Why are you interested in serving on a City of Norco Commission/Committee/Advisory Council?
As a Norco resident, I am very interested in how the City of Norco will go about upcoming property developments/construction/growth while retaining the more "Rural" lifestyle that Norco provides it's residents.

In your opinion, what are the goals and objectives of the Commission(s)/Committee(s)/Advisory Council(s) you are applying to serve on? As stated above, to retain what makes Norco so unique by being a more "Rural" lifestyle with a focus on equestrian and animal keeping properties. This is "Horsetown USA" and I believe the City of Norco should remain as such, most people live here for this reason. I do understand that growth/development is inevitable but there has got to be a way to still preserve Norco's roots.

If appointed, how would you help achieve these goals and objectives? I am a very hard worker and tenacious. I will do everything that I can possibly do to serve the city and hopefully help keep Norco so precious. I love this city....I moved here by myself when I was only 19 years old (I grew up in Los Angeles), rented a very small house on 7th St. and got my first horse...Norco was heaven to me and I'd like to be a part of keeping Norco so wonderful.

If appointed to serve, do you see any potential for a conflict of interest claim based on personal interests?
None

Why are you interested in serving on a City of Norco Commission/Committee/Advisory Council?

Page 607 of 694 ends

My wife and I moved to Norco originally from a prayer driven decision. every moment since then, has only solidified and reaffirmed that it was the correct decision and design for us. Our family has grown from 2 to 4 since moving to Norco, and we foresee this being our forever home.

I have a heart of service, and I would like to do what I can, in whatever capacity is needed, to help our city thrive, while retaining the important character that makes Norco so special compared to our neighboring cities.

In your opinion, what are the goals and objectives of the Commission(s)/Committee(s)/Advisory Council(s) you are applying to serve on? In my view, the planning commission is there to safeguard the development of the city to be in alignment with the city charter, first among equals, protecting the animal keeping lifestyle.

In the face of many state and federal laws that sometimes run contrary to the goals and ideals of the charter, I think the planning commission should be the body that provides creative design goals that are in alignment with the laws, but also in alignment with our charter. the members of the planning commission should be the design professionals that are best equipped to ask the correct questions, and guide the discussion toward those goals.

If appointed, how would you help achieve these goals and objectives? I plan to be a very active participant on the commission, as I have been on EDAC. The valley square presentation was a great example of the limitations of discussion under EDAC vs. the questions I would have been able to raise on the planning commission.

I make a point of thoroughly researching every topic before the meeting. I did this for my role in EDAC where I worked directly with Chad and Roger at the city, as well as working with STUC, and finally drafting the report for staff to share with city council on the topic of parking on Hamner.

I think the biggest difference that would set me apart, however, would be my enthusiasm for the opportunity to directly play a role in shaping the future of the City I love.

If appointed to serve, do you see any potential for a conflict of interest claim based on personal interests?
I do not believe so.

My only experience on a committee was serving as Committee Chair for Troop 999 in Norco from 2010 to 2013.

Employment Background (List titles and duties)

Page 624 of 694 ends

I have been in Construction Management for over 36 years in both the private and public sector. The majority of my experience has been in Public Works, both working on the construction side and for public agencies. I was the Contract Administrator for the City of Riverside for almost 3 years then left and started my own business consulting for many public agencies throughout Southern California.

Educational Background (List degrees, majors, credentials, certificates and/or licenses) I attended al Poly Pomona and majored in mathematics. I also attended Cal Poly's Extended University and received certificates in Construction Management, Construciton Business Management and Advanced Construction Management and now I instruct Legal Aspects of Construction pert-time at Cal Poly's Extended University.

Relevant Experience (Briefly explain how your background, training, education and/or interests specifically qualify you as an applicant for the governmental body you are applying to serve on)
In my 37 years of hands on Construction Management I have been exposed to numerous projects varying from large site improvements, roadways, bridges, buildings, parks, city facilities and city improvements including plan review, constructability reviews, code compliance, building compliance, design conformance and ADA compliance. I feel my ability to read and understand plans and hands on construction experience would assist with the Planning Commission abilities in many ways. I have worked with several Building Divisions in Southern California for many years and understand how to articulate the rules and regulations, and make sure projects are being constructed to the standards required by the City. When necessary, evaluate changes required to make sure the concerns of our Council members and people of Norco are being properly represented. I feel it is very import to be relevant to the past while also evaluating the future.

