5. Five hundred dollars ($500.00) for a fifth violation of this resolution within one year of the first violation. Water usage over 300 units in excess of the Water Allocation Target during a single billing cycle shall also constitute an additional violation, in excess of four.
6. When a civil penalty is to be imposed, the customer will be given written notice of the penalty to be imposed. Within seven (7) days after delivery of such notice, the customer may submit a written request to the City requesting a hearing by the City Manager or designee and an opportunity to present evidence that a violation has not occurred. Within seven (7) business days after the hearing, the City Manager or designee shall render a decision in writing to the customer that requested the hearing.
Upon receipt of the written decision, the customer shall have seven (7) days to appeal the decision to the City Council. The City Council shall then schedule the matter for consideration at a regular or special meeting of the City Council and render its decision, which shall be a final decision. e. Violation is further subject to enforcement through the installation of a flowrestricting device at the meter. f. In addition to the above civil penalties, each violation of this code is subject to Chapter 1.04 of the Municipal code.
g. Willful violations of the mandatory conservation measures and water-use restrictions applicable during a Level 5 Water Shortage Emergency condition may be enforced by discontinuing service to the property at which the violation occurs.
Drought Surcharges
Ordinance No. 1056, Chapter 14.04 Water System
January 15, 2020
During declared Water Shortage Response Levels 2 through 5, mandatory water reductions may result in unplanned reduction in revenues in the water fund. To address the potential future reductions in revenues the City Council may elect to enact a "Drought Surcharge" during each respective Level as a means to stabilize rate revenues. It is important to note that the "Drought Surcharge" would only be enacted as deemed necessary by the City Council. While the City may never need to enact the surcharges, having the ability to implement them if necessary would allow the City to quickly address unforeseen revenue shortages due to mandatory conservation in the future. The "Drought Surcharge" shall not be more than adopted by City Council as establish by resolution and within proper public notification guidelines as required by federal or state rules and regulations. A copy of all current "Drought Surcharges" shall be provided upon request and listed on the City's website.
SECTION 2: EFFECTIVE DATE: This Ordinance shall become effective 30 days after final passage thereof.
SECTION 3: SEVERABILITY: If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause, subsections, sentences, clauses, or phrases hereof irrespective of the fact that any one or more of the sections, subsections, sentences, clauses, or phrases hereof be declared invalid or unconstitutional.
SECTION 4: POSTING: The Mayor shall sign this Ordinance and the City Clerk shall attest hereto and shall cause the same within 15 days of its passage to be posted at no less than five public places within the City of Norco.

SUBJECT:
Approval of Contract for Design Services to Upgrade the Existing Recycled Water Pump Station
RECOMMENDATION:
Approve a contract with Krieger & Stewart Engineering Consultants for design services for upgrades to the existing Recycled Water Pump Station located at the Western Riverside County Regional Wastewater Authority facility and authorize the City Manager to issue a purchase order in the amount not to exceed $85,800.
SUMMARY:
Based on Krieger and Stewart Engineering Consultants site assessment, a design proposal was provided to the City to prepare the necessary plans and specs for the upgrade of the recycled water lift station and Navy improvements based on a 10 week schedule (see attached proposal). Staff is recommending the City Council accept the proposal for design services from Krieger and Stewart, Inc., award a contract in the amount not to exceed $85,800.
BACKGROUND:
In 2005, the City of Norco constructed a recycled water pump station located at the Western Riverside County Regional Wastewater Authority (WRCRWA) facility. This pump station was intended to provide recycled water to the City of Norco once the State approved the use of recycled water from WRCRWA. However, the permitting process for recycled water from WRCRWA was delayed for over 15 years due to legal protests from Orange County Water District that needed to be resolved. WRCRWA now has a State permit to provide recycled water to its members for use in their respective jurisdictions.
While the City does have some backbone distribution pipelines that can deliver recycled water to Wayne Makin Park, Neil Snipes Park, Pikes Peak Park, and Ingalls Park, there are no customers currently eligible to accept recycled water. However, over the past couple years the Navy has inquired with the City if recycled water could be provided to
Lake Norconian. The City is currently providing non-potable water to Lake Norconian but this water has iron and manganese which creates water quality issues for the lake and the Navy would prefer recycled water if it can be made available. The City has informed the Navy that recycled water is now available and could be provided to Lake Norconian but this would require some improvements to the City's existing pump station and adding some valving and meter to the existing pipeline currently used to provide non-potable water.
