner, and if the CONTRACTOR for a period of three (3) calendar days after receipt of written demand from CITY or its designated representative to do so, fails to furnish tools, equipment, or labor in the necessary quantity or quality, and to prosecute its work and all parts thereof in a diligent and workmanlike manner, or after commencing to do so within said three (3) calendar days, fails to continue to do so; then the CITY may exclude the CONTRACTOR from the premises, or any portion thereof, and take possession of said premises or any portion thereof, together with all material and equipment thereon, and may complete the work contemplated by this Agreement or any portion of said work, either by furnishing the tools, equipment, labor or material necessary, or by letting the unfinished portion of said work, or the portion taken over by the CITY to another contractor or by a combination of such methods. In any event, the procuring of the completion of said work, or the portion thereof taken over by the CITY, shall be a charge against the CONTRACTOR, and may be deducted from any money due or becoming due to CONTRACTOR from the CITY, or the CONTRACTOR shall pay the CITY the amount of said charge, or the portion thereof unsatisfied. The sureties, provided for under this Agreement shall become liable for payment should CONTRACTOR fail to pay in full any said cost incurred by the CITY.
X. INSURANCE
Prior to the beginning of and throughout the duration of the Project, CONTRACTOR and its subcontractors shall maintain insurance in conformance with the requirements set forth below. Attached hereto as Exhibit C are copies of Certificates of Insurance and the waiver of subrogation endorsement as required by Section 6.B.1. CONTRACTOR will use existing coverage to comply with these requirements. If that existing coverage does not meet the requirements set forth herein, CONTRACTOR agrees to amend, supplement or endorse the existing coverage to do so.
CONTRACTOR acknowledges that the insurance coverage and policy limits set forth in this section constitute the minimum amount of coverage required. Any insurance proceeds available to CONTRACTOR or its subcontractors in excess
C25-113
of the limits and coverage identified in this Agreement and which is applicable to a given loss, claim or demand, will be equally available to CITY.
A. Types of Insurance
Without limiting CONTRACTOR's indemnification of CITY, and prior to commencement of Work, CONTRACTOR shall obtain, provide and maintain at its own expense during the term of this Agreement, policies of insurance of the type and amounts described below and in a form satisfactory to CITY:
1. General liability insurance. CONTRACTOR shall maintain commercial general liability insurance with coverage at least as broad as Insurance Services Office form CG 00 01, in an amount not less than $1,000,000 per occurrence, $2,000,000 general aggregate, for bodily injury, personal injury, and property damage, and a $2,000,000 completed operations aggregate. The policy must include contractual liability that has not been amended. Any endorsement restricting standard ISO "insured contract" language will not be accepted.
2. Automobile liability insurance. CONTRACTOR shall maintain automobile insurance at least as broad as Insurance Services Office form CA 00 01 covering bodily injury and property damage for all activities of the CONTRACTOR arising out of or in connection with Work to be performed under this Agreement, including coverage for any owned, hired, non -owned or rented vehicles, in an amount not less than $1,000,000 combined single limit for each accident.
3. Umbrella or excess liability insurance. If CONTRACTOR is using umbrella coverage to meet part of its liability insurance requirements under Paragraph 1 of this Section, CONTRACTOR shall obtain and maintain an umbrella or excess liability insurance that will provide bodily injury, personal injury, completed operations and property damage liability coverage at least as broad as the primary coverages set forth above, including commercial general liability and employer's liability. Such policy or policies shall include the following terms and conditions:
• A drop down feature requiring the policy to respond in the event that any primary insurance that would otherwise have applied proves to be uncollectable in whole or in part for any reason; • Pay on behalf of wording as opposed to reimbursement; • Concurrency of effective dates with primary policies; • Policies shall "follow form" to the underlying primary policies; and
• Insureds under primary policies shall also be insureds under the umbrella or excess policies.
C25-113
4. Workers' compensation insurance. CONTRACTOR shall maintain Workers' Compensation Insurance (Statutory Limits) and Employer's Liability Insurance (with limits of at least $1,000,000) for CONTRACTOR's employees in accordance with the laws of the State of California, Section 3700 of the Labor Code. In addition, CONTRACTOR shall require each subcontractor to similarly maintain Workers' Compensation Insurance and Employer's Liability Insurance in accordance with the laws of the State of California, Section 3700 for all of the subcontractor's employees.
CONTRACTOR shall submit to CITY, along with the certificate of insurance, a Waiver of Subrogation endorsement in favor of CITY, its officers, agents, employees and volunteers.
