ISSUE:

The City Council’s approval is required to approve the
first reading of Ordinances amending the monthly salary for the Mayor and City Councilmembers.

RECOMMENDED ACTION:

ADOPT an ordinance (second reading) amending the
monthly salary for City Council members; and ADOPT an
ordinance (second reading) amending the monthly salary
for the Mayor – Human Resources Department

DISCUSSION:

The compensation of the City of Richmond’s elected officials is governed by the City Charter. The Mayor’s compensation was established in accordance with Section 6 of Article III-A of the City Charter and was increased following the adoption of Ordinance AGENDA

The Councilmembers’ compensation was established in accordance with Section 4 of Article III of the City Charter and Ordinance 388 and was increased following the adoption of Ordinance No. 13-00 in 2000 and Ordinance No. 14-07 and Ordinance No. 24-07 in 2007.

The City of Richmond’s elected officials have not received a cost-of-living compensation increase since 2007. The current monthly salary for the Mayor is $3,875 and the current monthly salary for Councilmembers is $1,402.50 (See Attachment 3 - Ordinance No. 24-07 N.S.; Ordinance No. 32-07 N.S.; and Ordinance No. 14-07 N.S.).

Given the substantial increase in the cost of living in the Bay Area since the last salary increase in 2007, and to make the City’s elected officials’ compensation equitable and commensurate with comparable cities (See Attachment 1 - Bay Area and Contra Costa Cities Compensation Survey), an increase of five percent per year, non-compounding for sixteen (16) years which is the maximum allowed per California Government Code section 36516 [this is an 80% increase (5% * 16yrs = 80%)], as recently amended by Senate Bill No 329. Government Code section 36516 is being used as a guideline for the proposed compensation increase.

The following table shows a comparison between the Mayor’s and Councilmembers’ current and proposed salaries.

NEXT STEPS:

WHEREAS, the compensation of the City of Richmond’s elected officials is governed by the City Charter; and

WHEREAS, the Councilmembers’ compensation was established in accordance with Section 4 of Article III of the City Charter and Ordinance 388 and was increased following adoption of Ordinance No. 13-00 in 2000 and Ordinance No. 14-07 and Ordinance No. 24-07 in 2007; and

WHEREAS, the City of Richmond’s elected officials have not received a cost-of-living increase since 2007; and

WHEREAS, there has been a substantial increase in the cost of living in the San Francisco Bay Area since the last salary increase in 2007; and

WHEREAS, to make compensation for the Councilmembers equitable and commensurate with comparable cities, an increase of five percent per year, non-compounding for sixteen (16) years is appropriate. This amount is the maximum allowed per California Government Code section 36516, recently amended by Senate Bill No. 329, which serves as a guideline for the proposed increase; and

WHEREAS, the California Legislature passed SB 329 as acknowledgement of the important work of local governments, as well as the time and dedication that elected public service requires; and

WHEREAS, the City Council of the City of Richmond wishes to modify the salary compensation for the Councilmembers in accordance with the City Council findings set forth above.

The City Council of the City of Richmond does ordain as follows:

SECTION 1. Section 1 of Ordinance No. 14.07 is hereby amended to read as follows:

“Section 1. The City of Richmond shall pay to each member of the City Council a total monthly salary in the amount of Two Thousand Five Hundred Twenty-Four and 50/100th dollars ($2,524.50). Included in said monthly salary is the amount of Fifty and no/100ths dollars ($50.00) which each member of the City Council is authorized to receive by virtue of Ordinance No. 388, adopted on July 19, 1915.”

SECTION 2. If any section, subsection, subdivision, paragraph, sentence, clause or 211

phrase of this Ordinance is for any reason held by to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance irrespective of the unconstitutionality or invalidity of any section, subsection, subdivision, paragraph, sentence, clause or phrase.

SECTION 3. Effective Date. Ordinance becomes effective 30 days after its final passage and adoption.

Existing law authorizes a city council to enact an ordinance to pro vide each member of the city council a salary based upon the population of the city, as specified. Existing la w authorizes that amount to be increased by the city council by an amount that does not e xceed 5% for each calendar year from the operati ve date of the last adjustment of the salary that is in effect when the increase is enacted. Existing law provides for the procedures by which a city may enact ordinances.

This bill would increase the maximum amount of salary, based upon the population of the city, that may be approved by an ordinance passed by the city council, as specified. The bill w ould authorize the salary of council members to be increased beyond the specified maximums to an amount not exceeding the greater of either 5% for each calendar year from the operative date of the last adjustment of the salary in ef fect when the ordinance or amendment is enacted, or an amount equal to inflation since January 1, 2024, based upon the California Consumer Price Inde x, which shall not exceed 10% for each calendar year. The bill would require the city council to consider the adoption of an ordinance to increase council member compensation in open session during at least 2 regular meetings of the city council.

