Armored Vehicles with Breaching or Entry Apparatus or Water Cannon Description: Inventory includes four LENCO Ballistic Engineered Armored Response Counter-Attack Trucks (BearCat).

Usage: The BearCats are primarily used during high-risk tactical enforcement operations, officer rescues, and vehicle-borne interventions. Additional deployments are used during criminal unrest and riots. Rescue vehicles provide ballistic safety during the containment and apprehension of armed violent suspects. • Rescue vehicle for on-campus active shooter incidents to rescue injured victims

Mandated Biennial Review of the City's Conflict of Interest Code RECOMMENDED ACTION:

It is respectfully recommended that the City Council direct the City Manager to review the City's current Conflict of Interest Code and return with any recommended updates for Council consideration.

BACKGROUND:

The Political Reform Act (Government Code Section 87306.5) requires every local government agency to review its Conflict of Interest Code (“Code”) every even-numbered year (biennially) and determine whether the Code needs to be amended. This process begins with the City Council's direction to review the current Conflict of Interest Code for any updates and amendments.

DISCUSSION:

Government Code Section 87306.5 mandates that local government agencies review its Conflict of Interest Code biennially. The City Council is the code reviewing body for the City of Hemet. The City Council must notify staff to review its Code. No later than October 1st of each even-numbered year, staff must submit to the City Council a report indicating whether or not an amendment is necessary.

The City Manager will have each City position reviewed to determine whether it should be included on the list of designated Statement of Economic Interests (Form 700) filers. By October 1, 2026, a report will advise the City Council whether or not amendments are needed to the existing Code. If amendments are necessary, the revised Code will be placed on a City Council agenda for review no later than December 29, 2026. A City’s amended code is not effective until it has been approved by the City Council.

On September 24, 2024, the City Council adopted Resolution No. 2026-172, adopting and promulgating the Conflict of Interest Code and designated officials and employees of the City of Hemet who are required to file a Statement of Economic Interest and rescinding Resolution No. 2023- 037 (Attachment No. 1).

THE CONFLICT OF INTEREST CODE AND DESIGNATED

OFFICIALS AND EMPLOYEES OF THE CITY REQUIRED

TO FILE A STATEMENT OF ECONOMIC INTEREST AND
RESCINDING RESOLUTION NO. 2023- 037
The City Council of the City of Hemet, California ( hereafter referred to as the " City Council") does resolve as follows:

WHEREAS, Government Code Section 87300 requires every local government agency to adopt and promulgate a conflict of interest code, and review its conflict of interest code biennially to determine if it is accurate or needs amending; and WHEREAS, Section 18730 of Title 2 of the California Code of Regulations allows j local government agencies to incorporate by reference the terms of Section 18370 along j with the designation of employees and the formulation of disclosure categories in the Appendix referred to in Section 18730 to constitute adoption and promulgation of a conflict of interest code within the meaning of Government Code Section 87300; and WHEREAS, the City previously adopted such a Conflict of Interest Code in 1976 by referring to then Section 18730 of the former California Administrative Code, which code has since been amended and incorporated as part of the California Code of Regulations; and
WHEREAS, as part of its biennial review, the City Clerk' s Office has indicated the need to amend certain positions for filling of Statements of Economic Interest.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HEMET FINDS, DETERMINES, ORDERS AND RESOLVES AS FOLLOWS:

1. Resolution No. 2023- 037 and each prior Resolution of the City Council regarding the subject matter herein, is hereby superseded by this Resolution.

2. The City hereby incorporates by reference the terms of Section 18730 of Title 2 of the California Code of Regulations, as that section may from time to time be amended, along with the description of employees and the formulation of disclosure categories in the Appendix referred to in Section 18730, as that Appendix may from time to time be amended, as the City' s Conflict of Interest Code required under Government Code Section 87300.

3. The City hereby adopts the list of designated employees attached hereto as Exhibit A" required to file Statements of Economic Interest, Assuming Office Statements, Annual Statements, and Leaving Office Statements. The list of designated employees shall govern where there is a conflict with the Appendix referred to in Section 18730 of Title 2 of the California Code of Regulations.

Consideration of Appointment to the Hemet Public Library Board of Trustees RECOMMENDED ACTION:

It is respectfully recommended that the City Council:

Appoint candidate Tina Warbington to fill the remaining term of Seat 3 expiring on June 30, 2027, for the Hemet Public Library Board of Trustees.

BACKGROUND:

The Hemet Public Library Board of Trustees was created in accordance with Chapter 5 of Title 1 of the California Education Code, commencing at § 18900. The Board of Trustees consists of five members appointed by the City Council to serve a three-year term. The Board meets on the third Thursday of each month, beginning at 2:00 p.m. unless otherwise noticed.

The term for Seat 3 is scheduled to expire on June 30, 2027. Joan Covi was originally recommended by Council Member Michael Perciful and appointed by the City Council at its Regular Meeting on February 14, 2017. She was subsequently reappointed by the City Council at its Regular Meetings on September 14, 2021, and May 28, 2024.

On October 22, 2025, the City received a letter of resignation from Joan Covi, creating a vacancy for Seat 3. In response, a Notice of Recruitment was scheduled for publication in the Press-Enterprise on October 24, 2025, to begin the recruitment process to fill the unexpired term.

ANALYSIS:

Should the City Council approve the appointment of a candidate to Seat 3, their term would expire on June 30, 2027.

The City Clerk's Office solicited applications through advertisements in the Press Enterprise and on Social Media. The City Clerk's Office has received a total of three qualified applicants:

AN ORDINANCE OF THE CITY OF HEMET, CALIFORNIA,
AMENDING SECTION 2- 164 AND SECTION 2- 165 OF THE HEMET

MUNICIPAL CODE TO MODIFY RESIDENCY REQUIREMENTS FOR

MEMBERS OF BOARDS, COMMISSIONS, AND COMMITTEES OF

THE CITY OF HEMET

RECITALS
Whereas, the City Council of the City of Hemet (" City Council") previously adopted Ordinance No. 1662 adding Sections 2- 164 and 2- 165 to Article 2 of the Hemet Municipal Code thereby establishing certain residency requirements for boards, commissions, and committees of the City of Hemet and permitting not more than two persons who reside in the City' s sphere of influence or who own a business in the City to serve on such boards, commissions, and committees; and,
Whereas, the City Council has reviewed the operation and implementation of these requirements and has determined that these provisions could be construed to permit persons living outside of both the City' s boundaries and the City' s sphere of influence to serve on the City' s boards, commissions, and committees which are in contrary to the intent of the City Council; and,
Whereas, the additions and deletions to Sections 2- 164 and 2- 165 are shown on attachment "A" to this Ordinance for reference.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF HEMET,
CALIFORNIA, ORDAINS AS FOLLOWS:

SECTION 1. Section 2- 164 of the Hemet Municipal Code is hereby amended to read as follows:

Sec. 2- 164. Residency for Quorum
For the purpose of determining the presence of a quorum, all boards, commissions, and committees established under this Code, or as may otherwise be established by the City Council, shall count only one voting member who resides outside of the City' s boundaries, but within the City' s sphere of influence, toward the number of persons constituting a quorum under the requirements RN #4833- 3924- 4032 vl - ICITY COUNCIL ORDINANCE NO. 1732

established for such board, commission, or committee in this code or their respective by-laws.

SECTION 2. Section 2- 165 is hereby added to the Hemet Municipal Code as follows:

Sec. 2- 165. Residency for Membership
a) All voting members of any board, commission or committee established under this code shall, at the time of appointment and continuing thereafter for their term of service, meet one of the following criteria:
1) the individual is a current resident of the City of Hemet who has lived in the City of Hemet for at least one year immediately prior to the individual' s appointment to the board, commission or committee; or
2) the individual is a current resident of the City of Hemet' s sphere of influence who has lived in the City of Hemet or in the City of Hemet' s sphere of influence for at least one year immediately prior to the individual' s appointment to the board, commission or committee.
b) Notwithstanding the provisions of subdivision ( a) of this section, no board, commission, or committee established under this code shall have more than two 2) voting members who are residents of the City of Hemet' s sphere of influence.

SECTION 3. If any part of this Ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining parts of this Ordinance, and the Council hereby declares it would have passed the remainder of this Ordinance if such invalid portion thereof had been deleted.

SECTION 4. This Ordinance shall be introduced at least five ( 5) days prior to the Council meeting at which this Ordinance is to be adopted. The City Clerk is authorized and directed to cause this Ordinance to be published within fifteen ( 15) days after its passage in a newspaper of general circulation and circulated within the City on accordance with Government Code Section 36933( a) or, to cause this Ordinance to be published in the manner required by law using the alternative summary and pasting procedure authorized under Government Code Section 39633( c).

Hemet Public Library Board of Trustees - 3 Year Term
The Library Board consists of five members appointed by the City Council for three year terms. It meets on the 3rd Friday of each month at 10:00 a.m. Responsibilities are statutory and include setting policy on the operation and services of the Library. The Board advises the City Council on the budgetary needs of the Library, its services, and other related matters.

Measure U Citizen Oversight Committee - 2 Year Term
In accordance with Hemet City Ordinance No. 1918, the Measure U Citizen Oversight Committee consists of 7 members appointed by the city council to serve two (2) year terms. The purpose of the committee is to independently review and advise upon the City’s proposed expenditures of Measure U Funds as well as the actual expenditures of Measure U Funds and review of the annual audit conducted of Measure U Funds as required by the Ordinance. The Committee is advisory only and reports its comments directly to the City Council. Eligible community members must reside within the city limits or the sphere of influence or own a business having its primary offices located within the city limits. A majority (4 or more) of the committee members shall be residents of the City of Hemet.

Mobile Home Rent Review Commission - 3 Year Term
Established by Ordinance No. 772, an initiative of the voters of the City of Hemet, this Commission meets by request only and with duties as outlined in the Hemet Municipal Code. It consists of five members appointed by the City Council to 3 year terms. The Commission shall be made up of one mobile home park owner, one mobile home park tenant and three “at large” residents who do not live in mobile home parks.

Planning Commission - 4 Year Term
Created in accordance with the provisions of the State Planning Act, the Commission consists of five members appointed by the City Council to serve four-year terms. The Commission meets on the first and third Tuesdays of the month at 6:00 p.m.

The purpose of proposed Ordinance No. 2077 (Attachment No. 2) is to add language to Chapter 82, Article III, Division 3 of the Hemet Municipal Code prohibiting the use of potable water to irrigate nonfunctional turf in accordance with AB 1572. The amendment also includes a minor correction to Section 82-133(f), changing the reference from “Conservation Stage 3” to “Conservation Stage 6” to maintain consistency with the City's adopted Water Shortage Contingency Plan stages. The ordinance will take effect 30 days after its adoption on June 23, 2026.

BACKGROUND:

The City of Hemet owns and operates a water production and distribution system that provides potable drinking water to customers throughout its service area. The City currently serves more than 9,000 water customer accounts and a population of over 30,000 residents.

California has long been at the forefront of water conservation policy, becoming the first state to adopt urban water-use efficiency targets through the Water Conservation Act of 2009 (SB X7-7, Steinberg).

This legislation required a 20 percent reduction in urban per capita water use by 2020. As California continues to experience prolonged drought conditions, shrinking snowpack, extreme weather events, and increasing water supply challenges, the State has adopted additional long-term water conservation measures.

