Library Board City Code Updates
City Council
April 29, 2025
Kathleen Ashmore, Library Manager
1029
That the City Council approve the first reading by title only and waive further reading of the proposed Ordinance titled: AN
ORDINANCE OF THE CITY OF OXNARD, CALIFORNIA
AMENDING THE OXNARD CITY CODE TO REDUCE THE
MEMBERSHIP OF THE OXNARD LIBRARY BOARD TO FIVE
MEMBERS
RECOMMENDATION 2
1030
• Library Board first established on December 26, 1906 with establishment of Oxnard Public Library
• California Education Code (CEC) requires that a municipal library be managed by a board of library trustees
consisting of five members serving three-year terms on a staggered basis.
• In 1998, the Library Board was updated to become an
advisory board to Council, and in 2019, it became a
seven-member board in alignment with council districts. • Although consistent with the spirit of the CEC, the current structure is not entirely consistent with the CEC.
BACKGROUND 3
1031
• In July 2024, staff recommended restructuring the Library Board to ensure full compliance with the CEC pending an opinion from the State Attorney General (AG) to determine if the Library Board could be a seven-member body
consistent with the current Council membership.
• In February 2025, the City received a response from the AG that a Library Board must remain at five members
consistent with CEC.
• To ensure compliance with the CEC, staff is recommending that City Council adopt an ordinance revising various
sections of the Oxnard City Code.
DISCUSSION 4
1032
CEC Sections 18910-18987 define that a public library shall be managed by a Board of Trustees which must:
• Consist of five members who are appointed by the Mayor with approval from City Council;
• Serve three-year, staggered terms;
• Hold monthly meetings;
• Comply with the Brown Act; and
• Report to the legislative body of the municipality by August 31st of each year on the state of the library.
The new Library Board of Trustees will be managed by the Library Manager. Meetings will tentatively take place on the third Wednesday of the month at 4:30 p.m. and be held in the Main Library. After Council approval, the City will conduct recruitment and coordinate with the Mayor to bring
nominations forward to the Council.

REPORTS
AGENDA ITEM NO. M.5
DATE: April 29, 2025
TO: City Council
FROM: Michael Wolfe, Public Works Director, (805) 385-8055, [email protected] SUBJECT: Agreement 32500464 with Carollo Engineers, Inc. for Professional Engineering Services for the Digester Improvements Project. (10 minutes)
RECOMMENDATION
That the City Council approve and authorize:
1. The Mayor to execute an Agreement with Carollo Engineers, Inc. for a total not to exceed value of $2,100,000 for Professional Engineering Services for the Digestion/Cogeneration Improvement Project PW 25-70; and
2. A budget appropriation of $1,504,000 from the Wastewater Operating Fund (611) available fund balance, as well as the corresponding Wastewater Capital Fund (612) appropriation increase in the same amount for this Project (C2408). (This item did not originate in Committee as this is a capital improvement project specifically listed in the City's Capital Improvement Program budget, which was previously approved by the City Council.) BACKGROUND
The Oxnard Water Resource Recovery Facility (WRRF) has three anaerobic digesters for treating wastewater solids. The resulting byproducts of the anaerobic digestion process are biosolids and digester (methane) gas. Currently, the biosolids are transported daily by a third party to a composting facility. Digester gas is used on-site to power the WRRF cogeneration facility. Digesters 1 and 2 were constructed in 1975. Digester 3 was built in 1990. Properly operating digesters are critical to meeting regulatory and operational requirements for the treatment and disposal of the digestion byproducts. A typical lifespan of the type of digesters at the WRRF ranges from 50 to 100 years for the structures, 10 to 20 years for equipment, and 30 to 50 years for underground utilities.
In 2017, the city completed the Public Works Integrated Master Plan (PWIMP). The work included the evaluation of existing facilities, equipment and processes to inform decision making and to develop a prioritized list of repair and replacement projects. All three digesters were identified for complete rehabilitation. Improvements to digester 2 are nearing completion as part of the ongoing Reliability Project construction.