The people of the State of California do enact as follows:

SECTION 1. The Legislature finds and declares all of the following:
(a) The compensation schedule for general la w cities has not been adjusted since 1984, meaning that city council compensation has not k ept pace with inflation.
(b) Allowing cities to adjust their compensation for inflation since 1984 may help city councils become more diverse because increased compensation can help individuals from across different income levels receive sufficient income from their service to help ensure that they can continue to serve the public and support their families.

SEC. 2. Section 36516 of the Government Code is amended to read:

36516. (a)  (1)  A city council may enact an ordinance pro viding that each member of the city council shall recei ve a salary based on the population of the city as set forth in paragraph (2).
(2)  The salaries approved by ordinance under paragraph (1) shall be as follows:
(A)  In cities up to and including 35,000 in population, up to and including nine hundred fifty dollars ($950) per month.
(B)  In cities over 35,000 up to and including 50,000 in population, up to and including one thousand two hundred seventy-five dollars ($1,275) per month.
(C)  In cities over 50,000 up to and including 75,000 in population, up to and including one thousand six hundred dollars ($1,600) per month. (D)  In cities over 75,000 up to and including 150,000 in population, up to and including one thousand nine hundred dollars ($1,900) per month. (E)  In cities over 150,000 up to and including 250,000 in population, up to and including two thousand five hundred fifty dollars ($2,550) per month. (F)  In cities over 250,000 population, up to and including three thousand two hundred dollars ($3,200) per month.
(3)  For the purposes of this subdivision, the population of a city shall be determined by the last preceding federal census, or a subsequent census, or estimate validated by the Department of Finance.
(4)  The salary of council members may be increased beyond the amount provided in this subdi vision by an ordinance or by an amendment to an ordinance, but the amount of the increase shall not e xceed the greater of either of the following:
(A)  An amount equal to 5 percent for each calendar year from the operative date of the last adjustment of the salary in ef fect when the ordinance or amendment is enacted.
(B)  An amount equal to inflation since January 1, 2024, based upon the California Consumer Price Inde x, which shall not e xceed 10 percent for each calendar year.
(5)  No ordinance shall be enacted or amended to provide automatic future increases in salary.
(b)  Notwithstanding subdi vision (a), at an y municipal election, the question of whether city council members shall receive a salary for services, and the amount of that salary, may be submitted to the electors. If a majority of the electors v oting at the election f avor it, all of the council members shall receive the salary specified in the election call. The salary of council members may be increased beyond the amount provided in this section or decreased below the amount in the same manner.
(c)  Unless specifically authorized by another statute, a city council may not enact an ordinance providing for compensation to city council members in excess of that authorized by the procedures described in subdivisions (a) and (b). For the purposes of this section, compensation includes payment for service by a city council member on a commission, committee, board, authority, or similar body on which the city council member serv es. If the other statute that authorizes the compensation does not specify the amount 96 — 2 — Ch. 27

of compensation, the maximum amount shall be one hundred fifty dollars ($150) per month for each commission, committee, board, authority , or similar body.
(d)  Any amounts paid by a city for retirement, health and welf are, and federal social security benefits shall not be included for purposes of determining salary under this section, pro vided that the same benefits are available and paid by the city for its employees.
(e)  Any amounts paid by a city to reimburse a council member for actual and necessary expenses pursuant to Section 36514.5 shall not be included for purposes of determining salary pursuant to this section. (f)  A city council member may w aive any or all of the compensation permitted by this section.
(g)  (1)  For the purposes of this section, a city council shall consider the adoption of an ordinance to increase compensation in open session during at least two regular meetings of the city council.
(2)  At the first meeting, the city council shall present the proposed ordinance, which shall include findings demonstrating the need for the increased compensation. The ordinance shall not be adopted at the first meeting.
(3)  At least seven days after the first meeting, the city council shall hold a second meeting to consider whether to adopt the ordinance.

DISCUSSION:

The City of Richmond proclaims January 27, 2025, as International Holocaust Remembrance Day, honoring the millions of individuals who perished during the Holocaust, including six million Jews and countless others persecuted by the Nazi regime. This day marks the anniversary of the Soviet Red Army’s liberation of Auschwitz-Birkenau, a symbol of the horrific genocide that targeted Jews, Romani people, LGBTQ+ individuals, disabled persons, and political dissidents. The City of Richmond urges its residents to reflect on these atrocities, educate themselves about the Holocaust, and recognize the importance of confronting and preventing current and future genocides. By committing to combat anti-Semitism, hatred, and injustice in all forms, Richmond affirms its responsibility to act against the early warning signs of AGENDA

INTERNATIONAL HOLOCAUST REMEMBRANCE DAY
January 27th, 2025

WHEREAS, International Holocaust Remembrance Day is observed annually on January 27th, the anniversary of the Soviet Red Army liberation of Auschwitz-Birkenau, the largest Nazi concentration and death camp; and

