MTGL holds the certifications required by the City’s RFP and QAP.

Communication, planning and documentation is our culture for any project, and the proposed RE will work diligently with the inspector and contractor to ensure that proper acceptance testing is performed when it needs to be performed with proper records per the LAPM. Planning inspections and acceptance testing will begin prior to construction with a thorough review of the plans and specs to generate a list of expected QA inspections, then at the baseline schedule submittal for planning, and further refined during weekly progress meetings and while looking at the planned activities for the week. The QA inspections will be either accepted or the contractor will be issued a non-conformance report.

Project Approach
Work Plan
CPM Partners has read and clearly understands the expectations and requirements set forth in the RFP Scope of Services. The construction contract for the base bid has a duration of 90 working days. The project has an estimated value of $2.3M. The project federally funded and, as such, is subject to compliance with federal regulations and document control standards.

Based on his experience leading complex projects with labor agreement, federal funding, with scope perfectly matching the scope of this project, Alex Janecek will lead the management effort the CM providing pre-construction kickoff activities, construction management and closeout for this project at the direction of the City’s Project Manager. Alex will be the main point of contact for the City, public and stakeholders. A1 Management & MTGL Inspection staff will support Alex with daily field inspections and materials testing.

Project success will be highly dependent on the leadership, knowledge, and organization of the construction manager. Being able to accurately envision the City’s finished product at the proposal phase is critical to ensure that the proposal is tailored to the City’s needs and provide the best value for the City. If successful, Alex would have already performed a thorough review of the plans and will have identified risks as part of his proposal scope review. By doing this, CPM Partners can provide the City with immediate feedback on the plans, and begin to prepare for any potential change orders early in the project.

There are a few key stakeholders for this project and open lines of communication will be required at all times; regular phone calls and email updates are critical to ensure that there are no holdups or delays due to scheduling inspections, sign-offs or coordination. Additionally, Alex will regularly provide reminders and request status updates from the Contractor during weekly construction progress meetings so that he is always informed of the progress and planned activities. Key stakeholders include but not limited to:
 The City of Hemet (Project Owner)
 Federal ATP (Funding)
 Contractor - TBD
 Riverside County
 General Public & Local Businesses
Making sure that the contractor provides a sound baseline schedule at the beginning and accurate progress updates it is something that CPM Partners excels at. By identifying schedule issues early, and looking at production rates and crews on-site, we can identify problem areas early on, and issue the proper notifications in a timely manner. From here, we can work with the contractor on recovery schedules to get back on track if they fall behind. Typical outcomes of recovery schedules include increasing project resources, adjusting work hours, or adding concurrent work.

We are proposing a lean duo of highly skilled professionals that can provide the best services to the City at the best value. Minimizing cost-overruns during construction and minimizing change orders will be a major factor in keeping project costs down. Understanding the construction contract is a key element in achieving project success within budget and schedule. Identifying when a change order is merited and understanding when the contractor may be “double-dipping” on a merited change will help to reduce the overall project cost. Additionally, proper negotiating for a lump sum on behalf of the City is also critical for ensuring that the project stays within budget and schedule.

The following pages will outline our typical CM workflow, tailored to this project, broken down by phases, critical milestones, and options available to the City.

If successful, immediately after professional services contract award:
 Prepare a coordination matrix, risk register & project administration forms such as RFI Log, issues log, CCO tracking log, budget log, etc. Many of these have already been created and successfully used on previous projects, they will need to be slightly tweaked for this project.  Perform a “deep dive” into plans and specs, advise the City with any potential risks, areas of improvement or additional findings.
 Facilitate a project kickoff meeting with the project team and City personnel to go over the risk register, coordination matrix, and project team expectations.  Outreach to stakeholders informing them of the project being underway and ensuring that we have all the right contact information & distribute a contact list.  Prepare an agenda for the preconstruction meeting and develop a submittal list in preparation for the construction contract award.
 Set up the document control structure consistent with the City format, which will be ready for audit at any time.
 Establish clear lines of communication with the project team.  Develop quantity sheets based on the bid items, such that the field inspector knows where to place specific work items, speeding up the payment application process.

Immediately after the construction contract award:
 Set expectations for the successful contractor and for the baseline schedule. Work with the Contractor, as needed to obtain a quality schedule.
 Request that they prepare critical submittals and schedules such as product data, installer certifications, shop drawings, SWPPP plans, traffic control plans, baseline schedule, AC and Concrete mix designs, shop drawings, products, etc.
 Ensure all permits are in place and that the contractor understands how they relate to the project.
 Prepare an agenda for the Pre-construction meeting that includes, at a minimum, a discussion on:
 Project schedule & construction phasing
 Maintaining access for residents, visitors and first responders.

Long Beach, CA (2014-2016, $80M Est.)
Role: Project Manager - Responsible for design startup project management for the remaining buildings within the middle harbor program. The buildings include a 21,000 S.F. commercial office building, two 1,000-2,000 S.F. facilities for break/restroom & truck repairs and a technologically advanced battery exchange building for electric, autonomous shipping container handling vehicles. Construction of these buildings are set to begin late 2018. My responsibilities included management of a consultant design team, coordination with adjacent project design teams, tenant satisfaction & developing project budgets.

Port of Long Beach – Project Controls
Long Beach, CA (2014-2015)
Role: Program Scheduler - Responsible for monthly project & program schedule updates. Worked within a team to develop financial forecast reports and schedules for executive management reporting. Managed and reported on construction forecast schedules based on meetings, weekly reports and project status reports. Helped test & implement POLB’s new controls software plan.

SANDAG – MTS RAPID Route Improvements
Escondido, CA (2014)
Role: Resident Engineer - Responsible for overseeing the progress, budget for the route upgrades to the 235 Line. The upgrades included a new shelter with electric service and concrete pad, a variable message sign (VMS) along with upgraded emergency vehicle detectors along the route & traffic control system software/hardware updates. Although this Job-Order-Contract (JOC) was a smaller project, the coordination between agencies (NCTD, City of Escondido, SANDAG) and traffic control were the most challenging.

Calculation Notes:

Palm Canyon (1) was calculated as 50% complete, they made two passes on the shoulder covering approximately 50% of the road surface.

