Declaration of Covenants and Restrictions to be recorded concurrently with PM38886 to memorialize the COA that apply to the parcels.

The Developer is requesting approval of the associated Agreement for Placement of Survey Monuments (PM38886 Agreement) as required by the Project’s COA. The PM38886 Agreement requires that improvement securities be posted to guarantee the completion of the required survey monument within 24 months from the date of City Council approval.

Tract Map No. 31229-1 (TM31229-1), the first phase of the Project, it is a proposed residential development by the Developer of 48.97 acres, for residential purposes. TM31229-1 proposes to construct 120 single-family lots, two private water quality basins, a private park, and a private lake. This phase of the Project is located within parcel 1 of PM38886.

On January 21, 2026, a Public Improvement Agreement and securities for TM31229-1 were approved by City Council to facilitate the start of work before map recordation. At that time, the Developer voluntarily assumed the risk, without liability to the City, that the Project’s final map may not be approved, or may be approved with different improvement plans or COAs than those anticipated.

The Developer is now requesting approval and filing of TM31229-1 and approval of the associated Agreement for Placement of Survey Monument (TM31229-1 Agreement) as required by the Project’s COA. The TM31229-1 Agreement requires that improvement securities be posted to guarantee the completion of the required survey monument within 24 months from the date of City Council approval.

Staff have reviewed the Developer’s request and determined that the Agreements meet the requirements of the Project’s COA. A summary of the bonds being posted to guarantee the required improvements are shown in Tables 1 and 2 below.

CITY OF MENIFEE
SUBJECT: First Reading and Introduction of an Ordinance for Annexation No. 39, Haven, into Community Facility District 2017-1, Maintenance Services
MEETING DATE: March 18, 2026
TO: Mayor and City Council
PREPARED BY: Mandy Stephens, Management Analyst
REVIEWED BY: Nick Fidler, Public Works Director
APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Adopt a resolution calling an election to annex territory, including Tentative Tract Map (TTM) 38766, Haven, located on the northwest corner of Garbani Road and Evans Road, into Community Facilities District (CFD) No. 2017-1 Maintenance Services and to levy a special tax on that land; and

2. Adopt a resolution declaring the results of the special landowner election; and

3. Introduce an ordinance, amending Ordinance No. 2017-231 and levying and apportioning the special tax in CFD 2017-1.

DISCUSSION
On February 4, 2026, the City Council adopted Resolution No. 26-1678, declaring its intent to annex territory to CFD No. 2017-1 and commence the annexation proceedings for the territory to be annexed, also known as Annexation No. 39. The next steps in the annexation proceedings are to hold a public hearing on March 18, 2026, to conduct an election for the landowners and to declare the results of that election. Notice of the public hearing was published in the Press Enterprise and mailed to the property owner in accordance with the Mello-Roos Act.

The area within Annexation No. 39 is included in TTM 38766 and is approximately 18 gross acres of a residential vacant lot within the City. The property is located on the northwest corner of Garbani Road and Evans Road, as shown in the attached Project Location Map. The proposed maintenance services would include items such as landscaping, lighting, streets, drainage, parks, trails, and graffiti abatement.

Per the request of Garbani Road 134 Owner, LLC (Owner), the City would establish a rate and Item Title: 11.1

method of apportionment and authorize the levy of special taxes on the taxable property within Annexation No. 39 to pay for those services.

Annexation No. 39 would have a maximum annual tax of $1,292 per unit and would be included in CFD No. 2017-1 as “Tax Zone 39.” This tax rate includes a Maximum Special Tax A of $913 per unit per year for maintenance services of public facilities and a Maximum Special Tax B (Contingent Tax B) of $379 per unit per year. The maximum annual tax rate is proposed to escalate each year at the greater of Consumer Price Index (CPI) or 2%. The attached CFD Maintenance Site Plan Exhibit illustrates which services would be maintained by the CFD.

The Owner submitted Consent and Waiver forms on file in the City Clerk’s Office to:
hold the election and declare election results; and
consent to the shortening of election time requirements; and waive analysis and arguments; and
waive all notice requirements relating to the conduct of the election immediately following the public hearing.

A copy of the boundary map entitled “Annexation Map No. 39, Community Facilities District No. 2017-1 (Maintenance Services)” was recorded on February 10, 2026, in Book 98 of Maps of Assessment and Community Facilities Districts at Page 93, in the office of Riverside County Recorder. Annexing the parcel into CDF No. 2017-1 would cover the costs of maintenance of public improvements associated with the development.

STRATEGIC PLAN OBJECTIVE
Thriving Economy

FISCAL IMPACT
The individual property owners in the CFD would be responsible for annual payments of special taxes. Upon full completion of the tract development, there would be an annual collection of Special Tax revenues of approximately $61,171, not including Contingent Tax B, to be used to pay for maintenance costs.