In 2021, Public Works hired Krieger and Stewart Engineering Consultants (Krieger and Stewart) to conduct a site assessment and analysis of the existing recycled water pump station to determine the condition of the pump station and what modifications or improvements might be necessary in order to deliver recycled water to the Navy.
Unfortunately, due to 15 years of inactivity, the recycled water pumps and valves Norco installed have seized up and now need to be replaced and require other minor improvements to the pump station in order for the pump station to function properly.
Fortunately, the Navy has made the City aware of a federal grant that might be able to pay for all the necessary improvements. This grant requires any project to be shovel ready and would need to be in construction within 12-months from the award of the grant. Based on the population of Norco, the City is eligible to receive 100% grant funding if our project is selected. Staff is currently working on the grant application with the Navy in order to meet the July 1 deadline. The Navy is providing the City with a support letter for the proposed project. Staff has estimated the overall construction budget would be about $500,000.
In order to ensure the City is shovel ready for the grant application the City needs to complete design plans (or be in progress) to upgrade the recycled water pump station and the improvements to the existing Navy connection. Based on Krieger and Stewart site assessment, a design proposal was provided to the City to prepare the necessary plans and specs for the upgrade of the recycled water lift station and Navy improvements based on a 10 week schedule (see attached proposal).
FISCAL IMPACT:
The WRCRWA & Recycled Water Capital Improvement Project was approved as a Capital Improvement Project (CIP) in the Sewer Fund for Fiscal Year 2021-2022. Funds in the amount of $2,500,000 are available for Fiscal Year 2021-22 and $3,000,000 is being requested for Fiscal Year 2022-23, therefore sufficient funding is available (project number 4808.2; account number 147.960.53250).
RELATIONSHIP TO STRATEGIC PLAN:
The approval of the design services for the recycled water pump station is consistent with Strategic Plan Goal No. 5 - Infrastructure & Asset Management: Ensure timely preservation, replacement, improvement and acquisition of infrastructure and capital assets.

Subject: Norco Reclaimed Water Pump Station
Design Engineering Services Proposal
Dear Mr. Blais:
We appreciate the opportunity to submit our proposal to provide engineering services for subject project.
Our proposal is based on your request and is organized into the following sections:
I. Project Understanding
II. Scope of Services
III. Fee Estimate and Schedule
I. PROJECT UNDERSTANDING
The Norco Reclaimed Water Pump Station (Station) is located within the Western Riverside County Regional Wastewater Authority (WRCRWA) Wastewater Treatment Plant (Plant). We understand the Station was constructed in 2006, but has not been in operation since being constructed. The Station was constructed to receive tertiary water from the Plant and discharge to the City of Norco's (City's) reclaimed water system via the 12" reclaimed water pipeline in River Road adjacent to the Plant. The City's reclaimed water pipeline system connects the Station to a turnout connection to Lake Norconian, and to the rest of the pipeline system that extends through the City. There is also a connection to the City of Corona's (Corona's) River FCS-833 Subzone pressure reducing valve and metering station (FCS-833 PRV); however, FCS-833 PRV requires higher system pressure to operate then the City's Lake Norconian turnout. The City is repairing this Station in order to take its allocation of reclaimed water from the Plant and convey it to Lake Norconian.
In preparation for this upgrade project, we prepared a Condition Assessment Report for the Station that included an alternative evaluation. Based on said evaluation and subsequent discussions with the City, the design flow for these upgrades is 1.5 million gallons per day (MGD) and the flow will be conveyed to Lake Norconian; upgraded facilities will not be adequate to convey flow to Corona's FCS-833 PRV or to the City's other reclaimed water connections, which include the Snipes Park Reservoir and connection at Ingalls Park. The basic design approach for the Project will follow the Alternative 1 recommendations in the Condition Assessment Report, which generally includes replacement of damaged valves and sensors and upsizing of the existing pumping units.
