CITY MANAGER' S REPORT
MAY 12, 2025 CITY COUNCIL MEETING REGULAR MEETING
ITEM:

ITEM 5. 3

PUBLIC HEARING ( PUBLISHED NOTICE) TO
CONSIDER FISCAL YEAR 2025/6 ASSESSMENTS

FOR THE LANDSCAPE AND LIGHTING MAINTENANCE
DISTRICT NO. 93- 1 WOODFIELD PARK

MAINTENANCE ZONE
RECOMMENDATION: Council to Consider the Following:

1. Hold a Public Hearing; and

2. Adopt a Resolution Amending and / or Approving
the Final Engineer' sReport and Ordering the Levy
and Collection of Assessments for the Landscape
and Lighting Maintenance District No. 93- 1
Woodfield Park Maintenance Zone for Fiscal Year
2025/6; Proposed Annual Assessment for FY
2025/6not to exceed $ 123. 90
SUMMARY:

At the April 14, 2025 City Council Meeting, Staff presented the preliminary Engineer' s Report and Intent to Levy for the Landscape and Lighting Maintenance District No. 93- 1 Woodfield Park Maintenance Zone (" Woodfield Park") or (" District") to Council for approval, and requested to set a public hearing date to initiate the final approval process.

The City Council approved the preliminary Engineer' sReport and Intent to Levy for the District and set the public hearing date for May 12, 2025. The public hearing was published in the Manteca Bulletin on April 23rd and April 30th of 2025.

The revenues for the District do not meet expenditures, and while City Staff has cut costs in an effort to minimize the shortfall, a General Fund subsidy of $ 64, 421, will be required to maintain current service levels. In order to prevent the annual need of General Fund subsidies, a Proposition 218 balloting of the district' sproperty owners would have to be successfully completed, which would amend the assessment rate and provide for an annual escalation factor. This is not being proposed at this time.

Woodfield Park is proposed to be levied at a rate of $ 123. 90 per Equivalent Dwelling Unit ( EDU). The assessment rate of $123. 90 per EDU has been in effect since Fiscal Year 1998/ 99and is not proposed to increase.

The table below displays the current and proposed assessment rates. 913

Tonight, the City Council is being asked to approve the final Engineer' sReport for the Landscape and Lightning Maintenance District No. 93- 1 Woodfield Park Maintenance Zone and order the levy and collection of annual assessments for Fiscal Year 2025/6.

City Council may order amendments to the Engineer' sReport or confirm it as submitted. If approved, the assessment information will be submitted to the County Auditor -Controller and included on the property tax roll for each benefiting parcel for Fiscal Year 2025/6. The collected monies will fund Woodfield Park operation and maintenance costs.

BACKGROUND:

Maintenance Districts are formed to fund services and improvements that provide special benefit to the properties within the District' s boundaries. Improvements may include landscaping, park sites, street lightning and storm drainage. The Districts levies are made pursuant to the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code ( the " Act"), applicable to the provisions of Proposition 218 ( California Constitutional Articles XIII C and XIII D).

Each parcel within a District is assessed in accordance to assessment methodology adopted and approved by the City Council at the time of District formation. The assessments are paid by the property owner as a part of each parcel' s secured property tax bill.

NBS performs an annual review of the Districts, evaluating costs of the maintenance, operations, and servicing of the improvements to be maintained. The process is generally initiated in March. Upon the completion of the review, NBS submits a preliminary Engineer' sReport ( the " Report") to City staff which includes a district overview, estimate of costs, method of apportionment, district diagrams, and parcel listing. City staff utilizes the Report findings to produce the District' sannual budget.

The City of Lathrop has eight ( 8) Maintenance Assessment Districts ( MAD): five ( 5) Landscaping and Lighting Districts ( LLMD), including Woodfield Park; three ( 3) Benefit Assessment Districts ( BAD). Woodfield Park was created to fund the cost of the operation and maintenance of specific park improvements within Tract 2051. This 914

includes costs for personnel to maintain buildings and equipment and the cost for contracted park maintenance.

