ITEM TITLE: CONSIDERATION OF THE REVIEW PROCESS OF IMPERIAL BEACH MUNICIPAL CODE CHAPTER 4.60 “CANNABIS FACILITIES” TO CONSIDER ANY CHANGES TO THE CITY’S CANNABIS REGULATIONS MF 1550. (0610-95) ORIGINATING DEPARTMENT:

Community Development
EXECUTIVE SUMMARY:

On July 18, 2018, the City Council adopted Ordinances No. 2018-1173 and No. 2018-1174 amending Title 4 (Business Taxes, Licenses and Regulation) of the Imperial Beach Municipal Code (“IBMC”) to allow for limited commercial cannabis activities in Imperial Beach with regulations. Pursuant to IBMC Section 4.60.230, the City Council shall review Chapter 4.60 Cannabis Facilities five years after its approval by appointing an ad hoc subcommittee of the City Council to perform the review and report any findings or recommendations to the City Council.

Additionally, in accordance with IBMC Section 4.60.060, a minimum of twelve (12) months after the opening of the first Cannabis Permitted Use, the City Council may consider allowing a second Cannabis Permitted Use pursuant to a review of pertinent factors. The City has issued one Regulatory Safety Permit (RSP 22-01) allowing for the operation of a retail cannabis outlet, which has been in operation for over one year at the time of this report. City staff has collected data related to the factors as directed by the City Council and can compile that data as part of the review process once the City Council has provided input on the method to conduct the review.

RECOMMENDATION:

That the City Council consider and discuss the item and:

1. Appoint a limited term ad hoc subcommittee of the City Council to work with staff to review IBMC Chapter 4.60 and submit the findings/recommendations at a future Council meeting; and/or

2. Provide direction to staff to perform the review with input on the pertinent factors such as whether or not the City Council wants to pursue any modifications to the ordinance to allow an additional cannabis facility.

OPTIONS:
 Consider the information provided and do nothing at this time;  Discuss the item and vote to appoint an ad hoc subcommittee; or  Continue the agenda item with direction to staff to provide additional information.

BACKGROUND/ANALYSIS:

On July 18, 2018, the City Council adopted Ordinance 2018-1174 amending Title 4 of the IBMC to allow for limited commercial cannabis activities and Ordinance No. 2018-1173 to create Chapter 4.60 “Cannabis Facilities”, which provides for the City’s regulations of cannabis activities within the City. Pursuant to IBMC Section 4.60.230, the City Council must review IBMC Chapter

4.60, at a minimum, five years after its approval by appointing an ad hoc subcommittee of the City Council to perform a review and report any findings or recommendations to the City Council.

Recommendations may include but are not limited to amendments to the separation requirements for cannabis permitted uses, changes to the application process, updated requirements for the issuance of a regulatory safety permit (“RSP”), revised design requirements, and/or changes to reflect updates to state law. The City Council may also decide not to make any substantive changes to Chapter 4.60.

In addition to reviewing the City’s Cannabis Facilities ordinance, IBMC Section 4.60.060 states that allowance of a second cannabis facility may be considered by the City Council at least 12 months following the opening of the first facility. On March 24, 2022, the City issued Regulatory Safety Permit 22-01 allowing for the operation of a retail cannabis outlet at 740 Palm Avenue, which has been in operation for over one year at the time of this report. Consideration for a second facility would include review of pertinent factors, including, but not limited to: complaints, criminal activity, license status of the currently operating cannabis permitted use, public input, research findings, and the application review process. In addition to these factors, in December 2021, the City Council requested that staff prepare a monitoring plan that incorporates baseline data and metrics for monitoring the impacts of a cannabis permitted use. In response, staff met with representatives from the Sheriff’s Department, Sweetwater Union High School District, and various City Departments to prepare a monitoring plan and form that would gather violations, complaints, and other related information. The data collected through the monitoring form may provide additional assistance when considering the impact of cannabis permitted uses within the community. Such data can be reviewed by the ad hoc subcommittee and presented to the City Council with its recommendations related to this issue. Additionally, this City Council may provide direction related to other information it would like to consider on this topic.

