AMENDMENT NO. 5 TO
AGREEMENT BETWEEN T.Y.LIN INTERNATIONAL
AND THE CITY OF MENIFEE FOR CIP 13-03
(HOLLAND ROAD/ I-215 BRIDGE OVERCROSSING PROJECT)

ENVIROMENTAL AND CIVIL ENGINEERING DESIGN SERVICES
This is Amendment No. 5 to that certain AGREEMENT for Professional Services Agreement (“Agreement”) made on between the City of Menifee (“City”) and T.Y.LIN INTERNATIONAL (“Consultant”) for CIP 13-03 (HOLLAND ROAD/ I-215 BRIDGE

OVERCROSSING PROJECT) ENVIROMENTAL AND CIVIL ENGINEERING DESIGN SERVICES which Amendment No. 5 is made and entered into on ______________, 2022 to increase the scope of work and compensation amount as indicated below:

1. Section 1, “Compensation” is amended to increase the maximum compensation by $77,390.00 (SEVENTY SEVEN THOUSAND THREE HUNDRED NINETY DOLLARS AND ZERO CENTS), and is amended to read as follows:

Section 1. COMPENSATION.

City hereby agrees to pay Consultant a sum not to exceed $ 2,496,508.00 (TWO MILLION

FOUR HUNDRED NINETY SIX THOUSAND FIVE HUNDRED EIGHT DOLLARS AND ZERO CENTS) notwithstanding any contrary indications that may be contained in Consultant's proposal, for services to be performed and reimbursable costs incurred under this Agreement. In the event of a conflict between this Agreement and Exhibit A, regarding the amount of compensation, this Agreement shall prevail. City shall pay Consultant for services rendered pursuant to this Agreement at the time and in the manner set forth herein. The payments specified below shall be the only payments from City to Consultant for services rendered pursuant to this Agreement. Consultant shall submit all invoices to City in the manner specified herein. Except as specifically authorized in advance by City, Consultant shall not bill City for duplicate services performed by more than one person.

2.Section 2. Exhibit A, Scope of Services is supplemented to include Amendment No. 1 Scope of Work Additional Work, which supplement is attached as Exhibit A hereto. “Amendment No. 1 Scope of Work Additional Work (Amendment No. 1)” is not intended to replace the original Exhibit A to the Agreement, but instead to augment and increase the scope of work listed in the original Exhibit A to the Agreement.

3. All other terms and conditions of the Agreement remain in full force and effect.

RECOMMENDED ACTION

1. Authorize the City Manager to execute a Utility Reimbursement Agreement between the City of Menifee and Eastern Municipal Water District (EMWD), and any future amendments thereof, for reimbursement of costs related to the water facilities for Peacock Community Resurfacing, Capital Improvement Project No. CIP21-17; and

2. Authorize the City Manager to execute a Utility Reimbursement Agreement between the City of Menifee and EMWD and any future amendments thereof, for reimbursement costs related to the water facilities for Tradewinds Community Resurfacing, Capital Improvement Project No. CIP22-07.

DISCUSSION
The Peacock Community Resurfacing Project is located south of Chambers Avenue and east of Valley Boulevard. The project improvements consist of resurfacing the existing roadway, restriping, and reconstruction of noncompliant curb ramps.

The Tradewinds Community Resurfacing Project is located east of Interstate 215 and north of Highway 74. The project improvements consist of resurfacing and reconstruction of existing roadway, restriping, and reconstruction of noncompliant curb ramps.

Both projects require the utility adjustment of manholes and water valves as part of the project scope. The City’s Capital Improvement Program (CIP) staff have been working with EMWD to adjust the existing water and sewer utilities that are in direct conflict with these projects. EMWD owns and maintains all water and sewer appurtenances in these neighborhoods.

4 Through research and coordination with EMWD, it was determined that the City has easement rights that supersede EMWD’s. Therefore, EMWD is liable for all utility adjustment costs associated with both projects.

Reimbursement costs for the Peacock Community Resurfacing Project are estimated to be $29,080 as shown in the bid schedule received for the project. Actual reimbursement costs will be determined upon completion of the work.

Reimbursement costs for the Tradewinds Community Resurfacing project are estimated to be $20,980 as shown in the bid schedule received for the project. Actual reimbursement costs will be determined upon completion of work.

The attached utility reimbursement agreements detail the scope of the reimbursement efforts and mechanisms to reimburse the City for the work to relocate EMWD’s facilities.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. Funding is available in current project budgets to cover reimbursement costs initially. The City will be reimbursed for all costs associated with the water utility facilities for both projects.

UTILITY REIMBURSMENT AGREEMENT

BETWEEN THE CITY OF MENIFEE AND EASTERN MUNICIPAL WATER DISTRICT FOR THE CIP 21-17 PEACOCK PLACE RESURFACING

This Utility Reimbursement Agreement (“Agreement”) is entered into by and between City of Menifee (“CITY”) and Eastern Municipal Water District (“EMWD”) whose address is 2270 Trumble, Road Perris, CA 92570
CITY proposes to improve existing Peacock Place neighborhood which include the following streets:

Felicia Avenue. Genevieve Drive, Leah Lane, Connie Way, Lola Court, Roylene Drive, Monica Way, Doreen Drive, Tyler Court and Cayla Court all in the City of Menifee, California, hereinafter referred to as “PROJECT”. As part of this PROJECT, the existing street will be improved. EMWD owns, operates, and maintains 8” VCP sewer pipelines, 6” ACP water pipelines, 8” ACP water pipelines, and 12” ACP water pipelines, located within PROJECT limits. The existing sewer manholes and water valve covers will need to be adjusted vertically.

Therefore, it is hereby mutually agreed between CITY and EMWD that:

I. WORK TO BE DONE
A. CITY shall prepare plans for vertical adjustment of sewer manholes, and water valve covers.

B. CITY shall adjust manholes, and water valve covers to proposed grade.

C. All work shall be performed substantially in accordance with EMWD’s water and sewer standards.

EMWD shall review and approve CITY’s plans prior to commencement of construction, and agrees to permit construction in the manner approved. After approval of the plans by EMWD, changes in the plans shall be for unforeseen conditions only unless both parties mutually agree otherwise D. Deviations from the work described above, initiated by either CITY or EMWD, shall be agreed upon by both parties hereto under a Revised Notice to Owner. Such Revised Notices to Owner, approved by CITY and agreed to/acknowledged by EMWD, will constitute an approved revision and are hereby made a part hereof. No work under said deviation shall commence prior to written execution by EMWD of the Revised Notice to Owner. Changes in the scope of the work will require an amendment to this Agreement in addition to the Revised Notice to Owner.

E. EMWD shall have the right to inspect the work by CITY’s contractor during the adjustment to grade of the manholes and water valve covers. Upon completion of work by CITY, EMWD agrees to accept ownership and maintenance of the relocated facilities.

F. EMWD shall provide inspections of adjustment to grade of the manholes and water valve covers work performed within the contract.

G. EMWD shall be responsible for all communication between the CITY’s contractor performing the work and their Inspector.

H. EMWD shall provide in writing any corrective work to the CITY’s contractor. No work on EMWD facilities will be allowed to be performed by the CITY’s contractor without an EMWD Inspector on site.

UTILITY AGREEMENT – Eastern Municipal Water DistrictPage 2 of 8 I. EMWD shall perform inspections in a timely manner to avoid project delays.

II. LIABILITY FOR WORK
A. Costs incurred by CITY are to include, but are not limited to, all elements of planning, design, construction, inspection, and project closeout.

B. The adjustment of manholes, and adjustment of water valve covers will be relocated at EMWD’s expense and shall include all EMWD staff, consultant, inspection, and contractor costs.

III. PERFORMANCE OF WORK
A. CITY will administer the construction contract to adjust the manholes and water valves to grade on CIP 21-17 Peacock Place Improvement plans. CITY will provide construction management and inspection as well.

B. EMWD shall have access to all phases of the facilities being adjusted by the CITY, as described in Section I above, for the purpose of inspection to ensure that the work is in accordance with the specifications contained in the PROJECT Construction Contract, however, all questions regarding the work being performed by CITY will be directed to CITY’s Engineer for their evaluation and reply to the question. EMWD shall retain the right to make final decisions that impact their facilities.

C. Engineering services for locating, making of surveys, preparation of plans, specifications, estimates, supervision, and inspection are to be furnished by CITY.

D. Pursuant to Public Works Case No. 2001-059 determination by the California Department of Industrial Relations dated October 25, 2002, work performed by the CITY’s contractor is a public work under the definition of Labor Code Section 1720(a) and is therefore subject to prevailing wage requirement.

E. Work performed directly by EMWD’s employees falls within the exception of Labor Code Section 1720(a)(1) and does not constitute a public work under Section 1720(a)(2) and is not subject to prevailing wages.

IV. PAYMENT FOR WORK
A. EMWD shall be solely responsible for costs associated with adjustment of manholes and water valves.

In the event additional work becomes necessary to complete this work, EMWD shall bear full financial responsibility for all costs associated with the additional work.

B. As indicated under Section III, Performance of Work, EMWD will perform plan check and construction inspection activities of facilities. The actual costs incurred by EMWD in its performance of said work will be paid by EMWD.

C. It is understood and agreed that CITY will not pay for any betterment or increase in capacity of EMWD’s facilities in the new location.

Any and all increases in costs that are the direct result of deviations from the work described in Section I of this Agreement shall have the prior concurrence of EMWD.