The City adopted its original Water Conservation Plan Ordinance in 1991 and subsequently amended the ordinance in 2015 through Urgency Ordinance No. 1894. Most recently, the City revised the Water Conservation Ordinance in 2022 to comply with Assembly Bill 1668 (AB 1668) and Senate Bill

606 (SB 606), which established long-term water-use efficiency standards. The 2022 update also established the City's six Water Shortage Contingency Plan stages.

ANALYSIS:

In 2023, the California Legislature adopted Assembly Bill 1572 (AB 1572), authored by Assemblymember Friedman, which prohibits the use of potable water to irrigate non-functional turf located on commercial, industrial, and institutional (CII) properties, including common areas maintained by homeowners associations (HOAs).

AB 1572 requires urban water suppliers to revise applicable regulations, ordinances, or policies by January 1, 2027, and to communicate those requirements to affected customers.

The proposed ordinance amendment adds language to Chapter 82, Article III, Division 3 of the Hemet Municipal Code prohibiting the use of potable water to irrigate non-functional turf in accordance with AB 1572. The amendment also includes a minor correction to Section 82-133(f), changing the reference from “Conservation Stage 3” to “Conservation Stage 6” to maintain consistency with the City's adopted Water Shortage Contingency Plan stages.

DISCUSSION:

Non-functional turf is generally defined as decorative grass that is not used for recreation or other community purposes. Examples include turf located along roadway medians and ornamental landscaping surrounding commercial or institutional properties.

Functional turf areas are exempt from the prohibition and include areas used for recreational purposes, such as sports fields, parks, picnic areas, and cemeteries, as well as landscapes irrigated with non-potable or recycled water supplies. Residential properties are also exempt from the requirements of AB 1572.

The State’s compliance timeline for AB 1572 is as follows:
 January 1, 2027 – State and local government properties  January 1, 2028 – Commercial, industrial, and institutional properties  January 1, 2029 – Homeowners association common areas, mobile home parks, and retirement communities
 January 1, 2031 – Government properties located within disadvantaged communities PREVIOUS COUNCIL ACTION:

OF THE CITY’S MUNICIPAL CODE TO IMPLEMENT

STATE REQUIREMENTS FOR NONFUNCTIONAL TURF

IRRIGATION
WHEREAS, the City of Hemet owns and operates a water production and distribution system that provides potable drinking water to customers throughout its service area, with over 9,000 water customer accounts serving a population over 30,000; and
WHEREAS, California Water Code section 375 authorizes public entities that supply water to adopt and enforce water conservation programs to reduce water use for the purpose of conserving water supplies; and to comply with the California Water Code Division 6 (Conservation, Development, and Utilization of State Water Resources) and to assure an adequate water supply for the community, the City is required to adopt a mandatory water conservation plan; and
WHEREAS, the California Legislature passed AB 1668 (Friedman) and SB 606 (Hertzberg), establishing a new long-term water conservation framework for California; and
WHEREAS, Assembly Bill 1572 (Friedman), codified in part at California Water Code sections 10608.12 and 10608.14, prohibits the use of potable water to irrigate nonfunctional turf on certain commercial, industrial, institutional, public agency, homeowners' association, common interest development, and similar properties on

phased compliance dates established by state law; and
WHEREAS, California Water Code section 10608.14 requires public water systems, by no later than January 1, 2027, to revise their regulations, ordinances, or policies governing water service to include the statutory nonfunctional turf irrigation requirements and to communicate those requirements to customers; and WHEREAS, the City recognizes a need for the revision of the City’s current “Water Conservation Plan,” as set forth in Chapter 82, Article III, Division 3 of the Municipal Code; and,
WHEREAS, revisions to the Water Conservation Ordinance will align the City with other local agencies and their water conservation programs, and will codify the six Water Shortage Contingency Plan Levels previously adopted in the City’s Urban Water Management Plan in 2021; and
WHEREAS, the City last revised the existing Water Conservation Plan in 2022, and this Ordinance is necessary to protect the City's potable water system from actual and, conserve potable water supplies, prevent water waste, and ensure consistency with applicable state law.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HEMET DOES DETERMINE, FIND AND RESOLVE AS FOLLOWS:

SECTION 1. RECITALS. The City Council hereby finds that the foregoing recitals are true and correct and are incorporated herein as findings of the City Council. The recitals are not intended to be codified.

(A) Section 82-132 of the Hemet Municipal Code shall be amended to read as follows:

Sect. 82-132. Definitions.

The following words, terms, and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

AWSDA means annual water supply and demand assessment.

City means the City of Hemet.

CII means commercial, industrial and institutional customers.

Customer means any person or persons, corporation, public or private entity, governmental agency or institution or any other user of water provided by the city.

Functional turf means a ground cover surface of turf located in a recreational use area or community space, , including but not limited to sports fields, picnic areas, and cemeteries. Turf enclosed by fencing or other barriers to permanently preclude human access for recreation or assembly is not functional turf. Areas irrigated with nonpotable water and residential lawns are exempt from any prohibition on irrigation of nonfunctional turf under this division.

Landscape irrigation system means a system with controllers, valves, pipes, hoses, spray heads or sprinkling devices that are operated by hand or through an automated system used to water outdoor landscaping.

Nonfunctional turf means turf that is not functional turf, including decorative grass areas that serve no recreational or functional purpose. Nonfunctional turf includes, but is not limited to, turf located within street rights-of-way, road medians, parking lots, and areas outside businesses or other establishments that are not used for recreation or assembly.

Turf means a ground cover surface of mowed grass, unless a different definition is established by applicable state law.

Water shortage contingency plan stages means the established actions and procedures for managing water supply and demands during water shortages. (B) Section 82-133 of the Hemet Municipal Code shall be amended to read as follows:

Sect. 82-133. Permanent water conservation requirements.

The following water efficiency requirements shall continuously apply to all existing customers regardless of city or statewide drought status:
(1) Hosing down driveways and other hard surfaces, is prohibited except for health or sanitary reasons and then only by use of a hand-held bucket or similar container, a hand-held hose equipped with a positive water shut-off device or a low-volume, high-pressure cleaning machine equipped to recover and recycle any water used. (2) No customer of the water division shall permit water to leak or runoff from any property where conditions may be corrected or reasonably modified to prevent such leakage or runoff.
(3) Property owners are only allowed to irrigate landscape between the hours of 6:00 p.m. and 6:00 a.m. This provision does not apply when:
a. Manually watering landscape with a hose containing a positive shut-off device attached.
b. During the establishment period for new landscape.
c. For very short periods of time for the purpose of adjusting or repairing an irrigation system.
(4) The watering or irrigating of any lawn, landscape or other vegetated area with potable water using a hose watering device that is not continuously attended is prohibited.
(5) Use of decorative fountains, unless they are equipped with a recirculating system, are prohibited.
(6) Where potable water is used for commercial cooling systems, such as chillers,

cooling towers, and building air conditioning systems, the water must be recirculated to the maximum extent feasible.
(7) Water shall not be allowed to run while washing vehicles. A hand-held bucket or similar container and/or a hand-held hose equipped with a positive water shut-off device shall be allowed.
(8) Watering or irrigating any lawn, landscape or other vegetated area during rain events or within 48 hours after a rain event in which 0.5-inches or greater accumulated rain has fallen in the previous 24-hour period, is prohibited. (9) Operators of hotels and motels shall post notices in each guest room urging guests to conserve water, and shall provide guests with the option of choosing not to have towels and linens laundered daily. Notice of this option shall be displayed in each guestroom using clear and easily understood language. The city shall provide appropriate language upon request.
(10) Restaurants or other public places where food is served shall only serve water to their customers upon request.
(11) Prohibition on potable water irrigation of nonfunctional turf — Purpose. This item implements California Water Code sections 10608.12 and 10608.14, as may be amended, and any implementing regulations, orders, forms, or guidance issued by the State Water Resources Control Board.
(a) Prohibition. No person shall use or permit the use of potable water to irrigate nonfunctional turf on properties subject to California Water Code section 10608.14, except to the extent expressly allowed by state law. (b) Compliance dates. The prohibition in subsection (a) shall apply on and after the following dates, or such later date as may be authorized by the State Water Resources Control Board pursuant to state law: (i) January 1, 2027, for all properties owned by local governments, local or regional public agencies, and public water systems, except as provided in subsection (b)(iv); (ii) January 1, 2028, for all other institutional properties

and all commercial and industrial properties, other than cemeteries; (iii) January 1, 2029, for all common areas of properties of homeowners' associations, common interest developments, and community service organizations or similar entities; and (iv) January 1, 2031, or the date upon which a state funding source is made available to fund conversion of nonfunctional turf to climate-appropriate landscapes, whichever is later, for properties owned by local governments, local public agencies, and public water systems in a disadvantaged community.
(c) Exceptions. The prohibition in this item shall not apply:
(i) to the use of non-potable water, (including recycled or reclaimed water, which is not currently available within the city's service area but is retained here for future applicability should such supply become lawfully available), where lawfully available and used in accordance with applicable requirements;
(ii) to the extent necessary to ensure the health of trees and other perennial non-turf plantings;
(iii) to the extent necessary to address an immediate health and safety need;
(iv) to cemeteries, to the extent exempted by California Water Code section 10608.14; or
(v) to any use expressly exempted or deferred by the State Water Resources Control Board or other applicable state law.
(d) Customer communication and implementation. The city manager or designee shall communicate the requirements of this item to water customers on or before January 1, 2027, and may prepare forms, notices, guidance, procedures, or administrative rules to implement this item. (e) Certification and documentation. Any person subject to state certification, reporting, or compliance documentation requirements under California

Water Code section 10608.14 or implementing state regulations shall timely submit required certifications to the State Water Resources Control Board and, upon request, provide copies or evidence of compliance to the city manager or designee.
(f) Enforcement. A violation of this item may be enforced pursuant to this division, chapter I, article II of this Code, any applicable water service rules or regulations, and any other remedy available at law or in equity. Each day that a violation exists or continues shall be treated as a separate violation.
(g) No limitation on more restrictive measures. Nothing in this item limits the city's authority to impose more restrictive water conservation measures during a declared water shortage, water shortage emergency, or other lawful conservation program.
(C) Section 82-138 of the Hemet Municipal Code shall be amended to read as follows:
(a) General variance criteria. No relief shall be granted unless the customer demonstrates maximum practical water reduction, including, but not limited to, the installation of low flow showerheads, toilets, water conserving devices on all faucets, installation of irrigation controllers with rain shutoff features, and the repair of all leaks. All requests for variances shall be submitted in writing to the city manager or their designee. Upon review, the city water/wastewater superintendent or his designated representative may require a water audit to verify conditions.
(b) Residential variance criteria. A variance may be granted to provide relief to a residential customer that reflects changes in circumstances, such as:
(1) Irrigation of new plantings, when their installation occurred prior to adoption of water use restrictions.
(2) Medical conditions as certified by a physician or other medical

professional.
(3) Abatement of health or safety hazards.
(4) Change of the occupancy or number of occupants of the residence. (5) Other circumstances submitted in writing by the customer, and as may be warranted based on the determination of the City Manager, Public Works Director, or Water/Wastewater Superintendent.
(c) Commercial, industrial, institutional (CII) variance criteria. A variance may be granted to provide relief to a CII customer to reflect changes in circumstances which have occurred, such as:
(1) Irrigation of new plantings, when their installation occurred prior to adoption of mandatory water use restrictions.
(2) Increased in the number of employees.
(3) Production of new products which require an increase in process water. (4) Increase in business activities.
(5) Abatement of health or safety hazards.
(6) Other information submitted in writing by the customer, and as may be warranted based on the determination of the city manager, public works director, or water/wastewater superintendent.
(D) Section 82-144 subsection (f) of the Hemet Municipal Code shall be amended to read as follows:
(f) Shortage level 6—Mandatory compliance—Emergency water shortage. The city council may, by resolution, declare a conservation stage 63 upon recommendation by the city manager based on water supply and delivery projections by the water/wastewater superintendent that an overall system-wide reduction of over 50 percent is necessary, taking into consideration projections and estimates made by the public works superintendent pertaining to the city's water supply. In order to achieve an overall system-wide reduction of over 50 percent, the following activities shall be enacted:

(1) Any activities prohibited during lower shortage levels. (2) All landscape watering and non-essential outdoor water use for all customers.