Why are you interested in serving on a City of Norco Commission/Committee/Advisory Council?
I have always lived in the surrounding area of Norco and wanted to have residency in Norco. It ha taken several years to finally obtain that goal. I have always wanted to become more involved in the community. With all of my years serving in the public sector I have been exposed a side many do not see. The good, the bad, the politics and the possibilities. I feel Norco is very unique committee and I am proud to finally be part of the community. I have grown a successful business, have many years of knowledge and feel it's time to share that experience where it could be well served.

In your opinion, what are the goals and objectives of the Commission(s)/Committee(s)/Advisory Council(s) you are applying to serve on? As stated above, it is necessary to constantly evaluate the rules and regulations currently in place at the City of Norco, maintain an understanding of those rules and regulations and make sure those standards are current and relevant to the City. It is also important to maintain the integrity of the City standards and listen to City staff, the people and City Council and understand the current rules and regulations as well as evaluating the necessary changes that may be needed to keep the City relevant.

If appointed, how would you help achieve these goals and objectives?

Page 625 of 694 ends

By listening to the people of Norco, City Council and City staff. I believe it is critical to listen and understand the needs. As previously stated, Norco is a very unique community and there are many things that need to be preserved, however, times change. It is critical to make sure the integrity and intent of the City is maintained while evolving with the needs of the future.

If appointed to serve, do you see any potential for a conflict of interest claim based on personal interests?
I do not see any potential for conflict. I believe I have a very strong professional and business ethic that would be uncompromised.

High School Graduate (North Hollywood High School) 1987 Relevant Experience (Briefly explain how your background, training, education and/or interests specifically qualify you as an applicant for the governmental body you are applying to serve on)
As a real estate appraiser I am familiar with property zoning and property uses.

None

Page 659 of 694 ends

I have been in Construction Management for over 36 years in both the private and public sector. The majority of my experience has been in Public Works, both working on the construction side and for public agencies. I was the Contract Administrator for the City of Riverside for almost 3 years then left and started my own business consulting for many public agencies throughout Southern California.

Educational Background (List degrees, majors, credentials, certificates and/or licenses) I attended al Poly Pomona and majored in mathematics.

Page 660 of 694 ends

It is critical to make sure the integrity and intent of the City is maintained while evolving with the needs of the future.

If appointed to serve, do you see any potential for a conflict of interest claim based on personal interests?

City Council

STAFF REPORT
Date: June 15, 2022 Agenda Item:

5.B.

To: Honorable Mayor and City Council Members
Prepared By: Lisette Free, Finance Director
Department: Finance
SUBJECT:

Rate Adjustments Proposed by Waste Management of the Inland Empire for Fiscal Year 2022-2023.

RECOMMENDATION:

Adopt Resolution No. 2022-39, approving Cost of Living and Pass-Through Adjustments for FY 2022-2023.

SUMMARY:

The existing ten-year Franchise Agreement provides that Waste Management is entitled to receive rate adjustments for inflation (based on the Consumer Price Index) and “pass through” disposal cost increases. This proposed rate adjustments include an increase of

8.59% percent representing the annual Consumer Price Index (CPI) for 2021. For the Fiscal Year 2022-2023, Waste Management is requesting pass-through disposal costs in solid waste disposal, green waste, and manure. Under the Agreement, the City is required to not unreasonably withhold rate adjustments. Any disputes, including the withholding of rate adjustments, are to be resolved before a third party neutral Hearing Officer.

BACKGROUND:

The current Franchise Agreement between the City and Waste Management of the Inland Empire was executed on May 7, 2014 and became effective July 1, 2014. The ten-year term of the Agreement will expire in the year 2024. The Agreement provides that the franchisee is entitled to adjust rates on an annual basis to cover increased costs due to inflation based on increases in the CPI and “pass-through” costs incurred by the franchisee for disposal of the solid waste.