The PWIMP recommended renovating digesters 1 and 3 after completion of the digester 2 rehabilitation. The work required as part of the rehabilitation of digesters 1 and 3 includes the addition of a new boiler and the replacement of the heat exchangers, gas mixing compressors, control system, sludge heating system, underground utility lines, and all related equipment.
The goals of the project are to increase the reliability of the digesters, create redundancy, reduce energy consumption, and enhance overall digestion performance.

Project No. C2408 - Digester/Cogeneration Improvement Project, Specification No. PW 25-70, CIP 2025-2029 - Adopted June 4, 2024 - Page 148.
DISCUSSION
The specific work for this project includes the following:
• Review of all existing data and previous reports
• Development of a Preliminary Design Report
• Inspection and condition assessment of digesters 1 and 3 and all related equipment and structures • Identification and preparation of permit applications • Development of bidding documents, including plans and specifications • Cost estimates
• Services during bidding
• Construction phase services
A request for proposals (RFP) was published on December 19, 2024, with proposals due on January 29, 2025. The RFP was sent directly to 33 firms and published on www.PublicPurchase.com and the City’s Purchasing website. The City received two proposals from Carollo Engineers, Inc. and AECOM Technical Services, Inc. The proposals were reviewed and evaluated by three staff members, consisting of the Wastewater Division Manager, and Project Managers from the Engineering and Wastewater Divisions.
Carollo Engineers, Inc. was selected as the most qualified firm to complete the work identified in the scope of work.
Consistent with the City’s procurement policy, the selection was based on the company profile, assigned staff, related project experience, project approach and understanding, and overall submittal responsiveness. Staff have confirmed that Carollo Engineers, Inc. meets all required City contractual provisions, including possession of a City business tax certificate, insurance certificates and corporate filing with the California Secretary of State.
Staff recommends awarding the agreement to Carollo to complete the Digester/Cogeneration Improvement Project for the WRRF. They have extensive experience in completing digester evaluation and planning studies and detailed design services. Carollo authored the Co‐Digestion Capacity in California Analysis for the State Water Resources Board in 2019.
STRATEGIC PRIORITIES
This agenda item supports the Infrastructure and Natural Resources strategy. The purpose of the Infrastructure and Natural Resources strategy is to preserve and improve our roads, utilities, parks, trees, water supply and natural resources through effective planning, prioritization, and an equitable and efficient use of available funding.
FINANCIAL IMPACT
The cost to complete the scope of work for this project shall not exceed $2,100,000 over the five-year term. There is approximately $596,000 currently available in this Project (C2408) in the Wastewater Capital Fund (612) funded from the Wastewater Operating Fund (611). Since the design phase is starting this fiscal year, staff is requesting a budget appropriation of $1,504,000 from the Wastewater Operating Fund (611) available fund balance, as well as the corresponding Wastewater Capital Fund (612) appropriation increase in the same amount for this Project (C2408) to fund this agreement.
COMMITTEE OUTCOME
This item did not originate in Committee as this is a capital improvement project specifically listed in the City's Capital Improvement Program budget, which was previously approved by the City Council. 1036

INSURANCE REQUIREMENTS FOR CONSULTANTS
(WITH ERRORS AND OMISSIONS REQUIREMENT)
1. Consultant shall obtain and maintain during the performance of any services under this Agreement the following insurance against claims for injuries to persons or damages to property which may arise from or in connection with the performance of services hereunder by Consultant, its agents, representatives, employees or subconsultants.