SECTION 3. CEQA FINDING. The City Council finds that adoption of this Ordinance is exempt from the California Environmental Quality Act pursuant to State CEQA Guidelines section 15061(b)(3), because it can be seen with certainty that the Ordinance will not have a significant effect on the environment. The Ordinance is also exempt pursuant to State CEQA Guidelines sections 15307 and 15308 because it consists of regulatory requirements and procedures to assure the maintenance, restoration, enhancement, and protection of natural resources and the environment, including conservation of potable water supplies and protection of drinking water quality. The City Clerk is directed to file a notice of exemption if required or deemed appropriate.

SECTION 4. SEVERABILITY. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are severable.

The City Council hereby declares that it would have adopted this Ordinance irrespective of the invalidity of any particular portion thereof.

SECTION 5. NO CONFLICT WITH STATE OR FEDERAL LAW. This Ordinance is intended to supplement and implement applicable state and federal law. In the event of a conflict between this Ordinance and any mandatory requirement of state or federal law, the mandatory state or federal requirement shall control. References to state statutes, regulations, handbooks, standards, or policies include any amendments, replacements, or successor provisions.

SECTION 6. EFFECTIVE DATE. This Ordinance shall take effect thirty (30) days after its adoption. The City Clerk is directed to certify to the adoption of this Ordinance and to publish or post this Ordinance as required by law.

SECTION 7. NOTICE. The City Clerk is authorized and directed to cause this Ordinance to be published within fifteen (15) days after its passage in a newspaper of general circulation and circulated within the City in accordance with Government Code Section 36933(a) or, to cause this Ordinance to be published in the manner required by law using the alternative summary and posting procedure authorized under Government Code Section 39633(c).

Sec. 82-127. Declaration of policy.
(a) Water Code § 350 et seq. permits public entities which supply water at retail to adopt and enforce a water conservation program to reduce the quantity of water used by the people therein for the purpose of conserving the water supply. The city council hereby establishes a comprehensive water conservation plan pursuant to the state Water Code to conserve water supplies and to avoid or minimize the effects of any future shortage.
(b) Water Code § 351 provides as follows: "Excepting in event of a breakage or failure of a dam, pump, pipe line or conduit causing an immediate emergency, the declaration shall be made only after a public hearing at which consumers of such water supply shall have an opportunity to be heard to protest against the declaration and to present their respective needs to said governing board." (c) No customer of the city shall knowingly make, cause, use or permit the use of water supplied by the city for residential, commercial, industrial, agricultural, governmental or any other purpose in a manner contrary to any provisions of this division. Any of the restrictions described in this division shall take effect by adoption of an implementing resolution by the city council as provided in this division. (d) It is declared that the city shall, for the general public health, safety and welfare, to comply with Water Code div. 6 (conservation, development, and utilization of state water resources) and to assure an adequate water supply for the community, requires a mandatory water conservation plan to be authorized. The city finds actions taken pursuant to this division to be exempt from the California Environmental Quality Act (CEQA) as specific actions necessary to prevent or mitigate an emergency pursuant to Public Resources Code § 15269(c).

This division shall be effective upon its adoption. Sec. 82-130.5. Purpose.

This water conservation ordinance is to minimize the effects of a water shortage to the water customers of the city, to comply with the California Water Code, and to significantly reduce the delivery and consumption of water, thereby extending the period that water may be supplied or delivered to the distribution system of the city. Sec. 82-131. Implementation of division.

The city manager, public works director, water/wastewater superintendent or other designated city representative is hereby authorized and directed to implement the provisions of this division as approved by the city council.

CII means commercial, industrial and institutional customers.

Customer means any person or persons, corporation, public or private entity, governmental agency or institution or any other user of water provided by the city.

Turf means a ground cover surface of mowed grass, unless a different definition is established by applicable state law.

Sec. 82-134. Obligation to fix leaks, breaks, or malfunctions.

Excessive waste, loss or escape of water through breaks, leaks or other malfunctions in the water user's plumbing, irrigation, or distribution system shall be repaired in a timely manner. (1) Minor exterior leaks shall be repaired within seven business days of the property owner receiving written notice of the leak by the city.
(2) All substantial exterior leaks as identified by the city's water division personnel shall be repaired within 48 hours of written notification from the city, unless other arrangements are made with the city's water division in writing.
(3) The city may shut off the water supply to a property when repair of exterior leaks have not been timely made after prior written notice from the city as set forth in subsection (2) above, and are causing the continual and excessive waste of water to exist and discharges from the property. Sec. 82-135. Requirements for new landscape.

All landscaping and irrigation shall comply with chapter 90, zoning, article XLVIII, landscaping and irrigation, of this Code.

Sec. 82-136. Enforcement of water wasting.

Sec. 82-137. Appeals.

Right to an administrative hearing and waiver of advance deposit shall be in accordance with chapter I, article II, section 1-27 of this Code.

(2) Increased in the number of employees.
(3) Production of new products which require an increase in process water. (4) Increase in business activities.
(5) Abatement of health or safety hazards.
(6) Other information submitted in writing by the customer, and as may be warranted based on the determination of the city manager, public works director, or water/wastewater superintendent. (Ord. No. 1997, § 5, 4-12-22)
Sec. 82-139. Water shortage.

A water shortage may exist based upon the occurrence of one or more of the following conditions:
(1) A major failure of any or all supply, storage or distribution facilities of the city water and reservoir system that decreases the city's ability to meet customer maximum daily water demand through its own sources or through interconnects with other water agencies. (2) A water supply shortage due to the inability of the city to meet acceptable water quality standards mandated by the state health department.
(3) A general water supply shortage due to increased demand or limited supplies from either the city's own sources or other regional sources.
(4) A significant decline in the underground aquifer which the city relies upon and as measured by the height of water in the city's wells.
(5) A complete long-term power failure of all electrical connections from the electrical provider in which the city may not be able to replace through backup generators or other means. (Ord. No. 1997, § 5, 4-12-22)
Sec. 82-140. Emergency water shortage response.
(a) The city manager may invoke emergency water shortage restrictions when a major failure occurs, whether temporary or permanent, in the supply, the water quality, the distribution lines, or the reservoirs of the city's water system or;
(b) When the governor and state water board find and declares that an emergency exists due to severe drought conditions and that adoption of proposed emergency regulations is necessary to address the emergency. (Ord. No. 1997, § 5, 4-12-22)

Sec. 82-141. Water shortage contingency.

This section establishes six water shortage contingency plan levels to be implemented in the case of an emergency water shortage. During times of a water shortage and based on the severity of the water shortage, the city council shall direct the city manager, the public works director, the water/wastewater superintendent or a designated city representative to implement the provisions of this division.

To provide a consistent regional and statewide approach for conveying the relative severity of water supply shortage conditions, the 2018 Water Conservation Legislation mandates that water suppliers plan for six standard water shortage contingency plan levels that correspond to progressive reductions of up to 10, 20, 30, 40, 50 percent, and greater than 50 percent from the normal reliability condition. Each shortage condition should correspond to additional actions water suppliers would implement to meet the severity of the impending shortages. For each declared water supply shortage level, customers will be required to reduce consumption by the percentage specified in the corresponding water shortage contingency plan level listed in Table 1, below. (1) Water shortage contingency plan levels shall be implemented and shall continue as necessary, with additional mandatory water use restrictions enacted if the target water savings are not achieved within 30 calendar days of the declared water shortage.
(2) For each of the state's standard shortage levels (also called "stages"), Table 1 summarizes the water shortage range (i.e. percent shortage from normal supplies) and a brief narrative description of the corresponding water shortage condition. These water shortage stages apply to both foreseeable and unforeseeable water supply shortage conditions. Table 1 presents the city's reorganized stages, which align with the state's current standard stages.

Sec. 82-142. Shortage response actions and effectiveness.

The city will track progress toward water use reduction goals through a comparative analysis of total monthly water production volumes between comparable months such as July of the current year with July of the previous year. The analysis will compare the drought month production for a specific month with the previous non-drought month production in the previous year to obtain a percent reduction. The city will increase or decrease its public outreach efforts based on observed usage reduction. The demand reduction actions discussed in section 82-144 may be considered as tools that allow the city to respond to water shortage conditions. The city will adjust response actions to demands and available water.

Sec. 82-143. Demand reduction.
(a) The city may request that its customers reduce their water demands in response to any water shortage stage through public outreach. During water shortage conditions, the city plans to reduce demand by implementing the actions in section 82-144. Demand reduction actions are organized by the triggering water shortage level. The city will continue to use these actions in the lower stages unless otherwise noted. (b) If the residential customer's usage amount reaches an amount equal to or below the state standard for residential indoor water use as adopted by the state legislature (through AB 1668, Friedman-2018.), then no further water conservation is required for residential customers. Sec. 82-144. Demand reduction actions.
(a) Shortage level 1—Voluntary conservation. In order to achieve an overall system-wide reduction goal of up to ten percent, all potable water customers of the city are requested to:
(1) Protect and preserve water supply and eliminate wasteful water use. (b) Shortage level 2—Mandatory compliance water shortage watch. The city council may, by resolution, declare a shortage level 2 upon recommendation by the city manager based on water supply and delivery projections by the water/wastewater superintendent that an overall system-wide reduction of up to 20 percent is necessary, taking into consideration projections and estimates made by the water/wastewater

superintendent pertaining to the city's water supply. In order to achieve an overall system-wide reduction of up to 20 percent, the following prohibitions shall be enacted:
(1) Protect and preserve water supply and eliminate wasteful water use. (2) Limit outdoor irrigation of ornamental landscapes or turf with potable water by the persons it serves to no more than once every other day. Even numbered property addresses may only water on even dates of the month and odd numbered property addresses may only water on odd dates of the month. (3) Any use of water from a fire hydrant except for fighting fires or essential construction needs and system flushing, as determined by the city's water division, shall be prohibited. (c) Shortage level 3—Mandatory compliance—Water shortage warning. The city council may, by resolution, declare a shortage level 3 upon recommendation by the city manager based on water supply and delivery projections by the water/wastewater superintendent that an overall system-wide reduction of 30 percent is necessary, taking into consideration projections and estimates made by the water/wastewater superintendent pertaining to the city's water supply. In order to achieve an overall system-wide reduction of up to 30 percent, the following prohibitions shall be enacted:
(1) Any activities enacted during lower shortage levels. (2) Limit outdoor irrigation of ornamental landscapes or turf with potable water by the persons it serves to no more than two times per calendar week. Even numbered property addresses may water on Mondays and Thursdays. Odd numbered property addresses may water on Tuesdays and Fridays. (3) Planting of any new landscaping, except for drought resistant landscaping shall be curtailed until all shortage levels have been rescinded.
(d) Shortage level 4—Mandatory compliance—Significant water shortage. The city council may, by resolution, declare a shortage level 4 upon recommendation by the city manager based on water supply and delivery projections by the water/wastewater superintendent that an overall system-wide reduction of 40 percent is necessary, taking into consideration projections and estimates made by the water/wastewater superintendent pertaining to the city's water supply. In order to achieve an overall system-wide reduction of 40 percent, the following prohibitions shall be enacted:
(1) Any activities enacted during lower shortage levels. (2) The refilling or initial filling of any swimming pool is prohibited, unless required for public health and safety purposes.
(3) Watering of any residential, commercial, industrial area lawn with potable water, at any time day or night is prohibited. An exception will be made to permit drip irrigation for established perennial plants, home and commercial orchards and trees using automatic time-controlled water application. (4) "Will serve" letters will not automatically be issued by the city. Projects may/or may not be approved individually based upon overall impact to the city water supply requirements. (5) Car washing is prohibited, unless using a commercial carwash that recycles water. (e) Shortage level 5—Mandatory compliance—Critical water shortage. The city council may, by resolution, declare a conservation stage 5 upon recommendation by the city manager based on water supply and delivery projections by the water/wastewater superintendent that an overall system-wide reduction of up to 50 percent is necessary, taking into consideration projections and estimates made by the water/wastewater superintendent pertaining to the city's water supply. In order to achieve an overall system-wide reduction of up to 50 percent, the following prohibitions shall be enacted:
(1) Any activities prohibited during lower shortage levels.