Modification to the pump controls will be required to operate the station based on RTU call in lieu
Chad Blais
May 19, 2022
of the hydropneumatic system controls in the current design. In addition, a flow control and metering station is required to maintain upstream pressure and monitor the amount of water delivered to Lake Norconian. In general, the flow control station will be equipped with an 8" abovegrade pipe assembly (includes flow control valve, flow meter, and isolation valves), solar power generation (solar panel, inverter, and batteries), and control panel (flow meter and flow control valve controllers and space for SCADA remote control equipment).
Design engineering services required by the City for the Norco Reclaimed Water Pump Station Upgrade project consist of the preparation of complete Contract Documents, which consist of all documents required for bidding and constructing the Pump Station upgrades, including 24" x 36" construction drawings, bidding sheets, contract, special requirements, basic specifications, standard drawings, and bidding/award assistance.
II. SCOPE OF SERVICES
We propose to organize our Design Engineering Services into the following components:
1. Booster Station Design
1.1 Verify Pump Selection
1.2 Controls Evaluation and Electrical Design
2. Flow Control and Metering Station Design
2.1 Site Selection and Preliminary Design
2.2 Site Survey
3. Contract Document Preparation
4. Bidding Phase Support
1. Booster Station Design
1.1 Verify Pump Selection
During the condition assessment phase of this project, we performed preliminary hydraulic analysis to determine feasibility of the alternatives and to select preliminary pump models for the alternatives. Said analysis was primarily based on record drawing for the pipeline. However, record information for the turnout pipeline from Western Avenue to the lake outlet was not provided, so we used the most direct alignment for the preliminary hydraulic analysis. As part of the final design, we will verify or revise the turnout alignment used for the preliminary hydraulic analysis and will finalize the pumping unit selection.
1.2 Controls Evaluation and Electrical Design
During the condition assessment phase of this project we performed a preliminary condition assessment of the existing MCC to determine if the existing equipment
Chad Blais
May 19, 2022
was in acceptable condition for use. However, a detailed evaluation of the control circuits was not performed. For the design phase of this project, we propose to subcontract with Doby Engineering, which is the firm that did the original design.
As part of the electrical design process, Doby Engineering will perform a field evaluation of the existing MCC panels to determine the current control scheme and required modifications for the intended operation. In addition, Doby will perform all electrical design for the project.
2. Flow Control and Metering Station Design
2.1 Flow Control Station Siting and Preliminary Design
As one of the first orders of work, we will coordinate with the City to select a location for the proposed Lake Norconian Flow Control and Metering Station (Flow Control Station). We expect that this Flow Control Station will be in existing right-of-way or utility easement along the existing pipeline on Western Avenue. Once a location is set, we will select equipment, which include coordination with manufacturers, and prepare a preliminary layout for City review.
We will include manufacturer's data for solar power equipment, flow control valve, and flow meter with the preliminary site layout submittal. The layout for the Flow Control Station will be based on the preliminary layout and the corresponding City review comments regarding same.
2.2 Design Survey
Once the Flow Control Station site has been selected, we will provide a site which will be used for preparation of base construction drawings.
3. Contract Document Preparation
Our design engineering services will include preparation of construction drawings and specifications, as well as selection of equipment. We propose to use the existing record drawing as a base for our construction drawings. Pumping unit characteristics will be determined based upon the system hydraulic analysis. Control equipment requirements will be coordinated with the City's staff and SCADA subcontractor.
We will prepare the complete set of Contract Documents for bidding, including the bid sheets, special provisions, technical specifications, and construction drawings, and compile a PDF including same on behalf of the City for distribution to interested bidders.

g. Flow Control and Metering Station Plan
The flow control and metering station plan sheet will be prepared on 10 or 20 scale (as appropriate) base drawings and will show existing physical features, existing improvements, survey data, site grading, dimensions and elevations, and locations for above grade piping and valve assembly, solar power equipment, electrical conduit/conductors, and RTU panel with valve and meter controllers. h. Flow Control and Metering Station Sections and Details The flow control and metering station detail sheets will be prepared to include sections and details as needed to identify the flow control valve, magnetic flow meter, and solar/control panel requirements, as well as other upgrade requirements.
We will also prepare the project specifications, which will include the bidding sheets, special requirements, and technical specifications. The specifications will also include the Notice Inviting Bids, Contract Performance Bond, Payment Bond, Contract Appendix, Basic Specifications, and applicable Standard Drawings. In addition, we will prepare a construction cost estimate.