E. Detailed records from which the billing is compiled shall be retained by CITY for a period of three years from the date of the final payment and will be available for audit by CITY and/or Federal auditors. EMWD agrees to comply with Contract Cost Principles and Procedures as set forth in 48 CFR, Chapter 1, Part 31, et seq., 23 CFR, Chapter 1, Part 645.

F. As indicated under Section III, Performance of Work, CITY will: design, prepare plans, prepare specifications, oversee and inspect all work. CITY shall perform the work at EMWD expense.

G. 90% of the reimbursements will be paid by EMWD to the CITY within the first 60 days after bids have opened.

V. GENERAL CONDITIONS
A. If CITY’s PROJECT which precipitated this Agreement is canceled or modified so as to eliminate the necessity of work described herein, CITY will notify EMWD in writing and CITY reserves the right to terminate this Agreement by Amendment. The Amendment shall provide mutually acceptable terms and conditions for terminating this Agreement and reconciling outstanding costs/reimbursements due.

B. CITY shall prepare all documentation and obtain any and all environmental clearances as necessary for the relocated facilities, including but not limited to compliance with requirements imposed under the National Environmental Protection Act (NEPA) and the California Environmental Quality Act (CEQA).

C. CITY represents and warrants that this Agreement is not subject to 23 CFR 635.410, the Buy America provisions.

D. EMWD and CITY each hereby agree to indemnify, defend, and hold harmless the other party and their respective directors, officials, officers, employees, and agents from and against any claims, actions, damages, and liabilities arising out of or in any manner connected with the activities governed by this Agreement due to any negligent acts, errors, or omissions or willful misconduct of the indemnifying party performed in connection with such party's duties and obligations hereunder.

E. The undersigned individuals hereby warrant and represent that they each have full legal authority to sign this Agreement and bind the respective party hereto.

F. This Agreement will be construed and interpreted under, and governed and enforced according to the laws of the State of California.

G. This Agreement contains the entire agreement between the parties regarding the subject matter of this Agreement. No subsequent agreement, representation, or promise made by either party hereto, or by or to any employee, officer, agent or representative of either party, will be of any effect unless it is in writing and executed by the party to be bound thereby. No person is authorized to make, and by execution hereof each of the parties acknowledges that no person has made, any representation, warranty, guaranty, or promise except as set forth herein; and no such agreement, statement, representation, or promise that is not contained herein will be valid or binding on any of the parties.

UTILITY AGREEMENT – Eastern Municipal Water DistrictPage 4 of 8 H. This Agreement may be executed simultaneously in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument. For purposes of this Agreement, facsimile and electronic signatures will be deemed to be original signatures.

I. Each of the parties has reviewed this Agreement and each has had the opportunity to have its respective counsel review and revise this Agreement. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party will not apply in the interpretation of this Agreement or any amendments or exhibits thereto. In this Agreement the neuter gender includes the feminine and masculine, and singular number includes the plural, and the words “person” and “party” include corporation, partnership, firm, trust, or association wherever the context so requires. The recitals and captions of the sections and subsections of this Agreement are for convenience and reference only, and the words contained therein will in no way be held to explain, modify, amplify or aid in the interpretation, construction or meaning of the provisions of this Agreement.

J. If any part, term or provision of this Agreement is held by a court of competent jurisdiction to be illegal or in conflict with any law, the validity of the remaining provisions will not be affected, and the rights and obligations of the Parties will be construed and enforced as if this Agreement did not contain the particular part, term or provision held to be invalid.

EMWD owns, operates, and maintains 6” VCP sewer pipelines, 8” VCP sewer pipelines, 8” PVC sewer pipelines, 15” PVC sewer pipelines and 8” ACP water pipelines, located within PROJECT limits. The existing sewer manholes, sewer clean out covers, and water valve covers will need to be adjusted vertically.

Therefore, it is hereby mutually agreed between CITY and EMWD that:

I. WORK TO BE DONE
A. CITY shall prepare plans for vertical adjustment of sewer manholes, and water valve covers.

B. CITY shall adjust manholes, clean out covers, and water valve covers to proposed grade.

C. All work shall be performed substantially in accordance with EMWD’s water and sewer standard.

EMWD hereby acknowledges review of CITY’s plans for work and agrees to the construction in the manner approved.

D. Deviations from the work described above, initiated by either CITY or EMWD, shall be agreed upon by both parties hereto under a Revised Notice to Owner. Such Revised Notices to Owner, approved by CITY and agreed to/acknowledged by EMWD, will constitute an approved revision and are hereby made a part hereof. No work under said deviation shall commence prior to written execution by EMWD of the Revised Notice to Owner. Changes in the scope of the work will require an amendment to this Agreement in addition to the Revised Notice to Owner.

E. EMWD shall have the right to inspect the work by CITY’s contractor during the adjustment to grade of the manholes, clean out covers, and water valve covers. Upon completion of work by CITY, EMWD agrees to accept ownership and maintenance of the relocated facilities.

F. EMWD shall provide inspections of adjustment to grade of the manholes, clean out covers, and water valve covers work performed within the contract.

G. EMWD shall be responsible for all communication between CITY’s contractor performing the work and EMWD Inspector.

II. LIABILITY FOR WORK
A. Costs for relocation by CITY are to include, but are not limited to, all elements of planning, design, construction, inspection, and project closeout.

B. The adjustment of manholes, adjustments of clean out covers, and adjustment of water valve covers will be relocated at EMWD’s expense and shall include all EMWD staff, consultant, inspection, and contractor costs.

III. PERFORMANCE OF WORK
A. CITY will administer the construction contract to adjust the manholes, clean out covers, and water valve covers to grade on CIP 22-07 Tradewinds Improvement plans. CITY will provide construction management and inspection as well.

C. Engineering services for locating, making of surveys, preparation of plans, specifications, estimates, supervision, and inspection are to be furnished by CITY.

IV. PAYMENT FOR WORK
A. EMWD shall be solely responsible for costs associated with adjustment of manholes, clean out covers, and water valve covers. In the event additional work becomes necessary to complete this work, EMWD shall bear full financial responsibility for all costs associated with the additional work.

C. It is understood and agreed that CITY will not pay for any betterment or increase in capacity of EMWD’s facilities in the new location.

UTILITY AGREEMENT – Eastern Municipal Water DistrictPage 3 of 8 D. In any event, if the final bill exceeds 125% of the estimated cost of this Agreement, an Amended Agreement shall be executed by the parties to this Agreement prior to the payment of CITY’s final bill.

Any and all increases in costs that are the direct result of deviations from the work described in Section I of this Agreement shall have the prior concurrence of EMWD.

F. As indicated under Section III, Performance of Work, CITY will: design, prepare plans, prepare specifications, oversee and inspect all work. CITY shall perform the work at EMWD expense.

G. 90% of the reimbursements will be paid by EMWD to the CITY within the first 60 days after bids have opened.

C. CITY represents and warrants that this Agreement is not subject to 23 CFR 635.410, the Buy America provisions.

E. The undersigned individuals hereby warrant and represent that they each have full legal authority to sign this Agreement and bind the respective party hereto.

F. This Agreement will be construed and interpreted under, and governed and enforced according to the laws of the State of California.

G. This Agreement contains the entire agreement between the parties regarding the subject matter of this Agreement. No subsequent agreement, representation, or promise made by either party hereto, or by or to any employee, officer, agent or representative of either party, will be of any effect unless it is in writing and executed by the party to be bound thereby. H. This Agreement may be executed simultaneously in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument. For purposes of this Agreement, facsimile and electronic signatures will be deemed to be original signatures.

RECOMMENDED ACTION

1. Approve and authorize the City Manager to execute amendment No. 6 to the Professional Services Agreement with NV5 for Bradley Road Bridge over Salt Creek, Capital Improvement Project No. CIP13-04, in the not-to-exceed amount of $304,248 and extending the term of services through June 30, 2026.

DISCUSSION
In September of 2015, the City of Menifee contracted with NV5 to provide professional services for the completion of environmental and design for Bradley Road Bridge Project. Amendments No.1 and No. 2 were approved as term extensions only through June 2019 and June 2020, respectively. Amendments No.3 through 5 were approved which increased the scope of work and further extended the agreement term as summarized in Table 1.

In March 2022, the City received notice of the approval of federal funding for the Project from the fiscal year 2022 Appropriations bill in the amount of $5 million. Projects receiving federal funding are required to comply with the National Environmental Policy Act (NEPA) requirements. Services for NEPA compliance are not included under the existing agreement with NV5. In order for the project to comply with NEPA requirements to utilize the federal funding, the amendment with NV5 is necessary. Additional work required for NEPA compliance is identified below:
Project Management and Coordination - This task includes overall project management to oversee the NEPA preparation, administration, and coordination with associated outside agencies.
Environmental Work - Updates/NEPA specific conditions to the Project’s existing California Environmental Quality Act (CEQA) document which will consist of:

Access Ramps - The design of new access ramps on the south side of Salt Creek in accordance with Riverside County Standard Drawing requirements. Geotechnical Services - Preparation of a limited geotechnical investigation of the proposed access road ramp area to determine whether subgrade over-excavation, use of triaxial geogrids, or other geotechnical recommendation would be required for access road ramp construction.

The total cost for the additional work is $304,248 and will require an extension of the current agreement term with NV5 through June 30, 2026 to ensure timely completion of the NEPA process. The amendment will also revise the total not-to-exceed contract value for NV5 to $1,230,209. This amount represents the original agreement, all previous amendments, and the proposed amendment No. 6.

Pursuant to Menifee Municipal Code §3.12.090, any change orders greater than 10% of the contract amount or that exceeds $25,000 in value, and any time extension of the performance deadline exceeding 60 days, must be approved by the City Council. A summary of the agreement amendments is provided in Table 1 on the following page.