Palm Canyon (2) was calculated as 25% complete, they made two passes on 50% the total length of the segment, similar to (1) but only half the length of the segment.

Traffic Control
At 6:55 AM, I arrived onsite and Contractor had started work at 6:45, traffic control was already setup, etc. Warning signs and cones set ap along Christmas Circle covering the road segment being treated.

Production consisted of a crew truck escorted at walking pace by a flagger in rolling shoulder closure per SDRSD Dwg No. TCP-06. Traffic volumes were minimal along Christmas circle and almost zero on ave sureste and noreste. Palm canyon was the busiest I’ve seen to date. It was surprisingly busy on Palm Canyon but no issues with flagging.

PCMS Signs observed at Palm Canyon Rd and Christmas Circle Dr.

Work Progress
At 7:00 AM, I met with Mike Huggins (Foreman) and reviewed work plan. We discussed quantities of payment, quality, and streets planned for today.

Crews started on the Circle to finish/touch up work from yesterday at approximately 6:45am, then moved to Ave Sureste at approx. 8:20, then moved to Ave. Nordeste at approx. 8:50am. Not many cracks were filled on Nordeste and Sureste due to the surface conditions. Most of the cracks looked like alligator cracks under the gravel and past sealant. Ave Nordeste complete at approximately 9:20am. 9:45am: Crews moved to Palm Canyon Drive Segment 2 and started about halfway in btwn Country Club and 5 Diamonds headed eastbound (downhill) towards the circle. At approximately 10:25, crews reached segment 1 at Country Club and continued their eastbound path towards the circle. Crews hit the circle at approximately 11:50am.

Crew had lunch and Mike went to refill propane tanks. They returned to the same Palm Canyon start point at approximately 1:00pm and continued eastbound in the westbound lane until they hit the circle at approximately 2:30pm.

On Palm Canyon, crews mostly worked in the bike lane and shoulder on their first and second pass.

Quality
Ave Nordeste and Sureste were particularly challenging due to significant surface gravel, thin tar paper surface, and previous seal coats.

Routing the cracks just ripped up the paper and frayed the edges. Gravel would get caught in the cracks and make it difficult to determine if the cracks were open, similar situation with the previous sealant. Some locations looked like cracks but were sealed, and some looked like they were sealed but were open.

Additional reminders to the contractor of their requirement to ensure crack fill is within ¼” of the existing surface, otherwise “if after 2 days the crack treatment is more than ¼” below the specified level, the sealant fails, or the crack re-opens, re-treat the crack.” (Std Spec 37-5.03).

I photo documented of a few locations (not all) where they will need to come back and reapply due to sealant being left more than ¼” below surface (Section 37-6.01D(2) Department Acceptance of Special Provisions).

Crews used accepted submittal 27r1 "DEERY 200" Type 2 sealant, part of Caltrans AML. Water was sprayed on larger cracks to assist in setting up. De-tack agent was onsite but not used. Lanes were closed on the circle while the sealant set up, no need for de-tack on the circle.

Palm circle: I observed a few cracks that were borderline ¼” or larger and were not filled, I notified Mike that this is out of spec. He responded that the cracks were less than ¼” and don’t need to be filled but that he will circle back and treat some more.

Safety
Crews had plenty of water and Mike brought a canopy for the bed of the truck, crews appeared to appreciate the shade without having to find Sample Daily Report

Traffic was slow and respectful of the work around the circle and almost no traffic on Ave. Sureste and Nordeste.

Mike brought up the question of the definition of a lane-mile because roads out here are very wide and include the center parking lanes, nordeste and sureste are 80-85ft wide and Palm Circle is 60ft+ wide. 2. Relevant Experience
With state and/or federally funded projects, all documentation must be in order so that the City gets timely reimbursement. The Dudek team has a strong federal and state-funded project track record regarding audits and has successfully passed every one. The City can rest assured that Dudek will be in compliance with Caltrans and that the City will get their money.

The key to success is to develop a clear understanding of project issues that will be encountered during construction. Dudek’s approach is to make certain that our understanding of project issues and the methods we implement to manage the project are consistent and mutual to that of the City and per the Caltrans Local Assistance Procedures Manual (LAPM). Our goal will be to develop and propose solutions to issues, implement a management plan that addresses the scope of work, and provides a “hands-on” team of construction professionals that will be maintained throughout the project.

Dudek personnel all have Caltrans experience, have worked with the Caltrans LAPM and are accustomed to coordination with their staff. The personnel selected for this contract all have Federal and State funded project experience and are accustomed to administering projects in accordance with LAPM requirements.

As a firm Dudek has successfully completed numerous Federal and/or State funded projects as noted below with no denied reimbursements on any projects. We have successfully completed Caltrans and CWSRF audits on many projects and have continuously received praises for our project files and compliance with the LAPM.

Dudek can support your labor compliance needs related to state and federal regulations, including Davis- Bacon and state prevailing wage requirements. Our team has extensive working knowledge of: HUD- funded and public works housing and capital improvement projects, Federal and State contracting requirements, implementation and monitoring of Equal Employment Opportunities (EEO), implementation of Prop 84 regulations, DIR regulations, and best practices related to labor compliance monitoring.

Coastal Rail Trail Reach 1 Improvements/Carlsbad Blvd. Roundabout Client: City of Carlsbad
Client Reference: Skip Hammannn (Retired), 760-802-5605 Project Dates: January 2014-September 2014
Dudek provided Construction Management services on a $1.2 million project for the City of Carlsbad providing new trails and bike paths on Carlsbad Blvd. (Coast Hwy 101) and North County’s first coastal roundabout at Carlsbad Blvd. and State Street. The roundabout provides a welcoming and astatically pleasing gateway to Carlsbad’s northern border while improving safety for vehicular traffic, bikers and pedestrians.

The project included mass grading, drainage improvements, staged roadway construction, extensive irrigation and landscaping, signage and striping and an art sculpture with boulder-scape surround. Strict adherence to US Fish and Wildlife and California Coastal Commission Permits was required due to the close proximity to sensitive habitat at the Buena Vista Lagoon. Close coordination with the City’s Traffic Engineering Dept. minimized traffic impacts to the high-volume traffic corridor between cities of Oceanside and Carlsbad.