We will provide the following milestone submittals for City review:
75% Submittal Construction Drawings - essentially complete. Specifications - all Technical Specifications and Supplemental Special Provisions. 100% Submittal Complete Construction Drawings and Specifications. Engineers Cost Estimate.
4. Bidding Phase Support
During the bidding period, we will provide clarifications of the Contract Documents, and will prepare addenda (if necessary) for distribution. We will assist City staff with review of each submitted bid to determine whether or not it is responsive. For the apparent low bidder, we will check the references supplied. Following our review of the bids, we will prepare a recommendation of award memo for City staff which will summarize the bids received and the results of the reference checks, and recommend contract award.
III. FEE ESTIMATE AND SCHEDULE
Our estimated fee for providing the above-described design engineering services is $85,800 as shown in Table 1 attached. Our estimated fee is based on the rates in our 2022 Fee Schedule, also attached. Our estimated fee is subject to negotiation based on clarification or revision of the Scope of Services.
Chad Blais
May 19, 2022
Our estimated fee for design engineering services is based on the following understandings and assumptions:
1. Upgraded pump station will have the required capacity to pump to the Lake Norconian turnout but will not have the required capacity or surge equipment necessary to convey water to the City's other connections or to City of Corona's FCS-833 PRV station.
2. Preparation of a new geotechnical study and CEQA compliance documents will not be required and are not included in our proposal.
3. Flow control and metering station will be located offsite in existing City right-of-way or easement. Legal and plat preparation for land acquisition will not be required.
4. Flow control station piping will include pipe riser and flow control valve and flow meter will be installed above grade. Design of a vault is not included in the project.
5. Flow control station control panel will include the equipment required to manually set a flow rate locally (onsite). The control panel will be designed for a future upgrade to SCADA remote control which will include space in the control panel for SCADA equipment and a dedicated terminal strip with the key connections pre-wired to the flow meter and control valve controller.
6. All pipelines are existing and offsite pipeline design is not required.
7. Electrical power at the existing Chemical Building MCC-M is adequate to power the station and design and coordination of a new SCE electrical service is not required.
We estimate we can complete the above services in approximately ten (10) weeks.

If at any time during the life of the Contract or any extension, Contractor or any of its subcontractors fail to maintain any required insurance in full force and effect, all work under this Contract shall be discontinued immediately, and all payments due or that become due to Contractor shall be withheld until notice is received by City that the required insurance has been restored to full force and effect and that the premiums therefore have been paid for a period satisfactory to City. Any failure to maintain the required insurance shall be sufficient cause for City to terminate this Contract. No action taken by City hereunder shall in any way relieve Contractor of its responsibilities under this Contract.
The fact that insurance is obtained by Contractor shall not be deemed to release or diminish the liability of Contractor, including, without limitation, liability under the indemnity provisions of this Contract. The duty to indemnify City shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Contractor. Approval or purchase of any insurance contracts or policies shall in no way relieve from liability nor limit the liability of Contractor, its principals, officers, agents, employees, persons under the supervision of Contractor, vendors, suppliers, invitees, consultants, sub-consultants, subcontractors, or anyone employed directly or indirectly by any of them.
In the event of a partial or total destruction by the perils insured against of any or all of the work and/or materials herein provided for at any time prior to the final completion of the Contract and the final acceptance by the City of the work or materials to be performed or supplied thereunder, the Contractor shall promptly reconstruct, repair, replace, or restore all work or materials so destroyed or injured at his/her sole cost and expense. Nothing herein provided for shall in any way excuse the Contractor or his/her insurance company from the obligation of furnishing all the required materials and completing the work in full compliance with the terms of the Contract.
If Contractor should subcontract all or any portion of the services to be performed under this Contract, Contractor shall require each subcontractor to provide insurance protection in favor of City, its officers, officials, employees and agents in accordance with the terms of each of the preceding paragraphs, except that the subcontractors' certificates and endorsements shall be on file with Contractor and City prior to the commencement of any work by the subcontractor.

City shall, within 45 days of receiving such statement, review the statement and pay all approved charges thereon.
3.3.3 Reimbursement for Expenses. Consultant shall not be reimbursed for any expenses or work completed unless said work was requested and authorized in writing by City.
