RECOMMENDATION
Staff recommends that the City Council introduce and a dopt Ordinance No. 1643, an Ordinance of the City Council of the City of Palmdale, recommending City Council approval of General Plan Amendment (GPA) 24-0002, Zone Change (ZC) 24-0002, and Comprehensive Development Plan (CDEV) 24-0003 finding that the project is consistent with Program Environmental Impact Report (PEIR) 22 -002 prepared and certified in conjunction with the City’s General Plan (Palmdale 2045) and direct staff to make necessary modifications to the Palmdale Transit Area Specific Plan (SP).
BACKGROUND
On June 13, 2024, the Planning Commission adopted Resolution No. PC -2024-014 recommending City Council approval of the proposed project to amend the boundary of the SP and modify the General Plan D esignation and zone of 12 parcels , totaling approximately 59 acres within the SP area to Regional Commercial (RC).
The SP was adopted on December 15, 2020, to guide the development of a pedestrian- oriented mixed -use district surrounding the City of Palmdale’s Transportation Center with the future California high -speed rail (CAHSR) station. Th e SP replace d, in its entirety, the original Palmdale Transit Village Specific Plan (PTVSP), adopted in 2007.
Report to Mayor and City Council
Re: Ordinance No. 1643
June 26, 2024
The 2007 PTVSP suggested a Transit Oriented Develop ment surrounding the City’s Transportation Center, which is served by local buses and regional Metrolink rail. With the introduction of CAHSR in the region, Palmdale will experience a new era of growth, thereby increasing interest and development around the new Palmdale Station hub.
Since 2020, there has been one amendment to the SP, not including the proposed CDEV 24-0003. The SP area is bounded by Technology Drive to the north, 10th Street East to the east, Palmdale Boulevard to the south, and State Rou te 14 (SR-14) to the west.

FIGURE 2 – PROPOSED MODIFICATION
DISCUSSION
CDEV 22 -001 has been initiated to revise the SP boundary along the southwestern portion of the SP to remove 12 parcels as shown in Figure 2. With the modification to the SP boundary, GPA 24 -0002 and ZC 24 -0002 is a request to amend the General Plan Land Use designation and zone of the 12 parcels from SP to RC. The amendment would permit all the uses allowed within the RC zone pursuant to Palmdale Municipal Code Table 17.47.020-1 (Allowed Uses – Commercial/Office Zones). In addition, the proposed amendment is beneficial to the City because it provides flexibility for future development to a prominent entry point in the City, will address split zoning, and will assist in creating synergy for the acquisition of Palmdale Boulevard. Furthermore, no development is proposed in conjunction with this request.
ENVIRONMENTAL REVIEW
PEIR 22-002 (State Clearinghouse # 2021060494) was prepared and certified by the City Council (Resolution No. CC 2022-096) on September 21, 2022, for approval of the City’s General Plan (Palmdale 2045). As part of the environmental analysis, PEIR 22 -002 also considered the adoption and implementation of the Comprehensive Zoning Code and Map update. Staff review has determined that a subsequent or supplemental PEIR as Parcels to be

designated

Re: Ordinance No. 1643
June 26, 2024
described in California Environmental Quality Act (CEQA) Guidelines Sections 15162, 15163, or 15164, is not required because the proposed GPA, ZC, and CDEV modify the boundary of the SP and would not require major revisions of the PEIR, there are no significant changes in circumstances and there is no new information of substantial importance that will involve new significant environmental effects or increase the severity of previously identified significant effects. As such, staff concluded that the request is consistent with the previous PEIR in accordance with CEQA Guidelines and has determined that no additional environmental analysis is required.

2. State law requires that the regulations governing the use and development of lands within the municipal limits of a city be consistent with the adopted General Plan for that city. On September 21, 2022, the City Council adopted a comprehensive update to the General Plan (Palmdale 2045), which required a comprehensive update to Title 17 of the Palmdale Municipal Code (PMC) ; and
3. On March 15, 2023, the City Council of the City of Palmdale adopted Ordinance No. 1603 a comprehensive Zoning Code and Map update; and
4. On August 16, 2023, the City Council of the City of Palmdale adopted Ordinance No. 1613 and 1614, which identified minor amendments to the PMC necessary to address inconsistencies, clarify review procedures, correct typographical errors and section references, as well as update the associated Zoning Map; and
Ordinance No. 1643