Woodfield Park reporting is submitted on a stand- alone basis due to the size of the district and because a City Council member currently resides within the district. (Legal guidelines generally prohibit legislative body members from voting on matters involving districts where they reside if the district( s) in question comprise less than 10% of the agency' stotal residential parcels as defined by the County Assessor.) Woodfield Park will receive $ 54, 763. 80in revenue from assessments. The total expenditures for this District are $ 142, 861, which creates a shortfall of $ 88, 097. The fund balance at the beginning of Fiscal Year 2025/6is estimated at $ 23, 676. 20 which will be fully used by the end of Fiscal Year 2025/6, resulting with a balance of $ 0.0. In order to keep the same service levels in the District, a General Fund subsidy in the amount of $ 64, 421 will be needed to fund the remaining shortfall.

Woodfield Park is proposed to be levied at a rate of $ 123. 90 per Equivalent Dwelling Unit ( EDU). The assessment rate of $ 123. 90 per EDU has been in effect since Fiscal Year 1998/ 99and is not proposed to increase.

The Woodfield Park District was created several years ago, without a revenue inflation factor. This means Woodfield Park has a maximum assessment rate that does not escalate to mirror increases in district expenses. The imbalance of Woodfield Park' s expenditures will continue due to the lack of the revenue inflation factor. In order to remedy this imbalance, a Proposition 218 balloting of Woodfield Park' s property owners would have to be initiated and successfully completed.

By law, assessments may only increase to the maximum approved amount set by property owners at the time of district formation or annexation. Any proposed increase which exceeds the approved amount requires the approval of the then - current property owners via a Proposition 218 ballot process. Each of the City' s Districts has a maximum assessment amount. The City Council may authorize any level of assessment up to the maximum amount. If it is determined that the maximum amount is not needed, City Council may lower the actual annual assessment without jeopardizing the ongoing maximum assessment.

The final Engineer Report for Woodfield Park is available for review at the City Clerk' s office and the Public Works Department. Copies will be available at the City Council meeting per request.

1. EXECUTIVE SUMMARY
The City Council of the City of Lathrop (the " City"), State of California, directed NBS to prepare and file a report presenting plans and specifications describing the general nature, location, and extent of the improvements to be maintained, and an estimate of the costs of the maintenance, operations, and servicing of the improvements for the City of Lathrop Landscape and Lighting Maintenance District No. 93- 1 (the " District") for Fiscal Year 2025/6 including only the Woodfield Park Maintenance Zone. The report includes a diagram for the District showing the area and properties proposed to be assessed, an assessment of the estimated costs of the maintenance, operations and servicing the improvements, and the net amount to be assessed upon all assessable parcels within the District in proportion to the special benefit received;
The proposed assessment rate of $123. 90 per Equivalent Dwelling Unit (" EDU") has not increased from the previous year. The District is in compliance with the assessment balloting procedures set forth in Section 4 of Article XIII D of the California Constitution and the District was formed by consent of 100% of the landowners;
Only parcels that receive direct special benefit are assessed, and each parcel is assessed in proportion to the estimated benefit received. The following assessment is made to fund the portion of the estimated costs of maintenance, operation, and servicing of the improvements to be paid by the assessable real property within the District in proportion to the special benefit received:

2. OVERVIEW

2. 1 Introduction
The City previously formed several maintenance assessment districts for the purpose of providing maintenance services to benefit certain parcels in the City. Over several years, these districts have levied and collected special assessments. In 1993, the districts were consolidated, and now represent distinct zones in the District. The District was formed and the levies made pursuant to the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code ( the " Act").

Since Fiscal Year 1998/ 99, only the Woodfield Park Maintenance Zone has been included in the annual assessment of the District.

This Annual Engineer' sReport (the " Report") describes the District and the proposed charge per EDU for Fiscal Year 2025/6 based on the historical and estimated cost to maintain the improvements and provide the services that benefit parcels within the District. Maintenance and operation of the facilities provides a healthy alternative for youth and adult activities while protecting the capital investments that have been made within the District.