5. Description of Services

5.1 Project Understanding
The City of Hemet has requested proposals to assist the City with construction management and inspection services for the Hemet Valley Bikeway Project. This unique project involves constructing Class II/III facilities, bike trail, bike boxes, bike lockers, and repair stations. The purpose of the project is to provide a bike path for public use that increases safety for pedestrians, motorists, and bicyclists. The project has a duration of 90 working days.

Due to the linear nature of this project, the work will have to be constructed from one end to the other in phases to minimize impacts to traffic and adjacent businesses and residents. The project may need to be phased in multiple stages (by multiple block sections) preventing the contractor from demolishing the entire alignment and leaving it in disrepair for an extended period of time. Limiting impacts to every extent possible and maintaining access to these businesses/residents will be one of the key issues on this project. An innovative and proactive role by the construction management team will be essential for the success of this project. Maintaining the flow of motorist, pedestrian, and bicyclist traffic, and minimizing the impacts to traffic during any phases of the project through multiple staging/traffic control plans will be the second key issue to project success.

5.2 Understanding the City’s Objectives
Dudek understands the City is seeking a consultant to provide construction management, inspection, and related services for this project. With this proposal, Dudek presents an array of construction management services and expertise—a toolkit for the City to initiate and complete this project. Our assembled team offers a broad range of expertise under an experienced project manager. The Dudek team approach is to provide the City with construction management and inspection services that facilitate this project is completed per contract, on time, within budget, and to the City’s standards. Dudek places a great emphasis on establishing cooperative and professional working relationships to realize this mutual goal.

5.3 Approach to Resolving Key Issues
Our proposed staffing has provided construction management and inspection services on all types of projects throughout Southern California and the surrounding areas such as the City of Fontana. Based on our past experience, there are four essential issues that must be addressed that are the foundation of all successful projects. As a firm, we train and expect our construction managers, resident engineers, and inspectors to identify and proactively address these issues throughout the project, which will lead to success or failure if they are not properly addressed:

Establish a Single Point of Contact
Establish a single point of contact between the owner and the contractor. One person must be in charge of the project and responsible for overall project coordination. This has to be established from the beginning of the project in order for the construction manager to effectively administer the contract, maintain proactive communication with all stakeholders, promptly resolve issues when they arise,

Page 377 of 676 ends

17.B

Page 865 of 1164 ends

CM and Inspection for Hemet Valley Bikeway Project 12
properly document the project, conserve the project budget and contingency, and stay firm with the contractor. All correspondence between the owner/agency/contractor must go first through the construction manager. This eliminates misunderstandings and misdirection.

Maintain Strict Adherence to the Contract Documents
We have found most unnecessary disputes/claims are ultimately the result of allowing the contractor to stray from the contract requirements during the course of the project. Once this has occurred, it is nearly impossible to get this strict control of the contractor back, so therefore it is critical that the construction manager maintains strict adherence to the contract documents in handling all issues in dealing with the contractor. The construction manager and inspector must be firm and fair in all dealings with the contractor throughout the project.

Timely Response to Issues
The key to avoiding controllable schedule delays are timely responses to submittals, RFIs, and other contractor inquiries. It is essential these issues are dealt with expeditiously, which requires the construction manager to pre-review all submittal/RFIs/change orders that need to be reviewed by the design engineer or owner, and regularly follow up with the reviewers to ensure these items are reviewed promptly. Coordination meetings and conference calls will be scheduled to discuss and resolve all issues as quickly as possible rather than tabling these items to be resolved at a later date.

Ensure Quality Assurance
Dudek believes the most important role we perform on the project will be quality assurance of the work during construction. We want to ensure there is no lingering long-term maintenance issues left for the owner due to lack of or improper inspection. We understand future costs can result when a project is not constructed and inspected properly, so it is essential the right personnel are assigned to the project.

Dudek will provide the proper, qualified personnel who have a long track record of successfully inspecting the particular type of work being built on each phase of this project. We have an exceptional mix of construction managers, engineers, and inspectors with specialties in civil, mechanical, structural, and electrical disciplines on public building, parks, and roadway rehabilitation projects. Our proposed staffing has a history of successful completion of high-quality projects for our clients. They will be responsible for documenting, testing, and coordinating material testing/special inspection to ensure all work is constructed in accordance with the contract documents; if work does not meet these standards it will be rejected and reworked until it is acceptable.

5.4 Allocation of Resources and Budget
The Dudek team is composed of a wide range of experienced, local talent with depth to meet any of the City’s needs. George Litzinger, a firm principal who leads Dudek’s construction management practice, will be assigned as the City’s initial main contact. Mr. Litzinger will be supported by proposed Construction Manager Ryan Ruiz, PE, and an experienced inspector. George will maintain open and effective lines of communication with the City regarding a project’s status. The CM Team will develop a project procedures plan based on five elements per the City’s requirements: Team, Budget, Schedule, Lines of communication, and QA/QC control. Each element will be part of the management approach and will be used for allocation of staff resources, establishment of budget and schedule milestones, and assessment of progress during the course of work.

5.5 Scope of Work
Dudek will perform the following tasks. These activities are assigned to the staff as detailed in the staffing plan and level of effort as required. Below is the Dudek Team’s general plan for completing this project.

Preconstruction Services
A review of the project plans and specifications, material submittals, and project documentation will be completed prior to the preconstruction meeting to ensure all City requirements and specifications are established and no contradictions to the plans and specifications exist. Special attention to the documents will include contract milestones, liquidated damages and coordination with other agencies has been completed. The construction project area will be field inspected to ensure conditions are consistent with the contract documents.

Review of Contract Documents
Dudek will review all contract documents for consistency with the required construction work scope. The review shall include, but not be limited to, the appropriateness of the number of working days allowed, the appropriateness of the amount of liquidated damages, and timely coordination with other agencies.