Waste Management submitted its proposed rate adjustments March 1, 2022 (see Attachment A). The proposed rates reflect a 8.59% CPI (see Attachment B). Residential and Commercial services franchise fees of 17.90% will not increase. Pass through rates are as follows:

Page 667 of 694 ends

• Solid Waste Disposal Cost - Riverside County tipping fee will increase by 8.59% effective July 1, 2022. This means the per ton rate will increase from $42.68 to $46.35 (see Exhibit C).
• Green Waste and Organic Disposal Cost – Effective July 1, 2022, the green waste/organics processing fee will remain the same $85.22 per ton. As of January 2020, the City’s green waste and organic waste is being processed by Waste Management’s South Valley Composting (SVC) facility in Tulare, CA. • The manure disposal component of the rates for FY 2021-22 will increase from $24.20 to $26.70, (see Attachment D). This translates into overall rate increase of $3.35 from $35.58 to $38.93 for a 95-96 gallon manure cart and $12.12 from $127.01 to $139.13 for a 2 cubic yard manure bin.

Residential Rate
The current residential rate would increase from $32.70 to $34.86 by the CPI adjustment.

The residential rate is for the weekly collection of trash, green waste and recycle. Manure collection and disposal service is considered an extra service offering.

Scout Fees
Scout fees are increasing by the CPI adjustment.

Alternative Disposal Options
Pursuant to Section 6 of the Franchise Agreement, Waste Management is required, upon request of the City Manager to meet and confer with the City to review and discuss industry updates, commercially reasonable technological advances for post-collection processing, handling, diversion or resource recovery and their potential application to the City. Waste Management has met with a Sub-Committee of the City Council and staff to discuss and review available alternate disposal options for organics and manure. While there are potentially available options, the cost at this time is still very prohibitive.

Recommendation
It is the City Attorney’s opinion that this proposed rate adjustment does not trigger Proposition 218 Protest Hearing Provisions as the existing agreement provides that the Franchisee is entitled to adjust rates on an annual basis to cover increased costs due to inflation based on increases in the CPI and pass through disposal costs. Therefore, staff is recommending approval of the proposed rates. The new rates will become effective on July 1, 2022.

FISCAL IMPACT:

The approved solid waste rates are calculated to recover the cost of providing solid waste services to each commercial and residential customer class. These services are provided by Waste Management under contract with the City. While the franchise fee rate will remain unchanged at 17.90%, the rate increase will result in additional franchise fee revenue of approximately $76,000 to the City's General Fund.

RELATIONSHIP TO STRATEGIC PLAN:

Page 668 of 694 ends

The Waste Management Rate Adjustments are consistent with Strategic Direction No. 4 - Communication and Stakeholder Experience: Enhance the stakeholder experience, engage the community, and build brand awareness through proactive, effective and consistent communication.

STAFF REPORT
Date: June 15, 2022 Agenda Item:

6.A.

To: Honorable Mayor and City Council Members
Prepared By: Lisette Free, Finance Director
Department: Finance
SUBJECT:

Approval and Adoption of the City of Norco Operating Budget for Fiscal Year 2022-2023 RECOMMENDATION:

Adopt Resolution No. 2022-40 approving and adopting the City Operating Budget for Fiscal Year 2022-2023 and authorizing appropriations therefrom.

SUMMARY:

On May 18th, May 31st and June 9th, 2022, staff conducted budget workshops to review the proposed Operating and Capital Improvement Program Budgets for FY 2022-2023.

During these workshops, staff presented Preliminary Operating Budgets to the City Council. The total recommended Fiscal Year (FY) 2022-2023 Operating Budget appropriation is $51,959,881. The Funds included in the City’s Operating Budget consist of the General Fund, Water Fund, Sewer Fund, Housing Fund, Community Development Block Grant (CDBG) Fund, Gas Tax Fund, Measure R Fund, Miscellaneous Grants Fund (including American Rescue Plan Act Fund), Nancy Newman Trust Fund, National Pollution Discharge Elimination System (NPDES) Fund, and Air Quality Management District (AQMD) Fund. The recommended budget is balanced for all Funds with FY 2022- 2023 total projected revenues and available spendable fund balance exceeding total projected expenditures.