AMENDMENT NO. 3 TO

This is Amendment No. 3 to that certain AGREEMENT for Professional Services Agreement (“Agreement”) made on September 2, 2015 by and between the City of Menifee (“City”) and NV5, Inc. (“Consultant”) for CIP 13-04 (BRADLEY BRIDGE) DESIGN SERVICES which Amendment is made and entered into on ______________, 2020 to extend the term, increase the scope of work and compensation amount as indicated below:

1. Section 1.1, “Term of Services” is amended to read as follows:

1.1 Term of Services. The term of this Agreement shall begin on the September 2, 2015 and shall end on June 30, 2021 unless the term of the Agreement is otherwise terminated or extended as provided for in Section 8. Section 2. City hereby agrees to pay Consultant a sum not to exceed $738,011.00 (SEVEN HUNDRED THIRTHY EIGHT THOUSAND ELEVEN DOLLARS AND ZERO CENTS) notwithstanding any contrary indications that may be contained in Consultant's proposal, for services to be performed and reimbursable costs incurred under this Agreement.

In the event of a conflict between this Agreement and Exhibit A , regarding the amount of compensation, this Agreement shall prevail. City shall pay Consultant for services rendered pursuant to this Agreement at the time and in the manner set forth herein. The payments specified below shall be the only payments from City to Consultant for services rendered pursuant to this Agreement. Consultant shall submit all invoices to City in the manner specified herein. Except as specifically authorized in advance by City, Consultant shall not bill City for duplicate services performed by more than one person.

Section 3. Exhibit A, Scope of Services is supplemented to include Amendment No. 3 Scope of Work Additional Work , which supplement is attached as Exhibit A hereto. “Amendment No. 3 Scope of Work Additional Work (Amendment No. 3)” is not intended to replace the original Exhibit A to the Agreement, but instead to augment and increase the scope of work listed in the original Exhibit A to the Agreement

If Consultant enters City property or meets in person with City employees during the performance of the Services, Consultant shall comply with all State, County, and local emergency orders, directives, protocols, and best practices related to the COVID-19 pandemic, including, but not limited to: (A) wearing facial coverings, (B) maintaining adequate physical distancing when possible, (C) regular hand washing, and (D) regular hand sanitizing.

RECOMMENDED ACTION

1. Accept Fiscal Year 2022-23 California Department of Transportation (Caltrans) Sustainable Transportation Planning Grant funds for the City of Menifee Complete Streets Plan; and

2. Adopt a Budget Adjustment Resolution appropriating $221,325 in revenue and expenditures for the City of Menifee Complete Streets Plan from the Grant Fund (301) into accounts designated by the Finance Department and appropriating the local match of $28,675 into expenditures from the General Fund (100) into accounts designated by the Finance Department; and

3. Authorize the City Manager or their designee to execute all necessary agreements and other grant-related documents required to receive the Sustainable Transportation Planning Grant funds for the approved Complete Streets Plan.

DISCUSSION
The Sustainable Transportation Planning Grant (Grant) was established to support the mission of Caltrans in providing safe and reliable transportation networks that serve all people and respects the environment. Funding for the grant comes from Senate Bill 1: The Road Repair and Accountability Act of 2017 (SB1), providing $25 million in funding in the fiscal year 2022-23 Grant cycle. Eligible planning projects are expected to directly benefit the multi-modal transportation system.

In October 2021, the City submitted an application for the fiscal year 2022-23 Grant cycle to conduct the City of Menifee Complete Streets Plan (Plan). The proposed Plan is purposed to become a guide that will create a network of complete streets designed to safely and comfortably accommodate all modes of travel in the City. 1 underdeveloped areas with existing gaps in access and prioritize them for complete street improvements. This will enable the City to expand on the existing Active Transportation Plan by filling the gaps to include multi-modal opportunities and transportation improvements that go beyond pedestrian/bicycling opportunities. The estimated cost of the Plan is $250,000.

In April 2022, the City was notified that the Plan was awarded grant funding in the amount of $221,325, or 88.53% of the total estimated cost. The grant funding was awarded with the requirement for a local fund match of 11.47%, or $28,675, of the award amount. The Grant funds will reimburse the costs incurred for the Plan quarterly upon receipt of reimbursement requests from the City. The grant funding must be expended by February 2025.

The City will coordinate with Caltrans to ensure the conditions of the Grant are met throughout the Plan development process and will begin work upon receipt of the Notice to Proceed. Upon completion of the Plan, the City will have a list of recommendations to incorporate complete street improvements that improve safety, mobility, air quality, sustainability, and support the economy into the City’s Five-Year Capital Improvement Program.

FISCAL IMPACT
The total estimated cost for the City of Menifee Complete Streets Plan is $250,000. With the acceptance of the Grant funds, the City will cover 11.47%, or $28,675 of the Plan costs, using local funds. The Plan requires an appropriation of $221,325 from the Grant Fund (301) and $28,675 from the General Fund (100) as summarized in Table 1 below. An appropriation in the amount of $221,325 within the Grant Fund will be needed to recognize the grant revenue as detailed in the attached Budget Adjustment Resolution.

RECOMMENDED ACTION

1. Adopt a Resolution authorizing the City Manager to execute a Construction Zone Enhanced Enforcement Program (COZEEP) Agreement with the State of California, California Highway Patrol for the Holland Road Overpass Project, Capital Improvement Project No. CIP13-03 in the amount not-to-exceed of $45,264.

DISCUSSION
The Construction Zone Enhanced Enforcement Program (COZEEP) was adopted by the State of California to improve project safety through the use of supplemental California Highway Patrol (CHP) personnel. The program enables agencies to obtain CHP services to patrol project construction zones. COZEEP services are required under circumstances where construction activities will impact traffic lanes, on ramps, or off ramps on the interstate highway system.

To prepare for construction of the Holland Road Overpass, the City submitted a request for COZEEP services to the local Temecula CHP Area office in December of 2021. Requested COZEEP services will be needed for the anticipated evening closures of Interstate 215 (I-215).

Said closures will be needed in order to install and remove falsework that cannot be done over live traffic. Traffic will be redirected along Haun Road to reconnect commuters onto the I-215.

In March of 2022, the City received a response from the CHP. To move forward with the COZEEP services, the City must enter into a Program Agreement with the State of California CHP. Under the agreement, the CHP would provide officers for traffic control operations on the I-215 during the anticipated closure dates for construction of the Holland Road Overpass. The total cost for COZEEP services throughout construction of the Holland Road Overpass is $45,264 which will cover the estimated 10 evening closures of the I-215. Rates for the CHP officers under the reimbursement agreement are summarized on the following page.

AUTHORIZING THE CITY MANAGER TO EXECUTE CONSTRUCTION ZONE

ENHANCED ENFORCEMENT PROTECTION PROGRAM AGREEMENT WITH THE

STATE OF CALIFORNIA, CALIFORNIA HIGHWAY PATROL
WHEREAS, Interstate 215 (I-215) runs through the City of Menifee; and WHEREAS, the City of Menifee has Public Works projects which impact the operations of the interstate highway system on I-215; and
WHEREAS, the State of California Highway Patrol (CHP) has jurisdiction over the interstate highway system; and
WHEREAS, the CHP and the City of Menifee are required to enter into Program Agreements under the Construction Zone Enhanced Enforcement Program (COZEEP) on projects requiring CHP officer assistance with traffic control operations to ensure public safety; and WHEREAS, a COZEEP Program Agreement requires a resolution of authority from the municipal governing body to execute said agreements; and
WHEREAS, the City of Menifee is dedicated to maintaining public safety during Public Works construction projects impacting local travel; and
WHEREAS, execution of the COZEEP Program Agreement enables the City of Menifee to hire CHP officers and vehicles in order to patrol project construction zones.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Menifee, California:
does hereby adopt the resolution authorizing the City Manager to execute Construction Zone Enhanced Enforcement Program Agreements with the State of California, California Highway Patrol.

RECOMMENDED ACTION

1. Approve and authorize the City Manager to execute a no-cost joint-use agreement for public, educational and governmental (PEG) programming between the City of Menifee and Mt. San Jacinto Community College District through April 30, 2023.

DISCUSSION
Under the federal Cable Act and California’s Digital Infrastructure and Video Competition Act (DIVCA), local franchising authorities such as the City of Menifee, Mt. San Jacinto Community College District, and Riverside County may require cable operators to set aside channels for public, educational, and governmental (PEG) use. A PEG channel is used to broadcast local government and educational programming.

To enhance the City’s ability to share information with the community in a timely and transparent manner, on August 4, 2021, the City Council authorized staff to move forward with creating a City of Menifee PEG channel (Menifee TV). At the same time, the City Council authorized staff to develop partnerships with the Mt. San Jacinto Community College District (MSJC) and the County of Riverside to share PEG channel programming.

The joint-use agreement between the City and MSJC will expand community access to the City’s public meetings with the live broadcast of the City Council, Planning Commission, Parks, Recreation, and Trails Commission, and Senior Advisory Council meetings on MSJC’s educational channel. Under the terms of the agreement the City will be provided with up to 15 hours of programming airtime per month at no cost to the City beyond the staff time involved in content creation. The agreement will also allow the City to work with MSJC’s creative media program students to produce content such as updates on community events, activities, services, and initiatives. This partnership will provide for student training opportunities while also enabling Item Title: 10.12

4 the City to expand and enhance our ability to develop locally produced programming. The initial term of the agreement is set for 12 months through April 30, 2023, with the option for a one-year extension. Once Menifee TV is fully operational, the scope of the agreement can be amended to allow MSJC to provide content that can be aired on Menifee TV. MSJC is also in the process of building a recording studio. Once completed, it is anticipated that the City will have the opportunity to work in collaboration with the creative media program students to produce content utilizing the MSJC studio.