(2) The use of potable water for construction activities and uses such as dust suppression or process waters, however use of recycled water for construction activities shall be exempt from this restriction. (3) The filling of swimming pools, wading pools, spas, ornamental ponds, and fountains. (f) Shortage level 6—Mandatory compliance—Emergency water shortage. The city council may, by resolution, declare a conservation stage 63 upon recommendation by the city manager based on water supply and delivery projections by the water/wastewater superintendent that an overall system-wide reduction of over 50 percent is necessary, taking into consideration projections and estimates made by the public works superintendent pertaining to the city's water supply. In order to achieve an overall system-wide reduction of over 50 percent, the following activities shall be enacted:
(1) Any activities prohibited during lower shortage levels. (2) All landscape watering and non-essential outdoor water use for all customers. (g) The city council shall have the authority to prohibit other activities and water uses upon the recommendation of the city manager, public works director or water/wastewater superintendent where that such additional measures are necessary in order to achieve an overall system-wide reduction regarding each stage reduction of water usage.

Sec. 82-145. Restoration of water service.

Where water service is disconnected or a flow restriction device has been installed, as authorized in this division, normal water service shall be restored upon correction of the condition or activity and payment of the reconnection charge and penalties. The reconnection charge shall include all costs associated with disconnecting and reconnecting the service or installing and removing the flow restricting device. Sec. 82-146. Maintenance of public health and safety.

Nothing contained in this division shall be construed to require the city to curtail the supply of water to any customer when, in the discretion of the city water superintendent, such water is required by that customer to maintain an adequate level of public health and safety. Sec. 82-147. Rights of city; disposition of fees.

FOR FORENSIC TOXICOLOGY SERVICES, INCREASING THE ANNUAL NOT-TO-EXCEED COMPENSATION AMOUNT FROM $60,000 TO $75,000 PER FISCAL YEAR BACKGROUND:

The City of Hemet Police Department utilizes forensic toxicology testing services to support criminal investigations, including driving under the influence (DUI), narcotics-related offenses, and other cases where toxicological evidence is necessary for prosecution. These services include the identification and quantitative analysis of drugs and alcohol from blood, urine, and evidence specimens.

On September 23, 2025, the City Council approved a Professional Services Agreement with Bio-Tox Laboratories, Inc. as a sole-source provider of forensic toxicology services in an amount not to exceed $60,000 per fiscal year through June 30, 2028. Bio-Tox was selected due to its specialized qualifications, including Title 17 certification for blood alcohol testing and accreditation by the American Board of Forensic Toxicology (ABFT), ensuring reliable and court-defensible results.

ANALYSIS:

The proposed First Amendment to Professional Services Agreement No. 2026-019 increases the annual not-to-exceed compensation amount for forensic toxicology services from $60,000 to $75,000 per fiscal year. No other terms or conditions of the agreement are modified.

Bio-Tox Laboratories remains uniquely qualified to provide these services due to its Title 17 certification for blood alcohol testing, accreditation by the American Board of Forensic Toxicology, and an established history of providing reliable, court-defensible toxicology testing services to the City of Hemet. Approval of the amendment will ensure continuity of service and maintain the Department's ability to obtain timely forensic toxicology results necessary for criminal investigations and prosecutions.

DISCUSSION:

The Police Department has experienced a significant increase in the number of cases requiring forensic toxicology testing since the agreement was approved in September 2025. Increased staffing levels within the Traffic Unit has resulted in enhanced DUI enforcement efforts and a corresponding increase in blood-alcohol and drug-related toxicology submissions. Additionally, the AERO Team now operates seven days per week, resulting in increased proactive enforcement activity and a corresponding increase in arrests involving individuals suspected of being under the influence of controlled substances.

Based on current expenditures and projected case volume, the Department anticipates exceeding the existing annual not-to-exceed amount of $60,000 by approximately $7,000 during the current fiscal year. The proposed amendment is being brought forward proactively to ensure adequate funding authority is available to meet anticipated testing demands and avoid any interruption in critical forensic toxicology services.

The increase in toxicology testing requests is directly attributable to the Department's proactive enforcement efforts aimed at reducing impaired driving and addressing public intoxication and drugrelated offenses. Maintaining adequate funding for these services ensures that the evidence necessary for successful prosecution remains available and supports the City's ongoing commitment to public safety.

PREVIOUS COUNCIL ACTION:

September 23, 2025 – City Council approved Professional Services Agreement No. 2026-019 with Bio-Tox Laboratories, Inc. for forensic toxicology services as a sole-source provider in an amount not to exceed $60,000 per fiscal year through June 30, 2028.

FISCAL IMPACT:

Funding for the increased contract amount is available within the Police Department's approved FY2026-27 budget under Professional/Specialized Services Account No. 110.09.30.

The proposed amendment increases the annual not-to-exceed compensation amount by $15,000, from $60,000 to $75,000 per fiscal year. Based on current expenditures and projected case volume, the Department anticipates exceeding the existing contract limit by approximately $7,000 during the current fiscal year. Approval of this amendment will provide sufficient funding authority to meet anticipated forensic toxicology testing needs through the remainder of the fiscal year and for future fiscal years covered by the agreement.

ALTERNATIVE(S):

1. Approve the Resolution Authorizing the First Amendment (Recommended) Approval of the proposed amendment will increase the annual not-to-exceed compensation amount from $60,000 to $75,000 and ensure the continued availability of forensic toxicology testing services necessary to support criminal investigations and prosecutions.

2. Deny the Resolution
Denial of the amendment would leave the existing annual not-to-exceed amount at $60,000. Based on current expenditure trends, the Department anticipates exceeding that amount during the current fiscal year, which could result in delays or interruptions in forensic toxicology testing services and negatively impact criminal investigations and prosecutions.

3. Provide Alternate Direction
The City Council may provide alternate direction to the City Manager regarding forensic toxicology services or funding levels. Any alternative approach may require additional staff analysis and could result in delays in securing the necessary testing services.

WHEREAS, the current annual not-to-exceed compensation amount is projected to be insufficient to meet the Department's forensic toxicology testing needs; and WHEREAS, the proposed First Amendment to Professional Services Agreement No. 2026-019 increases the annual not-to-exceed compensation amount from Sixty Thousand Dollars ($60,000) to Seventy-Five Thousand Dollars ($75,000) per fiscal year while leaving all other terms and conditions of the Agreement unchanged; and WHEREAS, sufficient funds are available within the Police Department's approved budget to support the increased compensation amount.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HEMET FINDS, DETERMINES, ORDERS AND RESOLVES AS FOLLOWS:

SECTION 1. The recitals set forth above are true and correct and are incorporated herein by this reference.

SECTION 2. The City Council finds that approval of the First Amendment to Professional Services Agreement No. 2026-019 with Bio-Tox Laboratories, Inc. is in the best interests of the City and necessary to ensure the continued availability of forensic toxicology testing services.

SECTION 3. The City Council hereby authorizes the City Manager, or designee, to execute the First Amendment to Professional Services Agreement No. 2026-019 with Bio-Tox Laboratories, Inc., substantially in the form attached hereto, increasing the annual not-to-exceed compensation amount from Sixty Thousand Dollars ($60,000) to Seventy-Five Thousand Dollars ($75,000) per fiscal year.

This First Amendment to the Professional Services Agreement for the purpose of Forensic Toxicology Services is made and entered into as of this 24th day of June, 2026, by and between the City of Hemet (“City”), a California municipal corporation and Bio-Tox Laboratories, Inc., a California corporation (“Consultant”). City and Consultant are sometimes hereinafter referred to as “Party” and hereinafter collectively referred to as the “Parties.”

RECITALS
A. City and Consultant entered into an agreement entitled “Professional Services Agreement” dated September 24, 2025 (“Agreement”) for the purpose of retaining services of Consultant to provide Forensic Toxicology Services.

B. Pursuant to Section 27 of the Agreement, the Parties desire to amend the Agreement to increase the not to exceed compensation.

C. Section 4(a) of the Agreement provides that the Compensation shall not exceed Sixty Thousand Dollars ($60,000.00) per City fiscal year.

D. This First Amendment amends Section 4(a) to provide that the Compensation shall not exceed Seventy-Five Thousand Dollars ($75,000.00) per City fiscal year.

OPERATIVE PROVISIONS
NOW, THEREFORE, in consideration of the promises made and recited herein, the Parties do hereby enter into this Amendment which modifies and amends the Agreement as follows:

1. AMENDMENT. The Agreement is hereby modified and amended as follows:

1.1 [COMPENSATION]. Section 4(a) of the Agreement is hereby amended to increase the Not to Exceed Amount to Seventy-Five Thousand Dollars ($75,000.00) per City fiscal year.

2. MANDATORY INVOICE INFORMATION/NOTICES.

Consultant shall notify the City in writing whenever it has reason to believe that the costs the Consultant expects to incur under this Agreement in the following sixty (60) days, when added to all costs previously incurred, will exceed eighty percent (80%) of the Not to Exceed Amount specified herein. As part of the notification, the Consultant shall provide the City with a revised estimate of the total cost of performing this Agreement.

On invoices submitted to the City, Consultant shall identify at the top of the first page, the Agreement’s not to exceed amount, the total amount billed to date, the services

rendered during the billing period, and the amount due for the statement invoice for which reimbursement is sought in the statement invoice.

3. REMAINDER UNCHANGED. Except as specifically modified and amended in this Amendment, the Agreement remains in full force and effect and binding upon the Parties.

4. INTEGRATION. This Amendment consists of pages 1 through 3, inclusive, which constitute the entire understanding and agreement of the Parties and supersedes all negotiations or previous agreements, including written or verbal communications between the Parties with respect to all or any part of the transaction discussed in this Amendment.

5. SEVERABILITY. If any portion of this Amendment is declared invalid, illegal or otherwise unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

6. EFFECTIVE DATE. This Amendment shall not become effective until the date it has been executed by the appropriate authorities of the City and Consultant.

7. APPLICABLE LAW. The laws of the State of California shall govern the interpretation and enforcement of this Amendment.