BACKGROUND:

The City’s Operating Budget for FY 2022-2023 includes the General Fund, Water Fund, Sewer Fund, Housing Fund, Community Development Block Grant (CDBG) Fund, Gas Tax Fund, Measure R Fund, Miscellaneous Grants Fund, Nancy Newman Trust Fund, National Pollution Discharge Elimination System (NPDES) Fund, and Air Quality Management District (AQMD) Fund with total recommended appropriation of $51,959,881. The Appropriation Schedule is provided as Attachment “A”.

The City’s General Fund is the primary Operating Fund of the City and is the main source of monies used to pay for public safety services (fire and police), community services,

Page 680 of 694 ends

animal control, administration, legal, planning and building, engineering, code enforcement, senior programs, facilities maintenance and other essential governmental type services. The total recommended appropriation and projected revenue are $27,810,978 and $30,287,492, respectively. This results in total estimated General Fund operating revenue surplus of approximately $2.5 million. Although the General Fund is projected to have an estimated budget surplus of $2.5 million, it is important to note that estimated revenues include significant amount from development fees which could be negatively impacted by project delays for various reasons. It is also important to note that American Rescue Plan Act (ARPA) funding in the amount of $1.1million has been included into the Proposed FY 2022-2023 Budget. Without ARPA funds, these expenditures would have been funded through the General Fund.

The Water Fund has total estimated operating revenues of $13,562,316 and total estimated expenditures of $13,446,536 while the Sewer Fund includes total estimated operating revenues of $7,915,708 and total projected expenditures of $7,396,443. The difference between total projected revenues and expenditures in the Water and Sewer Funds of $115,780 and $519,265, respectively, will be used to fund operating reserves, rate stabilization reserves and future capital projects.

For additional information regarding revenues and expenditures estimates for the rest of the City Operating Funds, including Gas Tax, NPDES, CDBG, AQMD, Nancy Newman Trust, Measure R and Miscellaneous Grant Funds, see Appropriation Schedule (Attachment A).

The budget data for the Successor Agency of the former Norco Community Redevelopment Agency, which includes total estimated expenditures of $6,728,586 are presented in the City’s budget document for information purposes only. The Countywide Oversight Board and the State Department of Finance have the authority for approving the Recognized Obligations Payment Schedule (ROPS). On the other hand, budget information for the Housing Successor Agency, which includes total estimated expenditures in the amount of $259,183, is included in the total City budget because the City Council is the Successor Housing Entity's Governing Board.

Factors Affecting the Proposed Operating Budget:

As a result of the impacts from the Coronavirus Pandemic, General Fund revenue projection has been very volatile over the last two years. As the health impact from the pandemic begins to abate, the economic impact is also expected to stabilize. However, due to rising inflation, there are concerns that consumer spending could slow down causing key General Fund revenues such as sales tax to decline. With this in mind, General Fund revenues for FY 2022-2023 have been conservatively estimated. But, it is important to note that General Fund revenues include significant amounts expected to be derived from two major residential development projects which may be delayed due to declining economic conditions and other factors.

Outlined below are additional major factors that are likely to impact Operating Budget revenue in FY 2022-2023.
• Sales tax which represents nearly 36% of total estimated General Fund revenue is projected to increase slightly by 2.8%. City sales tax revenue has risen substantially in recent years. However, rising inflation may lead to slow down in

Page 681 of 694 ends

consumer spending which along with ongoing redistribution of online sales tax could have significant negative impact on FY 2022-2023 sales tax revenue growth. • Community Development revenues are estimated to significantly increase based on planned and ongoing commercial projects; and two major planned residential projects. Due to economic and other existing uncertainties, the residential projects may experience delays, which could have significant negative impact on projected revenues.
• Community services, facility rentals and recreation program revenues are estimated to significantly increase based on resumption of group activities and events after the pandemic.
• Water and Sewer Funds revenues are estimated based on current consumption levels and approved rates structure. No rate adjustments are scheduled to be implemented during the fiscal year. It is important to note that with the rising cost of purchased water and other costs, the Water Fund is projected to be at a breakeven point. Unless this trend is reversed, future rate increases will be necessary.

