2 WHEREAS, various health organizations throughout the world, including the CDC and the World Health Organization (WHO), consider the COVID-19 virus to be a very serious health threat, a “public health emergency of international concern,” and as of March 11, 2020, the WHO identified it as a pandemic; and WHEREAS, on March 12, 2020, the City’s Director of Emergency Services proclaimed the existence of a local emergency within the City and on March 16, 2020, the City Council for the City of Imperial Beach adopted Resolution 2020-13, ratifying the declaration of the Director of Emergency Services and declaring the existence of an ongoing local emergency pursuant to COVID-19 and has renewed the local emergency proclamation regularly including at its last Council meeting on September 21, 2022; and WHEREAS, the Governor of the State of California has stated that individuals exposed to COVID-19 may be temporarily unable to report to work due to illness caused by COVID-19 or quarantines related to COVID-19 and individuals directly and indirectly affected by COVID-19 may experience potential loss of income, health care and medical coverage, and ability to pay for housing and basic needs, thereby placing increased demands on already strained regional and local health and safety resources, including shelters and food banks; and
WHEREAS, as a result of the public health emergency and the precautions recommended and required by health authorities to address the COVID-19 virus, many residential tenants in the City of Imperial Beach have experienced and are expected to experience sudden and unexpected income loss which is out of their control; and
WHEREAS, during this Local Emergency and County public health crisis, and in the interest of protecting the public health and preventing the transmission of COVID-19, it is essential to avoid unnecessary housing displacement due to eviction or rent increases, to protect the City’s available housing stock, and to prevent housed individuals from falling into homelessness; and
WHEREAS, further substantial and long-term economic impacts caused by COVID-19 and the County public health crisis on homelessness are anticipated, leaving residential tenants vulnerable to eviction and rent increases; and WHEREAS, a tenant’s sudden and immediate displacement caused by an eviction or unsustainable rent increase can have a profound impact on the financial, emotional, physical health, and professional stability of a tenant’s life, which impacts are compounded by the ongoing Covid-19 emergency and County public health crisis on homelessness; and
WHEREAS, pursuant to Chapter 2 of the Imperial Beach Municipal Code, the Director recommends that the City Council adopt this ordinance as a local measure in order to protect life and property of the residents of Imperial Beach affected by the declared emergency and public health crisis on homelessness; and
3 WHEREAS, the City Council has the power under Government Code Sections 36934 and 36937 to adopt an ordinance that takes effect immediately if it is an ordinance for the immediate preservation of the public peace, health or safety, contains a declaration of the facts constituting the urgency, and is passed by a fourfifths vote of the City Council; and WHEREAS, the City finds it is necessary for the City Council to adopt this ordinance as an Urgency Ordinance, as set forth in the above recitals, which are incorporated herein by reference, and pursuant to the powers under Government Code Sections 36934 and 36937, for the immediate preservation of the public health and safety, as affected by the emergency caused by the spread of COVID-19 and the County public health crisis on homelessness; and
WHEREAS, this ordinance is exempt from review under the California Environmental Quality Act (CEQA; California Public Resources Code Section 2100 et seq.) and CEQA regulations (Title 14, California Code of Regulations Section 15000, et seq.) because this ordinance is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment (Section 15061(b)(3)).

