(Based on 2022 State HCD Income Figures for Orange County)
1. Income Eligibility1
The first step in determining eligibility for tenancy and occupancy of the Affordable Units (that include studios/0-bedroom, 1-bedroom and 2-bedroom units) is determining whether the person or family that will be renting the housing unit meets the following income standards applicable to Orange County, based upon the size of the household:

2. Determining Affordable Rent
For rental housing, the second step in determining compliance with affordable housing requirements is determining whether the total rent costs payable by the tenant are within allowable amounts. Rent figures below are rent plus/inclusive of applicable utilities allowance (i.e., rents stated are set at the gross rents minus the currently applicable utilities allowances based on basic cooking, heating, and electric per the applicable regulation.)
For Lower Income Households:2
• renting a 0 bedroom unit, monthly rent may not exceed $1,250.25 • renting a 1 bedroom unit, monthly rent may not exceed $1,429.50 • renting a 2 bedroom unit, monthly rent may not exceed $1,608.00 1 Based on currently effective median income of Orange County, as released by the Department of Housing and Community Development (“HCD”) by memorandum dated as of May 13, 2022 as posted to the HCD website.
These median income numbers are revised annually.
2 Affordable Rent for Lower Income Households is the product of 30 percent times 60 percent of the area median income adjusted for family size appropriate to the unit. Health and Safety Code Section 50053 (b)(3).

Calculation of Affordable Rent

In addition, for any Lower Income Household whose income falls within the following guidelines, it is optional for the City of Fountain Valley to require or allow in its sole discretion for affordable rent not exceed 30 percent of the gross income of the household:
3 • 1 person households whose income is between $50,010 and $75,900 • 2 person households whose income is between $57,180 and $86,750 • 3 person households whose income is between $64,320 and $97,600 • 4 person households whose income is between $71,460 and $108,400 • 5 person households whose income is between $77,190 and $117,100 • 6 person households whose income is between $82,890 and $125,750 For purposes of determining Affordable Rent, “Rent” is an average of estimated housing costs for the next twelve months. “Rent” includes the total of monthly payments for all of the following:4
• Use and occupancy of a housing unit and land and facilities associated therewith. • Any separately charged fees or service charges assessed by the lessor which are required of all tenants, other than security deposits.
• A reasonable allowance for utilities not included in the above costs, including garbage collection, sewer, water, electricity, gas, and other heating, cooking, and refrigeration fuels. Utilities does not include telephone service. Such an allowance shall take into consideration the cost of an adequate level of service. • Possessory interest taxes or other fees or charges assessed for use of the land and facilities associated therewith by a public or private entity other than the lessor. 3 Health and Safety Code Section 50053 (b)(3).

COUNCIL ACTION REQUEST
To: Honorable Mayor and Agenda Date: June 6, 2023
Members of the City Council
SUBJECT: Amendment #1 to extend contract # 22-11 from July 1, 2023 through June 30, 2024 with City Net for homeless outreach services in the amount of $321,036.28
Three-Year Strategic Goals
☒ Enhance the culture and environment of “A Nice Place to Live” ☐ Attract and retain revenue producing businesses
☐ Achieve fiscal stability in accordance with the 20-Year Financial Plan ☐ Attract and retain quality staff
☐ Not applicable
EXECUTIVE SUMMARY:
In 2022, Staff identified City Net as a sole source vendor that was uniquely qualified to provide street outreach and engagement for the homeless population in the City of Fountain Valley. Staff recommends extending the City Net contract to continue providing essential social services to our homeless population.
DISCUSSION:
Our partnership with City Net began March 1, 2022, and has been very effective with 45 successful street exits through April 21, 2023. Hundreds of other homeless individuals have accepted some sort of outreach services including, but not limited to, temporary shelter, medical services, mental health services, financial services, and employment services.
City Net, in conjunction with several City departments, has been vital to minimizing encampments within the Sports Park, allowing for the uninterrupted use of its intended purposes. Case Managers have spent significant time building relationships with many in our homeless population. Oftentimes, these relationships build trust allowing the homeless to feel comfortable enough to accept services.
City Net has been responsive to our needs, often responding to locations at the request of our police officers to engage with the homeless. City Net provides their own