8. REFERENCES. All references to the Agreement include all their respective terms and provisions. All defined terms utilized in this Amendment have the same meaning as provided in the Agreement, unless expressly stated to the contrary in this Amendment. [SIGNATURE PAGE FOLLOWS]

THE AGREEMENT
BACKGROUND:

The South Coast Air Quality Management District (SCAQMD) has requested the use of a small portion of the City-owned Park Hill Tank Site (APN 438-270-006), located at approximately 897 Park Avenue in the City of San Jacinto, for the temporary installation and operation of air quality monitoring equipment. Although the property is physically located within the City of San Jacinto, it is owned and operated by the City of Hemet as part of its municipal water system infrastructure.

In response to City Council interest in expanding air quality monitoring opportunities within the Hemet/San Jacinto Valley, staff coordinated with SCAQMD to identify potential locations that could support temporary and potentially permanent monitoring activities. Staff evaluated several City-owned properties and identified multiple candidate sites that generally met SCAQMD's monitoring criteria.

SCAQMD staff subsequently conducted field evaluations of the proposed locations to assess site suitability.

Following the site evaluations, the Park Hill Tank Site was identified as the preferred location for temporary deployment of monitoring equipment. The facility provides a secure, fenced environment

with controlled access, an existing unused concrete pad suitable for equipment placement, and available electrical service capable of supporting the monitoring equipment. The site also offers favorable conditions for air quality monitoring, including adequate separation from potential obstructions and localized emission sources.

The proposed monitoring period is anticipated to last approximately nine (9) to twelve (12) months and is intended to evaluate whether the location satisfies SCAQMD's technical requirements for a potential future permanent air quality monitoring station. Air monitoring stations support public access to air quality information, regulatory compliance activities, emissions studies, and air pollution research.

DISCUSSION:

Under the proposed License Agreement, SCAQMD will install, operate, maintain, and ultimately remove temporary air quality monitoring equipment on a designated portion of the Park Hill Tank Site.

The equipment will be used to collect air quality and meteorological data and may include ozone sensors, particulate matter (PM2.5 and PM10) monitors, wind speed and direction instruments, ambient weather sensors, and a small temperature-controlled enclosure.

Installation will be limited to placement on an existing concrete pad and will not require grading, excavation, drilling, or permanent modifications to City property. The monitoring equipment is expected to have minimal operational impacts and will not interfere with the City's water production, storage, treatment, distribution facilities, routine maintenance activities, or staff access to the site.

Power will be supplied through an existing 110–120 volt electrical outlet. The equipment's estimated electrical demand is approximately 206 watts and 1.9 amps, which is considered minimal and incidental to normal facility operations.

Key terms of the License Agreement include:
 No Cost to the City – SCAQMD will be responsible for all costs associated with installation, operation, maintenance, insurance, and removal of the equipment.  Temporary and Limited Use – The agreement grants a temporary, non-exclusive right of entry solely for air quality monitoring purposes.
 Termination Flexibility – The City may terminate the agreement without cause upon seven (7) days written notice, or immediately if safety concerns or operational conflicts arise.  No Property Interest – The agreement is a revocable license and does not convey any ownership or real property interest.
 Restoration Requirement – SCAQMD must remove all equipment and restore the site to its original condition upon completion of the monitoring period.  Insurance and Indemnification – SCAQMD must maintain required insurance coverage and indemnify the City against claims arising from its use of the property.

At the conclusion of the evaluation period, SCAQMD will determine whether the site meets its longterm monitoring objectives. Should SCAQMD wish to pursue a permanent monitoring station at this location, staff would return to the City Council with a future agreement for consideration.

The City will provide access to an existing electrical outlet at the facility to support the equipment's estimated power demand of approximately 206 watts and 1.9 amps. This electrical usage is considered incidental and can be accommodated within the existing operating budget.

The City Council of the City of Hemet, California (hereafter referred to as the “City Council”) does resolve as follows:

Hill Tank Site was identified as a suitable location for temporary monitoring activities; and
WHEREAS, the proposed License Agreement provides SCAQMD a temporary, non-exclusive right of entry for a period of up to twelve (12) months, does not convey any real property interest, and requires SCAQMD to remove all equipment and restore the site upon completion of the monitoring period; and
WHEREAS, the proposed License Agreement requires SCAQMD to maintain insurance coverage and indemnify the City against liabilities arising from its use of the property; and
WHEREAS, approval of the License Agreement will facilitate the evaluation of a potential air quality monitoring location within the Hemet/San Jacinto Valley at no significant cost to the City.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HEMET FINDS, DETERMINES, ORDERS, AND RESOLVES AS FOLLOWS:

EQUIPMENT
This License Agreement (“Agreement”) is entered into this ___ day of __________, 2026, by and between the City of Hemet, a California municipal corporation (“CITY”), and the South Coast Air Quality Management District (SCAQMD) (“LICENSEE”) (collectively, “PARTIES”), and shall become effective upon execution by the CITY.

RECITALS
WHEREAS, CITY owns certain real property identified as Assessor’s Parcel Number 438-270-006, commonly referred to as the Park Hill Tank Site, located at approximately

33.755559, -116.945537 (~897 Park Ave, San Jacinto, CA 92583) (“Property”); and WHEREAS, LICENSEE desires to install and operate temporary air quality monitoring equipment for data collection and site evaluation purposes; and WHEREAS, CITY is willing to permit LICENSEE to access and use a portion of the Property for such limited purposes under the terms and conditions set forth herein.

NOW THEREFORE, in consideration of the mutual covenants herein contained, the receipt and sufficiency of which is hereby acknowledged, the PARTIES hereto agree as follows:

1. Right of Entry. CITY hereby grants to LICENSEE and its employees, officers, agents, and contractors (collectively, “LICENSEE PARTIES”) a temporary, non-exclusive right of entry (“Right of Entry”) to access and use a designated portion of the Property (“Access Area”) for the purposes described herein, subject to all existing encumbrances and conditions affecting the Property.

2. Purpose. The Right of Entry granted herein is limited to the installation, operation, maintenance, and removal of temporary air quality monitoring equipment, including but not limited to ozone sensors, particulate matter (PM2.5/PM10) sensors, meteorological instruments, and a small temperature-controlled enclosure (collectively, “Equipment”).

3. Term. The term of this Agreement (“Term”) shall commence upon full execution and continue for a period of up to twelve (12) months (anticipated to be approximately nine (9) to twelve (12) months), unless earlier terminated as provided herein.

CITY may terminate this Agreement without cause upon seven (7) days written notice, or immediately for safety concerns or interference with operations.

4. Terms and Conditions. The Right of Entry is given subject to the following terms and conditions:

a. Compensation. No fee shall be charged for use of the Property. LICENSEE shall be responsible for all costs associated with its use and activities on the Property. b. Compliance with Laws. LICENSEE PARTIES shall obtain and maintain all necessary permits and comply with all applicable laws, regulations, and agency requirements. No entry shall occur until CITY has approved a schedule of access and a list of authorized personnel.
c. Utilities. Subject to CITY approval, LICENSEE may utilize an existing 110– 120V electrical outlet at the Property to power Equipment, with an estimated maximum load of approximately 206 watts and 1.9 amps. Such use is intended to be incidental and minimal. LICENSEE shall ensure all Equipment is compatible and shall not overload, alter, or damage CITY infrastructure. No generators or additional electrical installations shall be permitted without prior written approval by CITY. CITY makes no representation or warranty regarding the availability or reliability of electrical service and shall not be responsible for any interruption or disruption of power. LICENSEE shall be solely responsible for any damage to CITY electrical infrastructure caused by its Equipment. d. Installation and Use. Installation shall be limited to minor, non-invasive placement of Equipment. No permanent alterations, grading, drilling, or structural modifications to the Property shall occur without prior written approval from CITY.
e. As-Is Condition and Assumption of Risk. LICENSEE PARTIES accept the Property in its current “as-is” condition and assume all risks associated with its use.
f. Release and Waiver. To the fullest extent permitted by law, LICENSEE waives and releases CITY from any and all claims arising from LICENSEE’s use of the Property, except those caused by CITY’s sole active negligence or willful misconduct.
g. Indemnification. To the fullest extent permitted by law, LICENSEE shall indemnify, defend, and hold harmless CITY and its officers, employees, and agents from and against any and all claims arising out of or related to LICENSEE’s use of the Property.
h. Insurance. LICENSEE shall maintain insurance in accordance with Exhibit “B” attached hereto.

i. No Property Interest. This Agreement constitutes a revocable license only and does not convey any real property interest.
j. Restoration of Property. Upon termination, LICENSEE shall remove all Equipment and restore the Property to its original condition, reasonable wear and tear excepted, subject to CITY inspection and approval. k. City Access. CITY retains full access and control of the Property at all times. l. Equipment and Data. All Equipment installed by LICENSEE shall remain the sole property of LICENSEE. CITY shall have no responsibility for the operation, maintenance, or security of the Equipment. Any data collected by the Equipment shall be the responsibility of LICENSEE; however, LICENSEE may share such data with CITY upon request. Equipment could include, but is not limited to, the following:

5. Termination. CITY may terminate this Agreement at any time upon seven (7) days written notice. Upon termination, LICENSEE shall promptly vacate the Property and complete all restoration obligations.

6. Assignment. LICENSEE shall not assign this Agreement without prior written consent of CITY.

7. No Liens. LICENSEE shall not permit any liens or encumbrances to be placed on the Property.

8. Entire Agreement. This Agreement constitutes the entire understanding between the parties and may only be modified in writing.

9. Governing Law and Venue. This Agreement shall be governed by the laws of the State of California, with venue in Riverside County.

10. Notices. All notices given in conjunction with this Agreement shall be written, and shall be effective upon personal delivery to the other party or, if by mail, three (3) days after deposit in the U.S. Mail, first class postage prepaid to the applicable address stated below, or to such other address as the party may designate by written notice:

INSURANCE REQUIREMENTS
Types; Amounts. Licensee shall obtain and shall require any subcontractor to obtain insurance in the amounts described below unless specifically altered or waived by City (“Required Insurance”).
i. Commercial General Liability Insurance. Licensee shall maintain occurrence version commercial general liability insurance or equivalent form, with a combined single limit of not less than Two Million Dollars ($2,000,000) per occurrence and Two Million Dollars ($2,000,000) in the aggregate, and excess liability coverage in the form of an umbrella policy of no less than Four Million Dollars ($4,000,000). ii. “All Risk” Property Insurance. Licensee shall maintain a policy of property insurance for perils usual to a standard “all risk” insurance policy on all its improvements or alterations in, on, or about the City Property, with limits equal to ninety percent (90%) of the replacement value of all such improvements or alterations. iii. City shall be endorsed as an additional insured for liability arising out of the use or maintenance of the part of the City Property used by Licensee iv. The insurance provided to the City shall be primary to and non-contributory with any insurance or self-insurance maintained by Licensee.

The City of Hemet employs various department heads and senior management personnel who serve in at-will positions under the direction of the City Manager. These employees occupy key leadership roles within the City's organizational structure and are responsible for overseeing municipal operations and advancing the City's strategic goals and priorities. The City Council has delegated authority to the City Manager to appoint, supervise, and manage these employees, including the administration of their compensation and benefits. On September 24, 2024, the City Council adopted Resolution No. 2024-181, which established compensation and benefit provisions for the City's at-will employees.