Preconstruction Meeting
Prior to the Notice to Proceed (NTP), the construction manager will meet jointly with the contractor, City, project designer and other involved entities to outline the following: contract administration guidelines, project concerns, contractual roles and relationships, specific requirements for safety, security, and access through/around the construction site. Our approach during the preconstruction phase is to clearly establish lines of communication and procedures to the contractor. We will reinforce to the contractor that the project will be administered in strict accordance with the contract documents and project plans and specifications. Dudek will also require that all preconstruction permits are obtained, and an approved Traffic Control Plan (TCP) and Storm Water Pollution Prevention Plan (SWPPP) are approved and on file during this phase.

Dudek will prepare the agenda to be reviewed and approved by the City, conduct the meeting, and prepare and distribute detailed meeting minutes within 72 hours of the meeting. This meeting will set the tone for the project, and it is crucial that the contractor understands that we expect compliance with the contract documents, particularly in regard to environmental and public relations. Our goal is to ensure the contractor understands we are there to enforce the specifications fairly and consistently. We want to portray an attitude of mutual cooperation and reassure we are there to help expedite the project, not become a hindrance. Prior to the start of construction, Dudek will walk and video tape the entire project with a representative of the awarded contractor. The video tape will include audio noting of all existing improvements. Special note will be made of damaged improvements along the project limits and will include numerous photographs in addition to video.

Construction Phase Services
Construction Management Services
Correspondence, Reports, and Other Project-Related Communication During the construction phase of the project, our team will maintain a firm and fair policy in dealing with the contractor. Our approach is to be diligent in controlling the work through enforcing good workmanship and ensuring conformance of materials and equipment to the contract documents. Dudek will assist the contractor by alerting him to special project requirements, such as project standards, coordination and inspection with the City and any other utilities. The construction manager will ensure submittals, RFIs, design clarifications and change order requests are dealt with expeditiously and respond to all inquiries accordingly. Inspections and tests will be made promptly. Regularly scheduled progress and technical coordination meetings will be held to identify/resolve issues, coordinate, and update project status.

Claims for additional work will be reviewed against the contract documents for validity, accuracy, and method of computing. Valid claims for additional work will be brought to the City with a recommendation.

Invalid claims will be rejected.

The key to avoiding unnecessary claims and schedule delays is our timely response to contractor submittals and inquiries. Strict adherence to the contract documents will also help to avoid disputes and schedule delays. Along with daily construction activity reports provided by the Dudek field inspector, the construction manager will also provide regular progress reports to the City, which will include photo project documentation, potential claims, safety concerns, coordination, detailed force account activities, adjacent property issues, manpower reports, and possible delay reports.

Construction Progress Meetings
The construction manager will maintain ongoing interaction with the City and the contractor at progress meetings and project updates will be conducted at regular intervals after start of construction. The project manager will schedule and chair weekly and monthly meetings with representatives of the contractor, subcontractors, and the City to discuss all project matters (e.g., progress, 3-week look ahead schedule, job problems, Notices of Noncompliance, actions requiring clarification of design intent, ambiguities in contract documents, etc.). Responsibilities for response will be assigned to appropriate participants.

Action monitoring will be implemented to ensure compliance and timely response by all parties. Other affected agencies and entities will be invited and encouraged to attend to hear the information firsthand.

Their attendance will be mandatory if specific issues to address are in their area of responsibility. The meetings will be documented and distributed to the City, contractor, design engineer, and others as requested to be on the distribution list for a complete record of project transactions, and will be included in the project files.

Submittal/Shop Drawing Review
Dudek will receive, log, review, and comment on all contractor submittals/shop drawings for the project.

All submittals will be digitized into an electronic PDF format and stored as a part of the project documentation. A submittal log will be kept to track the status on all submittals. The log will identify each submittal and re-submittal, date received, reviewer, when returned to the contractor, action required, and other pertinent information. The construction manager will review and respond to all submittals and will send certain submittals for review to the appropriate party – design engineer and City, as necessary. We will insure any mock ups are prepared by the contractor and then reviewed and approved by the City prior to the start of this work.

Page 380 of 676 ends

17.B

Page 868 of 1164 ends

CM and Inspection for Hemet Valley Bikeway Project 15
Critical Path Method Construction Schedule Review
The contractor’s schedule will be closely reviewed by the construction manager, assuring all project items and dates are accurate and in compliance with the contract documents, including submittal review times, long lead/lag items, etc. These reviews will be performed and submitted with each monthly progress payment. If discrepancies are discovered, the contractor will be immediately notified to re-submit an accurate schedule. The construction manager will maintain accurate records of the project schedule by using a Statement of Working Days form to document days worked by the contractor, working days lost to weather or other similar delays, and any change order extension days that will be provided to the contractor weekly.

In reviewing the contractor schedule, the construction manager will ensure the contractor has properly phased his work per the contract, i.e. not demolishing all frontage improvements along the entire alignment at one time, and will continually maintain access to the adjacent businesses.

Requests for Information (RFI) Review
Dudek will receive, log, review, and comment on all contractor RFIs during the project. Dudek will review and respond to all RFIs and send RFIs to the appropriate party for review – City and design engineer, as necessary. Dudek will review all RFIs and will process written responses to contractor RFIs and distribute responses to the contractor and the City in a timely manner.

Progress Payments Review and Processing
Payment will be based on actual quantities of contract items constructed in accordance with plans and specifications. Progress payment request invoices from the contractor will be reviewed. Dudek will review quantities and percent complete and compare the contractor’s invoice amounts for percentage against our records; if accurate, we will make a recommendation for payment to the City for payment and prepare the progress payment and associated memorandums as necessary to complete the pay request process with the City.

Certified Payroll Review
We will review the contractor’s certified payroll reports on a monthly basis to ensure their employees are being paid in accordance with State prevailing wage regulations. We will ensure the contractor submits an acceptable certified payroll report with each monthly progress invoice.

Contract Change Order Management
Dudek will review all requests for contract changes by the contractor and respond promptly to these requests whether they are or are not within the scope of the contract documents. Legitimate requests will be reviewed for compliance with construction document procedures, non-legitimate requests will be rejected. Cost and method for determining additional work will be reviewed for accuracy and appropriateness. Dudek will review all change requests with the City and will not authorize any changes without the approval of the City’s project manager. Dudek will review and negotiate cost and method for determining additional work. Dudek will provide the City a complete and accurate cost estimate for changes. On legitimate change requests or owner-initiated changes approved by the City, Dudek will make recommendations on whether the contractor’s cost proposal is appropriate or to proceed with this change on an extra work basis so that changes are cost effective for the City. Dudek will assist in the resolution of all potential change requests and claims that may arise during the course of the project.