transportation allowing them to transport people directly to shelters, hospitals, retrieve paperwork necessary for housing, and a multitude of other resources. This ability allows them to provide service quickly and efficiently.
Homelessness continues to be a problem throughout society. It is an issue that the Police Department and other City departments are not equipped to handle alone. City Net has been vital in the City’s strategic goal to enhance the culture and environment of “A Nice Place to Live.”
FISCAL REVIEW:
The cost of the 12-month contract for City Net services (July 1, 2023- June 30, 2024) is $321,036.28. This amount has already been included with the proposed FY 2023-24 budget. The cost will be expensed to account 100.70.70700.53006 in the Police Department budget. There are no additional anticipated costs associated with the City Net contract.
The Police Department received $369,374 in grant funding through the California Housing and Community Development Department PLHA Program (funding years 2019 and 2020) to pay for the existing City Net contract. These funds are held in the State Grants account 100.00.00000.44011. We have been awarded an additional $247,348 (funding year 2021) to be used toward the cost of City Net services. Additional funding is anticipated to be available for street outreach and engagement services through the PLHA grant in funding years 2022 and 2023 as well.
PUBLIC NOTIFICATION:
Notification was made through the regular agenda process.

This action has been approved by the Attorney for the City.

CITY OF FOUNTAIN VALLEY
CITY COUNCIL
COUNCIL ACTION REQUEST
To: Honorable Mayor and Agenda Date: June 6, 2023
Members of the City Council
SUBJECT: Approve Amendment No. 2 to CON-20-20 with Sweeping Corporation of America for Street Sweeping Services to extend the contract term for two years and increase the annual contract amount by $14,181.41
Three-Year Strategic Goals
☒ Enhance the culture and environment of “A Nice Place to Live” ☒ Attract and retain revenue producing businesses
☐ Achieve fiscal stability in accordance with the 20-Year Financial Plan ☐ Attract and retain quality staff
☐ Not applicable
EXECUTIVE SUMMARY:
The City’s current contract (CON-20-20) with Sweeping Corporation of America (SCA) for Street Sweeping Services will expire on June 30, 2023.
Per the terms of the contract, the City has the option to renew the contract, with contractor concurrence, for two (2) additional two-year periods on the same terms and conditions.
After considering the City’s historical Request for Proposal results, current economic conditions and the recent street sweeping contract experiences of other Southern California cities, Public Works staff thinks that it is in the best interest of the City to renew the existing contract. Public Works staff has managed the work performed by SCA (formerly Jonset Corporation dba Sunset Property Services) over the past three years of the contract and has been satisfied with their performance. Therefore, staff wishes to extend the contract for an additional two-year period through June 30, 2025.
Per the terms of the contract, SCA has agreed to extend the contract through June 30, 2025, and has requested a 3.7% cost increase to the annual contract amount, which is an increase of $14,181.41. The requested cost increase is below the Consumer Price Index (CPI) for the contact term, which is 14.9%.
Amendment No. 2 to CON-20-20
June 6, 2023
Staff is requesting that the City Council approve Amendment No. 2 to CON-20-20 with Sweeping Corporation of America for Street Sweeping Services to extend the contract term for two years and increase the annual contract amount by $14,181.41.
DISCUSSION:
The City of Fountain Valley began outsourcing street sweeping services in 2005. Since then, the street sweeping services contract has been awarded to several different vendors.
With the existing contract for street sweeping services set to expire on June 30, 2020, the City approached the contractor, R.F. Dickson Co., Inc., about renewing the contract. R.F. Dickson Co., Inc. was not interested in renewing the existing contract because they were not able to provide the street sweeping servies for the agreed upon amount at an acceptable profit, even with a CPI increase. Therefore, City staff prepared and issued a request for proposal (RFP) for street sweeping services on April 27, 2020. The scope of services includes sweeping the City’s arterial, industrial and residential streets, as well as the parking lots at the Civic Center, Senior Center, Recreation Center & Sports Park, and City Yard. A total of four proposals were received in response to the RFP.
After City staff carefully evaluated the proposals to determine which contractor would provide the best value to the City, City Council awarded a contract (CON-20-20) to Jonset Corporation dba Sunset Property Services (Sunset Property Services) in an annual amount of $383,284.99 on June 16, 2020. The term of the contract commenced on July 1, 2020, and continues through June 30, 2023.
Sunset Property Services was acquired by Sweeping Corporation of America (SCA) through a stock purchase in May of 2021.
On October 13, 2022, Amendment No. 1 to CON-20-20 was approved by the City Manager to substitute Sweeping Corporation of America as a party to the agreement in place of Sunset Property Services.
The current term of the contract will expire on June 30, 2023.
Public Works staff has managed the work performed by SCA (formerly Jonset Corporation dba Sunset Property Services) over the past three years and has been satisfied with their performance. Therefore, staff wishes to extend the contract for an additional twoyear period through June 30, 2025.
Per the terms of the contract, SCA has agreed to extend the contract through June 30, 2025, and has requested a 3.7% cost increase to the annual contract amount, which is an increase
Amendment No. 2 to CON-20-20