5. Pollution liability insurance. Environmental Impairment Liability Insurance shall be written on a CONTRACTOR's Pollution Liability form or other form acceptable to CITY providing coverage for liability arising out of sudden, accidental and gradual pollution and remediation. The policy limit shall be no less than $1,000,000 dollars per claim and in the aggregate. All activities contemplated in this Agreement shall be specifically scheduled on the policy as "covered operations." The policy shall provide coverage for the hauling of waste from the project site to the final disposal location, including non -owned disposal sites.
Products/completed operations coverage shall extend a minimum of three (3) years after project completion. Coverage shall be included on behalf of the insured for covered claims arising out of the actions of independent contractors.
If the insured is using subcontractors, the Policy must include work performed "by or on behalf" of the insured. Policy shall contain no language that would invalidate or remove the insurer's duty to defend or indemnify for claims or suits expressly excluded from coverage. Policy shall specifically provide for a duty to defend on the part of the insurer. The CITY, its officials, officers, agents, and employees, shall be included as insureds under the policy.
6. Builder's risk insurance. Upon commencement of construction and with approval of CITY, CONTRACTOR shall obtain and maintain builder's risk insurance for the entire duration of the Project until only the CITY has an insurable interest. The Builder's Risk coverage shall include the coverages as specified below.
The named insureds shall be CONTRACTOR and CITY, including its officers, officials, employees, and agents. All Subcontractors (excluding those solely responsible for design Work) of any tier and suppliers shall be included as additional insureds as their interests may
C25-113
appear. CONTRACTOR shall not be required to maintain property insurance for any portion of the Project following transfer of control thereof to CITY. The policy shall contain a provision that all proceeds from the builder's risk policy shall be made payable to the CITY. The CITY will act as a fiduciary for all other interests in the Project.
Policy shall be provided for replacement value on an "all risk" basis for the completed value of the project. There shall be no coinsurance penalty or provisional limit provision in any such policy. Policy must include: (1) coverage for any ensuing loss from faulty workmanship, Nonconforming Work, omission or deficiency in design or specifications; (2) coverage against machinery accidents and operational testing; (3) coverage for removal of debris, and insuring the buildings, structures, machinery, equipment, materials, facilities, fixtures and all other properties constituting a part of the Project; (4) Ordinance or law coverage for contingent rebuilding, demolition, and increased costs of construction; (5) transit coverage (unless insured by the supplier or receiving contractor), with sub -limits sufficient to insure the full replacement value of any key equipment item; (6) Ocean marine cargo coverage insuring any Project materials or supplies, if applicable; (7) coverage with sub -limits sufficient to insure the full replacement value of any property or equipment stored either on or off the Site or any staging area. Such insurance shall be on a form acceptable to CITY to ensure adequacy of terms and sublimits and shall be submitted to the CITY prior to commencement of construction.
B. Other provisions or requirements
1. Proof of insurance. CONTRACTOR shall provide certificates of insurance to CITY as evidence of the insurance coverage required herein, along with a waiver of subrogation endorsement for workers' compensation. Insurance certificates and endorsements must be approved by CITY's risk manager prior to commencement of performance. Current certification of insurance shall be kept on file with CITY at all times during the term of this contract. CITY reserves the right to require complete, certified copies of all required insurance policies, at any time.
2. Duration of coverage. CONTRACTOR shall procure and maintain for the duration of the contract insurance against claims for injuries to persons or damages to property, which may arise from or in connection with the performance of the Work hereunder by CONTRACTOR, his agents, representatives, employees or
subcontractors. CONTRACTOR must maintain general liability and umbrella or excess liability insurance for as long as there is a statutory exposure to completed operations claims. CITY and its officers,
C25-113
officials, employees, and agents shall continue as additional insureds under such policies.
3. Primary/noncontributing. Coverage provided by CONTRACTOR shall be primary and any insurance or self-insurance procured or maintained by CITY shall not be required to contribute with it. The limits of insurance required herein may be satisfied by a combination of primary and umbrella or excess insurance. Any umbrella or excess insurance shall contain or be endorsed to contain a provision that such coverage shall also apply on a primary and non-contributory basis for the benefit of CITY before the CITY's own insurance or self-insurance shall be called upon to protect it as a named insured.
