A. If there are a greater number of applications that meet all Phase II merit criteria than can be issued because of the numeric cap established by Hemet Municipal Code section 18-508(c), then prior to the City processing the tiebreaker lottery, any applicant may voluntarily place themselves on a waitlist.
B. The waitlist shall remain valid for thirty-six (36) months from the date of this resolution unless amended by the City Council.
C. The City Manager is authorized to advance the next-in-line waitlisted applicant to the permitting process upon any of the following:
1. A population increase documented by the California Department of Finance or U.S. Census that legally permits an additional retail license;
2. Voluntary surrender, revocation, or non-renewal of an existing retail permit; or
3. Council adoption of an increase to the retail permit cap.
D. Placement on the waitlist confers no vested right to a permit and may be rescinded by the City Council in its sole discretion.
SECTION 2. Waitlist for Rahman & Associates LLC DBA Star Budz The City Manager is hereby authorized and directed to negotiate and execute a Conditional Agreement (“Agreement”) with Rahman & Associates, LLC DBA Star Budz, consistent with the terms of this Resolution and subject to approval as to form by the City Attorney. The City Manager is authorized to make minor, non-substantive modifications to the Agreement that do not increase materially alter the intent of this Resolution.

Essential Terms. The Agreement shall include, at minimum, the following:
A. Stay of Processing. The City shall stay final action on the Applicant’s permit until a triggering event under Section 1(c) above.
B. Upon a triggering event, the City Manager shall notify the Applicant in writing and resume processing consistent with the Application Procedures & Guidelines then in effect.
C. The Applicant acknowledges that execution of the Agreement does not constitute issuance of a permit, land-use entitlement, or vested right.
D. The Agreement shall expire thirty-six (36) months from execution unless extended by mutual written consent or earlier terminated.
E. Indemnification. The Applicant shall defend, indemnify, and hold harmless the City, its officers, and employees from any claims arising out of or related to the Agreement or the underlying application.
SECTION 3. Effective Date.
This Resolution shall take effect immediately upon adoption.

PUBLIC COMMENT - HEMET CITY COUNCIL MEETING

Good evening, Mayor, Councilmembers, and City Officials.
My name is Anthony Noriega, District Director for LULAC District 5 - Inland Empire. I'm here tonight not to ask politely, but to speak a truth this city refuses to face.
Over one year ago-July 4,2024 Jimmy Lopez was killed by Hemet police. Five offrcers allegedly fired more than one hundred rounds. Jimmy was hit repeatedly-some say 24 times.
One offrcer, records now show, never fired. Did he alone see Jimmy as no threat at that moment? A year later, the violence is compounded by silence. The Riverside County Coroner still withholds Jimmy's autopsy, citing an "ongoing investigation." Some say it could take three years to release.
The civit lawsuit? Still winding through the courts.
Two excessive-force complaints? Ignored.
Public Records Act request? Acknowledged-no records provided California DOJ investigation? Still pending.
Yet the Hemet Police Department continues to speak of accountability and transparency. These are empty words meant to prolect the department.
While this council and the hemet police remain silent, Jimmy's family and supporters await answers to questions they may never get-Their courage and persistence stand in stark contrast to your unwillingness to act.
I will be filing another formal complaint with the Califomia Department of Justice- for the Hemet City Council's and Police Department's willful failure to respond to the family and to the community you claim to serve. Within 45 days, I will be filing a separate complaint involving one of your officers. This complaint will be filed directly with the DO.l and or with the Hemet Police Department. Starting this September and continuing until Juty 4.2026,1 will share our Jimmy's story with all 497 newspapers and online publications in Califbmia.
Jimmy Lopez's name will not be forgotten. Neither will your failure to answer for what happened.