of $14,181.41. The cost increase is below the Consumer Price Index (CPI) for the contract term, which is 14.9%.
The continued street sweeping services to be provided by SCA support the City’s strategic goals of enhancing the culture and environment of “A Nice Place to Live” and attracting and retaining revenue-producing businesses by maintaining clean, aesthetically pleasing streets and removing debris before it reaches the City’s storm drain system.
FISCAL REVIEW:
The cost of the amended contract is $397,466.40 per year, which will be expensed to Public Works’ Street Sweeping – Contract Services account (100.50.50557.53010) within the General Fund. The proposed FY 23-24 budget allocates $441,000.00 for Street Sweeping Service Contracts (100.50.50557.53010). Therefore, there are sufficient funds for Amendment No. 2 to CON-20-20.

ATTORNEY REVIEW:
The Attorney for the City has reviewed and approved Amendment No. 2 to CON-20-20.
ALTERNATIVES:
Alternative No. 1: Approve Amendment No. 2 to CON-20-20 with Sweeping Corporation of America for Street Sweeping Services to extend the contract term for two years and increase the annual contract amount by $14,181.41. This is the recommended action.
Alternative No. 2: Do not approve Amendment No. 2 to CON-20-20 with Sweeping Corporation of America for Street Sweeping Services and discontinue street sweeping services in the City of Fountain Valley.
This is not recommended, as street sweeping is considered a best management practice for pollution prevention by the U.S.
Environmental Protection Agency and is an integral part of the
Amendment No. 2 to CON-20-20
June 6, 2023
City’s Stormwater Pollution Prevention Plan as required by the City’s National Pollutant Discharge Elimination System (NPDES) permit. Street sweeping minimizes the pollutants that get into the stormwater system leading to water pollution. It also reduces the frequency of catch basin and storm drain cleaning.
Alternative No. 3: Do not approve Amendment No. 2 to CON-20-20 with Sweeping Corporation of America for Street Sweeping Services and direct staff to issue an RFP for street sweeping services. This is not recommended, as staff has been satisfied with the quality, costeffectiveness and overall efficiency of SCA’s services. The cost increase requested by SCA is modest and staff believes that issuing an RFP would result in higher costs to the City given the City’s historical RFP results, current economic conditions and the recent street sweeping contract experiences of other southern California cities.
Alternative No. 4: Do not approve Amendment No. 2 to CON-20-20 with Sweeping Corporation of America for Street Sweeping Services and direct staff to perform the necessary street sweeping services with City staff and equipment. This is not recommended, as the City does not have the staff or equipment to perform the work needed. In order to implement this alternative, the City would need to hire additional staff and purchase multiple street sweepers.
RECOMMENDATION:
Staff is requesting City Council approval of Alternative No. 1 to approve Amendment No. 2 to CON-20-20 with Sweeping Corporation of America for Street Sweeping Services to extend the contract term for two years and increase the annual contract amount by $14,181.41.