4. CITY's rights of enforcement. In the event any policy of insurance required under this Agreement does not comply with these requirements or is canceled and not replaced, CITY has the right but not the duty to obtain the insurance it deems necessary and any premium paid by CITY will be promptly reimbursed by CONTRACTOR or CITY will withhold amounts sufficient to pay premium from CONTRACTOR payments. In the alternative, CITY may cancel this Agreement.
5. Acceptable insurers. All insurance policies shall be issued by an insurance company currently authorized by the Insurance Commissioner to transact business of insurance or is on the List of Approved Surplus Line Insurers in the State of California, with an assigned policyholders' Rating of A- (or higher) and Financial Size Category Class VII (or larger) in accordance with the latest edition of Best's Key Rating Guide, unless otherwise approved by the CITY's risk manager.
6. Waiver of subrogation. All insurance coverage maintained or procured pursuant to this agreement shall be endorsed to waive subrogation against CITY, its elected or appointed officers, agents, officials, employees and volunteers or shall specifically allow CONTRACTOR or others providing insurance evidence in compliance with these specifications to waive their right of recovery prior to a loss.
CONTRACTOR hereby waives its own right of recovery against CITY, and shall require similar written express waivers and insurance clauses from each of its subconsultants.
7. Enforcement of contract provisions (non estoppel).
CONTRACTOR acknowledges and agrees that any actual or alleged failure on the part of the CITY to inform CONTRACTOR of non- compliance with any requirement imposes no additional obligations on the CITY nor does it waive any rights hereunder.
C25-113
8. Requirements not limiting. Requirements of specific coverage features or limits contained in this Section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type.
If the CONTRACTOR maintains higher limits than the minimums shown above, the CITY requires and shall be entitled to coverage for the higher limits maintained by the CONTRACTOR. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the CITY.
9. Notice of cancellation. CONTRACTOR agrees to oblige its insurance agent or broker and insurers to provide to CITY with a thirty (30) day notice of cancellation (except for nonpayment for which a ten (10) day notice is required) or nonrenewal of coverage for each required coverage.
10.Additional insured status. General liability policies shall provide or be endorsed to provide that CITY and its officers, officials, employees, agents, and volunteers shall be additional insureds under such policies. This provision shall also apply to any excess/umbrella liability policies.
11. Prohibition of undisclosed coverage limitations. None of the coverages required herein will be in compliance with these requirements if they include any limiting endorsement of any kind that has not been first submitted to CITY and approved of in writing.
12.Separation of insureds. A severability of interests provision must apply for all additional insureds ensuring that CONTRACTOR's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the insurer's limits of liability. The policy(ies) shall not contain any cross -liability exclusions.
13. Pass through clause. CONTRACTOR agrees to ensure that its subconsultants, subcontractors, and any other party involved with the project who is brought onto or involved in the project by CONTRACTOR, provide the same minimum insurance coverage and endorsements required of CONTRACTOR. CONTRACTOR agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section. CONTRACTOR agrees that upon
C25-113
request, all agreements with consultants, subcontractors, and others engaged in the project will be submitted to CITY for review.
14.CITY's right to revise requirements. The CITY reserves the right at any time during the term of the contract to change the amounts and types of insurance required by giving the CONTRACTOR a ninety (90) day advance written notice of such change. If such change results in substantial additional cost to the CONTRACTOR, the CITY and CONTRACTOR may renegotiate CONTRACTOR's compensation.
15.Self-insured retentions. Any self -insured retentions must be declared to and approved by CITY. CITY reserves the right to require that self - insured retentions be eliminated, lowered, or replaced by a deductible.
Self-insurance will not be considered to comply with these specifications unless approved by CITY.
16.Timely notice of claims. CONTRACTOR shall give CITY prompt and timely notice of claims made or suits instituted that arise out of or result from CONTRACTOR's performance under this Agreement, and that involve or may involve coverage under any of the required liability policies.
17.Additional insurance. CONTRACTOR shall also procure and maintain, at its own cost and expense, any additional kinds of insurance, which in its own judgment may be necessary for its proper protection and prosecution of the Work.
XI. CONTRACTOR'S LICENSE
CONTRACTOR must possess at the time of commencing work and throughout the Project duration, a Contractor's License, issued by the State of California, which is current and in good standing. CONTRACTOR shall ensure that any subcontractor working on the Project possesses at the time of commencing work and throughout the Project duration, a Contractor's License, issued by the State of California, which is current and in good standing.
XII. REGISTRATION REQUIREMENTS