On June 1 of each year, every taxable unit for which a building permit has been issued within the boundaries of the CFD would be subject to the special tax for the ensuing Fiscal Year. If the anticipated costs of maintaining the facilities in any given Fiscal Year, prior to buildout of the project, exceeds the special tax revenues available from parcels for which building permits have been issued, the special tax may also be applied to property within recorded final subdivision maps, as well as other undeveloped property within the boundaries of the CFD.

All costs associated with annexation into the CFD have been borne by the Owners. By annexing into the CFD, the costs of maintaining improvements located within the development would be financed through special taxes levied on the parcels within CFD No. 2017-1 and not through the City’s General Fund.

CITY OF MENIFEE
SUBJECT: Confirmation of the Statement of Abatement Costs for the Krikorian Entertainment Complex
MEETING DATE: March 18, 2026
TO: Mayor and City Council
PREPARED BY: Craig Carlson, Building Official
REVIEWED BY: Orlando Hernandez, Community Development Director APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Adopt a resolution repealing and replacing Resolution No. 26-1671, confirming the final statement of costs in the amount of $420,527.25 to abate the public nuisance for the Krikorian Entertainment Complex located at 27387, 27459, and 27483 Newport Road; and

2. Authorize the placement of a special assessment or lien on the real property in case of delinquency.

DISCUSSION
At the January 21, 2026, City Council meeting, the City Council adopted Resolution No. 26-1671, confirming the statement of costs to abate the public nuisance for the Krikorian Entertainment Complex. This item is being brought forward for the City Council’s reconfirmation to ensure that all parties involved receive appropriate notification regarding the action being taken for the confirmation of the statement of abatement costs. The City Council is required to hold a public hearing to authorize the assessment or lien to the properties.

The Krikorian Entertainment Complex is located at 27387, 27459, and 27483 Newport Road (Property). Until the City’s recent abatement, the site consisted of three partially completed commercial structures, one retail framed shell building, one burned retail building with only remaining foundation/posts, and one partially constructed movie theater building.

Since 2021, the City has taken multiple code enforcement and abatement actions regarding ongoing violations at the Property owned by Showprop Menifee De, LLC (Owner). These actions are summarized in Table 1: Timeline of Actions. The City’s involvement began when the Property was first cited on September 1, 2021, for non-compliance due to overgrown vegetation, graffiti, and lack of adherence to development standards. Over time, the Property remained in violation, and in June 2023, all City-issued building permits expired due to lack of construction progress.

Subsequent inspections and enforcement efforts throughout late 2023 led to the issuance of Item Title: 11.2

Notices of Intent to Abate Public Nuisance for both the theater and the adjoining retail pad structures. The Owner appealed both notices, prompting administrative hearings in early 2024.

The hearing officer ultimately upheld the City’s position, denying the Owner’s appeals.

Following continued deterioration of the partially constructed structures, the City obtained a court- approved Inspection Warrant and performed a comprehensive inspection in April 2024. The inspection was performed by a team of Structural Engineers, City Fire Inspectors, and other construction specialists to fully assess the fire, life safety, environmental and health hazards at the Property. The inspection was necessary in order to determine the extent and scope of the substandard conditions on the Property and any further enforcement action that would be required to ensure the safety of community. The findings in the report revealed that a number of substandard conditions and public safety issues existed on the Property that required attention and that the Property constituted a public nuisance under a number of the City’s regulations including Menifee Municipal Code section 11.20.020 (2)(a-j), (4), (5), (7), (8), (13), (14), (27), (34), (39), (40)(a, c).

Based on the results of the comprehensive inspection, the lack of progress by the property owner to both adequately secure the site and ensure public safety or address the substandard conditions on the property, and in conformance with Menifee Municipal Code Section 11.20.130, the City Council adopted Resolution No. 24-1434 in June 2024, declaring the theater property a public nuisance, and authorized the City to abate the conditions should the Owner fail to do so. The Owner subsequently allowed the project’s land use entitlements to expire and took no action to correct the violations. A second administrative hearing regarding the retail pads resulted in a similar outcome, and in December 2024, the Council adopted Resolution No. 24-1526 declaring those structures a public nuisance.

In November 2024, the City Council authorized the City to enter into a demolition and site clearance contract with a Project Scope consisting of site clearance, debris removal, demolition and removal of the theater and retail pad structures, accessory structures, foundation, concrete work, pavement, footings, and all vegetation. The Project also included the removal of sub-surface utilities and the cap-off of water and sewer lines per Building Division and Public Works requirements. In response to the Owner’s failure to commence abatement of the nuisance conditions, the City moved forward with the demolition of the three commercial structures on January 24, 2025. The City Council accepted the completed demolition and site clearance on November 19, 2025, and authorized the City Clerk to file a Notice of Completion (NOC) with the Riverside County Recorder’s Office.