COUNCIL ACTION REQUEST
To: Honorable Mayor and Agenda Date: June 6, 2023
Members of the City Council
SUBJECT: Approve Amendment No. 1 to CON-21-19 with Great Scott Tree Service, Inc. for Tree Maintenance Services to extend the contract term for two years and increase the annual contract amount by $38,834.50
Three-Year Strategic Goals
☒ Enhance the culture and environment of “A Nice Place to Live” ☒ Attract and retain revenue producing businesses
☐ Achieve fiscal stability in accordance with the 20-Year Financial Plan ☐ Attract and retain quality staff
☐ Not applicable
EXECUTIVE SUMMARY:
The City’s current contract (CON-21-19) with Great Scott Tree Service, Inc. (Great Scott) for Tree Maintenance Services will expire on June 30, 2023.
Per the terms of the contract, the City has the option to renew the contract, with contractor concurrence, for two (2) additional two-year periods on the same terms and conditions.
Public Works staff has managed the work performed by Great Scott during the first two-year term of the contract and has been satisfied with their performance. Therefore, staff wishes to extend the contract for an additional two-year period through June 30, 2025.
Per the terms of the contract, Great Scott has agreed to extend the contract through June 30, 2025, and has requested a 12.5% cost increase to the annual contract amount, which is an increase of $38,834.50. The requested cost increase is consistent with the Consumer Price Index (CPI) for the initial contact term, which is 12.5%.
Staff is requesting that the City Council approve Amendment No.1 to CON-21-19 with Great Scott Tree Service, Inc. for Tree Maintenance Services to extend the contract term for two years and increase the annual contract amount by $38,834.50.
Amendment No. 1 to CON-21-19
June 6, 2023
DISCUSSION:
The City of Fountain Valley has contracted for tree maintenance services since 2009 as a cost saving measure. The City’s current tree inventory consists of approximately 11,000 trees, as follows:
• 4,800 Parkway Trees (belong to the homeowners)
• 2,110 Arterial/Median Trees (will increase when OC405 trees are added to inventory) • 3,000 Park and Civic Facility Trees
• 1,090 Palm Trees
Although parkway trees belong to the homeowners, the City trims them to maintain the public right-of-way for vehicular traffic and pedestrians. Palm trees are trimmed annually, and all other trees are trimmed on a three-year schedule.
With the existing contract for tree maintenance services set to expire on June 30, 2021, Public Works staff prepared and issued a request for proposal (RFP) for tree maintenance services on February 4, 2021. The scope of work included trimming trees in accordance with the International Society of Arboriculture (ISA) Pruning Standards, worksite debris removal and legal disposal of all materials, tree planting, tree and stump removal, updating the City’s tree inventory management system and emergency tree services. A total of five (5) proposals were received in response to the RFP.
After City staff carefully evaluated the proposals to determine which contractor would provide the best value to the City, City Council awarded a contract (CON-21-19) to Great Scott Tree Service, Inc. (Great Scott) in an annual amount of $335,500 on May 18, 2021. The term of the contract commenced on July 1, 2021, and continues through June 30, 2023.
The current term of the contract will expire on June 30, 2023. Per the terms of the contract, the City has the option to renew the contract, with contractor concurrence, for two (2) additional two-year periods on the same terms and conditions.
Public Works staff has managed the work performed by Great Scott over the past two years and has been satisfied with their performance. Therefore, staff wishes to extend the contract for an additional two-year period through June 30, 2025.
Great Scott has agreed to extend the contract through June 30, 2025, and has requested a
12.5% cost increase to the annual contract amount, which is an increase of $38,834.50.
Per the terms of the contract, the compensation terms may be adjusted by a mutually agreeable amount based on and no greater than the Consumer Price Index for All Urban Consumers (CPI-U) for Los Angeles-Long Beach-Anaheim, CA changes over the previous contract period as published by the U.S. Bureau of Labor Statistics in Table A: Los AngelesLong Beach-Anaheim CPI-U all items index, not seasonally adjusted. RFP-21-002 for Tree Maintenance Services defined the CPI adjustment period for the first contract extension as March 2021 to March 2023. The March CPI data is released mid-April, making it the most
Amendment No. 1 to CON-21-19
June 6, 2023
recent data available to the contractor prior to submitting their CPI adjustment request in writing to the City sixty days before the end of the then-current contract period.
On April 10, 2023, Great Scott submitted a written request to the City for a CPI increase of 15%. They cited state mandated wage increases for tree trimmers, increased fuel costs and inflation as justification for their request.
On April 12, 2023, the U.S. Bureau of Labor Statistics released the March 2023 CPI data. The CPI increased from 282.648 in March 2021 to 317.873 in March 2023, which is an increase of
12.5% over the previous contract period. Based on this information, Public Works staff contacted Great Scott to let them know that their request for an increase of 15% exceeded the maximum allowed per the terms of the contract.
On May 8, 2023, Great Scott submitted a revised written request to the City for a CPI increase of 12.5%, which is consistent with the Consumer Price Index (CPI) for the contact term.
The continued tree maintenance services to be provided by Great Scott support the City’s strategic goals of enhancing the culture and environment of “A Nice Place to Live” and attracting and retaining revenue-producing businesses by maintaining the City’s urban forest in a healthy, safe and attractive condition.
FISCAL REVIEW:
The cost of the amended contract is $374,334.50 per year, which will be expensed to Public Works’ Tree Maintenance – Service Contracts account (100.50.50551.53010) within the General Fund.
The proposed FY 23-24 budget allocates $385,000.00 for Tree Maintenance Service Contracts (100.50.50551.53010). Therefore, there are sufficient funds for Amendment No. 1 to CON-21-