The word " parcel," for the purposes of this Report, refers to an individual property assigned its own Assessor' s Parcel Number by the San Joaquin County ( the " County") Assessor' sOffice. The County Auditor -Controller uses Assessor' sParcel Numbers and specific fund numbers to identify, on the tax roll, properties assessed for special district benefit assessments.

Following consideration of public comments at a noticed public hearing and following review of the Report, the City Council may confirm the submittal of the Report and may order the levy and collection of assessments for Fiscal Year 2025/6. If approved, the assessment information will be submitted to the County Auditor -Controller and included on the property tax roll for each benefiting parcel for Fiscal Year 2025/6.

2. Effect of Proposition 218
On November 5, 1996, California voters approved Proposition 218 by a vote of 56.% to 43. 5%. The provisions of the Proposition, now California Constitutional Articles XIII C and XIII D, added substantive and procedural requirements for assessments which affect the City' slandscaping and lighting maintenance assessments.

The assessment rate of $123. 90 per EDU has been in effect since Fiscal Year 1996/ 97 and is not proposed to increase. The District is in compliance with the assessment balloting procedures set forth in Section 4 of Article XIII D and the District was formed by consent of 100% of the landowners.

2. 3 Plans and Specifications for the Improvements
The City operates, services, and maintains Woodfield Park ( 5. 49 acres).

The District includes parcels within Tract 2051 and consists of a residential area generally located east of 1-5, west of the Union Pacific Railroad, and north of Lathrop Road. Parcels within this zone receive special benefit from the Woodfield Park improvements. Specific improvements within this zone include planting materials, irrigation systems, drainage systems, natural drainage areas, fencing, restroom facilities, playground equipment, picnic facilities, and hardscape.

Total District Costs 142, 861. 00

3. Balance to Levy
Total District Costs — Includes personnel services, maintenance and operations, capital, and indirect costs determined above.

Contribution to (from) Operational Reserves — The Operational Reserves item provides funds to operate the District from the time period of July 1 ( beginning of the Fiscal Year) through December when the County provides the City with the first installment of assessments collected from the property tax bills. This eliminates the need for the City to transfer funds from non -District accounts to pay for District charges during the first half of the fiscal year. Negative amounts shown here are transfers that are used to reduce the Balance to Levy. Using reserve amounts in this way allows the Levy per EDU to remain at prior period rates, despite increases in District costs.

Contribution to (from) Capital Reserves — The Capital Reserve Account item provides funds to maintain reserves for extraordinary maintenance items and unexpected capital expenditures that may occur as a result of natural occurrences or other unforeseen circumstances.

Balance to Levy — This is the total amount to be levied and collected through assessments for the current fiscal year. The Balance to Levy represents the sum of the total direct and administration costs, reserves, contributions, and other revenue sources.

4. METHOD OF APPORTIONMENT

4. 1 Method of Apportionment
Pursuant to the Act, the costs of the District are apportioned by a formula or method which fairly distributes the net amount to be assessed among all assessable parcels in proportion to the estimated special benefit to be received by each such parcel from the maintenance, servicing, and operation of the improvements. The formula used for the Woodfield Park Maintenance Zone reflects the homogenous composition of the parcels, as well as the improvements and services provided to fairly proportion the costs based on the estimated benefits to each parcel. The assessment has been levied in accordance with the assessment methodology adopted and approved by the City Council at the time of District formation.

The basis of benefit for the District was determined to be equal for all EDUs within the Woodfield Park Maintenance Zone.

The method used to calculate the assessments within the Woodfield Park Maintenance Zone is as follows:

Total Balance to Levy / Total EDU = Levy per EDU
To determine the EDU for single- family residential parcels, the Benefit Unit Factor (BUF) is multiplied by the number of developed residential units on the parcel.

To determine the EDU for vacant ( no buildings) residential parcels, the BUF is multiplied by the number of residential units that can be built on the parcel.

To determine the EDU for unimproved residential parcels, the number of potential parcels is calculated per the approved tentative map and the BUF is multiplied by that number of parcels.

All parcels in the District have been developed as single- family residential and there are currently no vacant or unimproved residential parcels.

4. 2 Benefit Unit Factors
The following table shows the Benefit Unit Factors.