Inspection Services
Field Inspection
We will provide daily inspection of the contractor’s work to verify quality installation conformance with the contract documents and City standards, and to make certain that the contractor uses the highest-quality materials and workmanship. We strictly enforce the project specifications and standard specifications of public works construction to verify a quality installation that meets or exceeds the project requirements.

All inspection performed will be followed up with an accurate and concise daily construction report and submitted to the City at the end of each day. The report will document construction activities, changes in conditions, labor, and equipment used that day. Field inspection includes the following:
▪ Maintain accurate records of the quantities of materials that are constructed. ▪ Meet with the contractor at the beginning of each workday and review proposed work plans, including specific details that may affect progress.
▪ Maintain accurate records of the equipment on the job and the idle or working time of equipment. ▪ The inspector will include details about any material delivered to the site in the daily report, as necessary.
▪ Maintain accurate records of accidents or claims that are related to construction. ▪ Coordinate contractor requests for interpretation of the plans and/or specifications in a manner that will document the resolution of questions and keep the project on schedule.

Contractor Performance
Dudek will encourage, monitor, and stay on top of the contractor to perform at a high level to provide the City with a great project. We will enforce these expectations starting at the preconstruction meeting and continuing throughout construction. Delays or deficiencies will be brought to the attention of the City and the contractor immediately with corrective action to follow, which will include withholding of payment for unsatisfactory work. The contractor will be required to provide a recommended corrective action for approval, and we will make sure the contractor follows through. Payment will be withheld until this item is completed to the satisfaction of the City.

Monitoring Activities
Monitoring activities will be conducted as follows:
▪ Review traffic control equipment and personnel to ensure that the project is safely constructed and that the public is not unreasonably delayed.
▪ Review and verify pedestrian and handicap access potentially impacted by the project to ensure that pedestrian traffic and handicap traffic is safely afforded access throughout the project.

Make sure the contractor is not ‘jumping ahead’ to the next phase and completing all necessary work prior to beginning work in the next phase.
▪ Inspect and verify concrete is being placed in a manner that matches the finish, color, and look of the approved mock ups.
▪ Through independent inspections, ensure that the contractor maintains traffic control, pedestrian access, and storm runoff at all times (during weekends, holidays, and storms). ▪ Ensure that the contractor protects its worksite from pedestrians and motorists at all times and nighttime traffic controls are secured at the end of each workday. Whenever trench plates are

Page 870 of 1164 ends

CM and Inspection for Hemet Valley Bikeway Project 17
used on the roadway, the inspector shall ensure that the trench plates are properly ramped and secured to the pavement at the end of each workday.
▪ Enforce storm water runoff control and pollution plans at all times. ▪ Evaluate work in progress and give weekly status report to the City for use in determining any effect of scheduling delays and any needed enforcement or corrective action.

Project Documentation
The importance of proper project documentation is imperative. Our staff knows project documentation is as much a responsibility as any task of their work. The inspector will prepare on a daily basis a complete report indicating all of the construction activities performed that day. All material quantities installed are documented, contractor equipment and labor documented by type and hours worked. Any specific project issues will be addressed, conversations logged and updated as-built drawings confirmed. Hard copy and electronic files will be kept and organized for all of the project documentation. All correspondence, submittals, logs, daily reports, photos, etc., will be kept digitally in a PDF or MS Word/Excel for Inspection Forms/Checklist.

Documentation is critically important in construction and all communication will be provided to effected personnel in writing. Our inspectors maintain daily logs, complete incident reports, and photograph elements of a project. We assist the City with progress pay estimates, contract change orders, labor and equipment records, personnel records, and other general correspondence that will ensure the effectiveness of the projects.

Inspection of Roadway Subgrade, Sidewalks, Curb/Gutter, Grades, Slopes Dudek has developed a proactive checklist for the inspectors that is used on projects as follows:

Trail/Roadway Subgrade
▪ Check plan requirements for existing soil foundation preparation and stabilization, subbase and base. Thickness? Density?
▪ Grade Stakes Set? Check for protection and setting of hubs by contractor. ▪ Review requirements and procedure with contractor. Sources of base and subbase; soil stabilization method; material tests and approval; compaction tests. ▪ Are all of the pockets of soft or yielding material ripped up and dried out or replaced with suitable material? Evaluate for contractor or agency responsibility. ▪ Imported base or subbase sampled from sampled from material delivered to job site? Test results okay?
▪ Maintain adequate dust and noise control during all grading and crushing operations. ▪ Collect delivery tickets for tonnage payment (from certified weighmaster). ▪ Test for compacted density of subbase; base.
▪ Check finished subgrade for grade, cross section and surface smoothness. +/- ¼” (6mm) (which must be compensating) is the usual tolerance of subgrade for pavement.

Asphalt Pavement Checklist

Construction and Materials Testing Services
The inspector will be responsible for witnessing the testing of all materials during placement. The inspector will also be responsible for coordinating and scheduling other materials and system testing as described below.

Dudek will utilize the services of Atlas as the geotechnical and materials testing consultants to provide observation and testing services for materials used on the project on an as-needed basis. These testing services include: compaction testing of soil, aggregate base and asphalt concrete, sampling and laboratory testing of cast-in-place concrete. They will also provide geotechnical observation and professional recommendations on an as-needed basis as well.

Closeout and Acceptance Services
Dudek’s inspector will coordinate and schedule a joint final walk-through with the City, business owners, and contractor. All outstanding and or unacceptable items will be compiled into a single, detailed punch list and transmitted to the contractor. All punch list items will be inspected by the Dudek inspector for completeness and acceptance. We will make it clear to the contractor that (1) the project is not complete until the punch list is complete, and (2) punch-list work is contract work to be completed within the specified contract time. Once we have verified that the contractor has successfully completed every item on the punch list, we will draft final change orders and obtain required lien waivers, guarantees, manuals, training materials, and spare parts for turnover to the City. Once all of the closeout documents and change orders are executed, we will assist the City in generating the final pay request. We will review and certify the contractor’s as-built drawings and cross-check against our set of as-built drawings. The final, clean set of record drawings will be submitted to the City’s project manager.