This is not recommended, as staff has been satisfied with the quality, costeffectiveness and overall efficiency of Great Scott’s services. Staff believes that issuing an RFP would result in higher costs to the City given the current economic conditions.
Alternative No. 3: Do not approve Amendment No. 1 to CON-21-19 with Great Scott Tree Service, Inc. for Tree Maintenance Services and direct staff to perform the necessary tree maintenance services with City staff and equipment. This is not recommended, as the City does not have the staff or equipment to perform the work needed. In order to implement this alternative, the City would need to hire additional staff and purchase new equipment and vehicles.
Alternative No. 4: Do not approve Amendment No. 1 to CON-21-19 with Great Scott Tree Service, Inc. for Tree Maintenance Services and discontinue tree maintenance services in the City of Fountain Valley. EXECUTIVE SUMMARY:
The City’s current contract (CON-19-28) with Merchants Landscape Services, Inc. (Merchants) for Sports Park, Parks, and Civic Facilities Landscape Maintenance Services will expire on June 30, 2023.
Per the terms of the contract, the City has the option to renew the contract, with contractor concurrence, for two (2) additional two-year periods on the same terms and conditions. The first two-year extension was approved by City Council on May 18, 2021.
Public Works staff has managed all of the work performed by Merchants over the past four years of the contract and has been satisfied with their performance. Therefore, staff wishes to extend the contract for a final two-year period through June 30, 2025.
Per the terms of the contract, Merchants has agreed to extend the contract through June 30, 2025, and has requested a 6% cost increase to the annual base maintenance amount of the contract, including the synthetic weed control chemical application, which is an increase of $43,328.40. The requested cost increase is below the Consumer Price Index (CPI) for the contact term, which is approximately 12.5%.
Amendment No. 3 to CON-19-28
June 6, 2023
In addition to renewing the contract, Public Works staff wishes to add landscape maintenance services at Moiola Park, the City’s new park located at 9770 Finch Avenue, at an annual cost of $11,984.88 and adjust the additional Sports Park turf renovation services previously agreed upon to meet the City’s needs related to community events at an annual cost of $60,786, a savings of $42,464 annually because the previously held BBQ Fest is not anticipated.
The combined financial impact of the 6% increase to the annual base maintenance amount of the contract and the changes to the scope of work is an increase of $12,849.28 to the annual contract amount.
Staff is requesting that the City Council approve Amendment No. 3 to CON-19-28 with Merchants Landscape Services, Inc. for Sports Park, Parks, and Civic Facilities Landscape Maintenance Services to extend the contract term for two years, add landscape maintenance services at Moiola Park, adjust the additional Sports Park turf renovation services to meet the City’s needs and increase the annual contract amount by $12,849.28.
DISCUSSION:
Fountain Valley has contracted landscape maintenance services at the Sports Park since 2013 and at the Parks and Civic Facilities since 2010 as a cost-saving measure.
With both the contract for Sports Park Landscape Maintenance Services and the contract for Parks and Civic Facilities Landscape Maintenance Services expiring on June 30, 2019, Public Works staff chose to combine the contracts into one contract to take advantage of economies of scale, a larger group of contract employees for special projects or events, and more efficient contract management.
Public Works staff, with input from Community Services, developed and issued a comprehensive request for proposal (RFP) that detailed the scope of work for Sports Park, Parks and Civic Facilities Landscape Maintenance Services. The scope of work covered all landscape maintenance at the Sports Park, 17 neighborhood parks, Reservoir No. 1, the City Hall Campus, Founders Village, Fire Station No. 1 and Fire Station No. 2, including:
General/daily maintenance
Chemical application
Weed and pest control
Turf mowing and edging
Turf renovation and aeration
Fertilization and fertigation
Shrub and groundcover
maintenance
Irrigation and irrigation maintenance
Sports field maintenance
Hardscape maintenance
Playground maintenance
On May 8, 2019, the City received two (2) proposals in response to the competitive RFP. After City staff carefully evaluated the proposals to determine which contractor would provide the best value to the City, City Council awarded a contract (CON-19-28) to Merchants Landscape Services, Inc. (Merchants) in the annual amount of $672,132 on June 11, 2019. The term of the contract commenced on July 1, 2019 and continued through June 30, 2021.
Amendment No. 3 to CON-19-28
June 6, 2023
On May 18, 2021, City Council approved Amendment No. 1 to CON-19-28 to extend the contract term two (2) years through June 30, 2023, add additional services to the scope of work, and increase the annual contract amount by $16,565.44 to $688,697.44. The additional work included adding the shrubs along the west side of Mt. Waterman Street to the scope of work for Ellis Park and increasing the landscape maintenance frequency at Fire Stations No. 1 and No. 2 from quarterly to weekly. Merchants agreed to provide the additional services at no additional cost. The increase in the annual contract amount was the result of a 2.6% increase in the annual base maintenance amount of the contract.
On September 20, 2022, City Council approved Amendment No. 2 to CON-19-28 to add additional services to the scope of work and increase the annual contract amount accordingly.
The additional services included:
Additional turf renovation at the Sports Park to repair damage caused by the Crawfish Festival, BBQ Festival and Lobster Festival for an amount not to exceed $103,250 annually.
Spraying of synthetic weed control chemicals along all of the City’s residential right-ofways following the City’s contracted street sweeper for an amount not to exceed $34,223 per application, up to a total of $68,446 for two applications at the City’s request per year.
Amendment No. 2 to CON-19-28 brought the total annual contract cost to $860,393.44, which included $35,000 in contingency funds for extra work requested by the City.
The current term of the contract will expire on June 30, 2023. Per the terms of the contract, the City has the option to renew the contract, with contractor concurrence, for two (2) additional two-year periods on the same terms and conditions. The first two-year extension was approved by City Council on May 18, 2021.
Public Works staff has managed all of the work performed by Merchants over the past four years of the contract and has been satisfied with their performance. Therefore, staff wishes to extend the contract for a final two-year period through June 30, 2025.
