11 Election Sequencing Rules
September 18, 2023
Which districts are up for election in which year?
The number of seats up for election each year does not change 3 in 2024, 2 in 2026
Statutory Language:
“the governing body shall give special consideration to the purposes of the California Voting Rights Act . . . and it shall take into account the preferences expressed by members of the districts.” (Elections Code 10010(b)) Standard Practice after Section 10010(b) compliance:
Let voters make re-election decisions by matching district election years to the year the term of the resident officeholder(s) expire.
This gets complicated when 2024 and 2026 Councilmembers are in the same district:
An at-large Councilmember may run for a district seat mid-term. A current Councilmember whose term ends and is in a district not up that year simply leaves the Council and cannot run for re-election that year.

12 Election Sequencing
September 18, 2023
Three districts must hold elections in 2024, and two in 2026. All focus maps and both new maps have Councilmembers Gatewood (2026), Pulipati (2024) and Terry (2024) in one district.
Simple part:
Respect the voters’ wishes and authority: assign the district with Councilmember Sander to 2024 and the district with Councilmember Budge to 2026. Complicated part:
Assign two other districts to 2024 and one other district to 2026. Map by Map:
The PDF files posted online for each map include the proposed election sequencing for that map.

MEMORANDUM
City Council Staff Report - Page 1 of 3
ITEM 11.2.
DATE: September 18, 2023
TO: Honorable Mayor and Council Members
FROM: Elizabeth Sparkman, Community Development Director Erin Naderi, Management Analyst
SUBJECT: RESOLUTIONS RELATED TO THE ANNEXATION OF STONECREEK
INDUSTRIAL PROJECT TO THE CITY OF RANCHO CORDOVA
COMMUNITY FACILITIES DISTRICT NO. 2014-2 (STREET, LIGHTING
AND LANDSCAPING MAINTENANCE)
RECOMMENDATION
Adopt the Resolutions.
RESULT OF RECOMMENDED ACTION
Adoption of the Resolutions would authorize a land owner vote which, if successfully passed, authorizes the annexation and levy of a special tax on the Stonecreek Industrial Project included in CFD No. 2014-2 (Street, Lighting, and Landscaping Maintenance). The special tax is for the purpose of paying for the public services to maintain public infrastructure necessary or incident to development in the CFD. Adoption of the Resolutions would also result in the cessation of the special tax for this project under CFD 2008-1 (Street Lighting and Road Maintenance) under which this project was previously annexed.
BACKGROUND
On April 21, 2014, the City adopted a Resolution of Intention to establish a Community Facilities District (CFD) and Future Annexation Area for Citywide street, lighting, and landscape maintenance services. On June 2, 2014, the City adopted the resolution forming CFD No. 2014-2 pursuant to the Mello-Roos Community Facilities Act of 1982 (State of California Government Code Section 5311 et seq.) (the “Act”). The action defining the Future Annexation Area for the District provided for a more efficient process for the annexation of property when the property owners have provided unanimous consent. Defining the future annexation area provided the resolution of intention, noticing, and public hearing for the entire future annexation area so these steps do not need to be repeated for each annexation.
Current Annexation
In April 2023, the City caused to be updated the Rate and Method of Apportionment for Community Facilities District No. 2014-2 (Street, Lighting and Landscaping Maintenance), to include a rate for Heavy Truck Traffic Parcels. Based on the operational requirements of the recently approved Stonecreek Industrial project and in order to apply the updated rates for this
City Council Staff Report - Page 2 of 3
type of use, it is appropriate to annex the parcel(s) to Community Facilities District No. 2014-
2. The property owner of the Stonecreek Industrial project has requested the City annex the project property into the Community Facilities District No. 2014-2 pursuant to the Mello-Roos Community Facilities Act of 1982 (State of California Government Code Section 53311 et seq.) to provide the method of financing for public streets, lighting and landscaping maintenance.
Because this project was not included in the Future Annexation Area for CFD 2014-2, the streamlined annexation process cannot be used. On August 7, 2023, the City Council adopted a Resolution of Intention to Annex the Stonecreek Industrial Project to CFD 2014-2 (Street, Lighting and Landscaping Maintenance).
Prior Annexation
On August 19, 2019, the City Council previously approved Resolution 94-2019, approving an Annexation Boundary Map for Stonecreek Industrial for Community Facilities District No. 2008- 1 (Street Lighting and Road Maintenance) with subsequent actions to record the Boundary Map and record a Notice of Special Tax Lien. Completion of the annexation of the project into CFD 2014-2 will also require the recording of a Notice of Cessation of Special Taxes for the parcels from CFD 2008-1 (Street Lighting and Road Maintenance).
DISCUSSION
The Resolution of Intention to Annex adopted by the City Council on August 7, 2023 set at 5:30 pm on September 18, 2023, or as soon thereafter as the matter may be heard, for the public hearing on the annexation of the Stonecreek Industrial Project into CFD 2014-2 and the levy of the special tax. The documents attached to this report will complete the annexation and levy the special tax in CFD 2014-2 and also cease the special tax under CFD 2008-1.
Included in this package as “Item” is a guide for the Mayor to use to facilitate the required public hearing and landowner vote process. Consult this document for an agenda to be followed to conduct the hearing and for the adoption of the items needed to complete the formation of the CFD and to hold the election