Property Type / Land Use BUF per Unit
Single -Family Residential 1. 0
Vacant Residential Parcels 1. 0

CITY MANAGER' S REPORT
MAY 12, 2025 CITY COUNCIL REGULAR MEETING
ITEM: PUBLIC HEARING ( PUBLISHED NOTICE) TO

CONSIDER A RESOLUTION TO ADOPT THE CITY OF

LATHROP BIENNIAL CAPITAL IMPROVEMENT PLAN
BUDGET FOR FISCAL YEARS 2025-026 AND 2026-
2027
RECOMMENDATION: City Council to Consider the Following:

1. Hold a Public Hearing; and

2. Consider a Resolution to Adopt the City of
Lathrop Biennial Capital Improvement Plan
Budget for Fiscal Years 2025-026 and 2026-
2027
SUMMARY:

The City' s Capital Improvement Program ( CIP) is a comprehensive 2 -year program of capital improvements needed within the City. The CIP is a proposed schedule for the expenditure of funds to maintain, acquire, or construct these necessary improvements over the two- year period.

The CIP plays a significant role in the implementation of the City' scomprehensive general plan by providing the link between planning and budgeting for capital projects. Pursuant to California Government Code Section 65401, Planning Commission Resolution 25- 4, approved on April 16, 2025, determined the proposed CIP' s for Fiscal Years 2025-026 and 2026-027 are in conformance with the City' s General Plan. This report is an overview of the program for City Council' s consideration. Adoption of the capital improvement budgets for the corresponding appropriations for funding Fiscal Years 2025-026 and 2026-027 will coordinate with the adoption of the City' s operating budgets.

BACKGROUND:

The CIP is a multi - year planning instrument used to identify the needs and financing sources for public infrastructure maintenance and improvements. CIP are projects with major physical improvements within the City and/ or expenditures that involve significant resources outside of the City' s operating budget. Capital projects tend to be special one- time projects designed to address or study a significant community need or problem. CIP excludes ongoing maintenance projects, replacement of equipment, and operating programs. This report provides City Council with a list of potential capital improvement projects and special studies with the intent of determining financial feasibility.

A total of sixty- eight (68) improvement projects are included in this year' slist: 39 on -going projects, 9 proposed projects, 7 future projects, and 13 regulatory compliance programs.

The list of on -going, proposed and future projects includes:

Twelve ( 12) General Government and Public Safety Projects; Six ( 6) Parks and Recreation Improvement Projects;
Fifteen ( 16) Street Improvement Projects;
Seven ( 7) Water Improvement Projects;
Four ( 4) Drainage Improvement Project;

One ( 1) Recycled Water Improvement Project; and
Thirteen ( 13) Regulatory Compliance Programs.

Although only the corresponding appropriations for funding Fiscal Year 2025-026 and 2026-027 will be funded, the CIP is a 2 -year programming document that serves as a guide for outlining the timing and financing schedules of capital and infrastructure projects for a 2 -year planning period, and for the next Fiscal Year capital improvement budget.

CITY MANAGER' S REPORT
MAY 12, 2025 CITY COUNCIL REGULAR MEETING
ITEM:

RECOMMENDATION:

PUBLIC HEARING ( PUBLISHED NOTICE) TO
CONSIDER AN ORDINANCE TO ADD CHAPTER 9. 06
ENTITLED " CAMPING OR SLEEPING IN MOTOR
VEHICLES OVERNIGHT PROHIBITED" TO TITLE 9,
PUBLIC PEACE AND WELFARE" OF THE LATHROP
MUNICIPAL CODE.

City Council to Consider the Following:

1. Hold a Public Hearing; and

2. First Reading and Introduction of an Ordinance to
add Chapter 9. 06 entitled " Camping or Sleeping in
Motor Vehicles Overnight Prohibited" to Title 9
Public Peace and Welfare" of the Lathrop Municipal
Code.