All close out and project documentation will be compiled in three (3) ring binders prominently labeled on the face and spine with the project title with accompanying electronic PDF file formatted CD or as requested by the City. Project photographs taken before, during, and after completion of construction will be included.

7. Quality Control
Project Management / Quality Control
Key elements of our management approach to keep project deliverables on time and error-free are:
▪ Assigning Principal-in-Charge George Litzinger, PE, who has over 35 years’ project experience ▪ Assigning personnel with directly relevant experience and training related to each task assignment
▪ Using senior-level staff for QA/QC of work products before they are delivered to the City ▪ Maintaining open and effective lines of communication with the City regarding a project’s status ▪ Early involvement in development, planning, staffing, and implementation of project work.

Schedule Control
Dudek’s construction management and inspection staff will provide services on a timely basis so as not to cause any delay to the City’s projects. This goes for other City consultants not contracted directly to Dudek. Any consultant working on construction projects managed by Dudek for the City will be replaced immediately if they are the cause of delays to the project.

Lines of Communication
To effectively manage a project, the construction manager serves as the single point of contact for all verbal and written communication. Establishing a sole point of contact for the contractor and owner at the beginning of the project helps avoid miscommunication, which is extremely detrimental to project success. The preconstruction meeting sets the tone for the project flow, standards, roles, and responsibilities. We make it clear that the contractor is not to proceed with any directive unless it comes directly from us and to notify us immediately if directives are received from others. This also applies to other consultants and agencies we are responsible for coordinating. Weekly construction progress meetings provide written lines of communication and documentation to continually address issues until they are resolved.

We maintain an open line of project communication using weekly construction progress meetings with the City, contractor, utility companies and other affected parties. Conflicts are either resolved at these meetings or in the field with our inspector. Any issues that cannot be resolved at the meetings, such as claims, are resolved at separate negotiation sessions.

If an employee believes that a violation of this policy has occurred, the employee has a duty to immediately report the incident(s) by using any of the following methods:
▪ Notify the employee’s immediate supervisor or any Dudek supervisor. Any supervisor who receives such a complaint must promptly report it to Human Resources. If the complaint involves a member of Human Resources, the supervisor should report it to the President. The description of the incident(s) can be given orally or in writing.

Any employee who is found to have committed such retaliation will be subject to discipline, up to and including termination of employment. Any employee who experiences or witnesses any conduct believed to be retaliatory should immediately follow the complaint reporting procedures stated above.

Successful achievement of a nondiscriminatory employment program requires cooperation between management and employees. Additionally, there are equal employment opportunity goals set and various systems in place that keep management informed of the equal employment opportunity status.

SECTION 3: STATEMENT OF QUALIFICATIONS

STATEMENT OF QUALIFICATIONS
FCG has a strong working relationship and rich history with our subconsultant team. Our previous experience, mutual trust, and ability to mobilize quickly and keep the project momentum moving forward allows us to present City of Wittier with a quality team that can work together to deliver a project successfully and on-time. The FCG Team members have extensive experience with construction management services for City of Lake Elsinore, City of Whittier, City of Downey, City of Norwalk, City of Irwindale, City of Pico Rivera, Caltrans, and a myriad of other clients and agencies. Each of us is familiar with construction management and inspection contracts and understands the importance of assembling a solid team. For this effort, we have four (4 ) highly qualified key staff, and additional as-needed staff, working together as a team to ensure City of Hemet is getting the highest quality candidates and service to successfully complete the project on-time. In this proposal, FCG will discuss several successfully delivered projects that are like this project in terms of plans, specifications, and FHWA requirements.

Our staff are our greatest strength and therefore our greatest asset. Our success is based on our hiring the best people in the industry to produce the highest quality results at the most reasonable price. This practice continues throughout our internal comprehensive training program that can get inspectors up to speed on any work assignment and in any work environment, concluding with our quality maintenance process. Our staff and subconsultant have a depth of knowledge and experience that sets us apart from our competitors as have proven in the past and will continue to do so in the days to come. Our personnel are highly qualified and experienced in their respective disciplines. Each of their qualifications illustrate multiple projects, past and present, they have worked on. We are proposing a sum of experienced candidates with the appropriate experience, as per the city’s requirements and the RFQ, who are ready and available to be deployed. This pursuit is a team effort and FCG is committed to ensuring City of Hemet receives the highest quality service from the appropriate candidates regardless of if they are prime or subconsultant.

Our relevant project experience is a demonstration of the different projects we have worked on from bridge widening to Caltrans right-of-way, utility relocation, traffic signals, building and widening ramps, building retaining walls, traffic control, night work, and 55-hour closures. We have completed this work enforcing different specifications, including Caltrans Standard Plans and Specifications, Greenbook Standard Plans and Specifications, SWPPP, Safety, Cal-OSHA, Caltrans Safety Requirements, and Caltrans Structures Safety Requirements. Each of us have worked around environmentally sensitive areas, near bodies of water, challenging interchanges surrounded by businesses and residences as well as congested interchanges, freeways, and live traffic. We have done work in Orange County Riverside, and Los Angeles counties, as well as other parts of the state. As a result, we understand the special needs of these types of projects and can bring that knowledge and understanding to this project.

Differentiator: FCG staff has the ability to efficiently staff projects with the most committed, experienced, and knowledgeable staff with relevant experience to each project. The FCG Team can provide large business service with a team of multi-discipline professionals; however, what differentiates our firm from others is having the ability to provide a small business, client-focused, and customer-service approach to deliver each client the one-on-one attention needed to specifically tailor cost-effective solutions and solve project needs.

SECTION 7: DESCRIPTION OF SERVICES

PROJECT UNDERSTANDING

The City of Hemet is planning to perform a flagship
project for the Bike Hemet improvement program
which constructs bicycle improvements along a four-
mile route that extends from the northern City limit to a new transportation mobility station located along the
NMTP Salt Creek Corridor. This critical link closes a
bikeway gap, providing needed connections to activity
centers within the City. Project elements include Class II and III facilities, bicycle detection, bike boxes, bike lockers, and bike repair stations. A transportation
mobility station provides bicycle staging areas and
linkages to regional trails. Other proposed
improvements include pavement rehabilitation, street
widening, improved signage, lane striping, curb, gutter, sidewalk, and ADA ramps. Missing sidewalks, faded
striping, inadequate signage, and an overall lack of
amenities currently discourage active transportation as a mobility option.