Per the terms of the contract, Merchants has agreed to extend the contract through June 30, 2025, and has requested a 6% cost increase to the annual base maintenance amount of the contract, including synthetic weed control chemical application, which is an increase of $43,328.40. The cost increase is below the Consumer Price Index (CPI) for the contact term, which is approximately 12.5%.
In addition to renewing the contract, Public Works staff wishes to add landscape maintenance services at Moiola Park, the City’s new park located at 9770 Finch Avenue, and adjust the additional Sports Park turf renovation services previously agreed upon to meet the City’s needs related to community events.
Landscape Maintenance Services at Moiola Park
Moiola Park is a new 1.12-acre park constructed on the former Fred Moiola Elementary School site, as part of The Currents development project. Per the conditions of approval of the project,
Amendment No. 3 to CON-19-28
June 6, 2023
Moiola Park will be dedicated to the City and the developer, Lennar, shall pay the City $176,631.15 for the maintenance and upkeep of the public park which also includes tree and playground equipment maintenance costs at an estimated $17,663.11/year for a 10-year period. These fees shall be paid in full prior to certificate of occupancy of the park. The developer has agreed to maintain the park for the initial 60-day period, after which the City will be responsible for maintenance. Dependent upon the final approval of the park, it is estimated that the City will assume responsibility for the park maintenance no sooner than July 1, 2023.
Merchants has agreed to provide landscape maintenance services at Moiola Park at a cost of $998.74 per month, which adds up to $11,984.88 annually for the next two years of the contract.
Staff acknowledges that the cost for landscape maintenance services at Moiola Park is significantly higher than the cost for a comparable 1-acre park, which is $316.48 per month at the new rate. Initially, Merchants provided the City with a quote on November 15, 2022, for $1,530 per month. City staff questioned the amount of the quote and requested an explanation for the dramatic increase. Merchants cited the elevated cost of labor, fuel, and raw materials as the reason for the cost increase. They also provided a new quote on December 16, 2022, for $998.74 per month. (This is the cost provided to the City by Merchants on Exhibit A.) The revised quote was accompanied by a detailed cost analysis showing how they came up with the quoted amount which has a zero-dollar profit margin. The economy has drastically changed since Merchant’s last consumer price index (CPI) adjustment in July 2021, and their quote for Moiola Park reflects the current economic conditions and what the City should have expected if the City chose to solicit a new contract through an RFP process rather than extend the contract with Merchants.
Adjust the Additional Turf Renovation Services at the Sports Park The Fountain Valley Sports Park is the City’s largest and most popular recreational facility, hosting several special events, multiple user groups, and over 100,000 people per year. This heavy usage stresses and damages the turf, making it necessary to schedule downtime throughout the year to aerate, reseed and restore the turf so it can continue to be enjoyed by the community. Large special events, such as Summerfest, require extensive renovations after the event to fill in uneven areas, reseed and replace turf as needed to remediate the damage caused by vehicles, large crowds, tents, fencing, carnival equipment, etc.
With the addition of the Crawfish Festival, BBQ Festival, and Lobster Festival at the Sports Park in 2022, additional turf renovation beyond what was included in the contract was needed to restore the playing fields. Amendment No. 2 to CON-19-28 added the additional turf renovation services needed to the contract’s scope of work at a total cost of $103,250.
During the next two-year contract term, the City expects to host the Lobster Festival on Sports Park Field A in September 2023 and 2024, as well as the Crawfish Festival on Sports Park Fields B and C in May 2024 and 2025. The City’s landscape staff worked closely with Merchants to determine exactly what would be needed to restore the turf after these events based on past experiences with these events and similar events. Merchants supplied costs for the needed services and detailed what was included in these costs. The turf renovations necessary after the Lobster Festival will cost $24,851 annually. The turf renovations following
Amendment No. 3 to CON-19-28
June 6, 2023
the Crawfish Festival will be less extensive and only cost $1,435 annually because the City only has time to apply Gypsum to break up the compacted soil on Fields B and C in the short window before Summerfest in June. Amendment No. 3 to the contract also includes $34,500 annually for approximately 15,000 sq. ft. of additional sod to be installed if needed at the City’s discretion. The total annual cost of the adjusted additional turf renovation services is $60,786.
This is a decrease of $42,464 because the previously held BBQ Fest is not anticipated. The Director of Public Works or his/her authorized representative may award these additional services to the Contractor, or other forces, at his/her discretion on an as needed basis during the term of the contract. There is no guarantee that extra work will be awarded to the Contractor.
The total financial impact of the 6% increase to the annual base maintenance amount of the contract and the changes to the scope of work is an increase of $12,849.28 to the annual contract amount.
The continued landscape maintenance services, the addition of landscape maintenance at Moiola Park and the additional Sports Park turf renovation services support the City’s strategic goal of enhancing the culture and environment of “A Nice Place to Live” by maintaining the landscape, hardscape, athletic fields and playgrounds at the City’s Sports Park, parks and civic facilities in a safe, healthy, sustainable and attractive condition for the purpose of community enjoyment. Maintaining and preserving the City’s residential right-of-ways through weed abatement also supports this strategic goal. In addition, these services will support the City’s strategic goal of attracting and retaining revenue-producing businesses by maintaining Fountain Valley’s image and aesthetic appeal as well as the condition of our sports fields for use by user groups.
FISCAL REVIEW:
The annual cost of the amended contract is $838,242.72 per year, with a contingency of $35,000 for extra work as needed, for a total annual cost of $873,242.72 which will be expensed to Public Works accounts within the General Fund. The costs will be split between the Recreation Center Service Contracts account (100.50.50558.53010) and the Parks Maintenance Service Contracts account (100.50.50552.53010) as detailed below.
The proposed FY 23-24 budget allocates $516,250.00 for Recreation Center Service Contracts (100.50.50558.53010) and $356,995.00 for Park Maintenance Service Contracts (100.50.50552.53010), for a total of $873,245.00. Therefore, there are sufficient funds for Amendment No. 3 to CON-19-28.