B. ORDINANCE
THE CITY COUNCIL OF THE CITY OF PALMDALE DOES ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby specifically finds that all the facts set forth in the Recitals, Part A of this Ordinance, are true and correct.
SECTION 2. The City Council hereby finds as follows with respect to the environmental document:
A. PEIR 22-002 (State Clearinghouse # 2021060494) was prepared and certified by the City Council (Resolution No. CC 2022-096) on September 21, 2022, for approval of the City’s General Plan (Palmdale 2045). As part of the environmental analysis, PEIR 22-002 also considered the adoption and implementation of the Comprehensive Zoning Code and Map update. Staff review has determined that a subsequent or supplemental PEIR as described in California Environmental Quality Act (CEQA) Guidelines Sections 15162, 15163, or 15164, is not required because the proposed GPA, ZC, and CDEV modify the boundary of the SP and would not require major revisions of the PEIR, there are no significant changes in circumstances and there is no new information of substantial importance that will involve new significant environmental effects or increase the severity of previously identified significant effects. As such, staff concluded that the request is consistent with Ordinance No. 1643
the previous PEIR in accordance with CEQA Guidelines and determined that no additional environmental analysis is required.
B. The custodian of records for the environmental document and all other materials that constitute the record of proceedings upon which the Planning Commission’s decision is based is the Planning Manager of the City of Palmdale. These documents are available for public review in the Planning Division of the City of Palmdale located at 38250 Sierra Highway, Palmdale, California 93550, telephone (661) 267-5200. In addition, the Final PEIR is available at:https://palmdale2045gp.org/wp-content/uploads/2022/10/Palmd aleGP_FinalEIRAppendicesResponsetoCommentsFindingofFactandStatem entofOverridingConsiderations.pdf.
SECTION 3. Based upon substantial evidence presented to this Council during the above-referenced June 26, 2024, public hearing, including public testimony, and written and oral staff report, this Council specifically finds as follows:
(a) The proposed change in land use is consistent with State law. (GPA) (b) The proposed Zone Change is consistent with the goals, policies, and objectives of the General Plan. (ZC)
(c) The distribution, location, and extent of land uses, including open space, as depicted in the Specific Plan, is consistent with the General Plan. (SPA) (d) The amendment is reasonable and beneficial. (GPA)
(e) The proposed Zone Change will not have a substantial adverse effect on surrounding properties or the community in general. (ZC) (f) The Specific Plan provides for adequate public infrastructure and services needed to support the land uses described in the plan; (SPA) (g) The standards and development criteria will ensure that development proceeds in an orderly fashion and maintains a high level of quality. (SPA) (h) The Specific Plan contains implementation measures to ensure that development is supported by adequate infrastructure as development occurs. (SPA)
(i) The site is suitable for the type and intensity of development proposed. (SPA)
Ordinance No. 1643
(j) The flexibility in development standards afforded by the Specific Plan process has resulted in a project providing a superior design and greater amenities than would occur pursuant to more traditional zoning practices, and the project provides clear and substantial benefit to the City. (SPA) The proposed application requests to change the General Plan land use and zoning designation for 12 parcels, totaling approximately 59 acres, from Specific Plan (SP) to Regional Commercial (RC). This change is beneficial to the City and will allow for more flexibility in future development of the site. If approved, the application would permit all uses allowed within the RC zone as outlined in the Palmdale Municipal Code Table 17.47.020-1 (Allowed Uses – Commercial/Office Zones). The RC General Plan Land Use designation and zone is intended for commercial/retail and service uses targeted at consumers from a regional market area. RC areas are designed to accommodate long-term goods and services such as big box retailers. In addition, the proposed amendment is beneficial to the City because it provides flexibility for future development to a prominent entry point in the City, will address split zoning, and will assist in creating synergy for the acquisition of Palmdale Boulevard.
No development is proposed in conjunction with the request; with the approval of this project, any future development is required to comply with the development standards of the RC zone.
SECTION 4. Based on the findings and conclusions outlined in paragraphs 1 and 2, this Council recommends approval of GPA 24-0002, ZC 24-0002, and CDEV 24- 0003, as shown in Exhibit A, and finds that the project is consistent with PEIR 22-002 prepared and certified for Palmdale 2045.
SECTION 5. All legal prerequisites and pre-conditions to introducing, enacting, and adopting this Ordinance have occurred as required by law and policy.
Ordinance No. 1643
SECTION 6. The City Clerk shall certify the adoption of this ordinance and shall cause this ordinance to be published or posted as required by law.