3.3.4 Extra Work. At any time during the term of this Agreement, City may request that Consultant perform Extra Work. As used herein, “Extra Work” means any work which is determined by City to be necessary for the proper completion of the Project, but which the parties did not reasonably anticipate would be necessary at the execution of this Agreement.
Consultant shall not perform, nor be compensated for, Extra Work without written authorization from City’s Representative.
3.3.5 Prevailing Wages. Consultant is aware of the requirements of California Labor Code Section 1720, et seq., and 1770, et seq., as well as California Code of Regulations, Title 8, Section 1600, et seq., ("Prevailing Wage Laws"), which require the payment of prevailing wage rates and the performance of other requirements on "public works" and "maintenance" projects. If the Services are being performed as part of an applicable "public works" or "maintenance" project, as defined by the Prevailing Wage Laws, and if the total compensation is $1,000 or more, Consultant agrees to fully comply with such Prevailing Wage Laws. City shall provide Consultant with a copy of the prevailing rates of per diem wages in effect at the commencement of this Agreement.
Modification to the pump controls will be required to operate the station based on RTU call in lieu

of the hydropneumatic system controls in the current design.
Chad Blais

was in acceptable condition for use.
Chad Blais
May 19, 2022
The Contract Documents will include the following construction drawings:
a. Cover Sheet
The cover sheet will include project title, vicinity map, location map, and index to sheets.
b. Construction and Material Notes
The construction and material notes sheets will address construction sequence, general construction, piping, electrical, and mechanical requirements, abbreviations, coating and finish schedules, and work site restoration requirements.
c. Booster Station Mechanical Plan
The booster station mechanical plan sheet will be prepared on 10 or 20 scale (as appropriate) base drawings and will show existing physical features, existing improvements, site grading, dimensions and elevations, discharge and blow off piping. In addition, all items to be replaced, refurbished, or otherwise upgraded will be clearly identified.
d. Booster Station Mechanical Detail Sheets
The booster station mechanical detail sheets will be prepared to include sections and details as needed to identify pumping unit requirements as well as to detail other upgrade requirements.
e. Booster Station Electrical Plan
The booster station electrical plan sheets will show the location of electrical components, including pumps, motor control center, service connection, electrical conduits and conductors, and miscellaneous electrical details. f. Booster Station Electrical Diagram and Details
The booster station electrical diagram and details sheets will show control ladder diagrams and details for any required sensor upgrades, conduit or conductor replacements, or any other electrical details required to identify the work requirements.
Chad Blais
May 19, 2022

Prepared By: Chad Blais, Public Works Director
Department: Public Works
SUBJECT:
Change Order Request for Norco MDP Line S-2 Storm Drain Project (Design) RECOMMENDATION:
Review and approve Change Order Request in the amount of $34,110 for the Norco MDP Line S-2 Storm Drain Project (Design)
SUMMARY:
Staff is requesting that City Council approve a change order request in the amount of $34,110 for Armstrong & Brooks Consulting Engineers for additional design efforts and modifications related to the Norco MDP Line S-2 Storm Drain Project.
BACKGROUND:
On October 4, 2017 the City Council awarded a design contract to Armstrong & Brooks Consulting Engineers in the amount of $35,750 to design the Norco MDP Line S-2 Storm Drain Project. During the preliminary design phase of the project the engineer recommended increasing the number of pothole locations due to the unforeseen quantity of underground facilities within Second Street. Based on the engineer’s assessment City staff approved an additional $8,259 for potholing services resulting in an overall contact amount of $44,009.
During the storm drain design process it was determined that in order to maximize the storm drain capture efficiency the project would need to incorporate curb & gutter improvements between Corona Avenue and Hillside Avenue. The City retained RKA to prepare the street improvement plans and work with Armstrong & Brooks for the joint storm drain and street project. The incorporation of the street work into the storm drain plans created additional work for Armstrong & Brooks in the amount of $14,465. This included additional catch basin and revisions to the hydrology report.
During the final design revisions it was determined that due to multiple grade differential issues between private driveway improvements and the new curbing that the street
design would need to be modified to shift the curbing and incorporate a super elevated roadway design along a portion of the project. This roadway change required revisions to the storm drain design resulting in an additional cost of $19,645. This included the relocation of several basins and updating of the basin and street hydraulics. The cost of the two addendums totals $34,110 ($14,465 & $19,645 - See attached Addendum) resulting in a total amended project design cost of $78,119.
