STAFF REPORT

HOLLISTER CITY COUNCIL
MEETING DATE: February 4, 2025
REPORT # Finance-2025-06

AGENDA ITEM: A RESOLUTION AMENDING PORTIONS OF THE CITY’S FISCAL YEAR 2024-25 MASTER USER FEE SCHEDULE

DEPARTMENT: Adminstrative Services
DEPARTMENT HEAD: Casey Estorga, Administrative Services Director STAFF CONTACT: Casey Estorga, Administrative Services Director

RECOMMENDED ACTION: Hold a public hearing, receive the results of a comprehensive user fee study, and adopt a resolution making changes to some user fees in the Fiscal Year 2024-25 Master User Fee Schedule.

DISCUSSION:

User fees are charges made directly to an individual or group for services that are provided by the City of Hollister and primarily benefit that individual or group, not the community at large. The City has the legal authority to collect user fees to offset the actual cost of service delivery to these individuals or groups. This also provides an opportunity for the City to uphold efforts associated with transparency and financial responsibility.

The City’s Budget and Fiscal Policies provide direction regarding user fees and cost recovery goals. The policy also requires fees to be reviewed on an ongoing basis and to be updated to ensure fees keep pace with changes in the cost-of-living as well as changes in methods or levels of service delivery. Further, the City’s policy states a comprehensive analysis of City costs and fees should be made at least every five years.

Then, fees may be adjusted by annual changes in the Consumer Price Index in years between comprehensive studies. The item being presented today is a recommendation to update user fees based on a comprehensive fee study.

The City conducted a comprehensive fee study to accomplish the requirements of City policy. The study was performed by a third-party contractor, Willdan. The contractor worked with staff from City departments to perform the study to gather data about service delivery methods and associated costs. This study evaluated fees in the following Departments/Divisions: Airport, Animal Control, Finance, Fire, Parks & Recreation, Police, and Public Works (Utilities). The results of the study, and recommended changes to fees, are included as an attachment to this staff report.

In establishing user fees, the City prioritizes the following tenants:

 Not overcharging fee payers; and
 Establishing the true costs of programs and services; and  Providing support for any fee set by the City to ensure compliance with the law.

City policy also identifies user fee cost recovery levels, including high cost recovery services and low cost recovery services. When considering cost recovery

Page 1132 of 1195 ends

methodologies for use in recommended user fees, City policy evaluates the following factors:

1. Community-wide vs. Special Benefit

2. Service Recipient vs. Service Driver

3. Effect of Pricing on the Demand for Services

4. Feasibility of Collection and Recovery

In evaluating these variables, the City’s low cost recovery services include instances where there is a clear community benefit and no intended relationship between the cost of delivering a service and the amount paid by a user of the service. For example, almost all social service programs are low cost recovery services. The City’s policy also identifies many public safety services, access to parks, small-scale licenses, and instances where collecting fees would discourage compliance with regulatory requirements as low cost recovery services that should have user fees benchmarked at a level lower than the true cost of providing those services. The policy announces that the primary funding for these services should be general revenues and not user fees.

The same City policy also identifies methodologies for high cost recovery services by identifying these services in several different categories, including services that are similar to those services offered in the private sector, the use of the service is generally discouraged (i.e. police response to a disturbance, false alarm call-outs, etc.), for demand management purposes, and/or if the service is regulatory in nature (i.e. building permits, plan checks, subdivision review fees, etc.).

The City’s Fiscal and Budget Policies also have specific cost recovery rules for the following different categories:

 Recreation Programs
o Youth/Teen/Senior Programs (Low-Range Cost Recovery)
o Community Classes (Mid-Range Cost Recovery)
o Adult Programs (High-Range Cost Recovery)

 Development Review Programs
o Policy states cost recovery should be in the high range for related services in Planning, Building, Engineering, and Fire categories. o Policy states that in most instances, cost recovery should be 100%.

