LOCAL COMMISSIONS APPOINTMENT LIST
June 10, 2024
RECOMMENDATION:
It is staff's recommendation that the City Council review the Commissions Appointments List and by motion, remove commissioners and/or make appointments to the posted vacancies.
BACKGROUND/DISCUSSION:
The Local Appointments List includes all Bell Gardens Commissions and Commissioners. The City Council adopted Ordinance No. 825 on July 13, 2009 establishing minimum requirements for service on commissions. All Commissioners must reside within the City of Bell Gardens and may only serve on one Commission at a time. Once appointed, each Commissioner must adhere to the requirements of the City's Conflict of Interest Code and state - mandated AB 1234 ethics training and AB 1661 harassment training.
Ordinance No. 825 allows each Council Member to remove or appoint one candidate per Commission, subject to the approval of the Council majority. Appointed Commission Members serve terms that coincide with the term of the Council Member who made the appointment.
CONCLUSION:
After an appointment is made, Commission members will receive their Oath of Office before beginning service with their respective Commission at the next regularly scheduled Commission meeting. The City Clerk's Office will arrange for the proper filing of Conflict of Interest Code forms and schedule trainings for AB 1234 and AB 1661.

RESOLUTIONS CALLING FOR NOVEMBER 5, 2024 GENERAL AND SPECIAL
MUNICIPAL ELECTIONS, REQUESTING CONSOLIDATION SERVICES WITH LOS
ANGELES COUNTY, AND ADOPTING REGULATIONS FOR CANDIDATE STATEMENTS DATE: June 10, 2024
RECOMMENDATION:
It is staff's recommendation that the City Council adopt the following:
1. Adopt attached Resolution calling for the holding of a General Municipal Election to be held on Tuesday, November 5, 2024;
2. Adopt attached Resolution calling for the holding of a Special Municipal Election to be held on Tuesday, November 5, 2024;
3. Adopt attached Resolution requesting to consolidate a General Municipal Election with the Los Angeles County Board of Supervisors;
4. Adopt attached Resolution requesting to consolidate a Special Municipal Election with the Los Angeles County Board of Supervisors; and
5. Adopt attached Resolution adopting regulations for candidate statements submitted to voters on Tuesday, November 5, 2024, which includes the new optional Candidate Online Statement.
BACKGROUND/DISCUSSION:
Bell Gardens Municipal Code Chapter 2.60.010 states that pursuant to Section 1301 and 1000 of the California Elections Code, the General Municipal Election date shall be the first Tuesday after the first Monday in November of even -numbered years. Previously, the City held elections in odd -numbered years but on September 1, 2015, Governor Brown signed Senate Bill 415 into law as California Elections Code Division 14 Chapter 1.7 "Voter Participation", requiring that local governments with low voter turnout hold elections only on statewide election dates.
The Bell Gardens City Council adopted Ordinance No. 881, moving the City to even -year elections, on December 12, 2016.
The upcoming General Municipal Election is scheduled for Tuesday, November 5, 2024. The ballot will include two (2) City Council Member seats for four-year terms and one (1) City Council Member seat that will require a special election to finish serving the remaining two (2) years of the existing term.
The City is recommending consolidation of the General Municipal Election and Special Municipal Election with the County and State election occurring on the same day. The City Clerk's Office will assume responsibility for the nomination period including the qualification of candidates and publication of required notices and the County will assume responsibility for the creation of the voter information guide, voting and canvass of the returns.
As in previous years, standards for Council Candidate Statements will be as follows: Candidate Statements are limited 790
to 200 words. If a candidate chooses to submit a candidate statement to be included in the Voter Information Guide, they are to submit payment at the time of filing their nomination packet.
Pursuant to California Elections Code sections 13307(c)(1)(2) and 13307.7, the Los Angeles Registrar Recorder County Clerk's office launched an Online Candidate Statement Pilot in LA County in 2022 that allowed candidates running for County level offices to pay for a candidate statement that would be posted online. The pilot program then became a program that was expanded to include cities, school districts, and other local jurisdictions that were on the ballot for the March 2024 election cycle, and for a reduced fixed fee of about $280, online statements were published on a dedicated page on the www.lavote.gov website. This option is being extended to the cities on the November 2024 election cycle. City staff recommends that this option be provided to Bell Gardens candidates as described in the attached Resolution
If a candidate chooses to pay for a translated candidate statement to be included in the Voter Information Guide, they are to submit payment at the time of filing their nomination packet.