a. Commercial General Liability Insurance, including Contractual Liability, in an amount not less than $1,000,000 combined single limit for bodily injury and property damage for each claimant for general liability with coverage equivalent to Insurance Services Office Commercial General Liability Coverage (Occurrence Form CG 0001). If a general aggregate limit is used, that limit shall apply separately to the project or shall be twice the occurrence amount;
b. Business automobile liability insurance in an amount not less than $1,000,000 combined single limit for bodily injury and property damage for each claimant for automobile liability with coverage equivalent to Insurance Services Office automobile liability coverage (Occurrence Form CA0001) covering Code No. 1, “any auto;” c. Professional liability/errors and omissions insurance appropriate to Consultant’s profession to a minimum coverage of $1,000,000, with neither Consultant nor listed subconsultants having less than $500,000 individually. The professional liability/errors and omissions insurance must be project specific with at least a one year extended reporting period, or longer upon request. d. Workers’ compensation insurance in compliance with the laws of the State of California, and employer’s liability insurance in an amount not less than $1,000,000 per claimant. Additionally, the workers’ compensation policy shall include a waiver of all rights of subrogation which the insurer may have against the City.
2. Consultant shall, prior to performance of any services, file with the Risk Manager certificates of insurance with original endorsements effecting coverage required by this Exhibit INS-A. The certificates and endorsements for each insurance policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. The certificates and endorsements are to be on the attached forms or on other forms approved by the Risk Manager. All certificates and endorsements are to be received and approved by the Risk Manager before commencement of services.
City reserves the right to require complete certified copies of all required insurance policies at any time. The certificates of insurance and endorsements shall be sent via email. If you have not received your request or are having difficulty with electronic upload, contact [email protected]
3. Consultant agrees that all insurance coverages shall be provided by a California admitted insurance carrier with an A.M. Best rating of A:VII or better and shall be endorsed to state that coverage may not be suspended, voided, canceled, or reduced in coverage or limits without 30 days’ prior written notice to the Risk Manager. The Risk Manager shall not approve or accept any endorsement if the endorsement contains “best effort” modifiers or if the insurer is relieved from the responsibility to give such notice.
4. Consultant agrees that the commercial general liability and business automobile liability insurance policies shall be endorsed to name City, its City Council, officers, employees, agents and volunteers as additional insureds as respects: liability arising out of activities performed by or on behalf of Consultant; products and completed operations of Consultant; premises owned, occupied or used by Consultant; or automobiles owned, leased, hired or borrowed by Consultant. The coverage shall contain no special limitations on the scope of protection afforded to City, its City Council, officers, employees, agents and volunteers. The General Liability Special Endorsement Form and Automobile Liability Special Endorsement Form attached to this Exhibit INS-A or substitute forms containing the same information and acceptable to the Risk Manager shall be used to provide the endorsements (ISO form CG 2010 11/85 or if not available, CG 2010 with an edition date prior to 01/04 and CG 2037).
5. The coverages provided to City shall be primary and not contributing to or in excess of any existing City insurance or self-insurance coverages (this must be endorsed). Additionally, the workers’ compensation policy shall include a waiver of all rights of subrogation which the insurer may have against the City. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to City, its City Council, officers, employees and volunteers. The insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability.
6. The insurer shall declare any deductibles or self-insured retentions to and be approved by the Risk Manager.
At the option of the Risk Manager, either the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects City, its City Council, officers, employees and volunteers, or the Consultant shall procure a bond guaranteeing payment of losses and related investigations, claim administration and defense expenses.
7. All insurance standards applicable to Consultant shall also be applicable to Consultant's subconsultants.
Consultant agrees to maintain appropriate agreements with subconsultants and to provide proper evidence of coverage upon receipt of a written request from the Risk Manager. 3/25

INSTRUCTION FOR SUBMITTING INSURANCE CERTIFICATES AND ENDORSEMENT FORMS Certificates of Insurance
The sample accord form on the following page is provided to facilitate your preparation and submission of certificates of insurance. You may use this or any industry form that shows coverage as broad as that shown on the attached sample. Please note the certificate holder address must be as shown on the attached sample accord form with the contract number and insurance exhibit identification information completed.