The project proposes to install Class II and Class III bicycle facilities, bicycle detections, bicycle boxes, bicycle lockers, bicycle repair stations, sidewalks, curbs, gutters, curb ramps, and transportation mobility stations with bicycle staging areas. The work will also include all necessary equipment and appurtenances necessary for the proper construction of the contemplated improvements, in accordance with Plans and Specifications for this Federally Funded (ATP) Project.

SECTION 7: DESCRIPTION OF SERVICES
City of Hemet RFP
CM and Inspection Services for
Hemet Valley Bikeway Project

Typical Issues & Recommendations
The FCG team has worked on several similar projects with relatively similar plans and specifications and found the following typical issues to be addressed for your review and consideration that will result in significant savings of time and cost to the City

ISSUE RECOMMENDATION
Safety
Safety is the most important thing on any construction project, including but not limited to, pedestrians, motorists, bicyclists, contractor workers, inspectors, city and agency staff, and anyone in the vicinity of the pr oject. The FCG inspector will always enforce safety due to construction activities.

Coordination with Utility Companies

Typically, coordination with utility companies takes time, especially with Southern California Edison (SCE). It is highly recommended that coordination with such agencies when it comes to identifying and locating their valves, pull boxes and vaults is done and completed prior to award of construction to avoid delays
Flagging
Typical payment for traffic control does not specifically include flagging costs.

We recommend including specific language for flagging as part of traffic control if flagging is needed.

Construction Schedule
We suggest adding language to the specifications to include a timeline for review and response to the baseline schedule and submittal of monthly schedule updates.

Project Information Signs
The FCG team will assist in developing a sign that includes funding sources as well as contact information for staff that will be able to answer questions and comments.

CMS Boards
The FCG team recommends using CMS Boards to inform the public of the project and upcoming work and lane closures by placing the boards on intersections, as needed, prior to start of construction showing duration of the project and potential lane closures.

ADA Compliance
The FCG team will ensure ADA compliance throughout the job site and that the Contractor continually maintains curr ent requirements for ADA access. The FCG inspector will make sure the Contractor provides acceptable temporary access for pedestrians, install signs indicating “ADA Access” and minimize public inconvenience.

Public Outreach
The FCG team will assist in developing public notices in English and Spanish and knock-on doors of local residents and businesses and pass them along.

The notices help minimize public inconvenience and complaints and provide a better and clear idea to the public of the work being performed and the duration of the work.

SWPPP
The FCG team will ensure SWPPP compliance, and that the Contractor installs and maintains BMPs daily. The FCG inspector will make sure the Contractor protects the work area from debris, erosion and discharge. 13

SECTION 7: DESCRIPTION OF SERVICES
City of Hemet RFP
CM and Inspection Services for
Hemet Valley Bikeway Project
CIP 5696; Federal Project No. 5186(018)

SCOPE OF WORK
Scope of Services
Our construction management services focus on coordination, review, tracking, reporting, public outreach, cost control, and field inspections to ensure the quality of the work complies with applicable federal funding requirements, LAPM, and the contract documents. The RE and inspector(s) will coordinate and work proactively to assist the general contractor’s construction efforts and maintain fluid channels of communication with the City’s design consultants to technically support the construction effort and the efforts of the City in achieving a successful completion with minimum complications.

The FCG Team’s team is unique in that it has a natural quality assurance/control system. Through its structure as an integrated unit with close communication between team me mbers and interlocking responsibilities that provide good coverage of all elements of construction engineering, it incorporates minimal overlap of duties to avoid misunderstandings and reduces costs.

The RE is responsible for daily decisions and assignments of specific duties while monitoring the success and completion of project construction. The resident engineer has specific administrative duties that include review of field activities. He will institute a system of periodic reviews of the field file for conformance with The FCG Team’s in-house filing system and LAPM. The inspectors will have specific assignments and move the products of their reporting to the resident engineer/construction manager. This bi-level approach has proved effective because the likelihood of a missed or incorrect item is essentially eliminated with this multi-level control.

Additionally, our team will maintain a project first philosophy with the contractor. When this is achieved, construction is easy, straight forward, and accomplished with a minimum of issues. We are a team; and right is right and wrong is wrong for all parties. When this is established, it creates a fair environment for all, and project success is achieved.

Task 1 Pre-Construction Services
Our Construction Manager (CM), AB Fakhouri, will start work on the Project immediately after the Notice to Proceed (NTP). AB will develop the tasks that need to be accomplished and assist in bid review, Project scheduling, and with City of Hemet’s concurrence, assign staff duties to the appropriate members. a. Constructability Review – The FCG Team will review the plans and special provisions during design for errors and constructability issues, report those findings to City of Hemet, and will coordinate with the design team to eliminate such issues. By being active during design, these findings typically provide for accurate and concise bids that eventually reduce RFI’s, changes or claims during construction. Most importantly, bid items in the Special Provisions must be clear as they describe the work, measurement of the work, and what is included in the payment of each item.

b. Schedule – The CM will work with City of Hemet to review the baseline schedule, look for issues, and make recommendations to City of Hemet as appropriate. Such recommendations will be based on logic and a realistic schedule. Our CM will propose enh ancements based on sequence and number of working days, milestones, and key dates to ensure development of an efficient and well managed Project. c.

Budget – The FCG Team will review the contractors’ bids and provide comments and recommendations to City of Hemet to ensure proper expenditure of funds to control Project costs.