City policy further states that user fees for services in Enterprise Funds shall be set at levels which fully cover all direct and indirect costs.

Given the guidance provided by the City’s Budget and Fiscal Policies, and the data synthesized in the comprehensive user fee study, the recommended changes to user fees align with City policy, best practices, and the law.

Any changes to the User Fee Schedule would be effective 60 days after adoption. If changed are adopted on February 4, 2025, new fees would be effective April 5, 2025.

FISCAL IMPACT: Increasing user fees may have multiple impacts to the City’s revenue

Page 1133 of 1195 ends

collections. In some cases, an increase in fees could decrease the number of customers using a specific City service. However, in many other cases, an increase in fees will result in an increase in the City’s ability to recover costs. While it is challenging to quantify exactly how the increase in user fees will translate to an increase in revenues, staff anticipates increasing fees based on the recommendations will have an overall net positive impact on City revenues.

PREVIOUS COUNCIL OR COMMISSION ACTION: The City’s Comprehensive User Fee Schedule was last amended by the City Council on June 18, 2024.

CEQA: Not a project.

Res. No. 73677
RESOLUTION NO. 73677

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN

JOSE SUPPORTING PUBLIC SAFETY AND IMMIGRANT
RIGHTS
WHEREAS, since June of 2006, the U.S. Immigration and Customs Enforcement agency (ICE) has conducted repeated immigration sweeps under "Operation Return to Sender," which has targeted criminal aliens for deportation; and WHEREAS, raids in recent months in Watsonville, Santa Cruz, Redwood City, Contra Costa County, and other locations--conducted for the purpose of arresting undocumented immigrants with serious criminal records--have also netted scores of immigrants with no criminal ties; and
WHEREAS, the San Francisco Chronicle, ICE reported that of the 119 arrested in a set of January sweeps in Contra Costa County, 18 were criminals, while 94 never appeared on ICE's original "wanted" list; and
WHEREAS, as a result of those raids, waves of fear have swept through immigrant communities in California, and within the City of San Jose; and WHEREAS, the City of San Jose has a strong interest in assuring that legal and undocumented immigrants do not fear interacting with their local governmental authorities. In past years, the City has seen how the reluctance of immigrants to interact with local authorities can critically undermine the health and safety of our community. For example, the failure of victims to report crimes, the reluctance of witnesses to cooperate with the police, or the unwillingness of parents to take children to school or to a health clinic, can have grave impacts on the well-being of all of San Jose's residents, including U.S. citizens;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:

T-342.062\ 402158 (2) 1

Res. No. 73677
The City of San Jose reaffirms the San Jose Police Department's longstanding policy that its officers will not arrest persons merely for their unlawful presence in the United States; that no otherwise law-abiding undocumented immigrants should fear arrest or deportation for coming forward to report a crime as a victim or a witness; and that no otherwise law-abiding undocumented immigrants should fear arrest or deportation by contacting any employee of the City of San Jose to express concerns or to ask questions. Moreover, the City of San Jose, maintains that ICE raids-while laudable where they target violent or predatory .criminals for deportation-can have harsh unintended consequences. Those sweeps that have cast the net widely to arrest otherwise law-abiding undocumented immigrants have raised the Council's concern, insofar as they undermine the ability of our police, fire department, and other city agencies to interact with fearful immigrants, leaving all of San Jose's residents less safe.

