CITY COUNCIL AGENDA REPORT
REPORTS
AGENDA ITEM NO. N.3
DATE: September 1, 2026
TO: City Council
FROM: Michael Wolfe, Public Works Director, (805) 385-8055, [email protected] SUBJECT: Ratify an Emergency Order for Sewer Collection System Repairs at Hemlock Street and Patterson Road.
RECOMMENDATION
That the City Council review and ratify the following:
1. The Director of Public Works’ emergency order to dispense with public bidding requirements pursuant to Public Contract Code section 22050, to make emergency repairs to the City’s sewer collection system;
2. Authorize the City Manager to enter into any contracts required to abate the emergency conditions necessitating emergency repairs to the City’s sewer collection system on Hemlock St. and Patterson Rd; and
3. Authorize the City Manager to enter into any contracts over $220,000 that may be required to abate the emergency.

BACKGROUND
Oxnard City Code Section 4-30(B)(5) authorizes the Director of Public Works to order or take any directly related and immediate action required in an emergency without giving notice for bids to let contracts for a public project, in conformity with Public Contract Code section 22050.
On Wednesday, August 12, 2026, at approximately 6:30 pm the Wastewater Division was notified of a sanitary sewer overflow through two separate calls to the wastewater after-hours emergency line. Wastewater crews arrived on-site and started to evaluate the situation and to determine the cause of the blockage. It took a couple of hours to dewater the system to a point where they could identify that a manhole upstream of Lift Station 29 had partially collapsed, washing soil into the sewers and blocking the flow. The cause of the collapse is still under investigation.
Crews worked throughout the night to partially clean the sewers in an effort to restore the sewer service to minimum levels. It was decided that the full extent of the damage could only be determined if sewage flow entering the damaged manhole was stopped. This required bypass pumping across Patterson Road. Starting on Thursday night, August 13th, at approximately 9 pm Toro Enterprises installed a temporary pipe across the southbound lanes of Patterson Road for bypass pumping. By Friday morning, August 14th, the pipe was installed and 2 portable pumps were deployed. These portable pumps require 24-hour, on-site monitoring by the contractor for emergency services.
Once the bypass pumps were installed, Oxnard crews began removing the soil and debris that had washed into the sewer system, which clogged the pipe. City crews worked throughout the weekend, allowing Wastewater staff to conduct a more thorough investigation. Upon further investigation, it was determined that a considerable amount of soil had washed into the wetwell (holding tank) of the lift station, reducing the performance of the existing fixed pumps and potentially 530
causing damage to the system.
Through field visits, in-house discussions, and meetings with contractors, it was decided that bypass pumping of all flow entering the lift station is required to restore the sewers and lift station to a safe operating condition. This requires diversion of three separate sewers with portable pumps. Once all planning is in place, it is estimated that the remaining field work to abate the emergency condition can be completed in less than two weeks. All work will be conducted at night to minimize disruption due to the construction.
In addition to the work completed to date, the remaining work to fully complete the emergency repairs includes, but may not be limited to: installation of a temporary underground bypass pumping pipe in Hemlock St; setting up bypass pumping for two additional sewers; constructing a new 15-inch sewer and manhole; cleanup of the lift station wetwell; repair of two additional manholes; and restoration of the streets.
DISCUSSION
The provisions of the Purchasing Ordinance allow emergency work to proceed without competitive bidding, subject to certain requirements. Pursuant to Oxnard City Code Section 4-30 and Public Contract Code §22050, the Director of Public Works may order any emergency action required to repair or replace any public facility without adopting plans, specifications, working details, or giving notice for bids to let contracts. Such work may be performed by City Staff or a Contractor, or a combination of the two. In this case, most of the emergency repair work will be performed by a thirdparty contractor, Toro Enterprises, Inc.
The City’s Purchasing Ordinance 3053 sets forth Section 4-30 regarding Emergencies for public projects. Under the City’s updated purchasing policy, task orders for similar work are limited to $75,000. When emergency repair costs are expected to exceed that threshold, the City must proceed immediately to address the emergency, restore service(s), and protect public health and safety, but the associated agreement(s) must subsequently be brought to the City Council for ratification and approval. As a result, Council is now seeing more emergency repair items than in prior years.
To provide additional context, Wastewater Division staff reviewed the City’s current major sewer main break log for the calendar year 2023 through the present. Based on the review, the sewer system experienced the following failures:
Year Number of Sewer Main Failures
2023 0
2024 2
2025 1
2026 1 (this item)
STRATEGIC PRIORITIES
This agenda item supports the Infrastructure and Natural Resources strategy. The purpose of the Infrastructure and Natural Resources strategy is to preserve and improve our roads, utilities, parks, trees, water supply and natural resources through effective planning, prioritization, and an equitable and efficient use of available funding.
FINANCIAL IMPACT
The current rough order magnitude cost estimate to make the necessary sewer repairs at Hemlock St and Patterson Rd is approximately $300,000. Approximately $35,000 has been incurred so far installing the temporary bypass pumping pipe in Patterson Rd and deploying 2 portable sewer pumps. Additional work and/or purchases may be required to complete the project and therefore, this current cost is only a rough order magnitude estimate. This will be funded from available FY2026-27 appropriations in the Wastewater Operating Fund (6113613-53200). A final project total will be provided to the City Council.
531
COMMITTEE OUTCOME
This item did not originate in Committee per the City Council Committee Bylaws Resolution 15,851, Article II, Section D. 3. c, as this is an urgency item.