ENVIRONMENTAL DETERMINATION:

Not a project as defined by CEQA.

FISCAL IMPACT:

There will be staff time and legal fees as it relates to modifying the cannabis regulations.

ITEM TITLE: RESOLUTION 2023-80 TO ACCEPT AND APPROPRIATE $150,000 IN STATE

ACTIVE TRANSPORTATION GRANT PROJECT APPROVAL & ENVIRONMENTAL

DOCUMENT FUNDS FOR THE PALM AVENUE COMPLETE MULTIMODAL CORRIDOR PROJECT (S22109). (0390-86)
ORIGINATING DEPARTMENT:

Public Works
EXECUTIVE SUMMARY: This resolution accepts and appropriates $150,000 in State Active Transportation Grant funding for the Project Approval & Environmental Document (PA&ED) stage for the Palm Avenue Complete Multimodal Corridor Project (S22109). The City has successfully applied for a Cycle 6 Active Transportation Program (ATP) grant to support the design and construction of this project. This will be a multi-benefit project to address storm water, active transportation, landscaping, aesthetic and safety improvements on Palm Avenue.

RECOMMENDATION:

Adopt Resolution 2023-80 to accept and appropriate $150,000 in State Active Transportation Grant funding for Project Approval & Environmental Document portion of the project.

OPTIONS:
 Adopt Resolution to accept and appropriate the State Active Transportation PA&ED funds for the Palm Avenue Complete Multimodal Corridor project for this phase of the project; or
 Request additional information and an additional report.

BACKGROUND/ANALYSIS:

Palm Avenue is a critical corridor for the local community and region as it provides access to essential destinations including schools, beach, library, regional employers (military facilities), transit facilities (Palm Avenue Station), residential homes, and commercial centers where people can access restaurants, grocery stores, and other daily services.

The City is fortunate to have been awarded this ATP grant to rehabilitate Palm Avenue within the City of Imperial Beach to make storm water, active transportation, landscaping, aesthetic and safety improvements. The Project Approval & Environmental Document stage is a process that considers the project background, relevant data, consults with other regulatory agencies, and clarifies transportation issues. The project will provide an enhanced travel experience and environment for motorized and non-motorized users through the implementation of protected bike

facilities, transit boarding islands, upgraded sidewalks with landscaping, traffic calming features, and intersection improvements. A review of the existing conditions and previous planning efforts/outreach demonstrated the need to address multiple community concerns along the corridor including safety, connectivity, and protection/visibility of vulnerable users such as children, pedestrians, and bicyclists. The proposed improvements were designed to address these identified community concerns and Palm Avenue will be designed to ensure a safer corridor.

The project will require additional public and stakeholder participation and review by the City Council prior to any final designs.

ITEM TITLE: RESOLUTION NO. 2023-81 AWARDING A PUBLIC WORKS CONTRACT TO

PAR WESTERN LINE CONTRACTORS, LLC TO CONSTRUCT THE FIBER OPTIC IMPROVEMENTS – PHASE 2 PROJECT (S20112) AND APPROPRIATING ADDITIONAL FUNDS TO THE PROJECT BUDGET. (0810-15)
ORIGINATING DEPARTMENT:

Public Works
EXECUTIVE SUMMARY: Resolution No. 2023-81 awards a construction contract to Par Western Line Contractors, LLC to complete the Fiber Optic Improvements – Phase 2 (Project) for a not-toexceed price of $331,000. Par Western Line Contractors, LLC was the lowest responsible and qualified bidder during the public bid opening held on September 28, 2023.

On February 15, 2023, Resolution No. 2023-05 added the Port District Fiber Optic Infrastructure Project to the Imperial Beach Capital Improvement Program. This previous project with the Port District installed the fiber optic cabling backbone for City facilities and traffic signals. This Project is Phase 2 and will bring the fiber optic cabling into City facilities for a faster and more secure network, will install traffic signal upgrades, and will create a Traffic Management Center at the Public Works facility.

RECOMMENDATION:

Adopt Resolution No. 2023-81 to: (1) award the construction contract to Par Western Line Contractors, LLC for an amount not-to-exceed $331,000 for the Fiber Optic Improvements – Phase 2 Project (S20112).

