C. Any payment required pursuant to this section shall be made payable to the city by cash, credit card, or cashier's check.

D. Waiver. Any fee, deposit or payment required pursuant to this chapter may be waived by the SEC if the applicant provides as part of the permit application a sworn affidavit in writing, together with any supporting documents, demonstrating the applicant's actual financial inability to pay the fee, deposit or payment and establishes to the satisfaction of the SEC that such fee, deposit or payment is not necessary.

1. Any applicant whose request for waiver is denied may appeal the decision by filing a written notice of appeal with the city clerk within five (5) days after such decision is made.

5. The city clerk shall provide notice not later than ten (10) calendar days before the scheduled hearing by first class mail to the appellant at the address listed on the request for a hearing.

6. The hearing officer shall issue a written decision within five (5) calendar days of the hearing. The decision of the hearing officer shall be final.

C. Waiver. If the SEC determines that a particular parade or special event does not present a substantial or significant public liability or property damage exposure for the city or its officers, agents, and employees, the city may provide a written waiver of some or all of the insurance requirements of this section.

D. No person shall conduct a parade or special event under a parade or special event permit without the insurance coverages as required by this section being in full force and effect. However, the insurance requirement for special events involving only the exercise of free speech rights may be waived by the SEC, , if the applicant certifies in writing that:
(1) the applicant and/or sponsoring organization does not maintain such insurance coverage; (2) the cost to obtain insurance coverage for the parade or special event is not commercially reasonable or is so cost prohibitive as to prevent the applicant or sponsoring organization from holding the parade or special event; and (3) the parade or special event will not include any of the following: pyrotechnics, commercial activity, the sale or consumption of alcoholic beverages, operation of carnival or animal rides or demonstrations with animals, floats or other non-standard vehicles, specialized recreational equipment, handling or serving of food, open fires, or fuel storage.

5. There are no outstanding violations of this code, any other code adopted by this code, or any state law on the private location for which the special event is to or is taking place.

6. There are no outstanding fees, fines, or other amounts outstanding and owed to the city in connection with the special event, inclusive of such amounts owned by vendor or sidewalk vendor that is part of the special event.

The city may deny a permit upon finding of any of the above facts do not exist, if the location where the special event is to take place or any property within the city owned, leased, or otherwise used by an applicant contains any violation of this code, any other code adopted by this code, or any state law, or if the applicant has outstanding fees, fines, or other amounts due and owing the city.

]Chapter 10.64 - PARADES AND SPECIAL EVENTS[1]
Sections:

Footnotes:
--- (1) ---
Editor's note— Ord. No. 2017-001, § 2, adopted Sept. 19, 2017, amended Chapter 10.64, §§

10.64.010—10.64.160, in its entirety to read as herein set out. Former Chapter 10.64, pertained to similar subject matter and derived from Ord. 98-01, § 1, adopted 1998; and Ord. 91-23 § 1 (part), adopted 1991.

10.64.010 - Findings.

The city council finds that parades and special events create traffic congestion and safety hazards, and require the expenditure of city resources for the regulation of such parades and special events.

Likewise, the city council finds that such parades and special events may also result in noise disturbances, increased littering, an invasion of privacy, a hindrance in the public's right to quiet enjoyment, or the harassment of members of the public.

CITY COUNCIL MEETING DATE: OCTOBER 21, 2025
TITLE: AMENDING CHAPTER 2.36 (PLANNING COMMISSION) OF THE CHINO MUNICIPAL CODE.

PAGE: 2

BACKGROUND
Section 2.36.020 (A) of the Chino Municipal Code establishes that the Chino Planning Commission shall consist of nine members, appointed by the Mayor with the approval of the City Council. This includes seven resident members and two nonresident members appointed from the City’s Sphere of Influence (SOI). The SOI is land area adjacent to the City boundary in the unincorporated area of the County of San Bernardino that is expected to one day be annexed into the City.

The scope of the Commission’s authority is defined in Chino Municipal Code §§ 2.36.060 and

20.23.010. The Commission has authority to review and make recommendations to the City Council on requests for general plan amendments, specific plan amendments, zone changes, zone ordinance amendments, and development agreements. The Commission also has authority to review and take final action on a variety of planning applications, including special conditional use permits, major variances, site approval applications, tentative tract and parcel maps, and pre-zoning of areas within the City’s SOI. The SOI members were added by the City Council in 2024 (Ordinance No. 2024-010) and have a limited role to only act on issues that would affect the areas within the SOI.

Recognizing the vital importance of sound planning and the critical role the Planning Commission plays in the current and future development of the City’s commercial, industrial and residential zones, the City of Chino strives for excellence in the selection of Planning Commissioners. To achieve this goal, the Council and City Staff periodically review the composition of its Commissions to maximize effectiveness. This review may include key factors such as compensation, size, and/or representation.

ISSUES/ANALYSIS
After a review of neighboring cities, City Staff has found that the Chino Planning Commission has more members than most cities in the area. After this review, Staff believes the City can achieve the same goals of delivering excellence in sound City Planning with a reduced Commission size of five resident members.

Comparison Cities
City Staff evaluated several neighboring cities to compare the Planning Commission size of those commissions against key factors such as City size, Council composition, and City population. According to the table below, most neighboring cities have five commissioners. This is consistent with the number of Council Members.

City Name Population City Size

Given the geographic size of the City of Chino, number of Council Members and population, the Chino Planning Commission is larger than most of its neighboring cities.

Appointments, Vacancies and Resignations
Section 2.36.020 (A) of the Chino Municipal Code establishes that “in the event that a member resigns or dies before the end of his or her term, or for any reason is unable to complete the term, the Mayor may appoint a member to fill the vacant position with the approval of the City Council.” This section will remain unchanged.

Residency and Term
Section 2.36.020 (B) of the Chino Municipal Code states that “seven members of the Planning Commission shall be residents of the City at the time of their appointment and throughout their terms of office and shall serve for a term of four years (full commission membership). The term and residency will remain unchanged, however, the number of commissioners in this section will be reduced from seven to five.

Quorum
If approved, the new quorum for the Chino Planning Commission will be set at three.

Sphere of Influence and Other Commissions
Approval of these changes will not impact the number or scope of the SOI members on the Planning Commission. Nor will these proposed changes impact the make-up of the Chino Community Services, Parks and Recreation Commission size or scope.

Based on the information provided, City Staff is recommending the City Council reduce the Planning Commission size from seven to five members. If approved, no other changes will apply to the Chino Planning Commission.