Once adopted by Council, the attached resolutions will be forwarded to the Los Angeles County Board of Supervisors and the Los Angeles County Registrar -Recorder's Office for formal approval.
CONCLUSION:
If approved, the City of Bell Gardens will:
1. Call for the General and Special Municipal Elections to be held on November 5, 2024;
2. Request for an election consolidation with the Los Angeles County Board of Supervisors; and 3 . Adopt regulations for candidate statements submitted to voters on Tuesday, November 5, 2024, including the new optional Online Candidate Statement.
FISCAL IMPACT:
The estimated cost for the November 5, 2024 elections is $110,000.

COUNCILMEMBER MARIA PULIDO'S EXCUSED LEAVE OF ABSENCE
June 10, 2024
RECOMMENDATION:
Grant permission and approve the leave of absence of Bell Gardens City Council Member Maria Pulido.
BACKGROUND/DISCUSSION:
City Council Member Maria Pulido wishes to take temporary medical -related leave of absence from attending City Council commencing June 11, 2024 and ending July 31, 2024.
California Government Code Section 36513 provides that if a City Council Member is absent without permission from all regular city council meetings for 60 days consecutively from the last regular meeting he or she attended, his or her office becomes vacant and may be filled as any other vacancy.
The Bell Gardens Municipal Code Section 2.04.020 sets the regular meeting schedule of the Bell Gardens City Council on the second and fourth Monday of each month. Thus, a Bell Gardens City Council Member who misses four consecutive meetings without an unexcused absence, would lose their position on City Council.
CONCLUSION:
In lieu of being absent from meetings, Council Member Pulido could participate remotely (Le., teleconference) pursuant to Government Code Section 54953. If Council Member Pulido were to follow traditional pre-COVI D remote participation procedures that require (i) the remote location identified on published agenda; (ii) the posting of the agenda at the remote location; and (iii) that the location be open to the public, the Council Member could participate remotely indefinitely so long as a quorum of the Council is physically present at City Hall during those meetings in which participation is remote. Under these traditional remote participation rules, there is no requirement that a Council Member have a reason for participating remotely.
Recognizing that traditional remote participation rules may not be practical on any sort of ongoing basis, the only way for Council Member to particate remotely under Government Code Section 54953 would be for her to invoke the "just cause" or "emergency cause" remote participation exceptions first established under AB 2449 in 2023.
Under Government Code Section 54953(e)(2)(A), the Council Member could participate remotely without having to comply with the agenda noticing and posting requirements associated with traditional remote participation procedures discussed above and without having to make the remote location accessible to the public. The Council Member, however, would be required to satisfy the following alternative set of requirements and restrictions: (i) that the Council Member have a "just cause" or "emergency cause" reason for participating remotely; (ii) that the Coucil Member 809
notify the City Council of her need to participate remotely for "just cause" or "emergency cause" reason at the earliest opportunity possible, including at the start of a regular meeting; (iii) that the Council Member be connected via an audio and visual connection; (iv) that at least a quorum of the City Council is physically present at the meeting; (v) as to the "just cause" basis for remote participation, the Council Member may only invoke "just cause" a maximum of two times in a single calendar year; (vi) as to the "emergency cause" basis for remote participation, the City Council must vote to allow such remote participation; (vii) when remote participation is permitted for "just cause" or "emergency cause" reasons, members of the public must also be afforded the ability to participate remotely by two- way audiovisual platform or a two-way telephonic service and a live webcasting of the meeting; and (viii) the Council Member must disclose whether persons 18 years of age or older are present with them at the remote location and the nature of their relationship to such individual(s).