ALTERNATIVES:
Alternative No. 1: Approve Amendment No. 3 to CON-19-28 with Merchants Landscape Services, Inc. for Sports Park, Parks and Civic Facilities Landscape Maintenance Services to extend the contract term for two years, add landscape maintenance services at Moiola Park, adjust the additional Sports Park turf renovation services to meet

the City’s needs and increase the annual contract amount by $12,849.28. This is the recommended action.
Alternative No. 2: Approve Amendment No. 3 to CON-19-28 with revisions at the direction of City Council to exclude the landscape maintenance services at Moiola Park or the adjusted additional turf renovations at the Sports Park. This is not recommended as the work is needed to maintain Moiola Park and repair the turf damage caused by the additional special events at the Sports Park. The City does not have the staff or equipment to perform the work needed.
Alternative No. 3: Do not approve Amendment No. 3 to CON-19-28 with Merchants Landscape Services, Inc for Sports Park, Parks and Civic Facilities Landscape Maintenance Services. This is not recommended as staff has been satisfied with the quality, cost-effectiveness and overall efficiency of Mechants’ services. The cost increase requested by Merchants is modest and staff believes that issuing an RFP would result in higher costs to the City given the current economic conditions.
RECOMMENDATION:
Staff is requesting City Council approval of Alternative No. 1 to approve Amendment No. 3 to CON-19-28 with Merchants Landscape Services, Inc. for Sports Park, Parks and Civic Facilities Landscape Maintenance Services to extend the contract term for two years, add landscape maintenance services at Moiola Park, adjust the additional Sports Park turf renovation services to meet the City’s needs and increase the annual contract amount by $12,849.28.