RESOLUTION NO. 5278

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOLEDAD

DECLARING THE CITY OF SOLEDAD AS A SANCTUARY CITY FOR ALL

RESIDENTS, REGARDLESS OF IMMIGRATION STATUS
WHEREAS, the City of Soledad has historically welcomed individuals of all racial, ethnic, religious and national backgrounds, including a large immigrant population, and has greatly benefitted from the contributions of its rich and diverse residential base; and WHEREAS, Soledad’s immigrant population has and will continue to contribute to the City’s economic and social prosperity by maintaining its role as a significant part of the City’s work force, by establishing and patronizing local businesses, by contributing to arts and culture, and through the achievement of significant educational accomplishments, and WHEREAS, establishing and maintaining a relationship of trust, respect, and open communication between City officials and residents is essential to the City’s mission of the efficient delivery of public services in partnership with its community, an effort which ensures public safety and due process, a prosperous economic environment, opportunities for our youth, and a high quality of life for residents; and
WHEREAS, many citizens, including residents of the City of Soledad, have expressed concern with regard to recent immigration-based federal policies and actions, and are fearful that said policies and actions will have a significant adverse impact on the existing relationship of cooperation and trust between the City and its immigrant population that will ultimately result in irreparable harm to local city operations and the well-being of the City’s residents; and WHEREAS, the City of Soledad desires to address the concerns and fears of its residents in relation to immigration status while at the same time being mindful that it must maintain positions on federal policy that do not affect the financial stability of the City in ways that are detrimental to the health and safety of its residents; and WHEREAS, many cities and towns throughout the United States have been designated “Sanctuary Cities” through the adoption of resolutions, ordinances, policies and practices that demonstrate their commitment to equal, respectful and dignified treatment of all people, regardless of their immigration status; and
WHEREAS, in light of the foregoing, the City Council of the City of Soledad desires to memorialize and clearly articulate its commitment to the equal, respectful and dignified treatment of its citizenry by unequivocally stating that it will provide a sanctuary to all residents who are fearful of recent federal policy and action pertaining to immigration status by assuring them that the City will not expend funds nor use its resources to administer federal immigration law, which should remain under the exclusive authority of the federal government, unless legally required to do so.

NOW THEREFORE, BE IT HERBY RESOLVED by the City Council of the City of Soledad as follows:

1.The City of Soledad hereby declares itself as a place of sanctuary in that no City resources may be used to assist in the enforcement of federal immigration law or to gather or disseminate information regarding the immigration status of individuals or any other such personal information unless and until such assistance is required by federal or state statute, regulation, or court decision. This prohibition includes, but is not limited to, the use of City resources or personnel, including the City’s law enforcement officers, to investigate, question, detain, apprehend, or otherwise participate in such authorities, and/or register persons based solely on a civil violation of federal immigration law. Said prohibition will not, however, forbid City cooperation with federal immigration agencies in matters that involve criminal activity and the protection of public safety or in instances in which the individual to whom requested information pertains provides his or her consent.

2. City of Soledad officials, including its law enforcement officers, will refrain from taking direct action against any individual based solely on his/her actual or perceived immigration status, nor will any individual be held in local custody for a civil immigration hold unless the individual has been convicted or charged with felony offenses, or is a sex or arson registrant. All holds will comply with the provisions of the Truth Act (AB 2792). The Council encourages the Soledad Police Chief and Police Department to continue their ongoing efforts to build and maintain trust with all communities served by the Department.

3. The City Council directs all City departments to review their confidentiality policies in order to ensure that eligible individuals are not deterred from seeking or engaging with City services as a result of their immigration status.

4. City of Soledad officials will not use any public resources or follow any federal program requiring the registration of individuals on the basis of religious affiliation, race, national or ethnic origin, gender, gender identity or sexual orientation.

5. Nothing in this Resolution should be construed or implemented to conflict with any obligation legally imposed by court order or federal law. The City Manager will provide the City Council with notice when the federal government requests or mandates the use of City resources to enforce federal immigration laws. City Staff will also continue to monitor any efforts by the federal government to withhold or withdraw federal funding as a result of the City’s policies to protect and defend its diverse community, and will take action necessary to protect such funding.

6. The Soledad City Council commends the work of local institutions and individuals who join in building a climate of trust and support for our immigrant community.

7. This Resolution is not intended to create or form the basis of liability on the part of the City, its agencies, departments, officers, employees, or agents. It is also not intended to Attachment 2