SUMMARY:

The proposed Ordinance would prohibit individuals from using or occupying motor vehicles for sleeping, camping, or habitation in unauthorized areas. This includes public property during nighttime hours, as well as private property without the owner' sconsent. While there may be various reasons someone may use a vehicle for temporary shelter, this activity can obstruct access, degrade public spaces, and present sanitation and safety challenges.

The proposed Ordinance aims to protect the integrity of neighborhoods, ensure public areas remain clean and accessible, and provide enforcement tools for managing prolonged vehicle habitation in a consistent, lawful manner.

BACKGROUND:

As in many other cities across California, the City has encountered instances of individuals using motor vehicles as makeshift living accommodations on both public and private property. Although such use may occur in response to hardship, it can result in conditions that negatively impact access, sanitation, and the safety of nearby residents.

The Lathrop Municipal Code does not currently contain a provision that directly addresses overnight occupancy of vehicles. This ordinance is intended to close that gap while ensuring enforcement is handled fairly and with consideration of circumstances.

ORDINANCE TO ADD CHAPTER 9. 06 ENTITLED " CAMPING OR SLEEPING IN MOTOR VEHICLES OVERNIGHT PROHIBITED" TO TITLE 9, "PUBLIC PEACE AND WELFARE" OF THE LATHROP MUNICIPAL CODE.

ANALYSIS:

The use of motor vehicles for overnight sleeping or habitation, particularly in public areas, presents a number of challenges that impact public safety, quality of life, and City resources. While some individuals may resort to this behavior due to personal circumstances, the need for a local regulatory framework has become apparent due to the following observed and potential impacts:

Obstruction of Public Access - Vehicles used for habitation are often parked for extended periods in front of homes, businesses, or in public lots, blocking access to driveways, sidewalks, and other right- of- way areas.

Sanitation and Public Health Hazards - Without access to restrooms or waste disposal facilities, overnight occupancy in vehicles has led to the accumulation of trash, human waste, and food debris, increasing the risk of contamination and attracting vermin.

Strain on Public Safety Resources - Calls for service related to welfare checks, disturbances, or long- term vehicle presence place added demands on law enforcement and code enforcement personnel.

Reduced Neighborhood Safety and Cohesion - Residents may feel unsafe or uncomfortable with vehicles visibly occupied overnight, particularly near homes, parks, and schools, which can erode community trust and neighborhood cohesion.

Inconsistent Enforcement - In the absence of a specific municipal code section, officers are limited to using general nuisance or loitering statutes, which are often insufficient or inapplicable.

Preservation of Public Space Use - Prolonged vehicle habitation conflicts with the intended use of public roadways and parking areas, discouraging community access.

The proposed Ordinance includes the following provisions:

9. 06.10 - Purpose and Intent:

Declares the City' s intent to safeguard public health, safety, and welfare by prohibiting the use or occupancy of motor vehicles for sleeping, camping, or habitation in unauthorized areas.

ORDINANCE TO ADD CHAPTER 9. 06 ENTITLED " CAMPING OR SLEEPING IN MOTOR VEHICLES OVERNIGHT PROHIBITED" TO TITLE 9, "PUBLIC PEACE AND WELFARE" OF THE LATHROP MUNICIPAL CODE.

9. 06.20 — Definitions:

Provides definitions for key terms including " motor vehicle," " camping," sleeping," and " public property" to ensure clarity in application.

9. 06.30 — Prohibited Activity:

Declares it unlawful and a public nuisance for any person to use or occupy a motor vehicle, RV, trailer, or similar unit for sleeping or camping:

A) On public property, including parking lots, between 10: 00 p. m. and 7: 00 a. m.;
B) On private residential property without the owner' sconsent; C) On private non- residential property without the owner' s written consent.

9. 06.40 — Violation and Penalty:

Establishes that violations are misdemeanors under LMC Section 1.6. 010 and may also be subject to civil nuisance abatement procedures.

The proposed Ordinance would equip staff with a clear enforcement mechanism while allowing for discretion and education in its application. The framework supports neighborhood livability, public access, and safe, sanitary use of community spaces.