Armstrong & Brooks has provided staff with the change order request in the amount of $34,110. Staff has reviewed the change order and has determined the proposed cost to be reasonable. Therefore, staff is requesting that City Council approve the change order in the amount of $34,110 for Armstrong & Brooks Consulting Engineers to complete the required design revisions.
FISCAL IMPACT:
The Norco MDP Line S-2 Storm Drain Project was approved as a Capital Improvement Project in the Storm Drain Fund for Fiscal year 2017-2018 funded by the Riverside County Flood Control and Water Conservation District. Funds in the amount of $910,000 ($25,000 for design and $885,000 for construction) were carried over to FY 2021-2022.
Total costs incurred to date are $47,186 ($35,175 for design and $12,011 for construction). Funds are available and sufficient to fund the additional design work in the amount of $34,110 (project number 4214.21; account number 129.935.43180.30). Staff will transfer funds from construction to design.
RELATIONSHIP TO STRATEGIC PLAN:
Authorizing approval of this professional design services change order is consistent with Strategic Direction No. 5 – Infrastructure and Asset Management: Ensure timely preservation, replacement, improvement and acquisition of infrastructure and capital assets.

Regarding: Addendum Request for Civil Engineering Design Services Norco MDP Line S-2
Dear Mr. Nelson:
As previously discussed, the City’s RFP stated that the S-2 storm drain design was “. ..not to include full street improvements such as curb, gutter and fullwidthpavement.” The subsequentaddition of the fully improved street plans byRKA has impacted the substantially completed storm drain design which was most recently submittedfor plan check via email on March 2, 2020.
RKA’s requirement to incorporate additional ?ow by catch basins where depth of ?ow is 4” or greater in the street section, not only required additional hydraulic analysis, but also required the addition of 4 new catch basins, laterals, junction structures, etc. togetherwiththe relocation of 4 sets of previously designedcatch basins, laterals, and structures (manholes/junction structures/transition structures).
The additional effort required to incorporatethese changeswas substantial and subsequentto the extra work previously expended to convert a previously submittedplan set from County of Riverside Flood Control drafting standards as originally speci?ed in the RFP to the City’s more traditional plan style.
We respectfully request that the City authorize an addendum to our original contract by amending the original scope of work with the following line items:

Attn: Mr. Sam Nelson, P.E.
Deputy City Engineer/Deputy Director of Public Works
Regarding: Addendum No. 2 - Request for Civil EngineeringDesign Services Norco MDP Line S-2
Dear Mr. Nelson:
As previously discussed the street design changes implemented by RKA necessitate additional changes to the substantially completedstorm drain design which was most recentlysubmitted via email on May 5, 2021.
The shift in curb alignmentsnecessitates updating the street centerline stations for all catch basins together with the lateral lengths and in some cases the lateral alignments. The street plan revisions propose relocatingfour catch basins and laterals and adding a catch basin and lateral to the proposed easterly curb line in Hillside at Second St.
Street design change includedsuper—elevatinga portionof Second St. and addinga cross gutter to Second St. at Temescal Rd. The super-elevation, cross gutter addition, catch basin addition and catch basin relocations leads us to recommend that the hydrology study be updated to confirm that the proposed catchbasins, laterals and main line are properly sized to accommodate the different points of capture and changesto the intercepted and conveyed ?ow.
The above referenced street design revisions also necessitate an update to the hydraulic model and analysis of the mainline, catch basins, laterals and street capacity calculations.
There has also been a request to relocate manholes from residential driveways. The manhole locations are utilized to accommodateproposedgrade breaks in the mainline. The subsequentchangesto pipeline slopes will require updates to the calculated inverts at joins and utility crossings within those reaches that are subject to change.
We respectfully request that the City authorize an addendum to our original contract by amending the original scope of work with the following line items:

STAFF REPORT
Date: June 15, 2022 Agenda Item:
2.Q.