The following are key highlights affecting the FY 2022-2023 Proposed Operating Budget estimated expenditures:

1. Public safety – fire and police contract rates: Sheriff contract rates are projected to increase by 2.5% while Cal Fire contract rates are projected to increase by 17.3%

2. Wages and salaries are projected to increase by 8% due to adjustments based on changes to the Consumer Price Index.

3. City contribution towards the cost of health insurance premium for employees with family coverage is projected to increase by $250 per month for general, confidential, mid-management and management employees. This contribution has been capped by the City since FY 2011, notwithstanding the substantial increases in premium since the cap was put in place.

4. Personnel additions to meet work loads and new programs to serve the needs of the community.

5. Pass-through increase in pension contribution rates

6. Increase in retiree medical insurance costs due increase in premium and the number of retirees

7. Pass-through increase in general liability, workers compensation and other insurance programs.

8. Cost increases in third-party contractual and professional services.

9. Rising costs of purchased water

10.Increase on third party sewer treatment costs

11.Increase in Information Technology spending for equipment, security and software upgrades and replacements
Operating Budget Enhancements:

Fund and Working Capital Balances
The estimated beginning and ending fund and working capital balances for the major Operating Funds consisting of the General Fund, Water Fund and Sewer Funds are discussed below.

General Fund: The estimated fund balance as of the beginning of FY 2022-2023 is $22,699,703. Total estimated revenues including transfers-in during the fiscal year is $30,287,492 while total estimated expenditures is $27,810,978; resulting in estimated revenue surplus of $2,476,514. This will bring estimated fund balance to $25,176,217 at the end of FY 2022-2023. This estimated fund balance amount represents 91% of total estimated FY 2022-2023 expenditures of $27,810,978. By all measures, this amount represents a strong fund balance that can continue to prudently support maintenance of existing service levels even if the General Fund experiences short-term revenue decline.

Existing City Council resolution requires that an amount equal to a minimum of 25% of estimated General Fund expenditures be maintained as fund balance for emergencies.

Based on the recommended total General Fund budget of $27,810,978 the amount of fund balance required for emergencies in FY 2022-2023 is $5,482,495.

Page 683 of 694 ends

Water Fund: The estimated beginning working capital balance as of July 1, 2022 is $6,975,408. Total estimated expenditures including transfers-out during FY 2022-2023 is $13,446,536 while total estimated revenue is $13,562,316 resulting in estimated increase of $115,780 in working capital. With this increase, ending working capital is projected to be $7,091,188 by June 30, 2023. The increase in working capital will be used to fund rate stabilization and operating reserves; and future capital projects.

The Water Fund’s working capital balance is reviewed annually to determine the amount necessary to make the required contribution in order to meet the target for operating and rate stabilization reserves; and make transfers to Water Capital Fund for future capital projects. The target operating reserve was set to equal three (3) months of the cost of Water Fund operations or $3.4 million for FY 2022-2023. The goal is to fully fund the operating reserve within five years or by the end of FY 2022-2023. The rate stabilization reserve target is $2 million with a goal to fully fund the reserves by FY 2025-2026. The actual amount of working capital balance available to be transferred to Water Capital Fund for future projects will be determined at the end of each fiscal year based on actual results.

Sewer Fund: The estimated beginning working capital balance as of July 1, 2022 is $4,657,057. Total estimated expenditures including transfers-out during FY 2022-2023 is $7,396,443 while total estimated revenue is $7,915,708 resulting in estimated increase of $519,264 in working capital. With this increase, ending working capital is projected to be $5,176,322 by June 30, 2023. Like the Water Fund, the Sewer Fund’s working capital balance is annually reviewed to determine the amount to be allocated to meet operating reserve target and to fund capital projects. The operating reserve target was set to equal three (3) months of the annual cost of Sewer Fund operations or $1.8 million. A rate stabilization reserve was not recommended for the Sewer Fund due to the stability of sewer revenues. The actual amount of working capital balance available to be transferred to Sewer Capital Fund for future projects will be determined at the end of each fiscal year based on actual results.