WHEREAS, the City of Lathrop City Council held a duly noticed public hearing at a regular meeting on May 12, 2025 to review and consider this Ordinance; and WHEREAS, proper notice of this public hearing was given in all respects as required by law; and
WHEREAS, this proposed code amendment is exempt according to the California Environmental Quality Act ( CEQA) Article 5 § 15061 by the " Common Sense Exemption" that CEQA applies only to projects that have a potential for causing a direct physical change in the environment, or a
reasonably foreseeable indirect

CITY MANAGER' SREPORT
MAY 12, 2025 CITY COUNCIL REGULAR MEETING
ITEM: PUBLIC HEARING ( PUBLISHED NOTICE) TO
CONSIDER AN ORDINANCE TO ADD CHAPTER 9. 05
ENTITLED " PUBLIC URINATION AND DEFECATION
PROHIBITED" TO TITLE 9, "PUBLIC PEACE AND
WELFARE" OF THE LATHROP MUNICIPAL CODE.

RECOMMENDATION: City Council to Consider the Following:

1. Hold a Public Hearing; and

2. First Reading and Introduction of an Ordinance to
add Chapter 9. 05 entitled " Public Urination and
Defecation Prohibited" to Title 9 " Public Peace
and Welfare" of the Lathrop Municipal Code.

SUMMARY:

The proposed Ordinance would add Chapter 9. 05 to Lathrop Municipal Code to prohibit individuals from urinating or defecating in a public place other than a designated restroom facility under circumstances where such act could be observed by any member of the public.

This ordinance supports clean and sanitary public spaces, promotes public health standards, and aligns with regulations adopted by many cities across California. It provides necessary authority for local enforcement and reinforces community expectations for hygiene and appropriate conduct in shared environments.

BACKGROUND:

Cities throughout California have implemented local ordinances to address the issue of individuals relieving themselves in public spaces under inappropriate conditions.

These actions, while sometimes related to lack of facility access, can lead to sanitation issues and diminish public comfort. Although not currently a widespread problem in Lathrop, the absence of a specific prohibition in the Municipal Code limits the City' s ability to enforce expectations for sanitary and respectful public conduct. The proposed Ordinance is a proactive measure to align with regional standards and ensure that community health and cleanliness are preserved.

ANALYSIS:

The proposed ordinance includes the following provisions:

9. 05.10 — Purpose and Intent:

Establishes the City' s intent to protect public health and preserve clean and sanitary public spaces.
971
CITY MANAGER' SREPORT PAGE 2

9. 05.20 — Definitions:

Defines " public place" to include streets, sidewalks, parks, parking lots, and other areas generally accessible to the public, whether publicly or privately owned.

9. 05.30 — Prohibited Activity:

Declares it unlawful and a public nuisance for any person to intentionally urinate or defecate in a public place, unless the act occurs in a washroom or toilet room, under circumstances where such act may be observed by any member of the public.

9. 05.40 — Violation and Penalty:

Designates violations as misdemeanors under LMC Section 1.6. 010 and authorizes additional civil remedies and abatement actions.

This ordinance will provide appropriate legal authority to address conduct that poses sanitation risks, particularly in shared public spaces, while reinforcing community expectations for public hygiene.

Public Notice
A Notice of Public Hearing was advertised in the Manteca Bulletin on May 1, 2025, posted on the City website, e -mailed to public hearing subscribers, and the meeting agenda was posted at various designated posting locations in the City. As of the writing of this report, no comments were received in favor or against the proposed ordinance.

FISCAL IMPACT:

No anticipated fiscal impact. Enforcement will be conducted by existing Police Department and Code Enforcement personnel.

RECOMMENDATION:

Staff recommends that Council consider all information provided and submitted, take and consider public testimony, and, if determined to be appropriate, take the following actions:

1. Introduce an Ordinance to Adopt an Addition to the Lathrop Municipal Code LMC) Chapter 9. 05, entitled " Public Urination and Defecation Prohibited" to Title 9, "Public Peace and Welfare" of the Lathrop Municipal Code. 972

PROGRAM
Application & Selection Process: On an annual basis, commencing in January, the Police Department will begin the application process for the annual Explorer Program cohort. The appointed Explorers will serve from July 1 to June 30 and can continue as an Explorer each subsequent year for up to six consecutive years or until they are no longer eligible or are no longer interested. The Police Department will continue to recruit each year up to the maximum number of 20 Explorers. Explorers will be selected based on the date of application and successful completion of a background check.