ITEM TITLE: INTRODUCTION OF ORDINANCE 2022-1219 TO ADOPT THE CALIFORNIA CODE OF REGULATIONS, TITLE 24 PARTS 1 THROUGH 12 WITH APPENDICES, 2022
EDITION WITH AMENDMENTS, ADDITIONS, AND DELETIONS RELATED TO THE CALIFORNIA BUILDING STANDARDS CODE. (0250-95 & 0710-95) ORIGINATING DEPARTMENT:
Community Development
EXECUTIVE SUMMARY:
Every three years, the California Building Standards Commission (CBSC) revises the California Code of Regulations, Title 24, also referred to as the California Building Standards Code. The CBSC has mandated that all jurisdictions within the State start enforcing the 2022 Edition of the California Building Standards Code on January 1, 2023. State law allows the City to adopt the California Building Standards Code with amendments as necessary to meet local conditions.
Without taking action to revise the California Building Standards Code prior to the effective date, the City loses the opportunity to revise the regulations governing new construction. Also, with the adoption of the new California Building Standards Code, changes to the Municipal Code are included to reference the codes and make minor changes to Chapters 8 and 15 of the Municipal Code to coordinate code and zoning requirements. Staff recommends the adoption of these code amendments contained in Ordinance No. 2022-1219 with incorporation of language from our previously approved code adoption and other minor technical changes.
RECOMMENDATION:
That the City Council introduce the ordinance by title only, waiving further reading, and set this matter for public hearing on November 2, 2022 at 6:00 p.m. to allow for adoption of the ordinance.
OPTIONS:
Introduce the ordinance by title only and set the matter for a public hearing and adoption on November 2, 2022
Provide direction to the City Manager to take a specific action Request additional information and an additional report BACKGROUND/ANALYSIS:
In 2019, the City Council adopted the current edition of the California Code of Regulations, Title
P a g e | 2
24, with local amendments by Ordinance Number 2019-1190 as part of the California Building Standards Commission (CBSC) code adoption cycle. On a triennial basis the CBSC adopts the newly revised International Building and Fire Codes or “model codes” in an effort to remain compliant with advancements in recognized fire protection methods, technology and building standards. Individual municipalities are then provided the opportunity to address the specific needs of their communities and make changes to these codes based upon topography, geography, climate, and energy management.
On July 1, 2022, the CBSC published the 2022 edition of California Code of Regulations, Title 24, allowing the City of Imperial Beach this opportunity to amend the new California Building Standards Code before becoming effective on January 1, 2023.
California Code of Regulations, Title 24, is divided into 12 individual parts that establish minimum requirements to safeguard the public health, safety and general welfare for new construction and the maintenance of existing properties. When city staff finds that code sections do not adequately meet the needs of our community, more restrictive regulations may be adopted but must meet state approval. Codes specifically addressing the administrative sections of Title 24 do not require state approval and may be locally amended to meet the needs of the city.
After careful review of the new codes, city staff has determined that only minor technical changes are needed at this time. Portions of the administrative section would receive revisions to resolve language conflicts with the existing Imperial Beach Municipal Code. Additionally, equivalent changes would occur within the Imperial Beach Municipal Code to further enhance the ability of city staff to maintain building safety standards. To complete the code adoption, previously approved changes included in the 2019 code adoption ordinance have been carried forward in this adoption as they continue to enhance the city’s ability to effectively maintain public safety and provide aid within our community.
Exhibits A through L detail the amendments being proposed.
Staff recommends introducing the ordinance and setting the public hearing for the Regular City Council meeting of Wednesday, November 2, 2022 at 6:00 p.m.
ENVIRONMENTAL DETERMINATION:
Not a project as defined by CEQA.
FISCAL IMPACT:
There is no anticipated fiscal impact to the city, conforming existing development or currently permitted projects conforming to current code.

ITEM TITLE: ADOPTION OF RESOLUTION NUMBER 2022-77 AUTHORIZING THE CITY
MANAGER, OR DESIGNEE, TO PURCHASE A PIERCE ARROW XT MULTI PURPOSE RESPONSE VEHICLE. (1120-10)
ORIGINATING DEPARTMENT:
Fire
EXECUTIVE SUMMARY: Traditionally, the City of Imperial Beach has attempted to replace the main fire engine about every ten years. The last fire engine was purchased in 2014 and it is prudent to begin the process to purchase a new fire engine at this time due to the time it takes to order, build and receive deliver of the new engine. Adoption of Resolution 2022-77 would authorize the City Manager, or designee, to place an order to build and subsequently purchase a Pierce Arrow XT multi-purpose response vehicle from Pierce Manufacturing in accordance with the Imperial Beach Fire-Rescue specifications at an estimated price of $1,214,808.83.
RECOMMENDATION:
Staff recommends the City Council adopt Resolution 2022-77 authorizing the City Manager, or designee, to purchase a Pierce Arrow XT multi-purpose response vehicle from Pierce Manufacturing in accordance with the Imperial Beach Fire-Rescue specifications at an estimated price of $1,214,808.83.
OPTIONS:
Adopt Resolution No. 2022-77 with direction to the City Manager to Purchase the response vehicle.
Provide direction to the City Manager to take another specific action. Request additional information and an additional report. Deny the request.
BACKGROUND/ANALYSIS: The City of Imperial Beach Fire-Rescue Department currently has a fleet of two multi-purpose response vehicles. The primary response vehicle is a 2014 Pierce with more than 67,000 miles of use. The back up response vehicle is a 2004 Pierce with more than 130,000 miles of use. Because the need is around the clock, every day of the year, the FireRescue Department utilizes two engines capable of responding to the various emergencies in and around the City. This allows for routine maintenance to be performed on each, while keeping the company in service to respond to emergencies. Additionally, one of the City’s fire companies could be called into action on a county, state, or federal level during wider scale emergencies as
P a g e | 2
a result of automatic or mutual aid agreements or boundary drops. Having a reliable fleet of response vehicles is critical and the Fire Department has an apparatus schedule where the apparatus is the primary response vehicle for ten years and the backup response vehicle for another ten years.
The design, construction and delivery of a fire engine takes many months. Approval of Resolution No. 2022-77 would allow the City of Imperial Beach to receive a new Pierce Arrow XT multipurpose response vehicle in mid-2025.
Purchase of the new apparatus will initially be funded through a financing agreement with Pierce Arrow’s financing partner. However, in December 2021, City Council approved Resolution 2021- 88 which set aside $500,000 towards a new engine purchase. These funds will be applied toward payment of the lease. Additionally, staff is looking into obtaining funding through CDBG, in the amount of approximately $100,000 - $125,000 per year, over a three-to-five-year period, to offset the additional costs of the new apparatus. However, CDBG funding is approved on an annual basis so future allocations and awards cannot be fully guaranteed at this time. Therefore, staff will anticipate budgeting approximately $100,000 in the General Fund each year, for approximately the next 6 years, to ensure that adequate funds are available as payments become due.
ENVIRONMENTAL DETERMINATION:
Not a project as defined by CEQA.
FISCAL IMPACT: Payment for the new fire apparatus will be funded from a combination of reserves ($500,000 that was set aside in FY 2021-2022), potential CDBG funding, and budgeted General Fund monies, as necessary.