It is not a violation of this section for an unregistered
C25-113
contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded."

This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.
D. The CONTRACTOR is not subject to public works requirements (including registration with the DIR) if the public works project is under $1,000, unless the CITY knows that the same CONTRACTOR will be awarded total project costs in excess of $1,000 for a given year.
XIII. CORPORATION IN GOOD STANDING
If CONTRACTOR is a corporation, the undersigned hereby represents and warrants that the corporation is duly incorporated and in good standing in the State of California, and that Hirad Emadi whose title is President is authorized to act for and bind the corporation.
XIV. PROVISIONS REQUIRED BY LAW

XV. SUBSURFACE HAZARDOUS MATERIALS
C25-113
A. In the event trenches or other excavations extend deeper than four (4) feet below the surface, the CONTRACTOR shall promptly, and before the following conditions are disturbed, notify the CITY in writing of any:
1. Material that the CONTRACTOR believes may be material that is hazardous waste, as defined in Section 25117 of the Health and Safety Code that is required to be removed to a Class I, Class II or Class I I I disposal site in accordance with the provisions of existing law.

3. Unknown physical conditions at the site of any unusual nature, different materially from those ordinarily encountered and generally recognized as inherent in the Work or the character provided for in the CONTRACT.
B. Upon receipt of said notification the CITY will investigate the conditions, and if it finds that the conditions do materially so differ, or do involve hazardous waste, and cause a decrease or increase in the CONTRACTOR's cost of or the time required for performance of any part of the work, the CITY will issue a change order under the procedures described in the General Conditions.
C. In the event that a dispute arises between the CITY and the CONTRACTOR whether the conditions materially differ, or involve hazardous waste or cause a decrease or increase in the CONTRACTOR's cost of or time required for performance of any part of the work, the CONTRACTOR shall not be excused from any scheduled completion date provided for by the Agreement, but shall proceed with all work to be performed under the Agreement. CITY OF BEAUMONT
PUBLIC WORKS AGREEMENT
This PUBLIC WORKS AGREEMENT ("Agreement") is made and effective August 20, 2025, by and between the City of Beaumont, a municipal corporation ("CITY"), and Southern California Landscape, Inc. ("CONTRACTOR"), a California Corporation. In consideration of the mutual covenants and conditions set forth herein, the parties agree as follows:
I. SCOPE OF WORK
The CONTRACTOR shall perform within the time set forth in Article 2 of this Agreement and shall furnish all labor, materials, equipment, tools, utility services, and transportation and perform and complete all work required in connection with the CIP WW24-01 WWTP Improvements - Bid Package 2 (hereinafter "Project").
CONTRACTOR's Bid, dated July 22, 2025, is attached hereto as Exhibit A and incorporated herein by this reference.
C25 -I15
III. THE CONTRACT SUM
The CITY shall pay to the CONTRACTOR for the performance of this Agreement, subject to any additions and deductions provided in the Project documents, the sum of Five Hundred Ninety -Eight Thousand, Nine Hundred Five and 00/100 dollars ($598,905).
C25 -I15
are intended to be as broad and inclusive as is permitted by the law of the State of California and will survive termination of this Agreement.
C25-115
C25-1 15
of the limits and coverage identified in this Agreement and which is applicable to a given loss, claim or demand, will be equally available to CITY.
C25-115
All Subcontractors (excluding those solely responsible for design Work) of any tier and suppliers shall be included as additional insureds as their interests may
C25-115
CITY and its officers,
C25-115
officials, employees, and agents shall continue as additional insureds under such policies.
C25-115
12. Separation of insureds.
C25-115
request, all agreements with consultants, subcontractors, and others engaged in the project will be submitted to CITY for review.
14. CITY's right to revise requirements.

Cities and counties throughout California, including Beaumont, have historically maintained local control over land use planning, housing densities, and the provision of infrastructure and public services. Through general plans and zoning codes, municipalities establish growth patterns that balance housing, public facilities, transportation, and quality of life for residents.
In recent years, the State of California has adopted several laws, such as the Surplus Land Act and the expanded Regional Housing Needs Allocation (RHNA) process, that significantly limit local discretion over land -use decisions. These laws mandate:
• The sale of surplus land with preference to housing developers, including affordability requirements of 15-25% of future units.
• Increased state oversight and reduced local control in approving high -density housing projects.
• The obligation for cities to update Housing Elements to accommodate large numbers of deed -restricted affordable housing units, often beyond local infrastructure capacities.
The City of Murrieta adopted Resolution No. 24-4799 in December 2024, formally opposing what it described as unfunded state mandates that strain municipal services
and diminish local control. Murrieta's resolution also encouraged other cities to take a united stance in advocating for land use authority to remain at the local level.
The attached draft resolution is provided for Council's discussion and consideration.
Fiscal Impact:
The estimated cost of preparing this staff report is $300.
This action may have an indirect impact on state grant applications if an opposition resolution is adopted.
Recommended Action:
Adopt a Resolution of the City Council of the City of Beaumont, California, opposing State interference in local land use authority; OR
Receive and file this report and remain neutral on this issue by not adopting the Resolution.

RESOLUTION NO. 2025-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BEAUMONT,
CALIFORNIA, OPPOSING STATE INTERFERENCE IN LOCAL LAND USE
AUTHORITY
WHEREAS, the City of Beaumont, like all California municipalities, has to plan responsibly for housing, infrastructure, and public services in a manner that reflects the unique character, needs, and resources of the community; and
WHEREAS, local governments, through general plans and zoning codes, establish land use policies that balance housing development with the provision of vital infrastructure, including roads, schools, libraries, parks, public safety facilities, and healthcare resources; and WHEREAS, recent state legislation, including the Surplus Land Act and mandates under the Regional Housing Needs Allocation (RHNA) process, increasingly limit local discretion by requiring cities to sell or lease surplus lands with mandatory affordable housing covenants, negotiate with developers regardless of local planning priorities, and demonstrate capacity to accommodate state -imposed housing allocations; and
WHEREAS, these mandates impose significant unfunded obligations on municipalities, compelling cities such as Beaumont to absorb growth that may exceed local infrastructure capacity, while also exposing the City to legal and financial liabilities without adequate state support; and
WHEREAS, the City Council of the City of Beaumont finds that such state actions undermine the principle of local control, create unsustainable development patterns, and threaten the quality of life of residents by straining existing infrastructure and municipal services; and WHEREAS, the City Council further recognizes the importance of collaborating with other California cities in advocating for the preservation of local land use authority and the need for balanced, community -driven growth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT AS FOLLOWS:
SECTION 1. ACTION
The City Council opposes state legislation and mandates that limit local control over land use decisions, including but not limited to the Surplus Land Act and current RHNA requirements.
SECTION 2. EFFECTIVE DATE
This Resolution shall take effect upon its adoption.