ANALYSIS:

In this Resolution, there is a clause providing for a base salary separation between Department Heads and their next highest paid classification. This base salary separation currently includes any applicable certificate pay, bilingual pay, longevity pay and/ or uniform allowance. The City has identified the need to include standby pay as compensation considered for the purposes of

maintaining salary separation for At-Will employees. The City has also identified the need for the City Manager, in his/her sole discretion, to provide an automobile allowance to Safety-designated At-Will employees in lieu of a City-assigned vehicle.

DISCUSSION:

Reevaluating and revising the parameters used to calculate salary separation promotes consistency in employment conditions and compensation structures for senior management personnel. In addition, incorporating provisions related to a Safety-designated automobile allowance into the Resolution enhances transparency and flexibility in the City's employment framework. These actions support the City's objective of maintaining an effective and adaptable leadership structure while providing competitive and equitable compensation and benefits for senior management employees.

PREVIOUS COUNCIL ACTION:

Council approved Resolution 2025-023 on February 25, 2025, amending Resolution 2024-181 to include future approved at-will designated positions.

STRATEGIC PLAN INTEGRATION:

GOAL FIVE: ORGANIZATIONAL EFFECTIVENESS
To identify the work needed inside the City organization to effectively provide services to the community and ensure financial stability.

Objective 1: Operate in a financially sustainable manner.

Objective 2: Evaluate existing practices to ensure continuity with industry best practices.

Objective 3: Provide Council with policies that are consistent while lessening liabilities.

Objective 4: Increase employee retention by training and creating a positive workplace.

FISCAL IMPACT:

The approval of this resolution would result in an approximate cost of $6,000 per year to the position of Chief of Police to maintain a differential of 7.5% to the next highest paid position and potentially any future City Manager dependent on their contract agreement.

If an auto allowance was implemented in lieu of a safety designated automobile, there would essentially be a net impact of zero based on a monthly stipend of $500 per month and ongoing maintenance of a city issued vehicle.

Appropriations will be included in each fiscal year's operating budget. No additional appropriations are needed at this time.

The City Council of the City of Hemet, California (hereafter referred to as the “City Council”) does resolve as follows:

WHEREAS, on September 24, 2024, the City Council adopted Resolution No. 2024-181, approving compensation and benefit parameters for at-will employees and approving revisions to the Classification and Compensation Plan of the City; and WHEREAS, Resolution No. 2024-181 applies to the City’s at-will employee group and delegates to the City Manager authority to administer and implement compensation and benefits for at-will employees within the parameters established by the City Council; and
WHEREAS, Section 3.E.5 of Resolution No. 2024-181 provides for maintenance of base salary separation for at-will employees by requiring salary ranges to be reviewed and adjusted to ensure a separation of at least seven and one-half percent (7.5%) from the top step of the base salary range for the next highest paid classification in the at-will employee’s department, plus specified additional pays and allowances; and

WHEREAS, the City Council desires to clarify that standby pay shall also be included among the additional pays considered when determining and maintaining salary separation for at-will employees; and
WHEREAS, the City Council finds that this amendment promotes internal alignment, consistency, and appropriate compensation separation between at-will employees and subordinate classifications; and
WHEREAS, the City identified the need for the City Manager, in his/her sole discretion, to provide an automobile allowance to Safety-designated At-Will employees in lieu of a City-assigned vehicle.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HEMET FINDS, DETERMINES, ORDERS AND RESOLVES AS FOLLOWS:

SECTION 1. Recitals.

The recitals set forth above are true and correct and are incorporated herein by this reference.

SECTION 2. Amendment to Resolution No. 2024-181.

Section 3.E.5 of Resolution No. 2024-181 is hereby amended to read as follows:
“5. Maintenance of Base Salary Separation. The actual salary for each at-will employee shall be reviewed and the City Council shall adjust the salary ranges to ensure a base salary for each at-will employee that maintains a separation of at least seven and one-half percent (7.5%) from the top step of the base salary range for the next highest paid classification in the at-will employee’s department, plus any applicable

Section 3.E.9 of Resolution No. 2024-181 is hereby amended to read as follows:
“9. Automobile. The City Manager, in his/ her discretion, may provide an at - will employee a City -owned vehicle for the employee' s exclusive use and limited personal use to maintain a one- hour response time to the City. The City shall pay for, or reimburse the employee, for the necessary cost of automobile registration, insurance, fuel, and maintenance. At -will employees shall keep the vehicle in reasonable repair, obey all traffic laws relating to the operation of the vehicle and shall use due care and caution in its operation.
i. In the City Manager' s sole discretion, for at -will employees, in lieu of providing a City-owned vehicle, the City Manager may authorize a monthly automobile allowance in an amount as determined by the City Manager up to a maximum of $500 per month. At -will employees must provide proof of insurance in the amounts of $100,000 per person and $300,000 each occurrence if provided an allowance. The automobile allowance includes reimbursement for an appropriate allocation of vehicle insurance and all other expenses of vehicle ownership, maintenance and operation.

SECTION 3. Continuing Effect.

Except as expressly amended by this Resolution, all provisions of Resolution No. 2024-181 shall remain in full force and effect.

SECTION 4. Severability.

If any section, subsection, subdivision, paragraph, sentence, clause, phrase, or portion of this Resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity or enforceability of the remaining portions of this Resolution. The City Council hereby declares that it would have adopted each section, subsection, subdivision, paragraph, sentence, clause, phrase, and portion of this Resolution irrespective of the fact that any one or more portions may be declared invalid or unenforceable.

SECTION 5. Effective Date.

This Resolution shall take effect immediately upon its adoption.

RECOMMENDED ACTION:

RESOLUTION NO. 2026-089 - A RESOLUTION OF THE CITY OF HEMET, CALIFORNIA, AWARDING A PURCHASE ORDER IN THE AMOUNT OF $200,000, FOR PIPELINE MATERIALS

TO OC WINWATER, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE PURCHASE ORDER AND APPROVE CHANGE ORDERS UP TO 10% OR $20,000 FOR FISCAL YEAR (FY) 2026/2027
BACKGROUND:

The Public Works Department’s Water and Sewer Division operates and maintains the City’s water distribution infrastructure, which serves more than 9,700 residential and commercial connections and a population of approximately 32,600 residents. The Division also operates and maintains the City’s sewer collection system, which encompasses approximately 6.75 square miles within the City of Hemet.

These systems include City-owned production wells, water storage reservoirs, transmission and distribution mains, service laterals, fire hydrants, valve systems, and interagency connections. The timely procurement of equipment, replacement parts, and operational supplies is essential to maintaining the water supply and sewer collection systems in a safe, reliable, and regulatorycompliant manner 24 hours per day, seven days per week. Establishing an annual purchase order enables staff to respond immediately to operational and emergency needs, maintain adequate inventory levels, and improve efficiency by reducing the need for repetitive procurement processes and bid solicitations throughout the year.

A solicitation for competitive pricing for Fiscal Year 2026-27 pipeline materials was issued through PlanetBids on May 5, 2026, with bids accepted through May 26, 2026. A total of 85 vendors were notified through the PlanetBids system. The City received six bid submissions, which were reviewed by Water and Wastewater Division staff and the Procurement Administrator for responsiveness, responsibility, and compliance with the bid specifications.

Based on the evaluation of the submitted bids, OC WinWater was determined to be the lowest responsive and responsible bidder providing pricing for the complete scope of materials identified in the bid package. Although Pacific Pipeline Supply submitted a lower total bid amount, it did not provide pricing for all required bid items and therefore was not considered the lowest responsive bidder. Accordingly, staff recommends awarding the annual pipeline materials purchase agreement to OC WinWater.

The total bid amounts reflect pricing submitted for all materials identified in the bid package that may be purchased during the fiscal year. Actual purchases will be made on an as-needed basis and will depend on operational requirements, maintenance activities, and emergency repair needs. The requested authorization amount is based on the Water and Wastewater Division’s projected annual material requirements and the funding appropriated in the Fiscal Year 2026-27 Operating Budget.

DISCUSSION:

The Public Works Department annually forecasts the materials required to operate and maintain the City's water distribution and wastewater collection systems and procures those materials through a competitive bidding process. Once a contract is awarded and a purchase order is established, staff can acquire materials more efficiently throughout the fiscal year for both routine maintenance activities and emergency repairs.

The bid solicitation reserved the City's right to award to one or more vendors. Upon review of the submitted bids, staff determined that separating the purchase of water meters from the remaining pipeline materials provides the best overall value to the City. Accordingly, the purchase order recommended under this award will include all pipeline materials except water meters. A separate purchase order for water meters will be issued under the City Manager's purchasing authority to the vendor submitting the lowest responsive and responsible bid for that category.

The bid prices establish unit costs for materials that may be purchased throughout Fiscal Year 2026- 27 and do not represent a commitment to purchase fixed quantities. The recommended purchase order authorization of $200,000 reflects the Water and Wastewater Division's projected annual

material requirements and budgeted funding levels, allowing staff to procure materials on an asneeded basis throughout the fiscal year at competitively bid prices.

The Purchase Order will be broken down between the two funds with a estimate of 90% coming out of Fund 571 and 10% out of Fund 254.

ALTERNATIVE(S):

1. Do not award a Purchase Order to OC WinWater.

2. Provide alternative direction to the City Manager.

LOCAL BUSINESS PREFERENCE AND CERTIFICATION REQUEST
(Bidders requesting a 5% Local Business Preference must enclose this form in the Bid Package) NOTICE TO ALL BIDDERS: Section 2-332 of the City of Hemet Municipal Code provides that a Local Preference be given to bidders who qualify as a local business, subject to applicable state and federal law requirements.

A. Section 2-332 requires qualified local vendors to be given preference in bid evaluation and award if a qualified local vendor does not make the lowest priced submission, subject to applicable state and federal law. Any qualified local vendor that makes a responsive and responsible submission shall have their submission price reduced by five percent for the purposes of comparison to the other submissions received by the City in making the determinations. If with this five percent reduction a qualifying local vendor would be awarded the contract, the qualifying local vendor shall be given the opportunity to amend their submission to price match the true lowest priced submission. If the qualifying local vendor agrees to price match and executes any required price match agreement within the time specified by the City, then the contract shall be awarded to the local qualifying bidder.

B. For purposes ofthis section, a “qualified local vendor” shall be defined as a bidder that meets all of the following requirements:

1. An individual, partnership, limited liability company, or corporation which has maintained fixed facilities with employees located within the corporate limits ofthe City for a continuous period of at least twelve (12) months immediately preceding the bid opening date; and which is shown by the records maintained by the City’s finance department as having secured all necessary business licenses and as having paid all applicable fees and taxes imposed by the City, with no outstanding delinquencies;

2. The business maintains a physical business street address within the City limits where business operations are actually conducted (PO. Box, mail drop or residential address shall not suffice to establish a local preference);

3. For contracts involving the sale of goods, all sales tax for such goods must be reported to the State of California through a business location within the geographic boundaries ofthe City of Hemet, as evidenced by documentation from the California Department of Tax and Fee Administration.

Based on the information available today, here’s some key details:

Historically, Master Meter has absorbed a significant portion of the 2025, 15% tariƯ import fee based on the International Emergency Economic Powers Act (IEEPA) “Liberation Day” tariƯs imposed on April 2, 2025.

We have only passed along a 7% tariƯ-related surcharge to customers. The Supreme Court struck down the “Liberation Day” tariƯs on Friday, February 21, 2026.

Over the weekend, the Administration levied a new tariƯ using Section 122 of the Trade Act of 1974. This new tariƯ mirrors the previous tariƯ import fee of 15%.