The agreement was presented to the MSJC Board of Trustees on April 14, 2022, as an informational item, with both the Board of Trustees and the MJSC President expressing support for the establishment of a PEG programming joint-use agreement. Following the Board of Trustees meeting the agreement was sent to the MSJC President for final approval.

Next Steps - PEG Channel Creation and Partnerships
The establishment of the City’s government channel, Menifee TV, is well under way. There are currently three cable providers operating in various poritons of the City including Spectrum, Frontier Communications, and Mediacom Communications Corperation. Spectrum has approved the City’s government channel application and has installed fiberoptic cabling between City Hall and Spectrum’s local cable head-end facility. Additionally, the encoder and transmission equipment needed to allow high-definition broadcasts over Spectrum’s network will be installed and tested over the next several months. It is anticipated that Menifee TV will go live on the Spectrum network this summer (2022). The goverment channel application submitted to Frontier Communciations is under review and a similar application is being prepared for Mediacom Communications Corporation. Once established, Menifee TV will include public meeting broadcasts; updates on community programs, activities, and services; support for local businesses; promotion of tourism; and educational resources for City policies and initiatives aired on all three cable networks.

City staff are also reaching out to the County of Riverside to develop a joint-use agreement that will enable both organizations to share public meeting and governmental content that can be broadcast on Menifee TV as well as Riverside County’s PEG channel.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action beyond the use of staff time to produce and transmit streaming content for broadcast on MSJC’s PEG channel.

Between The City of Menifee and
Mt. San Jacinto Community College District
Section 1. Term
A. This Agreement between Mt. San Jacinto Community College District (“District”) and the City of Menifee (“City”), together referred to as the Parties (“Party”), shall be for a term of 12 months, commencing on May 1, 2022 and ending April 30, 2023 (the "Initial Term"), unless terminated earlier, as provided for in this Agreement.

B. Subject to approval by the District, the City shall have the option to request to renew the Agreement for an additional term of one year prior to the expiration of the Initial Term. To exercise this option to extend the Term, the City must give the District written request to extend sixty (60) days before the expiration of the Initial Term, subject to District Board of Trustees approval. Section 2. Joint Use
A. Subject to the terms and conditions of this Agreement, the District hereby agrees to provide the City with up to 15 hours of programming air time per month. depending upon request from the City;
B. The District shall receive and re-transmit over the PEG Channel the City’s live broadcast of public meetings including City Council, Planning Commission, Parks, Recreation, and Trails Commission, and Senior Advisory Council. Generally these meetings are held Wednesday and Thursdays 4 weeks a month commencing at 6 PM and concluding around 9 PM. On occasion, a meeting will run longer than 9 PM and will need to be broadcast in its entirety. It is anticipated that this will result in approximately 15 hours of content per month. The City may request additional programming hours and the City and the District will meet and confer to determine if any additional programming time can be accommodated. The District retains the right to make the final determination if additional programming can be accommodated.

The City shall provide a broadcast ready feed in a format specified by the District and shall provide the equipment necessary to enable the District to receive the feed.

The City shall be solely responsible for producing the feed.

C. The District has the first right to determine if the content is appropriate and meets federal and state guidelines. The District maintains the right to refuse content deemed as inappropriate.

D. The District has first right of programming District content in time slots determined by the District. The District will make every attempt to program City content as requested, but it is understood that this is not guaranteed.

E. The City shall provide its own broadcast equipment and personnel so that it can monitor and produce its own edited and audience-ready content.

F. The City may submit a request seeking to work with the District’s Creative Media Program and its students to produce City content. The request must be approved by the District’s Public Information & Marketing Director or their designee and the Digital Media Program Dean or their designee. The work completed in partnership between the City and the District’s Creative Media Program shall provide instructional, hands-on opportunities for the District’s students.

G. The District shall not permit any person to work with students, use the District Facilities or Equipment without the supervision and assistance of the Creative Media Program Dean or Chair or their designee.

Section 3. Independent Contractor Status
This Agreement is by and between two independent entities and is not intended to and shall not be construed to create the relationship of agent, employee, partnership, joint venture, or association.

Section 4. Indemnification
A. To the fullest extent permitted by California law, the City shall indemnify, defend, and hold harmless the District, its directors, officers, agents, employees and volunteers from and against any and all claims, suits, actions, causes of action, losses, damages, or liabilities of any kind, nature or description, including payment of litigation costs and attorneys' fees, brought by any person or persons for or on account of any loss, damage, or injury to person, property, or any other interest, tangible or intangible, sustained by or accruing to any person or persons, directly or indirectly arising or resulting from any alleged acts or omissions of the City, its directors, officers, employees, agents, subcontractors, or volunteers in the performance of this Agreement.

The City shall indemnify and hold harmless the District, its directors, officers, agents, employees, and volunteers from and against any and all claims or other injury, including costs of litigation and attorneys' fees, arising from or in connection with claims or loss or damage to person or property arising out of the Item Title: 10.12

failure to comply with any applicable laws, rules, regulations or other requirements of local, state, or federal authorities, for claims of libel, slander, invasions of privacy, or infringement of common law or statutory copyright, for breach of contract or other injury, or damage in law or at equity which, directly or indirectly, result from the District's performance of this Agreement.

Section 5. Insurance
The District and the City shall maintain in full force and effect at all times during the term of this Agreement insurance as required by this Section.

A. Comprehensive Liability Insurance. Comprehensive liability insurance, including protective, completed operations and broad form contractual liability, property damage, and personal injury coverage, and comprehensive automobile liability including owned, hired, and non-owned automobile coverage. The limits of such coverage shall be at a minimum: (1) bodily injury including death, $1,000,000 for each person and each occurrence and $2,000,000 in the aggregate; and (2) property damage, $1,000,000 for each occurrence and $2,000,000 in the aggregate.

B. Equipment Insurance. Insurance on all equipment and facilities, including fixtures, funded in whole or in part under this Agreement to full replacement cost. The insurance shall include, at a minimum, insurance against loss or damage beyond the user's control, theft, fire, or natural catastrophe and will be paid to the party that replaces the equipment. The City shall maintain the insurance required by this paragraph for the City Equipment. The District shall maintain the insurance required by this paragraph for all District-owned equipment utilized under this agreement, but excluding the City Equipment.

C. Workers' Compensation and Employer's Liability. The minimum limit of Workers' Compensation Insurance shall comply with the limits required by California law. The limit of Employer's Liability coverage shall be $1,000,000.

D. Property Insurance. The District shall maintain appropriate insurance against loss or damage to any part of the Site against all perils included within the classification of fire, extended coverage, vandalism, and malicious mischief.

E. Additional Insured. The City shall name the District as an additional insured on all aforementioned insurance policies of the insured party. The policies shall provide that the insurance company or the insured party may effect no cancellation, major change in coverage or expiration without first giving the other party thirty (30) days written notice prior to the effective date of such cancellation or change in coverage.

F. Commencement of Coverage. On or before commencement of working with District students or the Creative Media Department, the City shall provide the District with proof of insurance coverage as follows: (1) Comprehensive Liability and Workers' Compensation; and (2) equipment insurance. All required insurance coverages shall be maintained by the Parties at all times in accordance with the requirements of this Agreement. Insurance shall not be canceled or reduced without thirty (30) days written notice to the other party.

Section 6. Termination
A. Either Party may terminate this Agreement upon sixty (60) days written notice for material breach of any provision of this Agreement to the other party, including, but not limited to, interference with the educational program or activities of the District or failure to comply with all applicable laws, ordinances, rules, and regulations. The breaching party shall have thirty (30) days from receipt of the notice to correct such breach; provided, however, that if the nature of the breach is such that more than thirty (30) days are reasonably required for its cure, then the breaching party shall have sufficient time to cure the breach if it has commenced, and is diligently prosecuting, such cure.

B. Either Party may terminate this Agreement at any time, for any reason, by providing written notice at least sixty (60) days in advance of the effective date of the termination.

C. Section 12 of this Agreement shall not apply to the exercise of the Parties' rights to terminate this Agreement under this Section.

All notices and other communications to be given by either Party must be in writing and may be effective by personal delivery, overnight courier, or first class or certified mail, return receipt request and addressed to the appropriate Party as follows:

Notice shall be deemed received on the date personally delivered or, if mailed, three days after deposit in the mail. Notice provided by overnight delivery shall be deemed received on the next business day after delivery by the overnight delivery service. A Party may change its addressee by written notice to the other party at any time.

Section 8. Dispute Resolution
It is the intent of the Parties to provide an efficient, effective, and inexpensive method to resolve any disputes concerning the interpretation or performance of this Agreement ("Disputes") when Disputes cannot be informally resolved. Within three (3) days after written notice to the other Party of a dispute (the "Notice of Dispute"), each party shall designate one or more persons to meet with the designated representatives of the other Party to consult and negotiate with each Item Title: 10.12

other in good faith, a just and equitable solution satisfactory to both Parties. If within fifteen (15) business days after delivery of the Notice of Dispute, the dispute cannot be settled through negotiation, the Parties shall attempt in good faith to settle the dispute by mediation. The mediation shall be conducted in the manner mutually agreed upon by the Parties and if no such agreement is reached within thirty (30) days after the Notice of Dispute, the mediation shall be administered by the American Arbitration Association under its Mediation Rules in effect on the date of the Notice of Dispute. If, within ninety (90) days after the Notice of Dispute the Parties do not reach a mutually satisfactory resolution of the Dispute, the Parties may pursue whatever legal remedies are available to them under the law.