SECTION 3. AUTHORIZATION TO IMPLEMENT
The City Clerk shall certify to the adoption of this resolution, and the same shall be entered into the book of original resolutions maintained by the City Clerk.

• Maintain current 104 vendor spaces, but expand capacity by:
o Relocating Kids Zone and City Booths to adjacent parking lots (improved visitor communication and safety).
o Adding vendors along 7th Street.
o Creating a dedicated food court in the Beaumont Music Center parking lot. o Removing a few vendor spaces on Beaumont Ave near 7th Street to create more visitor seating areas and picnic tables to sit and eat at.
4. Shade & Sound Enhancements
• Install a stage shade structure in the summer months extending across the southbound lanes for audience comfort, with structural supports doubling as mounts for additional speakers to improve sound coverage.
5. Vendor Operations
• Establish multiple vendor check -in points for faster setup. • Continue road closures at 1:00 p.m.; vendor check -in to shift later if event hours change.
• Implement the recently adopted vendor registration fee to reduce vendor no- shows.

DATE: September 2, 2025
SUBJECT: Annual Freedom Festival 4th of July Celebration Recapitulation and Analysis
Description: Event summary and analysis for the 2025 Freedom Festival 4th of July Celebration.
Background and Analysis:
On May 6, 2025, staff provided an update to City Council on the annual 4th of July celebration regarding the pyrotechnic operator shortage in Southern California. This shortage, ongoing since the COVID-19 pandemic, stems from an aging workforce, retirements, and limited certification opportunities due to stringent training and background requirements.
In response, the City reallocated the fireworks budget to produce an enhanced drone show, one of the first in the region to use overlapping drone sequences for an extended performance. The result was a re -branded event, Red, White, and LIGHTS at Beaumont Nights, featuring a 22 -minute aerial display with animations of Beaumont landmarks, local sports, first responders, and traditional Independence Day imagery. The drones launched from the Stewart Park construction area, with primary viewing at Palm Innovation Academy's field and throughout the Beaumont Nights event area. 2025 Event Overview
The 2025 Red, White & Lights event featured 53 vendors across two downtown blocks, along with live performances by Acme Time Machine ('50s -'60s rock revival) and the Grand Junction Band (country hits), plus a DJ at the drone viewing site. Event setup included portable restrooms, trash receptacles, and light towers to support safety and accessibility. Additionally, the City's Parks & Recreation booth distributed thousands of branded patriotic giveaways, including canine bandanas for event -going dogs.
Data from the City's contracted software, Placer.ai, indicates the estimated attendance at the stage and vendor area was approximately 4,000 people. Placer.ai's privacy policy
prohibits the use of its platform to generate data about K-12 schools or any populations primarily composed of individuals under the age of 18. Due to this policy, and the fact that the viewing location is within Palm Elementary School, the City was unable to capture the full attendance in the viewing area. Staff estimates that an additional 1,000 people were present in the viewing area, bringing total attendance to approximately 5,000.
Public Safety
The Beaumont Police Department staffed the event with nine (9) police officers, including one police sergeant, from 4:30 p.m. to 11:00 p.m. Their primary responsibilities included ensuring public safety, providing security inside the venues, and managing traffic control for street closures. All staffing was comprised of overtime personnel. There were no significant incidents reported at either venue.
Given the recent increase in illegal fireworks activity during the 4th of July, the Beaumont Police Department supplemented patrol operations with overtime personnel dedicated to fireworks enforcement. This enforcement team included ten (10) police officers and one police sergeant/drone operator, working from 6:00 p.m. to midnight.
Two fire incidents were reported during the evening: a large brushfire of approximately two acres near the Amazon warehouse on 4th Street, which was extinguished within 45 minutes without damage to structures, and a small fire in the 1100 block of Orange Avenue, possibly caused by fireworks, that was quickly extinguished by neighbors.
Calls for Service and Citations
• 911 calls related to fireworks: 175 (compared to 57 in 2024) • Citations issued: 9
Public Safety Staffing Costs
• Freedom Festival staffing: $5,217.26
• Fireworks enforcement staffing: $5,368.23
• Total Public Safety staffing cost: $10,585.50
Community Feedback and Next Steps
While community feedback was positive for the drone show, many residents expressed a desire for the return of traditional fireworks alongside drones in future celebrations. In response, staff have begun working to restore the fireworks for the 2026 4t" of July Celebration while maintaining the high -quality drone experience. A Request for Proposals (RFP) for pyrotechnic services was released on August 29, 2025, and published on the cities public bidding software Planet Bids. The proposal due date is set for September 29, 2025. A second RFP for drone show services will also be released later this month to ensure the City continues to deliver top -tier holiday programming. It is
expected that vendors for both services will be selected in October, and the City will have executed agreements by the end of November, well in advance of the 2026 event.
Fiscal Impact:
The annual Freedom Festival 4th of July Celebration was included in the FY 2025/26 operating budget in General Ledger account 100-1550-7046-0000. Total operating expenditures for the 2025 event were approximately $98,552. Additionally, deposits for the FY 2025/26 celebration are included in the budget.
The cost to prepare this staff report is estimated to be $480.