Improperly addressed certificates may delay the contract start-up date because the City’s practice is to return unidentifiable insurance certificates to the insured for clarification as to the contract number. Cancellation provisions must be endorsed to the policy. Modifying the certificate does not change coverage or obligate the carrier to provide notice of cancellation.
Endorsement Forms
Original endorsements are required for commercial general liability and business automobile liability insurance policies and must be attached to the applicable certificate of insurance. City preference is that the Consultant/insurer use the endorsement forms which are attached. Substitute forms will be accepted, however, as long as they include provisions comparable to the sample accord form.

RECOMMENDATION
That the City Council approve and authorize the City Manager to approve:
1. Transfers in the total amount of $49,531.62 from the General Fund (101) available fund balance to seven Landscape Maintenance Districts (Fund 120), with the corresponding budget appropriation adjustments for reimbursement of service charges, including interest; and
2. Transfers in amounts detailed in Table 2 of the Financial Impact section from six Landscape Maintenance Districts (Fund 120) available fund balances to six other Landscape Maintenance Districts (Fund 120), and subsequent transfers to and from the General Fund (101) for changes in General Benefit contributions with the corresponding budget appropriation adjustments for reimbursement of service charges, including interest. BACKGROUND
The Special Districts Division of the Public Works Department is responsible for the maintenance, operation, and administration of the City’s 50 Special Districts, including bonded and non-bonded Community Facilities Districts (CFDs), Landscape Maintenance Districts (LMDs), Waterways Maintenance Assessment Districts (WADs), and a Maintenance Assessment District (MAD). Each of these Special Districts has specific authorized individual services and improvements, including, but not limited to: maintenance of park landscapes, open spaces, parkways, medians, other public improvements, and recreation and park amenities such as picnic shelters, restrooms, arbors, and fountains.
Properties within each District are assessed an annual parcel charge for the purposes of maintaining the improvements and other authorized services. Many of the services are provided by Contractors, who invoice the districts individually for the service(s) that are completed within that district. Prior to payment, invoices are reviewed by Special Districts staff for confirmation of the services rendered and the costs allocated to the appropriate district, or other funding sources, as applicable. However, errors, while uncommon, must be corrected when staff confirms any discrepancy.
In September 2023, a resident brought to the Special Districts Division’s attention that there may have been charges to LMD-28 for sidewalk displacement grinding services that should have been charged to another funding source, since the area in question was not a component of that LMD. After reviewing the completed sidewalk maintenance records for LMD-28, the inaccurate charges were confirmed by Special District staff. Staff then reviewed all of the sidewalk maintenance charges that were performed within the LMDs. The result was a City Council-approved reimbursement on March 19, 2024, to the various LMDs totaling $168,247.67. 1087
As part of that March 19, 2023 staff report, Public Works staff noted that additional review would be done to check for other potential discrepancies for services beyond the sidewalk displacement grinding. Consistent with the starting timeframe that was reviewed for the sidewalk displacement grinding services, a staff member in the City Manager’s Office was assigned to perform spot checks for invoice discrepancies that were billed to the LMDs from Fiscal Year 2017-18 through Fiscal Year 2021-22. Since FY 2022-23, the Special Districts Division has staffing levels sufficient to continue conducting these spot checks.
DISCUSSION
The spot checks that were performed by staff from the City Manager’s office included invoices for monthly landscape maintenance services, tree trimming and removal, pest control, fence repair and replacement, and lighting repairs. The methodology for the review included the following quality control measures: confirmation that the services were performed within the appropriate District, confirmation that the services correspond with that fiscal year’s LMD Engineer’s Report, use of the City’s Geographic Information Systems (GIS) to verify each District’s boundaries and improvements, and use of the Finance Department’s Chart of Accounts to ensure the correct account numbers were used.
It is important to note that in cases where a service to an LMD authorized improvement was performed, but the corresponding invoice was unclear, potentially questionable, or staff was not able to validate a charge, the recommendation from staff was to err on the side of caution and reimburse the charges in question. For further details, please see the City Manager’s Office Memo, dated January 30, 2025, attached hereto as Attachment 1.
