governments charge for essential services. A summary of the Proposition 218 Process is outlined as follows:
• Notice to Property Owners: The agency must mail a written notice to all affected property owners at least 45 days before the public hearing. The notice must include:
o The proposed rates or changes
o The basis for the calculation
o The date, time, and location of the public hearing
o Instructions on how to file a written protest
• Public Hearing: A public hearing must be held at least 45 days after mailing the notices.

The hearing provides an opportunity for the public to comment on the proposed rates and for the agency to respond.
• Protest Counting: If a majority (50% + 1) of affected property owners submit written protests before the close of the hearing, the rate increase cannot be adopted. Protests must be in writing and include the parcel address and a signature. • Rate Adoption: If a majority protest is not received, the agency may adopt the proposed rates through a vote of the governing body (e.g., City Council). • Customer Rate Notification: The City will be notifying customers of the new water and sewer rates through a bill insert included with utility bills. In addition, a separate mailed notice will be sent to ensure all customers are informed of the changes. These notices will provide details about the new rates and when they will take effect.

Receive a Presentation on the Initial Financial Plan of the Water and Sewer Rate Study and Provide Direction on the Proposed Rate Increase Implementation Process

Page 4 of 4 ends

BUDGET IMPACT:

The water and sewer utilities are operated as Enterprise Funds. As a result, both utilities must be self-sustaining and funded entirely from rates and fee for service charges that are separate and apart from the City’s General Fund. The financial plan as completed through the Water and Sewer Rate Study proposes revenue adjustments of 5% annually for the water utility and 3% annually for the sewer utility, which will provide adequate funding to maintain the City’s water and sewer service and provide revenues proportionate to the cost of providing these services.

The proposed annual increases account for annual inflation and projected cost of service increases. Revenues will increase annually proportionate to the needs to fully fund both operating and capital programs.

CONCLUSION:

It is recommended that the City Council receive the presentation on the initial financial plan developed as part of the Water and Sewer Rate Study, and provide direction on the proposed rate increase. Additionally, staff recommends that the City Council approve the proposed timeline for the completion of the rate study and associated public outreach efforts.