OPTIONS:
 Approve resolution and recommendation from staff.
 Authorize the Public Works construction contract to Par Western Line Contractors, LLC. and identify a different funding source for the additional budget needs.  Reject bids and provide direction to staff on how to proceed on the project.  Request additional information and an additional report.

BACKGROUND/ANALYSIS:

The Port District Fiber Optic Infrastructure project furnished the fiber optic cabling backbone in the following locations throughout the City including Imperial Beach Boulevard from 13th Street west to 2nd Street; 2nd Street from Imperial Beach Boulevard north to Elder Avenue; and Elder Avenue from 2nd Street west to the Dempsey Center building; along 9th Street from Imperial Beach Boulevard north to Cypress Avenue; Cypress Avenue from 9 th Street east to 10th Street; 10th Street
from Cypress Avenue north to the Bayshore Bikeway; Palm Avenue from 13th Street west to Rainbow Drive; Rainbow Drive from Palm Avenue north to State Route 75;

P a g e | 2
Phase 2 of the Fiber Optic Improvement project will connect the cabling from where the Port District left off and install fiber optic communication infrastructure into three (3) City facilities (City Hall, Public Works and Sports Park Recreation Center). This will include traffic signal upgrades and a Traffic Management Center at the Public Works facility.

The Project was advertised for construction bids on September 7, 2023. A Non-Mandatory job walk was held on September 18th and a public bid opening was held on September 28, 2023.

The following are the bid results:

Base Bid

1. Par Western Line Contractors, LLC

2. Vector Resources, Inc. dba Vector USA

3. DBX, Inc.
$306,086.59
$390,347.32
$396,250.00
The Engineer’s Estimate for the base bid was $312,000.

Upon review of the bids, the lowest responsible and qualified bid was submitted by Par Western Line Contractors, Inc. Staff recommends awarding the contract for a not-to-exceed amount of $331,000 to Par Western Line Contractors, Inc.

At the May 6, 2020 City Council meeting Council approved a Memorandum of Agreement between SANDAG and the City of Imperial Beach via Resolution 2020-36 for SANDAG to provide advance funding through debt financing to appropriate to the SR-75 Signal Interconnection project in the amount of $600,000. These funds are to be used to make roadways more functional by providing safe connections between residences, schools, transit, tourist attractors and businesses. These funds will also be used to interconnect the traffic signal lights on Palm Avenue to allow for better flowing traffic during high peak times.

ENVIRONMENTAL DETERMINATION:

The project may be considered exempt per California Environmental Quality Act (CEQA) Guidelines Section 15301 (Existing Facilities) and Section 15304 (Minor Alterations to Land) because minor alterations would occur to existing public facilities/rights-of-way with negligible or no expansion of an existing use, and a Notice of Exemption would be filed with the County of San Diego. In addition, the project would be considered exempt from a Coastal Development Permit per Imperial Beach Municipal Code Section 19.87.040, Exempt Projects.

FISCAL IMPACT:

Budget:

SR-75 Signal Interconnection Project (S20112) Balance $ 64,000 RTCIP Fund $277,000
SB1 Fund $ 10,000
TOTAL REVENUE $351,000
Expenditure:

Public Works Contract – Construction $ 307,000

BACKGROUND/ANALYSIS:

The City has completed hiring new staff in various departments currently housed in the City Hall complex to provide needed services to the community. In particular, new staff members have been hired to fill vacant positions within the Recreation and Human Resources Departments. With these personnel additions, new office spaces are required to house and equip the new staff. In January 2023, a project was completed to convert the Mayor’s Office located at City Hall in the administration office into two offices for the Human Resources Department. This allowed the Recreation Department to expand into the previous Human Resources office, which is a shared office. With the conversion of the Mayor’s Office into administrative offices for the City, a new location for the Mayor’s Office is needed. The Project proposed will improve the entire Community Room to include an office area for the Mayor. The improvements to the Community Room will include upgrades to the flooring, lighting, paint, audio and visual, and improvements throughout, as well as construction of a new office at the north end of the building.