Benefits: The Explorer Program aims to promote positive relationships between law enforcement and youth. Positive interactions through the Exploring program help law enforcement and community members establish mutual trust and cooperation, which are key elements of community policing. The program also serves as a recruitment tool for the Police Department by engaging the next generation of law enforcement professionals with a deep- rooted interest in successful community policing. Upon successful completion of the program, Explorers will receive a Certification of Completion and a Letter of Recommendation from the Lathrop Police Department to be used for college admissions and/ or prospective employers.

Program Mentors: The program includes Explorer Advisors who are sworn Lathrop Police Officers, to lead the Explorer Program' s activities and offer mentorship to the Explorers. Explorer Advisors will consist of School Resource Officers, officers interested in working with youth, and officers who have prior experience as an Explorer. These officers will guide the youth through various training sessions, ride - a - longs, and community service opportunities. Explorer Advisors will coordinate transportation to community events and Explorer competitions. Additionally, select community members and City of Lathrop employees may contribute by helping with logistics, event support, and mentorship and resources for the Explorers. Explorer Advisors will assist with recruitment, review applications, conduct interviews and complete a background review. There will be a minimum of three Explorer Advisors in the program to ensure adequate supervision in case one of the Explorer Advisors is not available for a meeting or an event.

BACKGROUND:

In 2015, the President' s Task Force on 21st Century Policing introduced recommendations to increase the trust between law enforcement and the communities they protect and serve. One of the key pillars introduced in these recommendations focused on the need to actively build positive relationships with the community.

In 2021, The City of Lathrop reached out to the community, internal staff, and the City Council to obtain feedback on the Lathrop Police Department' s policing philosophy prior to the launch in 2022. Feedback from the survey indicated it was very important and nearing critical that the City of Lathrop Police Department practice community policing. Police exploring serves as a catalyst for social connectivity by actively building positive relationships through consistent civil engagement. 982

PROGRAM
Respectful interactions through the Exploring program help law enforcement and community members establish mutual trust and cooperation —key elements of community policing.

Learning for Life - Boy Scouts of America
The proposed Explorer Program operates under the broader exploring umbrella, which is a part of Learning for Life, a subsidiary of the Boy Scouts of America ( BSA). The proposed Explorer Program falls within the Scouting America Greater Yosemite Council. As such, the program follows Learning for Life guidelines. Interested youth and their parents must complete a youth application form, sign the Explorer contract, and review the guidelines provided by the BSA and LPD. These documents set forth the expectations for behavior, participation, and commitment within the program.

Additionally, parental consent is required for all youth participants. While direct parental involvement is not a formal requirement of the proposed Explorer Program, parents or guardians play a supportive role in their child' s participation.

They are required to sign waivers acknowledging the physical and legal risks associated with the program, as it includes activities such as physical training, ride - a - longs, and community patrol support. Parental support is also essential in ensuring that Explorers attend scheduled meetings and events and maintain the standards of conduct and performance expected by the program. Open communication between program leaders and parents helps reinforce the structure and accountability that contributes to the Explorers' success.

To form a successful Explorer Post, a minimum of five youth members is required.

However, it is recommended to start with a group of 10 to 20 youth to ensure that the program is sustainable, as some participants may drop out or miss meetings. A larger group can also create a more dynamic and engaging environment, allowing for better peer interactions and increased participation in group activities. The Explorer program provides general liability insurance through Learning for Life, covering participants in case of accidents, injuries, or other unforeseen incidents that may occur during official activities. This insurance ensures that both youth participants and Advisors are covered.

Essential Rules & Requirements — Background Checks
Explorers and Advisors who participate in the program will undergo background checks as part of the program' ssafety protocols. The Department of Justice ( DOJ) clearance is required for both youth participants ( if necessary) and adult leaders to ensure that they meet the safety and legal standards necessary for involvement in such a program. These background checks help ensure that all participants are trustworthy and suitable for working in a law enforcement environment and with youth. Advisors are required to complete Youth Protection Training through Learning for Life.