1. Construction Bid and Award
The FCG Team will assist City of Hemet in the constr uction bid procurements, including contract documents, Federal and State requirements, Plans and Special Provisions, and permit requirements. We will perform all work as per the Caltrans Construction Manual and Local Assistance Procedure Manual. a. Construction Bid Documents – The FCG Team will review the bids for compliance with contract documents and contract scope to avoid unbalanced bid items and to prepare tabulations of all bids. The CM will advise City of Hemet’s Project Manager, (on issuing the NTP based on review of apparent low bidder price and schedule. This allows for the contractor to obtain all appropriate permits prior to construction. 14

SECTION 7: DESCRIPTION OF SERVICES

b. Pre-Construction Meeting – Once the NTP is produced, the FCG Team will coordinate for the preconstruction meeting by preparing a list of attendees, including, but not limited to, the contractor, designer, City of Hemet, Caltrans, and utility companies. Prior to the meeting, the CM will prepare for City of Hemet review an agenda that identifies the following: documents required from the contractor for supervision and safety, certified payroll requirements, materials sampling and testing criteria, and certificates of compliance for all materials. The attendees will receive meeting minutes, including a sign-in sheet, for their records following the meeting.

c. Construction Contract Award – The CM will review all bids and will make a recommendation to City of Hemet to award to the lowest apparent responsive bidder. Additionally, we will develop a payment excel file, verify the contractor’s references, licenses, insurances, and coordinate with the contractor for award.

d. Funding Documents – The FCG Team will assist the City with the following:

1. Send copy of notice of preconstruction meeting to Caltrans.

2. Prepare local agency contract award checklist.

3. Prepare detail estimate and summary and finance letter based upon low bid.

4. Obtain from contractor Local Agency Bidder – DBE Commitment (construction contracts) and Local Agency Bidder – DBE Information (construction contracts) based upon low bid.

5. Prepare resident engineer’s construction contract administration checklist to help local agency with administration of federal aid project.

6. Submit to Caltrans DLAE Item No. 2 through 5 along with City provided data for engineer’s final opinion of probable construction cost, contractor’s bid, bid analysis, executed contract, and as advertised plans and specifications.

7. Prepare progress invoice at least every six months based upon contractor’s contract progress reports and submit to Caltrans DLAE.

Task 2 Construction Management and Coordination
As the pre-construction phase comes to an end, we will begin staffing for construction management and inspection based on the contractor’s actual schedule of activities and staging of the work. The staffing will parallel the contractor activities to ensure maximum efficiency in expenditure of the construction management contract with City of Hemet.

When Project activity increases, we will add additional field staff necessary. A staffing plan is included in the Proposed Staffing and Project Organization section of this proposal. As we have demonstrated in the past, The FCG Team is committed to reducing the Project duration, which will result cost savings to City of Hemet.

Task 2.1 Meetings
The FCG Team will coordinate and conduct weekly
progress and field meetings with the City of Hemet, the design team, and Contractor. Our CM will prepare the
meeting agendas, which will include reviews of the
Project schedules, a summary of submittals and RFI’s,
unresolved issues, and new issues requiring follow-up.

Our CM will produce meeting minutes of each meeting.

In addition, The FCG Team will coordinate and meet with residents, business owners, utility firms, and other
agencies involved with this project.

Los Angeles, Orange, San Bernardino, Riverside, San Diego, and Imperial, and has developed strong working relationships based on trust and respect. The FCG Team has the experience and capability of communicating and working with the contractor. The FCG Team will continue to develop good working relationships while producing the desired product for the City of Hemet.

Utility Coordination – The FCG’s CM will manage the Project’s utility coordination efforts with the contractor and the local utility companies. A critical factor for constructing any project is early partnering with utility companies within the project limits. Our CM and the FCG Team will coordinat e with each utility company and work diligently to communicate, schedule and achieve the timeline for each relocation or new construction. Also included in the appendices section of this submittal is a list of the utility work to be performed by others as shown on the plans (Table A). For utilities planned for relocation during construction, the FCG Team plans to initiate coordination with the contractor and the respective utility to plan for USA Dig Al ert, potholing, and scheduling of the relocation work of the facilities. The CM will verify the Contractor incorporates work related to the utilities in the baseline schedule.

Task 2.3 Project Schedule and Cost Control
FCG’s CM will manage the Project’s schedule and budget and will set up an internet-based document controls system and Primavera scheduling. The team will prepare independent monthly estimates for the Project duration, monitoring both the Project and contingency budgets. Ou r report to City of Hemet will incl ude amount paid to contractor to date, previously paid amount to contractor, percent complete of each bid item, executed change orders, and retention withheld from each pay estimate. Our intent is to keep City of Hemet fully informed of the financial status of the Project.

 Pay item quantities will be measured daily and documented on daily reports.  Quantity Sheets will be prepared with each pay estimate, with backup calculations.  Change orders will be prepared, monitored, costs independently estimated and verified, and work documented daily on a separate daily diary with tentative agreements (if force account (T&M)).  Our tracking system includes costs, including supplemental work and furnished materials.

The CM will monitor the Contractor’s schedule, beginning with a thorough review of the baseline schedule submittal, and following with a review of the monthly schedule updates. The CM will identify any changes or deviations and discuss these issues with the contractor to determine the causes for deviation.

Contract Change Orders and Claims
The FCG Team will work with the City of Hemet during Construction Contract Award and Change Order process to assist City of Hemet in controlling the costs of the Project and controlling the factors that may escalate Project costs.

The FCG Team will receive, process, track and document Project requests for Contract Change Orders from the Contractor and a CCO log will be establish ed at the beginning of the Project and will be continuously maintained and updated by Mr. Fakhouri. To the delegated level of approval, and under the City of Hemet’s direction, the FCG Team will determine the need, merit, scope, estimated cost, and schedule impacts to the project as a result of potential contract change orders. The FCG Team will also negotiate change orders with Contractor as directed. Once merit is established, Mr. Fakhouri will prepare change orders based on the Contract Documents and in close coordination with the Design Engineer and City Project Manager.

All contract change orders will include a transmittal memorandum that will identify the issue, provide background information, determine merit and provide financial and schedule impacts. This transmittal memorandum is generally for City review only and is not shared with the Contractor. All contract change orders will be reviewed with the City Project Manager. The FCG Team will work with City of Hemet’s Project Manager to establish levels of financial authority from the City Project Manager up the chain of command to provide guidelines for change authorization. The FCG Team compile the monthly Project costs, including engineering an d management costs, and include it in the monthly report to City of Hemet.