The findings from the City Manager's Office concluded that a total of $40,455.54 was incorrectly allocated or was questionable enough to recommend reimbursement among the LMDs. There is a difference of $570 between the total amount identified within the attached memo and the amount identified within this report. This is due to the inclusion of the entire amount of a single invoice, rather than a partial total, after further review of the specific charge. This table represents the total amount, per fiscal year, that was incorrectly charged to various LMDs.
Sum of Identified Charges
FY 17/18 $5,104.15
FY 18/19 $24,500.00
FY 19/20 $4,477.39
FY 20/21 $5,004.00
FY 21/22 $1,370.00
TOTAL $40,455.54
The necessary corrections for each impacted LMD are listed in the Financial Impact section.
Staff does not expect any further reimbursements to correct LMD service charges. However, staff is currently reviewing all LMD utility charges and expect some additional corrections to be presented to the City Council once that analysis is completed.
STRATEGIC PRIORITIES
This agenda item is a routine operational item or does not relate to the five strategic priorities adopted by City Council on March 16, 2021.
FINANCIAL IMPACT
The transfer amounts and corresponding budget appropriations, which include interest and applicable general benefit contributions, are outlined in Tables 1 and 2 below. To distinguish between transfers from the General Fund (Fund 101) and those occurring between various Landscape Maintenance Districts (LMDs), the details have been separated accordingly in the table.
The interest reimbursement adjustment was calculated taking into consideration the following assumptions: 1) Each respective invoice was paid within 30 days of the invoice date; and 2) the Local Agency Investment Fund (LAIF) interest 1088
rate was applied for each quarter through the quarter ending December 31, 2024. Since the LAIF rate for the quarter ending March 31, 2025, is not yet available, the interest for that quarter has been estimated using the trailing 4-quarter average of LAIF rates. The difference between the revised interest allocation and the original interest allocation is the proposed interest reimbursement. Additionally, the corresponding general benefit contribution attributed to these expenses has also been included in the transfer calculation.

Reimbursement of Service Charges to Special
Districts
City Council
April 29, 2025
Anthony Miller
Special Districts Manager
1113
RECOMMENDATION 2
That the City Council approve and authorize:
1114
BACKGROUND
• The Special Districts Division of the Public Works Department is responsible for the maintenance, operation, and
administration of the City’s 50 Special Districts, including bonded and non-bonded Community Facilities Districts (CFDs), Landscape Maintenance Districts (LMDs), Waterways
Maintenance Assessment Districts (WADs), and a Maintenance Assessment District (MAD).
• Each District has specific authorized individual services and improvements.
3 1115
BACKGROUND
• Many of the services are provided by Contractors, who invoice the districts individually for the service(s) that are completed within that district.
• Prior to payment, invoices are reviewed for confirmation of the services rendered and the costs allocated to the appropriate district, or other funding sources.
• Errors, while uncommon, must be corrected when staff
confirms any discrepancy.
4 1116
BACKGROUND
• In September 2023, a resident brought to the Special Districts Division’s attention that there may have been charges to LMD28 for sidewalk displacement grinding services that should have been charged to another funding source.
• After review, the inaccurate charges were confirmed by staff. • Staff then reviewed all sidewalk maintenance charges that were performed within the LMDs.
• The result was a City Council-approved reimbursement on March 19, 2024, to the various LMDs totaling $168,247.67. 5 1117
BACKGROUND
• As part of the March 19, 2023 staff report, Public Works staff noted that additional review would be done to check for other potential discrepancies for services beyond the sidewalk displacement grinding.
• Consistent with the starting time frame that was reviewed for the sidewalk displacement grinding services, a staff member in the City Manager’s Office was assigned to perform spot checks for invoice discrepancies that were billed to the LMDs from Fiscal Year 2017-18 through Fiscal Year 2021-22.