FREEDOM FESTIVAL:
The 2025 Freedom Festival was held in conjunction with Beaumont Nights on Friday, July 4th, 2024. This event was free to the public and included live entertainment, vendors, and a drone show. Beaumont Nights was located along Beaumont Ave., between 6th Street and 8th Street. The drones for the Drone Show were deployed from Stewart Park with a viewing area at the Palm Innovation Academy field. There were approximately 2,000 in attendance, between the two venues, throughout the day.
The Beaumont Police Department staffed this event with a total of (9) Police Officers, including one Police Sergeant (supervisor) from 4:30 pm to 11 pm. Their primary responsibility was to provide safety at the event, as well as traffic control for street closures. During the event, police officers provided security inside the venues. Staffing was comprised of overtime personnel.
During this event there were no significant incidents at either venue.
FIREWORKS ENFORCEMENT:
During recent years, the City of Beaumont has experienced an increase in illegal fireworks during the 4th of July. Since 2022, the City of Beaumont took proactive measures and enhanced our local municipal code 9.41.020, increasing the imposed fines to the following:
• $1,000 for the 1St violation
• $2,500 for the 2nd violation
• $5,000 for the 3rd and all subsequent violations
The Beaumont Police Department supplemented patrol operations with overtime personnel dedicated to the enforcement of illegal fireworks. In conjunction with the Freedom Festival, this effort was staffed with a total of (10) police officers, including one Police Sergeant (supervisor/drone operator) from 6:00 pm to midnight.
The personnel were subdivided into four pairs. The two officer units were driving marked police vehicles. Two drone operators were strategically placed in the city. Officers responded to calls for service related to fireworks and directed to areas fireworks were being ignited.
A total of nine violators were cited (three cited in 2024). One small firework was confiscated, due to the subject that were cited had ignited the fireworks that were visible by officers. There was a large brushfire, approximately two acres in size, adjacent to the ag

Amazon warehouse on 4th Street. The fire was extinguished within approximately 45 minutes, and no structures were threatened/damaged. There was a small fire in the 1100 block of Orange Ave., possibly started by fireworks, but the owner of the property did not answer. The fire was quickly put out by neighbors.
At approximately 11:00 pm, the firework related calls and activity slowed down, becoming very infrequent. Due to the calls not justifying further overtime costs and the need to supplement patrol, officers were released at approximately midnight.
TOTALS:
• 911 calls for Service = 175 calls related to fireworks (57 firework calls in 2024) • Citations Issued = 9

CONDITIONS/RECOMMENDATIONS FOR 2026:
FREEDOM FESTIVAL:
1. The staffing level was sufficient, due to two separate locations needing to be covered. The Palm Innovation Academy viewing area fills in approximately one hour prior to the drone show.
2. Community Services was provided with delayed information from the Drone Show vendor, requesting the 800 blocks of Orange Ave. and Maple Ave. clear from spectators. This was related to the "fall out zone" of the drone being within this area. Citizens were parked in this area and had set up chairs. It was difficult to accommodate the request on short notice. In the future this request should be evaluated.
3. I recommend there be no parking in the 800 block of Orange Ave and Maple Ave.
Also, close Orange Ave. and Maple Ave. at 9th Street. Prior to the drone show, several vehicles attempted to drive south from 9th Street, and 8th Street was closed. ag
$7$
Due to there being cars parked on the east and west curbline of both streets, vehicles could not easily turn around to drive back north.
4. 8th Street from Beaumont Ave. to Palm Ave. should have been posted no parking 72 -hours ahead of the event. Vehicles parked on 8th Street attempted to leave at the conclusion of the Drone Show, but could not due to citizens walking in the street.
5. It is recommended that Code Compliance work the event, due to unlicensed food vendors attempting to set up in the area, ice cream trucks and pushcart vendors walking through Market Night.
6. Obtain a list of licensed/approved food vendors from the Planning Department, the day prior to the event.
FIREWORK ENFORCEMENT:
1. The four teams of two officers, with two drone operators was an improvement from 2024. There were 175 firework calls for service, versus 57 for 2024. There were 9 citations issued this year, versus 3 citations in 2024.
2. Begin a firework education campaign in June in reference to safety concerns and fires. Along with the education, we will provide information about the Beaumont Municipal Code related to fireworks and the potential to receive up to a $5,000 citation.