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CORDOVA
CALLING SPECIAL LANDOWNER ELECTION
CITY OF RANCHO CORDOVA
Community Facilities District No. 2014-2
(Street, Lighting and Landscaping Maintenance)
RESOLVED, by the City Council (the “Council”) of the City of Rancho Cordova (the “City”), County of Sacramento, State of California as follows:
WHEREAS, this Council has adopted a Resolution entitled “A Resolution of the City Council of the City of Rancho Cordova of Intention to Annex the Stonecreek Industrial Project to the City of Rancho Cordova Community Facilities District No. 2014-2 (Street, Lighting and Landscaping Maintenance) (the “Resolution to Annex”); and WHEREAS, pursuant to the provisions of the Resolution to Annex, the propositions of the levy of the special tax shall be submitted to the qualified electors of the CFD as required by the provisions of the Act.
NOW THEREFORE, IT IS HEREBY ORDERED as follows:
1. Issues Submitted. Pursuant to the Act, the issue of the levy of the special tax shall be submitted to the qualified electors (as defined below) of the CFD at an election called therefore as provided below.
2. Qualified Electors. This Council hereby finds that fewer than 12 persons have been registered to vote within the territory of the annexation to the CFD for each of the ninety (90) days preceding the close of the public hearings heretofore conducted and concluded by this Council for the purposes of these proceedings. Accordingly, and pursuant to Section 53326 of the Act, this Council finds that, for these proceedings, the qualified electors are the landowners within the CFD and that the vote shall be by such landowners or their authorized representatives, each having one vote for each acre or portion thereof such landowner owns in the CFD as of the close of the public hearing.
3. Conduct of Election. This Council hereby calls a special election to consider the issues described in section 2, above, which election shall be held on September 18, 2023, and the results thereof canvassed at the meeting of this Council on September 18, 2023. The City Clerk is hereby designated as the official to conduct the election and to receive all ballots until the close of business on the election date. It is hereby acknowledged that the Clerk has on file the Resolution of Intention to Annex, a map of the boundaries of the annexation area, and a sufficient description to allow the Clerk to determine the electors of the CFD. Pursuant to Section 53327 of the Act, the election shall be conducted by messenger or mail-delivered ballot pursuant to Section 4000 of the California Elections Code. This Council hereby finds that paragraphs (a), (b) and (c) (1) of Section 4000 are applicable to this special election.
4. Ballot. As authorized by Section 53353.5 of the Act, the issues described in Section 1 above shall be combined into a single ballot measure, the form of which as attached hereto as Exhibit “A” is hereby approved. The City Clerk is hereby authorized and directed to cause a ballot, in substantially the form of Exhibit “A”, to be delivered to each of the qualified electors of the CFD. Each ballot shall indicate the number of votes to be voted by the respective landowner to which the ballot pertains. Each ballot shall be accompanied by all supplies and written instructions necessary for the use and return of the ballot. The envelope to be used to return the ballot shall be enclosed with the ballot, have the return postage prepaid, and contain the following: (a) the name and address of the landowner, (b) a declaration, under

penalty of perjury, stating that the voter is the owner of record or authorized representative of the landowner entitled to vote and is the person whose name appears on the envelope, (c) the printed name, signature and address of the voter, (d) the date of signing and place of execution of the declaration pursuant to clause (b) above, and (e) a notice that the envelope contains an official ballot.
5. Waivers. This Council hereby further finds that the provisions of Section 53326 of the Act requiring a minimum of 90 days following the adoption of the Resolution of Intention to Annex to elapse before the special election are for the protection of the qualified electors of the CFD. There is on file with the Clerk a written waiver executed by all of the qualified electors of the CFD allowing for a shortening of the time for the special election to expedite the process of annexation of the CFD and waiving any requirement for notice, analysis and arguments in connection with the election. Accordingly, this Council finds and determines that the qualified electors have been fully apprised of and have agreed to the shortened time for the election and waiver of analysis and arguments, and have thereby been fully protected in these proceedings.
This Council also finds and determines that the City Clerk has concurred in the shortened time for the election. Analysis and arguments with respect to the ballot measures are hereby waived, as provided in Section 53327 of the Act.
6. Accountability. Under Section 50075.1 of the Government Code, the following accountability provisions shall apply to the special taxes: (a) the providing of services in addition to those presently provided within the CFD, all as defined in the Resolution of to Annex, shall constitute the specific single purpose; (b) the proceeds shall be applied only to the specific purposes identified in (a) above; (c) there shall be created special account(s) or funds(s) into which the proceeds shall be deposited; and (d) there shall be caused to be prepared an annual report if required by Section 50075.3 of the Government Code.

Based on review of building permit records for property within the CFD, the Administrator shall determine which Parcels in the CFD are Developed Property for purposes of levying the Special Tax pursuant to Section D below. For Single Family Attached Property, Multi-Family Property, MicroUnit Property, and Hotel Property, the number of Units shall be determined by referencing the condominium plan, apartment plan, site plan or other development plan for the property. In any Fiscal Year, if it is determined that (i) a parcel map for a portion of property in CFD No. 2014- 2 was recorded after January 1 of the prior Fiscal Year (or any other date after which the Assessor

Second: If additional revenue is needed after the first step has been completed, the Special Tax shall be levied proportionately on each Parcel of Taxable Public Property up to 100% of the Maximum Special Tax that would have applied to the Parcel had the Parcel not become Public Property until the amount levied is equal to the Special Tax Requirement for the Fiscal Year.