The complete sequence of actions taken by the City is provided below.

The Owner received the Statement on November 20, 2025, and failed to contest the abatement costs within 15 calendar days of receipt, establishing a waiver of the Owner’s right to contest the Statement. As such, the Statement is final and binding upon the City Council's confirmation, and following the City Council action to confirm those costs, the City may proceed to collect the abatement costs in any manner allowed by law.

Pursuant to Civil Code § 2929.45, a public hearing notice was published on February 22, 2026, for the March 4, 2026 City Council public hearing. A public notice was published in The Press Enterprise and notices were mailed to property owners within a 300-foot radius of the project site.

All relevant public agencies and those requesting notification were notified of the public hearing.

At the March 4, 2026 City Council Meeting the City Council continued the public hearing to the March 18, 2026 Meeting.

FISCAL IMPACT
There is no additional fiscal impact associated with the confirmation of the Statement of Abatement Costs. As the City was forced to abate the violations with City Council approval, the City agreed to front the abatement costs, and associated staff and legal costs, from the available fund balance in the General Fund. The City will hereafter seek to recover the full costs of enforcement and abatement costs and fees through a special assessment or lien placed on the Property, or through direct recovery efforts against the Owner. To the extent any costs of abatement are recovered, they would be repaid to the General Fund.

Subject: Statement of Abatement Costs – Krikorian Entertainment Complex Retail Pad 3 (27459- Framed Shell), Retail Pad 4 (27483-Foundation/Burned Structure), Theater (27387- Partially Constructed)

To Whom It May Concern:

During a Public Hearing on June 5, 2024, the Menifee City Council adopted a Resolution that declared the Theater a public nuisance in conformance with Menifee Municipal Code section 11.20.130 and ordered Showprop Menifee DE (“Owner”) to abate the nuisance conditions within thirty (30) days.

Similarly, on December 17, 2024, a Resolution was adopted declaring the Retail Pad structures as public nuisances in conformance with Menifee Municipal Code section 11.20.020 and the California Civil Code section 3480. The Owner was again ordered to abate the nuisances by demolition within thirty (30) days and was notified that failure to abate said nuisance conditions within the 30-day period would result in the City completing the abatement of the properties. Both letters also informed the Owner that it would be liable for all abatement and administrative costs and fees if the City was forced to take abatement action. The Owner failed to abate the nuisance conditions in a timely manner and the City moved forward with the demolition and site clearance of the three commercial structures.

Pursuant to Menifee Municipal Code section 11.20.150, the City of Menifee has maintained an accounting of all administrative and abatement costs/fees in relation to the abatement of the nuisances as captured in the enclosed invoice. Pursuant to Menifee Municipal Code section 11.20.070, and by this letter, the City of Menifee formally demands payment of $420,527.25 as reimbursement for the incurred abatement costs and fees.

Showprop Menifee DE may contest the abatement costs by filing a written request with the Menifee City Clerk’s office within fifteen (15) calendar days of the date of this letter. Unless a timely appeal is filed, payment of the abatement costs must be made within forty-five (45) days of this statement date. Failure to take the required action in a timely fashion will result in a hearing during which the City Council will consider confirming the costs and authorizing staff to record a special assessment and/or a lien upon the property for all abatement costs, as well as any additional costs incurred in relation to the special assessment.

The City of Menifee appreciates your prompt attention and payment; and if you have further questions, please do not hesitate to contact Noam Duzman at 714-641-3478.

DATE OF HEARING: March 4, 2026
PLACE OF HEARING:MENIFEE CITY COUNCIL CHAMBERS
29844 HAUN ROAD, MENIFEE, CA 92586
A PUBLIC HEARING has been scheduled, pursuant to Civil Code Section 2929.45, before the CITY OF MENIFEE CITY COUNCIL to consider confirming the abatement cost incurred for the real properties listed below and authorizing City staff to record a special assessment or lien against said properties if the owner fails to pay those costs in a timely manner.

Project Location
The Project site is the Krikorian Entertainment Complex located at 27387, 27459, and 27483 Newport Road, Menifee, CA 92584.

Description of Nuisance and Abatement
The City determined that the above-described properties were maintained in a condition constituting a public nuisance in violation of applicable laws and ordinances. After notice and failure to abate by the responsible party, the City caused the nuisance to be abated.

Proposed Costs and Amount of Lien / Assessment
The City seeks to recover the actual and reasonable costs incurred in performing the nuisance abatement, including administrative costs, in the total amount of $420,527.25.

An itemized report of the costs is on file with the Building and Safety Department and is available for public inspection during normal business hours.