PROGRAM
The Explorer manual provides comprehensive guidelines on the expectations, rules, and procedures of the program. It outlines the responsibilities of both the youth participants and adult leaders, as well as the code of conduct that must be followed.

The manual includes information on safety protocols, behavioral expectations, and event participation. It is a key resource for new Explorers, helping them understand the program' sstructure and requirements. The manual also serves as a tool for adult mentors to ensure the program operates in a consistent, professional, and ethical manner.

Rules and regulations within the proposed Explorer Program are enforced through structured oversight by Advisors. Participants are expected to maintain high standards of behavior, academic performance, and physical readiness. Violations of program rules may result in disciplinary actions, including counseling, suspension, or removal from the program if deemed necessary. Officers who serve as mentors play a key role in upholding discipline and guiding Explorers to develop leadership, responsibility, and professionalism in all aspects of their participation.

Additional Details of the Program
The program intends to bring together law enforcement professionals, youth, and the community to create a mutually beneficial learning environment. The activities in the proposed Explorer Program are both varied and immersive, designed to provide comprehensive learning experiences. Explorers will receive classroom instruction on law enforcement topics such as criminal law, self- defense tactics, arrest procedures, and understanding search and seizure laws. Along with theoretical knowledge, they participate in physical training designed to develop fitness, discipline, and endurance, which are all essential traits for law enforcement officers.

Explorers also take part in community service activities, such as assisting with traffic control and community engagement at public events, helping during city functions like parades, bicycle safety rodeos, and festivals. Furthermore, Explorers have the unique opportunity to participate in ride - a -Tongs, where they accompany officers during their shifts and gain firsthand experience of police work in action. Guest speakers from various law enforcement sectors often visit to discuss specific fields like traffic enforcement, investigations, SWAT and community policing, offering Explorers insight into the diversity of careers available within law enforcement.

Training for Explorers participating in a Ride- Alongs will include completion of the agency' s basic training curriculum for Explorers, along with methods and techniques used in patrol operations and related police services, traffic control, telecommunications procedures, patrol vehicle/ conveyance systems and equipment familiarization, policy and standard operating procedures for Explorers, and spontaneous emergency protocols. Explorers must also undergo Youth Protection:

Personal Safety Awareness training, to include assertive and practical prevention and cessation procedures. Youth Protection training materials are available through the local Learning for Life representative.

Explorers 16 and older will be eligible for Ride- Alongs. Explorers under the age of 18 are prohibited from participating in a Ride -Along between 10 PM and 6 AM.

The types of activities that Explorers are typically allowed to assist with during a Ride - Along include, but are not limited to:

1. Observation.

2. Traffic control.

3. Telecommunications support.

4. Administration of first aid assistance.

5. Perimeter control at accident or crime scenes.

6. Note taking that may aid the law enforcement officer or assistance with completing incident or other forms.

In addition, Explorers must undergo a thorough background review to assess character and integrity that will include interviews with teachers and employers if applicable. The program is ideal for youth interested in pursuing careers in law enforcement, criminal justice, or other public service fields, but it also provides valuable skills and experience for anyone looking to develop leadership and teamwork abilities.

The proposed Explorer Program will run year- round, with weekly meetings that range from one to three hours. In addition to the weekly meetings, Explorers will have the opportunity to participate in community events, and Explorer competitions. Absences will be excused for illness, emergencies, school activities, family events, or other situations approved by an Explorer Advisor. Explorers are expected to participate in the program for a minimum of eight hours per month.

The program is designed to allow Explorers to stay involved as long as they are eligible, typically until they reach the age of 20. This extended duration gives participants time to accumulate a wide range of experiences, develop their skills, and even decide if they want to pursue a career in law enforcement or public service after completing the program.

Explorers in the Explorer Program are expected to maintain a professional appearance, wearing a uniform that distinguishes them from actual police officers but still mirrors aspects of a law enforcement uniform. The uniform typically includes a police explorer badge,