To: Honorable Mayor and City Council Members
Prepared By: Amanda Hamilton, Facilities and Maintenance Director
Department: Facilities and Maintenance
SUBJECT:
Approval of Six-Month Extension for Citywide Landscaping Services RECOMMENDATION:
Approve six-month contract extension and contract addendum for the Citywide Landscaping Service with BrightView Landscape Services, Inc., in the amount of $396,150 with the option of additional enhancement and irrigation work as needed in City Facilities and Landscape Maintenance Districts.
SUMMARY:
The Facilities and Maintenance Department secures and manages the service maintenance contract for the citywide landscaping of public facilities, parks, open space, parkways and Landscape Maintenance Districts (LMDs). In addition to landscape maintenance, this contract also includes the daily cleaning and opening of the park restrooms, along with daily trash service.
BrightView has provided service to the City of Norco on the current contract since 2015.
The contract has had two previous addendums (Attachment "E"). On June 30, 2022, BrightView Landscape Services Inc. current contract with the City of Norco is set to expire.
Staff is proposing a six-month extension to the contract to allow staff adequate time to thoroughly review the existing contract. This extended time period would also accommodate the incorporation of necessary changes to the contract, provide adequate time for bid solicitation, advertisement of bid, adequate assessment of bids, and award of contract by the City Council.
The timing for the contract extension is also consistent with the needs of the parks and LMDs. Summer months are typically busier times for the parks with higher vegetation growth rates, additional attention to irrigation management, and overall maintenance due to greater attendance at City facilities. The proposed contract extension would expire on December 31, 2022, and would offer a smoother transition during the winter months if the contract is awarded to a different service company.
BACKGROUND:
BrightView Landscaping Services, Inc. has proposed a 7% increase for annual maintenance of the Parks and LMDs. The proposed cost increase takes into consideration Consumer Price Index (CPI) increases, higher labor costs, and the increased fuel costs. The proposed six-month extension would be effective July 1, 2022 and continue until December 31, 2022.
The proposed LMD cost would increase from $385,527 Annually to $412,500 Annually.
Since this is a six-month contract, the proposed six-month contract amount is $206,250 with a monthly rate of $34,375 (Attachment "B"). The Parks cost would increase from $354,991 Annually to $379,800 Annually. The proposed six-month contract amount would be $189,900 with a monthly rate of $31,650 (Attachment "C").
The cost breakdown below provides current cost along with the costs for the proposed 7% increase for LMDs and Parks:
Current
Monthly Costs
Proposed
Monthly Costs
Proposed
Monthly
Increase
Proposed SixMonth Total
Norco LMD $32,127 $34,375 $2,248 $206,250.00
Norco Parks $29,582 $31,650 $2,068 $189,900.00
Billing for the proposed additional increase would begin on July 1, 2022, and will result in a total monthly increase from the existing monthly total of $61,709 to a new monthly total of $66,025. In addition, BrightView and City staff have discussed the attached adjustments to the contract terms in Addendum No. 3, amending the performance service contract for Citywide Landscaping Services.
The general adjustments to the contract include:
1. BrightView to provide a crew up to 10 men from July 1, 2022 through September 30, 2022
2. BrightView to provide a crew up to 9 men from October 1, 2022 to December 31, 2022
3. Additional Work Pricing Sheet with updated values (Attachment “D”)
4. Updated language for withheld payments
5. Contract duration shall be for a period of six (6) months starting July 1, 2022 and ending on December 31, 2022
6. All irrigation repairs will be considered an "extra charge" and charged at market rate The 7% rate increase has been accounted for in the Parks Landscape Maintenance Operating Budget for FY 22/23 and the upcoming Landscape Maintenance Districts Engineer Reports that will be brought to City Council on July 6, 2022. Staff is requesting
that the City Council accept the contract addendum, and award a six-month contract to BrightView Landscape Services, Inc. ending on December 31, 2022.
FISCAL IMPACT:
The proposed Park Landscape Maintenance Service Agreement is funded from the General Fund in the Park Maintenance Contractual Services Fund in the amount of $189,900 for the six-month extension ($31,650 Monthly).
The proposed Landscape Maintenance Service Agreement is funded from the five LMD Contractual Service Funds 34100 - 791, 792, 793, 794, 795 in the amount of $206,250 for the six-month extension ($34,375 Monthly).
Funding for the proposed Landscape Maintenance Service Agreement for both Parks and the five Landscape Maintenance Districts is included in the Fiscal Year 2022-2023 Operating Budget.