Other Funds: The proposed budget for other Funds, including CDBG, NPDES, Housing Miscellaneous Grant Funds, Measure R, and Gas Tax estimates that there will be sufficient revenues and fund balances during the fiscal year to cover total recommended expenditure appropriations as shown on Attachment A. For more details, please refer to the City’s Proposed Budget schedules for FY 2022-2023.

The recommended Operating Budget does not include any appropriation from the Special Asset Revenue Fund. The Fund currently has available cash balance of $4.6 million which can be appropriated by the City Council to meet one-time expenditure needs. The Special Asset Revenue Fund was established by the City Council to accumulate revenues from one-time sale of assets and receipt of revenues.

FISCAL IMPACT:

Attachment “A” of the resolution provides a summary of estimated beginning fund balance and working capital; FY 2022-2023 estimated revenues, transfers, expenditures; and estimated ending fund balance and working capital for each Operating Fund. The total operating budget, for all City Funds excluding Successor Agency for FY 2022-2023 is

Page 684 of 694 ends

$51,959,881. Any changes to this recommended budget will be incorporated into the final published budget document.

RELATIONSHIP TO STRATEGIC PLAN:

The allocation of financial resources through the City's Operating Budget for FY 2022- 2023 is consistent with all the five Strategic Priorities established by the City Council.

STAFF REPORT
Date: June 15, 2022 Agenda Item:

6.B.

To: Honorable Mayor and City Council Members
Prepared By: Lisette Free, Finance Director
Department: Finance
SUBJECT:

Approval of the Five-Year Capital Improvement Program for Fiscal Years 2023-2027 RECOMMENDATION:

Adopt Resolution No. 2022-41 approving and adopting the City of Norco Capital Improvement Program Budget for Fiscal Years 2023-2027.

SUMMARY:

Budget Workshops were held, May 31 and June 9, 2022, to review the proposed Fiscal Year (FY) 2023-2027 Capital Improvement Program (CIP) Budget for the City of Norco.

Staff is now recommending that the City Council conduct a Public Hearing to receive input from the public and that at the conclusion of the hearing, that the City Council approves the CIP Budget for Fiscal Years 2023-2027. Any changes recommended and approved by the City Council during the Public Hearing will be incorporated into the final published budget document.

BACKGROUND:

Budget Workshops were held May 31 and June 9, 2022 to review the Proposed FiveYear Capital Improvement Program Budget for Fiscal Years 2023-2027. During the Budget Workshop, staff reviewed key projects funded by the City’s various Capital Improvement Project Funds; including projects to be funded with Measure R revenues.

The Measure R Citizens’ Oversight Committee (COC) met to review funding requests submitted by staff regarding FY 2022-2023 budget requests at their April 28, 2022 meeting. The COC completed its review and finalized its recommendations to the City Council for final review and approval.

FISCAL IMPACT:

Attachment A provides a summary of estimated beginning fund balance as of July 1, 2022; estimated FY 2022-2023 revenues; and estimated FY 2022-2023 capital project

Page 689 of 694 ends

expenditures. The total estimated beginning fund balance as of July 1, 2022 is $37.7 million; total FY 2022-2023 projected revenues are $43.7 million; and total estimated expenditures are $52.1 million. Projected revenues are based on developments which staff estimates that permits will be issued during the fiscal year. However, it is important to note that project expenditures for FY 2022-2023 are largely expected to be funded with existing fund balance. These projects are not dependent on future revenues that may or may not be realized.

RELATIONSHIP TO STRATEGIC PLAN:

The Five-Year Capital Improvement Program is consistent with Strategic Direction #3 “Assure financial stability by identifying new revenue sources and continuing prudent financial management.” It is also consistent with Infrastructure Strategic Direction #5 – “Ensure timely preservation, replacement, improvement and acquisition of infrastructure and capital assets.”