As such, there will be no change in the 7% tariƯ-related surcharge to customers. It is “Business as Usual” – or at least the same usual that it has been around tariƯs.

We will work to quickly update you on any changes to our current policy or process. Stay tuned.

Scope of Integrity
This warranty applies exclusively to Master Meter Multi-jet 5/8”, 3/4”, 1”, 1.5”, and 2” meters and Positive Displacement 5/8”, ¾”, and 1” meters when used for clean cold potable water (per applicable AWWA Standard) and installed in accordance with Master Meter published installation instructions in effect as of the date of Master Meter's shipment. This warranty applies exclusively to the original utility purchaser when product is purchased from either Master Meter or an authorized Master Meter distributor. Coverage in both terms of time and registered usage is from date of shipment by Master Meter.

Materials and Workmanship
If used and installed as described above, Master Meter warrants all Multi-jet (5/8”, 3/4”, 1”, 1.5” and 2”) and Positive Displacement (5/8”, ¾”, and 1”) to be free from defects in materials and workmanship for a period of 24 months.

Case Integrity
If used and installed as described above, Master Meter, Inc. warrants that the low lead bronze cases of the 5/8”, 3/4”, 1”, 1.5” and 2” MultiJet Meters and the 5/8”, ¾”, and 1” Positive Displacement Meters will retain their structural integrity for a period of 25 years from the date of Master Meter shipment.

Sonata & Octave Ultrasonic meters for Residential and Intermediate Applications Scope of Integrity
This warranty applies exclusively to Master Meter Sonata, Octave Residential (5/8”, 3/4” and 1”) and Octave Intermediate (1.5” and 2”) meters when used for clean cold potable water (per applicable AWWA standard) and installed in accordance with Master Meter published installation instructions in effect as of the date of Master Meter's shipment. This warranty applies exclusively to the original utility purchaser when product is purchased from either Master Meter or an authorized Master Meter distributor. Coverage in both terms of time and registered usage is from date of shipment by Master Meter.

Case Integrity
If used and installed as described above, Master Meter warrants all Sonata, Octave Residential (5/8”, 3/4” and 1”), and Octave Intermediate (1.5” and 2”) meters will retain their structural integrity for a period of 20 years.

Electronics
If used and installed as described above, Master Meter warrants all Sonata, Octave Residential (5/8”, 3/4” and 1”), and Octave Intermediate (1.5” and 2”) meter batteries, transducers, LCD, and communications output (encoder, or integrated radios) will be warranted for a period of 20 years. Master Meter will repair or replace the meter at no cost for the first ten (10) years and prorated in Years 11 – 20 as listed below.

Accuracy
Master Meter warrants all Sonata,Octave Residential (5/8”, 3/4” and 1”), and Octave Intermediate (1.5” and 2”) meters will meet or exceed +/- 1.5% accuracy in the Normal Operating Range of the meter, as defined in the latest revision of the Sonata, Octave Residential, and Octave Intermediate Products Data Sheet for a period of 20 years.

Master Meter will repair or replace the meter at no cost for the first ten (10) years and prorated in Years 11-20 as listed below.

Octave Ultrasonic for Commercial and Industrial (C&I) Applications Scope of Integrity

If used and installed as described above, Master Meter warrants all Octave Commercial & Industrial meters (1.5” - 12”) main board, batteries, transducers and LCD will be warranted for a period of 10 years. Externally attached communication output modules (encoder, pulse, 4-20, dual output and Modbus) will be warranted for a period of 1 year.

Accuracy
Master Meter warrants all Octave Commercial & Industrial meters (1.5” - 12”) will meet or exceed +/- 1.5% accuracy in the Normal Operating Range of the meter, as defined in the latest revision of the Octave Product Data Sheet for a period of 10 years.

Master Meter 2” – 8” bronze body and 10” and 12” cast iron body Turbine Meters and Fire Hydrant Meters are warranted to perform to all applicable AWWA accuracy standards. Turbine and Fire Hydrant Meters are warranted be free from material and workmanship defects for two years (24 months) as of the date of Master Meter's shipment. Master Meter Turbine and Fire Hydrant Meters are warranted for accuracy for one (1) year from the date of Master Meter shipment.

Allegro Infrastructure & Equipment Warranty

1. Repeater. This covers all versions of repeaters, including but not limited to: Standard Repeater, Photocell Repeater, and Solar Repeater

2. Extended Warranty. Additional warranty for Allegro Infrastructure Equipment can be purchased on a per unit basis. Master Meter’s Extended Warranty must be purchased within 12 months of the original shipment date of equipment. Eligibility is based on continuous annual enrollment.

Escalation for Services: five percent (5%). Services. Invoices for Ongoing Fees and services shall be delivered annually or monthly, as applicable, in advance. Invoices for other services shall be delivered upon completion of the applicable service.

Register & Electronics – General Limited Warranty

DISCOUNT PERCENTAGES WILL BE APPLIED AGAINST PUBLISHED LIST PRICES IN EFFECT AT THE TIME THE PRODUCT IS ACCEPTED BY MASTER METER UNDER WARRANTY CONDITIONS. THE WARRANTIES CONTAINED ABOVE HEREOF ARE THE ONLY WARRANTIES WITH RESPECT TO THE LISTED PRODUCTS, AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, BETWEEN THE PARTIES OR ARISING BY LAW. I. Master Meter, Inc. (“Master Meter”) warrants its products and parts to be free from defects in material and workmanship for one (1) year from the date of Master Meter’s shipment, if not otherwise specified or as set forth in this document.

II. Allegro™ Integrated registers and Allegro™ External Transceiver Modules are warranted to be free from defects in materials and workmanship for Ten (10) years from date of shipment by Master Meter and at a prorated replacement cost of current list price during the following Ten (10) years based on the discounted rate value listing above (configured to the original factory settings of twice daily transmissions of 12 hourly interval reads, allowing for no more than 2 customer requested firmware upgrades for the life of the product, and no more than 4 data logs per year.) All other Allegro System Components are warranted to be free from defects in materials and workmanship for One (1) year from date of shipment by Master Meter.

III. Allegro™ Cellular and Allegro Cellular / IoT AMI Endpoints are warranted to be free from defects in materials and workmanship for Ten (10) years from date of shipment by Master Meter, and at a prorated replacement cost of current list price during the following Ten (10) years based on the discounted rate value listing above (configured to the original factory settings). All other Allegro Cellular and Allegro Cellular / IoT System Components are warranted to be free from defects in materials and workmanship for One (1) year from date of shipment by Master Meter.

Allegro Cellular Network Availability:

In the event that the Communication Network (“Network”) utilized by Customer’s Allegro Cellular AMI Endpoints (“Endpoints”) is explicitly and publicly discontinued by the Network Operator, rendering the Endpoints unusable, Master Meter will supply Customer with replacement Endpoints supported by the most current readily available full-scale technology at no charge to the Customer during years one (1) through ten (10) of the Endpoints written warranty. Any Endpoint replaced during years one (1) through ten (10) will carry the balance of its original warranty based on shipment date. Any Endpoint in the pro-rated portion of the written warranty will be replaced according to the pro-rated cost schedule included in this Warranty. Customer shall be solely responsible for all costs, both direct and indirect, associated with the replacement of such Endpoints.

IV. DIALOG 3G™ DS, DIALOG 3G™ DS Interpreter / Interpreter II registers, and DIALOG 3G™ External Transceiver Modules are warranted to be free from defects in materials and workmanship for Ten (10) years from date of shipment by Master Meter and at a prorated Years

V. Interpreter™ Register with GridLinx™ Protocol, Interpreter™ Register with Itron® (formerly Silver Spring Networks) Protocol, and all GridLinx or Itron External Transceiver Modules operating on the GridLinx and Itron Network are warranted to be free from defects in materials and workmanship for Ten (10) years from date of shipment by Master Meter and at a prorated replacement cost of current list price during the following Ten (10) years based on the discounted rate value listing above (configured to the original factory settings.) All other System Components for Registers based on GridLinx and Itron Network are warranted to be free from defects in materials and workmanship for One (1) year from date of shipment by Master Meter.

VI. AccuLinx™, eLinx™, and DIRECT READ registers are warranted to be free from material and workmanship defects for ten (10) years, and DIRECT READ registers for fifteen (15) years, from date of Master Meter shipment. All other Master Meter products not specifically identified above are warranted to be free of defects in materials and workmanship for one (1) year from date of Master Meter shipment.

VII. ReadMaster™ registers are warranted to be free from material and workmanship defects for five (5) years from date of shipment by Master Meter (configured to the original factory settings four (4) transmissions daily). All other ReadMaster system components not specifically identified above are warranted to be free of defects in materials and workmanship for one (1) year from date of shipment by Master Meter.

VIII. DIALOG 3G™ Gas Modules and DIALOG 3G™ Electric
Modules are warranted to be free from defects in material and workmanship for one (1) year from date of shipment by Master Meter.

IX. RETURNS: Master Meter’s obligation, and Customer’s exclusive remedy, under this Limited Warranty is, at Master Meter’s option, to repair or replace the product, provided the Customer (a) returns the product to the location designated by Master Meter within the warranty period; and (b) prepays the freight costs to such location.

Warranty & Limits of Liability
This warranty does not apply to meters or registers determined by Master Meter, at its sole discretion, to have been damaged by aggressive water conditions, foreign matter in water, vandalism, negligence, installation not in accordance with Master Meter, Inc. installation instructions, misapplication or other use not as described on this document, acts of God or other conditions beyond the control of Master Meter, Inc. This warranty is null and void if it is determined by Master Meter that a meter is altered by the addition of any register not manufactured by or on behalf of Master Meter, Inc. for its specific model and size. If a meter is claimed to breach the accuracy guarantees as stated herein, the customer shall submit a certified copy of the test results at the time the meter is returned to Master Meter, Inc. The accuracy warranty shall be void if an examination of the customer’s water system shows poor water quality causing an unusually adverse effect on metering equipment.

Master Meter’s liability under this warranty is expressly limited to repair or replacement of the product, or similar product and/or component, at Master Meter’s sole discretion, at Master Meter’s option. The repaired or replacement product will maintain the original meter’s warranty based on the original purchase date. The customer must pay for freight cost of the returned product or products to the factory or service center designated by Master Meter. The product returned becomes the property of Master Meter.

If product is not determined to be under warranty, customer will pay freight for return of the original product. If the product is determined to be under warranty, the product will be repaired and returned to the customer, replaced, or Master Meter will determine a suitable substitute (at Master Meter’s sole option), with freight paid by Master Meter. The original product returned becomes the property of Master Meter. Master Meter shall not be liable for special, incidental, in-direct or consequential damages of any kind.

The return of products for warranty claims must follow Master Meter’s Returned Materials Authorization (RMA) procedures. All Master Meter Products returned must be affixed with an approved Return Authorization form. For all returns, Master Meter reserves the right to request meter reading records by serial number to validate warranty claims.

For products that have become discontinued or obsolete (“Obsolete Product”), Master Meter may, at its discretion, replace such Obsolete Product with a different product model (“Replacement Product”), provided that the Replacement Product has substantially similar features as the Obsolete Product.

Any description of product, whether in writing or made orally by Master Meter, Inc or its agents, specifications, samples, literature, models, bulletins, drawings, diagrams, data sheets or similar materials used in connection with any customer’s order are for the sole purpose of identifying product and shall not be construed as an express or implied warranty. Any suggestions by Master Meter, Inc. or its agents regarding use, application, or suitability of product shall not be construed as an express or implied warranty unless confirmed to be such in writing by Master Meter, Inc.