The following paragraphs will describe in detail the apparatus, construction methods, and equipment proposed. This proposal will indicate size, type, model and make of components parts and equipment, providing proof of compliance with each and every item (except where noted) in the departments advertised specifications.
PIERCE MANUFACTURING was founded in 1913. Since then we have been building bodies with one philosophy, "BUILD THE FINEST". Our skilled craftsmen take pride in their work, which is reflected, in the final product. We have been building fire apparatus since the early "forties" giving Pierce Manufacturing over 75 years of experience in the fire apparatus market. Pierce Manufacturing has built and put into service more than 62,500 apparatus, including more than 33,900 on Pierce custom chassis designed and built specifically for fire and emergency applications. Our Appleton, Wisconsin facility has over 870,000 total square feet of floor space situated on approximately 105 acres of land. Our Bradenton, Florida facility has 300,000 square feet of floor space situated on approximately 38 acres of land.
Our beliefs in high ethical standards are carried through in all of our commitments and to everyone with whom we do business. Honesty, Integrity, Accountability and Citizenship are global tenets by which we all live and work. Consequently, we neither engage in, nor have we ever been convicted of price fixing, bid rigging, or collusion in any domestic or international fire apparatus market.
Pierce has only one brand of fire apparatus "Pierce", ensuring you are receiving top of the line product that meets your specification.
In accordance with the current edition of NFPA 1901 standards, this proposal will specify whether the fire department, manufacturer, or apparatus dealership will provide required loose equipment.

The auxiliary inlet will be provided with a strainer, chrome swivel and plug.
ANODE, INLET
A pair of sacrificial zinc anodes will be provided in the water pump inlets to protect the pump from corrosion.
INLET BLEEDER VALVE
A 0.75" bleeder valve will be provided for each side gated inlet.
The valves will be located behind the panel with a "T" swing style handle control extended to the outside of the panel.
The handles will be chrome plated and provide a visual indication of valve position. The swing handle will provide an ergonomic position for operating the valve without twisting the wrist and provides excellent leverage.
The water discharged by the bleeders will be routed below the chassis frame rails.
TANK TO PUMP
The booster tank will be connected to the intake side of the pump with heavy duty 4.00" piping and a quarter turn 3.00" full flow line valve with the control located at the operator's panel. A rubber coupling will be included in this line to prevent damage from vibration or chassis flexing.
A check valve will be provided in the tank to pump supply line to prevent the possibility of "back filling" the water tank.

TANK REFILL
A 1.50" combination tank refill and pump re-circulation line will be provided, using a quarter-turn full flow ball valve controlled from the pump operator's panel.
DISCHARGE OUTLET CONTROLS
The discharge outlets will incorporate a quarter-turn ball valve with the control located at the pump operator's panel. The valve operating mechanism will indicate the position of the valve or an indicator will be provided to show when the valve is closed.
The right side discharges will be controlled by an Akron 9335 electric valve controller provided on the pump operators panel. The electric control must be of a true position feedback design, requiring no clutches in the motor or current limiting. The unit must be completely sealed with momentary open, close as well and an optional one touch full open feature to operate the valve actuator. The controller will provide position indication on a full color, backlit LCD display. It will have manual adjustment of the brightness as well as an auto dimming option. In addition to the valve controls, the electric valve controller will include a pressure display
Additional Two (2) discharge outlets will have Akron 9333 electric valve controllers provided on the pump operator's panel. The outlet(s) will be located to be determined. The electric control(s) must be of a true position feedback design, requiring no clutches in the motor or current limiting. The unit(s) must be completely sealed with momentary open, close as well and an optional one touch full open feature to operate the valve actuator. The controller(s) will provide position indication on a full color, backlit LCD display. They will have manual adjustment of the brightness as well as an auto dimming option.
All other outlets will have manual swing handles that operate in a vertical up and down motion. These handles will be able to lock in place to prevent valve creep under pressure.
LEFT SIDE DISCHARGE OUTLETS
There will be two (2) discharges with a 2.50" valves on the left side of the apparatus, terminating with a 2.50" (M) National Standard hose thread adapter. Discharges will be located below the cab, and will be no higher than the top of the chassis frame rail. Discharges will not be located on the pump operator's panel. Lever controls will be provided at the valve.
RIGHT SIDE DISCHARGE OUTLETS
There will be One (1) discharge outlet with a 2.50" valve on the right side of the apparatus, terminating with a 2.50" MNST adapter. The discharge(s) will be located below the crew cab and will be no higher than the top of the chassis frame rail.
