Whitney Park Pump Track Design Review
Date:

June 27, 2023
Submitted By:

Kevin Huntzinger, Director of Parks and Recreation
Department:

Parks and Recreation
Recommendation:

Review and Approve the Final Design for the Whitney Park Pump Track and Prioritize the Project Components.

Background:

On March 10, 2021, the pump track concept was presented to the Parks, Recreation and Arts Commission for consideration and discussion. After several meetings and further discussion with stakeholders, the Commission recommended that staff bring the pump track concept to the City Council, which was done on May 25, 2021. Following the pump track concept presentation, the City Council directed staff to research basic feasibility, potential funding sources, and locations. On July 27, 2021, staff brought the site evaluation report to City Council for consideration. The City Council determined that Whitney Community Park was the best-suited location, for a pump track, given its dedicated funding source and existing infrastructure, including surrounding bike trails and storm drain connectivity. The City Council then directed staff to prepare a Request for Proposals for Design Services.

The City released a Request for Proposals (RFP), on April 11, 2022, to obtain design services for the Whitney Park Pump Track Project. The City received one qualified response from American Ramp Company (ARC), which was evaluated on factors set forth in the RFP.

American Ramp Company was interviewed by a committee consisting of the City Manager, Parks and Recreation Director, Parks and Recreation Manager, Administrative Analyst, and two of the Parks, Recreation and Arts Commissioners. Staff ultimately determined the proposal submitted by ARC was sufficient and began to negotiate a contract for pump track design services.

On July 26, 2022, City Council adopted Resolution No. 2022-162, authorizing the City Manager to execute a contract with American Ramp Company for professional design services for an asphalt pump track within the undeveloped park space at Whitney Community Park (Attachment 2). After receiving recommendations and feedback from City staff, the Parks, Recreation and Arts Commission, and the Rocklin Bike Coalition, ARC provided the City a final design concept for the Whitney Park Pump Track (Attachment 1). Along with the Item Number 5.A

711
design, staff requested separate cost estimates for the project components. This will allow the City to select the features that are considered to be a high priority while ensuring the project's budget is maintained. The breakdown of estimated costs is provided on the final page of Attachment 1, and summarized here:

Pump Track: $609,000
Bicycle Playground: $253,858
Jump Line (Dirt Trail): $213,278
Jump Line (Asphalt Trail): $393,278
P3 50/50 + Mow Strip: $78,264
P3 Mow Strip only: $27,098
Parking Lot: $136,800-$171,000
Benches: $4,500/each
Fixit Bike Repair Station: $3,000/each
Shelter: $45,000-$55,000

The Parks and Recreation Commission reviewed ARC's final design concept at their meeting on June 14, 2023. The Commission discussed two recommendations to bring forward to the City Council. The first and highest priority includes the pump track, P3 50/50 + mow strip, benches, and an ADA path from the existing parking lot or bike trail. The approximate cost is $742,000. The next and second priority includes the pump track, P3 50/50 + mow strip, bicycle playground, and an ADA path from the existing parking lot or bike trail. The approximate cost is $986,552. The P3 50/50 + mow strip is an alternate to natural turf and irrigation around the interior areas of the asphalt pump track, along with the exterior mow strip surrounding the outside edges. This product is similar to the rubberized play surface found in some playground areas, such as Willard Park.

Neither Commission recommendation includes the parking lot. The Commission's recommendation of an ADA path from the existing parking lot or bike trail is to ensure ADA access to the pump track without funding the parking lot at this time. The approximate cost for the ADA path is $30,000.

After thorough review and consideration of future development at Whitney Community Park, staff recommends funding the pump track, P3 50/50 + mow strip, and the parking lot. The approximate cost for these amenities is $847,000. Staff has identified the parking lot as a necessity for the current project while satisfying future needs as the City continues to develop Whitney Park Phase II. Parks and Recreation staff also support the installation of the P3 50/50 + mow strip to limit ongoing maintenance costs and eliminate upfront project expenses, including the installation of irrigation and other necessary infrastructure to support natural turf and maintenance access. It is a priority for staff to utilize the dedicated Northwest Rocklin Community Park Fee funding source to install the P3 50/50 + mow strip, rather than increasing annual maintenance cost in CFD #5 to maintain additional turf and landscape in the future.

Staff recommends the City Council approve the pump track design, approve the includes of the pump track, P3 50/50 + Mow Strip, and parking lot as Bid Items, and prioritize the remaining features as Bid Alternates. By prioritizing Bid Alternates, staff can include all items in the Bid Documents, and if bid rates are lower than the cost estimate, staff can add in alternate items in priority order.

712
Fiscal Impact:

A budget of $920,000 in the Northwest Rocklin Community Park Fee Fund (Fund 307) was approved for the project as part of the FY 2022/23 Annual Budget. The design costs totaled $67,300, with $852,700 remaining for project construction.