WHEREAS, the Holocaust was the horrific state-sponsored, systematic persecution and annihilation of six million Jewish people by the Nazi regime and its collaborators between 1933 and 1945; and

WHEREAS, millions more, including Romani people, the LGBTQ+ community, disabled individuals, Polish and Soviet civilians, political dissidents, and other groups, were also brutally targeted by the Nazi regime; and

WHEREAS, it is crucial to honor the memory of those who were systematically murdered, to acknowledge survivors and their stories, and to pay tribute to the international coalition who bravely fought against the Nazi regime; and
WHEREAS, the City of Richmond recognizes the importance of remembering both the early warning signs and atrocities of the Holocaust, as it is essential to ensure that genocide never occurs again; and

WHEREAS, the City of Richmond encourages all residents to commemorate this day, to continue educating themselves about the Holocaust, and to remain committed to building a community that combats anti-semitism and hatred in all its forms and promotes human dignity and justice; and

WHEREAS, this day provides an opportunity for reflection on the moral responsibilities of individuals, societies, and governments to prevent genocide and to condemn it vociferously when it occurs.

BLACK HISTORY MONTH

IN THE CITY OF RICHMOND

WHEREAS, the City of Richmond, California, recognizes February 2025 as Black History Month, a time to honor the rich history, culture, and contributions of African Americans; and

WHEREAS, African Americans have played a vital role in the history of Richmond, contributing significantly to its economic, cultural, and social development; and

WHEREAS, Richmond's history is deeply intertwined with the African American experience, from the migration of Black workers during World War II to work in the shipyards, significantly shaping the city's demographics and culture; and

WHEREAS, the city acknowledges the historic struggles and achievements of African Americans, including overcoming barriers of segregation and discrimination to achieve greater equality and justice; and

WHEREAS, Richmond has been home to notable African Americans, such as Betty Reid Soskin, the oldest active ranger in the National Park Service and a vital storyteller of African American wartime experiences; and

WHEREAS, the city recognizes the importance of educating its citizens about the contributions of African Americans in Richmond and across the nation, fostering a deeper understanding and appreciation of their history and achievements; and

WHEREAS, Black History Month is an opportunity for all residents of Richmond to reflect on the past and inspire future generations to make their own contributions to the city and nation.

NOW THEREFORE, I, Eduardo Martinez, Mayor of the City of Richmond, California, do hereby proclaim February 2025 as Black History Month in Richmond and encourage all citizens to participate in events and activities that celebrate and recognize the contributions of African Americans to our city and nation.

DISCUSSION:

On February 28, 2023, the City of Richmond entered into an agreement with Flock Safety for Automated License Plate Reader (ALPR) equipment, and on September 19, 2023, staff requested additional funding to deploy Flock Closed-Circuit Television (CCTV) cameras that have features such as Pan Tilt Zoom (PTZ), to replace its aging Axis CCTV system.

Police Department staff requests additional funding to expand its Automated License Plate Reader and CCTV program to include City facilities, such as the Corporation Yard, Employment and Training building, libraries, parks, recreation centers, Civic Center Plaza, etc.; and will install additional Flock cameras on city streets to combat illegal dumping, sideshows, encampments, etc.

To enhance public safety, with additional funding, Police Department staff would like to purchase two mobile CCTV trailers for temporary assignments at special events or hotspot locations, add additional software required to support the camera expansion, add a Flock OS fusion center that will allow Police Department staff to monitor all cameras from a secure location at the Police Department and replace the current CCTV room. Additionally, funding will be used for the replacement of damaged equipment because of theft and/or vandalism. On average additional cameras add roughly $2,800 to $3,800 (depending on the type) to the ongoing annual fees, and replacement costs vary based on the cost of the hardware and labor.

As cameras are deployed, Police Department staff evaluate their efficacy to determine if the position and location are a good fit. Since some locations are dynamic and have multiple ingress and egress roads, pedestrian crossings, undeveloped areas, and hotspots for illegal dumping, etc., occasionally additional locations are identified only after installing the planned camera. Adding additional funds to the contract will allow flexibility to quickly adapt to intersections of concern, parks, city properties, etc. to ensure coverage is complete and that no camera gaps in and out are discovered and/or exploited.

Police Department staff will be responsible for the implementation of cameras, but the responsibility for funding and payment will remain with the Department making the request for additional cameras.

5. City of Richmond Business License Active Status Maintained. Pursuant to Municipal Code Section 7.04.030, the Contractor must maintain its City of Richmond business license for this Contract Amendment to be deemed to be in effect.

6. Insurance Coverage Updated and Maintained. Pursuant to the Original Contract, the Contractor shall provide the City with updated insurance certificates, and the Contractor shall maintain insurance coverage, for this Contract Amendment to be deemed to be in effect.