Under Government Code Section 54953, "just cause" for remote participation is limited to the following circumstances: "caregiving need for child, parent, grandparent, grandchild, sibling, spouse, or domestic partner"; a contagious illness preventing member from attending; a need related to physical or mental disability; or travel while on official business of the body or another agency. "Emergency Circumstances" means a physical or family medical emergency that prevents a member from attending in person. There is no limitation for remote participation under the code for "emergency circumstances."
It is also important to note that a member of a legislative body may not participate in meetings solely by teleconference under this law for more than three (3) consecutive months or 20 percent of the regular meetings for the public agency within a calendar year. If the legislative body meets less than ten times in a year, a member may not participate remotely for more than two meetings.

APPROPRIATIONS LIMIT
DATE: June 10, 2024
RECOMMENDATION:
It is staff's recommendation that the City Council by motion approve:
1. The attached Resolution adopting the fiscal year July 1, 2024 to June 30, 2025 (FY 2024-2025) Operating and Capital Improvement Budgets and Compensation Plan; and
2. The attached Resolution establishing the GANN Appropriations limit for FY 2024-2025 pursuant to Article XI I I -B of the California State Constitution.
BACKGROUND/DISCUSSION:
Annual Budget Process
The City of Bell Gardens adopts a budget on an annual basis. The budget consists of projected revenues and proposed expenditures. Proposed expenditures specify the spending plan for the upcoming fiscal year, while the projected revenues address the expected available resources to fund City expenditures. Depending on the difference between the proposed expenditures and projected revenues, the budget will consist of a deficit, surplus, or a balanced budget.
Once approved by the City Council, the proposed expenditures are considered appropriated (at the fund level) and become available to pay for City expenditures.
Projected revenues are developed by the finance department along with input from other City departments. The formulation of the upcoming fiscal year's projected revenues includes taking into consideration projected economic conditions, historical analysis, the state budget, assistance from third parties and other future expectations.
The budget process begins with the City Manager instructing each City department to prepare budget worksheets which detail each respective department's spending plan for the upcoming fiscal year. The budget worksheets are received and reviewed by the finance department. Budget meetings are then held with each respective department, finance department and the City Manager to review and discuss the proposed spending plans and adjust as necessary. Finally, the City Manager will present the annual budget to the City Council.
Proposed Operating Budget
The proposed operating budget for Fiscal Year 2024-2025 reflects the strength of the local economy with a slightly 811
Surplus/(Defici
positive economic outlook as the City's top Seven (7) revenue sources show slight increases. After making changes to reflect the approved MOUs, vacancies, additional approved budget during the year, revenue adjustments, the general fund is projecting to end Fiscal Year 2023-2024 with an estimated fund balance of $166K.
FY 2023-2024 Financial Update
General Fund Update (FY 2023-2024)
For FY 2023-2024, the City Council adopted a General Fund budget with a surplus of $735K. During the mid -year review and after additional City Council approved General Fund expenditures, estimates were revised and the city showed a surplus of $187K. The expected General Fund projection for the end of year is a surplus of $166K.
General Fund revenues are projected to be higher than the adopted budget by $1.8M or 4.18%. The major increase in revenue is due to increased Bicycle Club Fees ($223K), Motor Vehicle In -Lieu ($454K), Refunds & Reimbursements ($390K) Building Permits ($130K) and Billboard lease Revenue ($110K).
Expenditures for FY 2023-2024 are projected to be higher than the original budget amount by $2.35M, due to City Council approved expenditures, MOU salary increases of 4%, leave payout, vacancy savings, part-time costs and increase costs in maintenance and supplies.
After the fiscal year ends on June 30, 2024, the City's financial information will be audited and financial statements will be published which will report the actual revenues, expenditures and surplus or deficit.