Commemorative Tree and Bench Donation Appeal
Date:

June 27, 2023
Submitted By:

Kevin Huntzinger, Director of Parks and Recreation
Department:

Parks and Recreation
Recommendation:

Reject the Commemorative Tree and Bench Donation Application Appeals Submitted by Barry Goodwin
Background:

As the Parks and Recreation Department began to receive an increased number of requests for the installation of trees and benches in City parks, it became evident that it would benefit the City to adopt a policy to regulate and manage the requests. On January 26, 2021, the City Council approved the establishment of a
"two by two by two" committee, with the task of
creating a tree and bench donation program and policy. The committee consisted of two members each from the City Council, Parks Recreation and Arts Commission, and Community Recognition Committee. The committee researched other municipalities in the area with similar programs and used key components to build the framework for the Parks and Recreation Tree and Bench Donation Policy.

On December 14, 2021, the City Council adopted Resolution No. 2021-240, approving the Tree and Bench Donation Policy (Attachment 1). Page 3 of the policy identifies what language can be included on the donation plaque. Since the policy’s approval, the Parks, Recreation and Arts Commission has approved several tree and bench donation applications using the policy as a guide for their decisions.

Mr. Barry Goodwin submitted two separate tree and bench donation applications, which were reviewed at the Parks, Recreation and Arts Commission (PRAC) meetings on August 10, 2022 and September 14, 2022.

The application that was reviewed at the August 10, 2022 PRAC meeting was rejected by the Commission because the third line of the plaque listed a date range. The policy requires that the third line of the plaque list the date of donation. The details of Mr. Goodwin's request are below.

The application that was reviewed at the September 14, 2022 PRAC meeting was rejected by the Commission because all three lines of the requested plaque verbiage did not meet the requirements of the policy. The details of Mr. Goodwin's request are below.

She Defended These Goals
Line Two:

Line Three:

On September 15, 2022, Mr. Goodwin appealed the two decisions (Attachment 2). Since the appeals have been filed, Parks and Recreation staff have been working with the City Clerk's Office and the City Manager's Office to develop a process for the appeals to be considered by City Council.

Staff recommends the City Council reject the appeals submitted by Mr. Barry Goodwin, as they are not consistent with the adopted Tree and Bench Donation policy.

Fiscal Impact:

There is no fiscal impact associated with the staff recommendation.

Tree and Bench Donation Policy 2022

Parks and Recreation Department
Tree and Bench Donation Policy

The City Council recognizes the need to promote community involvement and active participation in quality of life components throughout the community, and the need to establish a fair, equitable, and uniform procedure by which trees and benches may be donated to the City for installation in City parks. This policy establishes criteria for donations to assure area compatibility, attractiveness, usefulness, and sustainability of maintenance. Each donation considered for inclusion in the City's parks system will be subject to the limitations and guidelines for each particular area as established by the City’s Parks and Recreation Department.

I) Acceptance of Donations

1) All donation applications for the donation of trees and park benches to the City must be made on the form maintained by the Department of Parks and Recreation.

2) Based on the value of the donation and availability of appropriate property to install the donation, City staff will revie w the acceptability of any donation and determine if the benefits to be derived warrant acceptance of the donation. At a minimum, any monetary donation for a tree or bench shall cover the entire cost of purchasing and installing the item, at current market value based on the time of approval of the donation, as well as any other maintenance costs required below.

3) Criteria for evaluation includes consideration of any initial expenditure required in order to accept the donation, the community benefit to be derived from the donation, and, with respect to benches, the potential and extent of the City's obligation to maintain a donated bench for a minimum of 10 years. Unless otherwise specified in this policy, after 10 years, or at the end of the donated item's useful life, as determined by the City, the donated item may be removed or replaced by the City.

4) The cost of a park or bench donation shall also include a maintenance fee equal to 50% of the estimated 10-year maintenance cost of the donated tree or bench (including the plaque), paid for in full by the donor at the time of the donation. This maintenance fee is in addition the cost and installation of the donated item.

5) If, during the application phase, the Director of Parks and Recreation determines that there are no suitable or available locations for the donation, or if the donor only wants to make a donation for installation at an unavailable location, the Director of Parks and Recreation shall reject the donation application.

6) If a suitable general location for the donation exists, the donor is amenable for the item to be installed at that general location, and donor is willing to fund the donation amount required to install and maintain the donation, as required by this policy, the Director of Parks and Recreation shall submit the donation application to the Parks, Recreation and Arts Commission (“PRAC”) for review and approval. Pursuant to Rocklin Municipal Code Section 2.44.110, the PRAC is hereby responsible for reviewing and approving all tree and bench donations to the City, including the wording of any plaque to be attached to a donated bench, within the standards outlined in this policy. Any wording of a plaque approved by the PRAC shall be considered government speech and an action reflective of the view of the City Council.

7) Within fifteen (15) calendar days of the approval of the donation by the PRAC, the donor shall enter into a donation agreement with the City, subject to the review and approval as to form by the City Attorney. The Director of Parks and Recreation is hereby authorized to execute the donation agreement and to accept the donation on behalf of the City.

8) All donations accepted by the City shall become City property and shall be open and available for general public use in a manner consistent with the City of Rocklin Parks and Recreation rules, policies, and practices. At no point should the acceptance of a donation to the City be construed as the creation of a public forum.