Section 9. Subcontract and Assignment
Neither the City nor the District shall assign its rights, duties, or privileges under this Agreement, nor shall the City or District subcontract or attempt to confer any of its rights, duties, or privileges under this Agreement on any third party without the written consent of the other Party. Any such attempt without the other Party's written consent shall be void.

Section 10. Time
Time is of the essence in this Agreement and for the performance of this Agreement.

Section 11. Applicable Law
This agreement shall be interpreted and enforced under the laws of the State of California, County of Riverside.

Section 12. Attorneys' Fees
If any legal action is commenced between the Parties to this Agreement, each party shall bear its own costs of suit, including attorneys' fees.

Section 13. Severability
If any term, provision, covenant, or condition of this Agreement shall be determined to be invalid, void, or unenforceable by a court of competent jurisdiction, the remainder of this Agreement shall not be affected to the extent the remaining provisions are not rendered impractical to perform taking into consideration the purposes of this Agreement.

Section 14. Waiver
The waiver by either party of any breach of any term, covenant, or condition herein contained shall not be deemed to be a waiver of such term, covenant, condition, or any subsequent breach of the same or any other term, covenant, or condition herein contained.

Section 15. Successors and Assigns

This Agreement shall be binding upon and inure to the benefit of the Parties hereto and their respective heirs, legal representatives, successor, and assigns.

Section 16. Captions
The captions contained in this Agreement are for convenience only and shall not in any way affect the meaning or interpretation hereof or serve as evidence of the interpretation hereof, or of the intention of the Parties hereto.

Section 17. Entire Agreement
This Agreement is the entire agreement of the Parties and supersedes all prior negotiations and agreements whether written or oral. This Agreement may be amended only by written agreement and no purported oral amendment to this Agreement shall be valid.

Section 18. Incorporation of Recitals and Exhibits
The Recitals and each exhibit attached hereto are hereby incorporated herein by reference.

Section 19. Counterparts
This Agreement and all amendments and supplements to it may be executed in counterparts, and all counterparts together shall be construed as one document.

DISCUSSION
As a requirement by the U.S. Department of Housing and Urban Development (HUD), the City develops a Consolidated Plan (“ConPlan”) every five years to guide the use of Federal Community Development Block Grant (CDBG) funds, an Analysis of Impediments to Fair Housing Choice and a One-Year Annual Action Plan. 3 community development needs and market conditions. Additionally, the ConPlan is designed to assist the City make data-driven, place-based investment decisions. The draft ConPlan covers the period of fiscal year 2022-2023 through fiscal year 2026-2027.

Staff continues to work with a consultant, Michael Baker International (MBI), in preparing and disseminating public notices to meet the requirements of preparing the ConPlan document.

At the Council Meeting on April 6, 2022, Michael Baker and City staff presented to Council the first draft of the ConPlan. The ConPlan is currently open for public review, and MBI will update the document once we have received all public comments after the 30-day review period.

HUD requires a minimum of two public hearings to review the five-year Consolidated Plan before submission to HUD by May 15, 2022. The first hearing on April 6, 2022, was for the Council to review and provide feedback to refine the draft five-year Consolidated Plan.

The ConPlan will be available for a 30-day public review after the first public hearing and prior to the second public hearing. The second public hearing, scheduled on May 4, 2022, will be to review the final Consolidated Plan document and get Council’s approval.

During the April 6, 2022 Council meeting, some of the council members expressed concern that the Quail Valley area is no longer in a HUD designated Low and Moderate Income Area (LMA) and eligible for CDBG capital improvement projects. Staff reached out to the City’s HUD representative who explained that based on the American Community Survey (ACS) done annually, the percentage of residents reporting low/mod incomes for Quail Valley (44%) is not sufficient to meet the LMA national objective standard. For “Area Benefit”, at least 51% of the residents must be low- and moderate- income persons. As an alternative to using the ACS data the City can conduct an income- survey, however CDBG funds cannot be used for this survey.

The 2022-2027 ConPlan is the City’s comprehensive planning document and a required element for funding under the federal CDBG program. The ConPlan must include three components:
A housing and community development needs assessment;
A survey of available resources; and
A five-year strategy that specifies achievable housing and community development goals and programs. The goals serve as the criteria against which HUD will evaluate the City’s plan and its performance under the plan.

3 The Analysis of Impediments to Fair Housing Choice is required by HUD, and responses must be provided to any actions, omissions, or decisions that are:
Taken because of race, color, religion, sex (gender), disability, familial status, or national origin which restrict housing choices or the availability of housing choices; or
Which have the effect of restricting housing choices or the availability of housing choices on the basis of race, color, religion, sex (gender), disability, familial status, or national origin.

Each year an Annual Action Plan must be prepared and submitted to HUD for the upcoming program year.

Beginning on April 2, 2022, the 30-day public comment/review period (April 2, 2022 through May 1, 2022) and Notice of Public Hearing was published in the local newspaper and posted on the City’s website.

Draft Annual Action Plan 2022-2023
The Housing and Community Development Act of 1974 created the CDBG Program. The primary objective of the CDBG program is the development of viable urban communities by providing decent housing, a suitable living environment, and expanding economic opportunities, principally for persons of low- and moderate-income. The CDBG regulations require that each activity meet one of the following national objectives:
Benefit low- and moderate-income persons;
Aid in the prevention or elimination of slums and blight; or Meet other community development needs having a particular urgency.

Each year, the City certifies with the submission of its Annual Action Plan that it has given maximum feasible priority to activities, which meet the first and second objectives above.

Additionally, the City certifies that no less than 70 percent of the CDBG funds received, over a three-year certification period, will be designed to benefit low- and moderate- income persons.

At this time, allocations have not been announced. Jurisdictions are to project their Annual Action Plan using last year allocation of the $520,000. The following summarizes the funding plan included within the proposed 2022-2023 Annual Action Plan:

If City funding is either increased or decreased from what is presented in the draft Action Plan, no additional public review will be required, provided Congress does not complete HUD’s fiscal year 2022 appropriations process prior to the completion of the 30-day public review process and the final public hearing held in May. Instead, City staff will confirm that each agency included in the City Council-approved public services activities will be able to implement their program with the budget change. Once the City has determined the number of agencies willing to proceed with their program, City staff will proportionately increase or decrease all agencies’ grant awards based on the remaining amount. City staff will also review the approved capital improvement projects to determine the impact any budget changes may have on the project and will be authorized to make any necessary adjustments to the project scope.

All of HUD’s required noticing and disclosure requirements have been adhered to with respect to the CDBG documents. Therefore, staff recommends that subsequent to conducting the public hearing, the Council adopts the attached resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, APPROVING THE 2022-2027 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)

CONSOLIDATED PLAN, ANALYSIS OF IMPEDIMENTS TO FAIR HOUSING AND THE 2022-2023 ANNUAL ACTION PLAN
WHEREAS, the City of Menifee has participated directly within the federal Department of Housing and Urban Development (HUD) as an entitlement jurisdiction for Community Development Block Grant (CDBG); and
WHEREAS, the City has prepared all documents, notices, and forms required by HUD for participation in the CDBG Program by entitlement jurisdictions; and WHEREAS, the City has prepared a consolidated plan, which is an entitlement city’s comprehensive planning document and a required element for funding under the federal CDBG program; and
WHEREAS, the City’s 2022-2027 Consolidated Plan contains a housing and community development needs assessment; a survey of available resources; and a five-year strategy that specifies achievable housing and community development goals and programs; and WHEREAS, the City has prepared an Analysis of Impediments to Fair Housing that outlines the City’s strategy to affirmatively promote equal housing opportunity and remove impediments to fair housing ; and
WHEREAS, In preparation for the FY2022-2027 Consolidated Plan and FY2022-2023 Annual Action Plan, the City facilitated citizen participation through surveys, workshops, community meetings and public hearings. Efforts were made to encourage participation by low- and moderate-income persons, in areas where HUD funds are proposed to be used, and by residents of predominantly low- and moderate- income neighborhoods; and
WHEREAS, the 2022-2023 Annual Action Plan establishes a one-year program in compliance with HUD funding allocations and requirements; and
WHEREAS, the City has given notice of the required public hearing for consideration of approval of the 2022-2027 Consolidated Plan, Analysis of Impediments to Fair Housing, the 2022-2023 Annual Action Plan; and
WHEREAS, if Congress does not complete the appropriations process for HUD’s FY2022 prior to this public hearing and the City’s funding is either increased or decreases from what is presented in the draft Annual Action Plan, no additional public review will be required; and WHEREAS, City staff will inquire with the Menifee Citizens Advisory Committee (MCAC) the approved public services activities and determine if the agency will be able to implement their program with the budget change; and
WHEREAS, once the City has determined the number of agencies willing to proceed with their program, City staff will proportionately increase or decrease all agencies’ grant awards based on the remaining amount; and

WHEREAS, City staff will work with City departments having capital improvement projects to determine the impact of such budget changes and will be authorized to work with the City departments in making any necessary adjustments to a project’s scope; and WHEREAS, all prerequisites with respect to the approval of this Resolution have been met NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Menifee, California:

Section 1.Subsequent to hearing and consideration of all testimony, the City Council hereby adopts the Community Development Block Grant Program (CDBG) 2022-2027 Consolidated Plan, Analysis of Impediments to Fair Housing, and 2022-2023 Annual Action Plan.