Regarding: City of Fountain Valley Parks and Facilities – Contract Renewal Dear Gil,
We are grateful for your business this past years and Merchants Landscape Services agrees to extend its current landscape maintenance contract with the City of Fountain Valley for two (2) additional years.
Since the contract started back on July 1, 2019 we’ve experienced difficulties to continue delivering the quality of work that the City of Fountain Valley deserves. When major factors such fuel cost, and labor cost increase, the cost of almost everything in the supply chain increases, as well as other business expenses, including sub-contractors, materials, equipment parts and insurance.
In order for us to continue our current positive relationship with the City of Fountain Valley we respectfully would like to get a 6% increase for the two (2) years, and all current terms, conditions and specifications will remain the same.
Merchants Landscape will also add the following locations at additional cost; Under Parks: Add Moiola Park (see attached proposal, and cost analysis) Under Sport Complex: Add Turf Renovations Field A-B-C (See attached Schedule ‘E’) Merchants looks forward to have the opportunity to meet with you and discuss in better details the above request.
Sincerely,

DISCUSSION:
The Public Works Engineering Division needs temporary staff augmentation for engineering encroachment permits review and processing services for a projected duration of four (4) months until we can fill vacancies. The Public Works Engineering Division currently has three vacancies (2 Assistant Engineers and 1 Engineering Tech III vacancies) with increasing demands for residential and commercial private and public developments encroachment permits where the City currently realizes approximately 370 encroachment permits per year.
Per the City’s purchasing policy and in collaboration with the Finance Department, staff issued a Request for Qualifications (RFQ) for As-Needed On-Call Construction Management & Inspection Services. The RFQ established a qualified consultants list to support the various projects and staffing needs within Public Works for the next three (3) years for various CIP and private developments projects. Maintaining an active and comprehensive on-call list streamlines the process of awarding projects to the most suitable firm for specific projects and reduces time soliciting consultant services for each project.
On November 16, 2021, the City Council approved five (5) most qualified consultants among twenty-one (21) proposals for on-call services for construction management and inspection including encroachment permits and processing services. Annealta Group, Inc. was one of the five qualified consultants awarded an As-Needed On-Call Construction Management and Inspection Services contract.
On May 24, 2023, Annealta Group, Inc. submitted a cost proposal in the amount of $43,464 for encroachment permits review and processing services.
Annealta is a highly respected civil engineering and construction management firm with an excellent reputation for its work on similar projects throughout Southern California. Annealta has provided consulting services to Fountain Valley on past projects including providing inspection services on projects such as the City’s Rehabilitation and Resurfacing of Residential Roadways, Project GT229, Rehabilitation of Warner Avenue from Brookhurst Street to Euclid Street, Project TI275, and providing plan checking services for Frontier’s City-wide fiber optic installation plan.
Staff recommends that the City Council accept a fee proposal from Annealta Group, Inc. in the amount of $43,464 for encroachment permits review and issuance services, and authorize staff to issue a Purchase Order for the amount.

Re: Proposal to Provide As-Needed Encroachment Permit Review and Processing Services Dear Kyle,
Annealta Group is pleased to submit our proposal to provide As-Needed Encroachment Permit Review and Processing Services. We have carefully assembled a team of experienced and professional staff who possess the know-how and skill set to serve on this project and who have successfully served on projects throughout Southern California.
We understand the scope of work includes assigning a staff member to provide encroachment permit review and processing 20 hrs/week for about 4 months. Work is estimated to begin Monday, June 19. The individual will be responsible for reviewing permit applications for development projects, utility company work and other work proposed in the City right of way. We propose Jeff Jones, Engineering Technican II, to perform this work with supervision and oversight provided by Angel Fuertes, Program Manager. Both Jeff and Angel are familiar with City standards having assisted the City with the field review and processing of fiber optic encroachment permit plan sets and permits. As with the fiber optic plan review all work will be done off site.
Annealta focuses on providing the expertise required to assist our clients with professional services tailored to their specific and unique needs. Spanning critical municipal service areas including public works, city engineering, planning and building and safety, our team of experts bring a wealth of expertise in their respective fields. Our client references can attest to our successful track record of the delivery of services and projects on time and within budget in a customer friendly manner! Annealta’s unique combination of qualifications, experience and certifications will enable us to work effectively with the Public Works Department as well as other city departments in the successful delivery of projects for the City.