Bicycle Casino Revenues
After the Bicycle Hotel was opened in December of 2015, revenues from the Bicycle Casino reached a new high point in fiscal year FY 2016-2017, the first full fiscal year of operation, in the amount of $14,138,000. The following fiscal year, FY 2017-2018, revenues significantly decreased by $1,208,000 to $12,930,000, but steadily increased in the following years reaching another new high in fiscal year FY 2018-2019. The FY 2019-2020 Casino revenues were trending to set another record; however, on March 14, 2020, due to COVI D-19, the Casino abruptly closed and sporadically open until February. Beginning March 2021, the Casino has been successfully open daily, and the revenue has been steadily increasing again. For FY 2022-2023, Casino revenue was adopted at $14,900,000 which is $500,000 higher than FY 2021-2022 estimated budget. FY 2022-2023 saw a record high of $18,986,140. For FY 2023-2024 revenue was adopted at $17,951,569, year-end projections for FY 2023-2024 at $18,175,000. This is projected based on recent historical revenue figures that have increased during FY2023-2024. For FY 2024-2025 we are projected revenues of $19,836,000. However, these revenue projections are dependent on external factors such as the Casino's ability continue to increase revenues, the overall economy and government regulation. The negative existence of any of these external factors could have a material impact on revenue projections.

GANN Limit Initiative/Appropriations Limit for Fiscal Year 2024-2025 On an annual basis, California cities are required to complete an appropriations calculation for each fiscal year. The City's auditors are required to review and approve the appropriations calculation as part of their audit of the city.
Article XI I I -B of the California State Constitution places limits on the amount of revenue that can be spent by all entities of government. It is the responsibility of the City to calculate the annual appropriations limit. The prior fiscal year's limit is increased by a factor based upon the change in the population or that of the County if the County change in population is greater than the City's. Staff chooses the population change that is most favorable to the City. The choice of each of these factors is an annual election. For FY 2024-2025, the change in population is -
0.49% for the City of Bell Gardens and 0.05% for the County of Los Angeles. The FY 2024-2025 appropriations limit calculation is based on the 0.05% County of Los Angeles' population change. The change in the California per capita personal income was 3.62%.
For FY 2024-2025, the appropriations limit is $98,334,086; estimated tax proceeds are $36,607,407. The City is $61,726,679 below the FY 2024-2025 appropriation limit. An analysis of the calculation is attached on the GANN Limit worksheet.
Next Steps
Upon City Council's adoption of the budget and appropriations limit, the final adopted budget document will be compiled and published. The City budget will be constantly reviewed and updates will be provided to the City Council throughout the year. Additionally, requested increases to supplies, services and personnel, and capital outlay request will be analyzed and prioritized for the upcoming Fiscal Year. Any necessary changes that occur during the Fiscal Year will be brought back to the City Council for consideration.
CONCLUSION:
The proposed budget will result in a FY 2024-2025 All City Funds budget of $78,205,327. The City has remaining CIP projects of $64,824,684 with $13,461,706 in new appropriations for FY 2024-2025. Once the budget is adopted by the City Council, the final budget document will be compiled and published on the City's website. The budget will be monitored throughout the year and will be reanalyzed during the mid -year budget review.
FISCAL IMPACT:
The proposed budget will result in a total FY 2024-2025 All Funds budget of $78,205,327. The proposed City budget includes General Fund expenditures of $46,163,848 and proposed General fund revenues of $46,236,251 which results in a budget surplus of $72,403. The proposed budget includes a $200,000 transfer to General Fund reserves which will grow the contingency reserve to $4,300,000 which is 9.3% of General Fund proposed 821
expenditures.

Digital Discrimination Motion Agenda item 14: RESOLUTION
DENOUNCING DIGITAL DISCRIMINATION
6/10/2024 12:41:48 PM
Good afternoon council members. My name is Carlos Rodriguez on behalf of Innovate Public Schools and as a member of the Digital Equity LA Coalition, a group of nearly 70 equity and justice advocate organizations, working across the County and across the State to advance universal, equitable access to fast, reliable, and affordable broadband, and we care about this deeply because we focus on organizing parents for educational justice and without reliable internet students can no longer have quality education.
I support Item 14 which addresses the topic of digital discrimination in the City of Bell Gardens. Ensuring everyone has affordable, high-speed, and reliable internet access is essential for accessing education, health care, public resources, and participating in economic and civic opportunities. Thank you to Councilmember Chavez for introducing this motion. As an advocate, I urge the council to help close the digital divide by supporting the motion denouncing digital discrimination.
Thank you,