Section 2.Subsequent to hearing and consideration of all testimony, the City Council hereby approves action stated above if Congress does not complete the appropriations process for HUD’s FY2022 prior to this Public Hearing.

Section 3.The City Manager, or designee, is hereby authorized and directed to take any actions and execute any documents as are necessary and appropriate to effectuate the intent of this Resolution, including, but not limited to, as serving as the Certifying Officer for all environmental review procedures associates with the various CDBG projects, and Certifying Officer for the purpose of signing correspondence, agreements, and other required documents.

Section 4:This Resolution shall take effect upon the date of its adoption.

1. Introduction
The 2022-2027 Consolidated Plan is the City of Menifee’s Strategic Plan for the investment of an annual allocation of Community Development Block Grant (CDBG) funds from the U.S.

Department of Housing and Urban Development (HUD) during the five-year period beginning July 1, 2022 and ending June 30, 2027. These grant programs are consistent with HUD’s national strategy to provide decent housing opportunities, a suitable living environment, and economic opportunities—particularly for low- and moderate-income people.

In consideration of finite grant resources, the Strategic Plan within this Consolidated Plan outlines the areas and population segments with the greatest level of need for a particular program or activity and intends to invest grant resources in high leverage opportunities where data suggests that the city will be able to maximize the impact of every dollar. The Strategic Plan identifies the City’s priority needs, including the rationale for establishing allocation priorities and specific measurable goals to be addressed during the five-year period covered by the Consolidated Plan through activities to be implemented as part of the five Annual Action Plans using CDBG funds.

This Consolidated Plan also contains a Needs Assessment and Market Analysis that provide insight into the different levels of need in the community and the market in which grant-funded programs will be implemented. The Needs Assessment incorporates national data from the 2013- 2017 American Community Survey (ACS) 5 -Year Estimates and the 2013 -2017 Comprehensive Housing Affordability Strategy (CHAS) data, in addition to local data.

Community Development Block Grant (CDBG)
The Housing and Community Development Act of 1974 created the CDBG Program. The primary objective of the CDBG program is the development of viable urban communities by providing decent housing, a suitable living environment, and expanding economic opportunities, principally for persons of low- and moderate-income. The CDBG regulations require that each activity meet one of the following national objectives:
• Benefit low- and moderate-income persons;

• Meet other community development needs having a particular urgency.

Each year, the city certifies with the submission of its Annual Action Plan that it has given maximum feasible priority to activities, which meet the first and second objectives above.

Additionally, the City certifies that no less than 70 percent of the CDBG funds received, over a three-year certification period, will be designed to benefit low- and moderate-income persons.

For the 2022-2023 program year, the City will roughly receive $468,000 in CDBG funds. The following CDBG program activities to be implemented from July 1, 2022, to June 30, 2023.

2. Summary of the objectives and outcomes identified in the Plan Needs Assessment Overview
The priority needs and goals identified in the Plan needs assessment were identified based on analysis of information including the results of the City’s 2022 -2027 Consolidated Plan Needs Assessment Survey. Additionally, the housing and community development data elements required by HUD in the online Consolidated Plan system (the eCon Planning Suite) from the American Community Survey (ACS) 5-Year Estimates and the Comprehensive Housing Affordability Strategy (CHAS) covering the same time period were used. Other sources of information used to identify needs and establish priorities were obtained through consultation with local nonprofit agencies involved in the development of affordable housing and the delivery of public services to children, families, elderly persons, and persons with special needs throughout the community.

HUD’s Community Planning and Development (CPD) Outcome Performance Measurement Framework classifies objectives in three categories: decent housing, a suitable living environment, and economic opportunity. Based on the Needs Assessment and Market Analysis, the Strategic Plan identifies six high priority needs to be addressed through the implementation of activities aligned with six Strategic Plan goals.

In consideration of community input and available data, the six priority needs listed below are established as part of this Plan:

Consistent with HUD’s national goals for the CDBG programs to provide decent housing opportunities, maintain a suitable living environment and expand economic opportunities for low- and moderate-income residents, the priority needs listed above will be addressed over the next five years through the implementation of CDBG funded activities aligned with the following six measurable goals included in the Strategic Plan of this Plan.

3. Evaluation of past performance
A total of Two Thousand Nine Hundred Thirty-One (2,931) Low-and Moderate-Income persons were served through various projects/activities during the 2020/2021 Program Year period (this includes prior year program/projects completed in the 2020/2021 timeframe). Including:

4. Summary of citizen participation process and consultation process Subsequent t o the enactment of the Homeless Emergency Assistance and Rapid Transition to Housing (HEARTH) Act of 2009, HUD revised the Consolidated Plan regulations at 24 CFR Part 91 to emphasize the importance of citizen participation and consultation in the development of the Consolidated Plan. HUD strengthened the consultation process with requirements for consultation with the CoC, Public Housing Authorities (PHA), business leaders, civic leaders, and public or private agencies that address housing, health, social service, victim services, employment, or education needs of low-income individuals and families, homeless individuals and families, youth and/or other persons with special needs. Together with the analytic capabilities of the eCon Plan Suite, HUD’s online Consolidated Plan template, these requirements created the conditions necessary to implement a collaborative, data -driven and place -based planning process that includes a robust level of citizen participation and consultation.

The City adopted a new Citizen Participation Plan on January 4, 2017, along with some minor amendments on May 3, 2017, that reflects regulatory changes and process improvements. The CPP was again amended on June 17, 2020 for COVID -19 restrictions. In accordance with the City’s adopted Citizen Participation Plan, the City facilitated citizen participation through surveys, workshops, community meetings and public hearings. Efforts were made to encourage participation by low - and moderate- income persons, in areas where HUD funds are proposed to be used, and by residents of predominantly low- and moderate-income neighborhoods. The City also made efforts to encourage the participation of minorities and non- English-speaking persons, as well as persons with disabilities. The consultation process included representatives of the Riverside County Continuum of Care, Housing Authority of the County of Riverside, and other specified groups who completed surveys, provided local data, and assisted the City to ensure practical coordination of strategies to maximize impact and to avoid duplication of effort.

5. Summary of public comments
Public and private agencies directly or indirectly involved with fair housing issues as well as interested residents were invited to attend and participate in the Community Meetings. Advertisements for these meetings appeared in the local newspaper, social media, Menifee Matters, a quarterly magazine that goes out to all residents in Menifee, and the City's front web page, plus email blast that went out to over 375+ organizations.

Additional marketing was through direct solicitation and interviews with community groups and organizations. The purpose of the community meetings was to provide a background on the scope of the study and solicit input on the most pressing issues affecting housing opportunities in Menifee.

The City also created an online survey in both English and Spanish that received 538 responses from September 2021 to November 2021. The purpose of this survey was to gather information on what citizens in the City of Menifee perceive are the most pressing needs of their community. To encourage broad and meaningful community participation, an online community outreach survey was designe d with questions to elicit feedback about needs for housing, community facility needs, special needs services, homeless, economic development, and other supportive community programs. The survey also sought to gain input on the community’s experience with housing discrimination, awareness of tenant housing rights, home lending, housing affordability, and information related to home maintenance and condition.

Additionally, the city reached out to over 40 organizations within the City of Menifee and surrounding jurisdictions for 1:1 interview regarding fair housing, expanding economic opportunities, and infrastructure needs. The City also held a Community Outreach Meeting on October 14, 2021.

outlets, such as the City’s website and social media, were used to publicize the surveys.

Efforts to reach populations underrepresented in the planning process included discussions regarding the survey with various housing, social service, faith based, and other organizations that provide services to the disabled, special needs, low income, and homeless population communit y. Many of the organizations that assisted in the effort to distribute the surveys posted them on their websites and sent notification to their partners and clientele.

A public meeting before the Menifee Citizens Advisory Committee (MCAC) to receive comments on the housing and community development needs in the community was held on March 8, 2022.

A public hearing was conducted before the City Council on April 6, 2022, that focused on the housing, community and economic development needs in the community. (No comments were received.

A second public hearing was held on May 4, 2022. (No comments were received. – TBD)

All comments and views received by the City in the development of the Consolidated Plan are being accepted and taken into consideration in the development of the Consolidated Plan.

7. Summary
Examination of 2013-2017 American Community Survey (ACS) 5 -Year Estimates and the 2013-2017 Comprehensive Housing Affordability Strategy (CHAS) data, in addition to local data, as well as consultation with citizens and organizations revealed six high priority needs to be addressed through the investment of an anticipated $2.34 million of CDBG funds over the five-year period of the Consolidated Plan. The investment of CDBG funds in eligible activities shall be guided principally by the six goals of the Strategic Plan. Activities submitted for consideration in response to any solicitation or Notice of Funds Availability (NOFA) process must conform with one of the six Strategic Plan strategies and the associated action-oriented, measurable goals in order to receive consideration for CDBG funds.

Narrative
The Community Development Department of the City of Menifee is the lead department responsible for the administration of the CDBG program. The Community Development Department contracted the services of Michael Baker International to assist the City in the preparation of the 2022-2027 Consolidated Plan.

In the development of this Consolidated Plan, the city implemented a comprehensive citizen participation and consultation process and conducted a needs assessment and market analysis to identify levels of relative need regarding affordable housing, homelessness, special needs, and community development. This information was gathered through consultation with public officials and local agencies, public outreach and community meetings, review of demographic and economic data, and housing market analysis.

In the implementation of the 2022 -2027 Consolidated Plan and each of the five Annual Action Plans, the Community Development Department shall be responsible for all grant planning, management, and monitoring duties necessary to comply with HUD regulations and City policy.