6 1118
DISCUSSION
• Staff spot check items included invoices for monthly landscape maintenance services, tree trimming and removal, pest control, fence repair and replacement, and lighting repairs.
• Methodology for the review included:
• Confirmation that the services were performed within the appropriate District,
• Confirmation that the services correspond with that fiscal year’s LMD Engineer’s Report,
• Use of the City’s Geographic Information Systems (GIS) to verify each District’s boundaries and improvements,
• Use of the Finance Department’s Chart of Accounts to ensure the correct account numbers were used.
7 1119
DISCUSSION
• In cases where a service to an LMD authorized improvement was performed, but the corresponding invoice was unclear, potentially questionable, or staff could not validate a charge, the recommendation from staff is to reimburse the charge in question.
• City Manager’s Office Staff detailed their findings in a memo dated January 30, 2025, which is attached to this report. 8 1120
DISCUSSION
• Staff concluded that a total of $40,455.54 was incorrectly allocated or was questionable enough to recommend
reimbursement among the LMDs.
• There is a difference of $570 between the total amount identified within the attached memo and the amount identified within this report.
• This is due to the inclusion of the entire amount of a single invoice, rather than a partial total, after further review of the specific charge.
9 1121
DISCUSSION
• This table represents the total amount, per fiscal year, that was incorrectly charged to various LMDs.
10 Sum of Identified Charges
FY 17/18 $5,104.15
FY 18/19 $24,500.00
FY 19/20 $4,477.39
FY 20/21 $5,004.00
FY 21/22 $1,370.00
TOTAL $40,455.54
1122
DISCUSSION
• The necessary corrections for each impacted LMD are listed in the Financial Impact section.
• Staff does not expect any further reimbursements to correct LMD service charges.
• Staff is currently reviewing all LMD utility charges and expects some additional corrections to be presented to the City Council once that analysis is completed.
11 1123
FINANCIAL IMPACT
• The transfer amounts and corresponding budget appropriations, which include interest and applicable general benefit contributions, are outlined in Tables 1 and 2.
• Interest reimbursement was calculated taking into consideration the following assumptions:
1) Each respective invoice was paid within 30 days of the invoice date; and
2) Local Agency Investment Fund (LAIF) interest rate was applied for each quarter through the quarter ending December 31, 2024. The March 31, 2025 LAIF rate has been estimated using the trailing 4-quarter average of LAIF rates.
• Each transactions corresponding general benefit contribution which would have been attributed to these expenses has also been included in the transfer calculation.

CITY COUNCIL AGENDA REPORT
REPORTS
AGENDA ITEM NO. M.7
DATE: April 29, 2025

BACKGROUND
On June 4, 2024, the City Council finalized a three-year agreement with the Oxnard Peace Officer’s Association (OPOA), introducing a key modification by eliminating the enhanced disability benefit offered through CalPERS. Previously, this benefit enabled public safety employees retiring due to disability to receive up to 90% of their pension tax-free, compared to the 50% provided under the standard contract.
This adjustment affects only new hires starting after the ordinance takes effect, making them ineligible for the enhanced benefit while reducing their CalPERS contribution rates. Existing employees, however, will maintain their current higher contribution levels and retain the enhanced benefit, which is protected as a vested right under the Public Employee Retirement Law (PERL).
The Public Employees' Retirement Law requires an amendment of an agency's CalPERS contract to be approved by ordinance following adoption of a resolution of intention.
STRATEGIC PRIORITIES
This agenda item is a routine operational item or does not relate to the five strategic priorities adopted by City Council on March 16, 2021.
FINANCIAL IMPACT
1129
According to CalPERS, the new second tier employer rate for new employees entering this tier will be 29.54% and the new employee rate that is paid for by the employee will be 14.75%. The current employer rate for PEPRA employees who will continue to receive this enhanced benefit is 34.10% and the employee contribution is 16.5%.