SUBJECT: Oak Valley Parkway Medians Project Update
Description: Project Design Update for Capital Improvement Project (CIP) No. R-21:
City-wide Medians Project.
Background and Analysis:
On March 19, 2024, the City Council awarded an agreement to Conserve Landcare for the construction of the 6th Street Medians improvements. The new design included more drought -resistant landscaping, and the scope of work included:
• Mobilization and Traffic Control Plans
• Demolition
• BMP Implementation
• Concrete, Granite, Cobble, and Stove Paving
• Landscape Boulders
• City Entry Monument
• Electrical and Lighting
• Solar Power Pole
As the project approached completion, the City Council provided direction to staff to proceed with re -designing the Oak Valley medians to mirror the new 6th St. design.
Subsequently, on October 15, 2024, staff brought forth an amendment to the City's adopted five-year Capital Improvement Plan to change the project title from "6th Street Medians" to "Citywide Street Medians".
On October 29, 2024, a Professional Services Agreement was executed with Architerra Inc. in the amount of $63,200 to provide landscape architectural services and develop construction documents for the renovation of the Oak Valley Medians from Highland Springs Avenue to Cherry Avenue and from Desert Lawn to Palmer Ave.
As part of the scope, Architerra was tasked with preparing conceptual and construction - level plans, specifications, and cost estimates for median landscaping improvements.
This includes site evaluation, irrigation design, and integration of aesthetic and functional features that meet City standards. The work also covers coordination with City staff, compliance with applicable regulations, delivery of bid -ready construction documents, and construction administration.
Milestones Completed to Date
1. Site Visits and Data Collection
2. Hardscape Design
3. 3D Renderings of Eastern and Western Medians
3. CAD Base Development / Drawings
4. Final Construction Plans — In Progress (90% Complete) Cost Estimates and Current Funding
At this time, it is expected that the renovation of the Eastern medians will cost $1,198,786 and the Western medians will cost $2,471,834, bringing the total cost to $3,670,620. Based on current funding levels and contingent on bid results, it is expected that there will be a total funding shortfall of approximately $2.65 million. While this cost is significantly more than that of the 6th Street Medians project, the Oak Valley Medians encompass nearly four times the square footage.
Next Steps
Plans are scheduled to be finalized, incorporating electrical and structural components, for submittal to the Building Department for review and approval on or about October 3, 2025. The anticipated schedule provides for the release of a Request for Bids (RFB) in Tate October, with submissions due in November.
To address the funding gap, the project may be separated into two phases, with an initial contract award for the Eastern Medians. Contingent on Bids, this phasing may allow for contract execution in December and tentative commencement of construction in January 2026.
Fiscal Impact:
Funding for this project is provided through Capital Improvement Project R-21. Please refer to the following Project Accounting summary.

Staff Report
TO: City Council
FROM: Gustavo J. Romo, Deputy City Manager
DATE: September 2, 2025
SUBJECT: Discussion of Helmet Ordinance
Description: Discussion regarding the potential adoption of an ordinance requiring the use of protective helmets for operators and passengers of electric bicycles ("e -bikes") and other electric mobility devices; discussion to include whether to expand protective helmet requirements to all human -powered vehicles, such as traditional bicycles, nonmotorized scooters, skateboards, in -line skates, and roller skates.
Background and Analysis:
In recent years, the popularity of human -powered and electric -assisted devices including, but not limited to, e -bikes, e -scooters, skateboards, etcetera, has been on the rise. Although these popular devices provide an affordable, environmentally friendly, and convenient alternative to traditional vehicles, their growing use has been accompanied by increased hospital visits, reports of traffic collisions, sidewalk injuries (including traumatic brain injuries), and unsafe riding behaviors, particularly involving individuals not wearing protective gear.
The California Vehicle Code (CVC) classifies e -bikes into three categories (Class 1, 2, and 3) under Section 312.5. CVC Section 21213 requires helmets only for Class 3 operators of all ages. CVC Section 21212 provides that a person under 18 years of age may not operate a bicycle, nonmotorized scooter, skateboard, nor wear in -line or roller skates without a helmet. However, cities are permitted to enact stricter local ordinances to protect the public health, safety, and welfare under what is commonly referred to as the City's "police power" (Article XI, Section 7 of the California Constitution). The courts have routinely upheld the ability of local governments to impose stricter safety standards where state law is silent or permissive, where the regulations do not conflict with existing state law, or when the state does not seek to fully occupy the field of regulations in a particular area.
Although this topic recently came up in relation to electric bicycle safety measures, the impacts of not wearing a helmet also apply to non -motorized devices, such as traditional bicycles, skateboards, scooters, and roller skates/blades. As such, the City Council may
give direction to include such traditional modes of transportation in a potential ordinance, if it so desires.
If enacted, the ordinance would be an exercise of the City's police power to protect the public health, safety, and welfare. The City Council, therefore, has the authority to discuss extending the protective helmet safety requirements to all operators and passengers of human -powered and electric -assisted devices, including bicycles, nonmotorized scooters, skateboards, in -line skates, roller skates, electric bicycles, and electric mobility devices, regardless of age.
Fiscal Impact:
The cost to prepare this staff report is estimated at $250.
Recommended Action:
Staff recommends to pursue a helmet ordinance covering all human -powered and electric assisted mobility devices.