If any provision hereof, partly or completely, shall be held invalid or unenforceable, such invalidity shall not affect any other provision or portion hereof and these terms shall be construed as if such invalid or unenforceable provision or portion thereof had never existed.

THE FOREGOING EXPRESS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES OR GUARANTEES WHATSOEVER, WHETHER

EXPRESSED OR IMPLIED (EXCEPT FOR WARRANTY OF TITLE) INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CUSTOMER’S EXCLUSIVE REMEDY AND MASTER METER, INC.

AND ITS BUSINESS PARTNERS’ SOLE LIABILITY ON ANY CLAIM, WHETHER IN BIAS (INCLUDING STRICT LIABILITY), NEGLIGENCE,

CONTRACT, WARRANTY OR OTHERWISE, FOR ANY METER OR REGISTER WHICH FAILS TO MEET THE TERMS OF THE WARRANTY STATED IN THIS DOCUMENT, SHALL BE LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED ABOVE.

Maximum Liability. EXCEPT AS OTHERWISE PROVIDED IN NO EVENT SHALL MASTER METER’S AGGREGATE LIABILITY ARISING OUT

OF OR RELATED TO THIS AGREEMENT, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EXCEED THE TOTAL AMOUNT PAID TO THE SELLER PURSUANT TO THIS AGREEMENT. THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF THE CUSTOMER’S REMEDIES UNDER THIS AGREEMENT FAIL OF THEIR ESSENTIAL PURPOSE.

Sole Remedy. THIS LIMITATION OF LIABILITY SETS FORTH MASTER METER’S SOLE LIABILITY AND ENTIRE OBLIGATION AND THE CUSTOMER’S EXCLUSIVE REMEDY FOR ANY ACTION THAT IS BROUGHT AGAINST MASTER METER.

Governing Law and Venue. ALL DISPUTES ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL BE GOVERNED BY TEXAS

LAW, EXCLUDING ITS CHOICE OF LAW RULES, WITH JURISDICTION AND VENUE IN THE STATE OR FEDERAL COURTS OF TARRANT COUNTY, TEXAS. THE PARTIES CONSENT TO THE PERSONAL JURISDICTION OF, AND VENUE IN, SUCH COURTS AND AGREE THAT NO SUCH COURT IS AN INCONVENIENT FORUM.

2026/2027 PIPELINE MATERIALS BID
I. BRIEF OVERVIEW
The City is seeking bids for the supply of pipeline materials on an as-needed basis, as detailed in Attachment A. Materials include, but are not limited to, pipe, backflow prevention devices, sewer and drainage products, valves, fittings, restraint products, clamps, couplings, meter boxes, meters, tools, and other related miscellaneous items.

II. GENERAL INSTRUCTIONS

1. To be considered a responsive bid, Bidder must comply with all instructions and specifications as outlined in this Invitation for Bid (IFB). Bid response will be binding and firm.

2. It is the Bidder’s responsibility to examine and fully familiarize themselves with the specifications and the nature of the work required. The Bidder shall have no claim against the City based upon ignorance of the project’s requirements, site conditions, specifications, and/or Agreement provisions (Sample Agreement – Attachment B).

3. By submitting a bid, each Bidder expressly agrees to and accepts the following conditions:
a. The City’s specifications will become part of the agreement between the selected Bidder and the City of Hemet;
b. The City reserves the right to request further information from the Bidder, either in writing or orally, to establish any stated qualifications; c. The City reserves the right to solely judge the Bidder’s representations and to determine whether the Bidder is qualified to undertake the project pursuant to the criteria set forth herein. The Bidder, by submitting a bid, expressly acknowledges and agrees that the judgment of the City as to whether the Bidder is qualified to perform the project, shall be final, binding and conclusive;
d. This bidding process does not commit the City to award any Agreement, and the City is not liable for any costs incurred by the Bidder in the preparation and submission of a bid;

4. False, incomplete, or unresponsive statements in connection with the bid may be sufficient cause for rejection of a bid.

5. The City reserves the right to change any part of these instructions to Bidders and specifications any time prior to the bid opening date and time. Any changes shall be communicated and recorded in the form of addenda via PlanetBids

3 notification and will become part of the bid documents and subsequent Agreement. A Bidder’s failure to address the requirements of the addenda may result in rejection of their bid. If the City determines that a time extension is required for the bid, the addenda will indicate the new submission date and time.

6. All bids accepted by the City shall become the exclusive property of the City. Upon opening, all bids accepted by the City shall become a matter of public record and shall be regarded as public and any blanket statement (i.e., regarding the entire pages, documents, or other non-specific designations) shall not be sufficient and shall not bind the City in any way whatsoever. If disclosure is required under California Public Records Act or otherwise by law (despite the Bidder’s request for confidentiality), the City shall not in any way be liable or responsible for the disclosure of any such records or part thereof.

All records, documents, drawings, plans, specifications and other materials submitted by an applicant in its proposal, and during the course of any work awarded, shall become the exclusive property of the City of Hemet, and may be subject to release as a public record pursuant to the provisions of the California Public Records Act (Government Code section 6250 et seq.) The City of Hemet’s use and disclosure of its records are governed by this Act.

The City of Hemet will accept information clearly labeled “TRADE SECRET,” “CONFIDENTIAL,” or “PROPRIETARTY” as determined by the submitting party in accordance with the Act. However, under no circumstances, will the City of Hemet be responsible or liable to the applicant or any other party for the disclosure of any such labeled information.

The City of Hemet will not advise as to the nature or content of documents that may be entitled to protection from disclosure under the California Public Records Act, including interpretations of the Act or the definitions of “Trade Secret,” “Confidential,” or “Proprietary.”
If litigation is brought under the California Public Records Act concerning documents submitted in response to this IFB, the appropriate parties shall indemnify, defend, and hold harmless the City of Hemet from all costs and expenses, including reasonable attorney fees, in such litigation.”

7. The Agreement shall be awarded to the lowest responsive and responsible Bidder(s). In determining whether a Bidder is responsible and responsive, the following will be considered:

8. Bidders shall not be allowed to take advantage of any errors or omissions in these instructions to Bidders or specifications. Revised instructions will be provided, if such error or omission is discovered and brought to the attention of the City.

9. Pricing shall include all federal, state, local and other taxes as well as freight costs, if applicable.

10. All general or bidding inquiries shall be directed to the Q & A Section of the Bid Page. Questions will not be answered verbally or in an email.

11. Bid responses shall be delivered electronically on PlanetBids

12. Costs for developing bids are entirely the responsibility of the Bidder and shall not be chargeable to the City of Hemet.

13. If a Bidder takes exception to any part of these specifications as written, or as amended by any addenda subsequently issued, or the Agreement, they must do so in writing. Said exceptions must be submitted with the bid. Failure to do so will be construed as acceptance of all items of the specification and the Agreement.

14. City of Hemet may reject any or all bids and may waive any immaterial deviation in a bid. City of Hemet's waiver of an immaterial defect shall in no way modify the IFB documents excuse the Bidder from full compliance with the specifications if he/she is awarded the Agreement. Bids referring to terms and conditions other than City of Hemet’s terms and conditions may be rejected as being nonresponsive.

City of Hemet may make investigations as deemed necessary to determine the ability of the Bidder to perform the work, and the Bidder shall furnish to City of Hemet all such information and data for this purpose as requested by City of Hemet. City of Hemet reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy City of Hemet that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work specified.

15. The Agreement shall be signed by the Contractor and returned, along with the required attachments to the City of Hemet within ten (10) calendar days. The period for execution may be changed by mutual agreement of the parties.

5 Agreements are not effective until approved by the appropriate City of Hemet officials. Any work performed prior to receipt of a fully executed Agreement shall be at Contractor's own risk.

16. Failure to execute the agreement within the time frame identified above shall be sufficient cause for voiding the award. Failure to comply with other requirements within the set time shall constitute failure to execute the Agreement. If the successful Contractor refuses or fails to execute the Agreement, the City of Hemet may award the Agreement to the next qualified highest ranked Contractor.

17. When applicable, the City is subject to the State of California prevailing wage laws as set forth in California Labor Code section 1770 et seq. The contractor is responsible for registering with the Department of Industrial Relations (DIR) prior to placing their bid. Contractor must determine the appropriate DIR classification for the various employees and subcontractors used for a particular project or services. The rates for each classification are posted on the DIR website at www.dir.ca.gov/DIRdatabases.html. All contractors performing works for the City are responsible for abiding by all applicable prevailing wage laws and must furnish the City with Certified Payroll Records.

18. Contractor must hold and maintain liability insurance that meets the City’s minimum requirements as specified in Exhibit D Insurance Requirements, in the Agreement. Certification must be provided to and accepted by the City upon award of Agreement.

19. The City of Hemet requires that any Contractor doing business within the City limits must hold a valid City of Hemet business license, prior to conducting business with the City. Information regarding how to obtain a business license is available at https://www.hemetca.gov/326/Business-Licenses Bidder must obtain a business license from the City prior to execution of the purchase order.

• Meter boxes and meters for water usage monitoring
• Tools and related equipment for installation and maintenance • Miscellaneous items as detailed in Exhibit A
Requirements:

1. All materials must meet industry standards and specifications.

2. Suppliers must ensure timely delivery based on the City's schedule.

3. Exhibit A provides detailed descriptions and quantities.

4. Bids should include pricing for each item identified in Exhibit A.

6 5. All products must comply with applicable safety and environmental regulations.

IV. BIDDER REQUIREMENTS

1. Upon award of Agreement, Contractor shall start work within ten (10) business days after a purchase order has been issued by the City.

2. All workers shall wear uniforms that identify them as employees of the Contractor’s business.

3. The Water Wastewater Superintendent, Travis Holyoak, will be the City’s project manager for this work.

4. The project manager will be notified immediately when the Contractor is unable to perform the work and whenever any non-personnel or property related accident occurs while performing the specified contract work.

5. If additional work is required by the City, an estimate of cost shall be submitted by the Contractor to the project manager, prior to work being undertaken.

Additional work may not commence until a change order has been issued to the Contractor by the City’s purchasing division.

10 iv. LOCAL VENDOR PREFERENCE

CITY OF HEMET

LOCAL BUSINESS PREFERENCE AND CERTIFICATION REQUEST

(Bidders requesting a 5% Local Business Preference must enclose this form in the Bid Package)

NOTICE TO ALL BIDDERS: Section 2-332 of the City of Hemet Municipal Code provides that a Local Preference be given to bidders who qualify as a local business, subject to applicable state and federal law requirements.

B. For purposes of this section, a “qualified local vendor” shall be defined as a bidder that meets all of the following requirements:

1. An individual, partnership, limited liability company, or corporation which has maintained fixed facilities with employees located within the corporate limits of the City for a continuous period of at least twelve (12) months immediately preceding the bid opening date; and which is shown by the records maintained by the City’s finance department as having secured all necessary business licenses and as having paid all applicable fees and taxes imposed by the City, with no outstanding delinquencies;

2. The business maintains a physical business street address within the City limits where business operations are actually conducted (P.O. Box, mail drop or residential address shall not suffice to establish a local preference);

C. For purposes of this section, “preference” shall mean the five percent (5%) reduction factor applied to the bid of a qualified local vendor for evaluation purposes only, that will allow the qualified local vendor to amend their submission and price match the true lowest priced responsive and responsible submission. The preference shall not apply if its application would violate state or federal law or jeopardize the receipt of state or federal funding.