Pursuant to Civil Code § 2929.45, the proposed lien or assessment does not exceed the actual and reasonable costs of nuisance abatement, and the costs are proposed to be adopted by the City Council at this public hearing.

The determination of the City Council is final and binding. Judicial review of the decision is subject to the provisions and time limits set forth in California Code of Civil Procedure sections 1094.6 et seq.

Proposed Action
At the public hearing, the City Council will consider:

The confirmation of the final statement of costs in the amount of $420,527.25 to abate the public nuisance at the above-described properties and authorization for the placement of a special assessment or lien on the real property in case of delinquency.

The determination of the City Council is final and binding. Judicial review of the decision is subject to the provisions and time limits set forth in California Code of Civil Procedure sections 1094.6 et seq.

Any person wishing to comment on the proposed Project may do so in writing between the date of this notice and the public hearing and be heard at the time and place noted above. All comments must be received prior to the time of public hearing. All such comments will be submitted to the City Council, and the City Council will consider such comments, in addition to any oral testimony, before making a decision.

If this is challenged in court, the issues may be limited to those raised at the public hearing, described in this notice, or in written correspondence delivered to the City Council at, or prior to, the public hearing.

Be advised that as a result of public hearings and comment, the City Council may amend, in whole or in Item Title: 11.2

CITY OF MENIFEE
SUBJECT: Santa's Workshop Facility Use Request
MEETING DATE: March 18, 2026
TO: Mayor and City Council
PREPARED BY: Rebekah Kramer, Assistant City Manager
REVIEWED BY: Bryan Jones, Assistant City Manager
APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Review and discuss the local non-profit organization, Santa’s Workshop, facility use request.

DISCUSSION
Established in 2005, Santa’s Workshop is a local non-profit organization that partners with other public agencies, community, and service organizations to provide backpacks, school supplies, clothing, sports equipment, science and craft kits, and holiday gifts to children from low-income families served by the Menifee Valley Community Cupboard or attending schools within Menifee Union and Romoland School Districts.

On January 21, 2026, the City Council requested that staff bring forward a discussion item to evaluate the availability of City owned/operated facilities that could be utilized by Santa’s Workshop for the storage of donated items. The organization is currently occupying space at the Menifee Valley Elementary School site at no cost in exchange for the covenants in the use agreement and the community benefit they provide to students affiliated with Menifee Union School District (MUSD). Given MUSD’s plans to renovate the school site, they will need to relocate their donated items stored at the school by June 2026. For this reason, representatives from Santa’s Workshop are seeking approval from the City to utilize a portion of retired fire station 5 located in the Quail Valley area for the storage of donated items. Site access would be limited to a select group of program volunteers assigned to deliver, inventory, and remove donated items throughout the year. Climate control and access to other site amenities such as bathrooms would not be needed based upon the identified use.

A list of existing owned and leased facilities is provided in Table 1 on the following page.

*Facility does not meet current building code or Americans with Disabilities Act (ADA) compliance standards for use outside of life safety operations.

With the shift of fire suppression operations in the western portion of the city to a new facility in the Quail Valley area (29745 Goetz Road), the retired station located at 28971 Goetz Road is now unoccupied. While the City has significant space constraints and extensive facility needs to support municipal operations, consideration could be given to allowing an outside organization to occupy a portion of the retired fire station on a limited basis. It is important to note however that this facility, built in the 1960s, does not conform to current Building Code and ADA standards.

Due to the site conditions and liability considerations, the facility could not be utilized for a purpose outside of public life safety operations without addressing building code and ADA compliance requirements. Nor could the property be leased for use outside supply/equipment storage restricted to a small portion of the facility.

Until the best long-term use of this facility is identified and funding can be allocated for the upgrades needed to support municipal operations, the facility could be utilized for storage restricted to the existing apparatus bay area. Some modest facility modifications would be required for the existing apparatus bay (approximately 800 square feet) to be leased for this purpose. Such improvements would include reinforcing/securing facility doors/access points at an estimated cost of $2,000. It is also important to note that the building is not staffed or equipped with surveillance equipment outside of security alarms. Any organization leasing the space at this facility would need to assume the risk related to its use of the facility, indemnify the City, and maintain property and liability insurance coverage.

Should the City Council wish to consider leasing the apparatus bay portion of Retired Fire Station 5, staff would work with Santa’s Workshop to negotiate terms and prepare a lease agreement for Council’s consideration.

STRATEGIC PLAN OBJECTIVE
Community Engagement and Social Infrastructure

FISCAL IMPACT
The fiscal impact associated with leasing the apparatus bay portion of Retired Fire Station 5 would require securing facility doors/access points at an estimated cost of $2,000. These costs are in addition to the allocation of staff time to prepare and manage the lease agreement and site access. No additional budget appropriation action(s) is necessary.