1. Introduction
The City of Menifee consulted with representatives from multiple agencies, groups, and organizations involved in the development of affordable housing, creation of job opportunities for low- and moderate-income residents, and the provision of services to children, seniors, persons with special needs, persons with HIV/AIDS and their families, and homeless persons. To facilitate this consultation, the city solicited feedback through the following methods:

• Public hearings
• Receipt of written comments
To gather the greatest depth of information, the City consulted with a wide variety of agencies, groups and organizations concerning the housing, community and economic development needs of the community. The primary agencies, groups or organizations consulted can be found on the following pages. A comprehensive list of organizations is provided in Table 3 . The input received from these consultation partners helped establish the objectives and goals described in the Strategic Plan. Specific comments received from these organizations are included in Table 3.

The city recognizes the importance of coordination and alignment among various service providers to maximize the effectiveness of the CDBG program. As a result, during the development of this Consolidated Plan, the city consulted closely with organizations that provide assisted housing, health services and other community - focused programs. Outreach efforts included surveys, including specific questions associated with coordination, invitations to community meetings and workshops and in- person interviews.

The city further recognizes the importance of continued coordination and alignment during the upcoming five-year planning period with these organizations and agencies.

implementation of the NOFA process for CDBG funds and through technical assistance provided to subrecipients of CDBG funds each year. The city monitors its affordable housing every year to ensure compliance with State and Federal requirements. It supports the County’s Section 8 program and participates in the County’s Mortgage Credit Certificate (MCC) program.

Describe coordination with the Continuum of Care and efforts to address the needs of homeless persons (particularly chronically homeless in dividuals and families, families with children, veterans, and unaccompanied youth) and persons at risk of homelessness
The Riverside County Continuum of Care (CoC) guides the development of homeless strategies and the implementation of programs to end homelessness throughout the region. The CoC is comprised of a network of public, private, faith-based, for-profit, and nonprofit service providers who utilize several federal, state and local resources in providing services for homeless persons. The County and its cities, including the City of Menifee, also provide resources for services that assist the homeless and those at risk of becoming homeless. The nonprofit and faith-based community plays a key role in the current CoC system. Hundreds of agencies throughout the County provide programs ranging from feeding the homeless on the street to creating permanent supportive housing opportunities. These services are available to homeless families with children as well as single men and women. The nonprofit and faith-based community also serves special needs populations, such as victims of domestic violence, veterans, persons with disabilities and unaccompanied youth.

The city provided a detailed survey to the CoC to identify the CoC’s perceived needs in the County and its objectives to address the needs of different homeless populations, specifically chronically homeless families and individuals, families with children, veterans, unaccompanied youth, and persons at risk of homelessness. Following the delivery and response to this questionnaire, the City followed up with the CoC to clarify existing needs and objectives and understand opportunities for collaboration and coordination during the five-year planning process.

In the development of the 2022-2027 Consolidated Plan, the City of Menifee consulted forty-three housing, social services and other entities involved in housing, community and economic development in Menifee and throughout the region to obtain valuable information on priority needs in the City and how CDBG funds and other resources should be invested to provide decent affordable housing, a suitable living environment and economic opportunities primarily for its low- and moderate-income residents. The CoC was consulted directly by telephone and email to discuss performance standards, outcome and policies and procedures for HMIS. The City was referred to the Ten - Year Plan to End Homelessness, the 2020 Point -in-Time homeless count and other publicly available reports. The City does not receive any ESG funds.

1. Summary of citizen participation process/Efforts made to broaden citizen participation
Summarize citizen participation process and how it impacted goal-setting On January 4, 2017, the City adopted a Citizen Participation Plan (CPP) to describe how the City intends to involve its citizens in the development of the Consolidated Plan. On May 3, 2017, the Citizen Participation Plan was amended for appropriate and adequate citizen participation. On June 17, 2020, the CPP was revised for COVID-19.

The City established and followed the citizen participation process for the development of this five-year Consolidated Plan that included broad participation from the community. To assist in the identification of priority needs in the City, the Community Needs Assessment and Fair Housing Survey was prepared in English and Spanish and distributed to residents of the City to solicit input in the prioritization of needs related to community services, community facilities, infrastructure, neighborhood services, special needs services, businesses and jobs, and housing. The surveys were available online. The City received a total of 538 responses to the survey.

A community meeting was conducted on October 14, 2021 . A community workshop was conducted on January 27, 2022, with prospective nonprofits intending to submit grant applications for CDBG funds and to obtain input on community needs. The Menifee Citizens Advisory Committee conducted a community meeting on March 8, 2022, to discuss the Consolidated Plan process.

Two public hearings were held at different stages in the development of the Consolidated Plan. The first public hearing was held on April 6, 2022 . The second hearing was conducted May 4, 2022, to receive comments on the draft 2022 -2027 Consolidated Plan and the 2022-2023 Annual Action Plan. The Plans were adopted as presented (TBD).

At each step in the process, the City was careful to ensure that low - and moderate- income residents, members of minority groups, agencies involved in the provision of services to these populations, and others who are directly impacted by the programs and activities supported by the Consolidated Plan programs had the opportunity to be actively involved. To promote greater public accessibility to program documents, the Citizen Participation Plan, Consolidated Plan, Action Plans, CAPERs and the Analysis of Impediments to Fair Housing Choice are posted on the city’s website.

3. Needs Assessment
A. NA-05 Overview
Needs Assessment Overview
Prior to its incorporation in 2008, the City of Menifee was comprised of three distinct, isolated communities: Quail Valley, Romoland and Sun City. While these communities chose to become one city, they remain geographically and demographically distinct. Their needs vary greatly as do the programs to address those needs. Romoland is located about 3½ miles north of Sun City and dates back to the early 1900s. It has a community water and sewer system. Special regional districts, not the city, provide community water and sewer service and flood control. Therefore, the city has no jurisdiction in improving or maintaining these systems and addressing their needs.

Since 1990, the areas surrounding the Sun City has experienced tremendous growth with middle- class, master-planned subdivisions. Much of the data prior to incorporation is not available.

The Needs Assessment section of the Consolidated Plan examines housing, homelessness, non- homeless special needs, and non -housing community development needs. The housing needs assessment section evaluates household income, tenure (renter or owner), housing cost as a function of household income, disproportionate need among racial and ethnic groups and public housing needs. The homeless needs assessment examines the sheltered and unsheltered homeless population in Menifee and Riverside County to prepare the City’s strategy to address homelessness during the next five years. The non -homeless special needs assessment section evaluates the needs of people who are not homeless, but due to various reasons are in need of services, including, but not limited to, the elderly, frail elderly, severe mentally ill, developmentally disabled, physically disabled, persons with alcohol or other drug addictions, persons with HIV/AIDS, victims of human trafficking, veterans with posttraumatic stress disorder (PTSD) and victims of domestic violence. The non-housing community development needs assessment section discusses the need for public facilities, public infrastructure improvements and public services to benefit low- and moderate-income residents.

The City has identified these top priority needs as follows:

The City conducted a community needs survey and community outreach on October 14, 2021 .

The community was provided a survey and to prioritize the needs of the City for the next five (5) years, 2022 -2027. When asked to prioritize those needs, survey respondents noted that prevention and elimination of homelessness was the highest priority followed by infrastructure improvements, economic development, broadband needs, public services, and affordable housing preservation.

The City of Menifee will continue to support the efforts of the Riverside County Continuum of Care (CoC) and its member organizations that address homelessness. the City supports local nonprofit agencies who provide emergency rental assistance and housing counseling to low - and moderate-income residents to prevent homelessness.

The second highest priority noted are infrastructure improvements in the City. The City of Menifee is rapidly growing, with its population increasing by seventeen percent (17%) from 77,519 to 90,349 from 2010 to 2019, and the number of households increasing by three percent (3%) from 29,080 to 29,808, the residents have expressed a high priority need of infrastructure.

Based on an online survey provided to the community for input, the residents expressed less housing and more infrastructure. The residents would like to see more street improvements, sidewalk improvements and an increase in code enforcement.

The third highest priority in the City is economic development. The community would like to see more jobs being created in the City, work with major employers to develop incentives for new housing near their job sites, and i mprove education and provide sk ills training for education, healthcare, manufacturing, and construction jobs. With the creation of d evelopment of a Micro Enterprise Program that will provide small business development training, start -up loans and support to income qualified clients who would like to start their own small business would meet the needs of the City for the next five (5) years.

It was identified that Romoland lacks effective broadband connectivity. The City is exploring a Smart City initiative that will increase connectivity to all the districts.

There is a great need of public services, especially for the senior and youth community. Funding of public serv ices would be ideal to help barriers to accessing affordable housing and the homeless population.

There is a continued need for Senior Housing. Based on the survey results and community outreach, it was determined there is a demand of preservation of the quality of existing affordable housing stock occupied by low - and moderate-income households. Through the implementation of a Minor Home Rehabilitation Grant Program, addressing substandard or emergency housing conditions will allow low - and moderate-income families to maintain housing stability while also guaranteeing that all economic segments of the community live in decent housing.

Methodology
To assess community needs, the City examined data, held community meetings and workshops, conducted a CDBG Community Needs Assessment and Fair Housing Survey and consulted with local organizations. The Needs Assessment primarily relies on the following sources of data:
• American Community Survey (ACS) (2013-2017 5-year estimates) • Comprehensive Housing Affordability Strategy (CHAS) (2013-2017 5-year estimates) • 2020 Point-In-Time (PIT) Homeless Count for Riverside County including Menifee

CDBG Community Needs Assessment and Fair Housing Survey The City of Menifee conducted a CDBG Community Needs Assessment and Fair Housing Survey of its residents and program organizations asking them to rate the needs in Menifee regarding housing, fair housing services, community services, services for special needs populations, neighborhood services, community facilities, infrastructure and business and jobs services.

The ACS and CHAS data in Tables 7 through 12 below focuses on households earning 0 -100 percent of AMI. Analysis of the data in Table 10 indicates a need for housing assistance targeted at 6,996 (25 percent of the total City households) cost burdened households who pay more than 30 percent of their income for housing costs and who have incomes less than 80% of AMI.

According to Table 11, of the severe cost burdened households, 4,459 households (16 percent of the total City households) earning 0 -80 percent of AMI pay more than 50 percent of their income for housing costs, of which 48 percent who are renter households and 52 percent are owner households.

Table 7 presents the number of different household types in the City for different levels of income.

Small family households consist of 2-4 family members, while large family households have more than 5 persons per household. The income levels are divided by different HUD Area Median Family Income (HAMFI) levels corresponding with the HUD income definitions listed below. • 0-30 percent HAMFI: extremely low-income

Based on 2013-2017 CHAS data, 36 percent of all households in the City of Menifee earned less than 80 percent of HAMFI, with 11 percent earning between 80 -100 percent of HAMFI and 53 percent of all households earning more than HAMFI.

Tables 8 and 9 indicate the number of renter- and owner-occupied households for different AMI levels that are experiencing housing problems. HUD defines four (4) different housing problems as:

1. Lacks complete kitchen facilities: Household lacks a sink with piped water, a range or stove, or a refrigerator

2. Lacks complete plumbing facilit ies: Household lacks hot and cold piped water, a flush toilet and a bathtub or shower

Based on the data in Table 8 for households earning 0-100 percent of AMI, 90 percent of the 9,047 housing problems are attributable to cost burden. In this income category, 8,500 households out of 13,540 (63 percent) are cost burdened according to CHAS data for 2013-2107 Overcrowding and severe overcrowding are the second most prevalent housing problems, representing 6 percent of all housing problems. Of the eight h ousehold-occupancy and income groups represented in Table 8 as having one or more housing problems, the highest number of housing problems was reported by owner households earning 50 -80 percent of AMI (1,045 households) and renter households earning 0-30 percent of AMI (940 households).

Describe the number and type of single person households in need of housing assistance.

According to ACS data, there are 2,725 single person or small family households in the city earning 0-80 percent of AMI as shown in Table 7. Of these households, 2,022 experience cost burden of at least 30%, representing 74% of households in this category according to tables 10 and 11. Single-person and small family households are more likely to experience housing cost burden and require housing assistance due to smaller income sources.

Estimate the number and type of families in need of housing assistance who are disabled or victims of domestic violence, dating violence, sexual assault and stalking.

The State of California Department of Justice maintains statistics on domestic violence statewide by jurisdiction. In 2020, the Riverside County Sheriff’s Department responded to a total of 949 calls related to domestic violence. Of these calls:
• 714 of these domestic incidents did not involve a weapon • 184 calls involved personal weapons (i.e., feet or hands, etc.) and 51 domestic incidents involved other dangerous weapons.

Therefore, there are at least 949 households during the period of a year that were in need of some type of domestic violence services.

The form of assistance needed is twofold. First, the City recognizes that it is crucial to prioritize the creation of additional rental housing opportunities for low- and moderate-income households in general, because Riverside County is a “high -cost area,” as defined by the U.S. Department of Housing and Urban Development in the HUD Mortgagee Letter, dated November 30, 2021.

Second, it is important to ensure that both new and existing affordable housing opportunities are accessible to special needs populations, such as victims of domestic violence, persons with disabilities, single heads of household, seniors, and transition age youth. To address special needs populations, the City will also prioritize the provision of public services to remove barriers to accessing affordable housing.

What are the most common housing problems?
Based on Table 8, the most common housing problem in the city is cost burden, counting for 8,107 out of 9,045, representing 90 percent of all housing related problems in the City for households earning 0-100 percent of AMI. Analysis of the data in Table 10 indicates a need for housi ng assistance targeted at 6,996 (25 percent of the total City households) cost burdened households who pay more than 30 percent of their income for housing costs and who have incomes less than 80% of AMI. According to Table 11, of the severe cost burdened households, 4,459 households (16 percent of the total City households) earning 0-80 percent of AMI pay more than 50 percent of their income for housing costs, of which 48 percent who are renter households and 52 percent are owner households.

For household incomes of 0 -80 percent of AMI, b ased on Table 10 and 11 , elderly owner- occupied households have the greatest number of cases of housing cost burden (2,180 households) followed by the elderly rental households (1,240 households) and small-related renter (1,043 households) and owner households (979 households).

The next most common housing problem is crowding; however, this problem represents only 6 percent of all housing problems, according to Table 8.

Are any populations/household types more affected than others by these problems? Based on Table 10 and 11, for households earning 0 -80 percent of AMI, 74 percent of the 2,725 small- related low- and moderate-income households (2-4 persons) are cost burdened.

On the other hand, for large-related, 86 percent of 995 low- and moderate-income family households (5 or more persons) experienced a cost burden (860 households). Large families are prone to experiencing cost burden due to the need of buying larger, more expensive housing units.

Describe the characteristics and needs of Low-income individuals and families with children (especially extremely low-income) who are currently housed but are at imminent risk of either residing in shelters or becoming unsheltered 91.205(c)/91.305(c)). Also discuss the needs of formerly homeless families and individuals who are receiving rapid re -housing assistance and are nearing the termination of that assistance
The leading indicators of risk for homelessness include extremely low income and their housing cost burden. Tables 10 and 11 indicate the number of households with housing cost burdens more than 30 percent and 50 percent, respectively, by household type, tenancy, and household income. Based on the data in Table 10, 11,455 of households earning 0-80 percent of AMI in the City experience a cost burden. Of these low- and moderate-income households, 5,127 are renters and 6,328 are owners.

There are no known households in the City receiving rapid re -housing assistance. The County received Homelessness Prevention and Rapid Rehousing (HPRP) Program assistance from HUD but that program has been terminated.

The assessment of at -risk populations is based on ACS and CHAS data in the Consolidated Plan using HUD definitions for household types and housing problems.

Specify partic ular housing characteristics that have been linked with instability and an increased risk of homelessness
According to Table 10, the greatest need s would be the elderly low - and moderate - income homeowners, as well as small and large families . These extremely low- and low-income households are considered the most at risk of becoming homeless.

Small-related households also have a significant number experiencing a cost burden, at 74 percent of all households in that category . Additionally, 86 percent of all large families earning 0-80 percent of AMI experience a cost burden. These high rates lead to increased housing instability for these groups.

Discussion
Based on evaluation of ACS and CHAS data, the highest priority housin g need is the development of additional housing units, affordable to low - and moderate- income households, especially for the elderly, small-related households, and large families.

In addressing this priority need through the implementation of an affordable rental housing development goal in the Strategic Plan, assistance should be directed to the greatest extent feasible toward the development of units affordable to the severely cost burdened renter households who earn less than 50 percent of AMI and rehabilitation of housing units occupied by low- and moderate-income elderly households, who cannot afford to address housing rehabilitation needs.

C. NA-15 Disproportionately Greater Need: Housing Problems – 91.205 (b)(2) Assess the need of any racial or ethnic group that has disproportionately greater need in comparison to the needs of that category of need as a whole.

Introduction
HUD requires all grantees to compare and assess the need for housing for any racial or ethnic group present in the community. A disproportionately greater need exists when the members of racial or ethnic groups at an income level experience housing problems at a greater rate (10 percent or more) than the income level as a whole. For example, suppose that for 0 -30 percent of AMI households, 50 percent of those households experience a housing need. Discussion
Based on the above maps, all racial and ethnic groups are evenly spread throughout the City with the exception of three original communities of Menifee. The two older communities of Quail Valley and Romoland have higher concentrations of Hispanics and one census tract within Sun City has a higher concentration of Whites.

Based on this analysis, the following racial or ethnic groups were found to have a disproportionately greater level of housing problems relative to the percentage of all households in the given income category experiencing housing problems:
• Pacific Islander households with incomes 50-80 percent of AMI • American Indian / Alaska Native households with incomes 30 -50 percent, 50-80 percent of AMI
• Black/African American households with incomes 0 -30 percent, 30 -50 percent, 50 -80 percent of AMI
• Asian households with incomes 0-30 percent, 30-50 percent of AMI • Hispanic households with incomes 0-30 percent, 50-80 percent of AMI

Introduction
Similar to the previous section, Tables 17 through 20 below provide data to determine if disproportionate housing needs exist for any racial or ethnic group present in the community that experience severe housing problems, which are defined as:
• Lacks complete kitchen facilities: Household does not have a stove/oven and refrigerator. • Lacks complete plumbing facilities: Household does not have running water or modern toilets.
• Severe overcrowding: A household is considered severely overcrowded if there are more than 1.5 people per room
• Severe cost burden: A household is considered severely cost burdened if the household pays more than 50 percent of its total income for housing costs. Based on data in Table 21, 39 percent of Menifee households experience a cost burden (>30%), and 18 percent experience a severe cost burden (>50%). All racial and ethnic groups experienced a housing cost and severe housing cost burden. Based on an evaluation of available mapping resources through HUD's CPD Maps system, the old communities of Romoland and Quail Valley are heavily Hispanic. The old retirement communities of Sun City are mostly white. Racial and ethnic groups are spread evenly throughout the rest of the City.