II) Types of Donations

1) Trees

A) Donations for trees may be used to install a tree or trees at a City park(s) recommended by the Director of Parks and Recreation and approved by the PRAC.

B) Tree donations are limited to specific species that match the landscape in park locations. The type of tree to be installed shall be at the sole discretion of the City, as recommended by the Director of Parks and Recreation and approved by the PRAC.

C) Donors may request a location for the donated tree, but the City shall make the final determination based on various factors including, but not limited to, landscaping, irrigation necessity, safety, viability of the tree, or other determinative factors. The PRAC shall approve the general location for the installation of the donated tree, with the Director of Parks and Recreation approving the specific location within the approved general location based on the above factors.

D) Tree donations shall not be memorialized with a plaque or other fixture.

E) The City shall not assume responsibility for replacement of a donated tree for any reason at any time.

F) The City shall not guarantee the health, vitality, or existence of the tree for any amount of time.

G) The City shall reserve the right to remove or relocate a donated tree if the location of the donated tree is in conflict with any future park improvement project(s) at the location of the donated tree or if the donated tree is creating a potential or current health or safety hazard. The decision to remove a tree for the aforementioned reasons shall be at the sole discretion of the Director of Parks and Recreation.

2) Benches

A) Donations for a bench shall be used to install a bench at one of the City’s various parks as recommended by the Director of Parks and Recreation and approved by the PRAC.

B) The PRAC, with the assistance of the Park s and Recreation Department shall designate the type, style, design, and placement of benches to be donated to the City and placed on City property.

C) An inventory of all available bench locations will be maintained by the City.

D) Donors may request a loc ation for the donated bench, but the City shall make the final determination based on various factors including, but not limited to, accessibility, maintenance impacts, safety, or other determinative factors. The PRAC shall approve the general location for the installation of the donated bench, with the Director of Parks and Recreation approving the specific location within the approved general location based on the above factors.

The PRAC shall deny any plaque language it determines would be inappropriate for public display and/or that would attract vandalism. All content on approved plaques are expressive actions reflecting the views of the City Council and in no circumstance shall a plaque constitute a public forum.

(i) If the PRAC denies the donor’s proposed language, but approves alternative language, the donor may accept the alternative language and move forward with the donation without having to reapply for approval from the PRAC.

G) Donated benches and plaques are guaranteed for a minimum of ten (10) years following installation or “useful life”, as determined by the City, whichever comes first.

H) If a donated bench or plaque is damaged or stolen within the period set forth in Section II(2)(G) of this policy, the City shall repair or replace the item one time at no additional cost to the donor.

Additional replacements of the bench or plaque within the period set forth in Section II(2)(G) shall require another monetary donation by the donor in the amount set forth by the Director of Parks and Recreation at the time of installation of the subsequent bench or plaque. Installation of an additional bench shall not extend the original period set forth in in Section II(2)(G). If the donor does not furnish the funds to replace the damaged bench within five (5) calendar days of the City providing notice of such damage requiring repair, the bench and/or plaque shall be removed. Kevin,

As I expressed in the Parks, Recreation, and Arts Commission meeting yesterday; I would like to officially appeal the commission’s decision to support your suggestion to reject my application for a third line on the primary plaque, and a second plaque altogether, at the base of Julia Marie Goodwin’s bench.

Please let me know what additional steps I need to take in order to appeal this ruling.

Respectfully,

Barry Goodwin

Public Financing Authority of the City of Rocklin Adopting a Budget for Fiscal Year 2023/24

Recommendation:

Adopt a Resolution of the Public Financing Authority of the City of Rocklin Adopting a Budget for Fiscal Year 2023/24.

Background:

On December 13, 1994, the City of Rocklin (City) and the former Rocklin Redevelopment Agency formed a joint powers authority, the Rocklin Public Finance Authority (RPFA). In 1999, the RPFA issued revenue bonds in the amount of $14,910,000. The proceeds from the revenue bonds were used to purchase special tax bonds issued by the City for and on behalf of three Community Facilities Districts (CFD No. 6, CFD No. 8 and CFD No. 9). In 2003, the RPFA issued revenue bonds to refund the 1999 RPFA revenue bonds.

In 2017, the RPFA entered into a special tax revenue refunding loan agreement in the amount of $5,000,077 to refund the remaining 2003 RPFA refunding revenue bonds. The RPFA holds the debt of CFD No. 6, CFD No. 8 and CFD No. 9 as an investment. The investment balance is currently $1,526,806. The loan will be paid off in Fiscal Year 2025/26.

The budget for the RPFA is prepared and presented to the RPFA Board (Board) on an annual basis. The Board’s approval of the RPFA budget provides staff with the authority to pay the RPFA’s expenses. The annual debt service payments on the 2017 RPFA special tax revenue refunding loan agreement are the only expenditures of the RPFA. Debt service payments received from CFD No. 6, CFD No. 8 and CFD No. 9 are the source of funds used for the 2017 RPFA special tax revenue refunding loan agreement debt service payments. Interest earned from the CFD No. 6, CFD No. 8 and CFD No. 9 investment is the primary source of revenue for the RPFA.