SUBJECT: Legislative Update — September 2025
Description: An update on pending state legislation and redistricting measures with potential impacts on the City of Beaumont.
Background and Analysis:
City staff, in coordination with the City's legislative consultants, CPPG and David Turch and Associates, continue to monitor and track bills that could affect City operations, planning, funding, and governance.
A key area of focus in this legislative cycle is redistricting and elections. Several measures could significantly influence representation at both the state and federal levels, including SB 280 (Cervantes) on elections, AB 604 (Aguiar-Curry/L. Gonzalez) on congressional redistricting, and ACA 8, which proposes changes to how congressional districts are drawn. These measures may impact how the City of Beaumont is aligned within legislative and congressional districts. Boundary changes could alter the City's access to state and federal representatives, which in turn affects funding opportunities, advocacy strategies, and partnerships. Ensuring fair district boundaries is critical for maintaining the City's ability to protect its interests and advance its legislative priorities.
In addition to redistricting, several bills are currently under review that have direct or indirect implications for Beaumont at the State level:
• AB 339 (Ortega) — Increases notice requirements for local public employee organizations, potentially creating additional administrative burdens for cities.
Status: Senate Appropriations. Position: Oppose.
• AB 920 (Caloza) — Establishes a centralized application portal under the Permit Streamlining Act to expedite housing development projects. While it could accelerate housing approvals, it reduces local control. Status: Senate Appropriations. Position: Watch.
• AB 992 (Irwin) — Relates to peace officer standards and requirements, which may impact local law enforcement operations. Status: Senate Appropriations, suspense file. Position: Watch.
• SB 31 (McNerney) — Expands regulations related to water quality and recycled water usage, influencing long-term planning for water sustainability. Status:
Assembly Appropriations. Position: Watch.
• SB 634 (Perez) — Addresses homelessness through new local government requirements without identifying clear funding sources. Status: Assembly Floor.
Position: Oppose.
• SB 415 (Reyes) — Provides regulations for logistics use developments and truck routes, with potential effects on Beaumont's industrial corridors. Status:
Assembly Appropriations. Position: Neutral.
• AB 735 (Carrillo) — Similar to SB 415, establishes planning and zoning standards for logistics developments and truck routes, potentially affecting regional goods movement. Status: Senate Appropriations. Position: Neutral.
Looking ahead, the September 12 deadline for the Legislature to pass bills and the October 12 deadline for the Governor to act are key dates that will determine the outcome of these measures. City staff and CPPG will continue to monitor legislation and provide updates to the Council.
At the Federal level, the following Executive Orders and Public Laws could have an impact on the City:
• Executive Order: Suspending Duty -Free De Minimis Treatment for All Countries — Issued Jul 30, 2025. Ends the duty-free <$800 import exception for most shipments; temporary carve -out for postal shipments until CBP publishes a new process. City impact: higher procurement costs and delivery timelines for certain goods; local small e-commerce/importers may face higher costs that could affect sales tax receipts.
• Executive Order: Improving Oversight of Federal Grantmaking — Issued Aug 7, 2025. Directs agencies/OMB to tighten NOFO reviews, cap indirect costs preference, add termination -for -convenience clauses, and prohibit discretionary grants that fund certain activities; requires senior -level approval and added drawdown controls. City impact: expect new compliance terms, scoring criteria, and monitoring requirements across HHS/HUD/DOT/EPA and others. Grant language, policies, and drawdown procedures should be reviewed and updated. • Executive Order: Further Modifying Reciprocal Tariff Rates — Issued Jul 31, 2025. Raises/adjusts additional ad -valorem tariffs on many trading partners; includes a 15% floor framework for certain EU goods and a 10% rate for non - listed partners, with anti -transshipment penalties. City impact: potential cost
increases for fleet, IT hardware, public works materials; consider price -escalation clauses and schedule risk in contracts.
• VA Home Loan Program Reform Act (Public Law 119-31) — Signed Jul 30, 2025. Creates a VA "Partial Claim Program" to help prevent veteran mortgage foreclosures and directs loss -mitigation sequencing; boosts authorizations for homeless -veteran programs in FY25-26. City impact: may stabilize some veteran households locally and increase access to federal funds for veteran homelessness partners.
• Filing Relief for Natural Disasters Act (Public Law 119-29) — Signed Jul 24, 2025. Allows the IRS to extend deadlines for state -declared disasters and lengthens mandatory extensions from 60 to 120 days. City impact: useful for resident and business tax relief during wildfires/floods; the City can amplify IRS notices after state declarations.
• One Big Beautiful Bill Act (Public Law 119-21) — Signed July 4, 2025.
Creates new temporary deductions (e.g., "no tax on tips," "no tax on overtime," car -loan interest; extra senior deduction) and accelerates the phase -out of several energy tax credits. Local implications: potential near -term boost to disposable income for hospitality/retail workers; possible pull -forward or slowdown in EV/solar adoption affecting sustainability program uptake and permitting volumes; cuts to Medicaid and the Supplemental Nutrition Assistance Program (SNAP), which will put more pressure on state budgets, which in turn will constrain municipal budgets. City communications may need to update residents on changed credits/deductions.
Fiscal Impact:
The estimated cost of preparing this staff report is $300.
Recommended Action:
